First Quarter 2022 Real Estate Market Update By Sue Irwin, Realtor So here we are, two years after the country held its breath and waited out the first phase of the pandemic — lockdowns, economic slowdown, personal losses, societal upheavals and all. During that spring season two years ago, a relatively robust winter real estate market came to a near standstill, and we were trying to figure out how in the world to sell houses without spending time in person with our clients and agents, or at least how to be with them as little as possible. Everyone adapted, and the importance of home took front and center in our communities. With that, the real estate market took off like crazy. Have things slowed down at all since then? The answer is both yes and no. For this year’s first quarter (Q1), the number of closed escrows is down 21% for houses and 25% for condos compared to last year’s record shattering performance, but the drop in sales is actually on par with a drop in the number of listings that have come on the market. If there were more properties to buy, there would be more sales. And to add some perspective, this year we are still well above the number of sales in Q1 for all five years previous to 2021. So far, it’s a busy year. Given there were fewer sales than last year, you’d think the pace of sales might have slowed, but it hasn’t. Buyers, sellers and agents are experiencing first hand how quickly sales go from just listed to pending to closed. The pace of sales can also be numerically measured as “months of inventory” (MOI). This is a theoretical number of months it would take to sell all the properties on the market if sales continued at the same rate and nothing new came on the market. The bottom of the chart’s “Months of Inventory” column shows 0.6 months of inventory for homes and condos combined throughout the South Coast in Q1. That’s a little over half a month. Even with fewer sales this year, the pace of sales is even faster than last year, which came in at 0.7 MOI for combined homes and condos. If you are out there trying to purchase a home or condo anywhere on the South Coast, you know first hand that you have to move quickly to get your offers in when a property you like comes on the market. There’s no time to hem and haw. The MOI numbers also reveal how strong of a buyers market or sellers market is in play, with a balanced market being in the 3.0 to 4.0 months of inventory range. The lower the number, the stronger the sellers market, and the higher the number, the strong the market favors buyers. On our March 2022 chart, there’s something we’ve never seen before: an MOI number of 0.1! This is for the condominium market, so theoretically, at the end of March, if no new condos came on the market, then the condos available for sale would have all been under contract in 1/10th of a month — 3 days. The condo market is where entry level home buyers can still get into a property for under $1 million, so that is putting upward pressure on condo prices and they are selling as soon as they come on the market. This is also true for most homes as well, but the condo market is selling particularly quickly, followed closely by the market for houses in Goleta and Santa Barbara. No area of the South Coast has a build-up of housing inventory or is getting close to buyers market conditions. The number of sales is about equal to last year, and the median price of sold homes has gone from $1,186,000 in 2021 to $1,445,000 this year, an increase of 21.8% compared to the first quarter of 2021. — The number of home sales in Santa Barbara is down, but the median price has risen from $1,872,500 in Q1 of 2021 to $2,300,000 in 2022 (up 22.8%) — Although the number of sales in Montecito is down significantly this year compared to last year, the median price for sold homes in Montecito this quarter was an astounding $8,000,000, up from $5,042,500 in Q1 2021 (up 58.6%!) Sellers are still in the driver’s seat, and buyers still need to put their best offer forward, often in multiple offer situations, in order to purchase a property. Did you know? If you haven’t bought or sold a home recently, there are two practices that have become common when it comes to listing homes and making offers. Buyer letters: Buyers often submit personal letters with their offers, introducing themselves to the sellers and saying how much they love the home. While these letters can serve the buyers well if they strike the right chord, they are a legal issue for sellers when there are multiple offers coming in. Both buyers and sellers now sign a Fair Housing Discrimination Advisory, which lists “protected classes/characteristics”. By reviewing a set of letters from multiple buyers who provide personal information about themselves, sellers (or landlords and others) could possibly make decisions that appear to be discriminatory, whether they know it or not. In order to minimize such occurrences, the standard California Residential Listing Agreement now includes default language to the effect that the seller will not review buyer letters. (Sellers can, however, decide to check a box saying they want to review such letters.) The list of potential ways a person can discriminate is long, including race, color, religion, sex and gender categories and marital/family status, but also including source of income, language, age, and “any arbitrary characteristic.” It’s pretty broad, and more and more sellers are opting to not have their agents forward these letters to them. Sellers might provide all (or almost all) disclosures, inspections and reports upfront: Traditionally, buyers footed the bill for home inspections during a real estate sale and sellers provided their disclosures during the first week of escrow. Having sellers provide an inspection is slowly catching on now, and it’s really helpful when a buyer can review a home inspection

