Study finds understaffing, decrepit tech hampers Aurora city court system

Don’t shoot Trump, nor the messengers conveying how dangerous he really is

Don’t shoot the messenger, folks. Please.

In fact, don’t shoot anyone.

In the surreal post-Trump-attempted assassination world, it seems to be too late for that.

In fact, simply wishing that people didn’t shoot one another, or threaten to shoot each other, daily, has been an American problem for generations.

Assassins at grocery stores, in Aurora parks, an Aurora cinema, two schools, the nation’s gay bars, straight bars, and just on the streets in quiet, wealthy neighborhoods, have created a crisis of domestic terrorism.

The list of presidential and political shootings in the United States is horrifyingly long. Few may know, but President Gerald Ford got shot at twice.

Just recently, former House Speaker Nancy Pelosi’s husband was kidnapped and beaten.

Probably more than half of the county clerks and secretaries of state in the country have horror stories about death threats.

For years, I’ve absorbed thinly veiled and often overt death threats lobbed at me in the mail, on the phone and online from all over the country.

Some of the worst came when I wrote signed columns supporting then-nascent Colorado gun control measures about a year after the Aurora theater shooting.

The threats, from across the country, became so prolific and so serious that my family and I were all trained in how to try to survive a car bombing.

The trick there is to leave the driver-side door open with your left foot on the ground before you insert the car key or start the car. If a bomb goes off, and you’re lucky, the bomb will blast you out of the open car door and not into meatloaf.

My daughter was forced to have her high-school resource officer walk her to her car and check it out for her every day for months.

Be warned, the voice mail is incredibly profane and filled with racial slurs.

Like so many journalists and public officials, we are, tragically, not strangers to violence and threats of violence.

I, too, however, am staggered and galled at some 20-year-old nutcase with an assault rifle wounding Donald Trump and maiming and killing his fans at a political rally.

We may never know what compelled Thomas Matthew Crooks to shoot at Trump, but in the twisted minds of bullies, the goal is often to silence their victims with fear and intimidation.

It’s anathema to who we are as a free society, gifted with the power of free speech like no other nation on the planet.

That’s why it’s so disheartening and exasperating to suffer a tsunami of disingenuous Trump fanatics berate me, and millions like me, for calling out Trump for what he provably is: a danger to the democratic structure of the nation and to millions of people he regularly degrades and threatens.

No cogent, honest or rational person can deny the tens of thousands of outlandish and dangerous lies Trump has told — repeatedly proven as malevolent falsehoods — since he ran for president the first time in 2016. His lying is endlessly documented and dispelled, even by his own political allies.

Set aside, briefly, Trump’s catalog of rap sheets and criminal allegations — some of which include sex assaults — Trump attempted repeatedly, and unsuccessfully, to overturn the 2020 Election he lost.

What part of the treacherous dictator do so many of his followers not understand? He incited and supported an insurrection Jan. 6, 2021 at the U.S. Capitol, and he was convicted of it by congressional Republicans, who then became his sworn enemies.

Trump has since threatened revenge, targeting the people who held him accountable for those crimes and others.

This is not just a presidential candidate who is peddling lame trade policies or son-of-trickle-down economics. This is a man who admittedly and proudly admires and aligns himself with ruthless, murderous dictators like President Vladimir Putin.

There is no hyperbole in calling out the fact that Trump quotes and paraphrases Nazi and fascist texts and ideologies, he provably has repeatedly done it.

No one in their right mind disagrees that Trump, or anyone, does not deserve to be assassinated. He deserves to be convicted by voters in November and convicted in the courts for his many criminal charges.

But telling me, or anyone, that we can’t call out Trump for exactly what he does and exactly who he provably is, because it elicits assassinations, is every bit as much domestic terrorism and the nutcases looking somewhere for an assault weapon.

There is no demure nor polite way to hold Trump accountable for the heinous atrocities he’s committed and threatens to invoke. He got caught trying to steal the election that he provably lost. It doesn’t get any worse than that.

Yet.

