Terms and Conditions

BUYER’S PREMIUM The purchase price payable by the Purchaser shall be the total of the final bid price PLUS A PREMIUM OF SEVENTEEN PERCENT (17%) on any individual lot in the amount up to and including $500,000; TWELVE PERCENT (12%) on any individual lot on the amount in excess of $500,000. Invaluable on-line premium is TWENTY-TWO percent (22%). This premium is in addition to any commissions or other charges payable by the consignor.

4. At the fall of the Auctioneer’s hammer, the Purchaser shall (a) be acknowledged by bidder number by the auctioneer, (b) pay the hammer price and a buyer’s premium as outlined above. In addition, Purchaser may be required to sign a confirmation of purchase. All sales are final with no exchanges or returns.

5. Unless exempted by law, the Purchaser will be required to pay any and all Arizona state and local transaction privilege tax (sales tax). It is the Purchaser's responsibility to pay any applicable use tax imposed by their state of residence on the total purchase price.

Scottsdale Art Auction, LLC shall not be responsible for any errors or omissions or failure to execute such bids. It shall be in the sole discretion of Scottsdale Art Auction, LLC as to whether the opinion provided by the Purchaser is an opinion by a recognized authority on the artist. 3. Scottsdale Art Auction, LLC and/or Auctioneer reserves the right to reject any bids. The highest bidder acknowledged by the Auctioneer shall be the Purchaser. In the event of any dispute between bidders, the Auctioneer will have absolute and final discretion to either determine 4

the successful bidder or to re-offer and resell the Property item in dispute. After the sale, Scottsdale Art Auction, LLC’s record of final sale shall be conclusive.

7. No item of Property may be paid for or removed from Scottsdale Art Auction, LLC during the sale. After the sale has been completed and after the purchase price has been paid in full, Property must be removed from the saleroom at the Purchaser’s expense not later than three business days following the sale. Scottsdale Art Auction, LLC will, as a service to Purchasers, arrange to have Property packed, insured and shipped, all charges at the expense and entire risk of Purchaser. 8. Some items of Property may be offered subject to a “reserve” or confidential minimum price below which the item will not be sold. In such instances, Scottsdale Art Auction, LLC may implement the reserve by bidding through the Auctioneer on behalf of the Consignor. In no event shall the reserve exceed the low estimate in the catalogue. 9. Neither Scottsdale Art Auction, LLC, nor Auctioneer, nor Consignor make any representations whatsoever that the Purchaser of a work of art will acquire any reproduction rights thereto. 10. These Conditions of Sale and any other applicable conditions, as well as the Purchaser’s and Scottsdale Art Auction, LLC’s rights and obligations herein shall be governed by, construed and enforced in accordance with the laws of the State of Arizona. If these conditions are not complied with by the Purchaser, Scottsdale Art Auction, LLC may, in addition to other remedies available by law, including, without limitation, the right to hold the Purchaser liable for the total purchase price stated on the Confirmation of Purchase Invoice, either (a) cancel the sale and retain as liquidated damages any and all payments made by the Purchaser or (b) resell the Property privately or at public auction on three days’ notice to the Purchaser for the payment of any deficiency in the purchase price and all costs including handling charges, warehousing, the expense of both sales, the commissions, reasonable attorneys’ fees, any and all other charges due and incidental damages. 11. A letter from Leanin’ Tree Founder Ed Trumble Thank you, my friends, for your interest in the art of the Leanin’ Tree Museum and Sculpture Garden! As I write this on my 93rd birthday, I acknowledge that my physical limitations will unfortunately prevent me from attending “my auction” (as I have come to think of it) in Scottsdale in January 2018. So my gratitude must be expressed by letter rather than in person. Oh, how I wish I could shake your hand, and thank each and every one of you, and share my hope that you are successful with a winning bid for a piece (or pieces!) of the Leanin’ Tree Museum legacy. Western art has been my life’s passion and mission. The roots of my interest in the West were planted early and deep, in a young boy’s fertile imagination, as my family scrabbled for survival on a Depression and drought-battered Nebraska farm. Riding my cow pony Sunny, with ol’ Buster my dog darting to and fro alongside pulled by every elusive scent, we—well, I—dreamt of leading great cattle drives, fightin’ off determined varmints and rustlers, and pushing deep into steep, blue valleys in pursuit of beaver, gold, wealth, fame—the collective dreams of youth. The Good Lord has been gracious in allowing me 93 winters, but I’d be lying if I said I don’t feel those years. After all, it’s not like I’m 92 anymore! My life has been blessed by God and dumb Irish luck. But even the benevolent St. Patrick can’t stop the ceaseless march of time. For several years, a decision has been looming, haunting, inescapable. What to do with my art collection? My dear wife, best friend, confidant and co-curator, Lynn Marie, has traveled this path with me through many exciting and fruitful years, as we built the collection and fulfilled our vision of the museum and sculpture garden, culminating in my 2008 book The Story of Leanin’ Tree. We have shared an unbelievably wonderful journey. It was never my expectation that my family would maintain my art museum indefinitely. They have their own lives to lead, their own dreams to fulfill—plus a great business to run! I have always cared deeply about ensuring that my family can remain dedicated to their proud work of creating and selling Leanin’ Tree’s nationally popular greeting cards. So now the time has come. We all made the emotionally difficult decision to sell the art collection and close the Museum. Because the Museum has been my lifelong project, it was personally important to me to know that my collection would come full circle in the great hall of Scottsdale Art Auction, as my art treasures find their way into the loving care of the next generation of families, collectors and museums. I wish to thank the entire team at Scottsdale Art Auction who have worked tirelessly to produce a stunning auction catalog. My friendship with SAA’s Brad Richardson extends back many decades, and even further back through Brad’s father-inlaw, Troy Murray. Oh, the art stories we could tell! I have known Brad and his partners, Jack Morris and Mike Frost, to be trusted advisors and colleagues through our many years together down the western art trail. For almost five decades it has been an unparalleled honor to have hosted several million visitors to the Leanin’ Tree Museum. I have so many treasured memories standing in my museum—surrounded by visual treasures—sharing stories of the art and artists with pilgrims young and old, all with a golden light in their eyes, awestruck by the allure and accessibility of beautiful art of the American West. I remember a woman from New York, without ever taking her tear-filled eyes off the canvas in front of her, saying to me, “That is the most beautiful painting I have ever seen.” The Leanin’ Tree Museum and Sculpture Garden has brought immeasurable joy, appreciation and awe to those who have had the privilege to experience it in person. The gratitude I feel for those who have loved the art I have loved cannot be expressed. From the depth of my soul, thank you.

