Does YOUR HOA Have These Disclosures Ready For Buyers? By Kelly G. Richardson, Esq. CCAL California Civil Code Section 4525 requires specific important disclosures be provided to members upon request, to give to prospective buyers. Well-run HOAs should have these many disclosures readily available. Here is a checklist for buyers, sellers, and managers: Governing documents CC&R’s, bylaws, rules/regulations, Articles of Incorporation (or statement of non-incorporation), and Condominium Plan or Subdivision Map (not mandatory). Finances Annual Budget Report (multiple items, see Civil Code 5300). Annual Policy Statement (multiple items, see Civil Code 5310). Assessments Regular, special and any schedule future assessments. Unresolved Problems Delinquent assessments, unpaid fines, and unresolved violations. Unique Issues Disclosure if age-restricted community. Construction defect lawsuit information regarding defects disclosed to builder and (if settled) plans to repair them. Governing Documents The governing documents and any amendments must be provided, including any amendments to these documents. The Condominium Plan or Subdivision Map is not legally required to be disclosed but is an important document. Financial Documents and information The Annual Budget Report contains important information regarding the association’s finances. For example, is the association following the recommendations of its reserve study preparer, or is there little money in the reserve fund account, exposing the HOA to future major borrowing and consequently exposing members to future major special assessments? The HOA is required to have a written plan to become more adequately funded, and that plan must be disclosed annually to members. The Annual Budget Report also includes a summary of insurance. Does the HOA have dishonesty insurance or earthquake coverage? Assessments Buyers must be told what are the current regular assessments and any special assessments and also if there any future assessments approved but not yet due. Problems/Violations Information Is the residence being purchased not a good HOA member? The association must disclose any assessment arrearages,unpaid fines, and any unresolved violations in-

volving the property. Unique issues Some associations are age-restricted communities established for senior living. Such restrictions must be disclosed. If the HOA has sued the builder for construction defects, there should be a defect list, and if the case ended, a written disclosure of the association’s plan to deal with the listed defects. Difficulties The association can only charge its actual reasonable cost to make the copies, which must be provided within ten days of written request. Not all HOAs are wellmanaged, and the inability to comply with the disclosure requirements could indicate a disorganized or poorly run HOA. Realtors® should send this request very early in the selling process to avoid “rush” fees and to allow time in case the HOA is late.The person handling requests for these disclosures may be an overloaded manager or a homeowner volunteer struggling to take care of association paperwork in addition to their daytime jobs. Other Helpful Documents In addition to the specifically required documents, prospective buyers may seek the: Latest monthly financial reports, Last three board meeting minutes; and The latest reserve study. These are not mandatory disclosures but provide insight into the association’s operations. Read Civil Code Sections 4525,5300 and 5310 on the official state web site at https://leginfo.legislature.ca.gov. The law provides valuable information for HOA homeowners and prospective buyers. HOAs and their managers should be prepared to provide these disclosures. Buyers should make use of the information and becomemore informed buyers and better members of their new HOA community.

Twenty Years of ® REALTORS Disaster Relief The REALTORS Relief Foundation (RRF) marked its 20th anniversary this week. Within hours of the September 11, 2001 terrorist attacks, the National Association of Realtors® began to secure contributions to help those impacted by those devastating events. The Executive Leadership team utilized its leadership, infrastructure and standing as the world’s largest trade association to reach out to members and supporters seeking donations. These donors stood in solidarity with their fellow countrymen and countrywomen to help affected families. They raised more than $8.4 million to provide urgent housing-related assistance for those struggling in the aftermath. These funds were raised and distributed within 100 days to ensure families were able to remain in their homes. The Foundation continued their work and over the past 20 years, they have awarded over $33 million dollars to over 100 disasters across 38 states helping over 17,000 families. These are funds raised by members and partners of the National Association of REALTORS® including State and Local Associations. RRF funds are not just limited to REALTORS®. They can go to anyone impacted by a disaster. Similar to the RRF, the California Association of REALTORS Disaster Relief Fund was established in the wake of devastating wildfires in 2003 across California. The CAR Fund provides relief for natural disasters to REALTORS®, employees of REALTORS® and staff of Local Associations. Given the increase in fires and other natural disasters across California, this fund has raised over $500,000 to assist in times of need. Our local areas have been a direct beneficiary of both of these Funds. The 2017 Thomas Fire and 2018 Montecito Debris Flow saw massive damage and destruction in Santa Barbara and Ventura Counties. The Santa Barbara Association of REALTORS® was able to distribute over $650,000 from the RRF and the California Disaster Relief Fund to victims in order to cover rent and mortgage payments. These funds can never replace everything that the victims lost but making sure that our neighbors have a roof over their heads while they work to overcome their loss makes a difference. We have disasters going on right now across our state and our local REALTORS® are answering the call from our neighbors all over California to provide assistance to those most hurt. As evictions restart, how should a landlord handle a tenant who hasn’t paid in months? Even though the U.S. Supreme Court overturned the CDC eviction moratorium, several states and many municipalities still have restrictions in place. Dreamstime/TNS

By Gary M. Singer Question: Now that evictions are resuming, I need to deal with my tenant who is over six months behind. I have continued paying the mortgage, but it has not been easy. I need the cash flow from a paying tenant before I end up in foreclosure. Is there anything that I should know? – Peter Answer: The recent Supreme Court decision about the CDC’s eviction moratorium removed the federal roadblock to evicting tenants who did not pay their rent. While most tenants who stopped paying did so for valid reasons, the moratorium banned evictions, not paying rent or abiding by the lease agreement.

Tenants still had to maintain the home and pay the rent. When they stopped paying the landlord, the missed payments started accruing, and their debt to the landlord grew. Many tenants who relied on this protection face an insurmountable debt due to back-owed rent. Even with the CDC moratorium lifted, several states and many municipalities still have restrictions in place. Before you do anything, you need to ensure that you do not live in one of these jurisdictions. If you have the green light where you live, you need to follow the traditional steps, such as posting a notice and filing a lawsuit. You will also need to decide whether to take the more straightforward route of only regaining possession or the longer path of seeking money damages

for the back rent. When making this decision, consider your tenant’s financial situation. While many people genuinely could not afford to pay their rent due to the COVID-19 crisis, some exploited their situation by not paying rent they could afford. Other tenants found steady work recently as the economy reopened. If your tenant has a regular job or valuable possessions, it may be worth getting a money judgment and trying to collect. A note of caution: Many landlords have historically felt comfortable filing eviction lawsuits themselves, but the current climate is fraught with traps and obstacles. It would be wise to consult an experienced attorney if you are unsure of what to do.