But when it does, you’ll be thankful that dedicated journalists will continue to call out him and other criminal politicians regardless of their political stripes.

For the sake of victims,

it’s time to move Aurora’s domestic violence courts

Tragically, the Aurora City Council has inadvertently made clear that closing down the city’s domestic violence court system is in the best interest of about 1,600 victims of that insidious crime each year.

It’s a tragedy not just for future victims of beatings and all kinds of abuse suffered at the hands of partners, spouses and family members, but for Aurora as a community.

The nationally lauded, decades-old specialty court system is at risk over political hijinks and ineffectuality among a conservative faction of city lawmakers.

Led by council members Dustin Zvonek and Danielle Jurinsky, the push to close the court system is the latest in a ham-handed string of public safety sagas inflicted on Aurora by this city council, and these two city lawmakers in particular.

Driving this latest debacle is a quest to cut city costs for providing constitutionally mandated defense attorney services to indigent criminal suspects.

A faction of city council does not appreciate that, despite their personal feelings, Aurora, like Colorado and the nation, is governed by the rule of law, not the rule of whim.

In Aurora, and across the United States, anyone accused of a crime, truly does have the right to a qualified attorney and defense, and they are, truly, considered innocent until they are proven guilty in court.

The Sixth and Fourteenth amendments are so critical to the foundation of American government, that they have been upheld, defined and enshrined not just by founding Americans, but by a critical succession of Supreme Court decisions over the centuries.

The 1963 Gideon v. Wainwright decision, which was unanimous, held that states and other governments are required to provide not just attorneys for poor suspects, but qualified attorneys.

Zvonek has led the charge to save an undetermined amount of city taxpayer money by shutting down its public defender program and, instead, hiring private attorneys to provide counsel for less money.

The idea fizzled last year when a scheme to “privatize” the public defender program failed to turn up a single law firm to respond to a request for bids.

Parallel to this drama, state lawmakers have been working to ensure local courts, adjudicating jailable offenses, comply with defense counsel standards by being precluded from parting systems out, or privatizing them.

Zvonek, Jurinsky and others have adopted a mantra of political foul and lack of “local control” and are using the scheme as fodder for “possibly” closing the specialty domestic violence court system on these new grounds.

It would be tragic for domestic violence victims, especially indigent victims, whose lives are shattered and endangered not just by their perpetrators, but by the complications surrounding the crime of domestic violence, especially when it involves children.

Some of the city council have scoffed at claims by experts insisting that even the location of the county courts — in Brighton for Adams County residents, and at least 25 miles away, requiring a nearly 4-hour RTD bus ride — is an unnavigable encumbrance for many poor victims.

Their ignorance about the quagmire of domestic violence or callous victim shaming illustrates that these city lawmakers are too dangerous to be entrusted with the dire responsibility of legislating and maintaining a criminal justice system.

Zvonek is absolutely right in pointing out that it is unfair to Aurora taxpayers to have to shoulder the financial burden of providing constitutionally required quality public defense when that cost for all other state residents is borne by the state. While the city has yet to provide a reliable cost burden, it could be as much as $3 million a year.

But this city council continues to politically isolate itself from Democratically controlled state bodies and agencies and has no allies in the fight for equity for Aurora residents.

For the sake of victims and the accused, it would be best to close not just this specialty criminal court, but all criminal courts run by the city, and move those cases to more qualified administration among the city’s three counties and two judicial districts.

Until Aurora is led by more capable lawmakers, the critical needs of domestic violence victims, and the critical right of indigent suspects of all types of crime to a fair trial, which requires qualified defense counsel, must prevail.

Bethel Park was assassin-free then

Igrew up in Bethel Park, the middle-class suburb south of Pittsburgh where 20-year-old Thomas Matthew Crooks lived with his parents.

Crooks’ attempt to kill Donald Trump last weekend has filled my old neighborhood with shock and sadness.

Bethel Park is populated by decent, salt-ofthe-earth people — people such as my mom and dad who moved there in 1964 to raise their six children in a safe, friendly community with big yards and good schools.

