3 City Council votes to ban motorized vehicles from boardwalks NEWS

On Monday, Dec. 16, City Council voted 5-4 to prohibit motorized vehicles, including electric scooters, on Mission Beach, Pacific Beach and La Jolla Shores boardwalks, as well as Mission Bay Park Bayside Walk. Council President Pro Tem Barbara Bry of District 1, was joined by colleagues Dr. Jennifer Campbell of District 2, Monica Montgomery of District 4, Mark Kersey of District 5 and Vivian Moreno of District 8 in voting for a boardwalk ban. Dissenting City Council members were Scott Sherman of District 7, Council President Georgette Gomez of District 9, Chris Ward of District 3 and Chris Cate of District 6. Previously in 2018, the City Council voted 6-3 against a scooter ban on boardwalks. “Today, action is imperative,” said Bry, a mayoral candidate in 2020, in introducing the electric vehicle ban on boardwalks. “This is a public safety issue, not a transportation issue. Accidents, head traumas, and one death have compelled us to take action. We need to ensure safe space for residents and tourists who utilize the boardwalk.” “I was proud to vote with the City Council majority to ban motorized
devices, including scooters, from our beach and bay boardwalks,” said Campbell. “Keeping these pathways clear ensures the safety of our pedestrians and the livability of our neighborhoods. Thank you to my city council colleagues for recognizing the importance of this issue to the communities of Districts 1 and 2.” “The City Council must rely on sound scientific data, not politics and emotion when considering good policy,” countered Sherman. “Scooter regulations were just approved barely six months ago and an initial review shows that they have improved safety and reduced accidents. Data-driven policy, not a blanket ban, is the right path forward.” Testimony before the City Council vote Dec. 16 was weighted heavily in favor of residents for a boardwalk ban on motorized vehicles. Bicycling advocate Andy Hanshaw, who chairs the City’s Mobility Board, argued the boardwalk ban was within his board’s purview. He pointed out the board had not reviewed the proposed ban. “Six words: Vision Zero, public safety, common sense,” testified District 1 City Council candidate Joe LaCava of La Jolla. “Today is the day to take action: pass the ordinance.”

Vision Zero is a multi-national road traffic safety project that aims to achieve a highway system with no fatalities or serious injuries involving road traffic. One boardwalk ban proponent argued the decision came down to “safety or greed.” Mission Beach Town Council president Matt Gardner spoke in favor of the ban noting, “There are no crosswalks or safe places for pedestrians to cross on the boardwalk with the motor vehicles.” Following the vote, the office of the City Clerk said the new ordinance

said Point Loma resident Don Sevrens. “Assemblyman Todd Gloria, a candidate for mayor, believes the city should charge the supplier company a fee for use of the public right-of-way, where they park. I believe that is a concept worth exploring.” Sevrens noted scooter regulations generally apply to a younger demographic. “Has anyone over 50 ever ridden a scooter from Point A to Point B?,” he asked. The revocation hearing was scheduled after the city claimed Lime violated geofencing rules set forth in City permit guidelines established in July. The city accused Lime of disobeying geofencing rules that limit scooter speeds to 8 mph in areas like beach boardwalks, Balboa Park and Petco Park. Other areas like the Embarcadero and food plaza in Little Italy have a 3-mph speed limit. However, City hearing officer Matthew Freeman determined the city's accusations were based on speedometer reading on scooters, and found that the city never investigated the accuracy of the speedometers. Freeman's report also said the city failed to establish that its own speed testing of scooters took place within geofenced zones. “Lime is pleased with the decision and we appreciate the hearing

officer for recognizing our compliance in San Diego,” said Lime in a statement following the decision. “As San Diego’s longest-serving operator, we value our partnership with the City and look forward to continuing to serve the community. When the revocation process began this summer, attorneys for Lime immediately voiced strong procedural concerns. “We have been asking the city for months for guidelines. It feels like we’re being set up for an unfair process,” Lime’s lead attorney, Leslie Devaney, said in October. Devaney is a former Assistant
City Attorney with the city of San Diego. Lime’s concerns seemed to take Freeman by surprise, and he convinced both sides to allow him 30 days to make a decision following the hearing, though the city municipal code calls for a decision to be made in 10. “We respect the decision and look forward to adopting enhanced scooter regulations, which have already been presented to committee, that give the City even more tools to enforce public safety laws and keep our streets and sidewalks safe," city spokesperson Scott Robinson said.

