The leasing of mineral and gas rights associated with 18,347 acres of land in Oakland County — many of them in close proximity to lakes — at a May 8 state auction has prompted concerns among citizens and local officials alike. Just two oil and gas companies bid on and won five-year leases on the rights. Look at our map to see where.

As the weather warms, a pair of county stand up paddleboarding experts, Matt Campbell and Mary Radtke, are now offering individual and group lessons on the burgeoning sport that has the attention of Olympics officials, plus other services.

35 A yes and a no 50 Beach testing While one Oakland County lake community recently achieved success in an effort to have a special local watercraft control enacted for its lake, another has been stymied and is renewing its own effort to gain approval for a revised local marine law.

Budget cuts have once again forced the Oakland County Health Division to scale back the number of beaches it monitors each year — including the elimination of semi-public beaches — from over 100 to just 45 public beaches on 37 lakes during the 2012 season.

he growls of revving engines, rock 'n' roll and summertime blues will again ripple through the air at the 5th annual Walled Lake Thunder hydroplane race on Walled Lake on Saturday, June 9 and Sunday, June 10. People may come for the race at E. V. Mercer Beach, but they stay for the ambiance: The aromas of steaks and burgers sizzling on the grill, cold beverages with little umbrellas, and crowds of people milling up and down the beach chatting with friends and laughing the day away. As in-board hydroplanes torpedo across the lake topping out at 160 mph, bystanders watch wide-eyed from the grandstands, bask on the beach or soak up the sun. Bayside Sports Grille owner John Semma sponsors the event every year and antes up over $40,000 to put on the race. His monetary backing helps pay for prizes, cranes, equipment rentals and insurance costs. "John is really behind this project," said Todd Clickner, the general manager of Bayside. "It takes a lot of financial commitment, as well as time and effort, to coordinate this event every year." A nine-member ad hoc committee is annually formed to oversee the race and hash out all the details. "We plan out different responsibilities over the course of the weekend," Clickner said. For the past four years, in-board hydroplanes have been jetting across the city of Walled Lake's namesake and riveting crowds. This year will be no exception. "I've met people (at the race) from as far as Australia and all over the map," said Todd McQuade, owner of T & D Enterprises and the race's cochairman. "We get a lot from Up North like Gaylord and Iron Mountain — you can't get more north than that." McQuade has coordinated the Walled Lake Thunder event since its inception in one of the only historical lakefront communities in southeast Michigan. He is a member of both the American Power Boat Association (APBA) and Marine Prop Riders, and has lent his expertise to both the annual Quake on the Lake race

held on Pontiac Lake and the Gold Cup race on the Detroit River. "I act as co-chair of the (Walled Lake Thunder) race, along with Jim Sechler, one of our technical inspectors," McQuade said. "Every year, and before the race is done, I start working on next year's race. Each year I attend two to three conventions, and a meeting with the APBA." Over 60 boats are expected to compete at this year's Walled Lake Thunder event, a vast difference from last year when just over 40 boats registered. The event continues to grow and attracts the top racers from across the country. "We have a lot of returning customers, but 8-9 modifieds have not ever been at the race, so these are new teams," McQuade said. Sechler has taken first-place in the 1-liter modified race every year of the Walled Lake Thunder event. He's been racing since 1991 and has trekked all over the country, entering competitions in Washington, Virginia, Louisiana, Ohio, South Dakota, Maryland, New Jersey and Michigan, his stomping grounds. "The Walled Lake Thunder is a real fun race for us because it's local and we have so many friends and family to come out and watch," he said. s the reigning champion in his class, Sechler credits his team members for their stamina and innovation in ultimately bringing home the title. "I attribute winning to a combination of things, but mostly being well prepared," Sechler said. "I'm an engineer and Dan (Kanfousch, the team's driver) is a physicist, so we are always thinking about things and put into practice things we've learned along the way." This year, Sechler expects some stiffer competition. "Our competition gets harder every year," Sechler said. "They are always right behind us and one mistake and they'll pass us up. You must be at the right place at the right time and hope you're prepared." Apart from Sechler, the owner, his team is comprised of Kanfousch, who has over 20 years of experience; and Tim Collins, who drives the team rig

around the country and, like Sechler, helps with engine work. "Dan and built the boats and is similar to others we race against. Usually we try to have everything as upto-speed as possible and so far we've been successful," Sechler said. While trophies and cash prizes are always an added bonus, the personal goal is to win. "We've finished first in our class every year," Sechler said. "It's not uncommon for our team. We're very fortunate to win most of our races wherever we go, but winning first (place) is more a prestigious thing. Our goal every year is to win the APBA national title, so winning races is part of that and inches us closer to that goal." Sechler's team has won the title consecutively for the last seven years. "You try to get the best score of the day and add up the best 15 scores. The best racer in the country is the team with the highest points and the champion of that class." Sechler said that while his team is striving to win the APBA crown again this year, the camaraderie with his fellow racers is part of the ride. "Our competition are good friends with good boats who race together and then later have a beer together," he said. "It will be tough to earn high points this year, but we will give it our best shot." s a riparian and Walled Lake City Councilman, Casey Ambrose looks forward to the race each year. To celebrate it, he invites a slew of friends to join in the fun. "I have 40 or 50 people friends over to the house," Ambrose said. "It's one of the biggest spectacular events on the lake with its loud engines and boats going fast — that attracts a lot of spectators and the majority of the area looks forward to it, also." The 2012 Walled Lake Thunder will feature several different classes of in-board hydroplanes classified according to length of boat, and size and type of engine. The hydroplanes feature everything from personal watercraft engines all the way up to V-8 Ford engines and the classes include 1-liter stock; 1.5-liter