Like many kids in my neighborhood in the 70s, I attended St. Germaine Catholic Elementary School.

The nuns there taught us to embrace the virtues: prudence, temperance and courage.

They demanded we fend off the seven deadly sins: pride, envy, gluttony, lust, anger, greed and sloth.

They also made us sit up straight and keep our shirts tucked in.

I didn’t know it then, but the good sisters gave us the gift of moral clarity — and what they taught us worked.

The vast majority of my St.Germaine classmates went on to live healthy, productive and happy lives.

So did most of the kids who graduated with me in 1980 at Bethel Park High School — where Crooks would have a troubled and unhappy time four decades later.

At 20, Crooks was a member of Generation Z. We don’t know yet what his unique inner demons were. But we do know that many in the Zoomer generation are struggling.

Social psychologist Jonathan Haidt explains their troubles in his book, “The Anxious Generation.”

Haidt says the combination of helicopter parents and social media have rewired childhood for kids born after 1995, creating an epidemic of anxiety, depression and suicidality.

As it goes, parents have over-protected post-1995 children in their home lives, but under-protected them in their digital lives, where powerful, negative online forces overwhelm the positive influence of parents, churches and

teachers.

To be sure, the mindset of America’s first smartphone generation doesn’t echo my generation’s in any way:

– Only 26% of Zoomers have faith in God/religion vs. 65% of Boomers, according to a Public Opinion Strategies/NBC News poll.

– About 2 percent of Boomers identify as LGBTQ, but 16 percent of Zoomers do, according to a Gallup survey.

– Zoomers are less than half as likely to be proud to be American, according to a 2023 Gallup poll.

– Four in 10 Zoomers say the Founding Fathers are better described as villains than heroes, and 75% think the nation demands dramatic change, according to a Democracy Fund survey.

Generationally speaking, we tail-end Boomers had it made. The basic values that were infused in us by our parents, neighbors, churches and teachers gave us the tools that helped us flourish as adults.

It is heartbreaking to see that the simple values we were taught — the tried-and-tested values that have been passed down for many generations — are not being transferred fully to younger generations, such as the Zoomers.

My heart aches for the Comperatore family that lost its brave and good father Corey at Trump’s rally, and also two other shooting victims, who are still in critical condition.

My heart also aches for the very confused young man from my old neighborhood who threw his life away and caused so many people so much unnecessary pain.

Whatever his motives were, his horrific act is a reflection of the political hatred that divides us.

Aurora Rep. Jason Crow raises concerns to EPA about Lowry Ranch drilling proposal near Lowry Superfund site

U.S. Rep. Jason Crow relayed concerns this week to the Environmental Protection Agency about proposed oil and gas fracking near the polluted site of the former Lowry Landfill near Aurora.

The 500-plus-acre site east of E-470 was used by Denver as a dumping ground for sewage, garbage and industrial waste from the mid-1960s through 1990.

In the 1980s and ’90s, environmental testing overseen by the EPA found volatile organic compounds, heavy metals and other toxic chemicals permeating the soil and groundwater beneath the landfill, where hazardous materials had been deposited in unlined pits.

The landfill was added in 1984 to the EPA’s list of “Superfund” sites, which at the time included some of the most heavily contaminated properties in the nation.

The City and County of Denver and Waste Management of Colorado have since agreed to manage the cleanup of the site through a series of projects designed to limit

the flow of chemicals into the ground and control the release of toxic gases into the air.

Those projects have included underground “barrier walls” designed to keep groundwater from moving into or out of the area beneath the former Lowry Landfill as well as ongoing water treatment and gas flaring operations.

At the same time, oil and gas producer Civitas Resources is seeking approval from the state to operate as many as 166 wells on 10 new or expanded well pads in the area of the landfill and Aurora Reservoir, prompting pushback from residents who fear nearby fracking could poison their drinking water.

Civitas officials restructured their plan to preclude drilling or fracking under the landfill site, but plans still include drilling far beneath the Aurora Reservoir, the Sentinel reported earlier this summer.

