Guest Bathroom Facelift Question: I live alone in a large home which my husband used to take meticulous care of but he passed away several years ago and now I have to take care of the repairs and maintenance mostly by hiring contractors who my friends refer me to, some of whom do not have a contractor’s license. My son lives out of state and insists that I only hire contractors who are licensed and insured. How do I verify that a contractor really has a license and insurance? Your Handyman: Your son’s advice is sound, and he is looking out for your best interests. In California anyone performing work on your home that totals $500 or more is required by law to have a contractor’s license appropriate to the work. A contractor who is not licensed is not capable of carrying general liability insurance to protect his customer if their property is damaged in the course of the job. California State law also requires that a business that has any employees must have worker’s compensation insurance to protect their workers in the event of a work-related injury, but a contractor who works entirely on his own without any employees is not required to have worker’s compensation insurance. Anyone who applies to the State Contractors License Board for a contractor’s license is required to submit to a background and criminal check and a person with an arrest record will be denied a license. So basically, it comes down to no license means no insurance and anyone who is half way serious about their trade will make the effort to become licensed. You can check a contractor’s license status by going to the website for the California State Contractors License Board www.cslb.ca.gov and search by contractor’s name, business name or license number. Once you have established that your contractor is licensed simply ask him to provide a certificate of insurance from his insurance broker that will detail the type and amounts of his insurance coverage. Proof of insurance is very regularly requested of contractors by prospective clients and is a basic service provided by their insurance agent. Unfortunately, accidents do sometimes happen, workers do fall off ladders, contractors do back their trucks into the neighbor’s expensive gates and the last thing you need is to have to pick up the bills for the accidents of an unlicensed or uninsured contractor. If a worker is injured on your property without the protection of Workers Compensation insurance, you could legally be required to pay his medical bills and other costs associated with his recovery.

Are Term Limits Illegal, and Who Advocates for HOAs? By Kelly G. Richardson, Esq. CCAL Dear Mr. Richardson: With the new election law (effective 1/1/20) removing term limits for board members, does this mean the HOA no longer has to hold annual elections or send out candidate request forms? My association has not held an election in 2 years, no candidate forms are sent out. The current board selects who want to serve.We have term limits in our CCRS. – B.B. Mr. Richardson: I saw your recent article posted from the newspaper regarding the status of the legislation to restore to the law that a term limit in governing documents acted as a disqualification for election to a seat on an association board. I did see that the Senator who brought 20119’sSB 323 (Wieckowsk) had a bill to correct the deletion from SB323. I have been unable to find it or to determine its status. – J.C. Dear B.B. and J.C.: The major revamping of HOA election laws from 2019’s Senate Bill 323 created a number of problems. One is that it listed only five possible eligibility factors, and term limits was not included in that list. This means that at present, HOAs cannot use term limits as a disqualifier for candidates who have already served the maximum consecutive terms allowed under their governing documents.However, HOAs still must annually seek candidates and hold annual elections. Senator Wieckowski apparently recognized that one of many unanticipated consequences of his enacted bill was that it abolished HOA term limits and this year authored Senate Bill 432, which would add term limits as a sixth possible eligibility factor. That bill passed the Senate in May and appears poised to pass the Assembly quite soon. This would restore the legality of term limits in governing documents in 2022, assuming the Governor signs the bill into law.

As you can imagine we are heavily impacted, both financially and administratively, because of the existing state rules. We agree, as your recent article references, that it would be great if we can get changes made for the “small HOAs” like ours.So, are there any advocates, organizations, committees, etc. that you can recommend to us to join so we can join forces to hopefully aid in making these changes. – A.S. Dear A.S.: There are several groups which advocate for California’s over 50,000 HOAs. The largest is the Community Associations Institute (“CAI”), an international organization devoted to better HOA governance and management, which educates homeowners and credentials managers and has eight chapters in California. Those eight Chapters have an organization called the California Legislative Action Committee (“CLAC”) that advocates for California HOAs. Visit them at www. caiclac.com. Another organization, called the Executive Council of Homeowners (“ECHO”) is a California-based organization serving California HOAs. Visit them at www.ca-echo.org. Another organization consisting of California managers, the California Association of Community Managers (“CACM”),advocates for California HOA managers, but only managers can be members. Here’s five clean features I’ve worked with that hopefully you can include some or all of with your new toilet: 1. Elongated bowl: If you have the bathroom space, naturally the longer toilet bowl style is the way to go. 2. Skirted bowl: Bowl sides are flat and can be wiped more easily than standard bowls with nooks and crannies. 3. Clean-coat bowl and 360-degree rinsing: Bowl is specially coated to help repel liquids and flushing has full-coverage rinsing. 4. What to look for in a furnace inspection

