A 1900s Home for a Top Businesswoman

The architectural design of the home at 408 De la Vina Street in Santa Barbara was a popular one in the late 1800s and early 1900s. The front portion of the house usually held the living room, known then as the parlor. The home at 322 Castillo Street, which I wrote about in July, is a similar design. Numerous people lived in this home over the years, but one stood out so much that I decided to focus on her.

Emma Hummel arrived here from Wisconsin about 1912 a newly widowed immigrant from Germany with eight children, hoping to make a fresh start. She set up a baking business, which she had done in Wisconsin. She started by baking in the home’s kitchen. It’s not a large home, so the scent of bread and cakes must have filled the house. It’s not clear where she put all the children. But what is clear is her “can-do” spirit.

After a few years, she opened a bakery on the corner of Ortega and Rancheria streets. The business soon morphed into a grocery.

Her Place in S.B. History

Hummel worked hard, built up her business, and became a notable member of our business community. I was impressed to find a large article about her written in 1922, just 10 years after she arrived here.

The article was part of a book titled History of Santa Barbara County by Michael James Phillips. Nearly 300 prominent citizens of the city are profiled in this book, fewer than 10 of them women. Hummel was one of those women.

Here is an excerpt:

Santa Barbara is justly proud of its men of enterprise and public spirit and equally so of its women of ability and accomplishment. In this connection, Mrs. Emma A. Hummell [sic] is deserving of particular mention because of her achievements in the business world and her indomitable spirit, which has risen superior to adversity, conquering all obstacles and difficulties…. On the advice of a friend in Santa Barbara [she] decided to come to California…. In order to gain a livelihood, she started baking in her home, making bread, pies and pastry, and her culinary skill soon attracted trade…. Encouraged by her progress, Mrs. Hummel decided to broaden the scope of her activities and opened a small store nine by 12 feet in dimensions … [later expanded to 38 by 60 feet]…. Her business ranks with the oldest and largest of the kind in this section of Santa Barbara and stands as a monument to her courage, initiative and executive force.

A Moving Story

Although Hummel passed away in 1929, the building that her grocery store had occupied remained on the corner of Ortega and Rancheria streets until 1958. The freeway was being widened, and numerous homes and buildings had to be removed. Hummel’s store was auctioned off. A building mover named Frank Villalba bought the building. According to the local paper, he moved it all the way to Goleta. He must have felt that the building was well worth the effort to move. The address he listed in the paper for the new location was 274 Fairview. There is a small building at that location now which just might be Hummel’s old grocery store.

Homeowner Jennifer MacLeod is hard at work carefully restoring this century-old home at 408 De la Vina Street. She was hoping to put a plaque with a date on the home, but I was not able to figure out the exact date that the home was built. The address does not appear in a 1901 reverse directory, but a 1909 newspaper article mentions the home. I perused the handwritten book of building permits on file at the city, but could not find a building permit for this address during the years 1902 to 1909. That happens sometimes.

What Do You Pay Your Professionals?

What do you pay your professionals? There’s the price, certainly. Value is the trade for what you get versus the amount it costs to get it. Time, money, results, trust all these things blend together when we consider what we’ll fork over. And does that amount change when you consider how you will pay it? Financed, deducted, or a direct check does the method impact the terms? We look at any professional we deal with in the refractions above: dentist, mechanic, financial advisor, esthetician, attorney, lender, and, most currently in the spotlight, real estate agent.

It is a fact that an agent’s commission has been negotiable for years. It is also a fact that most buyers didn’t pay much attention to their agent’s commission, as it generally was taken from the seller’s proceeds. Out of sight, out of mind. Yet this year’s rulings in classaction lawsuits around antitrust laws have brought how a buyer pays their agent’s commission to be at the front of the home-buying conversation. While every state has their own forms, rules and regulations, individual jurisdictions, and multiple listing services, things have changed in the 805.

The California Association of Realtors (CAR Buyer Representation Agreements) has issued forms that are both required and seek to give guidance on buyers’ rights,

requirements, around this topic of representation. Now, timeframes, percentages, exclusivity, and even location are lined out and addressed with a buyer before an agent can be paid a dime for their time. The “Disclosure Regarding Real Estate Agency Relationship” has 13 pages of detailed specifics that outline what and how representation should be handled.

First, let it be clear that I am not a Realtor, real estate agent, or broker that can represent property. Speaking to a licensed individual is key to best understand what this agreement means for you. That said, my day-to-day job helps buyers purchase homes, and it is our responsibility to understand how this can impact our clients. I am writing this in hopes that it helps folks see how these changes can impact home financing. It must be noted that any and all commissions and concessions should be done directly through closing (escrow), as handling these outside of the disclosed transaction is considered a “kickback,” and is illegal.

