ity staff is working on a new ordinance specifying rules and regulations governing vending on sidewalks and boardwalks, which have seen a proliferation of vendors. SB 946, the Sidewalk Vending Ordinance, was passed by the state legislature in September 2018. Under the new law, the state mandates local jurisdictions to support and facilitate sidewalk vendors. The law’s intent is to loosen restrictions making it easier for independent small-businesses to operate. “I am currently working with the mayor and our City departments to enforce existing law and reign-in street vending,” said
District 2 Councilmember Jennifer Campbell. “For vending that falls under gray areas of the law, my office is now taking the lead on a City-wide street-vending ordinance to provide clear enforcement guidelines.” "I look forward to reviewi ng the Cit y's st reet vending ordinance when it comes to council,” said District 1 Councilmember Joe LaCava. “Regulations and enforcement of our sidewalks, boardwalks, and parks are in everybody's interest." sidewalks who are presently not bound by the same rules and restrictions that they are. Campbell’s chief of staff Venus Molina noted the beachfront and City Council Districts 1, 2 and 3 have been most affected by the proliferation of boardwalk/sidewalk vendors. “We’re not allowed to criminalize vending,” said Molina. “But control and enforcement is needed to ensure the rules are being followed.” Molina said City staff is hopeful of returning by the end of summer with a new ordinance spelling out what vendors can and cannot do plying their wares on sidewalks and boardwalks.

istrict 2 staff is busy working on fleshing out the details of the City’s new short-term rental ordinance and is likely to return to the City Council this October to put the finishing touches on new rules and regulations governing rentals. “We’re meeting with all the stakeholders and all the City departments discussing how this will roll out,” said Venus Molina, Councilmember Jennifer Campbell’s chief of staff. The City Council voted 8-1 on Feb. 23 in favor of the new shortterm rental ordinance sponsored by Campbell. The ordinance was signed into law by Mayor Todd Gloria on April 14. As outlined in a memorandum of understanding between Campbell’s office, Unite Here Local 30 union, and Expedia Group representing short-term rental platforms, her new ordinance claims to reduce the volume of whole-home short-term rentals. It also would create a legal inventory for STRs along with new rules governing their operation, including 24/7 accountability by operators.

NEW SHORT-TERM RENTAL ORDINANCE INCLUDES • Capping whole home STRs at 1% of the City’s housing stock per the San Diego Planning Commission (based on SANDAG’s annual Demographic and Socioeconomic Housing estimates), which would equate to 5,400 today. • No limit on home-sharing STRs. • Allowing part-time STR operators to obtain a license at lower annual fees to accommodate high visitor events such as Comic-Con, Pride or December Nights. • Allowing STR owners a maximum of one license, per person. • Creating a detailed Good Neighbor Policy along with strict enforcement guidelines, a fine structure for violations, and a license revocation standard.

traddling two cultures, La Jolla Country Day Class of 2021 graduate and Barona Tribal Member Jenna Rain Hernandez is proudly continuing her family’s military tradition. She will be attending the United States Naval Academy in Annapolis, Md. Inspired to pursue a military career by her parents, both West Point graduates, Hernandez is now the second Barona Tribal Member in her family to attend one of the country’s premier military academies. Hernandez also developed a nonprofit organization called Vaqueras Lacrosse to bring the competitive team sport that she loves so much to young girls in San Diego’s East County. In addition to serving as the founder and president, she has been an inspiring coach to girls from elementary through high school. Living on a Native American reservation and attending a K-12 private independent school in University City was an interesting challenge for Hernandez, both in terms of balancing both “worlds,” and getting the most from each. “The dynamic of living on the reservation and going to La Jolla Country Day was difficult, but my parents wanted me to get the best advantages I could have,” Hernandez said. “It was really nice being with my family and my cousins on the reservation. But it was difficult going to a school that was predominantly white, where people spoke a different slang and conducted themselves differently. It also helped to have my strong traditions of people on the Barona Reservation.” Of her family’s military tradition Hernandez said: “My parents are very proud of me wanting to carry on that tradition in my generation, which is a heartwarming feeling for me. It is a bonus that I’m making my family proud. But it’s also for my own benefit. And to prove something to myself.” Growing up on the Barona Reservation, Hernandez learned about her tribe and its history from her father Manuel Hernandez, grandma, aunt, and many other tribal elders. Her heritage being dear to her heart, Hernandez has also been a champion of causes affecting Native American women. She is an advocate for The Missing and Murdered Indigenous Women movement, which aims to raise awareness about violence that indigenous women face throughout the U.S and Canada. “I want to have a big platform to speak out on issues I care about,” said Hernandez. “I feel really blessed to get an opportunity to teach more people awareness about racial injustices that can be resolved. I do a lot of advocacy for Native Americans who were wrongly acted upon and their causes.” Hernandez added: “Crimes com m it t ed aga i nst Nat ive A mer ica n s a re of t en not prosecuted.” But Hernandez noted things a re look ing up for Native Americans, more of whom are being elected to government at all levels in the various states the federal government. Of her future, Hernandez said: “I want a long carer in the military. I want to travel and fly.”