Criminal Diversion offers treatment instead of jail time As part of their ongoing effort to get low-level drug offenders off the streets and into treatment, City Attorney Mara W. Elliott and San Diego Police Chief Nisleit have teamed to launch Prosecution and Law Enforcement Assisted Diversion Services (PLEADS). They announced the effort at the Central Library in San Diego’s East Village, along with County officials who will oversee the treatment components of the program. The library site was chosen because public libraries are experiencing ongoing problems from intoxication and illegal drug use on their premises, leading to bathroom closures and heightened security concerns. PLEADS is a voluntary, pre-booking diversion pathway that allows individuals suspected of being under the influence of a controlled substance to avoid prosecution and jailtime by agreeing to seek support services. The Neighborhood Policing Division is issuing PLEADS referrals during first watch, which is between • a.m. and • p.m. In its first week, police made nine referrals and six individuals agreed to treatment. PLEADS is jointly funded by the City and the County. The City is contributing state Homeless Emergency Aid Program (HEAP) grant funds for its first year of operation. Individuals who are arrested for being under the influence of a controlled substance are often homeless or at risk of becoming
homeless. The City Attorney’s Office created PLEADS with three primary goals: 1. Divert low-level drug offenders away from the criminal justice system and connect them to support services. 2. Save taxpayer dollars on time spent by police, attorneys, the court, sheriff staff, jail staff, and judges processing individuals for being under the influence of a controlled substance. 3. Reduce recidivism, allowing police officers and prosecutors from the City Attorney’s Office to focus on other public safety priorities. “Instead of perpetually prosecuting individuals who are addicted to drugs, we wanted to help them get to the root of the problem,” said Elliott. “PLEADS gives people a chance to escape the revolving door of the criminal justice system, begin their recovery from addiction, and build a better life for themselves.” “When community-based organizations, prosecutors, law enforcement, and social services agencies come together to create a diversion program, there is a clear benefit for the community, said Nisleit. “PLEADS is one such program that will allow individuals to seek help while not impacting the already strained criminal justice system.” The PLEADS process begins when an individual is picked up by SDPD on suspicion of being under the influence of a controlled
substance. During that initial encounter: • Police inform the individual of their ability to seek treatment in lieu of being booked into jail and prosecuted by the City Attorney’s Office for the offense. • If the individual decides to pursue treatment, they will be taken by police to the Sobering Services Center run by McAlister Institute, for an assessment and linked to existing county or other local programs. • Depending on the individuals’ needs, the programs will include inpatient or outpatient services, detox, housing, government benefits,
or other appropriate services. • Due to the likelihood of relapse, individuals have three chances within a 90-day period to be referred by way of PLEADS. • If the individual does not wish to participate in PLEADS, or exceeds three PLEADS visits to McAlister in 9• days, they will be arrested for being under the influence of a controlled substance and taken to jail. Prior to PLEADS, the same support services were not offered until after criminal prosecution and sentencing. Here is a breakdown of potential taxpayer cost savings: • In 2017, there were 88• arrests

of individuals for being under the influence of a controlled substance by the San Diego Police Department alone. • The cost per case was at least $2,00• (including staff time for police, attorneys, the court, sheriff staff, jail staff, and the judge). • With PLEADS in place, the potential annual savings is more than $1.• million, not including savings from the reduction in calls for emergency services and taxpayer-funded hospitalizations. “Getting people the care they need immediately will help us to keep people from cycling through both the criminal justice and healthcare systems,” said Luke Bergmann, director of County Behavioral Health Services.

