A ban on trans fat at restaurants highlights a host of new state laws ringing in 2010. County health inspectors started enforcing the ban Jan. 1 on the artificial fats deemed harmful to the body — particularly at fast-food restaurants. “This law is all about public health. Hopefully people can make good decisions to lead a happy and healthy life,” said Ric Encarnacion, environmental health specialist for San Diego County. Effective Jan. 1, food establishments cannot use oils, margarines, shortenings or serve foods that contain trans fat, with the exception of deep-fried donuts. On Jan. 1, 2011, the ban will expand to include all foods. “When there is no way to make a decision because the food is presented on a plate, the restaurant has to use food or food ingredients that do not contain trans fats,” Encarnacion said. “The impact to the consumer is hopefully a more healthy meal.” The aim of the new law is to protect consumers from eating trans fat when a meal’s nutrition facts are not readily available. It does not apply to any food being sold in its original manufacturer packaging, which already provides its nutritional information.

“Food being sold in the original sealed package made by the manufacturer are exempt because a person can make that decision by looking at the nutrition fact panel,” Encarnacion said. According to Encarnacion, consumption of trans fat has been linked to heart disease. He said the mechanism behind the artificial fats raises bad cholesterol (low-density lipoprotein) levels while lowering levels of good cholesterol (high-density lipoprotein) — a combination health experts consider detrimental. Penalties for eateries violating the new law will result in fines ranging from $25 to $1,000, depending on the severity of the violation. San Diego County Department of Environmental Health’s field staff will look for the trans fats during their normal inspections. “Manufacturers and retailers are cooperating very greatly with the health department to provide good meals for their consumers and to allow consumers to make an informed decision,” Encarnacion said.

A party to celebrate Mission Beach is in the planning stages. The event, called January Blues, is tentatively scheduled for Jan. 30. “Everything is sort of unofficial at this point, but I feel like it’s going to happen,” said Sally Aderton, local real estate agent and planner for January Blues. “It’s going to take about two weeks to get the approval process from the city.” If the permits are approved – including shutting down Mission Boulevard from Santa Clara Place to San Rafael Place on Jan. 30 –

North Mission Beach will host a parade and street fair for part of the day. Aderton said the idea is to build community spirit and showcase businesses in the area. “January Blues is about our deep blue sea – the Pacific Ocean and our beautiful Mission Bay,” Aderton said. “We’re going to be celebrating the fact that we’re a strip of sand between these two heavenly bodies of water that bring a lot of joy to people’s lives.” The proposal for January Blues includes a walking parade from the Giant Dipper roller coaster to Pacific Beach Drive and back, a sea life cos-

tume competition and a street fair afterward. “The idea is that this will be our inaugural event and every year maybe we can build on it,” Aderton said. “We can use it as a device to pull people to Mission Beach.” Aderton said the idea came from boys at Rubicon Deli, who wanted to have a party to celebrate Mission Beach. After some brainstorming, Aderton came up with the title and the water theme. “The idea of these boys was to create a party for Mission Beach to help bring good energy back to the beach, to celebrate the wonderful communi-

ty that we have,” Aderton said. While Aderton has been the planning mastermind for the proposed event, she is still looking for someone to chair it. She is also looking for volunteers to help assist in the setup and take down of the event, and local merchants who wish to donate goods as prizes for the costume competition. “If somebody wants to flex their organization muscle and organize this event, the rewards will come back 10,000-fold,” Aderton said. H1N1 vaccine is now available to the public BY SEBASTIAN RUIZ | BEACH & BAY PRESS

The swine flu vaccine is now available to the general public and San Diego County Health and Human Services Agency (HHSA) officials encourage those seeking H1N1 vaccine to obtain it from their primary care physician. Individual doses are also available from public facilities throughout the county. “The vaccine is being distributed based upon availability,” said County Health and Human Services Agency spokesman Jose Alvarez. “The vaccine is free at any of our public health facilities. (The doses) are primarily for those who do not have a primary care physician.” To date the San Diego County HHSA has received about 985,000 doses of the H1N1 vaccine in various forms including nasal spray and injections, Alvarez said. Despite a recall in past months of some lower potency vaccine, Alvarez said, the county HSSA has enough vaccine to go around and is expecting more shipments in the following months.

As of Dec. 30, the county HHSA reported approximately 778 cases of hospitalized patients with the potentially deadly flu which, according to the Center for Disease Control, has reached “pandemic” status. Information about the flu is available by dialing 2-1-1 or visiting the immunization branch page at www.sdiz.org. The Center for Disease Control website offers advice on prevention including age-old common sense like washing hands frequently and getting vaccinated against other strains of flu.