s if he’d just mastered a big wave, International Surfing Association president Fernando Aguerre was in Tokyo just prior to the Games rejoicing as his 20-plus year effort to make surfing a Summer Olympic sport has ended in triumph. “It was a long battle, and not an easy one, but a good surfer never really gives up; you stay on the wave,” said Aguerre, who lives in La Jolla where the ISA has a mailing address. “You paddle. And when it gets hard, you paddle harder. I’m happy that we never gave up. Believe me, there were moments when I felt it was not going to happen. No way. There were so many hurdles.”
TEAM USA Hawaii natives John John Florence and Carissa Moore join Californians Kolohe Andino and Caroline Marks on the USA surfing team, having clinched their spots via their performance in the 2019 World Surf League. Florence is one of only five surfers in men’s Championship Tour history to clinch his first two world titles in back-to-back fashion (2016-2017). The 28-year-old’s spot at the Games was put in jeopardy by a knee injury sustained at the Margaret River Pro in 2021, but after rehabilitation, he was declared fit for Tokyo. Andino is a second-generation pro from San Clemente. His father Dino Andino was a former World Tour competitor and national champion in the early 1990s. The 27-year-old won a record nine NSSA national titles as an amateur and qualified for the Championship Tour in 2012 at the age of 18. Moore is a four-time world champion from Honolulu. In 2019, Moore's total commitment to the sport saw her claim her fourth world title on home soil at Maui. The 28-year-old was a star student at Punahou High (the same school Barack Obama attended), where she met her future husband. Marks was the youngest surfer ever to qualify for the women’s Championship Tour. She honed her surfing skills in Melbourne Beach, Fla., but in 2017 moved to San Clemente. The 19-year-old won the rookie of the year award in 2018, her first year on the Championship Tour. The window for competition at the Tokyo Games runs July 25-Aug. 1. The surfing competition is broken up into multiple rounds consisting of timed heats. The preliminary round features four or five surfers per heat; the competition then turns to a head-to-head single elimination format. Heats typically last 30 minutes but can range from 20 to 35. Surfers take turns catching waves and trying to put together their best performances for judges. However, they are not allowed to ride more than 25 waves per heat.
One of those major hu rd l e s w a s c onv i nc i n g t he International Olympic Committee, and parts of the globe not acquainted with the sport, that surf ing deserved representation in the games as a world-class event. “When I first started out, a lot of people didn’t know what surf ing was, unlike coastal California where surfing is just like bicycling,” noted Aguerre, adding he saw a new opportunity in his quest to make surfing an Olympic event when the organizers expressed interest in exploring the possibility of adding new events. That, however, created a new problem – how to squeeze in at the Olympic table competing with other long-entrenched events. “We didn’t know how difficult it was going to be to ‘get a place at the party’ with the IOC,” admitted Aguerre adding, “As far back as 1995, I went to Switzerland to meet with the IOC president.” So how’s the surf shaping up in Japan for the COVID-delayed 2021 Olympics?

