Tips for artificial greenery By Cathy Hobbs When it comes to successful home decor, the secret often lies in the finishing touches. Often adding living or green elements such as trees and plants can help invigorate a room. But what if the associated maintenance isn’t feasible? This is when you can use artificial greenery as an aesthetically pleasing alternative.

• Pay attention to color. A richness of color is important when it comes to artificial flowers. You will want to have selections that won’t fade or loose significant color. • Avoid dried or silk flowers if looking to create a modern space. Dried flowers tend to work best in traditional or formal spaces. • Consider texture when looking for artificial flowers and stems. • Use artificial arrangements that are the appropriate size, height and scale. • Place artificial arrangements in areas where you would place live arrangements such as side tables, consoles and dining and coffee tables.

• Avoid placing artificial arrangements in direct sunlight. • Maintain artificial arrangements by cleaning and dusting their stems and leaves. • Look for trees with large leaves in large spaces as well as spaces with tall ceilings. Small plants and plantings work well in smaller areas and spaces. • Consider non-floral artificial elements such as palms, berries and other non-florals. • Bathrooms, entry consoles and small side tables are great locations for smaller artificial arrangements. Larger arrangements work well on larger surfaces such as dining and coffee tables.

Membership Quorum Is Important AND Attainable!

What can I do to stop my neighbor’s tenant from making messes in common areas? By Gary M. Singer

CCAL Some of the most important HOA decisions must be made by membership vote, but many associations cannot make those decisions because they fail to attain quorum. “Quorum” is the minimum number of members participating (in person, by ballot cast in advance, or by proxy) so that a membership vote can be taken. The failure to attain quorum can prevent the HOA from making actions such as election or recall of directors, major assessment changes, or amending CC&R’s or bylaws. Minimum Quorum. Membership quorumis needed for decisions by the entire HOA body, not the board. Bylaws usually specify the required membership quorum, but if the governing documents are silent, Corporations Code 7512(a) applies a quorum of one third of the members. The common quorum in many bylaws is 51% or a majority of the voting power. “Voting power” is the number of members entitled to vote, but under Civil Code Section 5115(c) all members vote, so that term now means “all members.” Unfortunately, many associations have been unable to attain quorum for years and cannot elect directors. In such associations, the boards simply appoint to fill board vacancies as they arise. One client association received a recall petition demanding election of a new board. Unable to achieve a quorum in over five years, the board agreed and asked the petitioners for help! Membership quorum is also critical because HOAs cannot take advantage of the election by acclamation process unless there has been at least one valid election conducted in the prior three years. Tips toward meeting quorum. 1. Some associations make their annual meeting a social event, with a party or catered snacks during or following the

meeting, or simply a “pot-luck” meal accompanying the meeting without HOA expense. 2. Make sure the voting materials are easy to follow and the ballots are clear. Members might abstain if they don’t understand the issue. 3. Investor owners often do not participate in HOA governance. Ask them for “quorum-only” proxies, so the other members can make decisions. 4. Consider a prize drawing for those that vote in advance, attend, or give a proxy that is voted (if voting proxies are used). The expenditure can be added to future budgets as part of the annual meeting cost. 5. Amend the bylaws by membership vote state that after failure to attain quorum the meeting can be adjourned to another date with a reduced quorum of 25% of members. There is an urban legend that a 25% reduced quorum is found in the Corporations Code, but that is incorrect. Some lawyers recommend eliminating quorum, but that recommendation ignores quorum’s purpose. Quorum provides stability by ensuring decisions have broad-based member support. Except perhaps for electing directors, preservequorum minimums. Membership decisions should be made by a representative group and not a small handful of members. Corporations Code Section 7515 provides a “last resort” provision allowing courts to dispense with quorum requirements upon a finding that it is “impractical or unduly difficult” for the association to conduct a meeting. This requires a court petition (legal expense) with proof that the association tried and failed. Don’t give up. Quorum is important and achievable. Remind neighbors that, to paraphrase Paul Sweeney, “[HOA] Democracy, like love, can survive any attack— save neglect and indifference.”

Questions My neighbor in my high-rise condominium rents his unit to a Section 8 tenant. The tenant tracks grease onto the hallway carpets, leaving ugly stains, often makes a mess of the common area laundry room, and often smokes in common areas where it is not allowed. I have documented these complaints to the property manager with no visible action. What further action do you suggest?

Answer

Before I can address the core of your question, I need to clarify that the tenant’s rental assistance has nothing to do with their rights and responsibilities. In some jurisdictions, it is discriminatory for a landlord or community association to even consider a tenant’s source of income. Stated otherwise, the tenant receiving rent assistance has no effect on your situation. That said, when a tenant, or unit owner, damages association property, they can and should be held responsible. The same goes for rule violations, like smoking in common areas. While it will not be possible to evict a tenant for violating community rules or damaging the property, their landlord can be held financially responsible for the damage and face fines for the tenant breaking the rules. If the owner does not pay, the association can collect rent directly from the tenant to get paid. If these financial incentives do not fix the issues, both the association and other unit owners have other options. It is the association’s responsibility to make sure the community rules are followed. Your condo can sue the unit owner and tenant to get an “injunction,” which is the court’s order to stop a specific behavior. Not abiding by a court’s order can have serious ramifications, including spending some time in jail, although it rarely comes to that. If the tenant’s behavior directly damages a neighbor’s use and enjoyment of their home, the aggrieved unit owner can sue the landlord and tenant if the association does not. Gary M. Petunias’ hearts paving the way for Blind Love By Norman Winter

