The Award No One “Really” Wants to Win
Gary Goldberg has been in the Santa Barbara real estate industry for over 27 years. On Friday, December 2nd, 2022, at the annual Board of Realtors Installation luncheon, Gary triumphed with the Howard Gates award. This award is the “acknowledgement of going the extra mile for your client by completing a difficult and complex transaction requiring extraordinary endurance, tenacity, diligence, patience and skill.” This is Gary’s second time winning the Howard Gates award; the first was in 2001.
The Seller chose Gary Goldberg to handle this sale because Gary is also an attorney, albeit a non-practicing one. The Seller said in the initial meeting that he did not expect the property to sell, but if it had any chance, he wanted someone who could “sift” through all the legalese. For instance, the adjoining property was in a multiyear lawsuit, which the owner won. This property is in the coastal zone and subject to the state Coastal Commission overview, being that it is blufftop, to make things even more complicated.
Gary coached both parties, walked them both through every step of the process and made sure they understood the importance of closing this affair and conforming to the agreement. The general understanding of the purchase price, and of the options regarding the sum of various deposits in the down payment was challenging due to onerous demands. The sale involved five renegotiations of the price, closing terms and closing dates. In Gary’s real estate career, he had never experienced such a difficult transaction. What mattered most to Gary, nonetheless, was for all parties to reach the paramount goal — close the escrow — which it did.
During Gary’s award ceremony acceptance speech, he explained that “this is the award no one really ever wants to win. It took perseverence, hard work and tenacity”
Special shoutout and thanks to Martha McNair, Gary’s right hand. He is eternally grateful for all her help with this “dreadful” deal of a lifetime.

How to make sure that your Christmas tree isn’t a fire hazard

Use goggles, gloves, and a saw with a handle and blade with no broken teeth, Baumann said.
“Even though we picked up our tree as close to Christmas, we’re not sure when it got cut down,” he said.
Always keep water in the stand
Set the tree firmly in the stand with room for plenty of water. It is critical to check the level of water every day to make sure the tree remains hydrated.
Think about decorations and the tree’s surroundings
Any decorations on a tree that are electrical, such as lights, require a solid connection. That means one outlet, one plug — no power strips or extension cords. “Never overload the outlets,” Baumann said.
Make sure that there are no portable space heaters or any other heat sources, such as radiators or baseboard heaters, close to the tree. As a general rule, keep the tree three feet from anything that could be considered flammable.
Dispose of your tree safely and ecologically
If you decide to get a fresh Christmas tree, purchase it as close to Christmas as possible, especially if you are buying from a pre-cut tree lot.

Fresh-cut Christmas tress can make the entire house smell festive, but they also pose a fire risk if not handled properly.
Philadelphians don’t need to look far in the city’s past to be reminded of the quick and horrific damage that a Christmas tree on fire can cause. That was the cause in a Fairmount rowhouse fire that claimed the lives of 12 people, including nine children, in January.
“There is not a day that goes by that we in the Philadelphia Fire Department don’t think about the families that we lost earlier this year in the Fairmount fire,” said Philadelphia Fire Commissioner Adam Thiel on Monday in an annual event promoting holiday fire safety.
There have been 37 fire deaths in the city so far this year, plus hundreds of people injured or displaced by home fires, he said.
Christmas trees pose a unique fire risk because of how flammable they are when they dry out.
A week and a half before the fire in Fairmount, in the
early morning hours of Christmas day 2021, a father and his two sons died in Quakertown, Bucks County, after lights caused a dry Christmas tree to ignite.
“Whether you choose a live tree, or like many firefighters, an artificial tree, which is much safer, it’s important to be extra cautious and fire-safe during the holidays,” Thiel said.
Here are some guidelines to making sure you celebrate safely this year.
Get a tree as close to Christmas as possible
If you decide to get a fresh Christmas tree, purchase it as close to Christmas as possible, especially if you are buying from a pre-cut tree lot, said fire battalion chief Gustav Baumann. Want the freshest possible tree? Cut it yourself at a farm.
Prepare the tree
Once you’ve gotten your tree home, cut 2 inches from the bottom of the stump to help it better absorb water. Trees begin to dry out as soon as they’re cut, and resin may

Other fire safety tips for the holiday season
• Be very careful smoking next to a Christmas tree.
• Do not put candles next to a tree.
• Check all string light wires for wear.
• If you are celebrating Hanukkah or Kwanzaa, make sure that your menorah or kinara are at least 3 feet from anything flammable. Consider having a nearby source of water that could act as a fire extinguisher.
• Never leave open flames unattended by an adult.
• When cooking holiday meals, keep track of any open flame and never leave stoves and ovens unattended.
• Make sure that every floor of your house has a working smoke alarm. Call 311 if you can’t afford one.
• Once a smoke alarm goes off, everybody in the house needs to know what to do. Have an exit plan and practice it.