Even as hot weather covers most of the nation, chillier fall days may be closer than you think. Right now is the perfect time to check up on your heating system and make sure it’s ready for fall and winter. HVAC pros are already getting their schedules filled up, so if you want an inspection, it’s best to call them sooner rather than later. Not only does this get your system prepped with plenty of time, but you can complete any necessary repairs before you really need the heat. The last thing you want is to fire it up in October and get nothing! You should hire a licensed HVAC contractor to inspect your system twice a year: before starting up your

air conditioner and before starting up your heater. Your heating pro will check all the vital systems and be sure the system is reliable and safe. They’ll also take a look at the cooling side as well, so if either component of your system is developing problems, this inspection can catch small problems before they become big (and expensive) ones. This inspection will generally cost about $100. If you have a service contract with an HVAC pro, there’s a good chance twice-yearly inspections are already included. How to perform a personal inspection The pros know what to look for inside the system, but you can also take steps to evaluate and protect your system. Take a look and make sure the system is free of residue or soot. Inspect duct work for loose

connections, and seal any openings. Ensure proper clearance by removing items from around the furnace. You don’t want to block airflow, and you definitely don’t want combustible items around it. Make sure all windows and doors in the house are sealed properly. Sealing your home from air infiltration keeps cold air out of the house, which can help prevent high utility bills. Clean the areas you can reach with a vacuum and brush attachment. Getting rid of debris on filters and coils will help the air flow. Take care not to damage or jar any components, though. You only want to address the surface issues; getting into the system’s internal areas is best left to a licensed pro. Replace your furnace’s air filter. It’s a good idea to do this frequently

(usually monthly, but pleated filters will last longer), but it’s most important when the system switches from heating to cooling and vice versa. This checkup is a good time to double-check all your safety detectors as well. Make sure carbon monoxide and smoke detectors have upto-date batteries, and test them.

Tribune News Service When I was asked to trial the new Luscious Citron lantana my first thought was: Why in the world do we need another yellow lantana? But six months later, I know the answer. It has to do with butterflies. I’ll get to that in a minute. Let’s start by looking at the color orange. There is a huge group of gardeners that think orange is too gaudy for the garden. The Garden Guy loves orange and the more “Good Lawdy How Gaudy” the better. We know, however, that once we tone it down or neutralize it a little by changing it to apricot or salmon, this group of gardeners will accept. It is like soft-pedaling orange. Another large group feels the same way about yellow. There is a reason the school bus is yellow. It gets immediately noticed; it grabs all the attention. How do you soft-pedal yellow, so to speak?

Welcome the Luscious Citron lantana, making its debut in 2022. Some might call it a pastel, but if you have ever seen a citron fruit, this nails it. Luscious Citron will soft-pedal the color yellow into every gardener’s heart. This is a lantana with a wonderful habit reaching 30 inches tall and wide. If it ever sets a fruit, it is unknown to me, as those I planted have not had the first one. It simply just keeps growing and blooming at the right pace. I used Luscious Citron in and around Pugster Blue and Lo & Behold Ruby Chip buddleias. Both are compact in habit and made perfect companions in color combinations and their ability to bring in an assortment of pollinators. I found it particularly thrilling to see that Luscious Citron was featured at the Young’s Plant Farm 2021 Garden Tour in Auburn Alabama. They combined it with Augusta Lavender Blue heliotrope, also making its debut in 2022, and Truf-

fula Pink gomphrena. To be honest, this partnership was incredible and looked as though it was a palette of pastels designed by an artist. Luscious Citron will bring the series to 11 colors. Their needs are simple — they need plenty of sun, and fertile, well-drained soil. Proven Winners touts their cold-hardiness as perennial in zones 9 and warmer, and thus a terrific annual in zones 8 and colder. I am growing Luscious Golden Gate, Citrus Blend, Royale Cosmo and Marmalade. In my zone 8a garden all returned from last winter, which had a lot of freezing hours, but no record cold. We will see what happens this winter. My experience says they will be more cold-hardy the second year. Despite all the other butterfly nectar options, the Luscious Citron has been a favorite. Giant swallowtails, Easter tiger swallowtails and spicebush swallowtails have all been regulars feeding on the

blooms. The smaller American lady butterflies have also made frequent visits. As a horticulturist my most frequent question on lantanas is that once the blooming has stopped, what can I do? Lantanas need to be kept in an active state of growth for continual blooms. Cutting back to stimulate growth, feeding and watering during drought periods are all part of regimen over a long hot summer. Luscious Citron has the ability to keep blooming until frost, rivaling any other plant in the garden. I hope you will give it a try. I am sure it will soft-pedal yellow into your heart, too.