A

stock; 2.5-liter stock; 2.5-liter modified; 5-liter; national modified; and grand national hydro. A new class has been added this year: Superlight Tunnel. "Between 7 and 9 of the out-boards race between 40 and 60 mph," McQuade said. "They've been around for decades, so we decided to include them this year." "We have a record number of boats in the race this year, so we're all geared up for it," Clickner said. here will be two Grand Prix boats performing exhibitions on June 9 and 10, with the boats racing up to speeds of 200 mph. New this year will be a half-dozen vintage boats on display each morning. "Anytime you can bring in people to the city in a positive way, everyone benefits," Ambrose said. Hydroplane is the oldest form of specialized boat racing. The boat's motor is within the boat itself. The race driver sits in a capsule while manning the helm. The boat skims across the top of the water, leaving a gap between the boat and the water's surface. The only parts that touch the water are the propeller and the steer fin. The city of Walled Lake was required to obtain a state Department of Natural Resources (DNR) permit and pay out sanction fees to the APBA prior to finalizing race plans. Once it sailed past those obstacles, it gathered designs for the 1-mile oval course that took a year of planning. Points are combined for qualifying rounds and finals both days over the weekend. First-, second- and third-place winners will earn trophies or monetary prizes. "Racers earn trophies for first, second and third (places)," McQuade said. "The cash prizes are divided up between first- through fifth-place — $750 per class per day, or $1,500 per weekend per class." Like last year, a grandstand will accommodate seating for over 100 attendees during this year's event. While the two-day affair is a highly attended event and attracts racing fans from all over the country, weather is always a factor. "Heavy wind can cause delays," McQuade said.

"We'll (race) in rain, but not complete downpours, not in thunder or lightening." ast year, four accidents occurred during the race due to high winds. "The first one happened on Saturday and another three on Sunday — all due to 7 mph winds coming from the wrong direction," McQuade said. "We would clean up one accident and then boom, we would have another one. Thankfully nobody was hurt, but the boats were kind of wrecked." McQuade estimates crowds exceeded 10,000 last year. "Every year attendance grows," he said. "Last year there was standing room-only on the beach. With the addition of more spectators at the beach and at Bayside, people are genuinely having fun and enthralled by the race." "Last year's turnout was outstanding," Clickner said. Bayside's pair of patios overlook the blue waters of Walled Lake. Spectator seating and viewing is free of charge, with food and drinks available at the viewing area or at Bayside's restaurant. VIP seating is available at a cost (covered or open seating) on the deck. Semma has also reserved a VIP tent with food and beverage options for anyone affiliated with or sponsoring the race. Booths will line up along Walled Lake Drive with program sponsors, like Bob Shuman of Shuman Chrysler Dodge Jeep Ram, to promote their goods and services. Ambrose's restaurant, Casey's of Walled Lake, will set up a booth selling barbecue pulled pork sandwiches and sushi balls. "We are the best of the east and west, and have the biggest sushi bar in Walled Lake," Ambrose said. "We have a new chef at Casey's — a trained Japanese sushi master chef. He makes these sushi balls (like a California roll) with sushi pieces in a tempura batter on a stick with choice of sauce." In addition, there will be a number of food stations with offerings such as lemonade, water, ice cream, hot dogs and hamburgers.

Entertainment is lined up during both evenings. On June 9, radio station 95.5 FM will be onsite from 9 p.m. to 2 a.m. Multiple well-known DJs will alternate playing music from the 1980s up to current Top 40 hits. Then on June 10, 95.5 FM will return from 3 to 8 p.m. At 9:30 p.m., classic rock band Major Woody will take to the stage and get the the crowds jamming. Security will be provided by the Walled Lake Police Department. Five or six officers will be assigned to patrol the event and surrounding area, according to Deputy Police Chief Bruce Kirby. The Oakland County Sheriff's Department will provide a Marine Division boat on the water that will be manned by two Walled Lake police officers. The DNR will also have a presence on the lake, while the Walled Lake Fire Department will remain on standby in case of emergencies. Roads impacted by planned weekend closures include East Walled Lake Drive from Leon to Liberty Street; Witherall from East Walled Lake Drive to Market; Ferland Street from East Walled Lake Drive to Market Street; and Market Street from Liberty Street to Witherall. alled Lake Drive from Liberty to Witherall will shut down at 2 a.m. on June 9. Barricades will be removed by 7 p.m. on June 10. Ferland and Market streets, as well as Witherall and Walled Lake Drive to Leon Road, will close only during event hours. Bayside will provide free valet parking in front of its parking lot at the front entrance on East Walled Lake Drive starting Friday. The main parking lot will be partitioned off and reserved for mechanics to work on the boats. Like last year, attendees can purchase a $10 pit pass to see the different boat motors and talk face-toface with drivers. Registration is June 9 beginning at 6 a.m. and again on Saturday at 8 a.m. Boats will be launched at 10 a.m. "It's such a cool thing for spectators and for the city at large," McQuade said. ❏