2022 SBAOR Installation & Awards Luncheon
On Friday December 2, the Santa Barbara Association of Realtors (SBAOR) hosted their 115th Installation & Awards Luncheon.
I was proud to attend, and be a part of, this wonderful celebration. This is a day not to highlight how many homes agents sell or how much money they make, but to showcase the amazing contributions that REALTORS® and affiliates make to our local community. It is also an opportunity to thank both the outgoing board of directors as well as the outgoing president for their service and to introduce the new president and board of directors.
REALTOR® Community Service Award - Sheela Hunt, Village Properties. Sheila is not only a very successful and highly thought of REALTOR®, but she has found the time to donate more than twenty years of service to the local Teddy Bear Cancer Foundation. She has served on their board of directors, Fund Development, Real Estate, and Planned Giving committees. She has co-chaired numerous events, and personally drives Easter baskets to families in treatment at the LA Children’s Hospital. Sheela also donates her time with the Montecito Union School District, Santa Barbara Junior High School, Santa Barbara High School and fundraising for the Teacher’s Fund Supplies Drive.
Community Service Award - Meichelle Arntz. Meichelle launched Angels Foster Care in 2006, a private non-profit Foster Family Agency that serves children from birth to age five. Her goal was to reduce the trauma that local babies and toddlers experience in foster care. She wants to keep these young children in one home, with one loving family, for the entire time that they were in foster care. Stability, love and trauma-informed care remain the cornerstones of the angels model today. Over the past sixteen years, Angels Foster Care has impacted the lives of 297 abused, neglected, and abandoned infants and toddlers in our local foster care system.
Affiliate of the Year - Matt Genovese, Finance of America. This award is given to an affiliate member of the SBAOR that makes a significant contribution to the association and gives service to the membership, usually over a period of years. The recipient must also model ethical business practices and standards, have a good reputation among peers and display a spirit of cooperation. Matt certainly exemplifies these traits and much more. He is always willing to step up and support any and all of our events throughout the year.
REALTOR Award of ExcellenceLinda Lorenzen, Coldwell Banker and Keith Berry, Coldwell Banker (posthumous award). This award is given to a member (or in this case, members) that not only excel in the standards and practices and transactions of our profession, but could circumvent their ego, collaborate and share their life long experiences, education and the lessons of this profession. Their life’s work is at the highest level of professionalism and one that we all should strive to achieve. Both of these esteemed REALTORS® have
served the local philanthropic community with distinction and have also served our local association for over five decades. Even though they were ‘competitors’ at the same brokerage, they always strived to help each other and everyone within our organization. Whenever you would hear either of their names; respect and professionalism are just two of the ideas that would be thought of. They are both truly class acts in every sense of the word.
Honorary Member for Life - Carol Kruckenberg, Village Properties. This award recognizes an outstanding member who has provided exceptional service to the association, as well as acknowledges their achievements. The recipient must be an exemplary member for at least 25 years and displays an incredibly strong dedication to our association and local community. During her 25 years as a member of our association, Carol has been chairperson of several committees, director, Secretary, Treasurer and President of the SBAOR as well as a Director of the California Association of Realtors Board of Directors. Her talented IT background has paved the way for leading our Budget & Finance, Business & Technology and Statistical Review committees. Carol’s long-term commitment to professionalism, excellence in real estate profession, unmatched work ethic, and unparalleled leadership is truly a model to be followed.
Howard Gates Award - Gary Goldberg, Coastal Properties. This award is given to the local REALTOR® that has played a significant role in bringing about a difficult transaction to a successful closing. This particular transaction had so many challenges but Gary was ultimately able to satisfy both the buyer and the seller in the end. And that is ultimately what we always are supposed to do.
REALTOR® of the year - Brian Johnson, The Management Association. This award is given to an association member who has gone above and beyond their normal scope of responsibilities and has served their fellow agents and the association in many capacities for many years. A note from the SBAOR
I would like to write about some of the awards and their recipients;
But We Can’t Afford It!

