Congratulations! I could not be happier by these rock stars that surround me for 2023 as our Board of Directors. Members of the Board of Directors are volunteers from the Association and are elected to two-year terms, with Officers elected yearly. Every year, a call for candidates goes out to all Association members. A Nominating Committee is appointed by the President (with Board approval) to review the candidates, conduct interviews, and submit their recommendations to the Board. The SBAOR staff supports our board of directors and committees. More to come about our amazing staff in the future.
Thank you to these Real Estate all-stars who give their time above and beyond the regular duties of a REALTOR®. Our Board deals with new legislation from the California Association of REALTORS® and National Association of REALTORS® to working with our local elected officials, from housing updates in this constantly changing profession to give back impact donations of time and money. Our Board also approves efforts from our many committees, which do a lot of the heavy lifting and put on our Association events, both fun and educational. Design Recipes:
Brighten up your space with a citrus color palette

Citrus colors are bright, friendly and gender-neutral. They are also often the perfect way to add pops of color to neutral spaces. From lemon and lime to orange and their various tints, tones and shades, when looking for ways to perk up your decor, citrus colors may be the perfect blend.
Here are some top tips for incorporating citrus colors into your home.
DO’S
1.Don’tbe afraid to blend citrus colors in the same space. For example, try pairing orange with yellow and green.
2 Don’t use overly bright foundation colors as a springboard to a citrus color palette. Using neutral tones such as cream, gray and black work best.
3 Don’t use dark shades in small rooms, as they will make small rooms feel even smaller.
4 Don’t blend too many tints, tones and shades of color in the same space.

Managers’ New Year’s Resolutions (Part 3)

[After previous columns proposing resolutions for directors and HOA members, here are ideas for managers. Next week - service providers]
As a community association manager, I resolve to:
NUMBER ONE:
1) Follow the Golden Rule.(“Treat others as you would like to be treated.”)
ATTITUDE CHECK:
2) Remember I am a professional. I will give the board the best advice I can. I am not employed to be silent.
3) Strive to give the board the answers and recommendations it needs to hear, not just the input the board hopes for.
4) Avoid reacting defensively to upset homeowners. I will try to provide the “why,” and not only the “what” regarding HOA rules.
5) Try my best to please all, while knowing that I can’t.
BE KNOWLEDGEABLE:
6) Pursue professional designations with CAI and/or CACM and attend seminars to keep me up to date.
7) Be prepared at any board meeting to explain significant deviations from budget or unbudgeted expenses.
8) Confirm in writing my advice to the board if it disregards my advice.
9) Avoid giving specialized advice and will refer the board to the appropriate specialized professional service provider.
10) Help the Board follow the Business Judgment Rule, providing the board sufficient information to make each decision.
11) Encourage directors to join the local Community Associations Institute Chapter, knowing educated boards are better boards.
BETTER BOARD MEETINGS:
12) Protect the board from overly long or disorganized meetings.
13) Create agendas with consent calendars to quickly handle non-controversial items.
14) Alert the board when a proposed agenda becomes too ambitious.
15) Become comfortable with parliamentary procedure fundamentals.
16) Help the board stay on agenda and on topic.
17) Alert the board if it is handling matters in closed session that should be
discussed in open session.
18) Bring the HOA governing documents to every meeting.
19) Be prepared to provide a recommended action or recommend hiring the appropriate specialized expertise on each agenda item.
20) Listen respectfully when homeowners in open forum criticize my work.
COMMUNITY BUILDING
21) Strive toward increasing meaningful and frequent membership communication.
22) Focus on the association’s community needs as well as its financial, maintenance, and legal concerns while I advise the board and execute its instructions and policies.
ETHICS
23.) Treat all members the same, regardless of how they treat me.
24) Communicate to the entire board when answering a director’s question or giving a report.
25) Remember my client is the HOA, not its board or president.
26) Not take sides in board elections or recalls, and not assist or advocate for or against any candidate. My personal opinions on those matters will remain secret.
27) Reject vendor offers of kickbacks, gratuities, or commissions and promptly disclose such offers to the board.
28) Not give my employer (or its related company) any advantage in bidding on HOA contracts.
VENDORS
29) Advise the board when specialized expertise is needed on specific issues or projects.
30) Provide the board with two or three candidate service providers to consider, not only one favorite vendor.
31) Suggest the appropriate consultant before the board evaluates major or complicated bids to help them select the best and most complete proposal.
32) Recommend the best bid, not simply the cheapest.
LAST:
33) Follow the Golden Rule.

