Meet the Experts from National Geographic We’ve handpicked a selection of National Geographic experts to enhance your river cruise experience. Photographers, explorers and travel writers will hold fascinating presentations and informal discussions. And, you’ll be giving back. Simply by taking a trip with National Geographic and Scenic, you’re supporting the work of their explorers and researchers around the globe who are working to preserve species and ecosystems, and protect cultures.

A

Q&A with Scenic Cruise Director, Richard Grey Cruise Director Richard Grey has years of experience under his belt managing river cruises along Europe’s greatest waterways. We caught up with him to discuss what his daily work program looks like, and what he enjoys about working alongside National Geographic. How would you describe your role as a cruise director? My job is to focus on exceeding the guest’s expectations, so they go home with such great memories and, hopefully, a whole bunch of new friends. I am required to have a good understanding of the ports, so guests wishing to do any independent touring can rely on us for good advice and guidance.

How does working as a cruise director on a Scenic and National Geographic cruise differ? We need to be familiar with how they do their lectures and with their involvement during excursions. We do this by working with their staff beforehand. This gives everyone an advance understanding of each role and the expectations. We also spend time doing webinars with the National Geographic experts, so we can assist the experts when on board. This improves our own knowledge, which in turn gives us the opportunity to better guide our guests on nonNational Geographic itineraries.

How do National Geographic cruises differ? We’ll usually feature one expert on the promoted topic, alongside an esteemed National Geographic photographer. Not only do they have the ability to open our eyes to so many things we didn’t know before, and on a range of subjects, they will share priceless techniques used by top ranked professionals. And, as the experts are on board for the entire cruise, guests can meet them at dinner, on excursions or while having a drink in the lounge, giving them an opportunity to interact and ask any burning questions. Q&A with National Geographic Photographer, Sisse Brimberg Award-winning National Geographic photographer Sisse Brimberg has produced more than 30 stories for National Geographic magazine over the last four decades. Her work ranges from documenting the life of fairytale writer Hans Christian Andersen, to a National Geographic project chronicling the Viking culture. Here, she reflects on the pleasures of traveling by ship and some of the unique photo opportunities that await travelers on these trips. What do you most enjoy about traveling by ship? In my opinion, there is no better way to travel than sailing on board a ship. I’ve always enjoyed this type of travel, where you venture ashore and get to know new places and people. Then you return to your lovely ship – your home base– which is ready to take you on the next adventure. From a practical standpoint, I like to spend my energy on being creative and not on having to move from place to place, with no need to unpack more than once. You can focus on really getting to know the places you explore.

What can our guests expect to learn about photography while traveling with you? As the on board photographer, I have a wonderful opportunity to teach my fellow travelers about photography, whatever their level is. I love that I can help guests take better pictures, and through the medium of photography, help them capture the spirit of the places they explore. This gives them the chance to take home a great set of photos from the journey, which they can share with family and friends.

What are you looking forward to as the National Geographic photographer on board these new river cruises? Over the years, I’ve had the opportunity to work at many of the destinations where we are going, and I can’t wait to share my experiences and my knowledge of these places with our travelers. I will also have the opportunity to give talks on board the ship to open the door to the world of photography for anyone interested. We are going to have fun.