ohn Popovich has seen the horrors of war. The 92-year-old Commerce Township resident of 60 years who lives on Lower Straits Lake was compelled to serve his country after the Japanese attacked Pearl Harbor on Dec. 7, 1941. Serving in 46 combat missions in the air as a U.S. Army radio operator and mechanic/gunner in a B-26 Marauder airplane during the most pivotal points of the war, including the Battle of the Bulge, Popovich was earlier this year awarded the Legion of Honor recognition by France, the country he and his brothers-in-arms helped liberate. "That really surprised the heck out of me," he said. Also a recipient of a Chevalier of the Legion of Honor, Popovich said "the most important and terrible" missions

in the Ardennes and Rhineland he flew on were from France, pushing into Germany. "I sat in that back end of the plane and when we got back on the ground, our ground crew pounded in the holes in the plane just where the top-turret gunner and I were sitting, in an area no longer than 15 feet, and we were all in that area with 82 holes in there," he said. "That's a lot of holes in that little area, and only one man ever got hit in there, in our 23rd mission." But despite of the terror of war, he and his fellow soldiers never lost faith. "We always thought that we would pull through," he said. "We'd certainly prayed we would and I was never afraid." — Michael Shelton — Oakland Lakefront photo/Amy K. Lockard

The oil and gas rights associated with 18,347 acres in the county were leased for a total of $616,514, with the average bid per acre at $33.60. The leases carry five-year terms. Two companies out of Traverse City — Jordan Development Company and Pteradon Energy — leased all of the Oakland County rights available during the May 8 auction. Pteradon leased the rights associated with 664 acres, while Jordan leased the rights to over 17,600 acres. (Oakland Lakefront graphic/Marcia Reimer)

state decision to auction off leases on oil and natural gas rights associated with lakefront parcels in southeast Michigan is being lamented by some Oakland County residents and municipal officials. The state Department of Natural Resources (DNR) offered state-owned oil and gas lease rights associated with 108,164 acres in 23 counties at an auction held on May 8. It was the first such auction where oil and gas rights associated with state-owned land adjacent to southeast Michigan lakes were offered for lease. State oil and gas auctions for five-year leases routinely occur twice a year, once in the spring and once in the fall. Two companies out of Traverse City — Jordan Development Company and Pteradon Energy — leased all the land offered in Oakland County at the recent state oil and gas lease auction, according to the tentative auction results summary posted on the DNR's website. The results are tentative pending approval by the director of the DNR at the next state Natural Resources Commission meeting in June. According to DNR Spokesperson Ed Golder, the mineral and gas rights associated with 91,000 acres of state land were leased at the auction, bringing in a total of $4.125 million. The average bid per acre was $39.90. "Historically, this was a pretty middling auction," Golder said. "It wasn't the smallest. It wasn't the largest. The largest was in May 2010. It raised $178 million, and on average the bid was $1,500 per acre." According to Golder, most of the auction proceeds go to the Natural Resources Trust Fund (NRTF), which under a state constitutional provision can only be used to purchase and develop land for public recreational use. However, if the NRTF is at its cap of $500 million, then the auction proceeds go into the Parks Endowment Fund, which contains money only used for park maintenance. A small amount also goes to the care of fishery and wildlife habitat. Oral auction bids can be submitted by individuals of legal age; or by a partnership, a corporation, or other legal entity qualified to do business in Michigan. According to Julie Manson with the state Department of Environmental Quality (DEQ), bidders typically are representatives from the oil and gas industry. In Oakland County, the mineral and gas rights associated with all 18,347 acres up for auction were leased at the May 8 auction. The proceeds gained from Oakland County tallied up to $616,514, with the average bid per acre at $33.60. Pteradon leased 664 acres, while Jordan leased the rest — over 17,600 acres. According to Golder, all the land leased in Oakland County is classified as "non-developmental." www.oaklandlakefront.com

"This means the surface of the land cannot be disturbed," he said. "There can be no drill head or apparatuses on that land." However, that doesn't mean that the oil or gas resources underneath the surface can't be accessed by drilling horizontally or directionally with the drill head in another location. "People could buy the property next door to the acreage leased and go in horizontally," Golder said. "They could also use the (non-development) land to put together a drilling unit. And while the unit cannot be on the non-development land, that land could be included to make a space large enough to satisfy the DEQ's requirement." According to the DEQ's General Spacing Rules, 40 acre spacing is established for all wells in Michigan, although there are exceptions. Ben Brower, the vice president of Jordan Development, said company officials believe the Oakland County land involved in last months lease has oil and gas potential. However, in order to utilize the non-developmental land, the company would need to enter into private leases, as well, to meet the DEQ's drilling unit spacing requirements. Leasing the mineral rights of a specific parcel doesn't by itself grant permission to drill a well. According to the DNR, if a lessee chooses to pursue development of the oil and gas rights, separate written permissions — including a drilling permit from the DEQ — must be obtained prior to drilling. urthermore, when oil and gas rights are leased, that doesn't automatically mean a well will be drilled. The drilling of a well doesn't always tap into commercial amounts of oil or gas. "The DEQ's Office of Oil, Gas and Minerals regulates the drilling and completion of oil and gas wells. The DEQ enforces a comprehensive set of regulations designed to protect Michigan's resources from potential negative impacts from drilling and completing wells," Golder said. These potential negative impacts have caused concern in some quarters, including among protesters at the auction held in Lansing last month. "Some were led out of the room — they had registered as bidders — for causing disturbances during the auction, and one was even arrested," Golder said. The protesters aren't the only ones with concerns. Citizens of West Bloomfield Township have also expressed reservations about the idea of mineral rights being leased in their area, according to township Clerk Cathy Shaughnessy, who crafted a resolution for the township Board of Trustees to consider in order to try