Hi Ed, I like the concept of touch-less kitchen faucets and want to install one. But, I want more than just that one feature if I’m going to upgrade. What other options are available when making the move to an electronic kitchen faucet?

Answer:
Touch-less faucets are a great addition to any kitchen, especially if you do a lot of “hands-on” food preparation and you want to keep the faucet a little cleaner. The good news is now that touch-less electronic kitchen faucets have been on the market for a while, some other nice options are also available.
Aside from the main touch-less feature, you can find electronic kitchen faucets that may include: LED status indicator lights, bypass water control in case of AC-power or battery power loss, voice control faucet activation with preset fill measurements, even Wi-Fi and smart phone pairing to display water-use information and notifications. These are just some of the options available on the electronic side and other faucet options are available on the plumbing side as well.
Bottom line: If you make the move to install a new “touchless” kitchen faucet, chances are you’ll find other “handy” features included!

What should I do if condo manager doesn’t respond to emails?

Several months ago, I discovered a large hole in the building’s exterior that exposed the inside of the wall in behind my apartment. I emailed our condominium’s manager a few times and have not gotten a response. What should I do?
Answer:
It is good that you are taking damage to your condominium building’s condition seriously. It is important that every resident report damage so that it can be repaired. Besides the obvious safety implications, damage tends to get worse and more expensive to repair if ignored.
Emailing your association’s management is a good start. However, despite their convenience, email sometimes goes awry, gets sent to the wrong address, or ends up in the recipient’s spam folder for no apparent reason
Because you have not gotten a response, you should assume that your emails are not getting where you sent them.
Your next step is to pick up the phone. In my work as an attorney, I see the over-reliance on email daily. The power of speaking with someone on the phone should not be overlooked.
This is not to say that written messages do not have their place. Email is a great way to communicate and create a record of the conversation. But when email fails, it is time to speak with the recipient directly.
If your community manager is still unresponsive, your next step would be to reach out to the board of directors for your condominium association.
If you know a board member, point out the problem to them. If not, attend the next board meeting and let them know. You may find that your association already knows about the problem and is working to fix it.
If the hole is causing damage to your apartment, you should make simple, temporary repairs to protect it, such as sealing the hole with a plastic sheet until your community makes permanent repairs.

Last week The Garden Guy attempted to take your mind off the impending doom from the arctic blast with a little “Mele Kalikimaka” from Hawaii. I know I failed — if you are a gardener, you are suffering. I too was leaning toward a mood of dark hysteria brought on by five days of 11-17 degrees Fahrenheit. Then a lifeline came in the mail: I received the new Spring 2023 Preview catalog from Proven Winners. There on page 14 were the new 2023 Proven Accent Plants, one of which, Waikiki Sunset, took me back to Hawaii.
Although I currently have a landscape of burnt toast, color is sure to come again. If you have not grown Waikiki Sunset, just know it is a mood changer, a spirit uplifter from the plant world. Waikiki Sunset will have you looking at The Bright Side (more on that later). But before I tell you why, let’s get down to the botany and taxonomy of this treasure.
Waikiki Sunset is known botanically as Lysimachia congestiflora with the recognized common name of dense-flowered loosestrife, moneywort and occasionally golden globes. None of the common names do the plant justice. Waikiki Sunset, on the other hand, fits perfectly.
As you may have gathered, it is related to the Goldilocks creeping Jenny, which is Lysimachia nummularia. Goldilocks is hardy to zone 3, while Waikiki Sunset is hardy to zone 7 (though I hear some touting zone 6).
Goldilocks travels in the garden and can cascade 24-plus inches over the rim of a container or basket. Waikiki Sunset won’t spread nearly as much and is taller, able to reach around 10 inches. But Waikiki Sunset offers green and gold variegated leaves and gorgeous golden globe flowers sporting rusty red centers or throats that persist off and on most of the summer.
I have grown them in between flagstone patio rocks with blue scaevola and was delighted. Son James has used them with blue lobelias in containers, which were dazzling. The blue partners as complementary colors and are a natural choice. But I want you to look at The Bright Side, which I mentioned earlier. This is a Proven Winners recipe that is as colorful as Carnival in Rio.