Terms & Conditions RESPONSIBILITY National Geographic Expeditions (a division of National Geographic Partners, LLC) has authorized Scenic Tours (as defined herein) to administer trips as outlined in their catalogs and on their websites (each an “Expedition”). Scenic Tours is a professional tour operator that will organize and administer such Expeditions. Scenic Tours acts only as an agent for any transportation carrier, hotel, ground operator, ship operator, or other suppliers of services connected with specific Expeditions (“Other Providers”), and the Other Providers are solely responsible and liable for providing their respective services. The passenger tickets in use by the carriers will constitute the sole contract between the carriers and the passenger; the carriers are not responsible for any act, omission, or event during the time the participants are not aboard their conveyances. Scenic Tours will issue a separate contract of carriage that will supplement the Responsibility Statement and Terms and Conditions in advance of such Expeditions. The participant’s itinerary does not form part of the Responsibility Statement and Terms and Conditions. The contract of carriage will contain further provisions that limit the participant’s legal rights, including the participant’s right to recover for loss of luggage, forum selection, and limitations of liability. Neither National Geographic Partners, LLC its parent, subsidiaries, and their respective employees, affiliates, officers, directors, successors, representative, assigns (collectively “National Geographic”), nor Scenic Tours (USA), Inc., its parent, subsidiaries, and their respective employees, affiliates, officers, directors, successors, representative, assigns (collectively “Scenic Tours”) will be held liable for (A) any damage to, or loss of, property or injury to, or death of, persons occasioned directly or indirectly by an act or omission of any Other Provider, including but not limited to any defect in any aircraft, watercraft, or vehicle operated or provided by such Other Provider; and (B) any loss or damage due to delay, cancellation, or disruption in any manner caused by the laws, regulations, acts or failures to act, demands, orders, or interpositions of any government or any subdivision or agent thereof, or by acts of God, strikes, fire, flood, war, rebellion, terrorism, insurrection, sickness, quarantine, epidemics, theft, or any other cause(s) beyond their control. The participant waives any claim against National Geographic and/or Scenic Tours for any such loss, damage, injury, or death. National Geographic Expeditions and Scenic Tours reserve the right, without penalty, to make changes in the published itinerary whenever, in their judgment, conditions warrant or if they deem it necessary for the comfort, convenience, or safety of the participants. Neither National Geographic, nor Scenic Tours, will be liable for any air carrier’s cancellation penalty incurred by the purchase of a nonrefundable ticket to or from the participant’s Expedition departure city. Baggage and personal effects are at all times the sole responsibility of the participant. TERMS AND CONDITIONS IMPORTANT NOTICE TO PARTICIPANTS: PLEASE CAREFULLY READ THE RESPONSIBILITY STATEMENT ABOVE AND THE FOLLOWING TERMS AND CONDITIONS THAT GOVERN BOOKING WITH NATIONAL GEOGRAPHIC EXPEDITIONS AND SCENIC TOURS THAT AFFECT THE PARTICIPANT’S LEGAL RIGHTS AND ARE BINDING ON , TO THE FULL EXTENT PERMITTED BY LAW, PARTICULARLY THE SECTION GOVERNING THE PROVISION OF MEDICAL AND OTHER PERSONAL SERVICES, AND THE SECTION LIMITING CARRIER’S LIABILITY FOR THE PARTICIPANT’S DEATH, ILLNESS, INJURY, OR DAMAGE CLAIMS RELATING TO BAGGAGE OR PERSONAL PROPERTY. PLEASE ALSO NOTE THAT THE “ARBITRATION AGREEMENT” SECTION BELOW CONTAINS PROVISIONS THAT REQUIRE (i) WITH LIMITED EXCEPTIONS, ALL DISPUTES ARISING BETWEEN THE PARTICIPANT AND NATIONAL GEOGRAPHIC AND/OR SCENIC TOURS UNDER THIS AGREEMENT TO BE RESOLVED IN BINDING ARBITRATION, AND NOT IN COURT, AND (ii) THE PARTICIPANT, NATIONAL GEOGRAPHIC AND SCENIC TOURS WAIVE THE RIGHT TO BRING OR PARTICIPATE IN A CLASS ACTION IN CONNECTION WITH SUCH DISPUTES. PLEASE BE SURE TO READ AND REVIEW CAREFULLY THE ENTIRE SECTION LABELED “ARBITRATION AGREEMENT” BELOW. BY ACCEPTING THIS AGREEMENT, THE PARTICIPANT AGREES TO BE BOUND BY THE ARBITRATION AGREEMENT. Basis of Rates: All prices are per person based on two persons sharing a room or cabin. All prices and fares are quoted in U.S. dollars. The rates are based on tariffs, currency values, airfares and third-party charges as of catalog publication date and are subject to change due to unforeseen circumstances. While National Geographic Expeditions and Scenic Tours will do everything possible to maintain the listed prices, if it is necessary to levy a surcharge, National Geographic Expeditions and Scenic Tours reserve the right to do so, and notification will be given at the time of final invoicing. Eligibility: Anyone under 18 must be accompanied by a parent or guardian for the entire Expedition. Some itineraries have minimum age requirements based on the laws of the jurisdictions to which participants travel. Call for more information. National Geographic Expeditions and Scenic Tours reserve the right in its sole discretion to accept, decline to accept, or remove any participant on an Expedition should it deem such action is necessary or