BAIL SET FOR MIDWAY MURDER SUSPECT A judge set bail at $5 million on Dec. 13 for a murder suspect accused of killing a man and injuring another victim in the Midway District in two incidents on Thanksgiving morning. Forrest Robert Brantley, 38, pleaded not guilty to all three
charges including the murder of Robert Erbe, 55, that occurred Nov. 28 on Sports Arena Boulevard near Rosecrans Street. He is also charged with premeditated attempted murder and felony assault of the other victim. Deputy District Attorney William Hopkins said the victim who survived was assaulted five hours

NEWS BRIEFS earlier before Erbe was attacked in the same general area. The surviving victim was stabbed twice in the back and once in the arm, he said. That victim was hospitalized. Brantley fled to the Ventura area where he was arrested on Dec. 4. He was brought down to San Diego county jail on Dec. 12. Authorities have not disclosed the motive, if any, for the attacks or how he was identified as the attacker. The prosecutor said if Brantley is convicted, he faces a prison sentence of 25 years to life. Bail had been set at $1 million, but it was raised to $5 million after a San Diego Superior Court judge heard about the second attack and Brantley's prior record. Brantley was ordered to return to court on Dec. 24 when a preliminary hearing date will be set. He remains in the George Bailey Detention Facility.

Marking its 10th anniversary in Ocean Beach this year, Miss Match has made a name for itself trailblazing sale of intergenerational women’s apparel. “We’re managing to still focus on brick-and-mortar,” said owner Tally Bercovitz, who has a second store in Coronado. “The idea was to create shopping for multi-generations — mother, daughter, and granddaughter. We’ve been successful at doing it. We also have a very lucrative e-commerce store.” With its corporate headquarters at 4932 Newport Ave., Miss Match boutique, open seven days a week, markets a wide variety of women’s clothing including sweaters, dresses, outerwear, denim, shoes, and accessories at mid-range prices. Discussing the origin of her business, Bercovitz noted, “As a woman in her 40s, I was having a hard time finding clothes that were trendy and age-appropriate. When my mother and I went shopping, she was on the third floor and I was on the first. We couldn’t really shop together. I decided to create an environment where mother, daughter and grandmother could all shop together.” Looking back on it a decade later, Bercovitz pointed out brick-andmortar retail remains the cornerstone of small business, though a retailer needs to be successfully

positioned on different marketing platforms. “Ocean Beach is a tourist place and people don’t come to sit in their hotel rooms and order online,” pointed out Bercovitz. “People still need something to do, and women like to show off things they’ve bought in their travels. You can’t replace that. And if you want your dress tonight, or even just get the shoes, you don’t have to wait.” Bercovitz noted buying firsthand also avoids time delays and shipping costs associated with online purchasing. She added the
personalized attention you get at a brick-and-mortar “you don’t get in a department store.” Bercovitz opened her first Miss Match in OB in 2009 and has been involved in the beach community, both personally and philanthropically, ever since. Miss Match appeals to a variety of styles as well as ages. Said Bercovitz, “We have a healthy combination between classic fashion, traditional fashion and forward fashion." So Miss Match patrons can indulge themselves with classic blazers, cardigan button-downs or collared shirt denims and sequined kimonos or jumpsuits, as well as trendy Aztec prints, camouflage or animal prints. Styles carried include Bohos and working woman. “It’s not just beachwear at all,” said Bercovitz of her inventory. She added, “We started out as a small business in 2009, and although we've grown, we vowed to stay true to our small-business philosophy: that every customer is our favorite customer, and we must continue to provide the care and styling collaboration you've grown to love.”

