When do you have to Vacate a Rental Unit in Ontario?

H

otels typically let you check in by 3 pm and ask you to check out by noon. This gives staff time to make the room ready for the next guest. Do the same sorts of rules apply when a tenant moves out of a rental unit? Will it make a difference if the owner is selling the home to someone who wants to move in on the same day? Here are the answers to those questions. Ontario tenancies are usually for a year, so if yours started on August 1, 2012, then it will end at 11:59 pm on July 31, 2013. However, if the tenant doesn’t give notice, the tenancy will automatically renew as a month-to-month arrangement, meaning the end of any term is the end of any month. If you have a month-to-month arrangement you must give 60 days’ notice before the end of your term. In the

above example, it would be the end of any month. For example, if today is April 8, 2013 and you pay rent on the first of every month, the earliest you can end your tenancy is June 30, 2013. You must leave before midnight on the last day, in this example, on the last day of the month. (If you pay your rent on the 15th of the month, then the end of your term would have been June 14th.) If you’ve bought a home or found another apartment, but can’t get in until July 1st, you may have no choice but to stay in a hotel or with friends overnight on June 30. You’d also have to store your belongings for a night. You have no right to stay until July 1, but if you have a good relationship with your landlord, he’ll probably let you stay until the morning, so long as you’re gone before noon. Remember, the landlord has to make sure that the unit is clean before

the new tenant takes over. It gets even more complicated if you are buying a property with a sitting tenant and you want to move in. If you schedule closing on the same day the tenant is supposed to leave, you may not get possession until late at night. Buyers and sellers should try to schedule the closing date so that it takes into account when the tenant will be leaving, unless separate arrangements can be made with the tenant to leave the unit earlier. This can be done by typically assisting the tenant to find another place to live. Landlords may run into a situation where an existing tenant does not leave on time, or even on the day that they are supposed to. If vacant possession is not given as promised and someone is waiting to move in, then the tenant who has been inconvenienced can sue for any costs incurred in storing their personal

effects and for hotel bills. In Ontario, apartments are not like hotels and tenants cannot be forcibly evicted. Landlords can consider inserting a clause in their lease that says if possession is delayed for any reason, the tenant only receives a rent credit for the days lost. Tenants should make sure to check whether special arrangements need to be made to reserve any elevators for moving purposes, especially in a condominium, which typically only permits moves to take place during specific times and only after timely notice has been given to the condominium management company. Real Estate Market Moving Toward More Balanced Market

T

he REALTORS® Association of Hamilton-Burlington (RAHB) reported the average sale price for all property types in March was 10.8 per cent higher than same month last year. There were 1170 property sales processed through the RAHB Multiple Listing Service® (MLS®) in the month of March, representing a 14.3 per cent decrease in sales from the same month last year. RAHB also reported a 9.7 per cent decrease in listings compared to the same month last year. “It’s certainly a quieter spring than we’ve had for the last three years,” said RAHB CEO Ross Godsoe. “We are seeing fewer listings and sales than average.” Seasonally adjusted* sales of resi-

dential properties were 8.4 per cent lower than the same month last year, with the average sale price up 2.9 per cent for the month. Seasonally adjusted numbers of new listings were 4.2 per cent lower than the same month last year. Actual overall residential sales were 14.7 per cent lower than the previous year at the same time. Residential freehold sales were 13.7 per cent lower than last year; the condominium market saw a decline in sales of 18.5 per cent. The average sale price of freehold properties showed an increase of 10 per cent over the same month last year, while the condominium market saw an increase of 7.5 per cent when compared to the same period last year.