advisable based on the circumstances. National Geographic Expeditions and Scenic Tours reserve the right, without penalty, to make changes in the published itinerary whenever, in their judgment, conditions warrant or if they deem it necessary for the comfort, convenience, or safety of the participants. By registering for an Expedition, the participant certifies that he/she does not have any mental, physical, or other condition or disability that would create a hazard for himself or herself or other participants. Each participant shall notify Scenic Tours, and when appropriate, Other Providers of any need for reasonable accommodations based on any functional limitations related to any disability as far in advance as possible, preferably at the time of booking to allow maximum opportunity to make reasonable accommodations when possible. It may not be possible to accommodate all such requests for reasonable accommodations based on limitations on the vessel, at foreign ports and at the destinations. Scenic Tours will make reasonable accommodations when reasonably possible. If a participant cannot be accommodated on a specific Expedition, Scenic Tours will work with the participant in an effort to identify another Expedition that may offer greater ability to accommodate the participant. Facilities and Mobility: Participants acknowledge the following: (i) some ships do not have elevators, and ships that are equipped with elevators may not have elevator access to all decks; (ii) wheelchair participants should be aware that some cabin doors, restrooms and corridors may not be wide enough to provide access for standard wheelchairs; (iii) requests for accessible rooms must be made at the time of booking and are subject to availability; and (iv) for safety reasons, passengers in wheelchairs cannot be carried on boarding ramps to the ship or on to motor coaches. Included in Expedition Cost: Accommodations and meals as indicated in the itinerary (B = breakfast, L = lunch, D = dinner); standard beverages and standard alcoholic beverages; educational materials; pre-departure information; entrance fees, excursions, and sightseeing noted as included in the itinerary; all gratuities including those for ship’s crew, unless otherwise noted on the itinerary page; ground transportation during the Expedition noted in the itinerary; transfers to and from group flights where applicable; services of National Geographic experts and/or local guides, lecturers, Expedition leaders, and any other staff; and taxes, port charges, baggage handling, and service charges. Please note: the “B, L, D” notations apply to the period during the Expedition only and do not include any meals on flights to/from the Expedition. Internal airfare is included on some international Expeditions as indicated in the itinerary. Not Included in Expedition Cost: Air transportation, overnight accommodation and related fees (except as indicated in the itinerary); activities noted as optional in the itinerary; passport, visa, and permit expenses; medical expenses and immunizations; baggage/accident/cancellation insurance; personal expenses, such as laundry, telephone calls, and premium and rare alcoholic beverages; and any other items not specifically noted as included. Single/Shared Accommodations: A limited number of single rooms/cabins are available at an extra cost on a first-come, first-served basis. National Geographic Expeditions and/or Scenic Tours will assist persons requesting a roommate. The participants will be notified if a suitable roommate is not available, in which case the single rate will be charged. Payments, Cancellations, and Refunds: To reserve space on an Expedition, a $500 per-person deposit is required within 48 hours. An additional $1500 per participant is required within 48 hours of the air schedule being released. Final payment is due no later than 90 days prior to departure. Payments must be made by credit card. A participant’s reservation may be canceled if full payment has not been received by 90 days prior to departure. For reservations made within 90 days of the departure date, full payment is required when the reservation is accepted. All cancellation notices must be received in writing and will become effective as of the date of the postmark. If a participant cancels 120 days or more prior to departure, a refund less an administrative fee of 50% of the deposit will be made. Per-person charges for cancellations that occur less than 120 days prior to departure (“Cancellation Penalty Period”) are as follows: 90-119 days prior to departure: 100% of the deposit amount; 60-89 days prior to departure: 35% of the Expedition; cost 31-59 days prior to departure: 50% of the Expedition cost; 30 or fewer days prior to departure: 100% of the Expedition cost. This policy also applies to pre- and post-Expedition extensions. Any revisions made within the Cancellation Penalty Period, such as a change in departure date or choice of Expedition, are subject to this cancellation policy. Any airline or other third party tickets issued are subject to the carrier’s refund policy. Arriving late or leaving an Expedition in progress, for any reason whatsoever, will not result in a refund, and no refunds will be made for any unused portions of an Expedition. National Geographic Expeditions and Scenic Tours reserve the right to cancel any Expedition because of inadequate enrollment that makes the Expedition economically infeasible to