Thomas Lorimer grew up in the Midwest and studied in Chicago and Los Angeles. He lived in Sedona but often visited and painted in Montana. His works ranged from contemporary Western portraiture to historical scenes and his work is prized for its draftsmanship and atmosphere.

Bill Hampton’s Old Gold Tooth became Leanin’ Tree’s first birthday card after Ed Trumble commissioned Western poet S. Omar Barker to compose the following verse to accompany the image: “May neither drought nor rain nor blizzard/Disturb the joy-juice in your gizzard!/And may you camp where wind won’t hit you/Where snakes won’t bite and bears won’t git you/Happy Birthday” Hampton’s humorous and soulful portraits have graced Leanin’ Tree cards ever since.

Mike Scovel’s caricatures of what Ed Trumble calls “ornery, sweet, cantankerous, bashful, careworn cowboys” have appeared on Leanin’ Tree cards for over twentyfive years. Despite the whimsicality of some of his his subject matter, Scovel is an accomplished artist who also sculpts and paints. Along with Bonnie Shields and Boots Reynolds, Mike Scovel formed Cowboy Cartoonists International in 1992. CCI now has twenty members and the organization mounts several group exhibits every year.

Before he became an artist, Lloyd Mitchell was a ranch hand and a bit player in Hollywood Westerns. After the Second World War, Mitchell decided to try his hand at art and studied in Los Angeles. “The fastest brush in the West,” Mitchell’s sense of humor pervades his “fine art cartoons,” especially his “skinny saloons” precariously perched and generally on the verge of collapse as they suffer one predicament after another.

California native Bill Bender saw some of the last of the cowboy idyll working with a pack outfit in Kernville in the 1930’s where, as he put it, “there were as many horses as there were cars.” The landscape made a painter of Bill Bender. He fell under the desert spell of James Swinnerton but soon developed his own style, soft, filled with light, and dappled with shadow.

Ray Swanson was born in rural South Dakota and educated in a one-room schoolhouse. After his father passed away, the family moved to California where Swanson studied drafting and aeronautical engineering and became a civil engineer. When he inherited a box of paints from his grandfather, Swanson began to paint farm subjects as a hobby. But the budding artist fell for the Native Americans of Arizona: the Navajo, Hopi, Zuni, and Apache, and came to the happy conclusion that their way of life would make an excellent subject for a professional painter.

Born in 1919 in the Texas Panhandle, Bill Chappell knew the hardships of the hardscrabble life of the ranch hand, living with his parents in a dirt dugout for a time. But even as a boy, Chappell’s hands turned to art. He painted, sculpted, worked leather, wood, and silver. After serving in World War II, Chappell opened a saddle shop and moved to Colorado. In 1965, he made art his full-time pursuit.