and other relevant documents prior to writing an offer — particularly if a seller has stated they want to sell the home in “As Is” condition. By providing these inspections and their seller disclosures to buyers ahead of time, buyers actually have at least some idea of what “As Is” means for that property. The less appealing side of this practice is that in a highly competitive market, it puts pressure on buyers to review all of these documents within 1-3 days before writing their offer, and to consider removing some or all of their investigation contingencies with their offer. The seller isn’t forcing this, but if buyers want a home badly enough and there is a lot of competition, removing contingencies along with an offer is an option. The real estate community does not condone forgoing your own inspections; if you are thinking this might be a good competitive move for you, please review the pros and cons of such a choice with your Realtor. Things are always changing in the world of real estate. Mortgage interest rates jumped up — they are still good rates but definitely higher than last year, making mortgage assisted purchases a little more challenging. So far the higher interest rates have not made an obvious dent in prices, but we will all be keeping an eye on this, along with price trends in general. Another topic on everyone’s minds is inflation and where that is headed. Real estate has a history of being a hedge against inflation for investors, and investment buying is a big part of what is driving the market right now — with a lot of 1031 tax deferred exchanges and second home purchases. Finally, we should note that in the past two years there has been a major influx of home buyers coming in from out of the area. The Problem with Rent Control – It Divides our Community The Santa Barbara City Council is trying to make it even harder to rent. The intention of rent control is noble, but the historical data and facts prove that rent control does not help, but instead hurts those it means to protect. Per an Economic Forecast Project report released earlier this year — Rent Control is Not the Answer: Never has Been, Never Will Be — history and data show us that “over a century of evidence [of rent control] from cities around the world points to disastrous outcomes”. With over 90% of economists agreeing that rent ceilings reduce the quality and quantity of available housing, why are we still having this conversation? We have a number of federal, state, and local laws regulating rental housing and in the past few years, during a worldwide pandemic, we’ve had to manage new laws on Just Cause Evictions, Rent Caps, COVID-19 Moratoriums, Mandatory Offers of a OneYear Lease, and Relocation Assistance. Instead of letting these new laws work and measure their effectiveness of them, rent control is being pushed because it has become an emotional and political issue instead of a broader discussion of what will really help the community. In addition to the discussion of rent control, on Tuesday, April 19th, the Santa Barbara City Council will determine if they want to spend $200,000 from their diminishing budget to find
out if Santa Barbara should have a more stringent rent cap than what the State already mandates (5% + CPI). They will also decide if they want a create a multimillion-dollar rental registry “to collect data”. The City states the registry is required “to enforce state laws meant to protect Santa Barbara tenants”, but the state law they are referring to, AB 838, specifically states “beginning July 1, 2022, […] a city or county that receives a complaint of a substandard building or a lead hazard violation” needs to be inspected. So what is this database really for? It is getting impossible to be a housing provider. People want stability in the rental market, but rent control is not the way. These measures are discouraging housing providers from continuing in the business and it will reduce the already low rental housing stock. Instead of punishing those that provide housing in our community, our City Council should be prioritizing education. As an old adage goes “what you don’t know, you don’t know”. We need to ensure that both private parties (tenant and housing provider) understand their rights and responsibilities. This will allow each to have open conversations and resolve disputes. We should be empowering all members of our community instead of creating victims and villains. We need to focus on positive solutions instead of dwelling on policies that just don’t work.