operate or because of good-faith concerns with respect to the safety, health, or welfare of the participants. If an Expedition is canceled prior to departure, Scenic Tours will provide the participants with a full refund of monies paid to Scenic Tours; except in the event that the cancellation is due to a significant event that makes it infeasible to operate the Expedition as planned, in which case Scenic Tours will provide the participants with a refund and/or credit toward a future Expedition equivalent to the amount paid to Scenic Tours. If National Geographic Expeditions or Scenic Tours cancels the Expedition in progress, the participants will receive a prorated refund based on the number of days not completed on the Expedition. Except as outlined above when National Geographic Expeditions cancels an Expedition, National Geographic and Scenic Tours have no responsibility for any expenses, including any non-refundable expenses, incurred by the participants in preparing for a cancelled Expedition or for any additional arrangements should the participants embark prior to the scheduled group departure date. Trip-cancellation insurance is available at an additional cost and is strongly recommended. For more information about and to enroll in an option available through Travel Insurance Services, visit the “Travel Insurance” section of the National Geographic Expeditions website at natgeoexpeditions.com. Itinerary Changes: The itineraries and staff presented in the catalog or on the website are subject to modification and change by National Geographic Expeditions or Scenic Tours. Every reasonable effort will be made to operate Expeditions as planned, but alterations may still occur after final itineraries are sent. National Geographic Expeditions and Scenic Tours will use reasonable efforts to provide participants the Expedition booked in accordance with the itinerary. However, due to the nature of travel, it may not always be possible for National Geographic Expeditions and Scenic Tours to adhere strictly to the itinerary, and the ship operator may need to make alterations to the Expedition or itinerary, before or after the commencement of the Expedition. Where, due to circumstances outside of National Geographic Expeditions’, Scenic Tours’, or Other Providers’ control, these parties are unable to provide the Expedition in accordance with the itinerary, these parties will use reasonable efforts to: (i) provide reasonable notice of any alterations, though there may be circumstances beyond National Geographic Expeditions’ or Scenic Tours’ control in which alterations will be required with little, or no, advance notice; and (ii) provide or arrange appropriate alternative activities, transport and accommodation as required. The circumstances in which the itinerary or the Expedition may be altered include: (i) high or low water levels in any river or canal; (ii) lock closures, unscheduled vessel maintenance or other operational reasons; (iii) road, river or weather conditions; (iv) national or local holidays affecting the closure of public buildings or attractions; (v) force majeure/acts of God; (vi) emergency events, accidents, injuries or other incidents involving the participant or other participants; and (vii) any other event beyond National Geographic Expeditions’ or Scenic Tours’ control. Alterations to the itinerary or the Expedition may include: (i) substitution of vessels for part or the whole of an Expedition; (ii) cabin changes on a vessel; (iii) additional embarkations and disembarkations; (iv) substitution of alternate transportation, including the use of motor coaches; (v) substitution of hotel accommodation for accommodation on a vessel; (vi) alterations to arrival and departure times; (vii) alterations to sightseeing activities; and (viii) reductions or increases in the time spent at a location. If the ship operator substitutes any vessel, motor coach or accommodation under this section, they will use reasonable efforts to provide participants with a substitution of equivalent specification or quality, though some services and facilities may not be available for all substitute arrangements. Documentation: Participants are responsible for obtaining any documents required for their participation in the Expedition such as a valid passport (valid for at least 6 months after the participant’s return date), all visas, vaccination certificates, and any other documents. Failure to obtain documents does not negate the Terms and Conditions, and any extra costs incurred for rerouting due to travel without the necessary documents will be the participant’s responsibility. Participants shall indemnify National Geographic Expeditions and Scenic Tours for all penalties, fines, charges, losses or expenses incurred or imposed upon National Geographic or Scenic Tours by virtue of an act or violation of law by the participant. Health Requirements: Participants must be in good physical and mental health. Any physical condition, diet, or treatment requiring special attention must be reported in writing when the reservation is made. National Geographic Expeditions encourages participants to consult a doctor for specific medical advice about any activities or destinations. Certain Expeditions may require that the participant obtain medical consent prior to departure as a condition of participation. Immunization requirements vary from country to country. Required inoculations, if any, must be recorded by the