“We’ve got a typhoon and three low-pressure systems in the forecast for the region, so it’s looking like we’re going to have amazing waves,” answered Aguerre. “It’s going to be a blast.” Aguerre noted the Olympic surfing competition will involve 20 men and 20 women competing over a three- to four-day period involving 18 countries from five continents. Surfing will take place in the ocean, and not in an artificial wave pool. The contest site for the Olympic Games is
Shidashita Beach, or "Shida,” about 40 miles outside of Tokyo in Chiba. “You can watch all of the Olympic surfing 24/7 on NBC’s website,” noted Aguerre. “This is one of those things I thought would never happen, and now that it’s happened, I can’t believe it,” said Aguerre, a native Argentinian, who mentioned he intends to represent the world’s surf culture by “wearing my bow-tie, my blue blazer and a Hawaiian shirt. We’re doing this
for the 50 million surfers around the world. This is changing the game.” Aguerre paid homage to Duke Kahanamoku, who popularized the ancient Hawaiian sport of surfing and dreamed of competing in the Olympics, but never was able to. “I’m just following in the Duke’s footsteps,” said Aguerre. “It’s nice to be able to give back.” To find out more about ISA and surfing in the Olympics, visit isasurf.org.

rockton Villa overlooking La Jolla Cove is marking its 30th anniversary this year operating out of the former seaside cottage built in 1894. And proud co-owners Megan and David Heine have been sole stewards of the historic cottage-turned-casual-restaurant at 1235 Coast Blvd., which is renowned for its signature menu item, the Coast Toast. The restaurant’s blufftop location offers a magnificent view of La Jolla Cove, and its wraparound veranda and patio have been favorites for outdoor dining, especially during COVID. Megan, whose clan started the Pannikin Coffee & Tea chain, has been in the restaurant business, one way or another, her whole life. A third-generation La Jolla High graduate, Megan is the stepdaughter of Pannikin Coffee and Tea founder Bob Sinclair. Growing up and working in the family cafe business since age 11, her love of preparing, cooking, and eating gourmet food led her to take on Brockton Villa as her own in 1994. Since then, she has married, had two kids, and opened a second restaurant, Beaumont’s in Bird Rock. Megan talked about their “historic” anniversary celebration plans this year for Brockton. “We are having a one-timeonly contest for guests called

‘Add Your History To Ours’ that started this month and will go through the middle of August when we will pick a winner,’” she said. “We’re asking people to submit by email their favorite memory of being at Brockton Villa. The story that is ultimately selected is going to win a ‘Toast The Coast Weekend Getaway in La Jolla.’” That weekend, Heine noted, will consist of a two-night stay at La Valencia Hotel, meals at Brockton Villa and Beaumont's, a La Jolla Kayak-sponsored tour,
and being featured in the restaurant’s social media. Brockton Villa was a departure for Megan from her family’s café-style menu and service. “We started with breakfast and lunch in 1991 and added dinner service, beer, and wine around 1994,” Megan said adding, “That led to other opportunities such as weddings, reunions, and receptions.“ To Megan, everything is memorable about Brockton Villa. “The building itself is really special being over 100 years old,”

she noted. “When we took it over in 1989 we had to do a lot of work on the 1894 building, whose history and architecture we continue to celebrate. We had to install a commercial-grade kitchen.” But she added, “Old pictures of the house look pretty familiar on the inside.” Brockton’s many features continuing to give it that historic homey feel includes historic photos they got from La Jolla Historical Society, as well as a spectacular abalone-inlaid
fireplace. Among the stars of Brockton’s 30th-anniversary celebration is their marque, World Famous Coast Toast, a souffle-style French toast co-developed by Megan, her mother Gay Sinclair, and good friend and chef Shari Robins. Coast Toast even occupies its own page on their website at brocktonvilla.com. Brockton Villa has won numerous awards over the years including the prestigious Orchid Award for historic preservation, multiple Silver Fork and “Best Of” awards, Travel & Leisure’s Best Breakfasts and as a top destination in New York Times travel section. Of doing business during COVID at Brockton, Megan noted, “It was a real roller coaster, to say the least with every day offering new rules, new fears, new precautions, and procedures. We were lucky to have a lot of outdoor space, but offering to-go here was like forget it. No one was going to drive down to Brockton to pick up to-go food. We had to be creative with our business model to survive.” Being a dual restaurant owner, Megan concedes, leads to a “pretty crazy busy lifestyle. But having Dave as my partner in crime has just been great because we balance each other.” And of their historic restaurant with its storied tradition, Megan concluded: “It’s a venue. It’s a historic landmark. It’s a place with a great view with great sunsets. It’s a very special location.”
Enhance La Jolla envisions new Prospect Street plaza for Village By DAVE SCHWAB

