VILLAGE OF ENOSBURG FALLS NOTICE Adoption of Amendments to the Sewer Ordinance Pursuant to 24 V.S.A. §1972(a), the citizens of the Village of Enosburg Falls are hereby notified that, at a regular meeting held on June 26, 2012, the Village Trustees adopted certain amendments to the Sewer Ordinance, which are summarized below: 1. Various changes were made to modify certain definitions in Article 2. Significant changes include: i. Defining “Building Drain” and Building Sewer (those portions of the lines for which the landowner is responsible) as extending from the building to the edge of the municipal right of way. ii. Transition of the connection fee to an allocation fee. iii. Elimination of the service wye inspection fee. 2. Minor changes were made to Article 3, Abbreviations, to delete certain abbreviations no longer applicable to the Ordinance. 3. In Article 4, reference to Village responsibility for construction costs and expenses from the owner’s property line to the Village sewer line was deleted, and the required sewer connection proximity was reduced from 250 feet to 100 feet. 4. Certain terms were modified in Article 5 to update terminology with respect to sewer allocation. Significant changes include: i. Substitution of the term “Approval” for the term “Permit throughout the Ordinance. ii. A reduction in the life span of approved by unused sewer allocations issued prior to adoption of the Ordinance from three years to two years. iii. Changes to the application process for sewer capacity allocation. iv. A reduction in the time newly approved preliminary allocations remain valid from 120 days to 60 days, together with a one-time only extension up to one year. v. Deletion of restrictions on “financial hardship” provisions for the payment of sewer allocation fees. vi. A reduction in the life span of final connection approval by unused sewer allocations from three years to two years. 5. Changes were made to Article 6 to modify and update terminology and to streamline billing procedures, including changing quarterly wastewater charges to monthly charges, and to update terminology, and clarify policies with respect to the installation of sewer connections. 6. Changes were made to Article 7 to reduce the threshold level of BOD that requires Board approval of wastes entering the system from 300 mg/l to 225 mg/l, and to require landowners to pay the cost of installation of required grease, oil, hair and sand interceptors. 7. Changes were made to Article 8 regarding rates and user charges. Significant changes include: i. Including costs of system upgrades in the rate setting process. ii. Use of Environmental Protection Rules Design Flows in the calculation of equivalent user units. iii. Restructuring of the rate components to include “sewer bond”, “sewer fixed rate” and “sewer usage rate”. iv. Deletion of the formula for user charge rates. v. Clarification of the collection process for

delinquent sewer bills. 8. Changes were made to Article 9 to delete sections related to “Sinking fund/capital reserve fund assets and “Other Expansion Funds”. 9. Certain terms were modified in Article 10, including substitution of the term “Approval” for the term “Permit throughout the Ordinance. 10. Article 11 was modified by deleting reference to a fine for violations of the Ordinance. The complete text of the Amended Ordinance may also be examined, upon request, at the Village Offices at 42 Village Drive, Enosburg Falls, Vermont at any time during normal office hours. Any citizen of the Village of Enosburg may petition for a public vote on the Amendments to the Ordinance at an annual meeting or a special meeting held pursuant to 24 V.S.A. §1973.
