A Law That Came Too Late

Dishwasher Not Draining Properly Question: Our dishwasher is no longer draining correctly and has standing water in the bottom. It is less than 10 years old so it seems like it should have lasted longer than it has. Should we call an appliance repair service or just have a new dishwasher installed?

During the onset of the Covid-19 pandemic, HOAs were presented with a conundrum: Local health authorities prohibited gatherings of more than a few unrelated persons; however, HOA boards were required by the Open Meeting Act to have meetings that included the option of personal physical attendance, even if most members chose to participate telephonically or virtually. For over a year, most HOAs and their managers and lawyers decided that it was more important to follow the emergency health orders and conducted purely virtual meetings, which technically violated the Open Meeting Act. Specifically, the meetings did not include a physical location where someone could attend and listen to the deliberations. This violated Civil Code Section 4090(b)and Section 4925(a), which require that there is a “physical location” with at least one director or person designated by the board in attendance. After evaluating whether to violate health directives or the Open Meeting Act, most lawyers decided that violating the Open Meeting Act was the lesser sin, and so the vast majority of HOAs met via purely virtual platform without a physical location announced. On September 24, 2021, the Governor signed into law Senate Bill 391, which as an emergency statute became effective immediately. It created a new Civil Code Section 5450, allowing HOAs during declared emergencies to have purely virtual meetings with no announced physical location. The new statute also requires certain disclosures to the membership and changes in board meeting procedure during these purely virtual meetings. Subsequently, many if not most HOAs still conduct purely virtual meetings, mistakenly thinking that the new law essentially ratifies the practice. However, the law was enacted far too

late to really be a help to HOAs during THIS emergency. SB 391 may be of great help during the next emergency, but not this one. The key language in the new Civil Code Section 5450 is that the governmental declaration of emergency must render the ”gathering in person … unsafe or impossible.” If so, and after the HOA makes certain disclosures to members, it can meet purely virtually. In early 2022, I do not know of any county presently banning or declaring unsafe small, in-person meetings of unrelated persons. Unless a local, state, or county government declares an emergency and prohibits small meetings of unrelated persons or declares them unsafe, Civil Code Section 5450 is inapplicable and HOAs must still comply with Civil Code Sections 4090(b) and 4925(a). Associations have in the past two years learned the great benefit of adding a virtual component to their board meetings. That component remains a valuable addition to HOA governance, as members who are traveling, ill, or otherwise unable to attend can observe their HOA governance. However, it is time for HOAs to return to full technical compliance with the Davis-Stirling Act and begin to provide for a physical location with one director or other designated person (the manager?) to attend. These “hybrid” meetings may well be the “new normal” for common interest communities, as we all welcome physical or virtual attendance. Associations would be well-served by some modest acquisitions of affordable sound and/ or video equipment to enhance the experience of virtual attendees. Consider modifying the HOA’s meeting procedures and embrace the new normal of both virtual AND personal attendees at board meetings.

Your HandYMan: If the dishwasher drain line is not clogged with food particles that are preventing it from draining into the garbage disposal, then it probably is suffering from a worn-out water pump which will need to be replaced. Sometimes repairing an older appliance can end up costing nearly as much as buying a new

appliance, so you are wise to consider which option to pursue. A friend of mine in the appliance repair business shared with me his anecdotal rule of thumb that if the appliance is older than 5 years or was purchased for less than $500, then it is best to replace it rather than spend money to repair it. I know this may sound a bit wasteful, but it seems to hold true. So, if there is no obstruction in the drain line, in my opinion you are best off to bite the bullet and purchase a new dishwasher. The good news is that new appliances are quieter, use less energy, and generally work better than their age worn predecessors.

What are my legal options after handshake deal over vacant lot? By Gary M. Singer

Question In 2014, I struck a deal to buy my neighbor’s vacant lot behind their house. We shook hands in front of a witness. According to our deal, I immediately wired the money to his account and paid the property taxes yearly. Last week I noticed a for sale sign on my lot. I called him to ask what was going on, and he told me that it was already under contract. He offered to give me my money back. I want to keep my lot. Do I have a legal leg to stand on? – Peter

