Some neighbors and Mission Bay enthusiasts are crying foul over expansion plans by Evans Hotels to increase its footprint at Bahia Resort Hotel, which opponents claim would eliminate 170 of 270 parking spaces while decreasing public beach access. Hotelier Bill Evans said parking changes being proposed as part of Bahia’s redevelopment will reconfigure — not eliminate — existing onsite parking. San Diego Park and Recreation Board’s Mission Bay Park Committee voted nearunanimously Jan. 2 to affirm Evans Hotels’ proposed expansion and parking changes on its existing site at 998 W. Mission Bay Drive. The board concurred with the hotelier’s view that that action would be consistent with the Mission Bay Park Master Plan. “Parking will be put in approximately three, 100-space parking lots replacing the 270 spaces on Gleeson Road with 273 spaces,” Evans said. “The Mission Bay Master Plan, which guides development in the park, calls for removal of SEE BAHIA, Page 12

City Attorney charges local landlord John Nobel for health and safety code violations BY NEAL PUTNAM | BEACH & BAY PRESS

A La Jolla couple, and a Pacific Beach man, have denied health and safety code charges they maintained a substandard apartment complex that reportedly had bathroom leaks, inadequate heating, insects, rodents, and improper wiring. The misdemeanor charges were filed by City Attorney Mara Elliott against John Nobel, 78, his wife, Mahin Nobel, 70, and Devdatt Niranjanbhai Patel, 34, earlier in December. The couple are the owners and Patel is a property manager. Through their attorneys, all three people pleaded not guilty Dec. 18 in San Diego Superior Court, and a future hearing was set for Jan. 23 in the new courthouse at 1100 Union St. The three were not required to appear in person because the charges are misdemeanors. "They were extremely surprised (to be charged)," said attorney Richard Katzman, who represented John Nobel on Dec. 28. Katzman said the couple hired a management company to oversee the apartment complex, located at 5344 Rex Ave. in City Heights. He said Nobel's wife had nothing to do with the apartment complex.

"I need to do research on what the word 'maintain' means," said Katzman, adding that was the reason the couple hired a management company to oversee it. "Did the owner maintain it or the management company?" said Katzman. The exact wording of the 10 charges alleges they "did unlawfully maintain, use, and permit the use of a building... in such a condition that it endangers the life, limb, health, property, safety and welfare of the public and the occupants thereof." A Dec. 20 press release from the city attorney says seven refugee families from the Republic of Congo moved into the complex with a Swahili interpreter and assistance from Catholic Charities in June through September 2016. The families repeatedly complained about bathroom leaks, old equipment, broken doors, a severe roach infestation, and a few said there were rats in some units. In a separate proceeding, an administrative law judge ordered the couple to pay $34,278 in relocation and other costs to the seven families, plus a $10,000 civil penalty on July 17. The couple were represented by another attorney, who could not be

reached for comment. The seven families were relocated by the city, and the city wants John and Mahin Nobel to pay the city back. They filed an appeal, but it was denied on Dec. 8, according to an order by an administrative law judge. A city code inspector cited the property for exposed electrical wiring, mold, lack of heating, presence of trash, debris, infestation of roaches, spiders, rodents and expired fire extinguishers. The property was developed into a 12-unit apartment complex in 1980, and the Nobels purchased the property in 2004 under the name of Casa De Las Palmas, LLC. Court documents say JN Financial Services manages the apartment complex and John and Mahin Nobel are officers for this firm with Patel as the property manager. "Exit and fire violations were created when the apartments were illegally converted from two-bedroom units into three- or four-bedroom units," according to the city attorney's press release. John and Mahin Nobel and Patel all remain free on their own recognizance.

It was an eventful year for Pacific and Mission beaches, which grappled with a number of vexing issues. Coastal communities tackled everything from community beautification to wetlands protection to short-term vacation rentals. The following is a month-bymonth chronicle of what the Beach & Bay Press covered in Pacific Beach, Mission Beach, and Mission Bay throughout 2017.

JANUARY n Planned Parenthood completed plans to modernize and double its Mission Bay Health Center. n County officials were working with “feral cat folks” to save, rather than exterminate, felines trapped in a federal program to preserve endangered coastal bird species by culling their predators. n A series of storms roared through beach areas Jan. 19 - Jan. 24, depositing about 2.4 inches of rain and causing some flooding, downed trees and power outages. n City Attorney Mara Elliott alleged several San Diego restaurants, including some along the beachfront, were adding questionably legal, 3 percent surcharges to customers' bills without proper notice to compensate for a minimum-wage pay increase.