to prevent any drilling for oil or gas in the township. "The state of Michigan (leased) the mineral rights for about 37 acreage parcels in West Bloomfield," Shaughnessy said. "There were quite a few parcels that were listed near Cass Lake — either under or near the lake. And they were nominated (for the auction) by an individual in Traverse City who is involved with a company that is involved with oil and gas. While the law doesn't allow us to forbid it, we are hoping that by passing a resolution saying we oppose any oil or natural gas drilling in the township that we can prevent it from happening." The West Bloomfield resolution also opposes "any and all directional drilling originating in another community and terminating under" the township. "You can horizontally drill from about a mile and a half away," Shaughnessy said. "So, someone could be drilling in Waterford and then underground drill horizontally for a mile and a half to Cass Lake." The resolution passed unanimously — at least among the five board members present at the meeting on May 14. West Bloomfield resident Kathy Chiaravalli initially brought the issue to the township board's Kathy Chiaravalli attention. She said she's concerned the state is not making enough money on oil and gas leases compared to the potential environmental risks. "Oil companies make a fortune, yet they don't clean up their messes that well," Chiaravalli said. "I'm just concerned about the water I drink, and the water my kids swim in. I don't like the idea of them fracking near my lakes. If they are going to frack, let's develop clean frack water. Once one lake is contaminated, all the lakes are interconnected through the watersheds. Oakland County is one big wetland." ydraulic fracturing, more commonly known as "fracking," is a well stimulation process used to extract underground resources, including oil, natural gas, geothermal energy, and water. It's used by gas producers to stimulate wells and recover natural gas from sources such as coal beds and shale gas formations, according to the U.S. Environmental Protection Agency (EPA). The process uses thousands of gallons of water, mixed with chemicals and sand, to create fissures in rock formations to release oil and natural gas. A study conducted by the EPA in 2004 concluded that there was little-to-no risk of fracturing fluid contaminating underground sources of drinking water. In 2005, Congress exempted hydraulic fracturing from the federal Safe Drinking Water Act.

H

www.oaklandlakefront.com

Since then, however, there have been complaints of water contamination following the use of fracking in several states, including Wyoming and Pennsylvania, which has raised concerns across the nation. hile her concerns have not been abated, Chiaravalli, who attended the May auction, said she was pleased by the solidarity shown among township officials. "It's a rare moment when all the township officials are in agreement, and they are about this," she said. While Shaughnessy said board members discussed drafting an ordinance prohibiting drilling in West Bloomfield, they were told by the township attorney that was not possible. "We can't override the state on oil and gas drilling. However, we are looking at including stronger language to environmental ordinances to deter oil and gas drilling," she said. Nevertheless, West Bloomfield's Development Services Director Marshall Labadie shared his opinion in a letter to the township board, that since parcels with mineral rights available are surrounded by lands that are "owned by the township, other institutions, and/or (are) densely developed by many private property owners," West Bloomfield should not have be too worried. "These areas are not ideal for setting up drilling and extraction operations as they would need to procure large areas of land held by private property owners," he further wrote. "The cost of drilling and extraction must be supported by significant volumes of oil and gas that are most likely not available under the small tracts of land available for drilling and extraction. Thus, their business model does not fit. I would be concerned in the rural areas of the state as well as state forests, parks and game areas that house protected species and high quality streams and unique wetland systems. I truly believe West Bloomfield and its surrounding communities are OK." Brower said Jordan Development has fielded calls from concerned citizens. "We have received calls from a few people who were concerned, in particular from West Bloomfield Township. We told them we do not intend to drill in that township. That area is not our focus," he said. Nevertheless, Chiaravalli said a petition drive has been started. "We want citizens who live on the lake to write Gov. (Rick) Snyder and (Oakland County Executive) L. Brooks Patterson because we don't think the state is making enough money to cover the risks. Perhaps they can have auctions where certain areas start at a higher bidding price depending on the higher risks associated with the area being auctioned," she said. More details on the auction can be found at the DNR's website, www.michigan.gov/dnr. â??

