Is Open Forum Truly Open? By Kelly G. Richardson, Esq. CCAL Kelly, Recently an owner had a matter which she wanted to bring up during the “Homeowner’s Forum” but she could not attend. She sent an email to the association delegating me to share with the board her concerns. At the meeting, the president shut me down and said only people present could speak and that no one had the right to have someone speak in their behalf. He said that was “illegal.” Can owners authorize another homeowner to speak on their behalf if they cannot attend? – J.N. Dear J.N.: The issue here is not whether your proxy allowed you to speak on your neighbor’s behalf in open forum, but why did the president think it was ok to limit what YOU could say in open forum? That is your time, and the board cannot censor or otherwise restrict it (except for a reasonable time limitation). If you choose to use your open forum time to speak about a neighbor’s issue, this is your right. However, don’t expect to have a second open forum session in that same meeting — you had your opportunity to speak. – Best, Kelly Dear Kelly: I went to the HOA meeting and was given an agenda consisting of 8 bullet points for the homeowners forum. The meeting started with the board asking me if I had any questions. Is it normal that the homeowner is asked questions in the beginning of the meeting? Questions from the floor came last, prior to closing the meeting. I feel this is all backwards and evasive. – J.K. Dear J.K.: Open forum should be at the beginning of the meeting, so that members can

speak ahead of any matters being voted upon. At the end of the meeting is too late, because the decisions have all been made. Having open forum early shows its importance. Sometimes on significant decisions it helps to reopen open forum for member input on that specific subject. — Regards, Kelly Dear Kelly: Our association just modified our driveways. A director attempted to explain that these were installed because of a homeowner lawsuit, but the manager shut down this conversation. In open forum, I asked why members were not privy to a lawsuit for which we not only paid legal fees but are living with the consequences of the settlement. Their position is that it is confidential information known only to the directors who were on the board at the time of the lawsuit. Why are we not entitled to be informed of any changes as a result of the suit? – A.P Dear A.P.: Disclosing sensitive issues regarding lawsuits can be very ticklish for a board or manager. The settlement might have included a confidentiality promise, and that promise is sometimes misunderstood as requiring the settlement not be disclosed to the members. Hopefully your HOA attorney required that the settlement not bar the HOA from disclosing the settlement to its members. Current board members have the right under Corporations Code Section 8334 to know about the past lawsuit, so long as they were not personally involved (meaning no conflict of interest). There are sensitive issues that must be kept confidential, but hopefully the HOA attorney has coached the board and manager on what is ok to disclose. – Thanks, Kelly

Pre-Qualified vs. Pre-Approved: What’s the Difference

In the loan process, the above two terms often get misunderstood or mixed up a lot. Both are good, but one certainly carries more weight than the other. Most real estate buyers have heard that they need to pre-qualify or be preapproved for a mortgage if they’re looking to buy a property. These are two key steps in the mortgage application process. Some people use the terms interchangeably, but there are important differences that every homebuyer should understand. Pre-qualifying is just the first step. It gives you an idea of how large a loan you’ll likely qualify for. Pre-approval is the second step, a conditional commitment to actually grant you the mortgage. The pre-qualification process is based on consumer-submitted data.Preapproval is verified consumer data — for example, a credit check. Pre-Qualified Getting pre-qualified involves supplying a bank or lender with their overall financial picture, including debt, income, and assets. The lender reviews everything and gives an estimate of how much the borrower can expect to receive. Pre-qualification can be done over the phone or online, and there’s usually no cost involved. Pre-qualification is quick, usually taking just one to three days to get a prequalification letter. Keep in mind that loan pre-qualification does not include an analysis of credit reports or an in-depth look at the borrower’s ability to purchase a home. The initial pre-qualification step allows for the discussions of any goals or needs regarding a mortgage. The lender will explain various mortgage options and recommend the type that might be best suited. Again, the pre-qualified amount isn’t a sure thing, because it’s based only on the information provided. It’s just the amount the borrower might expect to get. A pre-qualified buyer doesn’t carry the same weight as a pre-approved buyer, who has been more thoroughly investigated. Pre-qualifying can nonetheless be helpful when it comes time to make an offer. A pre-qualification letter is all but required with an offer in our market. Sellers are savvy and don’t want to enter into a contract with a buyer who can’t perform on the contract. It’s one of the first questions a Realtor should ask of a potential buyer: Have you met with a lender and determined your pre-qualification status? If not, we advise options for lenders. If so, the Realtor request and keep on file a copy of the pre-qualification letter. Pre-Approved Getting pre-approved is the next step, and it’s much more involved. A pre-qualification is a good indication of creditworthiness and the ability to borrow, but a pre-approval is the definitive word! The borrower must complete an official mortgage application to get preapproved, as well as supply the lender with all the necessary documentation to perform an extensive credit and financial background check. The lender will then offer pre-approval up to a specified amount. Going through the pre-approval process also offers a better idea of the interest rate to be charged. Some lenders allow borrowers to lock in an interest rate or charge an application fee for pre-approval, which can amount to several hundred dollars. Lenders will provide a conditional commitment in writing for an exact loan amount, allowing borrowers to look for homes at or below that price level. This puts borrowers at an advantage when dealing with a seller because they’re one step closer to getting an actual mortgage.