of trying too hard when it comes to container partnerships. The Bright Side features Waikiki Sunset lysimachia, Superbells Red and Superbells Tropical Punch calibrachoas. You will notice the clusters of golden globe flowers certainly stand out, but the golden chartreuse and green variegated leaves add a special pizzazz.
Many in the industry talk of this plant’s ability to stand out in a monoculture planting. Proven Winners added on to this idea by combining Waikiki Sunset with the new Graceful Grasses Queen Tut. This gives you monoculture on the bottom, then elegant tufts of green towering over the planting. Trust me, this is drop-dead gorgeous.
If you are trying in the landscape, amend tight heavy soil with 3 to 4 inches of organic matter, and work it shovel-deep, 6 to 8 inches. As you probably have gathered by now, I am a proponent of incorporating a little preplant slow-release fertilizer. It is considered a sun to part-shade plant. I have a high-filtered shifting sun, which also seems perfect.
When planting the Waikiki Sunset lysimachia or any other perennial, take care of not planting too deep. Plant where the top of the root-ball is even with the surface of the soil. The Waikiki Sunset is spreading, so space 10 to 12 inches apart.
Water to get the plants established, but then sparingly. A light application of a slow-released, balanced fertilizer a month after transplanting should be sufficient for vigorous growth. Commercial landscapers growing in mixed containers tend to use a preplant controlled-release granular fertilizer, followed up by dilute liquid feeding the rest of the summer.
It won’t be long, and this record cold spell will be thankfully forgotten. Use this down time to make your list of plants and start thinking of combos or recipes like The Bright Side that you may want to try.

Do I need to survey my land?

Ask most people where their property begins and ends, and they can give you a specific answer. The road to the west, the alley in the back, the front sidewalk, and the fence between their house and the neighbor’s place. It couldn’t be simpler, right?
And yet, many homeowners don’t really know the exact amount of land they own or where it begins and ends. And not knowing the precise dimensions of your most valuable asset can lead to various problems, ranging from “hilarious misunderstanding” to “complete disaster during home selling.”
Homeowners often rely on anecdotal evidence, such as the visual markers that border a property (streets, fences) to delineate their property. But even geographic information system information or Google Earth aren’t reliable indicators. Indeed, some of what you think is part of your front lawn might be owned by the state or city, depending on how far the legal right of way extends from the street.
The most obvious value of property lines is knowing how far you can and should place im-
provements along your yard. A 6-foot variance in your borders makes a big difference when putting up a fence.
Sometimes, a homeowners association will require that specific improvements be made to the property line.
The only reliable way to pinpoint your exact property lines is a professional surveyor, who surveys your property according to the exact dimensions recorded by the city or county office responsible for tracking property lines.
How to hire a surveyor
Licensing requirements vary by state. However, all states have a surveyor’s licensing board. The profession requires a deep knowledge of law and systems, extensive education and professional experience under a licensed surveyor before granting a license.
The profession also requires a bit of diplomacy — surveyors are sometimes called upon to explain their findings to angry landowners who discover they own much less than they thought or that their expensive landscaping extends several feet into someone else’s yard.
A survey costs about $525, but if you’ve never had one done, it could prove vital. You should al-
ways hire a surveyor when buying a new home. And if you’re undertaking landscaping or fence construction, it buys valuable peace of mind to know your boundaries.
Property lines vital to insurance and responsibility
Property lines get even more complicated when you consider elements that start on one property but impact another. Trees make up the majority of these problems. If your oak’s limbs extend over your neighbor’s yard, whose problem is it when the leaves fall? Or worse still, if a broken limb causes damage to a neighbor’s yard?
This is another case where your jurisdiction matters, so make sure you and your insurance company understand the specifics.
In the end, mutual respect for each other makes the most valuable difference. Consider your neighbors when making improvements near your property edge, regardless of where your property line is.