tand up paddleboarding is not a water sport for the casual participant. It requires very specific techniques to fully reap the benefits of the core body workout that it offers, not to mention that three people this year have drowned in the United States while participating in the sport. As such, it's important that when getting your feet wet — literally and figuratively — in the up-andcoming sport, you do so using the proper techniques and stroke. Enter Matt Campbell and Mary Radtke, two Oakland County stand up paddleboarding experts who have started Stand Up Paddleboarding Education (SUP EDU), which in addition to offering private and group lessons on the sport, also offers yoga classes on the boards, team-building events for businesses, parties, and stand up paddleboarding race clinics. For a private individual lesson, it's $60 for an hour and a half. For the same time frame, two to five people cost $50 per person, while six to 10 people cost $40 per person, according to Campbell. Those rates include equipment, said Campbell, who has played a key role in developing, promoting, and expanding the burgeoning sport that has been on the radars of Olympics officials as a possible Olympic sport in the future. "We're one of the cheaper ones for (lessons)," Campbell said. And stand up paddleboarding — an ancient sport that can trace its roots back to the Hawaiian islands and re-emerged in the early 1960s there — is more than just hopping on a surfboard and using a canoetype oar to propel yourself across the water. There's almost an art to it, an order of operations, particularly if you want to get the full core body workout it was intended to provide. "There's so much to the stroke," Campbell said. "It's almost overwhelming for me to actually tell you everything that people do that they're not paddling properly ... I would say there's a gazillion things to

paddling properly. When people take our classes, they are almost overwhelmed how hard it is to paddle efficiently and correctly — the way they are holding their paddle; the different kinds of strokes; pulling the paddle too far behind them; the way the blade is passed forward. All those things are just huge. There's a more aerodynamic and efficient way to pass your blade forward. All those things come together to create your strength and efficiency." Radtke, who spends time on Tipsico Lake and Proud Lake in Oakland County, among others, agreed: "If they don't have the knowledge of the proper stroke, it's really hard to have enough power to fight a wind or a current and you fatigue really quickly," she said. "The main thing of this sport is engaging your core and paddling from your core. It's more of a core stroke instead of just using your arms. Power really comes from your core, not your arms." "A lot of people will say they feel it in their triceps," Campbell added. "Well, if you feel it in your triceps, you're not getting the core workout that it was intended for. You're using too much of your arm muscles. When you're really paddling hard, you're using your entire body. A lot of people don't know how to isolate that within the stroke because, at any given time within the stroke, those muscle groups are changing over from one muscle group to another muscle group, depending on how far you are in the stroke." That's where safety comes into play, according to Radtke. "We have so many concerns in this sport ... because of the lack of knowledge of it," said Radtke, who has been participating in stand up paddleboarding for about six years.

up to 1,000 calories an hour and, for a woman, 700 calories an hour. "If you're doing it right, you're working your butt off out there," Campbell said. C

ampbell, who was introduced to the coatings trade as a pre-teen, spends much of his time promoting stand up paddleboarding and making custom boards for clients. At the same time, he's a leader in research and design for international manufacturers, conducts product testing, and formulates several products that are not only used by Campbell himself, but also by mass producers both in and outside the water board industry. He established c3d Industries due to the growing need in the composites industry to develop a new resin completely different than epoxy, vinyl ester, and polyester. The company's products have a slew of applications, including automotive, aerospace, enhanced carbon fiber properties, composite products, marine uses, motorcycles, sporting goods, structures, wind energy, and industrial flooring. The c3d products, including the non-yellowing Resin-X, provide fast production times, dynamic flex, vibration dampening qualities, and superior chemical resistance over epoxies — all crucial to surfboards and now stand up paddleboards. Resin-X is noncorrosive and produced from products such as potatoes, corn, and wheat, making it more environmentally-friendly and safer than previous coatings. It's not just big, multi-national firms and board

makers that are benefiting by incorporating Resin-X into their products. Resin-X is even being used on the world stand up paddleboarding tour by Hawaii North Shore shaper Robin Johnston, according to Campbell. Resin-X has many other practical uses — boat repairs and dock coatings being just a couple of them. And Campbell has developed and produced a line of Resin-X support products that are more environmentally-responsible. They also aide in the finishing of fiberglass and wood products. Also involved with the No Child Left Inside movement in Oakland County and Heavner Canoes in Milford, SUP EDU can accommodate the busy lifestyles of clients. For example, if a client lives on a lake, they will go to you, according to Radtke. And the sport is not just a one-trick pony, Campbell said. "There's so many things you can do," he said. "You can fish. You can go for a stroll. You can just go hang out. You can do yoga on the board. You can practice long board tricks. You can race. And the appeal is that there are so many facets of the sport, you don't need to necessarily pigeonhole yourself into one particular part of the sport."

P

romoting stand up paddleboarding requires exposing more people to the sport, so Campbell's c3d company — and his BlkBox Surf company — sponsor racing teams in the Midwest and Hawaii. While c3d sponsors a team based at Hawaii's famous North Shore, the BlkBox label is sponsoring riders in Michigan and across the Great Lakes. For more information on SUP EDU or to schedule lessons, visit them on Facebook or call Radtke at 808-344-1553. ❏

