Automatic Election Rules; No Ballot Box; and Term Limits

A Handrail for Cement Steps

Question: My front porch has three cement steps without any sort of handrail, and they are becoming more difficult for my husband and I to safely negotiate, especially if we are carrying something heavy like a bag of groceries. How can we get a safe handrail for these steps before one of us takes a bad fall? Your HandYman: Any fall can be a bad fall and many seniors have experienced a major decline in their quality of life after suffering a fall that a younger person would consider to be minor. The solution for making your front steps safer is a sturdy and attractive steel handrail fabricated from either wrought iron or ornamental iron, that will safely support a falling adult and hold up indefinitely to sun and rain. Wrought iron is made from solid metal bars that are heated up in a forge, and then twisted and hammered into all types of decorative designs. Ornamental iron is made from hollow posts that can’t be heated and twisted but is typically much less expensive than wrought iron, but still very attractive. The handrail posts can be fastened to your concrete steps with expanding concrete anchor bolts that are hammered into holes drilled into the cement with a masonry drill, or larger holes can be cored with a coring drill and the posts set into these cored holes with cement. The expanding anchor bolts are the least expensive method, and the bolt heads are then concealed with a decorative metal skirt that slides down the post. Most handrails are usually painted in a high gloss black but there is no reason that they can’t be painted any color that you prefer to match your home’s décor.

Dear Kelly: Our board approved the old version of the bill SB323 as is to replace our current election rules. Recently we had our annual election that was voided due to the quorum wasn’t met. I contacted the management company to inquire who was the inspector of election and it was revealed the inspector is the property manager’s father. The board members cannot appoint their relatives so should the managers? Next, I contacted the father and requested a copy of our election rules. He emailed me an old version of SB323. He keeps insisting that SB323 is our election rules. Can SB323 be adopted as is to replace an HOA’s election rules? – M.M. Dear M.M.: Civil Code Section 5105 requires all associations to have written election rules in place and dictates the minimum requirements of those rules. Simply declaring “we have rules” is not having rules. Per Civil Code Section 4350(a), rules must be written and adopted under the rule-making process described in Civil Code Section 5460. If your HOA is following the statutory process but does not have rules in place stating the process, it is hard to imagine a court setting such an election aside. However, it is easy to envision a situation wherean HOA could make mistakes, misunderstanding the process due to the lack of guidance from written rules. Without written rules, which of the five optional ineligibility factors apply? The statute doesn’t have automatic eligibility factors (except for the requirement of membership). Also, written rules can contain additional help for the HOA such as tie breaking procedures and candidate statement procedures, for example. Technically, nothing is improper about the manager’s father acting as Inspector. But that close relationship with the manager does raise possible conflict
of interest implications. Most smaller and mid-sized HOAs could function well with a volunteer instead of a paid Inspector. – Best regards, Kelly Kelly, Our board elections are coming soon. For the first time there will be no ballot collection box at the clubhouse. I am told by management that it is now illegal to have a ballot collection box at the clubhouse. Is this true? – Thank You, W.D. Dear W.D.: I wonder if your management considers handling the ballot box as Inspector of Election activity, and managers and other vendors serving HOAs are prohibited by Civil Code Section 5110(b) from acting as the Inspector of Election? Managers can assist the Inspector with various tasks, such as checking in members or maintaining the ballots if the Rules allow such assistance or if the Inspector requests. Managers are not required to completely disengage — they just can’t run the election. – Sincerely, Kelly Dear Mr. Richardson: Since the governor signed into law SB 432 for term limits effective 2022, does that supersede any of our HOA documents that do not mention term limits? – D.S. Dear D.S.: Term limits were inadvertently prohibited by the HOA election reforms in 2019’s SB326, because term limits were not listed as an eligibility factor that HOAs could adopt. This year, that error has been corrected, and HOAs again can have term limits. So, term limits are not required or automatically applicable to all HOAs. Term limits must be stated in the governing documents. – Thanks, Kelly

Figurines Where you might place a small or tall vase, consider using a ceramic piece instead.
Jewelry and global pieces Jewelry may not be the first thing that comes to mind when you think of an accent. However, jewelry can help to add an interesting, global element to a space.
Create a showcase for a few key accents Whether a bookcase or a shelf, look for interesting ways to display accents and accessories.
Vignettes Vignettes offer a prime opportunity for accents, by grouping them in interesting and dynamic ways.
Texture and color Accents offer an opportunity to infuse both texture and color into a space.