By Kelly G. Richardson, Esq. CCAL Dear Kelly: I’m in a dispute with my association. The doors facing the outside of my condo (original doors) have extensive dry-rot. I say this is the responsibility of the association to fix and or maintain. I acknowledge that the inside of the doors are my responsibility but the outside is theirs. I’ve read the association’s matrix regarding the responsibility issue and believe it spells out whose responsibility it is. l stated it is association responsibility, but I’m getting denied my request for repairs. – R.M. Dear R.M.: Civil Code Section 4775 allocates HOA maintenance and repair responsibility, stating that, unless the governing documents say otherwise, the HOA repairs common area and exclusive use common area, and homeowners maintain their exclusive use common area items. If the governing documents do not mention entry doors, then the Civil Code Section 4145(b) definition of “exclusive use common area” includes “exterior doors, doorframes, and hardware incident thereto.” So, if the governing documents are silent, the HOA would be expected to repair damaged entry doors (assuming that the damage was not caused by the homeowner). Maintenance matrices are an increasingly popular tool to provide guidance on responsibility for maintenance and repair of listed items. These are essentially attorney opinions in chart form and the governing documents and statutes still take precedence if there is a conflict. Occasionally, I find errors in a matrix prepared by someone else but corrections don’t require a board or membership vote — it is sufficient to just send a corrected version to the membership. – Thanks, Kelly

Good morning Kelly: I have been in touch with our manager several times about the cleanliness of the pools here. Nothing is happening. Multiple residents are very upset and claim they have been having this problem here for a very long time. Do you know who I can go to from here? Who do I speak to if the property management isn’t listening? – A.F. Dear A.F.: Normally your manager follows the board’s directions. If there is a problem with the association’s pool cleaning vendor, bring it to the board’s attention during open forum. If sufficient homeowners agree with you and the board does not seem to be listening, consider collecting a petition to demonstrate that you are not the only person with this concern. Hopefully that will help the board see that there is a problem vendor. Never try to intervene with the vendor personally, but instead allow the board to instruct the manager to handle the issue. – Best regards, Kelly Dear Mr. Richardson: Our HOA is considering no longer paying to cover slab leaks. Most of our units have already incurred a slab leak but mine has not. I have faithfully paid my monthly fees for many years to cover slab leaks and now find that I may no longer be covered. This does not seem fair and I am wondering what I can do. – C. B. Dear C.B.: To reallocate repair responsibilities would require an amendment to the CC&Rs; since any deviation from the Civil Code 4775 repair and maintenance allocations must be stated in the CC&Rs. Amending the CC&Rs on this subject would require a membership vote, which would give you an opportunity to oppose it. – Thanks, Kelly

How to create the perfect office

With more and more companies switching to workfrom-home or hybrid schedules, it is only natural that we want to create a space for ourselves to buckle down and get things done while at home. However, office spaces aren’t just for full-time employees. We all need a place to pay the bills, go through paperwork and keep our computers charging. So how do you set up a productive area without losing the charm of your home aesthetic you have worked so hard to achieve? It is all in the details, my friends! For those who work from home on a regular basis and need a dedicated room, I like to start with the bigger items and work
my way down to the finishing touches. That means bringing in the desk first. It is important to ask yourself what you need from your desk, as it should be a practical yet beautiful item. It may turn out that what you really need is a small table or delicate writing desk. However, when it comes to the focal point of an office, a majestic desk is hard to beat. The most important thing is to take the time to find one that fits with the scale and function of your space. Now that you have your desk, the next step is a place to sit down and get busy. Picking out a chair for your office is a big decision! There are so many better options beyond a basic computer chair that offer comfort along with style. I like to add a pop of texture with my chair choices, so I tend to gravitate to-
ward finely patterned upholstered styles or even rich classic leather seating. I love the elegance of a wingback chair in an office, but standard sized chairs can create just as much of an impact in the right fabric. When adding on guest seating, sometimes keeping your desk chair simple is the best option so it doesn’t overwhelm your room (or your guests!). Storage and shelfing is a must-have in any home office. I collect books and baubles like you wouldn’t believe, so having adequate shelving is at the top of my must-have list. Large case goods that sit up against the wall are a space-saver and a wonderful addition to any room, but especially an office. Mixing in your books and accessories is a great way to keep frequently used items on hand without sacrificing your desired
aesthetic. Not having a place to hide my papers is also a great motivation to keeping my office space clean and tidy. No room for a full office in your home? Try out a “cloffice”! I have seen these closet-turned-office hybrids popping up all over the place. Better Homes and Gardens recently did a wonderful how-to on converting your small storage space into a functional work area. To lower water usage, I plan to change the showerheads in both bathrooms to new high-efficiency models. What performance options do you recommend for water-saving heads? – Jack Answer: High-efficiency showerheads are a good idea for any bathroom and can save even more water than standard showerheads. Some areas may require only installing high-efficiency showerheads. So check your local water use requirements to make sure the new showerheads meet or beat local guidelines and/or codes. This question brings up a good point as far as high-efficiency showerhead performance. Since these showerheads can have a lower gallon per minute (GPM) flow rate, it’s important to get the most you can out of every drop of water. For performance features I like showerheads that include the following: • A wide nozzle pattern for better body coverage • Easy-to-clean flexible water jets to cut down on water deposits • Built-in “air-induction” technology Infusing air into the water flow can blow you away with a nice water-saving sensory experience!

