Co-Publisher To appear in House & Home, Contact our staff at realestate@newspress.com House & Home is a product of the Classified Advertising Department of the Santa Barbara News-Press. newspress.com newspress.com is a local virtual community network providing information about Santa Barbara, in addition to the online Association of the Santa Barbara News-Press.

By Kelly G. Richardson, Esq. CCAL When buying property in a common interest development (“HOA”), one automatically becomes a member. Here are 14 items to consider before closing escrow: 1. Read the CC&Rs. CC&Rs are an agreement between all association members, binding each when they take ownership. Read this document before taking ownership, not after. Look for restrictions regarding how your property is used — Are there pet limits? Can you park RVs in driveways? In a multi-story building, are there restrictions against hard floors? You need to know first, not later. 2. Review the reserves disclosures. Prudent associations set aside money each month to offset the ongoing deterioration of major capital components (roofs, asphalt, paint, etc). Associations with little money saved in reserves may require imposition of special assessments against the members to fund major refurbishments. Underfunded reserve accounts are a form of hidden debt not reflected on the balance sheet. 3. It isn’t about “me,” it’s about “us.” Common interest communities are just that — communities. Shared ownership also means shared control, which means you can’t just do anything you want (nor can your neighbors). 4. Is it managed? California HOA law is so complicated it is difficult to operate one without a professional manager. If the association has volunteer management, it is probably innocently violating many laws (and the board is probably working too hard as free community managers). 5. The directors on the board are also homeowners and pay the same assessments you do. They volunteer their time to handle things you don’t have to worry about. To understand more and be involved, volunteer for the board. 6. No license or credential is required in California to manage associa-

tions, so ask about the manager’s reputation and credentials. 7. If buying a condominium, understand that “common area,” the shared property, is probably a lot more than you think. It may include even the dry wall underneath your paint, or the floor underneath your carpeting. 8. In associations it is NOT better to ask for forgiveness than permission. Check the architectural requirements, as you may be required to apply to the association before making changes to your home or yard. 9. Never assume the board is not enforcing a rule or restriction and therefore that it is OK to just ignore it. The association’s enforcement actions are normally in closed session, and you may be unaware of the board’s actions against violators… until you become one. 10. HOA managers don’t make decisions – they advise the board and then implement board decisions and policies. 11. Directors have no individual power to make decisions — HOA leadership is a team sport, and boards make decisions by majority vote. 12. Very small HOAs often operate very informally with less compliance to law or the documents. 13. Download CAI’s free and informative “First Time Homeowners Guide to HOAs” available at www.caionline.org. Click on “homeowner leaders” then “resources for residents.” 14. It’s all about being a good neighbor. Consideration is the key to happy and successful association living. A selfcentred focus leads to conflict and unhappiness with one’s HOA neighbors. HOAs are a large and increasing sector of the housing market. Look before you leap — and make sure you actually read! Embrace the benefits (and responsibilities) of HOA living, and enjoy a positive experience in your HOA!

A note from the SBAOR President By Brian Johnson President of the Santa Barbara Association of REALTORS®

End of Summer To Do List As we enjoy the dog days of summer it’s easy to forget about pressing maintenance issues on our homes that were on our minds last winter but now seem so distant and forgotten. Our ongoing drought seems to dominate the local news, but people forget that we had almost 20” of rain in December 2011 causing Lake Cachuma to spill, and who really knows what next winter has in store for us? Remember the old adages that “the roof only leaks when it’s raining” and “out of sight out of mind”? The last weeks of summer are a good time to deal with problems with your home that may become urgent when the seasons predictably change, and the weather is no longer so hot and balmy. If your roof had any leaks last winter that were not repaired, now is the time to start making a few calls to line up an estimate or two to get the repairs done or a new roof installed. Roof leaks don’t magically heal themselves; they just about always get worse and even a small leak can cause expensive interior damage to walls, ceilings, electrical fixtures and more. If you wait until the first sign of storm clouds to start calling roofing contractors, you will be trying to reach them during their busiest time of year and you may have to stand in line to get any work done or to even have your call returned. Working on roofs is one of the most injury prone building trades and be sure to get proof of license and workers compensation insurance before a ladder is taken off the truck much less work done on your roof. If your home needs a new roof ask your contractor for homes in town where he has recently installed the same roofing that you are considering so you can drive by to see what it looks like from the

street, which can sometimes be a lot different than the marketing brochures printed by the roofing shingle manufacturer. One of the easiest home maintenance projects to postpone is painting and once the fascia, siding or exterior doors on your home get past a certain point of weathering it can become a very expensive project to return them to proper sealing. Painting adds color and design to your home, but we forget that the big reason for paint is to seal and protect exterior wood and masonry from constant erosion by Mother Nature via wind, rain, fog and sun. If you are starting to see any splitting or cracking running along the wood grain then the time is now to start lining up a painter to pressure wash, scrape and sand away any chipping or splitting, and then apply the proper primer and color topcoat of paint. It’s a good idea in our foggy coastal environment to have the painter mix a mildewcide additive to the paint to control the growth of mildew, especially if you live in a shaded area prone to mildew or are lucky enough to live next to the beach. It is easy to spot mildew-streaked homes throughout Santa Barbara and Goleta even on homes that were recently painted, and the right mix of paint will give you a beautiful mildew free paint job that will look nice for years. If your home already has extensive weather damage and has needed paint for quite awhile, the preparation work needed before the first bucket of paint is opened may be a much bigger job than the actual painting. Think of the prep work and priming as the foundation of the job and any corner cutting will just make the splitting and peeling go away only temporarily maybe to reappear the next spring.

