Can Non-Residents Run? Why Can’t Spouses of Directors? By Kelly G. Richardson, Esq. CCAL
Mr. Richardson: Can a non-resident owner be on the board? A board member moved but still stayed on the board while he rented his unit. Several homeowners opposed, but the manager said it’s a new law that just came in effect, however our bylaws state that board members need to be resident owners. What would be correct — bylaws, CC&Rs, or this new law? Is there a new law? – Thank You, L.S. Dear L.S.: Yes, there is a new law in effect this year. Civil Code section 5105 contains new board eligibility standards. HOAs can adopt four optional eligibility standards — candidates can be required to be owner for at least a year before running, to not have a co-owner already on the board, to not be delinquent in their assessments and to not have been convicted of a felony which could affect the HOA’s dishonesty insurance. It is unclear if these optional eligibility standards are the ONLY eligibility requirements HOAs can adopt. Most lawyers are taking the conservative interpretation, that these four are the only optional standards — and residency is not among that list. I think HOAs should be able to adopt their own eligibility standards, but this is now the law. – Best regards, Kelly Dear Kelly: One of our directors has been on the board for a long time. A few years ago, a director resigned and the board voted the director’s wife as a board member. They have both been re-elected to the board. I have no objection to either of them being on the board as they are nice well-intentioned people. There is nothing in our CC&R‘s that prohibits this. It just seems
like one home should not have two votes on the board. Any comment? – R.L. Dear R.L.: Civil Code section 5105(c)(2) allows HOAs to bar co-owners of a current director to run for the board. This is not an automatic eligibility requirement, as the HOA must amend its rules or bylaws to elect this standard. Even before this law took effect, I have long thought that spouses should not serve simultaneously on the board — it gives one membership two board votes. – Thanks, Kelly Mr. Richardson: It is my understanding that under the new law spouses of members not listed on the title are now not eligible to be on the board. What is the rationale behind this change? There are valid reasons for having only one spouse on the title. Those spouses may be better qualified, have more relative experience and knowledge and be more interested in serving on boards than the listed member. This is especially a problem in smaller HOAs where it is often difficult to find good board members. – E.M.

I moved to Santa Barbara in 1947 with my new husband and lived here for 33 years before moving to Lompoc. They say life begins at 40, well I have news for you, I found that my life has shown me I have reached the time and age to let my inner self come out in my 60’s. I did all the usual young age shinanagins in growing up — wife, housewife, mother of a son and daughter, even worked when children were in school. I worked, if you want to call it work, at the S. B. Polo Club as secretary, I loved it, worked there 13 years before it closed. I found another great job as receptionist at the law firm Schramm, Raddue & Seed for 9 years and then we moved to Lompoc where we bought D. J. Cocktails and I sold Real Estate. When my husband passed away in 2001, I did the usual mourning, but then one day I took pen and paper and wrote how to cope with being lonely and wrote my first short story, “Life, Love, Loss, The Empty Chair” and donated several copies to the local mortuary and that was the beginning of my writing short stories. I’ve had three of my writings published and promoted with Amazon and Barnes and Noble and self published 6 more short stories. I have been an activist for the Republican party, chairwoman for 2 years, was an actress and did 9 live performances at the Lompoc Civic theater. In 2005 I was elected Woman of the Year, won the annual Bed Race as Mae West and was an Ambassador with the C of C for 12 years chaired 2 years. I did a calendar for the Chamber of Commerce in Lompoc in 2008. I have written over 60 poems, winning a trophy from World of Poetry and won 2 awards for “Memoirs of my 7 year Life”, of a boy growing up. Oh, did I say I took tap dancing at 60, drum lesson for my 80th birthday, ho hum. Then the Virus came and changed our lives, no running around, stay at home restrictions, what to do. My inner self said you never did any art, so, with new brushes, canvas and paints, I become creative and have had fun doing over 60 whimsical pieces and surprise, have sold several. Life has been good, testing me with ups and downs but I enjoy each gifted day and don’t want to waste a moment. Keeping busy is the secret to living and at 94 years. To see what I have accomplished puts a smile on my wrinkled face.