The proposal is still pending, and opponents have taken the opportunity of recent public meetings to speak out against the Lowry Ranch fracking plan.

In his July 15 letter, Crow described residents’ worries

about oil and gas operations impacting the underground containment of pollutants at Lowry, asking the EPA’s regional director, KC Becker, what a “scientifically-based” buffer zone looks like around the former landfill.

“Local community members remain concerned over the lack of conclusive scientific review regarding an adequate seismic buffer zone to safeguard the (Lowry Landfill Superfund Site) remediation infrastructure,” Crow wrote.

The list of questions sent by Crow includes inquiries about the agency’s plans to test for and monitor the presence of specific chemicals such as 1,4-dioxane and PFAS compounds, how the agency will engage with local residents, and whether it will expand the boundaries of the Superfund site to incorporate an underground “plume” of tainted soil abutting Aurora’s Murphy Creek neighborhood.

The Colorado Energy and Carbon Management Commission is expected to consider the Lowry Ranch drilling and extraction plan July 30 and Aug. 2.

Phillip Morris announces $600 million Zyn facility in Aurora, creating 500 jobs

Phillip Morris officials say 500 local jobs will be part of a $600 million nicotine pouch manufacturing facility expected to open in Aurora next year.

Project backers Philip Morris International say project includes a “state of the art” facility to produce Swedish Match Zyn nicotine pouches, boasting a $550 million annual impact and providing for an additional 1,000 “indirect” jobs in addition to positions at the facility, according to Philip Morris spokespersons.

Gov. Jared Polis, Aurora Mayor Mike Coffman and other local elected officials were expected to speak at a public announcement in Aurora July 16.

“PMI and its U.S. affiliates are accelerating their mission to move adults who smoke away from cigarettes in the U.S. by investing in new U.S. manufacturing capacity to meet the increasing demand for nicotine options that are scientifically substantiated as better alternatives,” said PMI Americas President and U.S. CEO Stacey Kennedy. “We believe Colorado is likeminded in its commitment to innovation, economic opportunity and public health, and we’re eager to work with the state and its talented workforce as we expand our U.S. manufacturing presence.”

Plans call for breaking ground on the new facility later this year and to begin preliminary operations by the end of 2025, with regular production starting in 2026.

Officials said that about 5,000 construction jobs are expected to

be created.

Philip Morris first entered the U.S. nicotine patch market following its acquisition of Swedish Match in late 2022.

Swedish Match’s Zyn oral nicotine pouches have been on the market in the U.S. for more than a decade. Company officials said the pouches are designed for adult consumers who smoke, want to quit, but want to continue using nicotine.

Philip Morris also announced a commitment to Colorado veterans with a donation of $350,000 over two years to the Rocky Mountain Veterans Advocacy Project. The project is a Colorado-based law clinic to help veterans in need access the benefits and care they’ve earned through their service.

Company officials said affiliates also plan to provide the Veterans Community Project that provides veterans’ housing with $100,000. The funds are targeted to benefit Colorado Gold Star Mothers, the Colorado Freedom Memorial, Hire Heroes USA directed to Colorado homeless veterans hiring, Soldier’s Angels for food provisions and Musicians on Call for Veterans Administration hospital visits.

Phillip Morris will also provide $250,000 a year for the next eight years to the flexible housing fund that benefits residents of Adams County and the City of Aurora by supporting transitional housing, officials said.

Zyn in the news

Philip Morris “Zyn” has been making big headlines, sparking debate about whether new nicotine-based alternatives intended for adults may be catching on with underage teens and adolescents.

Zyn is an oral pouch that contains nicotine powder and flavorings like mint, coffee and citrus. The pouches are the fastest-growing segment of the tobacco industry,

which has struggled for decades to replace falling cigarette sales.

Zyn is marketed by Philip Morris International to adult tobacco users. Although it doesn’t contain tobacco, U.S. regulators still treat it as a tobacco product.

Competitors sell similar products. Altria, for instance, sells its own flavored pouches called On.

Users stick them between their lip and gums, where they slowly release low levels of nicotine that are absorbed into the bloodstream. Because pouches generally don’t contain tobacco, there’s no spitting, unlike older products like chew and snuff.

