Who’s to blame?
Fire and ice For nearly 30 years, local restaurant has been nothing short of extreme

manner, sautéing sliced bananas with brown sugar and butter, adding rum and banana liqueur to make the room light up. He also adds a touch of cinnamon (which he calls “gunpowder”) as the dish flares, making sparks fly like a firework fountain. He lets the hot mixture cool slightly, then serves it over vanilla ice cream. “When I start the flambé, everyone stops and watches,” he said. Another signature of the Maitre D’ dining experience is the swan-shaped ice sculpture that every guest receives before the main course. Filled with sorbet, “to cleanse the palate,” Zalesjak makes the sculptures — “my babies,” he calls them — using silicone molds that fit inside fivegallon buckets that are placed inside the restaurant’s two freezers. Zalesjak said he paid $10,000 for the molds themselves (six of them), and the frozen swans aren’t light. “They are about 15 pounds each with the plate,” he said. “I only have two hands and I serve and do flambé for almost every table.” Zalesjak truly is involved in every part of his customers’ experience, and as he says, “People don’t come here to eat; they come here to dine.” Zalesjak is not only the host, server and chef, but he’s also the musician. After every
La Jolla Shores Tomorrow (LJST) is an ad hoc committee created by Vaughn Woods and Dale Naegle that “seeks to preserve the charm of La Jolla Shores,” according to the group’s Facebook page. The catalyst for the creation of LJST and the notable development that the committee opposes is the Whitney Project — a controversial three-story mixed-use building proposal by Bob and Kim Whitney on their corner lot, located at the corner of Avenida de la Playa and Paseo Grande. The Whitneys’ proposed development includes a 2,300-square-foot retail space on the street level with two stories of condominiums above and a parking structure below. “The Whitney Project is a mixed-use project that substantially alters the existing charm and character of La Jolla Shores by building a massive three-story structure overshadowing Piatti’s Restaurant,” the LJST states on its Facebook page. “Such changes will open the door to threestory developers forever changing the walkable open community we know and love.” The Whitneys, however, have retaliated against claims made by LJST, namely pointing out that Woods and Naegle have received citations indicating building code violations on their own properties, located on 2226 and 2210 Avenida de la Playa, respectively. “Ironically, while this group claims they want to preserve and protect La Jolla Shores, the Naegle’s and Mr. Woods’ own buildings are in serious violation of our La Jolla Shores Planned District Ordinance (LJSPDO),” he said. Woods and Naegle were issued Civil Penalty Notice and Orders by the City of San Diego for building violations on their own properties in February and April. The violations include unlawful conversion of their carport or garage, non-permitted use of their retail ground floor space and illegally posted signage on and off their property. “The issue of the Civil Penalty Notice and Order is nothing less than sour grapes pressed by Mr. Whitney. Who complained or reported the carport conversion? Why do you think it was reported?” said Fritz Liebhardt, a La Jollan who has built several projects in the area. Naegle said that, ironically, everyone on the block who opposed the Whitney building was issued a Civil Penalty Notice and Order. He also said he secured permits prior to any alterations on his house, and there was no secretive conversion attempt. “Now that the city has explained, ten years after the fact, that our permit was issued in error, we will need to seek an appropriate resolution.

BY CLAIRE HARLIN | VILLAGE NEWS As they say, things change. But the Maitre D’ is not one of those things. Owner Louis Zalesjak, 76, has been serving the same menu to many of the same loyal regulars at the Bird Rock restaurant for nearly 30 years, never concerning himself with things like specials, promotions and advertising. And why should he? Ninety-five percent of his upscale restaurant’s guests are return customers, he said, and they keep coming back for the same experience and food. Competition simply isn’t in Zalesjak’s vocabulary, as he’s in a category all his own. “After 20 years of coming here, people know what they want,” said Zalesjak. “If I changed the menu, my guests, they would say, ‘What happened to my Steak Diane? Where is my Cherries Diable?’”
