An Election Tie and Another Has No Elections By Kelly G. Richardson, Esq. CCAL
Dear Mr. Richardson: We had an election where 3 people ran for 2 positions and the second and third place vote-getters tied. Without giving an explanation or detailed procedure they stated that they had to resolve it at a later meeting because candidate 3 was not in attendance. Briefly it said that candidate 2 later won as they took care of it. To me that is not an explanation and I asked but have not been given any other info. So how should it have been resolved. Thanks for considering for this knotty issue. – D.S. Dear D.S.: Fortunately, this situation (a tie vote) is not common, but HOAs should plan for this. Election rules or bylaws should state how ties are broken, because if neither of the tied candidates is willing to step aside, there might have to be a runoff election to break the tie. There are many ways a tie can be broken if the documents provide for it. Our firm typically places a coin toss in election rules we draft as a final not-so-scientific way of breaking ties. There is another issue here, and that is how the tie was broken. It is possible that one of the candidates stepped aside, but if the board decided how to resolve the problem in a closed meeting the board violated the Open Meeting Act. Some boards erroneously call such decisions “personnel actions” and so fill vacancies in closed session. Directors are not “personnel.” So, if the candidate stepped aside, leaving the other to take the open board seat, then no board action would be involved and the board could simply announce that the candidates worked it out among themselves. On the oth-
er hand, if the candidate was improperly placed in the seat, the board risks putting the HOA into turmoil and an election challenge. HOAs should make sure election rules or bylaws address tie votes. – Best regards, Kelly Dear Mr. Richardson: The Board has ignored its responsibility to hold board elections which should have been facilitated in over a year ago. How best to force this action? There has been no communication from the board to the homeowners in this regard and so it just drags on. Many of the homeowners are intimidated by 2 of the existing board officers so it is difficult to rally them to force such matters. I appreciate any brief guidance you might be able to provide.Regards and thanks in advance, – G.K. Dear G.K.: Associations should follow their bylaws and hold timely elections. If the board fails or refuses to hold an election, present them with a petition from the members. Pursuant toCorporations Code Section 75110(c), if the HOA has not had an election and it is at least 60 days past the normal annual meeting date or 15 months since the last meeting, a judge can order the election to occur. However, a member petition may alert the board that they need to listen to their neighbors. A legal action to compel an election is a major expense and should be avoided if at all possible. At the end of the day, it comes down to the community — the membership should not accept anything less than proper governance. – Sincerely, Kelly

Rain Gutters Question: I installed rain gutters on our house almost 30 years ago and now they have some small drips at the connections and at the corners. They aren’t in bad shape otherwise, but I wonder if it is best to replace them rather than try to repair the leaks? Your HandYMan: Rain gutters protect our homes from rainwater penetrating under the foundation and keep dirt and debris from being splashed up onto the outside walls of the house. If your rain gutters simply have leaks at the connection points, this can usually be solved by coating the inside of the connectors with an asphaltic tar roof patch compound that can be
purchased in the can or tube at any hardware store. If the gutters have extensive rusting in the bottom and the metal is falling away, then it is probably past the point of being repaired and the time has come for new gutters. There are many contractors in Santa Barbara who install continuous rain gutters that are formed from a big roll of sheet metal at your home and eliminate the need for connectors which are usually the cause of leaks. AND REMEMBER: Standing on a ladder is not a good idea for anyone mature enough to receive social security. It’s the hard landing part that hurts — not the falling part — even if the landing is onto a lawn.
Florescent Lighting Question: One of the lights on our kitchen ceiling stopped working recently. The two old florescent light tubes were black at the ends, so I replaced them, but they still don’t work. I love to cook but now my kitchen is dark as a cave! What do I do? Your HandYMan: It sounds like you are describing a common situation that occurs with florescent lighting. When a florescent light starts to flicker or does not turn on at all, it can usually be one of two things that have gone bad: the bulb or the ballast. The first step is to replace the old florescent tubes with new ones remembering that the old tubes contain a small amount of mercury
and are now considered to be a hazmat that must be taken to a recycling center and not put out in the regular trash. If the new bulbs do not light up correctly then the problem is probably with the ballast in the fixture having worn out and needing replacement. The ballast is basically a transformer that regulates the electrical current at the proper level for the florescent bulbs. You will need to get the model # from the old ballast and usually a replacement is easily found at the hardware or electrical supply store. Be sure to turn the circuit breaker off before attempting to install the new ballast and it is best to call an electrician if you are not experienced in electrical work.