Scenic°

participant’s health practitioner on a valid vaccination certificate which the participant must carry for proof of inoculation where required. Medical Authorization and Coverage: In the event the participant becomes sufficiently incapacitated as to be unable to direct his or her own care, there is no one on the Expedition who can direct participant’s care, and National Geographic Expeditions or Scenic Tours is unable or does not have time to contact participant’s emergency contact, the participant, by registering and paying a deposit for an Expedition, authorizes any medical treatment deemed necessary in the event of any injury or illness while participating in the activity including, but not limited to, X-ray, examination, anesthetic, medical or surgical diagnosis, or treatment and hospital care which is deemed advisable by, and is to be rendered under the general or specific supervision of, any physician and/or surgeon licensed in the United States, or, if in a foreign country and no physician licensed to practice in the United States is reasonably available, by a duly licensed physician deemed competent to render the necessary care. In addition, the participant certifies that they have medical insurance which will cover personal accidents, medical expenses, medical evacuation, air ambulance, loss of effects, repatriation costs and all other expenses which might arise as a result of loss, damage, injury, delay or inconvenience occurring to the participant, or that in the absence of this medical insurance coverage, the participant agrees to pay all costs of rescue and/or medical services as may be incurred on the participant’s behalf. Photography: National Geographic Expeditions and Scenic Tours and the Expedition leader reserve the right to take photographs or videos during the operation of any Expedition or part thereof and to use the resulting photography, videos, or recordings for promotional or commercial use. By making a reservation on an Expedition, the participant agrees to allow his/her likeness to be used by National Geographic, National Geographic-authorized third parties, and Scenic Tours without compensation to the participant. If the participant prefers that his/her likeness not be used, he/she must notify National Geographic Expeditions and/or Scenic Tours in writing prior to departure of the Expedition. Copyright in all photographs, video, and related materials created by the participant (“Expedition Materials”) will belong to the participant upon creation. The participant grants to National Geographic and Scenic Tours a nonexclusive, worldwide, irrevocable license to use any Expedition Materials provided to National Geographic Expeditions and/or Scenic Tours in any media for the following limited purposes: editorial use, promotion of this editorial use, promotion of National Geographic’s and Scenic Tours’ travel programs, or promotion of the mission of National Geographic or Scenic Tours. Assumption of Risk: By registering for an Expedition, the participant acknowledges that he/she is aware that travel such as the Expedition he/she is undertaking involves potentially dangerous activities, some in remote areas of the world, with a risk of illness, injury or death which may be caused by forces of nature, illness, or by willful or criminal conduct of third parties or by terrorism. The participant further acknowledges that weather conditions may be severe, adverse and/or unpleasant and that medical services or facilities may not be readily available or accessible or consistent with standards in the United States during some or all of the time during which he/she is participating on the Expedition and that when available may not be of the quality which exists in the United States. Cruising aboard a vessel used in an Expedition is provided solely by the ship operator of the relevant vessel pursuant to Scenic Tours’ or such Other Providers’ contract of carriage. The participant acknowledges that he/she will be subject to terms of any such contract(s) of carriage. Arbitration Agreement: (1) National Geographic and Scenic Tours (collectively “Tour Provider”), and the participant agree that any and all disputes and claims that the participant and Tour Provider may have against the other that arise out of or relate to this Agreement and the Expedition, including the breach, termination, enforcement, interpretation or validity of this Agreement, including the agreement to arbitrate (the “Arbitration Agreement”) and the scope or applicability of this Arbitration Agreement (collectively, “Disputes”), including but not limited to the arbitrability of any and all Disputes, and even if the events giving rise to Disputes occurred before this Arbitration Agreement became effective, will be resolved in a binding, confidential, individual and fair arbitration process, and not in court. The participant and Tour Provider agree to give up the right to sue in court. The participant and Tour Provider also agree to give up the right to have Disputes heard by a jury and the ability to seek to represent, in a class action or otherwise (see paragraph 9 of this Arbitration Agreement below). The only exceptions to this Arbitration Agreement are that (i) the participant and Tour Provider retains the right to sue in small claims court and (ii) the participant and Tour Provider may bring suit in court against the other to enjoin infringement or other misuse of intellectual property rights. (2) This Agreement evidences a transaction in interstate commerce, and thus the Federal Arbitration Act, 9 U.S.C. §§ 1-16, governs the interpretation and enforcement of this Arbitration Agreement. This Arbitration Agreement will survive termination of this Agreement.