Answer

You do have options to keep your lot, but they are limited because of your handshake deal. The “statute of frauds” is a legal doctrine that tries to protect people from dishonest behavior by requiring certain agreements, including those involving the purchase of real estate, to be in writing. That said, like most rules, there are exceptions. One exception to the statute of frauds is when one party does what they promised to do. In your case, you wired the purchase price to your neighbor. You completed the performance of your obligations by doing that, and your neighbor should have deeded the property to you. Even if you had only paid part of the purchase price, you could still sue your neighbor to require him to finish the deal, what lawyers call “specific performance.” You would still need to pay the rest of the purchase price. Avoiding this situation is part of the reason that deeds are recorded in the public land records. Since you do not have a deed, you can still lose your interest to an unsuspecting purchaser. You need to act fast and find an experienced local attorney to help you get your lot put into your name. Gary M. Stay on top of these kitchen trends for 2022 By Avery Newmark Homeowners are making room in their budgets to prioritize kitchen remodeling and renovations, according to a new study. Houzz, the leading home renovation and design platform, recently released its 2022 U.S. Kitchen Trends Study, which gathered information from 2,400 homeowners who are planning, in the middle of, or have recently completed a kitchen renovation. “We’re seeing a rise in overall kitchen renovation spend as homeowners not only splurge on specific features but also make major modifications to the kitchen layout, systems and walls, many of which require the assistance of licensed home professionals,” Marine Sargsyan, Houzz senior economist, said in the study. Here’s a rundown of some of the key trends that homeowners want to see in their kitchen remodels in 2022: Countertop central Countertops were the most commonly improved feature during kitchen renovations, with more than 9 out of 10 homeowners upgrading them. Engineered quartz

remains the most popular material for upgraded kitchen countertops, with 42% of homeowners opting for it. While granite remains the second-most popular material, it has dropped to 24% from 28% last year, the study reports. “It is clear that homeowners are willing to spend a little more to get exactly what they want in countertops that are both beautiful and practical, despite rising prices of labor, products and materials,” Sargsyan said. And as people continue to work from home, homeowners are making room for bigger kitchen islands. Nearly two in five new islands measures longer than seven feet in length today. Homeowners are also brightening up their spaces; 92 percent installed new light fixtures above islands. High-tech appliances The second most common feature that homeowners splurge on during kitchen renovations is appliances. Over a third of upgraded appliances have high-tech features, a 6-percent increase from the previous year. Wireless and smartphone controls

are the most popular kitchen appliance features, according to the study. Beverage refrigerators You can never stock too many beverages, which is perhaps why nearly one in five homeowners install beverage refrigerators in their kitchens, and why 14 percent are adding wine refrigerators — up 50 percent from 2021. Vinyl flooring Hardwood is the most popular flooring material in kitchens, accounting for 25 percent of all installations, but vinyl is on the rise for the third year in a row, nearly doubling in popularity since 2019 to 23 percent. White and gray continue their reign Clean, coastal vibes don’t seem to be going away — white and gray are still the most popular colors for kitchen cabinets, backsplashes and walls. But blues, blacks, and greens, are trending up at 26, 10 and 5 percent respectively. You can even add visual interest to your space by using contrasting cabinet colors.

Household problems don’t follow a 9-to-5 schedule. Gas leaks, an overflowing toilet and a dripping roof don’t always wait until you’ve had your morning coffee. Emergencies are an unfortunate reality of homeownership. Severe weather can arrive at any time, and many of your home systems are complicated machines that will eventually break down due to wear and tear. While you can’t predict when emergencies will arrive, you can prepare yourself by following these tips.

1. Keep in touch with contractors

Regular maintenance benefits you in more ways than one. Not only do you catch problems early and keep your system in good repair, but you’ll build relationships with reliable contractors who are familiar with your systems. That means when you call at 2 a.m. with a burst pipe or a concerning electrical problem, the pro that answers the phone has a head start on the fix. professional who already has experience with you and your house.

2. Know what you need to do

gertips will help keep bad situations at bay. Make sure you know your most essential contractors’ names and after-hours phone numbers. Yes, you can probably look this up on your phone fairly quickly, but you’ll save time and reduce complications during what will likely already be a chaotic situation. In some cases, a pro can talk you through potential solutions right there on the phone. Another key tip — make sure you know how to shut off your home utilities. You can shut down electricity at your main panel. Water and gas lines usually have a master shut-off point outside or in a basement or crawlspace. If you don’t know where these valves are located, ask your pro to point them out for you. You’ll be grateful for the know-how if you need to cut off the supply during a gas or water leak.

3. Be prepared for triage

In some fields, emergency calls don’t come in on a consistent basis but rather stack up all at once. For example, after a severe storm or wind event, every roofing company in the region will be swamped with calls for emergency help. In those cases, experts say that they’ll do triage work to prevent the worst of immediate damage by removing the most urgent problem, covering

up leaks, and doing their best to bring it under control. There may be cases where major repairs can’t be completed immediately. Be patient with your pros during crises; the odds are everyone’s doing their best to get problems addressed.

