of Swanton Land Records. The property is subject to the restriction that it may not be conveyed by the Grantee, Darin Rattee, his heirs and assigns unless it is conveyed as part of a conveyance of the lands of the said Grantee, known as 22 Andy Avenue (being Lot 24 of the Leduc Subdivision) acquired by deed dated June 28, 2002 and recorded in Volume 181 at Page 399. The purpose of this conveyance is to incorporate the within described 0.23 acres into Lot 24, increasing the size from 0.58 acres to 0.81 acres, as depicted on the aforementioned Lot Line Adjustment Map. Said lands and premises are subject to the terms and conditions of State of Vermont Deferral Permit No. D-6-1286 as set forth in State of Vermont Subdivision Permit No. EC6-1331 (corrected) dated July 19, 1988 and recorded in Volume 104 at Page 444 and State of Vermont Land Use Permit No. 6F0337 recorded in Volume 104 at Pages 124 & 395 of the Town of Swanton Land Records. Said Deferral Permit restriction is as follows: “In order to comply with the applicable state rules concerning potable water supplies and wastewater systems, a person shall not construct or erect any structure or building on the lot of land described herein if the useful occupancy of that structure or building will require the installation of or connection to a potable water supply or wastewater system, without first complying with the applicable rules and obtaining any required permit. Any person who owns this property acknowledges that this lot may not be able to meet state standards for a potable water supply or wastewater system and therefore this lot may not be able to be improved.” Subject to and benefitted by all rights of ways, easements, covenants, permits and rights of record. Reference is hereby made to the above instruments and to the records and references contained therein in further aid of this description.
