Don’t Be Reserved About Reserve Accounts

Rely on Your ® REALTOR Realtors® have been quickly adapting, as the market and the pandemic guidelines – state and local, are constantly changing. Our State and local Associations have moved quickly to respond on almost a daily basis to reflect a rapidly changing landscape. As of this month, we have new Mandatory Government Showing Requirements including Best Practices Guidelines and Prevention Plans. REALTORS® are following safe, consistent and responsible industry practices during the current pandemic while serving our clients and protecting our community. These include posting showing requirements on the doors of listings which must be followed by all who enter a property. Market activity is up, as sellers who need to sell are putting their properties on the market and buyers are buying. There is no market “norm” as activity varies not only by price range, but by neighborhoods and even down to specific properties. Some properties are lingering on the market while other are going into multiple offer scenarios, some with a dozen or more offers! It comes down to seller motivation and correct pricing. There are less properties to choose from with inventory down significantly. Properties in good condition which are well priced are getting the offers. Rely on your REALTOR® for the best pricing strategy for selling to garner market attention. After sheltering in place and giving a lot of thought to how our homes function and fit, buyers are eager to get into a home which suits their needs. This desire along with low interest rates are creating a bright spot in our economy in real estate. “As California’s economy and housing market slowly begin to see signs of improvement, homeownership and housing supply have never been more important to our state’s COVID-19 recovery,” said CAR President Jeanne Radsick. “During this crisis…the work that REALTORS® perform is essential to our state’s recovery and to the future of California. As you know, homeownership is the lifeblood of our state’s economy and is pivotal to helping working families and those from financially disadvantaged backgrounds build wealth.” The COVID-19 pandemic has put the importance of housing supply at center stage: without shelter, it’s impossible to shelter in place. Fortunately, as REALTORS® we’re at the front lines of protecting and expanding the dream of homeownership and housing.

Unfortunately, too many HOA boards overlook or disregard the reserve fund as unnecessary. This is unwise, because the reserve fund is a critical component of the healthy HOA. Don’t fall for the myths. MYTH — Funding is not expressly required by law, so it is less important. California law does not expressly require associations to accumulate money in reserve accounts. However, the law requires that such an account exist, that the board review it monthly, that the association every three years obtain an analysis (“Reserve Study”) of the funds needed, and make detailed disclosures annually to members and to prospective buyers. While state law does not require funding, federal lending guidelines since 2009 do require it. For condominium projects to be eligible for FanniMae or FHA loans, they must confirm that 10% of the annual budget is deposited into the reserve account. California Realtors® have long been concerned that HOA residence prices were unaffected by the level of the HOA’s reserve funding, despite that logic would dictate that homes in well-funded HOAs should be worth more than in poorly funded HOAs. This led to several new laws sponsored by the California Association of Realtors expanding disclosure requirements, requiring more detailed disclosure of the money it has actually accumulated for each building component (Civil Code 5570) and requiring boards to have a plan regarding how it will accumulate the money recommended by its reserve study (Civil Code 5550(b)(5)). MYTH — We can’t afford it. Many associations suspend reserve fund deposits, based on the belief that this helps hold assessments down and protects the mem-

bers. However, the project components (roofs, paint, decks, and so on) are steadily deteriorating, and there is a cost accumulating for the HOA each and every day — there isn’t a bill, but it is a hidden debt being incurred. If money is not set aside, the HOA increasingly falls into debt and endangers the members — and the day will come when the bill “becomes due” and new roofs are needed. MYTH — We should put that money to good use, it isn’t doing any good. I attended a meeting once where a member stood up and said the board was doing a horrible job, because the “reserve money is just sitting there” and should be put to “better use”. However, that money IS being put to good use, by protecting the HOA (and members) from financial hardship. MYTH — We’ll address it all later. Procrastination is easier but can lead to painful outcomes. When major repairs are needed, if the HOA has not accumulated refurbishment funds, it has two choices — ask members to approve a major special assessment, or get a bank loan (officially putting the HOA into long-term debt). If the HOA assumes that it can always apply for a loan, what happens if the HOA does not qualify and is rejected? State Consumer Warning. In 2012, the Department of Real Estate weighed in, issuing a Consumer Warning on “Underfunded Homeowner Associations”. [Read it at www.dre.ca.gov] It is important reading for those considering buying an HOA residence. Everyone agrees it is a bad idea to live on credit cards, building up debt, so why is it acceptable for the HOA to do the same? Boards must take responsibility and protect their association’s solvency.

With summer quickly approaching, it is time to break out the Uncle Sam hats, fireworks (sorry pups!) and our finest patriotic decor. While I love a red, white and blue palette, the colors are especially meaningful when we fly our flags on Independence Day. The colors symbolize a great many things to Americans. Most directly, white signifies purity and innocence, red signifies hardiness and valor, and blue, perseverance and justice. Between Memorial Day and the Fourth of July, the use of red, white and blue is at an all-time high, and I love it. While the color trio certainly pays homage to America, it is also a timeless color palette, and that’s something this design enthusiast can certainly appreciate (and celebrate). There are ways to incorporate the colors into your home, from a casual pop to full-on RWB mania as summer progresses. Last year I had the pleasure of visiting one of our lovely customer’s homes in Kansas called the Wagon Wheel. Her home is the perfect example of taking the important colors and crafting a beautifully balanced display that takes farmhouse chic to the next level. One lesson to take away when decorating with iconic color combinations is to choose a dominant color and spin it for your space. This customer’s focus on using many hues of blue — from navy to cerulean — allowed the space to welcome pops of red without turning into a statement on patriotism. Even without this being an existing color palette in your home, a few choice accessories can turn your space into a summer-ready paradise. We set up a Memorial Day celebration in a four seasons room that has a festive flair, not one flag in sight. By using everyday items, you can create a nod to the flag’s colors in a subtle and beautiful way. We started by switching out the winter table covering for a red, white and blue plaid and covering the buffalo check chairs with a nice white and blue ticking. We then set the table with our bright red plates — a favorite that plays into so many holidays — and accented the space with classic blue and white ginger jars. A few throw blankets and a whimsical star napkin ring brought the vision together and without a huge seasonal overhaul. When all is said and done, as a lover of seasonal decor I like to showcase some USA flair during the summer months. As we get closer to Independence Day, I turn up the volume on my RWB decor. The traditional beauty of a flag banner or swag cannot be underestimated. Mixing those traditional items with touches of stars, stripes and Americana is a perfect way to celebrate the season. Whether you go all out or prefer a more relaxed approach, the most important part of seasonal (or anytime) decorating is to have fun and find what makes you happy.
