Election by Acclamation, Self-Campaigning, and Cumulative Voting

Water Heater Leaks Question: Our home’s water heater is located in a hallway closet in the central part of our home, and we have just recently had very expensive hardwood flooring laid in this hallway, the living room and master bedroom. My wife and I are concerned about the wood floors being water damaged if the older water heater were to spring a leak. What can be done to protect our new floors? Your HandYMan: It was not uncommon for water heaters to be placed in an interior utility closet often alongside the furnace in tract homes that were built in the 1950’s and 60’s. Even the highest quality water heater is going to eventually suffer from internal rusting and start to leak, which if left unchecked can cause extensive water damage to flooring, cabinets, and drywall. Many of the owners of these homes have relocated the water heater out to the garage and the furnace up to the attic, and then converted the old utility closet to a linen closet or additional square footage for a bathroom or bedroom. If moving the water heater out to the garage is more of a project than you are primed for now, there are simple precautions that you can take to contain the eventual leak. A water heater in most any location should be seated in a shallow metal pan often called a Johnny Pan which ideally should have a drain line that allows water to drain out to the
exterior of the home. Such a drain line may not be possible in your utility closet, but the pan is still a good idea for containing a slow leak, and is also a good place to put a water leak alarm which can be purchased at most any hardware store for about $20. The alarm will sound off when any water comes in contact with the sensor and is similar in size to a smoke alarm. A seismic bracing strap kit can also be purchased at any hardware store to hold the water heater secure during an earthquake to prevent both water lines and gas pipes from breaking and to keep the tank from toppling completely over in a strong shaker. The tank needs two straps, one at the top 1/3 of the tank and the other at the bottom 1/3. The straps need to securely hold the tank in contact with the back wall or an inside wall corner in order to be effective. A tank not held in firm contact with the wall risks being torn loose as it moves about independently of the movements of house in an earthquake. Lastly, if you are going out of town for even a day or two, be sure to shut off the water supply to the house interior. This requires a separate water supply shut off valve for the house and for the outside sprinklers and hoses. Many unfortunate homeowners have arrived home from vacation to find that a minor water leak has flooded their home causing all sorts of expensive and time-consuming water damage.
Drains are Slow in Draining Question: We have three teenage daughters all with long hair who share the same bathroom and the tub drain is forever draining slow. Our house was built in the 1930’s but all the plumbing and drain lines were completely updated about 10 years ago. I have spent a small fortune on plumbers coming out twice a year or more to clear this drain and hope that maybe there is a less expensive solution? Your HandYMan: Three teenaged daughters sharing one bathroom is a true test for
even the most modern drainpipes and yes there an alternative to having your plumber’s phone number on speed dial. Try the new gel style Liquid Plumber type of drain cleaner which can be purchased at most any hardware store, and is very effective at breaking down soap crud, tooth paste, shaving residue, and hair. Purchase a few of the gallon size jugs, use monthly to keep the bathroom sinks, showers and tub flowing, and you should be able to use the money saved by not calling the plumber to help build up the college funds.

CCAL Dear Mr. Richardson: Starting in 2022, all HOAs have the option of utilizing the acclamation procedures in Civil Code §5103 when “the number of qualified candidates is not more than the number of vacancies to be elected.” My question: Do CCRs have to be changed before the HOA can implement the acclamation process? – A.Y. Dear A.Y.: No, the CC&Rs do not have to be changed (unless they specifically bar acclamation). The new Civil Code Section 5103 is a boon for most associations, but there are several procedural requirements which must be followed to preserve the option. For example, the election process must begin 60 days earlier, since the first membership notice regarding acclamation must be 90 days before the deadline for nominations (Civil Code Section 5103(b)(1)). There is a second notice between 7 and 30 days before close of nominations, and a prompt response is required to each nominator and nominee. Updating HOA election rules and incorporating the process required by Section 5103 is a good idea. That amendment need not pursue the twostep, 28-day notice process required for most rule changes, because rule changes that”merely repeat the existing law” are exempt from the process pursuant to Civil Code Section 4355(b)(5). So, this amendment could be accomplished in one open board meeting with the normal agenda notification. – Thanks, Kelly Hello Kelly, I’m wondering if a homeowner can request all members’ contact info from the manager in order to send out a “vote for me” email to everyone? Dear L.L.: Under Civil Code Section 5200(a)(9), members can request and receive a copy of the names, address, and email address of any member who has not opted out of allowing that information to be shared. Civil Code Section 4515 protects the right of members to campaign, and the middle 30-day period provided for by Civil Code Section 5115(b) seems to be intended to allow the nominees to campaign before ballots are sent out. Therefore, yes; any homeowner can do what you describe. – Sincerely, Kelly. Dear Kelly, We tried to get a bombastic braggart off the board by a vote. He interrupts and has even stood and approached board members threateningly. He has told homeowners to shut up. We even called the police once to get him to stop his antics. To accomplish removing him we had a special meeting. We had a quorum, but according to the attorney’s formula, he got to stay. I just can’t believe the recall formula that our attorney had us use is fair. I would appreciate your opinion on the recall formula. – D.S. Dear D.S.: I can tell from your narrative that the governing documents provide for cumulative voting, in which a member can stack their votes for candidates instead of casting one vote per candidate. Cumulative voting makes recalling individual directors very difficult, because under Corporations Code Section 7222(b)(1) the “no” votes count for more than the “yes” votes. This is yet another reason why most HOAs remove cumulative voting when they update their governing documents. Cumulative voting creates more problems for HOAs than it helps. – Best regards, Kelly.