Dear E.M.: Only HOA members can run for the board, pursuant to Civil Code section 5105(b). This is the one eligibility requirement which is now automatic. When I draft updated bylaws, I normally define “member” as an owner of record, as sometimes a spouse or other person will claim they are an owner due to community property or other undocumented interest. The clearest path to eligibility is to have a recorded grant deed showing that one is listed as an owner. – Best regards, Kelly

Hanging New Doors Question: My husband and I live in a North Goleta tract home that was built in the 1960’s and we want to replace all the bedroom and closet doors in our house. The doors we have now are just flat on both sides and we have found a new door style that we like that has six panels on each side, but we have no idea how to go about ordering the doors or arranging for them to be installed. Can you explain the process? Your Handyman: Installing new doors in your home is a relatively inexpensive way to give the home a new contemporary look and the process is actually pretty simple. A new door can be ordered either pre-hung or just loose. A door that is pre-hung will already be set with new hinges that are attached to a new door jamb and the door will be pre bored for a new lockset. The jamb (silent B) is the wooden frame that surrounds the door on the top and both sides and a pre-hung exterior door will usually include a new threshold nailed to the base of the new jamb. A door that is not pre-hung is simply just the door itself without any mortising for the hinges or boring for the lockset. The door jamb is screwed to a wall stud on each side and the gap between the jamb and the wall studs is concealed with the casement trim that frames the door both on the sides and top, and also on both the inside and outside of the door. If you purchase your doors pre-hung then the existing casement trim will need to be removed along with the existing jamb and door. It is unlikely that the old casement trim will be able to be removed intact without splitting or breaking, so you will probably need to have new casement trim installed and painted along with the new pre-hung door.
If you purchase new doors that are not pre-hung, then you will need to have a carpenter size and trim the new doors to fit the old jambs, mortis the doors for hinges that match the position of the hinges in the old jambs, and then bore a hole in the new door for the lock set. In most cases it will take more time for your carpenter to install a new loose door into the old jamb as opposed to installing a pre-hung door. Your first step in the process of installing new doors is to find a finish carpenter who is experienced in hanging doors and he can help you to measure for placing the order for the new doors to make sure that the doors are all ordered in the correct sizes. The same carpenter can pick up the doors for you when they arrive at the store or lumber yard, deliver them to your home in his truck, and install them correctly. If you are considering purchasing both the doors and the installation from the Big Box hardware store in Goleta, make sure that you personally meet the carpenter beforehand who actually will be doing the work and check his references. My recommendation for your project is that you purchase the doors pre-hung so that the doors, jambs, and casement trim are all brand new. The cost of the prehung door will be higher than just a loose door but they will usually take less time to install. You will need to select a new casement trim style and order it at the same time as the doors also with the assistance of your carpenter. Most doors and trim can be ordered with a coat of primer paint that is applied at the mill and this will make your job a lot simpler if the doors, jambs and trim can have a color top coat of paint applied while sitting in your garage before the installation, and just touch up done painting will be needed after the installation is complete.

I checked with the association management, and they had no insurance information on file for the vendor. Because the flood was caused by the carelessness of your association’s vendor when working on the common area of your community, the association is ultimately responsible. The association will most likely make a claim on its insurance, who will look to the vendor for reimbursement. The vendor’s missing insurance may complicate the insurance claim for your community. Anybody, including your association, should hire licensed and insured professionals, and their insurance company may use this misstep to reduce or deny that claim. If this happens, your association will still be responsible for the repairs, but the money will need to come from the community. Running an association should be treated like running a business, and the leadership needs to make sure that administrative matters, such as this one, get taken care of. Otherwise, a mistake can have consequences for the entire community. While you are waiting for this to happen, you will need to remove the water and prevent further damage. You are not allowed to sit back and wait. If you do, you will be responsible for additional repairs caused by the delay. This is called “mitigating your damages.” Document everything that happens by taking lots of photographs and detailed notes of who you speak to and what was said. If the situation goes off the tracks, your good documentation will prove invaluable to your attorney. Gary M. How to create the perfect video call backdrop By Katie Laughridge