The mysterious, white house at 5523 La Jolla Blvd., that doubles as Zalesjak’s oceanview apartment, is not a hot spot for locals — only about 10 percent of his guests are from La Jolla, he said. But the experience that takes place inside the unassuming two-story building has undoubtedly put Maitre D’ on the map in a broader sense. Many who have stumbled upon the restaurant keep returning, year after year, from places all over the world, and Zalesjak will proudly tell you that he’s the only chef on the West Coast — from “Tijuana to Vancouver,” he said — who does tableside preparation of flambé. Some 80 percent of his guests order the Steak Diane or Steak au Poivre, which Zalesjak cooks right in front of the customer within about three minutes, adding a touch of cognac that makes a flame at least four feet high shoot to the ceiling. Seven years ago, Mike Vinn had never set foot in a comedy club with the purpose of performing on stage. But there’s a first time for everything. Growing up on Chicago’s south side, Vinn came to San Diego by way of the Marine Corps. After enlisting, he decided to stay, but wasn’t quite sure what to do with himself. Remembering he had always wanted to try stand-up comedy, he made his way to the La Jolla Comedy Store’s open-mic night. As it turned out, Vinn wasn’t half bad, and eventually, he was hired on to seat people at shows. Its the regular comics/employees like Vinn who have kept the club going for 35 years (this weekend marks that momentous anniversary). All of the regular comics who perform at The Comedy Store (as well as at its sister club in Hollywood) also do their duty as hosts, bartenders, seaters and promoters, in exchange for the chance to hone their craft on stage every week. A running joke among employees/comics is the unique feeling of performing a great set, working over the audience, getting off stage feeling good — and then
being told by a manager that the toilet is clogged, so get to it. Vinn worked his way up through all of those positions, and now works as a talent coordinator doing promotions for the club, creating the line-up on certain nights, hosting the open-mic night and organizing charity shows, such as his annual Toys for Tots campaign. Since realizing his capacity for comedy, Vinn has performed all over the country in places like New York, New Jersey, Boston, Los Angeles, Las Vegas, San Francisco and Chicago, to name a few. He’s been part of the Iowa Comedy Festival and has had a few small acting roles. When the Whitneys chose a different blueprint than the one proposed by Naegle, “our disgruntled former architect, his wife and Mr. Vaughn Woods formed a small but vocal group called ‘La Jolla Shores Tomorrow’ in opposition to our building to protect and preserve the Naegles’ private view — not to protect La Jolla Shores,” he said. A resident of La Jolla Shores, Bernard Segal, argues the Whitney building’s three-story, 30-foot height is not of primary concern. “The floor area (ratio of total floor space to lot size) not only would be one-third greater than the building adjacent to it, it would be one-third greater than any other building on Avenida de la Playa west of La Jolla Shores Drive, one-third greater than any other building in the La Jolla Village business district and one-third greater than is allowed anywhere else in the city of San Diego on a similarly zoned property,” Segal stated in a letter. “The Whitney project in its present configuration threatens to change forever, and for the worse, the look and feel of the entire business district of La Jolla Shores,” he said. Whitney requested a review and
analysis of his project by Michael Stepner, author of the La Jolla Shores Precise Plan and the LJSPDO, particularly regarding its floor aspect ratio (FAR). In a letter, Stepner said the LJSPDO does not have a FAR requirement “because it was not believed to be a useful tool for guiding development in that neighborhood.” “Because of the nature of the area, the city Planning Department felt that more specific design guidelines were required to ensure ‘fit’ of new development in the ‘Shores.’ Set back and height requirements, coupled with the design guidelines, was a much better tool to ensure ‘unity with variety’ in new projects,” he wrote. “I have reviewed the proposed project and I believe it meets the criteria of the LJSPDO and fits the eclectic character of the La Jolla Shores Neighborhood Center,” Stepner’s letter concluded. The Whitney project has gone through several appeals. The project was first denied by the La Jolla Community Planning Association (LJCPA) in April 2010, then approved by a city hearing officer in July 2010, and appealed by the LJCPA to the city’s Planning Commission the following month. In January, the city’s Planning Commission voted to approve development permits and deemed an environmental impact report unnecessary. The decision was appealed by the LJCPA in the same month. Last month, the City Council granted the LJCPA’s appeal to require an environmental impact report for the project. What is the latest on the project? “We will be preparing an EIR report as requested,” Whitney said.