Mysterious Galaxy bookstore moving to Midway District with new owners Mysterious Galaxy, an independent bookstore specializing in science fiction, fantasy, mystery, young adult, romance, and horror, will transfer ownership to Matthew Berger and Jennifer Marchisotto in January. The store, currently located in Clairemont, will also be moving to the Midway District in the new year. Mysterious Galaxy has been a destination bookstore for local and international customers for 27 years. It offers a curated selection of genre fiction and hosts author and community events each week. The new owners are excited to usher the bookstore into its next
chapter. The end of 2019 is upon us. While Dec. 31 will bring a time of reflection for some, for many others it’s a great excuse to throw the biggest party of the year, in advance of any New Year’s Eve resolutions. This year’s musical offerings feature something for just about every musical taste and price range, with the Point Loma-Ocean Beach area ground zero for events in San Diego. Here are some of the area’s best offerings:
TOP THREE • One of the biggest end of year
celebrations, OMFG! NYE 2020, will take place at Pechanga Arena. Part of a two-night event, Dec. 30-31, the EDM (electronic dance music) party will feature two of the genre's current biggest names, Kayzo and Virtualself, the latter being nominated for a Grammy this year for his song “Ghost Voices.” Opening the event will be a selection of up and coming EDM talent including Anna Lunoe and Good Times Ahead. A check was presented to Loma Portal's Foundation president Valerie Lawson, Principal Mark Moricci, and music teacher Candy Szalay at Loma Portal Elementary School.
The theme for the Peninsula Singers fall 2019 semester was Hope for the Holidays. In keeping with their theme, the Peninsula Singers choir decided to help Loma Portal Elementary School further enhance their music program. In a four-week campaign, choir members personally gave to the Give Hope for the Holidays fundraiser, which was inspired by the choir's mission of reaching out to the Point Loma community and supporting school music programs. At the end of the fundraising campaign, the choir had been successful in raising $2,444 – enough to fully fund a class set of ukuleles for Loma Portal and purchase other needed items such as presentation microphones. A check was presented to Loma Portal's Foundation president Valerie Lawson, Principal Mark Morici, and music teacher Candy Szalay on Dec. 13 at Loma Portal School
and then again at the Peninsula Singers Holiday Concert at All Souls Church on Dec. 14. The Peninsula Singers is a community choir in Point Loma directed by Sarah Suhonen and accompanied by Stewart Simon on piano and welcomes singers with all levels of experience. The choir has performed at many venues throughout the community, including U.S.S. Midway, the Point Loma Village Cultural Faire, Southwestern Yacht Club, Point Loma High School, several local libraries, December Nights in Balboa Park and the San Diego Botanical Garden. Neurofibromatosis is a genetic disorder which causes tumors — sometimes cancerous — to form on a body’s nerve tissue. Usually diagnosed in children, these tumors often show up on the brain or spinal cord and can not only cause severe pain but also impede vision and cause loss of hearing. It’s a condition 15-year-old San Diego resident Angel Rechirei battles every day, sometimes spending full days at a time in a hospital bed. But thanks to Massachusetts nonprofit Team IMPACT and Point Loma Nazarene University juniors Izzy Turk and Cara Liggins, Rechirei gets to join a college sports team and take part in practices and games for her favorite sport: basketball. “Angel is a perfect fit for our team,” said Turk, whose been on PLNU’s women’s basketball team the past three years. “Her positive energy is
contagious. From the moment she walked into our gym, she’s had a smile on her face.” “Our team is pretty lighthearted and we’re a close-knit group that really loves being together,” added Liggins. “Angel embodies everything our team stands for and has taught us so much about what it means to truly stay positive.” Last summer, Turk came across a Penn State news story that detailed the university’s partnership with Team IMPACT, an organization that connects children facing chronic and life-threatening illnesses with college athletic teams across the country. An 11-year-old pediatric patient with muscular dystrophy got matched with the Penn State Altoona men’s basketball team. Turk said she was immediately inspired and quickly applied to the program. “The PLNU women’s basketball team is a fantastic group of athletes and coaches who have so much to
offer their community – not only with their athletic skills but with their empathy and commitment to service as well,” said Emily Berman, Rechirei’s case manager at Team IMPACT. “Our match-up staff knew Angel would be a great fit for their team.” On Dec. 10, PLNU and Team IMPACT held a “Draft Day” for Rechirei with a press conference, official signing, and special remarks from head coach Lisa Faulkner. Rechirei received a team jersey and PLNU athletics locker as the newest, youngest member of the basketball team. Since the Draft Day, Rechirei has joined in on team practices, attended home games and team dinners. Liggins said Rechirei’s presence on the team has had an even stronger influence than expected. “Every day we would come to practice as college students going through the same things, but with Angel, we now have an outside perspective we’ve never had before,” said Liggins,
who helped Turk pitch the Team IMPACT partnership to Faulkner. “It’s exciting to watch her come into the gym after being in the hospital for four hours or even all day and just be so happy to be anywhere other than in the hospital. Seeing how enthusiastic she is about life is super inspiring for all of us,” Liggins said. “We so often forget that healthy bodies are not a blessing given to everybody, and Angel has inspired us with her outlook on that,” added Turk. “She doesn’t let this illness stop her.” Faulkner said she’s had players many players in the past participate in Big Brother and Big Sister athletic programs as well as PLNU’s annual Special Olympics, but “This is different. Angel is a real member of our team and she will be with us for two years. We’re excited to be a part of her journey.” Faulkner and Turk both hope other

