Have you explored Long Term Care coverage? Should you?

A

s a proud “Pentagenarian,” I now have more insurance than hairs on my head. I have medical insurance for my entire family, life insurance for my wife and myself, home owner’s insurance, auto insurance for three cars, disability insurance, malpractice, office liability, employee dishonesty insurance, data protection insurance for my computers, employment practices insurance and worker’s comp. Now I will need to buy one more type of insurance: Long Term Care (LTC) Insurance. It seems, with each decade of life, one begins to worry about the ever increasing possibility of catastrophic events that are completely out of our control. Although health insurance ranks as one of our biggest concerns and the most significant drain on our disposable income, the devastating financial consequences of long term care is a close second in my list of worries (page 7, Figure 1). The thought of having to live my final years in a nursing home that ends up draining all of my life’s savings makes me re-think Dr. Kevorkian’s philosophy! Just take a survey of your patients, friends and relatives and you will find most people are facing some sort of a long term care issue for one of their loved ones. Although the United States ranks 38th in the world for

Well, I find it quite apropos that this issue has the theme of long term care. As I was proof-reading Dr. Ackerman’s article, I couldn’t help but chuckle on his play on words / theme. So, of course, I continue the theme… The “health theme” of long term care is so very important, and one that begs consideration, planning and discussion. Dr. Malick has done a wonderful job pulling this information together for you. The “long term care” of your Society, one that Dr. Ackerman points out, is also important and guides our everyday planning, activities, policies and procedures here at the SDDS office. Now… my take on the phrase: “In for the long term.” I am nearing the 12th anniversary of being the Executive Director at SDDS. Della has been with SDDS for 11 ½ years, Melissa for nine years and Lisa for eight years. Long term for sure. We welcomed both Kristen and Liz this year — hopefully just the beginning of their LONG TERMS! My point? Consistency. Dedication. Commitment. I am proud of our staff. As I write this article, we have just finished the busiest 15 days of the year with Smiles for Kids, Midwinter Convention and our Bump Dinner. Our staff ALL worked extremely hard and efficiently to make all these events the best ever for our members, our community and our profession. For them, I am grateful. Of them, I am proud. To them, I publicly thank them for their consistency, dedication and commitment to SDDS and all of our members. Thank you Della, Melissa, Lisa, Liz and Kristen! It is an honor to work with such an amazing team! 

Summary of 2012 LTC Costs National Median Rate HOMEMAKER SERVICES (Licensed) Provides “hands-off” care such as helping with cooking and running errands. Often referred to as “Personal Care Assistants” or “Companions.” This is the rate charged by a non-Medicare certified, licensed agency.

Who Pays for Long Term Care? Medicare

Long Term Care Insurance

Before you purchase, make sure you can continue to pay the premiums. The premium you pay should not exceed 7% of your annual income.

• Medicare pays less than 10% of all nursing care • To qualify for Limited Medicare Nursing Home care, you must need skilled care only a professional (RN, PT, OT) can provide • After a 3-day covered inpatient hospital stay within a 30 day period for a related illness or injury, you pay the following for each benefit period: i. Long Term Care Insurance — Protection, Peace of Mind and Enhanced Quality of Life for You and Your Family

Have you thought about long term care and its eventual impact on you and your loved ones? If your answer is “no,” or “not recently,” you are not alone.

Look at it this way: barring an accident or illness, you are going to live a long life. Medical and biotechnological advancements virtually ensure that men and women who are now in their mid-40s to early 50s will live well into their 80s. Living well past the retirement years is something most of today’s working professionals can count on, but longevity can take a toll on both caregivers and finances.

What is long term care? Many people hear the words “long term care” and automatically think of a nursing home. The truth is, as you age, you may need help with everyday activities at home long before you need skilled nursing care. Most long-term care involves help performing “activities of daily living” (bathing, dressing, eating, using the toilet, transferring from bed to chair and vice versa), and these needs progress as one ages. Some individuals need care as their bodies start to weaken with age, even though they remain mentally sharp. Others need care as they lose cognitive function (dementia, Alzheimer’s), although their bodies remain healthy and vital. When a person’s needs can no longer be met at home, adult day care, a nursing home or another type of care facility becomes necessary.