Philip Morris representatives say the nicotine-only formulation is part of Zyn’s appeal.

“People can be reluctant to move into an oral tobacco product if they view it as similar to traditional chewing tobacco,” company spokesman Corey Henry said. “Consumer acceptability is a big part of Zyn.”

All tobacco products carry serious health risks, medical experts say. Cigarettes are widely understood as the most harmful, increasing the likelihood of cancer, heart disease and lung problems. Chewing tobacco is linked to mouth cancer, gum disease and tooth loss.

But in the last decade or so, researchers and health regulators have begun to acknowledge different levels of harm among different tobacco products.

In 2019, the Food and Drug Administration said a different oral tobacco product, called snus, contains lower cancer-causing chemicals than cigarettes and could benefit smokers who switch.

Snus are similar to nicotine pouches like Zyn, except that they contain fermented tobacco. Studies from Sweden and other places where they are popular have shown lower rates of lung cancer and related diseases compared with other

European countries where smoking is more prevalent.

There’s little research on the long-term effects of nicotine pouches, but many researchers expect they will show similarly low rates of carcinogens and other toxic components.

Still, that doesn’t mean they’re safe, medical experts say. A study last year found Zyn and similar products contain low levels of harmful substances such as ammonia and formaldehyde.

Currently FDA officials are letting Zyn stay on the market while they review Philip Morris’ marketing application, which was submitted in 2020.

To win FDA authorization, companies generally must show that their products will reduce disease among adult tobacco users without attracting underage use by teens and adolescents.

Zyn doesn’t, so far, appear to be popular with youth, according to the latest federal data. Only 1.5% of high school and middle schoolers reported using nicotine pouches when surveyed last year. That’s well below the roughly 10% who used electronic cigarettes.

But anti-tobacco advocates point to worrying signs: videos of young people popping the pouches have racked up millions of views on social media in recent months.

A similar surge of online activity preceded the rise of Juul, the sleek e-cigarette widely blamed for triggering a spike in teen vaping in the years before COVID-19.

Concerns about Zyn going viral have sparked debate among health experts, parents and even politicians.

The FDA says it’s monitoring underage use of Zyn and other pouches and will take action, if necessary.

Currently only a handful of products are FDA-approved to help with quitting smoking, including medications, nicotine gums and patch-

es. Some researchers point out that Zyn works similarly to some of those products — gradually delivering nicotine that reduces cravings.

But early research suggests Zyn and other pouches may not be enough to help smokers quit.

Ohio State University researchers recently found it took smokers 30 minutes to an hour to get enough nicotine from Zyn to relieve their cravings. With cigarettes, smokers achieved the same nicotine levels — and relief — in five minutes.

For now, Philip Morris is focused on obtaining FDA authorization to stay on the market, and eventually it has said it could seek a reduced-risk designation similar to snus. But no tobacco company — Philip Morris included — has ever asked the FDA to approve their products to help smokers quit completely.

Aurora voters asked to re-decide citywide pitbull ban in November Aurora voters will once again be asked whether they want to allow the ownership of pit bulls after City Council members voted Monday to put the question on the November ballot.

The move comes after an 18th Judicial District Court judge found that the council acted “without authority” when it set aside the city’s ban in 2021, since the ban had already been upheld by voters in 2014, and Aurora’s City Charter specifies that legislation previously placed on the ballot can only be modified by an electoral vote.

“The reason we have to do this in July is we have a deadline to be able to get it on the coordinated ballot for November,” Pete Schulte of the Aurora City Attorney’s Office said

Three specific breeds are named in the ballot item, which was included in Danielle Jurinsky’s proposal to put the question to voters.

Schulte said the item only names the American pit bull terrier, American Staffordshire terrier and Staffordshire bull terrier rather than also including other breeds commonly referred to as “pit bulls” because the item needed to reflect the language of the 2005 ban in order to be valid.

The proposal was passed by all of the council members who relocated to the Aurora Room after the Paul Tauer Council Chamber was occupied by protesters Monday night.