The city has set up drop off points across San Diego to recycle Christmas trees that can be turned into tomorrow’s mulch, wood chips and compost. San Diego residents who already recycle their yard waste curbside can leave their bare trees on their curbs for the city to pick up. The remainder of San Diego residents can recycle their trees at 16 drop-off locations through Jan. 23. Trees sprayed with fake snow are accepted. Trees must be stripped of ornaments and lights. Recycling Christmas trees keeps them out of the Miramar landfill. “Green waste, such as yard clippings and other organic materials, including Christmas trees, have made up over 20 percent of the material buried in the landfill,” said Chris Gonaver, director of the Environmental Services Department. Recycling drop-off sites include: Mission Bay: SeaWorld Drive at Pacific Highway Ocean Beach: Robb Athletic Field Recreation Center, 2525 Bacon St. La Jolla: Kate Sessions Memorial Park, Soledad Road and Loring Street. SETTING SUN FOR SETTING STONES The sun sets Jan. 5 behind the giant floating crane that is being used to repair the south jetty at the entrance to Mission Bay. The crane is picking up and moving boulders as well as adding new ones. The project should be completed later this month. The U.S. Army Corps of Engineers Los Angeles District is overseeing the repairs to the outer 250 feet of the middle jetty at Mission Bay. In this photo the crane is at the end of the south jetty at the mouth of Mission Bay. This is a high dynamic range photo that is composed of three photos of the same subject but using different exposures (lighter and darker shots), and added together in the computer. This technology was orginally developed in the forties and fifties to take pictures of nuclear bomb blasts as the wide range of light values is impossible to capture with a single camera exposure.

The owner of a Pacific Beach medical marijuana dispensary has become the first operator out of the 14 raided last year to plead guilty to federal charges involving manufacturing marijuana plants and using his business for illegal drugs and money laundering. Joseph Nunes, 32, owned the Green Kross Collective which was located at 3415 Mission Blvd. before a number of similar businesses were raided Sept. 9, 2009, by federal and

state agencies. Nunes also operated a downtown site known as the Downtown Kush Lounge Cooperative at 777 Sixth Ave., which was also shut down. So far Nunes is the first operator to be charged in federal or state court, said Deputy District Attorney Steve Walter, adding that the investigation about other businesses raided is still ongoing. A mistrial was declared Dec. 22 in the murder trial of a 62-year-old Texas man who has admitted killing a man in 1971 whom he met downtown. Jurors deadlocked 8-4 over whether he was guilty of murder or manslaughter. Eight jurors agreed with the prosecution that Gerald Metcalf was guilty of first-degree murder, while four held with the defense position that Metcalf was guilty of voluntary manslaughter due to his mental condition at the time. They deliberated 12 hours over three days, but on Dec. 22 they told San Diego Superior Court Judge Ronald Frazier they were hopelessly deadlocked. Metcalf’s lawyer, David Lamb, conceded that Metcalf killed Gerald Jackson, 27, on Dec. 29, 1971, after Jackson picked up Metcalf, who was then 24 years old, at a gay bar in downtown San Diego. Jackson was stabbed 61 times and his nude body was found days later in his Pacific Beach apartment by two friends after he had not shown up for work. Deputy District Attorney Jill Schall successfully sought to put Metcalf on trial a second time. A new trial has been granted and is scheduled to begin May 21. Metcalf, who has been diagnosed with paranoid schizophrenia, usually appeared in court as if

he was on heavy medication. One note focused on a female psychiatrist who was a member of the jury and who agreed with the defense position that Metcalf’s mental state was such that he could not have formed the intent to commit murder. Most jurors met with attorneys in the hallway after the mistrial was declared, and shared their frustrations. Some said two male jurors looked to the psychiatrist juror almost in guidance. The defense hired a psychiatrist who testified that Metcalf must have killed Jackson in a schizophrenic episode and was too mentally impaired to form the intent to commit murder. The psychiatrist on the jury agreed with the defense psychiatrist. Metcalf stole the victim’s Ford Torino and the stereo system that Jackson’s father gave him for Christmas. Metcalf pawned the stereo for $30 and used Jackson’s identification which was written on the pawn slip. Metcalf left cigarette butts in the apartment including one that was stained with the victim’s blood. Police saved the cigarette butts, and DNA evidence in 2008 matched Metcalf as the smoker. Metcalf’s fingerprints, including some in blood, were found and preserved all these years. A police intern matched Metcalf’s fingerprints via a shared print database

with Texas as Metcalf had been arrested and his prints and DNA were on file. Metcalf is housed at the Vista Detention Facility on $1 million bail.