4. Keep your home stocked

Sometimes, severe weather means help could be days away. The Federal Emergency Management Agency (FEMA) suggests that you keep your home stocked with enough supplies to get you and your family through 72 hours without outside assistance. This kit should be prepared long before a crisis and stored where you can easily find it. Go to ready.gov for a complete list of necessities and tips on managing a crisis. Also, make sure your home has at least one fire extinguisher, preferably one for each level of your home. If you have only one, put it in the kitchen, and make sure everyone knows where it is as well as how to operate it.

Home Remodeling Projects With Top-Dollar Returns Not all home improvements are created equal. These will reward you the most when it comes time to sell. Your home is in the perfect location, came at the perfect price, with the perfect lot. (Yay southern exposure!) But the home itself? Perfect isn’t the adjective you’d use. But you knew that moving in, and now you’re ready to start making it just right. Where to begin, though? How about with data? Data is that friend who tells you like it really is. Because while any home improvement that brings you joy is priceless, not all add as much home equity as you might expect. The “Remodeling Impact Report” from the National Association of REALTORS® has tons of data on how much improvements cost — and how much of those costs you can recoup. Here are some of the report’s best home remodeling projects with equity-building might: u New Roof If you find yourself sprinting for the buckets when it starts to sprinkle, getting a new roof should be your No. 1 to-do. The cost: $7,500 The return: 107% at $8,000 Considering it’s what’s between you and the elements, it’s a no-brainer. Not sure if you need a new roof? Signs you might include: • Shingles are missing, curling up, or covered in moss. • Gritty bits from the asphalt shingles are coming out the downspout. • The sun’s shining through your attic. • You notice stains on ceilings and walls. • Your energy bill is sky high. u Refinished or New Hardwood Floors You flip on the TV to see that your fave home reno’ing duo is it at again, flipping a ranch that’s stuck in the ’80s. They make it to the living room, pull back the dingy carpet to reveal hardwood floors in great condition. They’re psyched — and for good reason. Hardwood floors are a timeless classic. Refinishing is a no-brainer. Neither will you regret adding new hardwood floors if you have none. The cost to refinish: $2,600 The return: 100% at $2,600 The cost to buy new: $4,700 The return: 106% at $5,000 u New Garage Door No surprise that a garage door replacement project made it onto this #winning list — a new garage door provides a big boost for your home’s curb appeal at a relatively modest cost.

The cost: $2,100 The return: 95% at $2,000 There are options galore, too. A host of factory-finish colors, wood-look embossed steel, and glass window insets are just some of the possibilities that’ll give your doors bankable personality. u Better Insulation Insulation is tucked out of sight, so it’s often out of mind — that is, until you’re forced to wear your parka indoors because it’s sooo darn cold. The cost: $2,400 The return: 83% at $2,000 (plus the added savings on heating and cooling costs!) u New Siding In any color! And never paint again. Those are two of the three benefits of vinyl siding. The third, of course, is your home’s value. But if long-time homeowners look at you funny when you mention vinyl siding, just tell them that today’s vinyl is way better than what they remember because of fade-resistant finishes and transferable lifetime warranties. The cost: $15,800 The return: 63% at $10,000 u Fiber-Cement Siding Want fiber-cement siding instead? It also shows a strong payback of 76%. Although it’s the pricier option — you’ll spend about $19,700 with a payback of about $15,000 — it has one thing vinyl still lacks — the perception of quality. The cost: $19,700 The return: 76% at $15,000 u HVAC Replacement Air quality is top of mind these days, so replacing an HVAC system is a timely project — plus it cuts those pesky utility costs. Of the people surveyed in the NAR report, almost half said the most important benefit of HVAC replacement was better functionality and livability. The cost: $8,200 The return: 85% at $7,000 Quality matters. In a survey from the National Association of Home Builders, “quality” was the one of the most important traits home buyers focused on when house hunting. Perceptions of quality can vary, but the majority of both first-time buyers and repeat buyers said they’d rather have a smaller home with high-quality products and services than a bigger home with fewer amenities. Standby generators don’t just stand by till you need them By Ed Del Grand Question:

Ed: I’ve read your past columns on standby home generators and have a question about winter startup concerns. Since they are permanently installed outside a home, are they just sitting there in the cold till you need them to start up? – Mike

Answer:

Standby generators are a great choice for home backup power. Most residential standby generators run on natural gas or propane, and they are professionally wired into a home’s electrical system. Standby generator systems include a special transfer switch that automatically turns the generator on and off in the event of a power outage. But like any piece of equipment, you do have to maintain them on a regular basis. Your dealer/installer can set you up with a service schedule to best fit your needs, especially if you live in a colder climate. Because they operate automatically, standby generators perform a weekly exercise to run the generator for about a half-hour. This way, no matter what season it is, your generator should be ready to go. Bottom line: Weekly exercise can help keep a standby generator in tip-top shape.

Most residential standby generators run on natural gas or propane, and they are professionally wired into a home’s electrical system.