Aurora searching for 7th police chief in 5 years as interim Chief Morris announces departure

‘Aurora is looking for a police chief, again.

Interim police chief Heather Morris and the city announced in a July 12 statement that Morris would not apply for the job as permanent chief of the Aurora Police Department, which has had six permanent and interim police chiefs in less than five years.

An open solicitation of applications for the job closed Friday at 5 p.m.

“What I’m really excited about is that, after over two years of having an interim chief, at the completion of this process, the department will have a chief who’s not interim,” Morris told the Sentinel. “I’m really looking forward to that and helping in any way I can in a smooth transition.”

Despite being publicly called on to resign by Councilmember Danielle Jurinsky earlier this year, Morris said her decision was made for “personal reasons” and was not the result of pressure from Jurinsky.

Morris took the reins from interim chief Art Acevedo, who in December 2022 took over from interim chief Dan Oates. That appointment came after a national search for a new permanent chief turned up no viable candidates in October 2022.

Oates was offered the temporary job when chief Vanessa Wilson was forced from the position in April 2022 amidst pressure from council members and police union leaders as well as allegations that she had mismanaged the department. Wilson has since filed a lawsuit against the city for wrongful firing.

Wilson was appointed chief in August 2020 after a few months of holding the interim title. She replaced former Chief Nick Metz, who retired in late 2019 as controversy was beginning to swirl around the officer-involved death of Elijah McClain.

Another Aurora police staffer, Paul O’Keefe, was appointed inter-

im chief but soon stepped down under scrutiny for his handling of a police officer who passed out drunk in his squad car and was permitted to remain on the force.

The Aurora Police Department has been had to grapple with a long list of controversies since Metz’s departure, mostly stemming from allegations of officers using excessive force against residents of color.

The city is currently engaged in a consent decree pact with the state attorney general’s office to enact a reforms addressing what the state says are “patterns and practices” of abusive behavior.

Neither Morris nor the city offered a timeline for the hiring of Morris’ replacement, though Morris said she would remain in the position until that person is chosen.

Protesters confront Aurora council conservatives at town hall after earlier contentious meeting

What was announced as a rally July 11 at the Aurora Municipal Complex by supporters of an unarmed Black man shot by police turned into a repeat of the scene that unfolded July 8, with protesters shouting down conservatives during a town hall at the nearby venue.

Aurora City Councilmember Stephanie Hancock’s town hall meeting for her constituents in the Maya Angelou Auditorium of the Colorado Early Colleges building was brought to a halt by a column of protesters who entered the room about an hour into the event with their hands raised, chanting the name of Kilyn Lewis.

After telling protesters to sit down, which they did not do, Hancock walked out of the meeting along with Councilmember Dustin Zvonek and most of the crowd who had come to take part in the town hall meeting.

Demonstrators remained in the building for about 15 minutes, continuing to chant Lewis’ name as well as, “If we don’t get it, shut it down,” and, “Up with the people; down with the police.”

“We have to stand up in groups and in numbers to all of this,” Kiawa Lewis, brother of Kilyn Lewis, told protesters after they had left the building and gathered in the parking lot.

“As long as they keep getting away with this, it’s going to be a civil war, and it’s going to be good against evil, and we’re gonna outlive it. I’m simply saying that if we’ve got to stand up and start going against the people that want to protect us, it’s going to happen.”

“We want justice. And we want Michael Dieck up under the prison. We ain’t talking about no slap on the wrist. We ain’t talking about no 25 years. We’re talking about 45 to life with no parole,” Lewis’ mother, LaRonda Jones, told the group.

Dieck’s decision to fire his weapon is under investigation currently by the 18th Judicial District’s Critical Incident Response Team, which has the power to recommend criminal charges, as well as APD’s Internal Investigations Bureau.

Directing demonstrators Thursday were former Denver Public Schools board member Auon’tai Anderson and Aurora activist Candice Bailey.