hile one Oakland County lake community recently achieved success in an effort to have a special local watercraft control enacted for its lake, another county lake community has been stymied and is renewing its own effort. Local watercraft controls are special marine laws enacted for an individual lake, or even a specific lake feature like a bay or a canal. Such marine laws can only be enacted with state Department of Natural Resources (DNR) input and approval. The process of establishing a local watercraft control typically begins with a lake community approaching the municipal governing panel to ask the DNR to investigate the need for a local marine law. If the DNR determines there's a need for special watercraft rules, the department proposes a local ordinance for municipal adoption. If watercraft controls aren't recommended, the municipality is notified of the reasons for coming to that conclusion. Such a determination, under the Public Act (PA) 237 of 2006, can be appealed to the state's Natural Resources Commission (NRC). State law sets criteria the DNR must use when investigating a need for special rules on a particular waterway. According to the law, those are: • Whether the activities subject to the proposed special rule pose any issues of safety to life or property; • The profile of the water body, including local jurisdiction, size, geographic location, and amount of vessel traffic; • The current and historical depth of the water body; • Any identifiable special problems or conditions on the water body; • Whether special rules would create a hardship on normal navigational traffic; • Whether user conflicts exist; • Complaints received from local law enforcement agencies; • The status of any accidents that have occurred on the water body; • Historical uses of the water body and potential future uses; • Whether the water body is public or private; and • Whether existing law adequately regulates the activities. Following the DNR's initial investigation, it must issue a preliminary report. The report will be given to the municipality or municipalities where the water body is located. Then a public hearing on the findings of the report will be scheduled. Within 90 days following the public hearing, if the DNR determines there is a need for special watercraft rules, the DNR will propose a local ordinance. The municipal governing body may begin the process www.oaklandlakefront.com

toward adopting the proposed ordinance as drafted, or reject it — local officials can't revise the proposed ordinance drafted by the DNR. If the DNR determines there's no need for an ordinance, it's required to notify the municipality and specify the reasons for its determination. The DNR's determination can be appealed to the NRC. Under the appeal scenario, the NRC reviews written arguments received from the appellant and the DNR. The NRC may hear oral arguments; determine if additional information is needed from either party (if so, an extension is granted); and may request and consider advice from legal counsel to the NRC on legal and procedural matters pertaining to the appeal. An NRC decision will then be reached based on a majority vote, and issued in writing. In mid-May, the Milford Township Board of Trustees unanimously approved the introduction of an ordinance that would authorize the use of electric trolling motors on Sears Lake. Currently, Sears Lake is regarded as a "no-motors lake" per a township ordinance; however, the Sears Lake Community Association board recently received requests from residents to allow electric motors on the water. The DNR held a public hearing regarding the use of electric motors on Sears Lake back on March 1 at the Milford Civic Center, at the request of the Milford Township board. The hearing drew a total of 30 people, including state Sen. Mike Kowall (R-White Lake), Milford Township Supervisor Don Green, Clerk Holly Brandt, and Treasurer Cynthia Dagenhardt. esidents at the meeting spoke for and against permitting electric motors on the lake. Those opposing electric motors cited reasons ranging from the size of the lake, environmental and tranquility concerns, and residents having purchased properties on the lake with the knowledge that no motors would be allowed. Sgt. Al Bavarskas, a DNR Marine Safety Specialist, stated in a letter addressed to DNR Boating Law Administrator Lt. Andrew Turner that based on all the information gathered, Sears Lake didn't have enough

R

37

activity to justify a no-motor restriction on the lake and recommended allowing the use of electric-troll motors. The homeowner's association previously set forth guidelines for a possible amendment to the existing nomotors ordinance, such as capping electric motors at no more than 45 pounds of thrust and not allowing more than one motor per boat. The association is also requesting that no more than two boats with motors be allowed per dock and that boats with motors must be owned by a Sears Lake resident, who must also be in a boat at all times during operation, with exceptions. The next township board meeting is scheduled for Wednesday, June 20. eanwhile, the West Bloomfield Township Board of Trustees has thrown its support behind the Green Lake Association as it prepares an application to ask the state to establish a 15 mph speed limit for watercraft on the lake. The board last month unanimously directed the township to prepare a resolution of protest if the DNR denies the association's latest application. This comes after the DNR turned down an application last year that was submitted by the association to establish a 10 mph speed limit for watercraft on Green Lake, where only vessels powered by electric motors are allowed on the water.

The DNR's Bavarskas stated in a letter dated Nov. 18, 2011 that no safety or environmental issues have been reported on the lake, according to the Oakland County Sheriff's Department Marine Division. Bavarskas also stated in the letter that there have been no documented complaints from law enforcement agencies regarding activities on Green Lake, and that no accidents have occurred on the lake, according to the Marine Division and the DNR's Law Enforcement Division. He added that a public hearing was held on the association's first request, but no township officials were present and only three people in attendance gave testimony on their concerns about future watercraft technology, including the development of turbo-electric motors. Green Lake Association President Emil Hagopian and other Green Lake residents expressed disappointment in the DNR's denial of the initial request at the April 23 West Bloomfield Township board meeting, saying they didn't like the DNR's stance that there must be a documented problem on the lake before the department would consider addressing the issue. Township Trustee Steve Kaplan said that the application for a 15 mph speed limit is currently being submitted and that a public hearing is being scheduled for sometime in either June or July. ❏

hen Dave Hallman, 35, isn't coordinating the flooring installation for an auto or trade shows, he's helping put together a canoe race to honor a fallen friend. Hallman was the director of the inaugural Doug Killingbeck Memorial Canoe Race that was held May 12 on the Huron River at Milford Village's Central Park. Killingbeck, a close friend of Hallman, died last year while trying to save a Harrison Township teenager from drowning in the Huron River. "The races went well and we had a great turnout from the Michigan Canoe Racing Association (MCRA)," said Hallman, who lives in Howell with his wife and daughter. Growing up in Clio, north of Flint, Hallman didn't take to canoeing until July 2006, when he watched part of

