Overloaded Circuits

Commercial Leases — NNN Reconciliations I have written before about the definition of a NNN lease. It is a lease where, in addition to the Tenant paying a Base Rent, they also reimburse the Landlord for expenses including taxes, insurance and common area operating expenses. Each year the Landlord will prepare a budget for those NNN expenses, typically based on the previous year’s actual expenses plus any forecasted increases. If your business has a triple net (NNN) lease, you will receive a reconciliation letter from the Landlord usually by the end of the first quarter after the calendar year ends. The purpose of this letter is to reconcile the estimated monthly payments made during the prior year with the actual expenses incurred for common area maintenance (CAM), building insurance, and real estate taxes. At the end of the year, the Landlord will compare actual expenses to those that the NNN budget contained. If the actual expenses exceeded the budget then the Landlord will send out a bill for those differences to the Tenant. That is the reconciliation process. It is critical that a Tenant review any reconciliation very carefully to make sure that these additional expenses are actually applicable to their tenancy. A Tenant has the right to request a copy of the reporting that was done so they can review and check for accounting errors or mistakes in billing. An especially tricky expense is capital expenditures. Capital expenditures are items like repairing/replacing the roof or an HVAC system. Other operating expenses such as janitorial, landscaping and parking lot maintenance are controllable expenses. Capital expenditures are funded over a period of time (the “useful life” of the improvement), controllable expenses are annual expenses, and uncontrollable expenses (property taxes, insurance, and utilities) are expenses that you pay to the Landlord as billed. Capital expenditures are normally billed separately since they are not a normal part of the common area expenses but some leases allow them to be amortized into the operating expenses and a Tenant will want to make sure they are not double billed or billed for something that is specific to another Tenant. A Tenant should always reach out to their commercial real estate agent to assist with the review of these expenses. The role of an agent does not stop once the lease is signed. They are there throughout the process to make sure a Tenant can focus on what is most important, their business.

Question: Last night I had way too many electrical things turned on in the bathroom and the power went out for all the plugs and lights in the bathroom and in two bedrooms also. I have been running our window air conditioner almost all night because of the hot weather and the circuit breaker has tripped several times now. What can I do? Your Handyman: It sounds like your circuit breaker correctly did one of the jobs that it is designed to do, which is to protect your home’s wiring from getting overheated when your appliances are demanding more electricity than the wiring can safely provide. Modern conveniences like air conditioners, hair dryers, toasters and coffee makers use relatively large amounts of electrical wattage and without the protection of a circuit breaker, the electrical wires in your walls could get dangerously hot trying to supply all the needed power when multiple appliances are in use. Most homes will have a circuit breaker box located on an outside wall where the power wires from the telephone poles connect to the house, and sometimes an additional smaller circuit breaker box or sub panel will be located on a wall inside a closet or in the garage. The circuit breaker box should always be approached with caution and should not be opened when standing out in a puddle or with wet hands. Usually, you can easily see which circuit breaker has “tripped” or turned off by just looking at the position of the switches. However, the circuit breaker needs to be pushed back into the ON position but not held in the ON position in order to reset its internal mechanism. Holding the breaker in the ON position if there is a short in the circuit could burn out the breaker in which case it would then need to be replaced. Your problem will likely continue as long as our hot summer weather makes running your air conditioner necessary and really all you can do is to not run additional appliances on the same circuit. If the power does not come back on after resetting the breaker, or you have any concerns about safely accessing the circuit breaker box, then it is time to call an electrician.

Question

Ed: I was able to buy a new cast-iron kitchen sink at a discount price. But the new kitchen sink only has one sink hole for the faucet. I’m used to seeing more holes in the sink rim. What type of kitchen faucet do I get to fit this style of sink? – Ted

Answer

With a new kitchen sink and faucet, usually you pick out a faucet and order a sink with the correct number of faucet holes. When you just need a new kitchen faucet, all you have to do is order a faucet style to fit the existing sink. Here are some suggestions for matching up a kitchen faucet that can fit your one-hole kitchen sink.

Four-hole mounting:

Four holes can accommodate a two-handle faucet with a remote spray head. Or, a faucet with a deck plate can cover three holes, with the last hole for the spray.

Three-hole mounting:

Use a two-handle faucet without a spray, or a single-handle control with a separate spout and spray.

Two-hole mounting:

A single-handle faucet with a side spray can fit.

Finally, a single-hole:

This sink uses a single-handle faucet with a pullout spray spout to give you a hole-in-one install.

How do you incorporate white into your home? Can you mix different shades of white in the same space? While to some the color white may seem boring or bland, white can be used creatively and purposefully in a number of ways to make a big impact. From allowing the eye to visually rest to being used to help create a sense of contrast, here are some do’s and don’ts of using the color white.

Do’s 1. D o consider using a monochromatic color scheme using tints, tones and shades of white. 2. Do incorporate pops of white through accessories and accents. 3. Do consider white for anchoring elements such as rugs, sofas and artwork. 4. Do consider white for architectural features such as cabinetry and countertops. 5. Do pair white with darker colors to add a sense of contrast.

Don’t’s 1. D on’t pair bright white and warm white in the same space. Bright whites tend to have bluer tones while warm whites have yellower ones. 2. Don’t place white elements in situations in which they may get overly soiled. 3. Don’t blend too many different shades of white in the same space. 4. Don’t be afraid to pair white with deep bold colors such as black, brown and indigo for a sense of contrast. 5. Don’t overlook opportunities to use white as an opportunity to bring negative space into a room, which can allow the eye to visually breathe.