Roy Kerswill was born in Devon, England, but found a home in Colorado’s Rocky Mountains. After serving in the Royal Navy’s Fleet Air Arm, Kerswill and some comrades decided to wander through the Yukon and the American Northwest. They ultimately canoed from the Columbia River to New Orleans, via the Snake, Platte, Missouri, and Mississippi Rivers. Compelled by the history of the fur trade and pioneers, Kerswill made this early era the principal subject of his art.

William Moyers was an early member of the Cowboy Artists of America, becoming a member in 1968. Born in Georgia in 1916, at the age of fourteen he went to Colorado, learned to be a cowboy, and paid his way through art school in California on the proceeds of his prowess. Moyers worked for Walt Disney before joining the army and moving to New York, where his career as an illustrator took off. In 1962, Moyers and his family moved to Albuquerque, where he exchanged illustration for fine art. Moyers once observed that he is drawn to the working cowboy as a subject because he is “a harmonious outgrowth of the environment. He accepts the action, weather, loneliness and responsibilities as normal existence.”

After purchasing Shorty Shope’s painting The Coming Home Song at a show, Ed Trumble teased that he didn’t like one of the pack horse’s legs. “Harry Jackson,” Trumble writes, “was also at the show that night, and he invited Shorty and me to an early viewing of a… documentary film about Jackson that John Wayne had narrated… When the four of us stopped to view The Coming Home Song, Shorty commented, “Mr. Wayne, the buyer for this painting doesn’t like the looks of this leg…” [Wayne] squinting at the painting, barked, “Aw, tell him to go to hell!” Shorty damn near fainted and pointing to me, he blurted, “Mr. Trumble is the buyer!”

Hans Kleiber was born in Germany, but by 1906 he was in Wyoming, working for the Forest Service. Kleiber began to paint and, working in his log cabin outside Sheridan, he developed an interest in the ancient art of etching. Kleiber befriended and influenced many artists, including Sharp and Gollings, and his mastery of line in his truly fine etchings of the American West testifies to his perception and talent.

George Dick was an outdoorsman. Peggy and Harold Samuels’s compendium, Contemporary Western Artists, states that Dick joined the U. S. Wildlife Service, traveled the West with a falcon named Margaret, and, after being wounded in World War II, recuperated in a lean-to in Jackson, regaining his strength by eating fish he caught. Dick studied with Kenneth Adams and Randall Davey and created his own approach to Western and wildlife painting. As he observed, “Most often I eliminate or subdue the background. To me, this adds to the feeling of the unknown, the vastness and the ‘foreverness’ of nature.”

Jack Lee McLean painted the Canadian and American West for over fifty years. As his family, in a website devoted to his work, writes, he “invites you into his paintings to become part of the West—taking a journey through his true-to-life landscapes with the cowboy, the Indian, the packer, and his trademark, the work horse.” McLean was an avid hiker and skier and often said that the Rockies were his real studio.

For many years in his hometown of Laguna Beach, California, he pursued his art as a hobby. As recognition came his way, he began to sculpt full time. In 1974, he sculpted Spooked and became an overnight sensation, winning many awards for this depiction of a really rough moment in the life of a cowboy. Sid Burns’ career as a Western sculptor was just beginning when cancer took his life in 1979.

Cartoonist Boots Reynolds paints cowboy life where, as Ed Trumble calls it, that life is “over the edge of good taste and good sense.” Eatin’ Out is pure satire, but Poetry in Motion shows that Reynolds knows his Western Art. Doug Coffin’s majestic, modernist totem poles essentialize traditional forms as geometric abstractions, merging the ancient and modern worlds. Before turning to sculpture, Martha Pettigrew was a scientific illustrator for the Nebraska State Museum. These illustrations sparked an interest in the American Southwest—and in sculpture. Pettigrew trained with Fritz White but her work is also inspired by Francisco Zuniga, Henry Moore, and others. Of her interest in Native American subjects, Pettigrew has said, “Women are the cultural bearer of all societies, and their everyday tasks have become an endless source of inspiration for my work.” Northern Exposure, on the other hand, depicts the “ecology of the beaver pond:” beaver dams stream, pond attracts frog and fish, fish and frog attract bear, bear scraps attract raven.”

Indian artifacts he found beside the Little Miami River in Ohio kindled Fritz White’s interest in the traditions and beliefs of Native Americans. White maintained that this experience allowed him to feel the presence of the past—the saga of the American Indian. As a consequence he studied voraciously and began to sculpt, first in marble, then in bronze. The Leanin’ Tree example of Hunter in the Night Sky (CAA Gold Medal, 1999) has a unique black marble base, fashioned by the artist, with the seven stars of the Big Dipper inset in bronze.