nhance La Jolla has unveiled phase one of a longrange plan to improve community gathering spaces by reclaiming and increasing space for pedestrians, street furniture, and landscape. On July 15, in its first in-person meeting since COVID, the coastal community’s maintenance assessment district’s 13-member board outlined its long-term vision for re-imagining La Jolla’s downtown Village. That update is to include a new Prospect Street plaza between Girard Avenue and Herschel Street. The MADD’s objective is for infrastructure improvements to be a catalyst for business, socializing, and programming throughout the year. Enhancements to Girard Avenue will increase accessibility and safety while expanding the pedestrian realm with a mix of trees offering daytime shade and additional nighttime lighting fixtures. Various traffic-calming measures are also part of the infrastructure improvement package. The streetscape revitalization plan is a collaboration between local architects including such high-profile names as the M.W. Steele Group, which designed downtown San Diego’s new

Enhance La Jolla board member Phyllis Pfeiffer of the La Jolla Community Foundation outlined key aspects of first-phase street improvements. Those upgrades aim to create a new public plaza at The Dip on Prospect Street, as well as providing new benches, trees, and lighting fixtures elsewhere on Girard Avenue and Wall Street. Pfeiffer said plans are to close off a section of Prospect Street to thru-traffic to create a new public plaza.
“The retaining wall there now will be moved and traffic will be redirected both ways down the Dip so you don’t get traffic down there at all,” Pfeiffer said. “The parking spots we lose there would be replaced when we go down to lower Girard.” “Currently, there’s only diagonal parking on one side of the street (Prospect), and we’d probably triple the parking on that side of the street,” added board chair Ed Witt. Pfeiffer noted M.W. Steele Group has been engaged in a consortium of local architects to collaborate on the public-improvement project.
The MADD for the Village of La Jolla includes residential, commercial, public, and non-profit properties. Property owners pay an annual assessment through their property taxes, with the funds being dedicated exclusively to providing landscape and maintenance services that benefit the Village. The services and improvements funded by the MADD are developed to best fit the needs of La Jolla property owners. Pfeiffer said this non-traditional approach, engaging architects to corroborate rather than compete with one another individually on the project, was done to cut costs and improve planning for long-term infrastructure revitalization. She added Latitude 33, a well-known San Diego planning and engineering firm that did the Bird Rock traffic roundabouts, will work with architects on future project planning. MADD board chair Witt noted planning for streetscape improvements will be “very flexible and very mobile.” He added the project will break fresh ground in other ways too. “This will be a public-private partnership, not just a nice project,” Witt said, adding District 1 Councilmember Joe LaCava “firmly believes this will happen and he’s glad to see it happen.” Pfeiffer said nonprofit LJCF,
an affiliate of the San Diego Foundation, will work together to fundraise for the long-term project, which she estimated will cost $10 million to $15 million for the proposed plaza in the project’s first phase. She discussed where some of that funding might come from. “Naming rights could be granted for $5 million to $7.5 million for a privately funded project in the public right-of-way with signage or a monument, or maybe even on the pavement of the plaza,” Pfeiffer said. Enhance La Jolla, a nonprofit organization, is dedicated to the maintenance and physical improvement of the Village of La Jolla. It manages one of the 64 maintenance assessment districts in San Diego, which have a contract with the City to make improvements in the public rightof-way and may also implement privately contracted capital projects, in addition to the maintenance services underwritten by property-owner fees. The LJCF is dedicated to improving the community through pooled philanthropy. Its purpose and vision are to foster a sense of community among La Jollans while enriching the environmental. Creativity abounds from fashion designer Pam Braden Marks Fashion Files