Who will provide this type of care for you? Family members provide the majority of long-term care, with friends, neighbors and community services rounding out the picture. While you may be able to afford some of the care you will need down the road, Long Term Care Insurance guarantees that your savings, income and assets are protected, and keeps you in control of your future and your health care. If you have already been through care issues or are dealing with them now because of your own parents or grandparents, you can see the value firsthand of this type of policy. LongTerm Care Insurance does not replace the care family members give their loved ones — it supplements that care, and provides welcome respite from the more difficult aspects of in-home care (feeding, dressing, toileting) so that families can spend their time and energy on enjoyable interactions. When the time comes for more skilled nursing care or round-the-clock supervision, Long Term Care Insurance covers these costs as well. In-home nursing care, adult day care, a nursing facility or a residential care facility are all options that will become available to you. Also covered are professional care providers such as physical, occupational, respiratory or speech therapists, should you need them.

What are the costs of long term care? There is no way around it, long-term care can be extremely expensive. Unfortunately, your health insurance will not pay for long term care, and Medicare will not pay for

any dentists are focused on the day-to-day challenges of building and maintaining a successful dental practice. Thinking about their health situation well after retirement is one of the furthest things from their minds. However, just as building wealth, setting aside a nest egg and planning for retirement are critical components of your future quality of life and well-being, planning for long-term care is essential as well.

The truth is, if you take steps now to put a long-term care policy in place, you can purchase your policy at today’s lower rates, choose a policy that will adjust for inflation over the years and ensure that you have protected your life savings and your family’s assets when care becomes necessary.

difficult. This is due to unforeseen health issues that occur with the aging process. You could never know how much you have changed my life by just replying to my email. Even if for some reason the dentist doesn’t want to do it, you still have given me some hope, which I have not had in a very long time. I called everyone i knew and told them how cool you were; that you could have just ignored me like everyone else did… but you didn’t. I have even written emails and letters to the Ellen Degeneres show hoping she would answer back. (of course, I’m still waiting…) This means the world to me, more than you know. I called my grandmother who is very ill and told her. She cried and told me my mom would have been so happy. My mom always told me that she wished that I would get my teeth fixed, and I promised her one day I would. My mom passed away last January. I know she won’t get to see her wish come true, but it makes me happy that I get the chance to keep that promise to her. I owe you more then i can give but I am willing to do what ever I can to make it up to you. I was in shock to hear so many people wanted to help. you should Cal/OSHA to adopt changes to hazard communication regulation California employers will soon need to provide new hazard communication training to employees. The State is expected to finalize amendments to the regulation this summer. Employers must train employees specifically on the new label elements and safety data sheet format by Dec. 1, 2013. The amendments will make the State’s regulation as effective as its federal counterpart. The Federal Hazard Communication Regulation was amended March 2012 to conform to the United Nations’ Globally Harmonized System of Classification and Labeling of Chemicals. The Cal/OSHA Standards Board met last November to discuss proposed changes that will bring the State’s regulation in line with federal law. The meeting was the first opportunity California business, labor and safety organizations could provide comment on the state’s proposed changes. The agency seeks to make changes necessary to conform to federal law and to ensure state law is not weakened in the process. MAJOR CHANGES TO FEDERAL HAZARD COMMUNICATION REGULATION INCLUDE:

Hazard classification: Provides specific criteria for classification of health and physical hazards, as well as classification of mixtures. The term “classification” replaces the term “determination” used in the old regulation. Labels: Chemical manufacturers and importers are required to provide a label that includes a pictogram that conveys specific hazard information; a signal word that indicates the relative level of hazard severity; a hazard statement that describes the nature of the hazard; and a precautionary statement that describes recommended measures to take to minimize or prevent adverse effects resulting from exposure to the hazardous chemical. Safety Data Sheets: Must be done in a specified 16-section format and order of information. (Note the word “material” was dropped, therefore, the abbreviation “SDS” will be used instead of “MSDS.”) Once California has finalized amendments, CDA will have training materials and a revised sample Hazard Communication Plan available on cdacompass.com for members to use. Staff training may be conducted by a knowledgeable dentist or staff person using OSHA and CDA materials or by a consultant who specializes in this area. A thorough understanding of the new system by all staff is the goal of the required training. 16

HIPAA Compliance Checklist All California dental practices must comply with state and federal privacy laws. The Federal Health Insurance Portability and Accountability Act (HIPAA) requires “covered entities” to comply with standards for maintaining the confidentiality, integrity and availability of protected health information. “Covered entities” include healthcare providers who transmit patient health information electronically. A detailed compliance guide is available from the American Dental Association. The ADA Practical Guide to HIPAA Compliance: Privacy and Security (2010) can help you develop, or update, your office policies and procedures. It is strongly recommended you use the ADA guide with the checklist at right. The guide has sample forms and policies, and provides thorough discussions and considerations on how HIPAA compliance affects a dental practice. You should refer to the ADA guide for almost every item listed on this checklist. Unlike HIPAA, California privacy laws apply to all healthcare providers irrespective of whether a provider transmits patient information electronically. Compliance with the more restrictive element of overlapping laws is required. Many of HIPAA’s privacy requirements mirror existing patient privacy rights in California. Compliance with state and federal privacy laws requires specific recurring actions, plenty of documentation, and continual staff training. It is an ongoing process of assessment, implementation and training. This checklist is intended to provide an at-a-glance view of the compliance elements. HIPAA documentation can be maintained electronically or on paper. All HIPAA-related documents, including policies, training records, employee sanction records, patient authorization for records release form, and more must be maintained for at least six years. he U.S. Department of Labor (DOL) recently issued a final rule implementing t wo important expansions of the Family and Medical Leave Act (FMLA).

The updates: • Provide service members' families with FMLA leave for events related to service members' deployments. • Expand coverage given to current military family members to eligible families of veterans. • A new provision makes it easier for flight crew employees to be eligible for FMLA and use FMLA benefits.

Specifics The new FMLA rule implemented Congressional amendments to the FMLA permitting eligible workers to take up to 26 workweeks of leave to care for a current service member with a serious injury or illness. Congress also created qualifying exigency leave, which permits eligible employees to take up to 12 workweeks of leave for qualifying exigencies arising out of active duty or call to active duty in support of a contingency operation of a family member serving in the National Guard or Reserve. The final rule also implements amendments clarifying the application of the FMLA to

Dentists and Dental Offices: Make the Commitment Mercury-containing wastes can threaten our environment. Washed down the drain or otherwise improperly disposed of, mercury can find its way into Sacramento waterways and the environment. The Sacramento Regional County Sanitation District (SRCSD) is working to reduce discharges to the Sacramento River, and the dental community can be acknowledged for their help. SRCSD has partnered with the Sacramento Area Sustainable Business Program to develop a certification for qualified dentists that voluntarily take actions to prevent pollution. Qualified dentists and dental offices can become certified for FREE in three easy steps: 1. Implement: Complete the five certification requirements below. 2. Apply: Fill-out the online application at www.amalgamrecovery.com. 3. Become Certified: Receive a window placard and certificate to show patients and employees your commitment to environmental stewardship.

Certification Requirements:

• Install an ISO 11143 certified amalgam separator, and maintain it according to manufacturer instructions.

• Collect all scrap amalgam, teeth with amalgam restorations and amalgam waste from filters, screens, separators and traps, and recycle as universal waste or manage as hazardous waste.

