BUYER’S PREMIUM The purchase price payable by the Purchaser shall be the total of the final bid price PLUS A PREMIUM OF SEVENTEEN PERCENT (17%) on any individual lot in the amount up to and including $1,000,000; TWELVE PERCENT (12%) on any individual lot on the amount in excess of $1,000,000. This premium is in addition to any commissions or other charges payable by the consignor. Auction The art illustrated in this catalogue will be offered for sale on April 9, 2021 by Scottsdale Art Auction, LLC on premises at 7176 Main Street, Scottsdale, Arizona. Scottsdale Art Auction, LLC is not responsible for any postponements of the sale due to conditions out of their control. Telephone Bidding As a courtesy to clients who are unable to attend the sale, a telephone and order (absentee) bid service will be offered as staff and time allow. Scottsdale Art Auction, LLC shall not be responsible for any errors or omissions or failure to execute such bids. The following are Procedures, Terms and Conditions on which all such Property listed is offered for sale by Scottsdale Art Auction, LLC as agent for various owners or other Consignors: 1. Scottsdale Art Auction, LLC reserves the right to withdraw Property at any time before or at the sale and shall have no liability for such withdrawal. 2. All Property will be sold “AS IS”. With respect to each lot of Property, Scottsdale Art Auction, LLC does not make any guarantees, warranties or representations, expressed or implied, as to merchantability or fitness for a particular purpose, the correctness of the catalogue or the authenticity or description of the Property, its physical condition, size, quality, rarity, importance, medium, provenance, exhibitions, literature or historical relevance. No statement, anywhere, whether oral or written, whether made in the catalogue, an advertisement, a bill of sale, a salesroom posting or announcement, or elsewhere, shall be deemed such a warranty, representation or assumption of liability. In no event shall Scottsdale Art Auction, LLC be responsible for genuineness, authorship, attribution, provenance, period, culture, source, origin or condition of the purchased Property and no verbal statements made regarding the Property either before or after the sale of the Property, or in any bill of sale, invoice or catalogue or advertisement or elsewhere shall be deemed such a guarantee of genuineness, or authenticity. Notwithstanding the foregoing, if within ten (10) calendar days after the purchase of any lot of Property, the Purchaser provides an opinion by a recognized authority on the artist and gives notice in writing to Scottsdale Art Auction, LLC that the lot is not authentic, and returns the purchased lot to Scottsdale Art Auction, LLC, within ten (10) days of its purchase in the same condition as when sold, then Scottsdale Art Auction, LLC will refund the full purchase price to the Purchaser. It shall be in the sole discretion of Scottsdale Art Auction, LLC as to whether the opinion provided by the Purchaser is an opinion by a recognized authority on the artist. 3. Scottsdale Art Auction, LLC and/or Auctioneer reserves the right to reject any bids. The highest bidder acknowledged by the Auctioneer shall be the Purchaser. In the event of any dispute between bidders, the Auctioneer will have absolute and final discretion to either determine the successful bidder or to re-offer and resell the Property item in dispute. After the sale, Scottsdale Art Auction, LLC’s record of final sale shall be conclusive.