I Love A Clean San Diego engaged nearly 900 elementary school students and volunteers at Mission Beach for the 24th annual Kids’ Ocean Day in May to clean the beach and spell out ‘Come Together.’ n San Diego lifeguard “legend” Bill Bender retired after 35 years service with “countless” rescues to his credit. n Volunteers created a “peace garden” at Mission Bay High. n The rebuild of the historic Plunge Pool at Belmont Park was ushered in at a Jan. 30 public tearing-down ceremony with Mayor Faulconer. The event included a

vehicles. A “driverless” car, also known as an autonomous, self-driving or robotic car, is a vehicle capable of sensing its environment and navigating without human input.

FEBRUARY n Public officials, businesses and residents collectively launched a “clean and safe program” to remove trash in Pacific Beach and make the community safer, while offering the homeless a hand up. n PB made Circulate San Diego's ignominious “The Fatal Fifteen” list of most dangerous intersections for pedestrians, with its problematic intersection at Mission Boulevard and Garnet Avenue. That crossing, No. 3 on the list, had 16 total collisions,

with 17 serious injuries recorded between 2001-2015. n Two Mission Beach businessmen pled guilty to conspiracy to sink a 57-foot boat used for charter sportfishing trips in order to collect insurance money. A judge later placed them on 18 months federal probation after they paid the U.S. Coast Guard $18,000 for rescuing them. n A motorist pled guilty to committing attempted murder and two assaults in hitting three pedestrians in Pacific Beach in which one suffered brain damage and was in a coma. n Family-run Saska’s steakhouse in MB reopened Feb. 23 with an updated design and feel as Saska’s Steak & Seafood. The popular eatery first opened in 1951. n Sprouts natural and organic grocery enlarged its space from 19,000 to 23,000 square feet adding a new salad bar, deli and juice bar. n A flamenco festival debuted in PB showcasing internationally acclaimed and local performers. n PB planners heard distressing news that the beach community ranked second to East Village, out of 125 city of San Diego communities, in violent crimes, with 216 reported the year before in the beach community. Then-PBPG chair Brian Curry characterized statistics as “simply unacceptable,” describing the status quo as “Apocalypse now.”

MARCH n Approximately 245 trailers were removed from the former De Anza Cove mobile home park while the city was midway through the De Anza Revitalization Plan, a three-year comprehensive outreach and planning program to re-imagine, re-purpose

meeting at Marina Village Conference Center. n PB Planning Group April 26 voted in favor of moving the weekly farmers market from Bayard to Garnet in the heart of the beach community's business district. n Beach residents got their last chance on April 25 to weigh-in on proposed alternatives for reclaiming marshland in Mission Bay at a fourth public workshop hosted by ReWild Mission Bay at MBHS.

PB Planning Group looks for new members The PB Planning Group (PBPG) is now accepting applications for new members. The group, which advises the city of San Diego, is comprised of 20 community volunteers – 15 residential and five commercial seats. Many new plans for the beach area, including the trolly extension, the redevelopment of the De Anza area, and traffic improvements for PB are presented and voted on each month. If you'd like to add your views and help shape the future of PB, then consider running for election. Candidates must be residents or own a business or property in Pacific Beach. New member elections will

take place on March 28. All candidates must attend at least one PBPG meeting during the period of January 2016 through January 2017. You can attend the Jan. 24 meeting to qualify for election. In addition, the surf club’s board worked some magic to also present a $1,000 check (held by club secretary John ‘Brando’ Brandelius) to Ashley Iverson, the five-month pregnant widow of Cory Iverson, and their 2-year-old daughter. Cory Iverson was a San Diego firefighter who died while fighting the Thomas Fire in Ventura. The community was devastated to hear of this horrible tragedy and felt compelled to do something for Ashley.

New-and-improved Pacific Beach Training is a place “where adults can come and be kids for an hour,” said Junior Leoso, owner of the allpurpose fitness center at 4440 Ingraham St. “The gym should be an adult playground,” said Leoso, a Hawaii native, who’s been revamping the decor and fitness menu at PBT, formerly Addie’s Personal Training Studio, the past couple years. “We’ve got a new look, feel, name and revamped our brand,” said Leoso. “The gym is built for this community. It’s built with the idea that we offer a well-rounded sportstraining aspect — but not just weight training.” PBT doesn’t concentrate on any particular workout mode, offering a little of everything instead. “I hired a kettle bell instructor to teach kettle bells. I hired a fighter to teach fighting classes, etc. So there’s no watered-down effect. We definitely live, and get the benefits from, the fact that we’re a team together,” Leoso said. PBT offers numerous small-group classes and training courses focusing on a number of fitness facets including nutrition seminars. “We plan on doing things like that all year long,” said Leoso, whose philosophy is training needs to fit individual lifestyles. A former semi-professional football player, Leoso initially focused on strength training. But he’s realized as he’s gotten older that fitness is broader-based. “My idea now is longevity, making sure my clients have good blood work, low body fat, that they enjoy hiking or surfing,” he said. “We have so much to offer, we don’t really have a genre. We don’t have the

‘weightlifting’ guy or the ‘aerobics’ girl. We’ve got everything inbetween.” Leoso doesn’t counsel clients that “this [exercise mode] is the only way.” Plus, he pointed out, variety is more fun — and practical. “For 99 percent of the population that goes to the gym for a healthier lifestyle, you’re going to benefit much more from (being) wellrounded,” he said.