preparation of a bananas foster flambé, he stands front and center to accompany the live pianist on his tambourine and by stomping his feet to the song “When the Saints Go Marching In.” Once he starts with the tambourine, he gets the room clapping, and he always plays “Happy Birthday To You” for celebrating guests. “Sometimes the people come jump up to me and I have to dance with them,” he said. And Zalesjak not only knows how to dance — he said he was a European gold-medalist in ballroom dancing in the 1950s — but he knows how to do a lot of things. He grew up training Lipizzan horses (which are born black but turn white as adults) in Slovenia, he planned big receptions for the Italian Embassy in the 1960s and he speaks four languages, in addition to the three dialects of Yugoslavia. He also attended hotel school in Switzerland and earned a degree in economics at a university in Sarajevo more than 50 years ago. He has worked in prestigious hotels and restaurants around the world, including working as a chef in Paris for five years and serving as maitre d'hotel for high-class destinations such as the Plaza Hotel in New York, the Dusit Thani Hotel in Bangkok and the Carlton Hotel in Johannesburg. His years of experience in this line of work inspired the name of his restaurant, which opened in 1982. The inside décor of the Maitre D’ is somewhat of an album of Zalesjak’s life. The walls are lined with red velvet, painted with murals and adorned with various antique mirrors and paintings that he's acquired at auctions all over the
world. He pointed out a few hangings — he also calls them his “babies” — that date back to the 1800s, and he spouted off the pieces' respective designers and painters as if they were Top 40 artists. The said is true with his cars, again his "babies." He beamed as he named off his vintage vehicles — his 1970 Jaguar XKE and his 1976 Corvette and his 1966 Thunderbird — that he keeps at his secondary home in Cardiff. Collecting is his passion, and it shows. He has a glass hutch filled with hundreds of trinkets, some gifts from guests, and some relics from his past. When opening the cabinet, the first one he picked up was a crystal figurine of the Twin Towers. He looked at the memento endearingly and briefly mentioned that he helped open the Windows on the World restaurant atop the World Trade Center in the 1970s. "It was my baby," he said. "I don't like to talk about that." But even more meaningful to him than chronicling his own life on his walls, is chronicling the memorable moments of his guests. Hanging throughout the dining room are hundreds of framed photos taken over the years of notable guests or cherished experiences like weddings or birthdays. His favorites span many years and countries, and include shots of him posing with notables like the king of

Thailand, the Shah of Iran, Elizabeth Taylor and Zsa Zsa Gabor. And so his clientele can cherish the Maitre D’ as much as he does, Zalesjak also takes and prints out large photos of guests, which they can pick up after their night at the restaurant. The Maitre D’s website is simple, displaying only a few photos, the unchanging menu and the restaurant’s contact information. "People tell me they see me on Google, but I don't pay attention to all that. I don't use the computers," Zalesjak said. What Zalesjak is talking about is that he doesn't need to promote his restaurant on the web. A quick Google search reveals various websites containing 60 or more reviews of Maitre D’ — some of acclaim, some of condemnation and some of downright bafflement. Some of the reviews describe the place as “strange,” “interesting” or “over-the-top.” But one goes as far as comparing the scene to a local carnival

Hearing set for three boys La Jolla dancers to be on ‘America’s Got Talent’ Tuesday involved in Craiglist murder BY KAI OLIVER-KURTIN | VILLAGE NEWS
An Aug. 16 preliminary hearing was set on May 20 for three 17-yearold boys being tried as adults for murder in the death of Garrett Berki following a deadly Craiglist transaction in which he hoped to buy a computer. Rashon Jay Abernathy, Shaquille Jordan and Seandell Lee Jones have been charged with murder in the death of Berki, 18, a Mission Beach resident, and a 2010 graduate of La Jolla High School. He was a student at Mesa College. They are also charged with shooting at an occupied vehicle and two counts of robbery involving Berki and his girlfriend. Berki and his girlfriend reportedly met with the three suspects on May 11 after answering a Craigslist ad for a $600 computer. They met the youths in Paradise Hills and were reportedly robbed of their cash and cell phones at gunpoint, according to police. Berki reportedly followed the robbers in his car to try and get their license plate number as they turned into a culde-sac. Deputy District Attorney Kristian Trocha said Abernathy fired a shot through a windshield and a bullet
struck Berki in the chest. Berki died later that night in a hospital. The mothers of Jordan and Jones appeared at the arraignment and told reporters their sons didn’t shoot Berki. “I’m very sorry for any part my son had in it. Shaquille didn’t rob them, didn’t shoot them,” said Jordan’s mother, Patricia Dykes. “He’s hurting because someone got killed.” Jones’ mother, Shearese Johnson, said, “My son didn’t kill anyone, so I don’t know why bail is as high as it is. It’s just unfair.” Trocha said all three teenagers are legally responsible for the murder under the felony murder rule. “All of them participated in the robbery. The murder was a part of the robbery and (they) tried to escape,” Trocha said. “These three gentlemen are 17 years old. Some are six months shy of being 18. It was this office’s choice to try them as adults.” If convicted, they all could be sentenced to 25 years to life for the murder and receive a consecutive 25-year term for using a gun in a homicide. — Neal Putnam