(3) Any arbitration between the participant and Tour Provider will be conducted by the American Arbitration Association (the “AAA”) and will be governed by the AAA’s Commercial Arbitration Rules and the Supplementary Procedures for Consumer Related Disputes (collectively, the “AAA Rules”), as modified by this Arbitration Agreement. The AAA Rules are available online at www.adr.org, or by calling the AAA at 1-800-778-7879. The arbitration will be conducted by a single arbitrator. If the participant and Tour Provider cannot agree on who that single arbitrator should be, then the AAA shall appoint an arbitrator with significant experience resolving the type of Dispute at issue. The arbitrator is bound by the terms of this Agreement. (4) If either the participant or Tour Provider wants to arbitrate a Dispute, the participant or Tour Provider must first send by mail to the other a written Notice of Dispute (“Notice”) that sets forth the name, address, and contact information of the party giving notice, the specific facts giving rise to the Dispute, the Expedition to which the Notice relates, and the relief requested. The participant’s Notice to Tour Provider must be sent by mail to Arbitration Notice of Dispute, c/o Business and Legal Affairs, Litigation VP, 1145 17th Street NW, Washington, DC 20036 and One Financial Center, Suite 400, Boston, MA 02111 attn: General Counsel. Tour Provider will send any Notice to the participant at the contact information Tour Provider has for the participant or that the participant provides. It is the sender’s responsibility to ensure that the recipient receives the Notice. During the first 45 days after the participant or Tour Provider sends a Notice to the other, the participant and Tour Provider may try to reach a settlement of the Dispute. If the participant and Tour Provider do not resolve the Dispute within those first 45 days, either the participant or Tour Provider may initiate arbitration in accordance with the rules and procedures provided for by the AAA. A form for initiating formal arbitration may be found on the AAA’s website at www.adr. org (“Arbitration Form”). In addition to filing this Arbitration Form with AAA in accordance with its rules and procedures, the participant must send a copy of this completed Arbitration Form to Tour Provider at the address listed above to which the participant sent the Notice of Dispute. (5) AAA charges fees to conduct arbitrations. Ordinarily, the claimant has to pay that fee to start a case, but if the participant wishes to commence an arbitration against Tour Provider, and the participant is seeking to recover less than $10,000 (inclusive of attorneys’ fees), the participant will not have to pay this filing fee; Tour Provider will pay it on the participant’s behalf. If the participant is seeking to recover $10,000 or more, the participant will have to pay the filing fee charged by AAA, but Tour Provider will reimburse that fee if the participant wins the arbitration. (6) If the participant is seeking to recover $10,000 or less, AAA rules provide that the Dispute should be resolved without a hearing, by submission of documents only. Either the participant or Tour Provider may request a hearing, however, and be responsible for the fees associated with it. If the arbitrator recommends a hearing even if neither the participant nor Tour Provider request one, Tour Provider will pay the arbitrator’s fees associated with the hearing. If the claim is for more than $10,000, the manner and place of the hearing will be determined in accordance with the AAA Rules. (7) Regardless of how the arbitration proceeds, the arbitrator shall issue a reasoned written decision sufficient to explain his or her findings and conclusions. (8) The participant and Tour Provider may incur attorneys’ fees during the arbitration. In addition to whatever rights the participant may have to recover the participant’s attorneys’ fees under Applicable Law, if the participant prevails in the arbitration, and if Tour Provider failed to make a settlement offer to the participant before the arbitration or the amount the participant wins is at least 25% greater than Tour Provider’s highest settlement offer to resolve the Dispute, then Tour Provider will pay the participant’s reasonable attorneys’ fees in addition to the amount the arbitrator awarded. If Tour Provider wins the arbitration, the participant will be responsible for the participant’s own attorneys’ fees. In addition, if the arbitrator, at the request of the winning party, finds that the losing party brought a Dispute or asserted a defense frivolously or for an improper purpose, then regardless of the amount in dispute, the arbitrator must order the losing party to pay both sides’ arbitration fees and may order the losing party to pay the winning party’s reasonable attorneys’ fees, unless such an award of fees is prohibited by Applicable Law. (9) The arbitrator may award declaratory or injunctive relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party’s individual claim. The arbitrator may not order Tour Provider to pay any monies to or take any actions with respect to persons other than the participant, unless Tour Provider explicitly consents in advance, after an arbitrator is selected, to permit the arbitrator to enter such an order. THE PARTICIPANT AND TOUR PROVIDER AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN THE PARTICIPANT’S OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, REPRESENTATIVE OR MULTI-CLAIMANT PROCEEDING. Further, unless Tour Provider agrees, the arbitrator may not consolidate other persons’ claims with the participant’s, and may not otherwise preside over any form of a representative, multi-claimant or class proceeding. If this specific provision