Homeownership entails dealing with occasional unanticipated expenses. Recently, I didn’t plan on a main water line breaking, but it happened. Days (and much money later), the problem was resolved. I didn’t want the expense, but it happened. I couldn’t say to the water company or my neighbors, “I’m sorry, I can’t stop this flooding right now, I can’t afford it.”
HOAs are a collection of interconnected homeowners, and major common area repair expenses affect them all. One of the many benefits of HOA living is that homeowners share costs of keeping up the HOA community, with economies of scale usually reducing the individual cost. The association’s duties are really nothing more than the individual homeowner has – they’re just shared.
I hear frequently from readers that the HOA needs replacement or repair of building components, but the HOA “can’t afford it this year.” However, nothing in the Davis-Stirling Act references financial hardship as an excuse from any of its requirements. Here is a quick review of some major requirements.
Maintenance – Civil Code Section 4775 requires HOAs to maintain and repair common areas. Nothing in that statute says “if the finances are in order,” or “if the money is in the budget.” Leaky roofs or pipes or unsafe balconies need to be repaired. Just like the individual owner who has to dig up their water supply line, it has to be done. Delay almost always makes things worse.
Termite treatment and repair – Civil Code 4780. Condominiums, stock cooperatives and community apartments are required to deal with termite prevention and damage repair. The statute does not have an exemption for times in which the HOA funds are low.
Balcony inspection – HOAs must
complete inspection of “elevated vertical elements” no later than January 1, 2025, and to repair anything found which could be a safety threat. The statute, Civil Code Section 5551, does not mention ability of the HOA to pay for the inspection or repairs.
Assessments – Civil Code 5600(a) – “the association shall levy regular and special assessments sufficient to perform its obligations,” which means that HOAs are required to budget for its reasonably anticipated costs of operation – not its hope-for costs but its anticipated costs. Target-based budgeting, in which the board dictates to its manager what assessment increase to budget for, has the process backwards and violates this legal requirement.
Reserves – Associations should set aside money to offset ongoing deterioration of common area components which the HOA replaces or repairs. Some HOAs skimp on those savings contributions to reduce pressure on assessments, but that means the HOA is quietly slipping into debt. The reserve fund can also be a very valuable emergency fund from which the HOA can borrow for up to one year, during which time the HOA can rearrange its finances (as would any homeowner experiencing major unexpected expense).
Emergency assessments – The law allows HOAs to deal with major surprises. Civil Code Section 5610 allows boards to pass emergency assessments to deal with major expenses which were unanticipated when the last budget was prepared. That must be accompanied by a written board resolution explaining to the membership why the emergency assessment became necessary.
Homeownership, including shared ownership, involves occasional unavoidable expense. Those expenses are best addressed head on, since they don’t go away or diminish with time.

Poinsettia partnerships will make your holidays beautiful

National Poinsettia Day was Dec. 12. While I am sure the powers that be wanted a celebratory day, from what I have been seeing this year is that this may have been a deadline day. Did you get your poinsettias by Dec. 12? This most likely applies to poinsettia partners, too! If you are asking what a poinsettia partner is, then put on your thinking cap and gather ‘round.

Proven Winners got most of us thinking about partners when they introduced the concept of combining poinsettias with Diamond Frost euphorbias. This is one of the best ideas ever, and we now actually have three choices: Diamond Frost, Diamond Snow with double flowers, and Diamond Mountain, the tallest of the three.
To a horticulturist like myself, this combination is special because both the Poinsettia and the Diamond Frost are euphorbias. That’s right, they are cousins. Just like at Christmas, families visit and long-lost cousins get together. Of course, the main reason we like this idea is that the red, pink or variegated poinsettia looks incredible. It’s as though it is sitting on a bed of snow or frost. I have found these to be more available at fine florists.
But if you are going to create your own and go plant shopping, then keep in mind some other options you might want to try. For instance, a couple of years ago, Jenny Simpson of Creekside Nursery in Dallas, North Carolina, introduced us to not only using caladiums at Christmas, but even in combinations with poinsettias. She used the Heart to Heart White Snowdrift caladiums, which turned out to be a perfect partner with red poinsettias.
My time as executive director at the Coastal Georgia Botanical Gardens in Savannah, Georgia, taught me opportunities for outside use with poinsettias, particularly if you are astute at long-range weather forecasting. Consider that Savannah is technically zone 8B with a proclivity to lean into zone 9. We used poinsettias in large planters surrounded by Silver Bullet Dusty Miller, or artemisia.
A similar application gave me the opportunity of photographing pink poinsettias mass-planted in an atrium-like setting and surrounded by gray-leaved Icicles Helichrysum. But if you are getting a late start, the most obvious and perhaps easiest is to combine your poinsettias with another Christmas plant like cyclamen. White cyclamen around a red poinsettia can be simply breathtaking.
This year I have also been watching what I call the professional garden club ladies walking out of both florists and floral departments with holly berries. We all think of hollies on swags above the fireplace or front door, but two or three preserved branches loaded with red berries stuck in a pot of white poinsettias is quick, easy and unbeatable.
Red berries for Christmas, landscape beauty, and of course feeding the birds is a prime reason to grow winterberry hollies like the compact Berry Poppins. Consider also growing Berry Heavy Gold winterberry holly. Cutting branches of the gold berries combined with red poinsettias makes a stunning partnership. If you don’t have poinsettias yet, make today your shopping day!