Straight from the La Jolla YMCA Firehouse to the stage of NBC’s hit show “America’s Got Talent” are members of Ooh La La Dance Company’s Cosabellas team, led by owner Susie Nguyen, ranked 15th in the world by ESPN for her salsa dancing. The group was hand-selected to audition in front of judges in Los Angeles after a producer from NBC’s top-rated summer series saw them perform on YouTube earlier this year. Already in its sixth season, the show premieres Tuesday, May 31 at 8 p.m., featuring celebrity judges Howie Mandel, Sharon Osbourne and Piers Morgan, with host Nick Cannon. “It was surreal having them judge us,” said Nguyen, “Interesting since we’re used to seeing them on TV all the time.” Just one out of 40,000 acts auditioning with talents ranging from singing
and juggling to magic tricks and contortion, the Cosabellas performed in front of a live audience, where no cell phones or cameras were allowed. Rumors concerning borrowing Is it just me, or have all the Federal regulations put in place since the financial crisis GUEST EDITOR started made it Nancy Gardner much harder for borrowers who can afford a loan and should get a loan, to qualify to procure one? Let’s review: HVCC, Home Valuation appraisal rules, make it harder for borrowers to shop for the loan in their best interest and in many cases get a fair valuation for their property. Big Banks started their own Nationwide appraisal companies, paid the appraisers a small amount and at first even used appraisers not familiar with the areas they were appraising. Distressed sales often are used as comps, bringing values down further. New Fannie Mae rules affect people who need the most help and who also tend to buy condos, charge more for condos than single family homes, if less than 25% down payment. FHA, government loans are supposed to be easier to qualify for, but require buyers to pay much more over the life of the loan. Without rental experience and a loan to value below 70% on an existing home, trade up buyers have to qualify with payments on both the new and existing residences with no offsets for renting one of them. New Dodd Frank rules obfuscate what lenders really make and reduce choices for what borrowers must pay and lenders can cover for them. By design, they push borrowers away from professionals who can offer
choices and creative support, to big banks increasingly employing less expensive order takers rather than borrower advocates. The Fed is floating rumors that soon the down payment guidelines will be changed to a minimum of 20%, while qualifying debt to income ratio’s will be reduced to early 1990 levels. With the increase in interest rates that is sure to come, buying power could be cut in half for most borrowers. Further rumors suggest that the Fed wants out of buying bonds and will eliminate the 30 year fixed loan bringing the US more at par with loans offered in Europe. All of this will send us back to Wall Street to sell mortgage backed securities. Traders will want high yields which will impact interest rates to the upside. Lender testimony has told me that banks are being told to loan to more low income and minorities. Those activities are strangely reminiscent of how we got into this mess. Buy now if any of this concerns you. Get the home of your dreams while you can. Who’s to say how soon the borrowing noose might tighten more? Surprisingly, as stated last month, there are currently some great, alternative documentation loans available for some borrowers who have cash flow or assets, but can’t use tax returns. WHEN FOOD MEETS ART A behind-the-scenes look at La Jolla caterers who cook outside the box BY KENDRA HARTMANN | VILLAGE NEWS Most of us don’t take too much time to consider the aesthetic appeal of what we eat. Taste, nutrition and convenience are generally the elements we take into account when choosing what to put in our mouths, but the artistic allure of our meal may not often be a deciding factor. Every once in a while, however, we are treated to one of those special events — a wedding, graduation or some other celebration — where we encounter food so artfully crafted it’s difficult to destroy by consumption. Some La Jolla caterers take the challenge to marry visual and culinary art an extra step, creating tiny masterpieces you can fit on a fork. Giuseppe Ciuffa, owner of Giuseppe Fine Catering (and the Museum Café at the Museum of Contemporary Art, La Jolla) approaches every catering job with a unique angle. Customization is at the center of his business model, and no two events are alike. “Everything I do is based on the client’s vision,” he said. “I put a lot of thinking and research into every event, and I make sure I understand that
vision. My motto is to exceed my client’s expectations.” Ciuffa said catering allows him to combine his love for cooking with his artistic creativity. He regularly does about two weeks of research before he begins creating menus and adding artistic elements. As extravagant as some of his events sometimes are, he said he has never failed to meet his creative vision. “I know what can be done, and I always find a way to do it,” he said. Giuseppe Fine Catering is just one option for catering services in La Jolla. Others are The French Gourmet, which has a top-notch pastry chef for creating artsy desserts, and Girard Gourmet, which sells “designer” cookies and prepares food made from the owners’ personal farm in Julian. All fulfill different niches, but all take food to new heights by adding that extra element: something interesting to look at before you scarf it down.

