A

judge on May 16 rejected probation for a surfer convicted of assaulting another surfer with a paddleboard and imposed five years in state prison. Paul Taylor Konen, 34, had been free on $30,000 bond, but was remanded immediately into custody after San Diego Superior Court Judge Robert Trentacosta pronounced the sentence. The victim, Kevin Eslinger, 56, of Point Loma, told the judge how the injury resulted in brain damage after Konen struck him in the head with a 7-foot paddleboard while both were surfing off Sunset Cliffs on June 26, 2018. Eslinger said the brain damage causes him to slur his words and he was hard to understand at times. He consulted with a speech therapist, who told him

City clears out cave dwellers at Sunset Cliffs BY DAVE SCHWAB | THE BEACON

T

hree men were recently forced to evacuate an elaborate, makeshift 20foot by 10-foot cave dwelling dug from the cliff face near Sunset Cliffs Boulevard and Osprey Street. As revealed on social media, the ramshackle residence contained cots, bookshelves, backpacks, laundry hamper, cleaning products, a bucket for waste and bottles of urine, countless needles, blow torches, tools, a scooter and two bikes, among other items. Concerning the viability of such encampments, Capt. Scott M. Wahl of San Diego Police Department’s Neighborhood Policing Division said: “It is illegal to lodge and/or camp in the beach or park area. We are familiar with this very remote and hard-to-get-to location. We have handled encampments there in the past, and need the public’s help in notifying us when they return. It is an area that is ‘off the beaten path.’” Added Wahl: “We are currently in the process of getting that site cleaned up. Our beach enforcement team this summer will check the area routinely.” “Until a case is brought to our office by law enforcement and specific charges are filed, we can can’t comment on potential penalties,” replied Hilary Nemchik, director of communications for the City Attorney, about prescribed pun-

OB PIER REOPENING Mayor Kevin Faulconer is scheduled to reopen the Ocean Beach Pier during a ceremony starting at 8 a.m. on Friday, May 24, weather permitting. “Repairs are on schedule to have the pier opened by Memorial Day,” said City spokesman Alec Phillip. “City crews did the railing, water and sewer work. SDG&E crews did the work on the electric line.” Repairs estimated at a cost of $430,000 by City officials were made to the iconic OB Pier, which has been closed since mid-January when strong winter storms and king tides damaged the structure. City staff determined more than 2,200 feet of guard rail, electric, water and sewer lines needed serious repair or replacement. At more than 1,970 feet, the Ocean Beach Pier is the second longest on the West Coast, and the longest concrete pier in the world. The pier opened in 1966 and more than 500,000 people visit it every year.

cliffs back then as well.” Responding to what can be done to prevent such encampments, Wahl said: “It is critical we have good communication with the community. We utilize the Get it Done application to receive complaints regarding encampments.

It is the best method to notify us of the situation. We can make sure there is resolution to the problem.” Wahl added police work closely with park rangers and environmental services to make sure trash is disposed of, and that abandoned property is properly abated.

Suspect in Ocean Beach murder pleads not guilty

ing McKibben would not leave and was trespassing in the 7900 block of Rainey Street. Police showed up at 9:15 a.m. May 2 and discovered that McKibben allegedly was armed with a knife. An officer shot him twice in the shoulder and hand.

McKibben was taken to a hospital while in custody and still remains there, a prosecutor said on Tuesday. He was arraigned in his hospital bed by a judge and the murder charge is the only one filed against him. The prosecutor said the facts of the case were not discussed at the hospital arraignment where he was represented by a public defender. Two hearings this week were set in San Diego Superior Court, but McKibben missed both of them because he remained hospitalized. A status conference has been set for May 23, and future hearing dates will be set then, the prosecutor said. He remains in custody without bail and is in stable condition.