Leoso’s goal has always been “to help people,” adding, “fitness just happens to be my key, my tool. People come into my gym, and that’s my chance to help them.” PBT is the culmination of years of training for Leoso, who noted the industry is a “people business.” He likes the one-on-one contact with clients. He responds to their input on how to improve his programs. Leoso said his location “is the best, in-between Grand and Garnet on Ingraham between the freeways.” “To my knowledge, we’re the only small gym with a parking lot (in PB), not street parking,” he added. More expansion might be on the horizon, and could happen sooner rather than later, Leoso acknowledged.

Christ Lutheran Church sells affordable senior housing complex in Pacific Beach Christ Lutheran Church in Pacific Beach announced on Dec. 14 the sale of Luther View Apartments, a 48-unit affordable senior housing complex that was built in 1979. The property was sold to Retirement Housing Foundation (RHF), a nonprofit, faith-based property housing provider headquartered in Long Beach with almost 200 housing communities and more than 55 years of experience. “RHF is pleased and honored that the Leadership of Christ Lutheran

Rock-a-billy comes to the 710 Beach Club on Jan. 12, with an excellent two-band bill featuring the Hard Fall Hearts and The Cat Chasers. Both bands share a modern take on a classic sound, as well as the trio format, with a standup bass and plenty of punk energy to propel their songs. For Pacific Beach resident Ryland Rubens, there is nothing much better in life than catching a wave. This month, Rubens has been spending time Down Under surfing in the World Junior Championships. In winning the North America junior tour crown last year, Rubens (who grew up on Mt. Soledad) qualified to head to New South Wales, Australia and compete against some of the top junior surfers in the world. According to Rubens, his dad (Peter) still surfs pretty much every day. Meantime, his sister (Cheyenne) surfs with the family while attending a local college. As Ryland notes, “It’s great to catch some waves with them both.” The Beach & Bay Press recently caught up with Ryland (who attends Audeo Charter School, where he will graduate this year) for an email chat as he looks for more surfing victories. BBP: How long have you been into surfing and how did you get your start? Rubens: I stared surfing when I was 3. I used to go to the beach with my dad and sister all the time and it became a natural evolution. BBP: What are you doing in Australia right now as far as competition? Rubens: I'm currently in Australia for the World Junior Championships and having a blast explor-

ing new areas on the down days between the competitions. BBP: Do you feel surfing here in San Diego gives you any advantage over surfers from other parts of the country and world? Rubens: I personally enjoy the waves in San Diego because they're fun and pretty consistent yearround. Every country has different kinds of waves, which makes them all unique. I don't see myself as having an advantage. BBP: What are your long-term goals with surfing? Rubens: Long-term would be to keep improving and aim to be on the WCT (World Championship

Tour) 2-3 years from now. It will take a lot of hard work and I will need to earn the points to qualify. BBP: Any plans for college? Rubens: Yes, college is in the works. Most likely going to start with online courses as I will be doing a lot of traveling in 2018. BBP: For any San Diego area kids wanting to take up surfing, what advice would you have for them? Rubens: I would say just to have fun and enjoy what the ocean has to offer. Competing or not, just being in the ocean is great for many aspects of life and just to take baby steps, because nothing happens overnight.

The boys, under head coach Marshawn Cherry, entered this week at 14-3, ranked No. 1 in San Diego County and 12th in California. Mission Bay opened play in the Western League with its first win over St. Augustine in seven years.

