State of Vermont, is the record owner of a mobile home park known as Roy’s Mobile Home Park (the “Park”) located in the Town of Swanton, Vermont. 2. Norman & Nichole Bushey (the “Busheys”) are the record owners of a certain mobile home described as a 1991 Amherst Derose Amber, 16’ x 70’ mobile home, bearing serial number HUDPFS228800 (the “Mobile Home”), located on Lot #24, Roy’s Mobile Home Park, 28 Howard Street in Swanton, Vermont (the “Lot”) according to the Swanton Land Records. 3. The Busheys leased the Lot in the Park from HFI pursuant to a written lease with the Park. Busheys paid no security deposit. 4. The Busheys’ last known mailing addresses were 28 Howard Street in Swanton, Vermont 05488 and 24 York Street in Swanton, Vermont 05488. 5. The mobile home has been abandoned. The home is empty. The last known residents of the mobile home were the Busheys. The Park believes they have removed all of her personal property from the mobile home and utility services have been terminated. The Busheys vacated the mobile home sometime in May, 2018. The Busheys have made no effort or attempts to remove the home from the Park or to sell it. 6. HFI’s counsel wrote to the Busheys on June 29, 2018 regarding their intentions with the mobile home. HFI’s counsel spoke with Mr. Bushey on July 9, 2018. He confirmed that they had vacated and advised counsel that they were walking away from the mobile home because of mold and its poor condition. 7. The following security interests, mortgages, liens and encumbrances appear of record with respect to the mobile home: a. The Busheys are in arrears on obligations to pay property taxes to the Town of Swanton, Vermont in the aggregate amount of $723.15, plus additional interest and penalties.

The delinquent property taxes are now a lien on the property. b. Village of Swanton, P.O. Box 342, Swanton, Vermont 05488 for unpaid property taxes in the amount of $358.83 and unpaid electric fees in the amount of $862.77, plus additional interest and penalties. 8. Mobile home storage fees continue to accrue at the rate of $384.00 per month. Rent, storage fees and late charges due the Park as of September 11, 2018 total $3,879.79. Court costs incurred by the Park exceed $1,000.00. 9. The Park sent written notice by certified mail to the Swanton Town Clerk and to the Delinquent Tax Collector on July 13, 2018 of its intent to commence this abandonment action. See attached. 10. The mobile home is uninhabitable. Doreen Phillips, Property Manager, will testify under oath as to the poor and unlivable condition of this mobile home at the abandonment hearing. WHEREFORE, HFI respectfully requests that the Honorable Court enter an order as follows: 1. Declare that the mobile home has been abandoned; 2. Transfer the mobile home which is unfit for human habitation to the Park owner, HFI without a public auction so that it may be removed and disposed of accordingly. 3. Order pursuant to 10 V.S.A. § 6249(j) that the mobile home and any security deposit paid be conveyed to the Park Owner in “as is” condition, and free from all liens and other encumbrances of record. See attached Vermont Mobile Home Uniform Bill of Sale. 3. Further, the mobile home bill of sale as recorded also lists a Sandra Barrett on the title. The Town Clerk has advised only Gaboriault is the owner. It is unknown if they were/are married, so Barrett is being listed in this Complaint in case she has a marital interest in the mobile home. It is believe that Barrett moved out of the mobile home many months ago, prior to the start of the eviction proceedings. They purchased the mobile home in April, 2017. 4. Gaboriault and Barrett leased a lot in the Park for his mobile home from Homestead pursuant to a written lease. 5. Gaboriault was evicted from the Park for non-payment of rent in March of 2018. A Judgment for the outstanding lot rent, court costs and attorney’s fees was entered against Gaboriault on February 21, 2018 in the amount of $2,415.09. See Homestead Acres Co-op, Inc. v. Gaboriault, Docket No. 28-1-18 Frcv. 6. Gaboriault’s and Barrett’s last known mailing address is 19 Homestead Drive, St. Albans, Vermont 05478. 7. The mobile home is empty and has been abandoned. The last

known resident of the mobile home was Sanford Gaboriault. Gaboriault has made no effort or attempts to remove the home from the Park. Homestead’s counsel has attempted to communicate with Gaboriault and has received no response. 8. The following security interests, mortgages, liens and encumbrances appear of record with respect to the mobile home: a. Homestead Acres Co-op, Inc. v. Gaboriault, Judgment Order dated February 21, 2018. b. Village of Swanton, P.O. Box 279, Swanton, Vermont for unpaid electric fees. 9. Uriah Wallace, a duly licensed auctioneer, is a person disinterested in the mobile home and the mobile home park who is able to sell the mobile home at a public auction. 10. Mobile home storage fees continue to accrue at the rate of $385.00 per month. Rent, storage fees and late charges due the Co-op as of September 14, 2018 total $4,115.00. Court costs and attorney’s fees incurred by Homestead to date exceed $1,500.00. 11. Homestead sent written notice by certified mail to the Town of Swanton and the Town’s Delinquent Tax Collector on June 20, 2018 of the Co-op’s intent to commence this abandonment action. See attached. WHEREFORE, Homestead respectfully requests that the Honorable Court enter an order as follows: 1. Declare that the mobile home has been abandoned; 2. 2018/2019 WINTER YARD MAINTENANCE At this time the WestRock Converting Company’s (formerly RockTenn Company) Missisquoi Mill, located in Sheldon Springs Vermont, is accepting bids for our winter yard maintenance covering November 15, 2018—April 15, 2019. The WestRock plant operates 24 / 7, and needs to be able to shuttle trailers around most hours of the day and night. Plowing, Sanding, and the ability to haul away excess snow when the need arises are minimum requirements. Plowing can be quite intense at times clearing trailer lots and loading docks, and you are expected to handle the job without direct supervision, including deciding when you need to plow and /or sand, as well as when to cut snow banks so vision is not obstructed around the facility. Some guidance will be given and cooperation solicited concerning parked cars and trailers during heavy storms however it is anticipated that plowing both before and after shift changes will be normal. Sanding and plowing needs to be kept up in all yards especially first thing in the morning before traffic begins at 6:00am, and employee parking lots must be avoided at all normal shift change times.