During the trial, Greco referred to Konen as “the bully on the beach.” “This wasn’t an accident. Nowhere is there remorse,” said Greco to the judge. “Never does he say he’s sorry. The inability to show empathy is really telling.” Trentacosta said Konen doesn’t understand his own actions and said he used a 7-foot paddle as a weapon. Trentacosta imposed two years for the felony assault charge plus three years consecutively for causing great bodily injury to Eslinger. Konen’s attorney, Brian

McCarthy, asked for a sentence Konen could serve in a work furlough facility. McCarthy said Konen worked at a warehouse and had already been screened for the work furlough program in which he could go to work during the day, but be incarcerated at night. “He’s not a violent person or a danger to society,” said McCarthy, who said he had no criminal record. McCarthy asked the judge to declare the case unusual which would allow him to grant Konen probation. The judge declined to do that.

man accused of killing his mother in Ocean Beach has pleaded not guilty from his hospital bed where he is recovering from gunshot wounds from police. Daniel Chase McKibben, 36, is accused of killing Heidi Green, 59, in a home in the 5000 block of Niagara Avenue near the OB Pier on May 1. A family member called police asking for a welfare check on her and police found her deceased. A Special Weapons and Tactics (SWAT) unit evacuated some residents nearby as a precaution. McKibben turned up at a home in La Mesa the next day. A resident there called La Mesa Police, say-

MIDWAY CARJACKER FOUND MENTALLY INCOMPETENT A would-be carjacker who didn’t know how to start a high-tech car in the Midway District was found mentally incompetent and was sent to a state psychiatric hospital. San Diego Superior Court Judge Albert Harutunian III looked at a psychologist’s report on Robert John Bustil-

los, 49, and determined he was not mentally competent to stand trial. Bustillos will be given psychiatric medications at Patton State Hospital and will return here after doctors and another judge determine he has regained his mental competency. Criminal proceedings remain suspended.

BARBARA ANNE FORSTER – JULY 17, 1953 TO MAY 5, 2019 Barbara was born in Trenton, NJ. and raised, along with 5 siblings, in the nearby Township of Hamilton. After completing her teaching degree, her adventurous nature kicked in. Over the course of her life she lived and worked on a Navajo Reservation, an Arctic Inuit community, four states, two territories, three countries, traveling extensively both abroad and at home. During all this she married and raised two children. In 1999 the family returned to San Diego, Dan’s (her husband) home town, where they settled down to domestic bliss. She loved working at Dana Middle School library a position she held for 9 years. In 2012 they both finally retired. Barbara had a distinctive laugh and has been described as a bright light shedding warmth, friendship, generosity and humor to all who knew her. She was a loving mother and devoted wife and stayed close to her family. Barbara is predeceased by her father, J. Robert Kinsley and survived by her mother Anne (Dietrich) Kinsley, her husband Dan and children Kelly and Charles and her favorite son-in-law Griffin Hagle. Also surviving are brothers Robert (Brenda), William (Emily), Patrick (Robin) and Tim and sister Susan Dunsmoor, and numerous nieces and nephews. A memorial celebration will be held at The Harp, 4935 Newport Ave. in Ocean Beach, on Sunday June 9th starting at 2 PM. Tears and a lawsuit at Peninsula Community leaders discuss traffic Community Planning Board meeting and air-quality issues at town hall BY DAVE SCHWAB | THE BEACON

A

ccusations flew, fingers pointed, tears fell and a lawsuit was unveiled at Peninsula Community Planning Board in May. At issue were allegations brought by nongroup members accusing two newly-elected board members – Margaret Virissimo and Don Sevrens – of promoting candidate slates in the March elections in opposition to the group’s bylaws. PCPB chair Robert Goldyn noted Virissimo previously declined an invitation by the group’s executive board to address charges against her. In defending herself, Virissimo alleged board bias against her. “Every year they try to find something wrong with me,” noted an emotional Virissimo, who said she declined the invitation to speak with the group’s executive board because, “I didn’t want to go through that again.” Added Virissimo: “I’m a volunteer who wants to help this community and I’ve chosen to give back. If you want my seat – have it. But I will continue to fight for this community, and if this board decides to remove me … I will run again, and the community will vote for me again.” “There have been allegations of violations of the rule against slates the last three elections in a row,” said elections chair Fred Kosmo. “It appears to me that there was a deliberate, intentional violation of the bylaws concerning slates, which influenced the outcome of the election.”