As the warm weather welcomes us into the summer months and our cities begin to open back up (safely and slowly we hope!), it has become clear that some of the changes from the last few months are here to stay. Some have produced a new set of challenges for us to work through, such as creating a productive home office space or turning our bedrooms into spaces fully dedicated to relaxation. A couple of weeks ago I received a phone call from one of our lovely customers who had come across a new home decor challenge for us. Like many of us during the time of COVID, she has been using video services like Zoom and FaceTime more than ever, and in doing so discovered her desire for a better background. What makes the perfect video chat background? As I tune into the news to watch at-home reporting and chat with my family and friends, I have noticed certain elements work better than others, and that clutter creates a noisy environment that makes it hard to concentrate on the person speaking. While there is no foolproof recipe for the perfect backdrop, you can take some steps to project your style through a camera lens. Reflect your style, not your screen First and foremost, avoid reflective surfaces behind you while video chatting. Mirrors are the biggest offender of projecting your screen back into your camera, but windows and shiny metal decor items can create problems by reflecting light and creating a glare. Cabinets with glass doors can also contribute, and the simplest solution is to open the doors and show off its insides. It’s a great excuse to rework and refresh those shelves and show off your favorite pieces. Simplify, then beautify Now that pesky reflections are taken care of, it’s time for the fun. Bringing your style into your space without creating a distracting backdrop is all about editing. This is the same technique we use at the store to show off our goodies. If you’re working with shelves, one of our (sometimes controversial) methods is to turn around books to create a neutral canvas for styled items to pop against. While this is not a method loved by all (which I understand, I too adore colorful books!), it creates a quiet backdrop that still looks beautiful. Sans shelves, a gallery wall can create a stunning visual as well. A display of art can be full of texture and depth without overwhelming your space. Stick with canvases for less glare.

Let there be light There’s a reason so many selfie sessions take place in the car: all that great natural light. If you have a space in your home with fabulous natural light (and space to work), make it your go-to Zoom spot. If you can, avoid sitting right in front of a window, regardless of whether the window is to your front or back. Sunny days can make your screen hard to see, and backlighting can make you hard to see for your workmates. Of course, we love lamps when natural light is not an option, just try to avoid placing it too close to your camera. Practice makes perfect, so don’t be discouraged if your first attempt at the perfect video setting doesn’t pan out — it is easy to fix.

Whether a series of mirrors or in a pattern or grid, multiple mirrors can be used to create a reflection wall that can be quite impactful in most spaces. 2. Experiment with different shapes and sizes. Round mirrors and those that are more ornate can add interest. 3. Hang mirrors vertically if looking for ways to make a space with a low ceiling feel taller. 4. Consider hanging mirrors vertically to help elongate a space. Long hallways are great opportunities. 5. Use mirrors in rooms that may not get much light or with limited windows, as mirrors can reflect light. Donâ&#x20AC;&#x2122;ts 1. Overlook leaning mirrors. These oversized mirrors can be used in areas where you may not want to hang mirrors or art, or to help create a focal point. 2. With all our recent talk of the razzle-dazzle that upholstered furniture brings to your space (and my obsession with the fun flair of fabrics), I’m ready to shift our focus to another home staple: wood furniture. What is the first thing that comes to mind when you think of wood furniture? Don’t worry, there is no wrong answer. Throughout my design journey (which is, truthfully, only just beginning), I have had mixed feelings about wood pieces — they are essential, but I used to find them intimidating. I find myself falling in love with them a lot more quickly these days and more fully appreciating their longevity and versatility. I’ve had everything from the college budget-friendly pieces to family heirloom pieces and I still firmly believe there is a time and place for all of the above. My most recent (and beloved) wood acquisitions are cherrywood pieces that have been handed down through my mom’s side of the family. They are beautiful in their simplicity, and they come with all the charm of well-loved wood furniture. My only challenge: finding the perfect spot for all the pieces in the set, which includes dining room furniture and bedroom furniture, without creating any matchy-matchy areas. A rule follower though I may be, when it comes to design, old rules are made to be broken. I can’t stand hearing “you aren’t supposed to mix styles” and “ you can’t have different finishes, they don’t work well together” and “Katie, you can’t fit another piece of furniture in this room — are you crazy?” No more naysayers. If we can maximalize patterns and mix styles when it comes to upholstery, there is no reason wood furniture needs to be bland and shrink into the background. It’s time to let those pieces shine! (And, if Mary Carol Garrity has taught me anything, it’s that there is always room for one more piece.) The first step in embracing your wood piece (old and new): Mix it up. You know what goes great with a gorgeous antique