• Do not rinse traps and vacuum filters — or flush amalgam waste — down the sink, drain or toilet. • Do not use bleach or chlorine-containing line cleaners on vacuum lines that service chairs where amalgam restorations or removals are performed. These line cleaners may dissolve amalgam waste that has been collected in traps or separators.

• Train staff on proper handling and disposal of mercury-containing and other hazardous wastes, such as x-ray fixer and sterilant waste.

Sacramento County Water Agency to provide fluoride to its customers soon.

S

acramento District Dental Society congratulates Sacramento County Water Agency (SCWA) who will soon be providing the benefits of water fluoridation to its customers. We at SDDS think it is a great service that will benefit all people; young or old, rich or poor. This is a day to celebrate as SCWA customers, all 180 thousand of them, join the 204 million people across the United States who already have optimally adjusted water fluoridation. A lot of hard work went into this day of celebration and I would like to take this opportunity to thank my colleague Dr. John Orsi who has been so instrumental in all efforts to fluoridate the entire Sacramento Region. His knowledge and commitment to this cause is second to none. I also want to recognize Dr. Kim Wallace who participated in every meeting and provided wise insights that were essential to our success. In addition, I want to single out Cathy Levering and the SDDS Board of Directors who have remained steadfast in their commitment to the goal of bringing the benefits of community water fluoridation to our entire region. Finally, I would like to acknowledge The American Dental Association www.ada.org/fluoride.aspx

First 5 Sacramento who made community water fluoridation a priority in their strategic plans for over 12 years and backed their words up with the millions of dollars in financial support that made it a reality. To my colleagues, I think this is a wonderful opportunity to provide reassurance and guidance to our patients about how this change in the fluoride concentration of the community water will benefit their oral health. You will rightly be perceived as the most trusted and knowledgeable health care professional to answer their questions. Please be aware that if your patient lives in the SCWA service area, which includes the following zip codes, you should discontinue systemic fluoride supplements (95624, 95639, 95655, 95690, 95742, 95757, 95758, 95829 and 95830). In addition, the use of topical fluoride applications should be also considered on an individual basis as determined by a caries risk assessment. I am certain that you already are well aware of the benefits of community water fluoridation but the following websites may be of help in answering your patients concerns. 

Are you up to speed on tax laws, potential deductions and other important business issues? In this monthly column, we will offer information pertinent to you, the dentist as the business owner.

More New Taxes in 2013 —

3.8% and 0.9% Medicare Tax From Dennis Nelson, CPA (SDDS Vendor Member)

W

hen the Patient Protection and Affordable Care Act was passed in 2010, two new taxes were legislated to help pay for the program. Along with the other tax increases that are effective in 2013, add the 3.8% and 0.9% Medicare tax. This 3.8% tax will apply to high income individuals and trusts. Married couples filing jointly who have net investment income and adjusted gross income in excess of $250,000 ($125,000 for married couples filing separately) will incur the tax. Single and Head of Household filers will also have this tax if they have net investment income and their adjusted gross income is in excess of $200,000. The 3.8% tax will apply to the lesser of net investment income or income in excess of these thresholds. Net investment income is interest, dividends, annuities, royalties, rents, income from passive activities and gains on sales of assets. Taxpayers may use capital losses to offset capital gains.

Tax exempt interest and retirement plan distributions are exempt. The tax will also apply to taxable gains on sales of principal residences, but not on the portion of the gain that is excluded.

Net income from S Corporations or other entities in which the doctor is working is not subject to this tax.

Net investment

This tax also applies to trusts and estates on the lesser of undistributed net investment income or the amount of adjusted total income at which the highest tax bracket begins (which for 2013, is projected to be $11,950). There is another new Medicare tax in 2013; this one is imposed on earned income. If your salary or self employment income exceeds $250,000 (joint filers), $200,000 (single or head of household filers) or $125,000 (married filing separately filers) you will be subject to this tax. Employers will be required to withhold the additional 0.9% tax once compensation exceeds