I co-own a house with a friend. Is it better to leave my share in a will, or should I draft a deed? By Gary M. Singer
A survivorship deed may be a more convenient and reliable way to convey a property share to a co-owning friend than a will.

Questions I own my home 50/50 with a friend. Neither of us has any close relatives that we would want to leave our half of the house. I read your article about owning a property with other people. Would it be OK to add something to my will stating that my friend will get my share of the house when I die rather than drafting a new deed making us joint tenants with the right of survivorship? – Evie
Answer
Unless you are married or have minor children, you can devise your part of the home to your friend in your will. But having you and your friend deed the house to yourselves as joint tenants with right of survivorship is a much better option for many reasons. The first reason is cost. Preparing a will is more expensive than a deed. Add the cost of probating your will, and it becomes much more costly. A survivorship deed would automatically vest in the surviving friend upon the first death — no need to file for probate. The deed method also avoids any issues with creditors that remain when you pass since the property goes to your friend outside of probate. Both the deed and wills can be changed at any time by you and your friend. However, because deeds are freely available in the public records, you will know if your friend changes her mind and decides not to leave her half to you. Wills are private, and you would not know if they were changed until after her death. Also, if either of your wills gets lost or destroyed, your intentions might not be carried out. This is not an issue with a deed because it is recorded in your county’s land records. In most legal matters, such as estate planning, there are many ways to accomplish your goals, but not all methods work as well or are as efficient as others. Gary M. How Smart Home Technology Can Be a Selling Point You often judge a house by it’s good looks. But guess what? Now you can also judge it by its IQ. Long-buzzed about smart home technology — think smart thermostats, smart lighting, and app-controlled security systems — are moving into more homes. Smart home tech can up your coolness factor and make homes easier to operate. Plus, it may also offer perks when you sell your home one day. Home shoppers are increasingly looking beyond that killer kitchen upgrade to a seller’s Wi-Fi signal and connectivity. This isn’t just a priority for the techie set. As smart home technology gets more affordable and easier to use, more people are adding devices. Half of U.S. consumers owned at least one smart home device in 2021, up from 35% in 2020, according to NPD Connected Intelligence. A Home’s Technology Smarts Matter Here comes a potential home buyer. Motion-activated lighting automatically turns on as they enter. A smart thermostat adjusts the temperature for ultimate comfort. The smart robot vacuum is keeping the home tidy. The window blinds are adjusting based on the sun’s direction. And the smart speaker is telling them about the home’s features. Four in 10 Americans have bought a smart home device since the COVID-19 outbreak and are more interested in smart home technology, according to a 2020 REALTOR.com study. The pandemic has driven smart home technology forward. How we interact with our homes is becoming different. At some point, buyers will expect it. The majority of real estate professionals believe smart home technology can help in marketing a home, according to the organization’s 2020 report on smart technology. In fact, some real estate professionals are already using smart home features as selling points. You may spot more icons on online 3D tours of real estate listings that flag smart technology inside a home. Smart Home Technology Costs and Buyer Preferences Consumers between 18 and 34 said they would pay more for homes with home theaters, smart speakers in every room, and connected kitchens, according to the REALTOR.com study. In the 25 to 54 age group, consumers said they’d pay more for solar roof tiles and home battery packs. And for those 55 and older, solar roof tiles, smart doorbells, and security systems would be worth extra money. Fully automating an entire home with higher-end systems could cost upward of $15,000. But an appraiser would factor in such a system at resale. Boosting Marketability with Smart Technology You can easily add smart home technology to modernize an older home and help it compete with newer ones. After all, many homebuilders offer smart home packages to outfit new homes with smart thermostats, app-controlled garage doors, smart lighting, door locks, and video security systems.
Smart home technology investments can range from $20 for adding smart lightbulbs to $20,000 or more for automated solutions that connect systems in one hub for an entire house. For $1,500, you can outfit your home with multiple systems like a smart speaker, smart lighting, and a smart thermostat to increase the home’s smart tech appeal. For about $5,500, homeowners could automate the lights, door locks, and thermostat, and install a smart speaker, hub, and smart plugs in three rooms, according to FixR.com. Regardless of how extensive your devices are, real estate professionals will typically want to spotlight them. Buyers may not have a lot of knowledge of smart home technology, but they do know and understand energy savings and cost savings. For example, a Nest consumer survey estimates that the company’s smart thermostat could reduce a home’s heating costs by 10% and cooling costs by 15%. What Else Adds Smart Tech Appeal Bigger brand names in smart home technology — like Nest, Ring, and Lutron — have instant name recognition when selling. Ease of use also counts. For example, having to open several apps on a phone to control various aspects of a home can feel cumbersome, but being able to say, “Hey, Google, turn on my lights!” shows convenience. With smart devices, you’ll need to be clear about what stays and what goes with the home sale. It’s a gray area with some of these devices on what’s considered personal property. For example, digital assistants like Alexa or Google Home may be used as your smart home hub. But sellers may consider these personal property to take when they move. So, it’s really important to get this all in writing so there’s no question at the end of a transaction. 3 Ways to Avoid Misunderstandings About Smart Home Tech 1. Find an agent with smart technology expertise. They can help avoid hiccups in selling a smart home and also tend to be savvy marketers of smart tech. 2. Identify which of your smart home technology devices or apps are real property versus personal property. In general, items affixed or hardwired to a house stay — likely your smart thermostat or any switches and mounts. If you plan to take your Nest thermostat or Ring doorbell, replace it before listing. The buyer could figure that anything in the house at a showing will remain with the house. 3. Turn over the virtual keys. On closing day, turning over the passwords in a smart home is like turning over the key to the front door. For all transferable technology, reset it to factory settings to erase any personal data. Leave instruction manuals or website links for the new owners to open up new accounts. Smart home technology is improving safety, security, and convenience in homes. Homeowners should also consider the benefits they’ll have when they sell one day. Just like curb appeal, high home appeal may make your home a standout to buyers.