The past couple of years there has been a lot of love in the world of petunias, thanks to one unique variety by the name of Supertunia Lovie Dovie. We have all seen petunias with stripes, some stars, others halos and blushes, but this is a special one with hearts. It’s funny, Proven Winners doesn’t tout them as hearts, but rather white and pink. They let the name “Lovie Dovie” say it all. It is like you fall in love with a Supertunia and the hearts magically appear. This year they have a special national recipe for you to buy or create yourself. It is called Blind Love. Oddly the phrase itself is a bit of an oxymoron, with this recipe suggesting you would love it even if you couldn’t see it. To me, petunias

have a wonderful fragrance, but I seriously doubt that is what they are referring to. Then you might possibly be thinking they are suggesting love is blind. In other words, you would love this recipe even with all its imperfections. But it has none. Maybe they were really thinking you would fall madly in love with this recipe and it would be the highlight of the 2022 growing season. There is a high probability this is their answer because as you look at a Supertunia that has white hearts edged in hot rose pink, you get a smile and a wonderment of how such things were even created in the world of plants. 6 Gotta Do’s in April for a Worry-Free Summer Tackling six simple tasks now gives you a head start on spring. That leaves you plenty of worry-free time to enjoy the warmer weather. #1 - Tell Insects to Bug Off Early spring warmth awakens insects, so start to protect your home now. Seal openings in eaves, decks, and other structures to keep out carpenter bees. Nix mosquitoes by eliminating standing water or treating it with larvicide. Call a pro to destroy wasp and yellow jacket nests, unless you’re experienced enough to engage in a bee battle. #2 - Prep Tools for Lawn Care Ladies and gentlemen, start your mowers. April’s the month to get this vital piece of equipment ready to roll. An unmaintained machine can cost money, slow you down, and leave your lawn vulnerable to disease. So, before you pull the starter rope: • Replace spark plugs and the air filter. • Change the oil and sharpen blades. • Fill the tank with fresh gasoline. While you’ve got your gloves on, clean, sharpen, and repair your garden tools. When your azaleas are ready to prune, you’re not going to want to keep them waiting. #3 - Tune Up the Air Conditioner With flip-flop weather comes another summer tradition: cranking up the air conditioning. Tune up your AC in April, before the mercury and service rates rise. Ask your HVAC company if they have a twice-a-year maintenance plan. Often, you can get discounted rates if you join, and you don’t have to worry about finding someone to do it each spring and fall. #4 - Check the Attic (and Garage) How long has it been since you looked in the attic? April’s the time to inspect this often-ignored space — before it gets too

hot. Look for signs of animal activity (raccoons love attics), and repair or replace damaged insulation or wiring. Ensure stored items are still secure; tighten container lids and dust covers and replace moth repellents. While we’re talking storage, how’s the garage? If soccer balls, bikes, and luggage have taken prime parking space, regain control with a storage system. Your car (and your partner) will thank you. #5 - Clean Up Bird Feeders Besides spreading diseases to birds, dirty bird feeders attract rodents and hurt curb appeal. Gross. Give your bird feeders a deep clean — not just a rinse-out. Empty them, take them apart, and wash with a solution of one part bleach to nine parts hot water. Rinse well to remove all traces of bleach, air dry, and refill with seed. Clean under feeders, too, because moldy or spoiled seed on the ground can make pets sick. Don’t forget the bird bath. A pretty yard that’s a healthy haven for birds makes a good impression — one that says “this is a well-caredfor home.” #6 – Changing your Smoke Alarm/ Carbon Monoxide Batteries Please remember to change the batteries in your smoke alarm and carbon monoxide alarms. The old adage is to change them when the time changes, so if you forgot to do it last month, then now is the time. This list really has nothing to do with buying or selling a home, however when you are spending so much money for your home these days, it makes perfect sense to maintain it properly. While this recipe is definitely simple, it has award winners written all over it. I guess you would think that, after all, the ingredients of the recipe are award winners. But here is what I have noticed over the last few years, and you will too: Whatever you use Supertunia Lovie Dovie with becomes a stunning combination. James, my color design guru son, has been dazzling clients with his creations at shopping centers and office complexes the past few years thanks in large part to the inclusion of Supertunia Lovie Dovie into his designs. One of my favorites was like the flower world’s A-team. He used Supertunia Lovie Dovie with Supertunia Vista Fuchsia, Luscious Royale Cosmo lantana and Truffula Pink gomphrena with a giant Alocasia elephant’s ear. This was like a tropical mix adorned with pollinators. In a similar container he added Hydrangea paniculata, Little Quick Fire. A look at Supertunia Lovie Dovie’s resume will be like the flower versions of the Academy Awards: Top Performer Michigan State, University of Minne-

Toss in a couple of Perfect Score All Season Awards from Oregon State and Oklahoma State, and you begin to get the idea. These petunias will give you their hearts, if you will, if you select a site in full sun. As good as these new petunias are, don’t expect wonderful success without proper bed preparation. Take the time to work in 3 to 4 inches of organic matter and till to a depth of 6 to 8 inches. More than likely, you’ll be growing these in baskets or mixed planters. These will need to be fed regularly because as you apply water frequently, each dose leaches out nutrients. I like to use a diluted, water-soluble fertilizer every two weeks. You will really be amazed to see the new shoots that will initiate if you maintain your fertilization program. Don’t be afraid to cut your petunias back. You will often find that cutting back and adding a little fertilizer helps them survive August and look wonderful through the fall. Don’t forget those Perfect Score All Season awards. I’m sure you will agree that in 2022, we could all use a little Blind Love — and Lovie Dovie will help you get there in your garden.