ashion designer Pam Braden Marks creates high-end fashion and art. I was excited to visit her studio to see her unique creations. Jackets are one of the specialties of this La Jolla resident. Some of them have rhinestones on them with sayings like “I’m The Boss!” Look for one of these jackets on the red carpet at the La Jolla International Fashion Film Festival. Other jackets have graffiti on them that are all meticulously hand-painted. I thought these were a must-have as are her handbags that are painstakingly hand-painted with art and sayings. The studio is beautifully decorated by Pam with antiques and art that are super uplifting and inspiring. In addition to all these marvelous creations, Pam also makes art pieces. She collects pages from the tabloids such as the Star or People magazine and creates collages with saying and pictures about what is going on in society. I asked Pam how she started in fashion and she said that her mother started her sewing at the age of 5. Her mother, who was creative and talented, inspired her to use her mind to be creative. “My
mother always had me using my imagination and under her guidance, I felt I could design and produce anything,” Pam said. Her first job was at Contempo Casuals in Fashion Valley when she was 14. She hung around older girlfriends who were chic and hot. She wanted to be part of this glam crew. Her mother, who owned an industrial silk-screening business, made all the girls T-shirts that read, “A Million Dollar Baby, from a Million Dollar Store.” These were a big hit until they found out she was underage and they had to let her go. She moved to Beverly Hills when she was 18 and landed her first real job at Fred Hayman at his Rodeo Drive boutique Giorgio. Famous and fabulous clients the world overcame in to have the “Giorgio” experience. She felt like she had died and gone to heaven. There were racks and racks of beautiful gowns from couture designers that she had never heard of but knew from the price tag that they were talented and important… so she took note. Her next position was working for Herbert Fink on Rodeo Drive who owned Theodore, Theodore Man, Claude Montana, and Sonia Rykiel. This was such a fabulous time be in Beverly Hills. One day, Stanley Donen the film director of fashion movies walked through the door and two weeks later she
married him at his former wife’s, house, Yvette Mimeux. Donen introduced her to Audrey Hepburn from “Funny Face,” and to this day it is still her favorite movie. She met her second husband, Gregg Marks, working at Audemars Piguet. He was a CEO of a public company that manufactured women’s apparel, shoes and also had retail operations, (Nine West, Anne Klein, Stuart Weisman, Barney’s NY, etc.) I wanted to know when she started her own business. She said: “I was at my house in Westchester, N.Y. during a snowstorm and picked up one of my handbags and started to paint. Everywhere I went people were complimenting me on my bag and inquiring where I purchased it. Scripps Oceanography climate scientist awarded prestigious global prize Veerabhadran Ramanathan, a renowned climate and atmospheric scientist at Scripps Institution of Oceanography at UC San Diego, will receive the Blue Planet Prize, the international environmental award
sponsored by Japan’s Asahi Glass Foundation. Ramanathan, the Edward A. Frieman Endowed Presidential Chair in Climate Sustainability at Scripps, has spent decades investigating the climate effects
of global warming pollutants other than carbon dioxide. He has pioneered the uncovering of the role of short-lived climate pollutants (SLCPs) such as methane, tropospheric ozone, halocarbons (HFCs),
and black carbon. His contributions include the discovery of the super-greenhouse effect of chlorofluorocarbons, and clarification of the climate effects of black carbon through an international field project he led