Special Considerations The advantage of completing both steps—pre-qualification and pre-approval—before looking for a home is that it offers an idea of how much a borrower has to spend. This prevents wasted time looking at properties that are too expensive. Getting pre-approved for a mortgage also speeds up the actual buying process, letting the seller know that the offer is serious in a competitive market. The borrower gives the lender a copy of the purchase agreement and any other documentation necessary as part of the full underwriting process after a home has been chosen and an offer made. The lender hires a third-party certified or licensed contractor to do a home appraisal to determine the home’s value. The final step in the process is a loan commitment, which is only issued by the lender when it has approved the borrower, as well as the home in question— meaning the property is appraised at or above the sales price. The lender might also require more information if the appraiser brings up anything that should be investigated, such as structural problems or a faulty HVAC system. Getting pre-qualified and pre-approved for a mortgage gives potential homebuyers a good idea in advance of how much house they can afford. But most sellers will be more willing to negotiate with those who are pre-approved. Preapproval also allows borrowers to close on a home more quickly, offering an edge in a competitive market. Tub fillers are available to fit different deck layouts By Ed Del Grande

Question: Ed: I’m installing a soaking bath with a two-handle tub filler mounted on the tub deck. But, I just realized a twohandle filler with a spout will take up too much deck space for my layout. I like the three-component faucet look, what do I do now? – Joe

Answer: Standard two-handle tub fillers are a popular choice, but they do take up deck space with a three-hole installation. If the soaking bath deck area is tight, single-handle tub fillers are available and use up less deck space. But with a one-hole filler installation, the single-handle control valve and the tub spout are combined into one component. This may not be good news if you like a multicomponent look. The good news is a compromise is available if the deck area can fit a two-hole installation. In this case, the two-component tub filler takes up less space than a standard filler, while retaining a multicomponent look. It does this by mounting a single-handle control in one hole and a tub spout in the other hole. I know this is a lot of information to soak in, so just remember: A single-handle, single-spout filler can give you the best of both worlds.

Dandy Man Color Wheel brings about the Rhododendron happy dance By Norman Winter Dandy Man Color Wheel is bringing out the rhododendron happy dance from the North to the South, and you will want to act quickly to get in on the party. Those of us who treasure azaleas have been green with envy of those in the Appalachian area and northward for their ability to grow rhododendrons. Shoot rhododendrons are even native to North Georgia and create postcardlike beauty in the mountainous scenic parkways and drape over the nation’s best trout streams. What is wrong with us; why did we get left out? Three years ago, The Garden Guy’s eyes were opened to southern possibilities when I discovered the Rhododendron Trail at Callaway Gardens in Pine Mountain, Georgia. Callaway is about 25 miles from my house and has one of the best azalea collections in the country. Of course, azaleas are rhododendrons, botanically speaking. It is the real rho-