be on all collectors’ must-have list as it features long narrow petals with fringed edges giving a spidery look. The flowers are large too, reaching 4 1/2 inches wide. These new introductions get about 24 inches tall with an equal spread. Marshmallow is a little shorter topping out at 22 inches. They are considered perennial in zones 5-9 the quintessential cottage flowers to be planted in sweeps or drifts with blue salvias, yellow coreopsis, rudbeckias and coneflowers or echinacea. Son James always pushes the envelope and thus has taught me over the years that Shasta daisies like Banana Cream or Daisy May can bring this same floral show to containers and tubs to be enjoyed in commercial settings by customers going to shop or dine in local restaurants. These pristine white blooms indeed light up the spring and summer garden like few other flowers. No matter the variety you select, know they will need at least six hours of sun and wonderfully tolerate a little afternoon shifting shade. The soil must be fertile, organic rich, moist and very well-drained. If plagued by tight, heavy soil that doesn’t drain, then amend with 3 to 4 inches of organic matter and till to a depth of 6 to 8 inches. This regimen gives clear indication why they have the ability to work so
well in mixed containers as potting soil certainly drains freely. Space plants 12 to 15 inches apart. Plant at the same depth they are growing in the container. Apply a layer of mulch after planting. Of course, in mixed, designer-type containers, you’ll be using the Shasta most likely as a pocket or filler plant complementing all the other companions. Maintain moisture through the long hot summer and feed with a light application of fertilizer every four to six weeks. Keep the flowers deadheaded for both a tidy look and increased flower production as these vigorous varieties often are known to repeat. Divide in the fall, spacing as recommended. This will be a yearly event in the South if you want the best blooms and healthiest plants. In the exclusive shopping center mixed containers, the plants will be removed in time for cool season color, but they did their job, as the shopping experience felt as though you were in the Garden of Eden. You, on the other hand, can leave yours in the container, or better yet move them to the landscape in the fall. Shasta daisies have the ability to give the gardeners years of perennial performance with just a little work.