Sevrens answered the charges leveled against him at the meeting by announcing he had filed a lawsuit that day. “This could have been resolved informally with group officers,” said Sevrens, claiming he hadn’t been offered proper due process. “I have filed suit in U.S. District Court against the City of San Diego as a corporation, and naming the Peninsula Community Planning Board as defendants. This is a very serious matter of the violation of First Amendment and civil rights.” The lawsuit, which Sevrens, a retired UnionTribune journalist, passed out to board and audience members contests the accusation that a flyer he circulated at his own expense during the March election, which listed the names and qualifications of several candidates, constituted a campaign slate. His lawsuit also challenges provisions in City policy 60024 governing community planning groups. “On its face, Policy 600-24 purports to forbid the development and promotion of slates of candidates, but restricts no other type of speech or expression,” states Sevrens’ suit. “Policy 600-24 comprises an illegal prior restraint of speech, since it purports to ban the endorsement of slates of candidates before anyone has engaged in such expression. Prior restraints on free speech are presumptively unconstitutional.” Virissimo, a community activist, resigned last year from the board only to reconsider and re-run this March. She got the second-highest vote tally, 202, behind only group chair Robert Goldyn’s 227 votes. READ MORE ONLINE AT sdnews.com

ommunity planners, the Navy, police, City Council District 2 and the San Diego Airport Authority fielded audience questions on airplane noise, homelessness, traffic and other hotbutton issues at a May 14 community conversation. The event held at UPSES Portuguese Hall was sponsored by the Point Loma Association, a nonprofit working to improve the quality of life of Point Loma through beautification, education, charitable activities and civic collaboration. Panelists included: Capt. Brien Dickson, commanding officer Naval Base Point Loma; SDPD chief David Nisleit; District 2 Council staffer Miller Saltzman; Midway Community Planning Board member Dike Anyiwo; District 4 County Supervisor Nathan Fletcher; and Kimberly Becker, president/CEO of the San Diego Airport Authority. The conversation was emceed by PLA president Dave Martin and past president Clark Anthony, who began by saying, “Let’s talk about the bigger issues, and one of those is transportation.” “We need to find ways to reduce congestion. You don’t need to remove that many cars from the road to reduce congestion,” responded Fletcher adding transportation woes occur in the air too. “We have an air-quality crisis in San Diego,” Fletcher added. “The American

Lung Association has estimated that a child born in Barrio Logan is eight times more likely to have asthma than a child in La Jolla. New owners take over Dog Beach Dog Wash BY DAVE SCHWAB | THE BEACON

A

fter 26 years, the guard has changed at Dog Beach Dog Wash. Owners Jane Donley and Mindy Pellissier are handing the leash over from the business they created in 1993 to new owners, the Stokes family and friends. The reason? “I’ve been working since I was 8 and I’m tired,” confided Donley. Donley talked about her business serving iconic Dog Beach, an internationally renowned 24hour, off-leash San Diego dog park and destination, got started. She and business partner Pellissier were always lamenting the difficulties in keeping their dogs clean without dirtying their residences. “We (finally) said, ‘Let’s look around,” added Donley, noting a real estate friend found them this (then) brand new empty building they’re still in today. “This used to have a (’70s) hippie shop on it called Baba Yaga where OB goldsmith and fine jewelry crafter Gary Gilmore got his start working leather,” Donley said. “Mindy designed it (wash) and kept her job as a psychiatric nurse.” The wash was a hit from the getgo. “The first day we had 26 dogs,” said Donley. "I worked here alone

for six months before we started hiring employees. We were busy enough after six months for Mindy to quit her job. We both worked here and kept growing.” The pair never anticipated being business owners. “It solved a problem, and I thought it would be fun to have my dog here at work (it wasn’t),” said Donley. New owner Melinda Stokes, who hails from El Cajon and has been coming to Dog Beach Dog Wash “all my life,” approached Donley and Pellissier about five years ago telling them, “If you ever

think about selling – let me know.” Stokes, along with a couple of friends who are now business partners, and her parents who live nearby, leaped at taking the dog wash over. “I thought she’d be perfect for it, that it would be a good succession,” said Donley. The dog wash has become a community hub. “Dog owners are very social people,” noted Donley. And busy. “In the summer, Dog Beach gets about 10,000 dog visits a week,” said Donley. “It’s just a magical

place for people with dogs.” The ownership transition earlyon has been pretty seemless, said Melinda Stokes, whose family assumed control May 13, and immediately got a crash course in day to-day operations. “We got pretty slammed within a two-hour period, we were cleaning tubs and greeting people: We had so much fun,” Stokes said. “We’re pretty excited as a group to take over this great legacy. Construction workers were recently shocked to discover a litter of kittens stowed away on their truck after driving from Hayward, Calif. to San Diego. The employees of DPR Construction were at the site of the future Kaiser Permanente Clairemont Mesa Medical Offices when they heard meows coming from a 60-foot steel column. The employees tried coaxing the kittens out with food, but eventually had to tip the column to get to them. Five kittens slid out, and the construction workers called San Diego Humane Society for help. Humane Officers picked up the one-week old kittens and transferred them to the SDHS Kitten Nursery for 24-hour care. The kittens, who are now four weeks old, are named after construction tools and materials. The three males and two females are Crowbar, Rebar, Chisel, Jackhammer and Piper. The kittens are gaining weight and doing well in foster care.