the annual 16-hour Au Sable River Canoe Marathon from Grayling to Oscoda. "It struck me and appealed to me," he said, adding that he's been an MCRA member since he started competing in races in 2007, although now he mostly canoes recreationally. "Two weeks later, I met up with paddlers and started training." When he's not in the water, Hallman is busy as the show coordinator for D.E. McNabb Flooring in Milford, where he plans the installation of flooring and carpets at car and trade shows across the country, including the North American International Auto Show at Detroit's Cobo Hall. — Michael Shelton — Oakland Lakefront photo/Amy K. here is an old adage that says, "If you want something done, you've got to do it yourself." While that statement may be a bit more amusing coming from a musically-inclined crab with a Jamaican accent, it's nevertheless true in many circumstances, especially in light of the numerous budget cuts experienced by many Oakland County programs, including the county's annual beach monitoring program. Back in 2007, both public and semi-public beaches — those operated by property owner associations in residential neighborhoods and open to members — across the county were monitored regularly for potentially unsafe levels of bacteria. Of course, not every public and semi-public beach could be monitored that year — or in previous years — since Oakland County is home to a roster of 279 active public and semi-public beaches. "Even if we were at full capacity, we wouldn't be able to sample every beach in Oakland County in any given summer," said Mark Hansell, the Environmental Health Services Unit supervisor for the Oakland County Health Division. "We used to rotate in semi-public beaches on a five-year rotation. However, for the last two to three years, we've only strictly tested public beaches." Budget cuts have forced the county to scale back the number of beaches it monitors each year from over 100 to just 45 public beaches on 37 lakes. The lack of funding to collect water samples from more beaches may be reflected in the number of beach closings seen over the past several years. In 2011, a total of four beaches on four lakes were closed for a total of five days because of high bacteria levels found in beach water samples. In 2010, 11 beaches were closed for 16 days, which is significantly different from 2006, when 22 beaches were closed for a total of over 90 days. Back in 2006, more semi-public and private beaches were being tested, which Hansell said most likely accounts for the difference in results. This is one of the reasons why Hansell strongly

www.oaklandlakefront.com

encourages lake associations and neighborhoods that share a semi-public beach to recruit volunteers to collect water samples and have them analyzed by the county for bacteria levels. Although that water testing service used to be free, the county instituted a fee for water sample analysis at the beginning of this calendar year. For $6, the county will provide the necessary supplies for citizens to collect water samples themselves, do the lab analysis, and interpret the results. "The fee is to cover the sample bottles and the materials necessary to conduct the test," he said. "People can pick up bottles through the county Health Division. We also have instructions available on how to collect samples and where to turn them in for lab analysis. We really encourage people to do their own sampling. We hope people will take us up on the opportunity". And even on those lakes where public beaches are tested, people may be interested in collecting water samples from their favorite swimming holes that may not be part of the main beach. According to the state Department of Environmental Quality (DEQ), it's a popular misconception that if one area of a lake is contaminated by high levels of bacteria, then the whole lake is contaminated. In reality, bacteria contamination originates from conditions or factors present on or near the shore in the immediate vicinity of the contamination. Two beaches on opposite ends of a lake that have different on-shore conditions will not have the same bacteria levels in the water. This is why it's important for private homeowners who swim near their house to periodically collect water samples from where they swim and not rely on testing results from a beach down the road. Since contamination originates on-shore, it's generally considered safer to swim in deeper areas away from the shoreline, because wind direction and wave action could trap bacteria against the shore. The main bacteria that water samples are being tested for is E. coli. Most people have probably heard of beaches closing throughout the summer due to high levels of E. coli, and yet it's not E. coli which most OAKLAND LAKEFRONT

beachgoers have to fear. In fact, most strains of E. coli are harmless — with a few exceptions, such as the infamous O157:H7 strain, which is the strain most related to E. coli outbreaks in foods. However, while most strains of E. coli are benign, they can serve as a useful tool for water quality monitoring. Because E. coli lives in the intestinal tracts of warm-blooded animals, including birds and humans, it's often excreted in feces. This makes E. coli a useful indicator of fecal pollution, which can contain other harmful pathogens like bacteria, viruses, and protozoa, according to Dr. Joanna Pope, a post-doctoral fellow at Michigan State University (MSU) working in the lab of Dr. Joan Rose. Rose is the Homer Nowlin Chair in Water Research at MSU and an international expert in water microbiology, water quality and public health safety. "In human fecal material, pathogens can include norovirus, salmonella and pathogenic strains of E. coli, such as O157:H7," Pope said. "It may also be possible to detect other pathogens such as Cryptosporidium or Giardia. These pathogens can cause acute symptoms such as gastrointestinal illness (vomiting and/or diarrhea) and in some people, more chronic conditions such as kidney disease, skin rashes or longer-term fatigue." She added that the types of pathogens found in fecal matter can be "highly variable, both in type and abundance," depending on the source of the fecal material. There are a variety of sources that contribute bacteria and other pathogens to surface water resources. Sources of bacterial contamination include combined sewer overflows, which are releases of raw or inadequately treated sewage from systems designed to carry both sewage and stormwater to wastewater treatment plants. When the volume of the combined wastewater is greater than the treatment plant can handle, the excess untreated sewage and stormwater are discharged into nearby waterways. Sanitary sewer overflows are another potential www.oaklandlakefront.com