Retired La Jolla dentist gets 15 months for elaborate tax evasion By NEAL PUTNAM
A retired La Jolla dentist with leukemia will surrender by July 28 to begin his 15-month federal prison term for an elaborate tax evasion scheme with a former rabbi. Dr. Bruce Baker, now 75, has paid $805,901 in restitution of the $1.3 million loss back to the Internal Revenue Service, wrote his attorney, Tom Warwick, who had asked for six months home confinement. Warwick had asked U.S. District Court Judge Cynthia
Bashant for probation with 100 hours of community service in June, saying he could perform dentistry with people who could not afford dental procedures. “He could help a lot of people in need in the time he does have remaining on this earth,” suggested Warwick to the judge. The U.S. Attorney’s office recommended the 15 months, with a prosecutor writing “some degree of punishment is essential... to send a sufficient deterrent message.” “The United States submits that the reasonable sentence for this
75-year-old retired dentist with no risk of recidivism and a terminal diagnosis of leukemia is a sentence of 15 months,” according to the sentencing memorandum. “Baker engaged in the scheme for two decades, with two different religious leaders,” stated the U.S. Attorney sentencing brief. “Baker procured the most benefits and caused the greatest tax losses.” Bashant ordered Baker to pay $574,727 to the Internal Revenue Service, which is the balance he owes after paying more than half of it back.
Baker pleaded guilty to conspiracy to defraud the U.S. and filing a false tax return. Warwick said he has since amended his tax returns. Baker remains free on his own recognizance until July 28. Baker conspired with Rabbi Yisroel Goldstein, who formerly worked at the Chabad of Poway and reported that Goldstein gave $2.6 million in charitable donations to the synagogue. Goldstein secretly returned $2.4 million back to Baker, according to court records, keeping 10% as his fee. Goldstein, 59, pleaded guilty to
conspiracy to defraud the U.S. and wire fraud, and is free on bond before he’s sentenced in October. A 19-year-old gunman attacked the Chabad of Poway synagogue on April 27, 2019, killing Lori Gilbert-Kaye, and shooting Goldstein in both hands, along with wounding another man and a girl. Goldstein’s index finger was shot off. The announcement of the case against Goldstein, Baker, and four others was on July 14, 2020, by the U.S. Attorney’s office. READ MORE ONLINE AT sdnews.com

Added Santacroce: “After July 1, 2022, if a request for an investigation is submitted and the follow-up inspection reveals code violations, staff will determine the appropriate remedy. Remedies occur on a
case-by-case basis and may include the issuance of a citation or notice. “In most cases, the person responsible for a violation can voluntarily comply and correct the situation. However, once the deadline in the notice has expired, the owner or responsible person may be subject to civil penalties or judicial remedies, among other options.” Santacroce said civil penalties for violating the STRO Ordinance may be assessed up to a maximum daily amount of $10,000 and up to a total maximum amount of $400,000. With judicial remedies, the City Attorney can also file criminal or civil cases against the
responsible party or parties. “We’ve been working on the fees, and the lottery, for the ordinance along with the (rental) platforms,” said Molina of ongoing work refining the rental ordinance. “We’re moving forward to talk about how to implement this ordinance. We want to bring the fees, pay to play, how much each permit will cost, and information for the lottery, back for council approval in the fall.” Added Molina: “Another thing we’re working on is how you prioritize good short-term operators that are in business who have been doing a great job. We have to have a lottery (capping rental numbers under the ordinance) and we’re working out all those details.”