The average sale price is based on the total dollar volume of all residential properties sold. Average sale price information can be useful in establishing long term trends, but should not be used as an indicator that specific properties have increased or decreased in value. The average days on market increased from 40 days to 44 days in the freehold market and decreased from 44 days to 43 for condominiums. “We seem to be moving toward a more balanced market,” noted Godsoe. “That will give buyers a bit more breathing room when they are looking for a home. From what the numbers say, however, buyers won’t be looking at paying less than they would have a year ago -

only a few of our areas are showing average sale prices that have gone down. ” Residential sales were down 13.1 per cent for the first quarter of the year when compared to the same period last year, while listings were down 6.3 per cent; average sale price rose 6.9 per cent for the quarter. Every community in RAHB’s marketing area has their own localized residential market. W

hen shopping for life insurance you face the same decision you must make when you're in the market for a new car: lease or buy? Those aren’t the words used for insurance, of course, but the concepts of term and permanent life insurance are similar to leasing and buying. Term insurance is like leasing a car. You purchase death benefits for a specified period—usually 5, 10 or 20 years. When the period is over, it’s like turning in the leased car. The deal is done and you walk away. Permanent insurance, on the other hand, is like buying the car you plan to drive forever. Permanent insurance stays in force as long as you live. It will pay a death benefit, and it accumulates a cash value, too. The two kinds of life insurance are appropriate for different situations. Term insurance is designed for those who are interested solely in a death benefit; for example, a young father who wants insurance so that his child will be able to afford college if Dad is not around to pay the bills. There is no cash value to this kind of insurance, so often the premiums are lower than they are for permanent insurance. But as the insured gets older, the premiums increase. Permanent insurance combines a death benefit with a cash value, or savings component, which grows tax-deferred. Many policyholders borrow from the cash value to pay for things such as a college education, or convert their cash value into a retirement fund. Because of the savings component, permanent life insurance may cost more than term life, especially at the beginning. But the

premium remains fixed for the life of the policy. Many people are familiar with the saying "buy term and invest the difference," which suggests going for the lower premiums and taking care of the savings component on your own rather than counting on the insurance policy for investment growth. With recent high returns in the stock market, many investments are growing faster than cash values. Various types of permanent insurance plans, however, do give the insured the option of deciding how the savings is invested. While term insurance often starts out cheaper, permanent life offers several advantages over a term policy, financial experts say. Because premiums don’t escalate, a permanent policy is more likely to be held until death and actually pay a death benefit than is a term policy, which can get quite expensive as the insured ages. And the death benefit will pass to beneficiaries tax-free. There’s a tax advantage to permanent life, because cash values will grow at a taxdeferred rate. With no cash value, there’s no tax advantage to term life. Besides, the "invest the difference" component of that adage is often ignored. If you go with cheaper term insurance, you should make a commitment to a regular savings and investment program. Canadian Homeowners don’t think they’ll be Mortgage-Free until Age 57

T

he average Canadian homeowner doesn’t think they’ll be mortgage-free until they’re 57 — two years longer than what they expected last year, a survey by CIBC suggests. The survey also found that half of those surveyed said other debt, from credit cards to lines of credit, have increased and impeded their ability to pay off their mortgage more quickly. “Our view would be that Canadians are taking a look at their broader finances and are working to pay down other debts first to reduce their interest costs,” said Colette Delaney, executive vice-president of mortgage, lending, insurance and deposit products at CIBC in an email. “Those with a growing amount of non-mortgage debt are less likely to be taking extra steps to pay down their mortgage, and this can lead to a longer payback period.” Of those who said they have taken on additional debt since buying a

home, only 11 per cent were able to make an extra payment on their mortgage last year. Meanwhile, 19 per cent of those who have not added to their debt loads since buying a home were able to make lump sum payments. The report released Friday also found those in British Columbia expected to be the oldest at 59 when they have paid off their mortgage, followed by those in Manitoba and Saskatchewan at 58. Elsewhere, the average expected age was 57 years old. Delaney said that the longer someone has to hold a mortgage may mean the less savings they have for retirement. “Being mortgage free sooner can help accelerate retirement savings, but carrying a mortgage into your late 50s can have the opposite effect and make it more challenging to reach your long term savings goals,” said Delaney.
