The Split Roll Initiative is BACK… What a difference a year makes right? It’s only been just over a year since voters defeated Proposition 15 at the polls and its proponents are back again with a new idea to raise property taxes. Proposition 15, also referred to as the Split Roll Tax, was a proposition on the 2020 ballot in California that sought to remove Proposition 13 tax protections from commercial properties. This would require all commercial properties be reassessed every three years and property taxes adjusted upward at that time. This would have put a huge tax increase onto property owners and commercial tenants, as they are often the ones that pay for property taxes. In September, a new proposal submitted to California state officials seeks to place a new version of Split Roll onto the 2022 ballot. Titled the “Housing Affordability and Tax Cut Act of 2022” the bill seeks to split the tax rolls differently this time around. Whereas last time the initiative’s backers sought to single out commercial versus residential, this time they seek to pit any property worth $4 million or more vs those worth under $4 million. For properties valued at $5 million or more, an additional 1.2% “surcharge” each year would be added onto the regular property tax. For a $5 million home, apartment complex or commercial property that comes out to an extra $60,000 per year. For properties between $4 million and $5 million, a formula is used to compute the additional tax. An example would be a $4.5 million property would see an additional $27,000 per year in taxes. Again, this is not just for commercial properties. This would apply to all properties, with minor exceptions such as commercial agriculture. That means a hefty tax increase for asingle-family home or an apartment complex worth over $4 million. The authors of the bill are tying these tax increases to increased property tax exemptions as a way of making it more palatable for voters. The revenue from this split-roll property tax increase would go to fund increases in both the homeowners’ property tax exemption and renters’ tax credit. The homeowners’ property tax exemption would increase from $7,000 to $200,000, increasing the property tax savings from $70 per year to a maximum of $2,000. Similarly, the nonrefundable renter’s tax credit will increase from $60 for individuals and $120 for joint filers to $1,000 or $2,000, respectively. The proponents have also included language that bars property owners from directly passing on the increased taxes to any tenants. In reality, it will be very difficult to determine whether the increased taxes have been passed on to the tenants. Property owners will increase rents or other expenses or they will not be able to afford to provide needed upgrades or repairs thus impacting tenants. Additionally, if you just bought a $4 million home you are going to be paying a vastly larger amount on taxes than a property that was purchased a year ago for $3.9 million, but now might be actually worth over $4 million if it were sold today. Additionally, what about a home inherited by the children of an owner and reassessed at over $4 million. Previously, that new owner could keep the old tax basis of the property but if this initiative passes that new owner may not be able to afford the taxes on the home now and forced to sell to someone wealthy enough to afford them. If the idea behind this is to make home ownership more affordable, it does not look as if it will achieve that goal. The initiative’s title sounds like it will make housing more affordable in California but the bill does little to address the root causes of affordability, namely the lack of adequate supply of housing. This initiative still has to go through the process of raising enough signatures to qualify for the ballot for next year so this will be monitored closely as it moves forward. Should I hire a handyperson or specialist? By Paul F. P. Pogue Everything from that squeaky door to the leaky faucet has been getting on your nerves, and you’ve decided it’s time to take care of them all at once. Hiring a handyperson service is an excellent way to cross everything off this to-do list in a hurry. However, even if you’ve got a reliable handyperson on speed-dial, you might not be sure if you should hire them or a licensed trade specialist for the work. How can you tell the difference? First up, go ahead and ask your handyperson if they’re capable of handling it. An honest pro should be able to give a clear answer. You can also research local regulations and find out what needs a license. Many cities have their licensing requirements online or staff who will be happy to answer specific questions. Licensing requirements vary significantly by state, but generally speaking, small jobs like fixing leaky faucets or replacing a light switch don’t require a license. However, anything that gets into the guts of the pipes or wiring is likely to need a license. Large jobs that involve multiple workers and/ or significant investment, such as a remodel or addition, usually require a licensed general contractor to oversee.

A few additional tips: Some handy services do carry specialty licensing or have particular trades on staff, so don’t hesitate to ask if they have a plumber or electrician available for licensed work! Whether you hire a handy service or specialty contractor, make sure they carry liability insurance and acquire whatever permits are required for the job. Most handy service companies charge by the hour, and often their jobs take much less time than that. To get the most out of your handyperson’s time, prepare a list in advance of all the small jobs you’d like them to cover in one visit. The person you hire to fix some drywall and mount a TV might also be able to repair a leak or hang a light fixture while they’re already at your house. They’ll get more done for you and will appreciate your respect for their time. Make sure you know ahead of time who’ll be responsible for supplying materials. Are We Required To Rebuild Our Balconies?

