They are: 1. The right to inspect and review the student’s education records within 45 days of the day the District receives a request for access. Parents of eligible students should submit to the school principal a written request that identifies the record(s) they wish to inspect. The school official will make arrangements for access and notify the parent or eligible student of the time and place where the records may be inspected. 2. The right to request the amendment of the student’s education records that the parent or eligible student believes are inaccurate or misleading, or otherwise in violation of the student’s privacy rights under FERPA. Parents or eligible students may ask the Maple Run Unified School District school to amend a record that they believe is inaccurate or misleading. They should write the school principal; clearly identify the part of the record they want changed and specify why it is inaccurate or misleading. If the District decides not to amend the record as requested by the parent or eligible student, the District will notify the parent or eligible student of the decision and advise him/her of his/her right to a hearing regarding the request for amendment. Additional information regarding the hearing procedures will be provided to the parent or eligible student when notified of the right to a hearing. 3. The right to consent to disclosures of personally identifiable information contained in the student’s education records, except to the extent that FERPA authorizes disclosure without consent. Disclosure without consent is disclosure to school personnel with legitimate educational interest, included, but not limited to, school officials employed by the District as an administrator, supervisor, instructor, or support staff member (including health or medical staff and law enforcement unit personnel); a person serving on the School Board; a person or company with whom the District has contracted to perform a special task (such as an attorney, auditor, medical consultant, or therapist); or a parent or student serving on an official committee, such as a disciplinary or grievance committee, or assisting another school official in performing his or her tasks. A school official has a legitimate educational interest if the official needs to review an education record in order to fulfill his or her professional responsibility. Upon request, the District will disclose education records without consent to officials of another school district in which a

student seeks or intends to enroll. 4. The right to file a complaint with the U.S. Department of Education concerning alleged failures by the District to comply with the requirements of FERPA. This means parents can also opt their children out of participation in certain school activities. These activities include student surveys, analysis, or evaluation that concerns one or more of the following eight areas (“protected information surveys”): 1. Political affiliations or beliefs of the student or student’s parent; 2. Mental or psychological problems of the student or student’s family; 3. Sexual behavior or attitudes; 4. Illegal, anti-social, self-incriminating, or demeaning behavior; 5. Critical appraisals of others with whom respondents have close family relationship; 6. Legally recognized privileged relationships, such as with lawyers, doctors, or ministers; 7. Religious practices, affiliations, or beliefs of the student or parents; or 8. Income, other than as required by law to determine program eligibility. This requirement also applies to the collection, disclosure, or use of student information for marketing purposes, and certain physical exams and screenings. Schools will provide parents with a schedule of activities requiring parental notice and consent/ opt-out for each school year, as well as advance notice of surveys, etc., with opportunities to review the materials and to opt out. This does not apply to such areas as school climate, learning opportunities, student assets, and other surveys that are not of a sensitive nature. The Vermont State Board of Education rules on seclusion and restraint require public and approved independent schools annually, at or before the beginning of each academic year, to inform parents of enrolled students of the requirements pertaining to the use of physical restraint and seclusion, and of the Vermont preference to use positive behavioral strategies and supports in order to avoid the use of physical restraint or seclusion to address targeted student behavior. The Vermont Legislature has exempted active duty “law enforcement officers,” who are certified in accordance with 20 V.S.A. § 2358, from the State Board of Education rules on seclusion and restraint. This provision applies to both full-time and part-time state police officers, municipal police officers, sheriffs and constables. The State Board of Education rules still apply to security guards and retired police officers (who are sometimes called school resource officers, but who do not fall within the definition of “active duty law enforcement officers.”) With the exception of certified law enforcement officers, persons who impose a restraint or seclusion must report its use to the school administrator no later than the end of the school day,

and school administrators must report certain types of restraints or seclusions to the superintendent. The rules require notice to parents within 24 hours of each use of seclusion and restraint and afford an opportunity for parents to participate in a review of an incident of restraint and seclusion. The superintendent must report to the Commissioner within three school days if: 1. There is death, or an injury requiring outside medical treatment or hospitalization of staff or student, as the result of a restraint or seclusion; 2. Physical restraint or seclusion has been used for more than 30 minutes; or 3. Physical restraint was used in violation of State Board of Education rules. State Policy It is the policy of the State of Vermont that all Vermont educational institutions provide safe, orderly, civil, and positive learning environments. Harassment, hazing and bullying have no place and will not be tolerated in Vermont schools. No Vermont student should feel threatened or be discriminated against while enrolled in a Vermont school. 16 V.S.A. § 570. State Law An owner or operator of a place of public accommodation or an agent or employee of such owner or operator shall not, because of race, creed, color, national origin, marital status, sex, sexual orientation, or gender identity of any person, refuse, withhold from, or deny to that person any of the accommodations, advantages, facilities, and privileges of the place of public accommodation. 9 V.S. A. § 4502(a). Discrimination/ Harassment Harassment of a student on the basis of sex can limit or prevent a student from participating in or receiving educational benefits, services or opportunities. Gender-based harassment may include acts of verbal, nonverbal, or physical aggression, intimidation, or hostility based on sex or sex stereotyping. For example, harassing a student for failing to conform to stereotypical masculine or feminine notions or behaviors constitutes sex discrimination. Complaints alleging discrimination or harassment based on a person’s actual or perceived transgender status, gender identity or gender nonconformity should be handled in accordance with the Policy on the Prevention of Harassment, Hazing and Bullying of Students. PUBLIC NOTICE Town of Swanton, VT Notice is hereby given that the Town of Swanton Selectboard adopted revisions to the “TOWN OF SWANTON, VT DOG ORDINANCE” at its Tuesday, August 21, 2018 regular meeting. The Selectboard revised the title of the ordinance by deleting “& WOLF HYBRID” from the title and other sections where it appears because the definition of dog in the ordinance includes wolf hybrid. The Selectboard deleted the words “domestic pet” or “pet” wherever they appear in the ordinance to clarify that the ordinance only deals with dogs/wolf hybrids. Wording was added to Section Three requiring a collar or harness to which shall be securely fastened a metal license tag and a metal tag with the name and address of the owner whenever such dog is “off the premises of the dog’s owner.” Section Six has been revised to read, “DOGS AT LARGE - Any dog at large which causes property damage, or creates a nuisance or viciously attacks a person or a domestic animal on private or public property may be impounded by the Enforcement Officer or Animal Control Officer upon a signed written complaint by the owner, legal occupant, or supervisor of the property. Please see the definition of “at large” in Section One. Please also see Sections Five and Eleven.” Section Seven has been revised by replacing the word “premises” with the word ”property” in the first sentence, by replacing the words “on same” with the word “there” in the second sentence, and by replacing the word “will” with the word “shall” in the third sentence. Section Eight has been revised by adding the word “written” before the word “complaint” in the second sentence. Section Eight has also been revised by adding the words “within twelve months of the original complaint” to the last sentence. Section Thirteen has been revised by deleting the words “postage paid” from the second sentence. Section Thirteen has also been revised by replacing the words “be continuing” with the word “continues” in the next to last sentence. In accordance with 24 VSA Sections 1972 & 1973, notice of these adopted revisions is being published in a local newspaper and on the Town of Swanton website (www.townofswanton vermont.weebly.com) within 14 days of the date of adoption. Qualified voters of the Town of Swanton who oppose the adopted revisions have the right to petition for a vote on the revisions at an annual or special meeting as provided in 24 VSA Section 1973. Unless a petition is filed, the adopted revisions shall become effective on October 20, 2018.