the Pacific Beach man who sold Kol the drugs also died from fentanyl poisoning in the same batch of drugs that killed the other man. The same batch also sickened Kol, his wife, and several others, who were hospitalized. Assistant U.S. Attorney Michael Deshong asked U.S. District Court Judge Cathy Ann Bencivengo for a sentence of 235 months in court documents but argued in court for 17 ½ years in prison. Attorney Lauren Williams, who represents Kol, asked for a 10-year term. Watching the sentencing in the audience were Kol’s wife, his parents, cousins, and uncles. Bencivengo gave Kol credit for serving 726 days in the Metropolitan Correctional Center since his 2018 arrest after his neighbor died. “He was regularly trafficking in drugs,” said Bencivengo. “He sold them to people he knew.” The judge noted that Kol “noticed there was something wrong with the cocaine” when he tasted it, yet he still sold it to his neighbor and others even after he got sick from it. “It is very disturbing to the court… the disregard for the human lives he was putting at risk,” said Bencivengo. That was fine because as I mentioned before, I really wanted $3,000,000 and I got what I wanted, so again he got me not once but twice $3,100,000 offers, that seems to be David's slogan, not once but twice, lol. David has sold over a dozen of the same properties two and three times over. But never in my wildest dream that I would get offers beyond that. David has special skills at negotiating with the buyers/agents. Not sure how he does it but he is the miracle worker. I will be more than happy to refer any of my friends and family to have David R. What are we entitled to? Rights, privileges, and special treatment Doing it Better By Natasha Josefowitz, Ph.D.
As I have started to go out to restaurants and stores, I have noticed several instances of unacceptable behaviors towards waiters, salespeople, and other customer-service personnel. The loud blowup about a wrong order or slowness of service made me think about what people feel entitled to, like getting the expected services in a timely manner. In The Boston Globe (7/16/21) I read that “some restaurant owners in Massachusetts described customers who are lashing out at employees when they can't be seated right away or endure longer wait times for their food.” These customers’ behaviors made the staff cry. The area designed for impulse control — the frontal cortex — shrinks as one ages, and one has less patience and becomes more irritable and quicker to anger. “Grumpy old men” as well as “cranky old women” is a reality for many. This loss of impulse control also expresses itself by inappropriate comments and actions. Today’s service providers respond differently than a generation ago when those who served
endured harassment for fear of losing their jobs. In those days, the mantra “the customer is always right” prevailed. Today the customer is on notice that by law the workplace must not be a hostile environment. Workers today feel free to quit, knowing that employers are scrambling to find and retain employees. Entitlement has two aspects: one is the right to benefits specified especially by law or contract; the other is a belief one is deserving of certain privileges and special treatment. While thinking about entitlement I came up with several categories: 1. Entitlement is a class issue. The proverbial 1 percent is most prone to feeling entitled to the world’s privileges — all too often at the expense of the people who have not had access to neighborhoods with good schools, affordable healthcare, and opportunities for jobs with decent salaries. 2. Entitlement is a gender issue. As a female college graduate in 1948, I wanted to be a doctor, but was told I was not going to be accepted at a medical school given my gender, so I did not try. Today 50 percent of medical school graduates are women. A generation ago women broke barriers as they began to feel entitled to equal opportunity at work. The struggle goes on today for equal pay and freedom from abuse. Moreover, a
generation ago, men felt entitled to belittle women who had little leeway to object or to be believed. The “me too movement” is making a difference. 3. Entitlement is a race issue. Our generation is experiencing a new push for equality by people of color as they look for the same respect, safety, opportunities, treatment, and privileges as white people have. “Black Lives Matter” is an effort to raise consciousness at the unfairness of a system which allows discrimination. 4. Entitlement is a religious issue. In the middle of the last century, Jews were not allowed to buy property in La Jolla. In the past, universities had quotas for Jewish students. Today universities have quotas for Asian students. Only a fixed number are accepted; this, too, is now changing. 5. Entitlement is an educational issue. People who attend elite colleges are more likely to land well-paying jobs and positions of power. Poorer students may not have computers and may not be able to follow class lessons online, the only way to learn during the pandemic. 6. Entitlement is an issue of location. During the pandemic, virtual learning through access to the internet was not available to all communities, which prevented may students from being able to learn online. When I lived in New

York City in the 1950s and ’60s, some co-op apartment buildings would not accept black people. 7. Entitlement is an issue of policy. The hiring and promotional policies in both business and government are often discriminatory. Try the following exercise. Make a list of what you thought you were entitled to in your life, but did not happened. Has your list changed over the years? How would this list be different today? The first step in dealing with lack of entitlement is awareness. The second step is action, the implementation of this awareness. Some people do not realize that they are entitled to certain rights and, therefore, do not demand them. Others are denied their rights due to the prevalent culture, generation, lifestyle, education, race, gender, religion, etc. We should all be involved in helping to make this awareness a reality. Let’s remember the Golden Rule: the principle of treating others as one wants to be treated. Our Declaration of Independence entitles us to “life, liberty, and the pursuit of happiness.” I would like to add … and equal opportunities for all! Natasha Josefowitz is the author of 21 books.