What’s the best way to prevent title fraud? By Gary M. Singer

Hello Mr. Richardson, Our HOA is claiming that 2019’s SB 326 (“Balcony Law”) adds to the DavisStirling Act and requires the homeowners to retrofit our balcony railings to current building code requirements. I don’t see anything in the bill that requires such retrofitting. Am I missing something? – Thank you, R.M. Dear R.M.: In 2019, Senate Bill 326 was passed and became law in 2020. It added a new Civil Code section 5551. The law followed a similar new law regarding apartment buildings, which also arose from a terrible balcony collapse incident at a Berkeley apartment building in 2015. Civil Code Section 5551 requires all HOAs with attached residences to obtain inspection of “exterior elevated elements” constructed of wood no later than January 1, 2025, and again at least every nine years afterward. The 2025 deadline seems far off, but HOAs now have only three years to complete those inspections. Prudent HOAs should start planning now. What must be inspected: All wood building components extending beyond the exterior walls, including walkways, decks, balconies, stairways (or other items intended for people to stand or walk on), and railings, which are more than six feet above ground level. The inspection must also include the waterproofing protecting the structural components from moisture damage (i.e., dry rot). What if the component is not HOA responsibility? Such components are exempted from inspection. Who must conduct the inspection: Licensed structural engineers or architects. What kind of inspection: A visual inspection, which may include visual observation or tools such as moisture meters, infrared device, or boroscope (a tube with a camera attached which is used to look into confined spaces).
How much of the building must be inspected: A “statistically significant sample” of the entire building, meaning one which creates a 95% level of confidence that the sample represents the condition of the entire building. The inspector must generate a random list of locations to check. What kind of report does the inspector create: A written report, identifying the components checked, describing their condition, projecting the remaining useful life of the components, recommending any necessary repairs, and describing any immediate threats to residents. What happens to the report: It is incorporated into the HOA’s next reserve study. Does the local building department get involved? If the inspector observes any immediate threats, the report must be provided to the local building authorities within 15 days. The HOA must take immediate safety measures to protect any areas of immediate hazard and then pursue repairs. Is there an exemption if the HOA has no money? No. How long does the HOA keep the report? At least two inspection cycles, meaning up to 18 years if the HOA is complying with the law. Are any HOAs exempted? HOAs with less than three attached units, or HOA buildings with less than three attached units (i.e., only duplexes). What happens if we don’t comply? Probably nothing, until someone sues the HOA for noncompliance, or unless a building element fails and someone is injured. Then there could be severe liability for the HOA and board. There are many possible challenges in compliance, such as finding structural engineers and architects who will do this. HOAs should not wait for 2024 and risk being out of compliance with this law.

Questions Recently, there has been an emphasis on stealing titles and the loss of a home. What is the best way to check on the status of our titles and prevent our properties from being stolen? – James
Answer
Real estate title fraud is a severe but fortunately rare event. In a typical real estate transaction, a deed is signed and notarized and gets recorded in your county’s official records. A title company or attorney typically does this, but anyone who knows how to meet the requirements can register a document in the public records. Along with modern conveniences, technology has made it easier for fraudsters to create a fake deed, making it seem like you deeded your home to a new owner. This fake new owner will typically wait a few months and then try to sell the property or take a mortgage loan against it. Vacant and vacation houses are more at risk than homes that people live in full time. Fraudsters have been known to monitor death certificates and target properties where the next of kin lives in a different state. The best defense against title fraud is paying attention. You can monitor what is recorded in the public records in most places by visiting the recording office’s website and searching for your name. If you do this every month or two, you will quickly learn about anything mentioning you in the public domain. In Broward County, Florida, for example, the property appraiser’s office has a free service you can sign up for that will alert you if a deed for your house is recorded. While this service is not available everywhere, you should check where you live. Anyone who has purchased a home can tell you of the mountain of junk mail and advertising you get after your deed is recorded. If this happens to you, check the public records. If you are a victim of this type of fraud, you should contact law enforcement. You also may need to hire a lawyer to fix the problem. While it is impossible to avoid becoming a victim of crime, diligence is your best defense. Gary M. ing in the South. The new AquaPots have eliminated the last of the anxieties — watering and feeding. We all are used to watering and applying fertilizer in the summer, but it has been somewhat of a mystery or roll of the dice in the winter. We’ve been taught to give water when the soil is dry to the touch, but that method is challenging, to say the least, when temperatures are in the 40s and the ever-present cold front has moved through. Many cool season annuals are also heavy feeders. Research has shown that the controlled-release granules, which need heat to disperse those needed nutrients, are not nearly as efficient in comparison to applying water-soluble fertilizer. Who wants to lug a water bucket around with your favorite liquid blue mix when it’s cold? This is where AquaPots hit the gamechanging home run. The ingenious selfwatering concept is based on a waterholding reservoir in the lower chamber of the pot with a soil-holding shelf in the upper chamber. The water now mixed, your water-soluble fertilizer wicks up to the soil and plant’s root zone via a cylinder that connects the chambers. The water will be there as the plant needs it. You may be thinking, how did the water and fertilizer get into the reservoir? A tube hidden by the flowers or foliage allows you to insert water-soluble fertilizer, followed by a water hose for the weekly filling. Depending on your AquaPot size, this filling time period may be longer than a week. No longer will you splash soil all over the patio or ruin flowers with the force of fire hydrant-like water pressure. No water or fertilizer stains on the patio or deck, either! If you think you might add too much water, forget it, there is an escape hole.