n Track Wellness, a multidisciplinary martial arts and fitness studio, has found a new home behind Pechanga Arena San Diego. Ownership duo Nate Church and Eric Romo bring 50 years of martial arts experience with additional instructor certification and training to their new studio at 3481 Kurtz St. Having taught small-group fitness classes since 2012, On Track Wellness now provides small-group fitness, personal training, all-ages martial arts, cardio kickboxing, athlete performance training, weightlifting, body transformation programs, nutritional guidance, performance/recovery/pain relief products and fitness retail. Church said their business model has evolved. “I started On Track seven years ago as a part-time business focusing on fitness,” said Church, who had been working nearly 20 years in the corporate world. “In 2016, I was sharing floor space with a cheer gym when I decided to launch my full program.” After meeting business partner Romo by chance, Church realized they shared career goals. “I started doing martial arts at age 5 and earned a junior black belt,” noted Romo. He described opening his own martial arts facility as “a lifelong passion.”

Romo had taken a year off to tour with a buddy’s band doing driving and unloading when a mutual friend introduced him to Church. Shortly thereafter, they decided to “do something together.” Church added their business has since morphed “into a total wellness center for the whole family,” adding, “We signed a lease in March and worked tirelessly for 40 days to prepare the space.” Romo agreed their new studio in Midway’s warehouse district is ideally situated. “We’re trying to

be part of the positive change happening in that area, part of a vibrant receptive community of things they’ve got going on back there,” he said. Church pointed out he and Romo have contrasting martialarts styles. “He comes from Korean, and I come from Japanese Shotokan,” Church said, adding their new training program is “a blend of our martial arts histories and influences.” On Track Wellness’ hybrid style incorporates aspects of both

Japanese and Korean arts teaching self-defense, take-downs, throws, awareness, strength, stamina and progression into more advanced techniques. Under the On Track Wellness United Martial Arts program, students age 4 and beyond learn the fundamentals of Karate including traditional forms, strikes, blocks and weaponry. On Track Wellness also has added a dedicated weight room rivaling larger gyms. Class sizes are capped to keep the group small for individual attention, and so members always have the equipment and tools they need. riday Night Liberty in Liberty Station is “supersizing,” expanding along with a name change to First Friday Arts District, and First Friday Arts District (((amplified))) for quarterly concerts. The launch of the inaugural First Friday quarterly event will be on June 7, starting at 6:30 p.m. It will feature live concerts on the grassy North Promenade, along with a craft beer garden and a popup market. June’s First Friday amplified will feature New Reveille, a four-piece Americana band from Raleigh, N.C. described as “twangy, truckdriving music that runs on classical gas.” Opening for New Reveille will be Nena Anderson with her blues-tinged, Americana music, velvet voice and catchy melodies. NTC Foundation associate director of marketing and communications Andrew Waltz said the Arts District has come a long way. “When we started in 2009, the Arts District had seven completed buildings,” Waltz said. “Ten years later, we’ve grown to 45 renovated buildings filled with more than 145 organizations and businesses including art galleries, artist studios, museums, cafés, a food market and more.” Waltz added the event’s new

Chimpos reunites after 30 years and finally records debut album BY BART MENDOZA | THE BEACON

I

n the music business the phrase “long-awaited debut album,” is practically a cliché. However, in the case of Ocean Beach-based band Chimpos, who took more than 30 years to see their album, “Flung Like A Horse,” come to light, it’s an apt description. Comprised largely of musicians who were part of Point Loma High’s band scene of the 1980s, Chimpos is a collection of lifelong friends who would gather to make music and have a little fun in between gigs with their own combos. The band is organized by Greg Hildebrand, perhaps best known as owner of Ocean Beach institution, Cow Records. He also wrote the words and music to the Chimpos songs. “It’s not your typical sort of group,” he said with a bit of understatement. The band’s website lists 15 members, though not all are musicians, such as website developer Michael McClure. Point Loma High School and the area has long had a rep for yielding acclaimed musicians and a look at the Chimpos roster confirms that to be true. Notables include bassist Jason Scheff (Chicago), bassist Thomas Yearsley (The Paladins), singer Laura Jane Wilcock (The Tighten Ups) and drummer David Friendly (Was Not Was), alongside guitarist and co-producer Steven Sundell. Chimpos is a true garage band, in both its humble beginnings, as a loose-knit group of teenagers aged 14-17, in a parent’s garage, as well as the fact that, though the band is comprised of music scene veterans, they don’t play live.