source of bacteria. They are discharges of raw or inadequately treated sewage from systems designed to carry domestic sanitary sewage, but not stormwater. According to the DEQ, systems that contain cracks, obstructions, illegal stormwater connections, or that are undersized with sewers and pumps too small to carry all the sewage may leak or overflow raw sewage from manholes, bypass pump stations, and treatment plants into surrounding waters, particularly during extreme hydrologic events. Failing septic systems also are a source of the bacteria that can force a beach closure. They can cause leaching and/or runoff into adjacent waterways, causing bacterial contamination. Urban stormwater runoff from roads, roofs, construction sites, parking lots, and other impervious surfaces may contain fecal matter from pets and wildlife, representing a common source of the bacteria that sometimes fouls beaches. Excessive waterfowl near beaches and animal waste runoff from farms and fields can work in tandem with stormwater runoff to contribute to elevated bacterial levels. Illicit connections of pipes containing sewage linked to storm sewers or surface waters are also a potential source of bacterial contamination. If E. coli is present in high levels, it's likely that other pathogens are in the water and sand, as well. However, it's very difficult to determine "a general risk frequency" with regard to beaches because of the multiple factors involved, according to Pope. These factors include behavior such as swimming vs. playing in the sand; susceptibility of the person, such as the difference between children and adults; and the weather conditions, such as onshore vs. offshore winds. "All of these factors can influence the possibility of health risks for a particular beach," she said. "EPA (Environmental Protection Agency) studies along Lake Michigan where wastewater influences the shoreline suggests that 10 percent of the people over the swim season may get sick." According to the DEQ, epidemiological studies of fresh water bathing beaches have established a OAKLAND LAKEFRONT

direct relationship between the density of E. coli in water and the occurrence of swimming-associated gastroenteritis. The recognition of this relationship has led to the development of criteria that can be used to establish recreational water standards. These standards specify that water samples from monitored beaches must meet a one-day standard of no more than 300 E. coli bacteria colonies per 100 milliliters of water, and a 30day geometric average standard of no more than 130 colonies per 100 milliliters of water. If a beach water sample exceeds either of those standards, the beach is closed until bacteria levels drop. Typically, bacteria levels will drop within 48 hours as wind and wave action, as well as ultraviolet light from the sun help reduce bacteria levels. However, there are exceptions to every rule, and sometimes it make take longer for bacteria to die in a freshwater environment, especially if the water is stagnant. Since illness can occur from swallowing water containing even minuscule amounts of fecal matter, it's important to determine as soon as possible if a local beach is contaminated — which is why many county health departments routinely collect water samples at beaches for testing to make sure the water is safe for swimming. "We think it's an important component to summer-time recreation. We want to make sure the facilities people use are safe for swimming," Hansell said. Four paid summer college interns will be responsible for collecting beach water samples at the county's public beaches this summer. "These interns are students usually studying environmental health sciences who need internships for a completion of a degree," Hansell said. The monitoring program starts on June 4 this year and will continue for eight weeks, until July 27. "We typically monitor through the last week of July. However, if there were beaches that were still having water quality problems, then we would continue to sample until problems clear up. In that www.oaklandlakefront.com

case, we might monitor for 10 weeks occasionally, but only for the beaches having those issues." Each of the 45 beaches targeted for testing this year will be sampled at least once a week for those eight weeks. If the lab results show E. coli bacteria levels exceed the state contamination standards, the county Health Division will close the beach by sending an intern to post a sign at the beach and by notifying the beach contact person. "If the results would have us close the beach, then we resample (that beach) every day," Hansell said. The closed beach will reopen once the E. coli levels are once again below the state's standards. While being active in monitoring private and semi-public beaches themselves, there are also a few other things riparian residents can do to ensure that E. coli levels remain low. Individuals can help prevent beach water pollution by conserving water; redirecting runoff; using natural fertilizers and compost in gardens; maintaining their septic systems properly; and properly disposing of animal waste, litter, toxic household products and used motor oil. People who use a beach also shouldn't feed the waterfowl or leave their trash because both continuously attract animals that may leave behind fecal matter. As for remaining healthy while enjoying the beach, it's always recommended to wash your hands after swimming or playing in the sand in order to avoid any invisible fecal matter from entering your system. And as for the county eventually monitoring more beaches in the future, Hansell said he's optimistic. "We are making proposals right now that we hope will allow us to add back next year some of those semi-public beaches," he said. "We are trying to include more for next season." waterway levels

Following are the waterway level readings for lakes and rivers across Oakland County, as compiled by personnel in Oakland County Water Resources Commissioner John P. McCulloch’s office. Legal levels are denoted by elevation in feet from sea level. Current (one month prior to press time) levels are denoted both in elevation from sea level and as plus or minus the legal level in hundredths feet. Prior year elevation from sea level is provided as a comparison. River depths are measured from the river bottom, at the point of measurement.