The hustle and bustle of the holidays bring a lot of traffic through your home, and more activities mean more chances for something spilling and damaging your carpets. And if you do live in a zone with a lot of snow, your carpets will see even more wear and tear as people track in salt and snow. That’s why winter is an ideal time to hire a pro to clean your carpets. You should hire a carpet cleaner about once every 12 to 18 months — and stick with 12 months if you have kids or pets! Carpet tips It may seem obvious, but frequent vacuuming is a crucial step to keep your carpet in good condition. One thing that’s not so obvious? You should avoid using DIY products to remove stains. Experts say homemade cleaning products can actually do more harm than good. Carpet stain removal can be a tricky chemical balancing act, and that expertise is one of the most valuable things a pro cleaner brings to the table. If you have a serious stain or spill, it’s better to have a pro take care of it sooner rather than later. Mop up what you can with a towel, and then call in help. When hiring, tell your carpet cleaner upfront what specific problems you need them to handle. Kids’ throw up, dog pee and spaghetti stains all call for different solutions. Your pro can use various techniques to address the issue, but only if they know what to look for You can also help the job go smoothly by clearing furniture and removing breakable items before your pro arrives. Questions to ask Before hiring a pro, make sure you get a quote with details about how they charge for their service. Some pros bill based on square footage, while others charge by the number of rooms they clean. Some may even tack on an extra charge for targeting specific stains. You should also ask how long their technicians have been on the job, and what kinds of certifications they hold. The Institute of Inspection, Cleaning and Restoration Certification is one of the more prominent certifying organizations and requires workers to complete continuing education to maintain certification. Don’t forget to ask about their cleaning method. Professional cleaners have a variety of tools available to them. Truck-mounted services tend to offer the deepest clean, but if you live in an inaccessible area, they may need to use a portable unit. Most cleaners use either dry-cleaning or hot-water extraction (sometimes called steam cleaning), which have their own pros and cons for various carpet types and situations. dodendrons, however, that all Southern azalea lovers dream about thriving in the garden. The Rhododendron Trail at Callaway is a testament of time, as these rhodies have been there for years and have stories to tell. The real message is clear, though: They are old and still beautiful. If you are thinking this is a mountain like North Georgia and the Blue Ridge area, the answer is no. It is a wonderful scenic destination. Three years ago also marks the point in time that I started growing Dandy Man Color Wheel rhododendron from Proven Winners. When it comes to rhododendrons, I am always the hopeful skeptic. When I got mine, they started blooming before I could plant them. My bride, Jan, was so struck by their beauty she said these would go as a centerpiece on the table for a few days. No argument from me, for a host of reasons. Dandy Man Color Wheel has the potential to get 4 to 8 feet tall and just as wide. Being a skeptic, I might not have given them enough room for their companions. If they keep performing like they have been, it will soon be goodbye, companions. The buds start out lipstick red, which I promise you gets the heart pumping with excitement. These open to big ruffled blooms with deep pink undersides and soft pink shades inside. The blooms then age to clear white before falling off. Now you can see the reason Jan wanted these plants for a centerpiece. As the blooms go through their aging progression, you will see all three colors at once. The color description probably has you already chomping to get some, but know these are very disease-resistant, saying no to phytophthora, but equally impressive is the heat tolerance. Yes, Virginia, we can grow rhododendrons in the South. In fact, these are recommended for zones 5-9. Like azaleas, the other rhododendron species, Dandy Man Color Wheel needs fertile, organic rich, well-drained, acidic soil. My location is on the side of a gentle slope that has collected falling leaves for decades. It is very fertile and gets very little direct sun. I am layering the area down the slope with azaleas, hydrangeas and hostas. The leathery evergreen foliage of Dandy Man Color Wheels stands out in the crowd, if you will, by giving a welcoming contrast of texture with all the companion plants. My sincerest hope is the Dandy Man Color Wheel breeders will be introducing some siblings we can all add to our collections. In the meantime, as growing year four starts in a few short weeks, you may just see me doing the happy dance, as I will be celebrating my beautiful rhododendrons.