PLNU sports teams — such as the baseball and soccer teams — will also take the same opportunity to partner with Team IMPACT. “I think it’s cool to use something as powerful as being a part of a team to create a real relationship with somebody,” said Turk. “We’re all just so taken with Angel and if Cara and I weren’t on this team, there’s a chance we never would have met her.” “Angel is an incredibly resilient girl with a caring and supportive team behind her,” added Berman. “The sky is the limit for all of them.”

When Point Loma boys basketball head coach Josh Aros went in search of an assistant coach with a load of experience and knowledge, he didn’t have to look too far. Aros’ father Dave, a veteran Pointer teacher, football and basketball coach, was eager to dip his toe into the coaching pool once again and has joined his son on the bench where his depth of knowledge and wisdom are a big addition to the Dogs’ staff and give rise to added expectancies for the 2019-20 season as the team plays in holiday tournaments at Sweetwater and Montgomery high schools. “Having my dad on the bench with us is really a great thing,” Josh Aros said last weekend after his team dropped a close game to El Camino in the Sweetwater Tournament. “He’s such a staple of
the community and relates really well to the players. I hope to have him with us for more years.” The younger Aros has done quite well on his own during his first three years at the helm, posting a 49-34 record for a .590 winning percentage. This year he feels he has the components to take his team to the top of the Eastern League standings and move into CIF Div. II playoffs. Four of last year’s starters return, part of eight with varsity experience. Returners include the team’s tallest player, Tyler Morris, a senior forward standing 6-feet 8-inches tall and weighing 235 pounds who is averaging 15.3 points per game in early tournament action. Other returning starters include Jakob DiCarlo (5-feet 9-inches tall senior point guard) and Gabe Harrison (6-feet tall junior wing/

point guard), and Blake Ledbetter (6-feet 3-inches tall junior forward/wing). With the addition of Kai Collins (6-feet tall senior wing/ point guard), Josh Aros feels he has a solid starting five. Three other players returned to the hardwood after not playing last season. They include Duce Gourson (6-feet 1-inch tall junior guard), Tristan Shafer (6-feet 1-inch tall senior guard) and Jaylon Brown (5-feet 8-inches tall junior point guard). When Josh Aros turns to his bench he has added talent in the person of Riley Harris (6-feet 5-inches tall senior forward/wing), Trent Bell (5-feet 10-inches tall junior wing/point guard), Ryan Yoder (6-feet 1-inch tall senior wing/forward), Travis Lewis (6-feet 2-inches tall senior forward/wing) and Austin Johnson (5-feet 11-inches tall senior wing).

The Pointers’ Eastern League foes this year include San Diego High, Scripps Ranch, and Lincoln. Areas the younger Aros is stressing with his team are its defensive play, guarding the ball, limiting turnovers and continuing to gel as a team. “We have a lot of good components,” he says, “and if we do these things we can compete with a lot of good teams.” Last year’s Pointer varsity put up a record of 17-10 and Josh Aros feels this year’s team could exceed that win total. “This year’s team is definitely a different group than last year,” he said. “But we’re gelling better and I think once we get everyone playing in their roles I believe we could be very good.” Part of improving on last year’s record, Josh Aros noted, also included scheduling harder teams