In holiday tournaments, the Bucs lost in the finals of the Corona Centennial Battle ZONE Tournament, won the Sweetwater Holiday Classic, and came in third place at the national Torrey Pines Holiday Classic. Rejean (Boogie) Ellis is averaging 26 points per game. waterfront parking, and having concentrated areas of parking off Gleeson Road put in.” The Jan. 2 park board meeting drew a crowd of about 200 water users of every type. Users argued the hotel’s expansion was a commercial land grab inconsistent with the park master plan which ignores the needs of countless aquatic recreationalists. Bahia resort wants to nearly double its capacity expanding from 315 rooms to 600 rooms, while adding a 10-foot walkway and 20foot grass area around Bahia Point park. That would necessitate shifting current public parking along Gleeson Road on the Bahia’s peninsula to other locations further from the shoreline. Opponents claimed the hotel expansion would deny public access to Bahia Point, a popular launching spot for small sailboats, kayaks and other watercraft. They argued

proposed replacement parking further away from the shoreline would be a hardship on, and inconvenience for, boat owners. Those contemplated moves upset neighbors and bay users alike, three of whom — Greg Knight, Mike Waters and Scott Andrews — representing boating enthusiasts, met with Beach & Bay Press to explain their displeasure with the hotel’s plans. “When the parks committee voted yes, it literally was like a sucker punch to the stomach,” said Mission Beach resident Knight, a kayaker. “I think they were a little surprised to see how many people showed up in opposition.” “I’m a sailor and a very large amount of the shoreline is rip-rap (rocks), which you can’t carry your boat across without at least risking a nasty fall,” said Waters, a sailboat owner. “[Evans] has purposely blocked both ends of the cove so you cannot access it,” claimed Andrews. “He sees [Bahia Point Park] as his domain. Now he’s making the

power play to get it all.” “We want parking and traffic studies done,” added Andrews. Evans said he has offered to put parking in on the existing Bahia Hotel site to accommodate boating users’ needs, adding he, and his hotel’s role are being misrepresented. “I’m being depicted as a bad guy by people who haven’t read the park master plan, and that these changes have been generated by me and the hotel as part of some land grab,” Evans said. “Really, all of the proposed changes are in the park master plan document that was ratified by both the City Council and Coastal Commission (in the ’90s). Those are now legal documents guiding development in Mission Bay Park.” Andrews insists the Mission Bay Master plan is dated, arguing it is an advisory document and “not the law.” In response to the hotel’s recently announced expansion plans, Knight started a Facebook page to rally against the hotel’s expansion as proposed.

Fiesta Island dog owners favored “Option B,” which keeps the fenced-in dog park intact, while Option A would put a road down the dog area. n May was National Hamburger Month and May 28 was National Hamburger Day. BBP profiled some of the best spots to grab a burger at the beach. n The less redevelopment the better was the takeaway from dog owners packing a May 23 scoping meeting at MBHS to hound the city about what they'd like — and not like — to see with long-range planning on Fiesta Island.

JUNE n The Pacific Beach Parking Advisory Board sought public input on what visitors and residents thought about the community's parking and traffic situation via an online survey. n The city approved funding for a roundabout at troublesome Foothill Boulevard and Loring Street intersection. n MB activists lobbied to get more money in the city budget for additional summer trash pickup to combat fly infestation during the busy tourist season. n SeaWorld debuted its new education-oriented “Orca Encounter” show replacing the old Shamu shows lobbied against successfully by animal-rights activists. n PB residents began fighting back against bicycle thievery, documenting the growing illicit repurposing and resale of stolen bikes. n MBHS’s Class of 2017's graduation ceremony June 14 was an ending – and a beginning — a familiar theme cutting across speeches in the commencement program. n The iconic Coaster Saloon in MB was sold for an undisclosed sum to Davies LLC, led by David Cohn of the Cohn Restaurant Group. n Following Coastal Commission review, the City Council approved zoning changes to a slightly downscaled project, with somewhat larger park space, that would redevelop the former Mission Beach Elementary School into condominiums. n The iconic building on the corner of Garnet Avenue and Fanuel Street in PB was named The Rose Center after the late Dr. Nathaniel Rose. n Thieves were warned by SDPD during a June 29 press conference that the bait bike program was in “full effect,” and that criminals caught stealing would face certain punishment.

AUGUST n Some PB residents near Kate Sessions Park were upset about the city's plans to sell the old 4.76-acre reservoir site in north PB, one of the beach community's last remaining developable open spaces offering views to the west. n The city and DecoBike both backed off on boardwalk bike-sharing, a sore spot with MB and PB small businesses complaining bikeshare was directly competing with them by taking away business.

SEPTEMBER n Catherine Jolley, former PB Town Council president, was named Citizen of the Year for Pacific Beach. Jolley received the honor for the continued support she has provided and for the season-opening breakfast she organized for all lifeguard divisions together. n A Pacific Beach man, Matt Phillips, launched a petition drive on change.org calling for coastal churches to end homeless “feeds,” a practice rekindling public debate over whether homeless need a hand out — or a hand up. n PB Town Council held its annual heartfelt salute to local emergency workers who make a difference in the community during the Police and Emergency Services Appreciation Night (PAESAN) Sept. 27.

n Crystal Pier celebrated its 90th anniversary.
