“A Delicious Way to Donate” SBAOR FundRAiSeR FOR the COVid-19 JOint ReSpOnSe eFFORt In efforts to raise some funds for our local community, the Santa Barbara Association of REALTORS® C.O.R.E. committee (Community OutReach & Events) has created an event “Dine and Donate” in hopes to offer support and awareness to the COVID-19 Joint Response Effort. Our vision is to support local businesses and at the same time raise funds for those who are being impacted most by COVID-19 in our local community. Local restaurant Uncorked will be cooking up delightful entrees to choose from: Mushroom and Truffle Sachetti, Lobster Ravioli, and Ahi Nicoise salad. The $100 ticket includes choice of two entrees, soup or salad, dessert, and a local bottle of wine which can be selected at pickup. The event will take place on Thursday, October 1st with curbside pickup available from 4-7. Diners will receive a face mask printed with the event logo “Support Local.” The Santa Barbara Foundation (SBF), United Way of Santa Barbara County (UWSBC), and the Hutton Parker Foundation are leading a countywide funders’ collaborative with members of the Foundation Roundtable. The Covid-19 Joint Response Effort will provide over $2 million in assistance to individuals and families, as well as organizations actively assisting members of the community affected by the COVID-19 pandemic. “There is no better time to support our local community. By participating in this event you are not only supporting those in our community who have been significantly impacted due to Covid-19 but you are also supporting the local food and service industry which has been impacted as well,” said SBAOR Past President and C.O.R.E. committee chair Thomas Schultheis. “We encourage anyone in our community to buy a ticket for themselves, for a friend or to give away. Tickets are limited. Our HOA Stopped Meeting - Is That OK? By Kelly G. Richardson, Esq. CCAL

Dear Mr. Richardson: Our board says that due to the pandemic they are suspending board meetings “until further notice.” Our bylaws state board meetings must be held at least every 3 months. They said if they do hold a meeting they will limit attendance to 10 members, but the Open Meeting Act says it must be open to all eligible members. The board refuses to hold a meeting outdoors because it’s “too much trouble.” Is Covid-19 a valid excuse for these restrictions? Has the board overstepped its authority and what can we do about it? – Thank you, G.B. Dear Kelly: Is it legal for an association to not hold meetings for months because of the pandemic? There’s been no attempt by the board to hold a Zoom or any other kind of general session meeting in months. – D.L. Hi Kelly, Since the shelter in place orders, our HOA has had two monthly Zoom board meetings, but when members attempted to dial in they were denied access. In my mind this is a serious violation of the Davis-Stirling act. What action can homeowners take to rectify this matter? – Sincerely, A.P. Dear G.B., D.L., and A.P.: Sorry, your concerns are currently typical of hundreds if not thousands of HOAs in California. The DavisStirling Act, and the Open Meeting Act contained within it has not been suspended by the pandemic. In fact, HOAs can quite easily adapt and hold board meetings (and most have) while still obeying the health department restrictions on groups of people meeting indoors. Civil Code Section 4090(b)

specifically allows California HOAs to conduct board meetings via telephone or electronic means. The one requirement is that at least one director or other HOA representative is physically present at the announced physical location of the meeting, and that, per Civil Code Section 4925(a), anyone participating via telephone or virtually can hear and be heard by those physically present. This is not difficult and does not require violation of any bans on physical gatherings, since one person can sit in the board room with their laptop or tablet and everyone else can participate virtually via internet platform or telephone conference service. There are various virtual platforms available, and none are expensive, so there is no excuse for boards which refuse to conduct business in proper board meetings. A board that does not meet is abandoning its responsibility to its association. If it is meeting in secret, or not meeting, or allowing one or two directors to make all decisions, that board is outside the Open Meeting Act and outside proper corporate process and all of its decisions could be subject to legal challenge. The technology is available and inexpensive to allow boards to meet their important duties and comply with the law. If they seem to be unaware of their options, send the board a copy of Civil Code Sections 4090(b) and 4925(a) and ask them to do their jobs. If they still won’t, then elect directors who will learn how to do things properly and comply with the governing documents and California law. G.B., D.L., and A.P., Thanks for your questions. Artwork for many is often the icing on the cake. But what are some of the best ways to create a stunning look, especially when it comes to creating art solutions that are larger in scale? The answer may lie in bringing in artwork that is smaller in scale and even mirrors. Here are some top designer hacks for creating big art solutions. Do: Use identical or similar artwork in a series.

This is one of the best ways to create a diptych (two pieces of art in a series) or a tryptic (three in a series). Consider using a grouping of smaller art pieces or mirrors to fill a space or wall. Frame artwork in identical frames. This technique will help you to be able to place artwork side by side for a seamless cohesive look. Hang artwork both vertically and horizontally to make a big art statement. Similar or identical artwork can feel like a single art piece when hung side by side or one on top of the other. Indeed, household accidents — especially falls and poisoning — account for more deaths each year than auto accidents. Protect yourself and your family and minimize dangers by following these tips.