Several decades ago, I bought a condo with a significant other. A few years later, we broke up, and he moved out. I kept paying the mortgage and have not seen or heard from him in over 20 years. I want to sell the condo to move closer to relatives, but his name is still on the deed. What can I do? – Fran
Answer Unlike the title to your car, where an actual certificate of ownership gets physically signed over, no single document controls the ownership of real property. Instead, it is necessary to look at various documents, primarily deeds, to determine who owns the property. These documents, the evidence of ownership, are known to lawyers as “muniments of title.” Property deeds are a formalized way of verifying someone’s intent to transfer their property to someone else. They get recorded in the public records to put the world on notice of the change. This is all lawyer-speak for telling you that rather than removing someone from a deed, you need to record another document showing the ownership change. When two spouses purchase a house, they are said to own it as “tenants by the entirety.” This form of ownership goes back hundreds of years into the history of the law. Back then, property owned by spouses was not owned by them together or even individually because the law considered the couple to be one person. Instead, the marriage, something distinct from the spouses, was considered to own the property. Back then, women did not enjoy the same rights as men, which allowed the male half of the couple to maintain control of almost everything. Even so, the law provided at least one strong protection for the wife — survivorship. Despite his substantial control of the property during the marriage, the husband could not sell the property without the wife’s consent. When the husband died, the wife remained the sole owner and gained control over the property. Back then, most privately owned property was income-producing, such as farms, to put this in context. A few hundred years passed, and laws were enacted known as the “Married Women’s Property Acts” that went a long way toward treating each spouse equally in control of the marital property. As society progresses, so does the law, and this form of ownership now applies to married couples of any gender, with each spouse being treated equally. Some things, however, do remain the same. And therein lies the answer to your question. When your spouse passed away, you stayed the owner — now the sole owner — of the property. To prove this to the world and effectively remove your deceased husband from the title, you simply have to record his death certificate in the public records. Answer The principles of modern property law have evolved from their roots over 900 years ago in feudal Europe. After the conquest of England in 1066, King William “the Conqueror” became the owner of all land. When he granted estates to his vassals, he retained the right to get the property back under certain circumstances, such as when the owner died without known heirs. All land passed from the owner to their heirs at the moment of death, and there could never be a gap in ownership. If no heir could be found, the property was returned to the government. This is called “escheat” and is still in effect today. Simplified, it means that someone always owns real estate, and if it cannot be determined who does, the property goes to the state. In your situation, you will need to find your ex or his heirs if he passed away. It’s tricky to track down someone you have not heard from in decades. There are tools and services that can find almost anyone. Once he, or his heirs, are identified, you will need to get them to sign over the property to you or your buyer. Most likely, they will want to be paid for this, and the amount can often be negotiated. If you cannot find him or his heirs, or if you do, but they are not reasonable about the decades you paid all the condo expenses, you will need to sue. The court can have the property sold and split the proceeds fairly between you and your ex or his heirs or have their share held to be escheated to the state if no one comes forward to claim them within a specified time.