Question: Ed: I’m looking to replace our tub/shower curtain with a glass door. I’ve noticed there are are a lot of choices to go through. Can you please help me cut through the shower fog and guide me through the basics of ordering a shower door? – Pam
For a door type, aside from custom stalls or steam showers, in most cases you’ll have just a few basic glass door choices.

Answer: When visiting a local home center, know the shower stall measurements and the type of glass door needed. To size up the alcove opening, get side-toside and top-to-bottom measurements. If you have a tub and shower unit, measure up from the top deck of the bathtub front wall. Also, take two sideto-side stall measurements, one high one low to check how square the alcove is. Bring along photos as well.
For a door type, aside from custom stalls or steam showers, in most cases you’ll have just a few basic glass door choices: a sliding shower door for large walk-in showers, a swing-out pivot door for smaller shower stalls, and a sliding tub and shower door for combo units. Finally, you can even add fancy options like decorative finishes and textured glass to give your shower door a touch of class.

Ed: We’re doing a kitchen remodel to include light fixtures and I have a few questions. What is pendant lighting? Is it different from chandelier lighting? If so, how do the costs compare and are there advantages to pendant lighting fixtures? – Gail
Answer: From conversations I’ve had with lighting salespeople, the basic explanation on a pendant light seems to be that it hangs from the ceiling and through a various length wire, tube or chain, it supports only one decorative light. This may differ from a chandelier that can support multiple lights on a single fixture. But definitions can be open for discussion, since lighting is a huge category with many variations. As far as pendant light costs compared to chandeliers, you need to compare apples to apples and with that, chandeliers may cost more per fixture. However, you may need a few pendant fixtures in place of one chandelier light. For custom lighting, strategically placed pendant lights can have advantages. Finally, for a bright idea you can even group several pendant lights for a fun chandelier-like look.

What Does Homeowners Insurance Cover? You’d be surprised at what your home insurance policy doesn’t cover. Here’s what is and isn’t covered by your insurance. What does your homeowners insurance cover? The short answer is: A basic homeowners insurance policy covers your home and possessions if they’re damaged or destroyed by these things: • Fire • Lightning • Windstorm (unless you live in a hurricane zone) • Hail (not available everywhere) • Explosion • Riots • Civil commotion • Aircraft (and things falling from aircraft) • Vehicles (and things thrown from vehicles) • Smoke • Vandalism (although some policies exclude this) • Malicious mischief • Theft • Volcanic eruption But many states don’t allow this basic policy to be sold. Instead, you have to buy an upgraded policy that covers more perils. Upgraded Homeowners Insurance That upgraded policy adds protection to your home and possessions from even more perils. You get protection from everything on the list (above) plus: • Falling objects • The weight of ice, snow, or sleet • Flooding from your appliances, plumbing, HVAC, or fire-protection sprinkler system • Damage to electrical parts caused by artificially generated electrical currents (such as a power surge not caused by lightning). But damaged electronics such as computers aren’t covered. • Glass breakage • Abrupt collapse (say from termite damage) That same list applies to the homeowners insurance you buy for a condominium or co-op. The Most Complete Homeowners Insurance
The most complete and protective form of homeowners insurancecovers you for all perils except some specific ones like: • Floods • Earthquakes • Wars • Nuclear accidents • Landslides • Mudslides • Sinkholes What Homeowners Insurance Doesn’t Cover No matter which basic policy you get, it’s not going to cover everything than can damage or destroy your home. Typical homeowners policies don’t cover: • Bad things that happen because you failed to maintain your home (like mold) • Hurricanes • Floods • Earthquakes • Mudslides • Landslides • Sinkholes • War • Nuclear accidents • Sewer backups • Sump pump failure • Ground movement and holes caused by mining (known as mine subsidence insurance) • Pollution You can buy additional policies to cover some but not all of those perils. And even if insurance is available for the most common natural disaster in your area, you may not be able to buy it if your home has features that make it vulnerable. For example, a home with unrated wood shake roof shingles may be tough to insure in an area where wildfires are common.