secretary? Literally almost anything. I think the beauty of design, and especially New Traditional design, is it takes the old and the new and marries them in a tasteful, unique way. While the rules used to tell us you needed to pick and stick to one defined style of furnishing, it’s not true. I think combining traditional wood elements with transitional, midcentury or a plethora of other styles makes for an interesting and dynamic room that allows each piece to shine. Picking out bold and balanced wood furniture doesn’t take away from the impact of each, but multiplies it. The same concept applies when it comes to the wide variety of finishes you can find in wood furnishings today. Back in the early days of furniture when there were only a handful of wood stain options to choose from, it was harder to create effective contrast in a room, and matching made more sense. When your vintage china cabinet was built all those years ago, I bet they didn’t have a hot pink option. However, that does not mean you can’t use the new trends on the market today when adding to your rooms. DIY culture has inspired a whole new range of wood finishes for fan-favorite staple pieces. In fact, painting wood pieces has gotten so popular that CR Laine offers its wooden accents to be painted any color in the Benjamin Moore paint line. With countless wood stains and brightly painted colors, there are many customization decisions to be made even before you decide antique distressed versus traditional glossy versus modern matte finishes. With all these new options, wood furniture is in the same league as the pattern mixing and matching we get to play with in upholstery. As long as there is balance, there is beauty.

Plan an azalea Bloom-a-Thon for your landscape By Norman Winter
Tribune News Service There has been an azalea bloom-a-thon at The Garden Guy’s house for the last six weeks and looks to not be stopping anytime soon. This has all been taking place in temperatures that have sometimes made me the irritable garden guy. If you have not gotten on the bandwagon with re-blooming azaleas you are missing a real treat. I gave you a clue in the lead but they are so new you may not know about the Bloom-A-Thon series. At The Garden Guy’s house, the Bloom-a-Thon lavender flowers have been putting on a summer show that will rival any other azalea in the market. The flowers are so large I had to get a tape measure to quantify. They are a whopping 3 1/2 inches wide. One of the real benefits to growing re-blooming azaleas is that they are in flower during peak butterfly season. So not only are butterflies hitting on them, but bees too! It is not often I rave about plant structure when it comes to azaleas. Its not that they are in any way bad it is just usually they are ho-hum. This is not the case with Bloom-A-Thon lavender. These are mounded and evergreen, reaching about 4 feet tall and wide. This gives them the ability to provide the needed bones of the landscape when not in bloom. Bloom-A-Thon Lavender azalea is recommended in zone 7a-9a and should be planted in fertile well-drained acid soil. The Garden Guy makes it a practice to incorporate organic matter into all azalea shrub beds. Add a layer of mulch after planting and again each year. The azalea keeps the roots near the soil surface and this annual decomposition of mulch and organic matter will maintain a good environment for new roots and help in moisture retention. I have mine in a part sun area that is shifting throughout into evry corner. They do have the ability to tolerate quite a bit of sun. The Bloom-A-Thon azaleas really do best in a filtered light to part sun area particularly in the south. I like them planted in curvy informal sweeps or clusters with odd numbers versus the formal toy soldier look. In the bed where I am growing Bloom-a-Thon lavender, I wanted to create a complementary color scheme in front of a hedge of dwarf Burford hollies. So, I created a curve or sweep and partnered them with Florida Sunshine anise that has bright golden chartreuse foliage. Though my planting is young it is already making you look. In my backyard I am growing Bloom-A-Thon red azaleas with blue re-blooming hydrangeas and Etched Glass hostas. I know there is an azalea-hydrangea partnership coming. The variegated hostas and Bloom-A-Thon red azalea marriage should provide a look that is both gawdy and wonderful. I’ll keep you posted. Proven Winners now has five colors in the Bloom-A-Thon series, lavender, pink double, hot pink, white and a red, that will steal your heart. The white is more compact or petite reaching about 3 feet tall and wide. So yes, you can have a glorious spring azalea bloom and follow it up with an extra-long, late summer to fall bloom too, when you grow Bloom-A-Thon re-blooming azaleas.