4. At the fall of the Auctioneer’s hammer, the Purchaser shall (a) be acknowledged by bidder number by the auctioneer, (b) pay the hammer price and a buyer’s premium as outlined above. In addition, Purchaser may be required to sign a confirmation of purchase. All sales are final with no exchanges or returns. 5. Unless exempted by law, the Purchaser will be required to pay any and all state and local tax pertaining to sales (sales tax, transaction privileged, etc...). It is the Purchaser's responsibility to pay any applicable use tax imposed by their state of residence on the total purchase price. In the event that sales tax has not been included in the invoiced amount and it is subsequently determined that Scottsdale Art Auction, LLC was required to collect sales tax in connection herewith, Purchaser shall reimburse Scottsdale Art Auction, LLC upon demand for any sales tax (or equivalent) accessed or due as a result of goods or services proveded by Scottsdale Art Auction, LLC hereunder, unless Purchaser provides Scottsdale Art Auction, LLC evidence of exemption from such taxes. 6. Terms for all purchases will be cash, check or credit card (VISA/MasterCard/American Express) with settlement and payment due in full the day of the sale unless otherwise arranged. All monies shall be made payable to Scottsdale Art Auction, LLC. At the discretion of Scottsdale Art Auction, LLC, payment will not be deemed to have been made in full until funds represented by checks have been collected or the authenticity of bank or cashier’s checks has been confirmed. An additional 3% will be charged on all credit card payments. 7. No item of Property may be paid for or removed from Scottsdale Art Auction, LLC during the sale. After the sale has been completed and after the purchase price has been paid in full, Property must be removed from the saleroom at the Purchaser’s expense not later than three business days following the sale. Scottsdale Art Auction, LLC will, as a service to Purchasers, arrange to have Property packed, insured and shipped, all charges at the expense and entire risk of Purchaser. 8. Some items of Property may be offered subject to a “reserve” or confidential minimum price below which the item will not be sold. In such instances, Scottsdale Art Auction, LLC may implement the reserve by bidding through the Auctioneer on behalf of the Consignor. In no event shall the reserve exceed the low estimate in the catalogue. 9. Neither Scottsdale Art Auction, LLC, nor Auctioneer, nor Consignor make any representations whatsoever that the Purchaser of a work of art will acquire any reproduction rights thereto. 10. These Conditions of Sale and any other applicable conditions, as well as the Purchaser’s and Scottsdale Art Auction, LLC’s rights and obligations herein shall be governed by, construed and enforced in accordance with the laws of the State of Arizona. If these conditions are not complied with by the Purchaser, Scottsdale Art Auction, LLC may, in addition to other remedies available by law, including, without limitation, the right to hold the Purchaser liable for the total purchase price stated on the Confirmation of Purchase Invoice, either (a) cancel the sale and retain as liquidated damages any and all payments made by the Purchaser or (b) resell the Property privately or at public auction on three days’ notice to the Purchaser for the payment of any deficiency in the purchase price and all costs including handling charges, warehousing, the expense of both sales, the commissions, reasonable attorneys’ fees, any and all other charges due and incidental damages. 11. Biding on any item indicates your acceptance of these terms and all other terms announced at the time of sale whether bidding in person, by phone, by Internet, by absentee bid, or through a representative. 12. In most instances, sculpture measurements do not include base. In measurements for two dimensional art, height precedes width and does not include frame. 13. Bidding increments will normally follow the pattern below but may vary at the sole discretion of the Auctioneer. James Boren painted the cowboy way of life like few others during a critical period of Western art in the 1960s and 1970s. Hailing from the colorfully named town of Waxahachie, Texas—a Native American word meaning “buffalo creek”—Boren spent much of his life in Texas, but later earned his masters at the Kansas City of Art Institute, after which he taught art for two years in Kansas and later worked as an illustrator in Denver. In 1965 he became the first art director at what was then the National Cowboy Hall of Fame, today the National Cowboy & Western Heritage Museum, in Oklahoma City. Shortly after that, in 1968, Boren was invited to be in the three-year-old arts organization, the Cowboy Artists of America. He joined the group during a decisive period for Western art and he helped bring the genre, particularly cowboy paintings, to shows all around the world, including in France and China. Pause at Dry Creek was created in 1973, during Boren’s storied rise through the ranks of the CA. Just three years after this work was created he was named Texas Artist of the Year. Boren was also known for mentoring a new generation of Western artists, including Martin Grelle.

Of course, this claim is debatable, but so is most everything about Megargee, who has become something of an Arizona folk hero, whose life is marked by tall tales and grand Western adventures. We do know he was born in Philadelphia, and likely took a train out West when he was 13. He ended up in Wickenburg, Arizona, where he was a cowboy and a charismatic up-and-coming artist. He did work for Stetson and famously for the Arizona Brewing Company, as well as 15 large murals at the Arizona State Capitol. Swirling around Megargee are also many myths and legends, some likely concocted by the artist himself. “To borrow from the lyrics of Kris Kristofferson’s ‘The Pilgrim,’ Megargee was a ‘walking contradiction, partly truth and partly fiction.’ His whoppers could lead one down the path of plausibility, but the listener had to figure out where to get off,” writes Arizona historian Marshall Trimble. “…Details of his life remain elusive due to the fact that, for various reasons, he tended to re-invent himself over and over. He also never let the truth get in the way of a good story…During his checkered and fabricated life, Megargee would claim to be a lot of things, but one thing can’t be denied—he had talent.”