There remain three basic ways to have commission paid to a buyer’s agent. The first is that the seller pays it directly to the agent via escrow. In this structure, the sales price of the home is the vehicle generating the funds to pay the agent. This is how it has traditionally been done for ages.

to the buyer, who then channels some, or all, of those funds to their agent. This structure also uses the sales price of the house to generate the funds to cover the commission. However, this structure directly impacts lending decisions, as not every type of loan (VA, for example) allows the buyer to pay commission. Additionally, most loans have limits on the amount of credit(s) a buyer can receive from a seller no matter what they do with it.

The final way to handle a buyer’s agent’s commission is for the buyer to fund it directly. Whether from their own accounts, a gift from family, or even perhaps adjusting their mortgage structure to facilitate paying the bill, this last method also has restrictions from a lending perspective. Again, not all loans allow for the buyer to pay commission to an agent, and not all funds are considered equal in lending guidelines and programs. Some programs require reserves a k a money on hand after closing and paying a higher closing cost could impact how one qualifies.

As you look to purchase property, it is super important that you review this with your lender and agent. Make sure that everyone is on the same page for how best to serve your financial needs. Make sure that you are prepared to adjust your sales price or mortgage structure, or bring out the check-

book to make it happen. And really, this part hasn’t changed. Knowing what is expected from you financially is one of the key things to take into consideration when buying a home it’s the conversation that has changed, not the importance of consideration.

All in all, it remains the same that commissions are negotiable. What is different is when, and how, this conversation must be had as a buyer. Options remain for your specific situation, and how this will play out is yet to be fully seen. Are we seeing some clients decide to write the check versus roll into their sales price? Yup. Yet, thus far, it seems to be the traditional, first method of commission structure that remains dominant, and we expect that to continue. Good professionals are invaluable and will continue to be so no matter how they’re paid.

S.B. Yacht Club Hosts Regatta for VNA Health

On September 7 at the S.B. Yacht Club’s Charity Regatta for VNA Health, guests enjoyed a splendid, full day of socializing, dining, and watching the regatta at the S.B. Yacht Club (SBYC) and on spectator boats. This year marked the 20th anniversary of the event, which over the years has raised more than $2.5 million for the treasured nonprofit VNA Health (formerly Visiting Nurse & Hospice Care).

The day began with brunch at the club, where guests enjoyed ocean views, perfect weather, and steel drum music. In a short program, emcee David Moorman shared his gratitude to VNA for the care his mother received in her last days at Serenity House, remarking that in those darkest days, VNA staff had infinite amounts of strength, resolve, and resources to guide him and his family.

Throughout the day, I heard many words of praise and gratitude for the care that they and loved ones had received at VNA, a level of care that some noted far surpassed what they had experienced with for-profit institutions. Every year, more SBYC members experience in some regard VNA Health’s services, and, quite fittingly, every year VNA Health is again chosen as the event’s beneficiary.

Commodore Dennis Boneck recognized the event honorees: first responders from a multitude of agencies that serve the S.B. Harbor. Guests were introduced to Project Harmony, a program run by 9-1-1 At Ease International, a nonprofit that offers counseling and therapy to first responders and their families. In Project Harmony, healing is provided through songwriting and music. Two participants, Lois Mahalia and Hannah Griffin, beautifully performed a tribute to the first responders present.

Many guests then boarded one of the 16 spectator boats for a fun couple of hours. I boarded Torqua, Geoff and Alison Rusack’s 86-foot Ocean Alexander luxurious motor yacht, where we enjoyed cruising the harbor, watching the regatta, and socializing in the various deck and cabin lounge areas.

After guests returned to the club, the party continued with a buffet dinner and guests seated at tables on the sand, while Davitt Felder & Band provided great music. Awards were presented to the winners of the three race classes: Dr. Laura Schlessinger, Warrior; Ole Eichhorn, Spot the 505; and Shawn Hughes, Picante.

Funds raised by the Regatta go to VNA Health’s charitable community programs and services.

VNA Health operates a multitude of programs, including home health, hospice (at Serenity House and inhome), and palliative care. Last year, the value of VNA’s charity care was $2.4 million, which included $1.7 million in services for uninsured and underinsured patients in these programs.

The other $700,000 went to programs it offers beyond the standard ones, such as its Loan Closet, bereavement care, and integrative therapies such as Reiki, pet therapy, and music services. Last year, VNA’s 380-plus employees and volunteers served more than 8,700 patients.

VNA Health always welcomes new volunteers, including for hospice (full training provided), music services (for those who play an instrument), Loan Closet (for those who like to tinker and fix equipment), pet therapy (owner/ pet teams) and veterans’ program (for vet volunteers to connect with vet patients).