By Norman Winter Recently I stumbled across a plant recipe called “This is the Life.” Not only was it a collection of some of my favorite plants, it was a wake-up call to an old favorite: the Persian Shield. Known botanically as Strobilanthes dyerianus, it is native to Myanmar and has 8-inch-long iridescent leaves in shades of purple, lilac and pink with purple-maroon on the undersides. If those colors aren’t awesome enough, the foliage looks as though it has a light coat of silver electroplated to the leaf. It has been around for a while, even in Victorian times, but it kind of slips to the back burner, depending on the whims of producers. It has been selected as an Athens Select plant of the University of Georgia and has won Top Performer and as well as Best of the Zoo at the Cincinnati Zoo and Botanical Garden. Thankfully it has secured its position as part of the Proven Accents section of Proven Winners, which is where you’ll also find all the new ornamental sweet potatoes. The Persian Shield prefers well-drained, organic-rich soil. I rarely see it in full afternoon sun looking its best in the South. I love planting it in morning sun and afternoon shade to keep its brilliant colors always photo-worthy. This spring, wait to plant until all danger of frost has passed, then space plants on 18- to 24-inch centers. I think we may finally be safe in my part of Georgia. The plants should reach close to 3 feet in height and are really considered maintenance-free. Don’t be afraid to pinch if needed to keep plants bushy. This is not exactly a drought-tolerant plant. On the other hand, those in our display garden when I was with Mississippi State endured much more than I ever believed possible. Keep the plants uniformly moist throughout the growing season. This is a tropical plant that likes summer humidity and performs well in heat. Keep it growing vigorously by fertilizing monthly with a light application of a slow-release fertilizer. My choice would be something like a 17-5-17 with minor nutrients, but it’s no big deal; just make sure to use a slow- or controlled-release blend. Almost everyone would think of Persian Shield as annual planting, much like coleus. It is, however, considered a perennial in zones 9-11, and ours came back several years in zone 8. Don’t expect it, but celebrate if it does. Many find it hard to believe that Persian Shield is in the Acanthus family (Acanthaceae) with relatives like Mexican petunia, Shrimp Plants, Firespike and even Thunbergia that we grow as vines. There are some great combinations to plant with the Persian Shield, which is where I started with “This is the Life.” The recipe features Truffula Pink gomphrena, Supertunia Mini Vista Pink Star, Plum Dandy alternanthera, also from the Proven Accents section, and of course the Persian Shield. You can also find eight more recipes to choose from. I love how they look with large bananas or in combination with lime green or chartreuse foliage. The purple foliage really contrasts with these colors. Another great choice would be to use violet- or white-colored impatiens like those found in the new Soprano series. Every week someone asks me which plants deer don’t like. The reports say this is one plant deer will leave alone, so let the celebration begin. Although Diamond Snow has only been out two years, it is racking up pages of awards, such as Perfect Score All Season at Oklahoma State, Top Performer at Biltmore Estate and universities like Minnesota, Ohio State, Cornell, Delaware and Florida, just to name a few. Why, you might ask? Well, the Diamond Snow blossoms are double. To the flower border, mixed container or basket, it is a choice, as the names suggest, frost or snow. Diamond Frost, the original, will always have a place, lending the artist touch to mixed plantings. It is like sprinkles, while Diamond Snow is a main course in your designs. It can get a “holy wow” alongside the most colorful begonia or petunia. These plants known as spurges, and euphorbias are related to the poinsettia and copper plant, but don’t let that throw you. They really are, and will always be, the toughest flower you can put in the garden. Although they’re small in stature, reaching about 12 to 18 inches tall and as wide, these award winners will never be without hundreds and perhaps now thousands of tiny white flowers. You would never really be able to count them all. For best blooming, select a location with as much sunlight as possible. Some shade is certainly tolerated. Despite its rugged nature, you will still want to give it good bed preparation so it will quickly establish and get happy in your flowerbed. If you are plagued with tight heavy clay, incorporate 3 to 4 inches of organic matter like compost, humus or peat to loosen and improve drainage and aeration. Plant at the same depth they are growing in their container, spacing plants 10 to 12 inches apart. It’s strange to me, but in the garden world I regularly watch,

it seems the mixed container of basket has captured the lion’s share of Diamond Snow cultivation. Son James, however, has rocked the West Georgia world in using them in the landscape with Boldly geraniums, Meteor Showers verbena and all varieties of begonias. Diamond Snow, like its sibling, is virtually pest-free and an absolute environmental wonder to gardeners, even more so when you consider the low water requirement. Overly moist soils and overwatering can be fatal. You might think a plant with this many flowers would need some kind of deadheading, but this is simply not the case, as it is selfcleaning and maintenance-free. Another outstanding trait is it is deer-resistant, which I appreciate as they have become an issue at The Garden Guy’s house for the first time. The double white flowers combine with any other color of flower for a dazzling display. Remember, all colors look better when paired with white. It can also be used in any style of garden from the tropical to the traditional and in baskets or containers. Use them as a filler plant for a baby’s breath-like look in mixed containers. But don’t forget, there is nothing subtle about the display of white. Whatever excuse you have made for not trying Diamond Snow, make this the year you do. It will be a game changer, whether in the landscape or on the porch, patio or deck.