During the great illustrator migration from east to west in the late-20th century, Roy Andersen left his commercial jobs to paint in Arizona and Texas. His subjects included Crow, Apache and Cheyenne figures, many of them rendered within contemporary backgrounds and beautifully loose brushwork. In The Panther Bowcase, the artist was striving for a sense of authenticity that could be seen in every detail. “The mountain lion was considered by the Crow to be the ultimate hunter,” he wrote in Dream Spinner: The Art of Roy Andersen. “His pelt, trimmed with beautiful beadwork and ribbons, lent its magic to the bow and arrows it contained.”

104 Harvey Johnson 1921-2005 Summer Camp Oil on board 24 x 44 inches Signed lower left and dated 1986 Estimate: $6,000 - 9,000 Raised by two artist parents—a sculptor father and a landscape-painting mother—Harvey Johnson was conditioned at an early age to appreciate art and creative pursuits. In his teen years, Johnson studied through WPA art classes, but was interrupted by three years of Army service during World War II. After the war, he studied at the Art Students League and later took assignments as an illustrator, including for the Western pulp publications that were popular in the 1950s and 1960s. He was also a teacher for 19 years and a charter member of the Cowboy Artists of America, and even showed at the group’s first show in 1966. The artist, who lived in Santa Fe in an adobe house overlooking the Santa Fe Trail, later became a full member and was active in the group until his death in 2005. “Harvey fell in love with the Old West while doing freelance illustrations for the early pulp magazines. Many of the stories that he was illustrating were of frontier life,” writes the artist’s son, Scott Johnson. “Always a stickler for detail, Harvey started to research the fine points of each story. He read about the types of guns and saddles that were used, the way a holster was made and worn and the geography of the areas in which they took place. The more he studied the more interested he became.”

After a move to Arizona in 1973, Swanson would begin documenting modern Navajo life in Northern Arizona, as well as bluecollar cowboys. In addition to strong Western works—such as Takin’ No Shortcuts, with its riders tearing through a snowy landscape—Swanson also painted cultures around the world, including the people of Morocco, the Arctic, Hong Kong, Nepal and Spain, where he found many subjects in Granada. In 1984 he painted Granada Stone Mason, a similar work showing the same cart shown here in The Team at Granada. “When I went to Spain, I searched for the fine old carts with the huge wooden wheels. They had been banned from the streets because their narrows rims cut into the pavement on hot days,” he writes in The Art of Ray Swanson. “…One year later, I returned to Granada and found the same man doing the same job with the same cart.”

157 Daniel Morper 1944-2016 Lines of Power Oil on canvas 44 x 48 inches Estimate: $8,000 - 12,000 Known for a vast array of subjects from all corners of the country, Daniel Morper might be best known for scenes of trains and train tracks, as well as rivers, canyons and roads. They all had one thing in common: they cut through the landscape in dramatic ways, allowing the artist to paint nature interrupted and abbreviated by outside elements. “Morper rewards looking,” wrote art critic Peter Frank. “…Morper has a knack for finding the spectacular in the mundane…emphasizing— but not exaggerating—the skew of a vantage, the force and weight of a horizon, the surprise and poignancy of an object silhouetted against a sky.” The artist found great success in Santa Fe, New Mexico, where he was a regular at many of the art hangouts, as well as the Santa Fe Railyard. The artist, who at one point in his life was supposed to be a lawyer, has been celebrated at museums around the country, including the Cleveland Museum of Art, Indianapolis Museum of Art, Minneapolis Institute of Art, Philbrook Museum of Art and Fort Wayne Museum of Art.