Despite the chill outside, it is full spring ahead in the decor world. It is always a strange time to walk out of the ice into a warm and colorful shop. This in-between time can also pose some decorating challenges. What is a home to do when it feels too early for full floral, but you don’t want to live in a winter wasteland for another month? This isn’t a one-size-fits-all answer, but this year I am doing what I love to do year-round — bringing out the veggies. FARM FRESH Continued on page 8

Continued from page 5 Garden-inspired decor is light and airy without bringing out the tulips too early in the season. It’s OK to tiptoe into spring! With this look, I started by featuring some of my favorite classic cabbage dishes on my existing tabletop displays. The classic cabbage dishes are a timeless addition to any china cabinet and perfect for almost any season (however, they really shine in the spring and summer months!). By slowly adding in these new touches, I get to enjoy my blue-and-white table for a while longer without it getting stale. Cabbage plates make for a great cabinet display when they are off the table. Replacing the holiday dishes is never easy, but these do take the sting out quite a bit. They pair well with just about any color and look ready for a fluffy bunny to come take a nibble out of as you prepare for Easter. I snuck in a few tomato dishes to accompany them and have the beginnings of a great display (and a great salad). As we delve deeper into spring, so too can our tables. I have been loving garden-inspired decor so far this year. There is something so fresh and clean about bringing produce into a display that breathes new air into our spaces. This love may also have something to do with my inability to grow veggies in real life. My current favorite table in the shop is bursting with homegrown goodies that even my lack of a green thumb can’t ruin. Vegetable dinner plates really pop against the beautiful, cheerfully colored chargers. Each one is cuter than the last, and I can’t decide which design I like best. Luckily, they are adorable as a matching set or mixed. Since it is still too early for fresh garden supplies, we have adorable faux veggies and herbs saving the day and looking good enough to eat (but I wouldn’t recommend it). A bowl of tomatoes can create a stunning countertop display, while a few herbs in a pot can make a table topper that puts a smile on your face. It has all the charm and allure, without spending a day in the garden. Soon we will be toiling in the soil for all natural goods, and I can’t wait for that either. In the meantime, I am chasing my winter blues away one place setting at a time.