La Jolla Playhouse opened an uproarious, blarney-infused comedy on Sunday, May 22, with an unpronounceable title, “A Dram of Drummhicit,” named for the local, single-malt liquor drunk only at co-authors Arthur Kopit and Anton Dudley’s wee fictional island off the coast of Scotland. As they say, drummhicit is “the closest thing to eating a campfire that you’ll ever do.” Your dram is therefore to be followed with a chaser of the viscous, local water. The mere thought — after watching the mucous-colored chaser poured for American newcomer Charles Pearse (Lucas Hall) at Mackenzie Stewart’s (Kelly AuCoin) tavern — evokes the gag reflex. Rev. Hagglehorne (Larry Paulsen) is at wit’s end over his parishioners, who are prone to singing madrigals and performing pagan rites over the Bog Bodies. Bog Bodies are Iron Age folk who keep popping up all over the golf course that is being built by American developer Robert Bruce (Murphy Guyer). The likable, rather naïve Pearse is actually Bruce’s “fixer,” front man and troubleshooter. He has come to deal with the Bog Bodies, of which there are at least a dozen. He hopes that British Museum anthropologist Felicity Oliphant (Kathryn Meisle) will take the bodies away, but she is more interested in researching the bog, into which the bog people were reverse-raptured. Pearse seeks William Ross (Alan Mandell), who negotiated the land deal for the islanders and knows much more than he reveals. Meanwhile, a man with both island and developer connections, Harry Morgan (Joseph Culliton), is seeking Ross, too. After rescuing Felicity from the fairies that live under the mountainous rock that looms upstage, Pearse is struck by lightning (no doubt the work of the island’s fairy population) and taken to the home of fisherman Angus MacLeod (John Ahlin) and his daughter, Fiona (Polly Lee). Fiona, who is a fairy, recognizes that Charles is at least part fairy; after all, he saw the Washerwoman — and only fairies see her. The hilarity climaxes with the arrival of Robert the Bruce, as the natives call him, a dangerous round of golf, the funeral of Ross, and the conversion of Rev. Hagglehorne. A seven-member ensemble, comprising San Diegan Ron Choularton and UCSD MFA students, swells the company to 16. The characters are redolent of Gilbert and Sullivan’s “Iolanthe” and Lerner and Loewe’s “Brigadoon.” The madrigals, especially “Sing Coo Coo,” are hysterical. John Gromada is composer/sound designer. The company — each one a memorable character — could not be better. The language has enough burr for flavor without obfuscation, thanks to dialect coach Eva Barnes. Lucas Hall is a veteran of the Old Globe Shakespeare Festival as well as Darko Tresnjak’s award-winning, got-legs “Merchant of Venice” for Theater for a New Audience. Mandell is fondly remembered in the Playhouse production of “Restoration.” Lee makes her Playhouse debut as Fiona, and Meisle is remembered for her riveting performance in “Creditors.” SEE DRAM, Page 13

But after all, laughter is more important than making complete sense. And this is the play’s world premiere, rewritten minute by minute until curtains rise.
Visual wonders include David Zinn’s scenic design, which turns inside out repeatedly and includes a fabulous fairies’ realm, tons of fog, and the bog; costume designer David C. Woolard’s flavorful village costumes; Tara Knight’s projections; and Philip Rosenberg’s lighting.