“But we’re going to soon, sort of,” explained Hildebrand. Earlier attempts for the band to play a gig have been scuttled by the band members’ busy schedules. “After we got the album in hand, I had gone ahead with promotion, I wanted to book a show, so I reached out to everyone. No one contacted me back for four days, so I went ahead and booked it.” Unfortunately, once band members did call back it was to say they were happy to record but weren’t able to do live shows. According to Hildebrand, Friendly came up with the perfect solution. “The plan is to get a bunch of 20-somethings to be Chimpos,” he said good-naturedly. “We wouldn’t make a big deal out of it by calling it ‘The New Chimpos’ or ‘The Young Chimpos,’ but they would do our songs. It would be a real kick to sit back and see that happen.” Plans are tentative for the band to play at the Pont Loma Library’s 60th anniversary event on Sept. 18 (6:30 p.m.). “Flung Like A Horse” was recorded over the course of a year at Chimpo band member Thomas Yearsley’s Thunderbird Analog Recording Studio and released on his label, Lux Records on both CD and vinyl. Record-setting Pointer baseball season comes to an end on ‘Elimination Saturday’ BY SCOTT HOPKINS | THE BEACON

T

here were looks of shock and disbelief on the faces of Point Loma High's baseball players, excruciating expressions as their last batter was unable to beat out an infield grounder and the realization hit hard. Their season was over. On a brutal Saturday afternoon last week known as "Elimination Saturday," the Pointers were one of 12 losers' bracket teams ousted from CIF divisional playoffs in the double-elimination tournament. Carlsbad's Div. II No. 3 seeded Sage Creek ended the No. 2 seeded Pointers' multiple record-setting year (24-6-2) with a hardfought 7-6 win on David Wells Field. The Pointers found themselves in the lower bracket following a tough 6-4 home loss to Bonita Vista the day before, ending their record 20game unbeaten streak and forcing them to take the field 17 hours later against Sage Creek who lost May 15 to Bonita Vista 7-3. For prep teams used to playing two games in a week, this playoff format puts a severe strain on teams' pitchers, who are subject to rest day limits and pitch counts.

Second starter Hunter Otjen threw only 74 pitches in a 6-1 complete-game win over Otay Ranch in the first round on Wednesday. Top starter Austin Curtice was unavailable after running his pitch count to 108 and going the distance in Friday's loss that led to the Pointers' Saturday afternoon elimination. Head coach Jeff Solis named sophomore Blake Ledbetter, used in relief all season, to start against Sage Creek. He was touched for three earned runs in 2.1 innings. When Hunter Greif entered in relief it was his first appearance in a month. He gave up only one hit and no runs during his 1.2 inning stint. Otjen was eligible on a limited basis and gave up a run on three hits in one inning while striking out the side. Hunter Hargett then allowed two runs on two hits in just 2/3 of an inning. Kevin White then pitched the final 1/3 of the inning with Sage Creek scoring again on three more hits. When senior Sam Sanford took the mound to pitch a perfect final (seventh) inning, it was only his third appearance of the season and first in a month, yet he was the only one of six Pointer hurlers

to hold Sage Creek hitless. The big blow for the Pointers was a bases-loaded double by Anthony Hall that scored three of his four RBIs for the game. Hall is drawing interest from pro scouts. The game put a momentary damper on what was an incredible Pointer season where the team's 24 victories set a school record for a season according to former Pointer standout player and coach David Camara. The team's 20-game unbeaten streak included an Eastern League title (11-0-1) and a Div. 6A championship in the recent Lions' Tournament. For senior team captain Ben Berry, the team's accomplishments are a peek at things to come. "It was definitely a winning season for the Point Loma Pointers," Berry said as he shouldered his equipment bag for the last time. "It's easy to look back on what you've done but I'm excited to see what this team is going to do in years to come. It's a young base, they've got the right mindset and they're ready to win."