Ten Tricks for Showing Your HomeThat Makes it Pop! Here’s what you can do to get your home ready for its big reveal, whether it be an open house or showings! 1. Time It Right Showings and even some open houses are by appointment these days and might limit the number of people in your place at once. To maximize traffic, avoid having your open house during holidays, big community events or unofficial “holidays” like Super Bowl Sunday. 2. Let Your REALTOR® Take the Lead In your own personal Home Show, your REALTOR® has two roles. To you, they are the director, giving you instructions on how to prepare for visitors and what to do during the event. To buyers, your REALTOR® is the host. They will welcome viewers, introduce your home’s impressive features, and take questions from the audience. The job of your REALTOR®, an expert on your local real estate market and what makes buyers tick, is to take care of the rest. Your REALTOR® can also stage a broker’s open house on your behalf. Unlike standard open houses, where buyers can stop by, at broker’s open houses, only REALTORS® are invited to attend. 3. There are two main benefits of having a broker’s open house: • It gives your listing more exposure. • It allows you to get feedback from real estate agents on your home. • Try Some Simple Staging You want your home to look its best while it’s on the market — especially during the open house. Many REALTORS® say the best way to primp your home for its big day is to stage it. Depending on what your REALTOR® recommends, staging may involve renting new furniture or decor for certain rooms in your home. There are also some easy staging tricks you can try on the day of your open house. Consider displaying a bouquet of fresh flowers in the entryway or setting your dining room table to make it look inviting. 4. Clean Like Crazy When your home is on the market, you need to keep it in showing shape — not only for the open house, but also for any scheduled showings with buyers. Even though you’ve already (hopefully) cleaned and organized your home for its listing photos, there’s a good chance you’ve let clutter or dust pile up again, especially if you have children or pets. 5. Do a Smell Check If buyers get a whiff of something funky, they’re going to run — not walk — out of your open house or showing. A week prior to the open house, ask your REALTOR® to do an honest, noholds-barred smell check. Some possible smell solutions: • If your house has the aroma of your beloved pet(s), deep clean the carpets, relocate the litter box, and take steps to eliminate all olfactory traces of Fluffy. • If the basement is dank and musty, buy a
dehumidifier to remove air moisture and run a fan to circulate the air. • If the kitchen drain stinks, drop in a cup of baking soda, then two cups of white vinegar. Enjoy the bubbling, then let the mixture sit for 20 to 30 minutes. Finally run hot water for 15 to 30 seconds to flush the odor. 6. Put Your Pictures (and Valuables) Away You want your home to feel cozy and inviting, but not like someone specific (you, for example) is living there. Personal belongings such as family photos, awards, and religious art can distract home buyers and make it harder for them to imagine themselves living in your home. There’s a safety element to stowing your personal belongings, too: Though your REALTOR® will be at the open house, you’re inviting strangers into your home. Secure valuable and medications away. 7. Let the Light In Light doesn’t only (literally) brighten up your space. It also makes rooms look and feel larger. On showing or open house day, open all curtains and blinds to let natural light in. (And in the week before the event, make sure curtains and blinds are squeaky clean.) 8. Give Your House Some Extra Curb Appeal Buyers will judge your house on its outsides. So, make last-minute improvements to turn up your home’s curb appeal. Cut the grass, prune the trees, and trim the shrubs. Touch up porch fixtures and furniture with a little paint. Heck, paint the whole porch, if your budget allows. Plant new shrubs or set out potted flowers. 9. Draw Attention to Your Home’s Best Features After your REALTOR® signs in and welcomes buyers to your home, they typically will have some time to wander around on their own. Even though you won’t be there, you can still draw visitors’ attention to features in your home that you’d like to highlight. 10. What to Do During and After Showings Once you’ve done everything you can to make your house look and feel amazing to buyers — and your REALTOR® is on site to assume their hosting duties — the time during your showings is yours to enjoy. Go to the park, get a three-course lunch, do whatever you like as long as you’re free to take calls. After the showing ends, your trusted REALTOR® will share with you what questions buyers asked and any comments they overheard by visitors. Buyers’ remarks will likely run the gamut, including some that could be negative. (“Why is the closet such a mess,” for example.) The important thing is to stay open to buyers’ feedback, and to follow your REALTORS® advice about how to respond. Based on buyers’ reactions, they may recommend that you make certain repairs, do some painting, or invest in additional staging before your next open house. Whatever they advise, it’s not personal — it’s just the business of selling your home.

However, the roots of New Traditional are always firmly planted in the past. As someone who is inspired by the styles and motifs found throughout history, there is no better style to align myself with and to explore. While the evolution of decor is never done, certain staples tend to hold on through the passing fads. One such item is the ever-charming ginger jar. Ginger jars have been around long before the English starting using them to bring beauty to their sitting rooms. These must-have accessories originated in China and have been around since at least the Ming Dynasty period (1366-1644) when they were used to transport spices, oil, salt and other goods to Western countries. Now, of course, once Europe saw how beautiful these cargo containers were, they became highly coveted accessories for homes. The beauty of these jars comes from both their unique shapes and the traditional surface designs. The most classically well-known ginger jar is customarily blue and white with stunning hand-painted designs that often feature human and animal figures, landscapes, blossoms, symbols and much more. While my love for original Asian toile patterns is still going strong, it is certainly fun and exciting to see all the wonderful options you can bring into your home today for your own collection. One thing that has stayed the same throughout the revival of ginger jars is their stunning form. Known for their easily identifiable high shoulders, small openings and domed lids, they are fabulous additions to any room. With a large range of sizes available, it is easy to work ginger jars into many a display. I love to use medium and small sizes in clusters (usually two or three) to create a statement vignette that provides a pop of elegance to a room. The large and extra-large jar sizes (some are almost as tall as I am!) are perfect for flanking a fireplace or doorway to add a punch of symmetry. Ginger jars are versatile and perfect for decorating all year long. For everyday use, I enjoy them as stand-alone pieces, but it’s easy to pop off the lids to use them as floral containers. They also make wonderful additions to bookshelves and pair wonderfully with other containers, decorative boxes, and of course, books. The possibilities are endless! And if you haven’t read up on the rich history of these beloved pieces, I highly recommend grabbing a gaiwan of tea — in blue and white of course — and digging in. Adapted from nellhills.com.