59

is found to be unenforceable, then the entirety of this Arbitration Agreement will be null and void, but the rest of this Agreement, including the provisions governing where actions against Tour Provider must be pursued, will remain in effect. (10) The participant and Tour Provider agree to maintain the confidential nature of the arbitration proceeding and shall not disclose the fact of the arbitration, any documents exchanged as part of any mediation, proceedings of the arbitration, the arbitrator’s decision and the existence or amount of any award, except as may be necessary to prepare for or conduct the arbitration (in which case anyone becoming privy to confidential information must undertake to preserve its confidentiality), or except as may be necessary in connection with a court application for a provisional remedy, a judicial challenge to an award or its enforcement, or unless otherwise required by law or court order. Cruise Environment, Logistics, and Amenities: Noise, Vibration and Odor. While the operator will take reasonable steps to minimize noise, vibrations and odors on the ships, each participant acknowledges and accepts that some noise, vibration and intermittent odors may be experienced on ships and that none of National Geographic, Scenic Tours, or Other Providers will be liable to any participants for claims in relation to any such noise, vibration or odors. Docking Position. During port stops, ships may dock side-byside, obstructing views and requiring participants to pass through other ships to embark and disembark. Service of Alcoholic Beverages. Responsible service of alcohol is adhered to by all staff on board the ships, and ship staff reserves the right to refuse service. The all-inclusive beverages policy does not apply to any third party suppliers or Other Providers. Internet Service. Internet facilities are available on board each Scenic ‘Space-Ship’ or Scenic Aura cruise at no additional charge. Complimentary internet service does not apply to any third party suppliers or Other Providers. Internet availability and quality may vary from country to country and can also be affected by technical issues, weather or unfavorable terrains and other factors outside of National Geographic Expeditions’ or Scenic Tours’ control. Scenic Tours does not guarantee the availability or quality of internet connections. Scenic Tailormade. Personal devices are provided in all suites on board a Scenic Space-Ship for use both on board and on shore. They are not available in Portugal or Myanmar. Entrance fees, gratuities and transportation while using Scenic Tailormade are not included in the price of the Expedition. Scenic Tailormade Tour/Journeys and their content cannot be guaranteed in all locations. Scenic Sundowner. Scenic Sundowner is a seasonal highlight and is included for sailings departing from 01 April to 30 September. Depending on sailing date, the event may not be held during sunset. Scenic Culinaire. Scenic Culinaire is offered on board Scenic Diamond and Scenic Sapphire Space-Ships only while sailing in France. Scenic Culinaire cooking school has limited capacity and may not be able to accommodate every participant on every Expedition. Cooking classes held in Scenic Culinaire will be hosted by the on board culinary team. Itinerary may vary on location and inclusion of the cooking school. Registrations are made on board. Scenic Freechoice. All Scenic Freechoice activities can be booked while on Expedition with the Cruise Director or Expedition Director (unless otherwise stated) and are subject to availability, and seasonal and operational factors. Some activities require a minimum and maximum number of participants to operate. Scenic Enrich. It may not always be possible to offer every Scenic Enrich activity in the itinerary, brochure, or catalog. Wherever possible, suitable alternatives will be provided without liability to the participant. Privacy Policy: National Geographic Expeditions’ privacy policy can be found at nationalgeographic.com/community/ privacy/. Mailing List: If you are receiving duplicate catalogs, have address updates, or would like to be removed from future National Geographic Expeditions mailings, please call tollfree 1-888-966-8687, and for Scenic Tours mailings, please call 1-857-201-0063. Other: The applicable Terms and Conditions may vary from those listed above based upon the specific Expedition selected by the participant. A copy of the final Terms and Conditions applicable to each participant will be provided when completing Scenic Tours’ trip personalizer. Additionally, Scenic Tours will subsequently deliver a contract of carriage.