Mr. Richardson: HOAs face a financial issue with interest rates so low. My HOA and the vast majority of other HOAs play it safe with CDs and money market accounts for investment. I am opposed to this. Now that we are averaging something well below 1.5%, the risk to HOAs is enormous. It is easy to increase HOA fees to homeowners by 3% per year and that will cover annual operating costs and maybe some reserve replenishment. Those reserves overall, though, will lose value over time as it relates to inflation and increases in costs. HOA management companies have financial advisors that warn against risk of going into stocks/bonds. But HOAs need to earn more. Otherwise, HOA fees will go up and up and up. And then property values will go down. – T.S. Hello Kelly: With the historic low interest rates in bank money market and CDs for our reserves, it seems to me that the board has a fiduciary duty to manage these funds like a trustee’s role in managing a defined benefit pension plan for its employees. I believe one could have a diversified fixed income portfolio to have safety and yield and value-oriented equity portfolio for income and growth and a small piece in growth. What are your thoughts on this approach? – Respectfully, R.S. Dear T.S. and R.S.: The Davis-Stirling Act presently requires that managers deposit HOA funds in a federally insured account (Civil Code Section 5380(a)). Furthermore, beginning in 2022, AB 1101 (sponsored by the Community Associations Institute) adds to Section 5380 a further prohibition against investing HOA funds in “stocks or other high-

risk investment options.” There is no similar explicit restriction on the actions of the board on this regard, so theoretically a board could bypass management and invest funds in a way that is not federally insured, or even in stocks or mutual funds. So, it is tempting to seek higher-yield (and riskier) investments for HOA funds. However, it is important to remember that, as R.S. correctly notes, HOA directors are fiduciaries with respect to the HOA funds in their care, and they can be arguably held liable if there is a loss of the principal due to a downturn in the investment. If the HOA is to invest its funds in a way other than managers are allowed, boards will need to consult some investment advice and develop a written investment policy. That will help keep the board within the Business Judgment Rule (Corporations Code Section 7231.5). Regarding the concern of erosion of accumulated reserve funds due to inflation, presumably the reserve study preparer takes that into account in their long-range financial recommendations. R.S. and T.S., some HOAs are so large that they can’t keep all their funds in insured accounts, and so they must pursue investment strategies which reasonably protect the HOA funds while providing a reasonable return. Such HOAs should have outside financial advisors or companies to monitor their funds and advise them. The federally insured approach may not be the best for growing HOA reserve funds, but it is the safest. That is why managers and lawyers typically recommend it for all but the largest associations, to avoid unpaid volunteers taking on personal risk in that regard. – Thank you, Kelly

aming a petunia “Picasso” gives clear indication this plant is something special. That is precisely what I thought the first time I saw Supertunia Picasso in Purple in plant trials. I actually felt a little intimidated as I started thinking what would I do with this beautiful flower in containers or in the landscape. Oddly, my opportunity came in October 2020. This is probably not your first thought when it comes to planting petunias. It is even an aggressive thought in zone 8a West Georgia. But that is precisely what happened. This unique petunia is a rich purple color with what Proven Winners describes as mint green edges — but I promise plenty of times the mint green leans toward chartreuse, which is even more riveting. So right there you have two color choices of incorporating into the design. In fact, a Proven Winner combination named “Breathless” may be the perfect partnership. Breathless uses Angelface Perfectly Pink angelonia as the thriller. Though called pink, it echoes the color of Picasso in Purple to perfection. But it is the ornamental Sweet Caroline Light Green Sweet Potato Vine that is the finishing touch, as it picks up the green in the petunia. The first week of October 2020 I planted my Picasso in Purple in the landscape and in a prized container I had reserved for such an occasion. In the landscape I obviously used it as a groundcover flower and partnered it with Firelight Tidbit hydrangea paniculata that was planted a week earlier. The purple flowers made a magical partnership with the hydrangea blossoms as they turned from white to various shades of pink. All the Supertunias lasted until the end of June. This was nine months, right at 270 days, which was beyond my wildest dreams. The Garden Guy is a sucker for containers that are made out of recycled or reconstituted material and my lavender purple container made out of bamboo was about to be put to the test with Supertunia Picasso in Purple petunia also planted in October. I chose Superbells Yellow Calibrachoa and White Knight Lobularia, or Sweet Alyssum, as partners. Again, I was probably even more surprised when everything — including the pot — survived the long winter. While we did not have the record cold of Texas and Louisiana, we did have a lot of nights in the mid-20s. By April this was like the picture of a spring bouquet. Like the other Supertunias I was growing, Picasso in Purple surprised me with frequent visits of the yellow eastern tiger swallowtail butterfly. It was like nature was doing its part to enhance the color scheme. So it is déjà vu as I have planted the partnerships again in the bamboo container. The White Knight Sweet Alyssum that survived the winter also survived the summer and is starting to flush with blooms. This year I have added Lemon Coral Sedum to echo the green in the Supertunia Picasso in Purple petunia. The Superbells Yellow Calibrachoa is much underused and is a container wonder. Supertunia Picasso in Purple gets about 12 inches tall with a spread of 2 feet, which is perfect for containers. Son James used them and they were the stars of the show in the containers of the Old Town community of North Columbus. Like all other petunias, it needs fertile, well-drained soil and plenty of sunlight. If you live in the South and find it now, give it a chance. Otherwise, come spring, be the first in line.