A Pacific Youth Soccer League team became the first team from Pacific Beach to win the Mesa Soccer Recreational All-Star Tournament last month. Team PB captured the under-14 title by beating Peninsula Soccer League AllStars 3-1 on Dec. 20 at Hickman Field in Clairemont Mesa. “It is an awesome accomplishment for the Pacific Beach area and our league,” said Team PB head coach Ernie Sandoval. “It was emotionally overwhelming.” During the two-day tournament, Team PB did not drop a match. On Dec. 19, they beat teams from Clairemont Mesa, Valley Center and Oceanside, and tied the Peninsula Soccer League (PSL) All-Stars, their rivals from Ocean Beach. The following day they beat Vista Soccer 3-0 in the semifinals and knocked off the rival PSL All-Stars 3-1 in the championship match. “They’re all champions,” Sandoval said. “Now they know what it feels like to be a champion.” Team PB has been together for a few years and when they first started playing together, Sandoval made a promise to the team if they won the tournament. That promise involved a trip to the Magic Kingdom. “A couple of years ago, I told them if we win this thing, I’m taking you

guys to Disneyland, just kind of kidding around,” Sandoval said. “We blew away the competition.” Sandoval is asking the community to help get this Disneyland dream off the ground. Now the waiting begins for the San Diego Chargers, who earned a bye in the first round of the NFL postseason as the No. 2 seed in the AFC. The Chargers will watch this weekend as eight teams battle it out in the wild-card round. They’ll get a chance to rest and heal injuries. Then they’ll return to their normal schedule in preparation for a Divisional playoff game in San Diego on Sunday, Jan. 17, with a scheduled kickoff at 1:40 p.m. San Diego earned its week off by finishing with the AFC’s second-best record behind Indianapolis. The Chargers (13-3) won their last 11 games in a row after starting 2-3. It took a two-yard pass from backup quarterback Billy Volek to Mike Tolbert with 13 seconds left to beat Washington 23-20 to keep the streak intact as most of the starters sat out or barely played. “You work hard to get to this point,” Chargers coach Norv Turner said. “You work hard to position yourself. You work hard to get the bye and the home game. Now we want to take advantage of that.” The Bolts took Monday and Tuesday off this week, and won’t practice on Saturday and Sunday either. They’ll come back to work next Monday, take Tuesday off and then game-plan and practice the rest of next week. “Wednesday, Thursday and Friday practices (next week) will be very similar to getting ready for a game,” Turner said. “There are some things we can do to shorten it up in areas. They may be considered classic rock, with band members now approaching their sixties, but few rock bands will ever match the popularity of 1970s era British blues rockers Led Zeppelin. Such is their popularity that numerous tribute bands dedicated to the four musicians now regularly tour the world. Notably one of the best, Dazed and Confused, which appears at the 710 Beach Club on Jan. 9, is based in San Diego, mixing a deep catalog set list with renditions that match the energy of the originals, while staying true to the musicianship. While so many tribute acts are weak imitations, Dazed and Confused’s onstage power will instantly take you back to the days when dinosaur rock bands ruled the earth. Dazed & Confused: Saturday, Jan. 9, 9 p.m. at the 710 Beach Club, 710 Garnet Ave. There’s a particular thrill in catching live performances from studio

musicians. Seeing the names touted on album sleeves is nice, but being virtuosos in their field, the chance to see the techniques employed by these performers can be breathtaking, even for other Allan Holdsworth musicians. On Jan. 13, four of music’s most celebrated musicians — guitarist Allan Holdsworth, drummer Terry Bozzio, bassist Tony Levin and drummer/electronics player Pat Mastelotto — will perform at Brick By Brick. Between them they have appeared on hundreds of albums backing such luminaries as Peter Gabriel, John Lennon, Frank Zappa and King Crimson. However, it’s when they get a chance to stretch out on their own, as in this show, that their playing truly shines. Music junkies will be hanging on every note. Holdsworth, Bozzio, Levin, Mas-

At home singing in English, Spanish, Japanese or French, Adams repertoire is limited only by her imagination, including such classics as “La Vie En Rose” or “Volver,” as well as terrific originals. Blessed with a wonderful, plaintive voice, Adams is equal parts torch singer and jazz diva with a hint of soul to her delivery. It all adds up to Adams being easily one of the most compelling jazz performers in San Diego today.

It helps that her piano-based ballads have a surplus of melody, but Paras is clearly an artist with vision. While the singer-songwriter field is overcrowded, there are still a few artists in the genre worth hearing, and locally at least, Paras should be at the top of that list.