Rainwater should ideally never pool or puddle near the side of your home and ideally all paving and landscaping work should slope away from the house to naturally channel surface moisture away without the assistance of drains or sump pumps. Water pooling near the house can work its way under the foundation or through the wall base to cause all sorts of expensive damage to floors and walls and if water is pooling under a house with a perimeter style raised foundation, the increased humidity under the house can promote dry rot and mold growth. Many homes are built on relatively flat lots with little natural slope and these homes can be problematic when trying to establish good drainage. French drains are often the solution, and the installation of a cistern and sump pump is sometimes the last resort, but both can be a complete waste of money if not planned and installed properly. I have seen French drain installations with insufficient slope that made the original problem worse by creating a new area for water to pool and sit. Any concrete porches, decks or walkways that drain toward the house will eventually cause water damage problems, and a paving or concrete contractor should be consulted with to try to create a slope away from the house. Continuous rain gutters are a very effective way to move rainwater away from your foundation. If your gutters are showing their age by pulling away from the house and sagging, they can be repaired by replacing the original aluminum spikes with long threaded screws that fasten into new wood on the rafter tails or fascia. Trees and shrubbery add much to the appearance and livability of a

home but should never be in contact with the house and tree branches should not be over hanging any part of the roof. Even the best roof and rain gutters will not keep rain out of your house if filled with leaves and dirt. Tree branches that are in contact with the house are subtlety and patiently scraping the paint off your siding and scouring away the top coating off asphaltic roof shingles as the trees constantly move and sway with the wind. Late summer and fall are a good time for cleaning and repairing rain gutters and trimming trees that are too close to the house. On a personal note, I finally stopped trying to trim my own trees when I realized how much nicer they looked after being shaped and trimmed by a professional tree trimmer who climbs throughout the tree giving it a skilled cut rather than the rough trim that I attempted from the ground. Tree trimming is not an easy thing to do safely so don’t let anyone start climbing your trees with carabineers and chain saws swinging from their work belt until you have proof of license and insurance. So be prepared and get your home ready for winter!

Turning the tables for autumn

This time of year is all about the harvest, so playing with pumpkins, feathers and pampas grass to make an earthy chic display is always a great choice. Photo courtsey Handout/TNS

Tribune News Service Just as Taylor Swift predicted, August sipped away like a bottle of wine (cabernet sauvignon, to be exact). I can hardly believe it is already September! This has been one hot and humid summer in the Midwest, and I could not be more ready to bundle up in my sweaters and sip my way through cider season. Besides loving the aesthetics, smells and colors of fall, I am excited to host family and friends (safely) at my home this holiday season. Fall represents to me the beginning of dinner party season. While summer barbecues and pool days are fun, for me nothing beats the cozy comfort of an intimate evening of drinks and dining during these few months (or weeks) of perfect temperatures and cool evening breezes. Besides, what better way to prepare for Thanksgiving than with some practice runs of table decor? We’ve easily turned our tables from summer chic to festive fall by adding touches of autumn textures and elements to our settings. With a couple classic additions, it is simple and quick to transform your dining room for the new season. It is no secret that I love to go all out when it comes to a centerpiece for our tables. I adore the drama and flair it brings to a dining space. While spring and summer are all well and good for fresh blooms, fall is the perfect time to start thinking outside the backyard bouquet. People forget that there are so many other decorative items that make for a stunning statement. In fact, before the 1850s, fresh blooms weren’t used at all for centerpieces — they were considered unsophisticated and cheap. However,

while tradition has changed in that regard, the beauty of using figurines and faux florals and vegetation has stayed constant. This time of year is all about the harvest, so playing with pumpkins, feathers and pampas grass to make an earthy chic display is always a great choice. If you aren’t one for a large central display, textiles are the next place I look to make a big splash. Start switching out your florals for plaids and your summer hues for the colors of a crisp changing autumn. There are so many areas in a well-designed table to introduce fall-inspired fabrics. When I can’t find a tablecloth or runner that meets my needs, I go straight to the fabric section. A few yards of your favorite textile can easily be turned into your next favorite table covering. I also love using fall throw blankets on the diagonal for a fun and unexpected twist (plus, they are so easy to throw into the wash after a meal). If you aren’t ready for a complete textile makeover, start with place mats and napkins for a simple fall refresh. These foundational adjustments to your table settings leave a canvas ready for future inspiration as the months go by. You can always add a splash with additional accoutrements like seasonal salt and pepper shakers, fall-inspired table toppers and napkin rings to level up your transitional table. I try to make my same adjustments to our dining room cabinets and hutches so our dining rooms stay consistent and cohesive. (Adapted from nellhills.com.