Anderson has stepped into the role of the communications director for the Justice for Kilyn Lewis Action Committee, a group that Bailey, who serves as committee chair, said also includes a coalition of 27 organizations across the country that have expressed their support.

“We must get up, because next, it may be one of our children, and we will be chanting their name,” Bailey said to the 70 or so protesters after they exited the school.

“There’s a commonality between Kilyn and the police, because guess what? Neither one of them are having a day in court. One because of a corrupt system, and the other because of a corrupt system.”

Hancock moved to prevent protesters from speaking during the July 8 city council meeting, at which point those present disrupted the meeting, and the council’s conservative majority relocated to a nearby room to finish the night’s agenda.

Hancock also referred to the group, which included members of Lewis’ family, as “bullies,” “provocateurs” and “terrorists,” labels that protesters mocked Thursday.

“You can continue to insult us, but we will show up to every single meeting,” Anderson said. “We came to their meeting on Monday, and all we wanted to do was talk to them. … We made sure she understood (that) you can’t continue to run from community.”

Anderson said the group will continue to host “weeks of action” coinciding with weeks when the Aurora City Council hosts its regular meetings and study sessions.

Vaping: Aurora, other Colorado schools get Juul lawsuit settlement money for prevention

Twenty-one Colorado school districts, seven charter schools, one cooperative education services board, and one youth residential treatment center have been awarded $11.4 million in funding over the next three years for vaping education and prevention programs.

The money comes from a $31.7 million settlement between the state of Colorado and e-cigarette manufacturer Juul Labs Inc. Colorado sued Juul in 2020, alleging that it targeted youth with deceptive marketing and played down the health risks of vaping. In settling the lawsuit, Juul did not admit any wrongdoing.

Colorado is poised to spend the bulk of the settlement money on a $20 million grant program aimed at improving children’s mental health. But the state is also giving smaller grants directly to school districts, nonprofit organizations, and government entities.

Colorado Attorney General Phil Weiser announced the recipients of the smaller grants in a press release Tuesday. The school district and school recipients include:

CSU study: Classroom ‘churn’ diminishes third-grade reading scores

Classroom “churn” — when students leave a classroom midyear or new students join — can have a negative effect on third grade reading scores, according to a new study that examined Colorado census and state standardized test data.

The study, by researchers at the Colorado Futures Center at Colorado State University, found that higher classroom churn was correlated with lower third grade reading scores, based on data from 2019. It’s a trend that the center’s executive director and lead economist, Phyllis Resnick, suspects has ramped up since that year, as schools experience higher levels of chronic absenteeism after the pandemic and struggle to make up for lost learning.

After the study revealed that finding, Resnick said she spoke to one teacher who had 40 different students cycle in and out of 20 seats in her classroom in a single year.

“Every time you have a new student, you have to take a step back and assess where that student is and then integrate them into the classroom,” Resnick said.

“It’s not easy to be a kid who’s bouncing in and out of schools,” she said, “but it’s also a challenge for the kids who are consistently in the classroom.”

Classroom churn was one of many factors examined in the study, called “Social Factors of Academic

Success.” The research, Resnick said, grew out of a question from CSU officials: What policies can Colorado adopt to help students be more prepared for learning after high school, whether that’s at a college campus, a vocational training program, or a job site?

Resnick doesn’t specialize in education research, but she said it quickly became clear that early intervention, or policies with the potential to impact young students, would be most effective.

With a team well-versed in figuring out the impact of different socioeconomic, demographic, and community health factors, she and the other researchers set out to determine which of those factors most affect third grade reading scores in Colorado.

Many of the findings were unsurprising. For instance, the team found that the more funding a school had, or the more access to early childhood education a community had, the higher its students’ third grade reading scores.

The finding about classroom churn stood out as more interesting, Resnick said. To calculate it, the team used data collected by the Colorado Department of Education on student mobility, plus scores from the state’s third grade standardized reading and writing test.

When stacked up against all the other factors, classroom churn ranked third among the factors most closely correlated with third grade reading scores, behind students’ household income and whether their parents have college degrees. Other classroom factors, including class size and teacher pay, did not correlate with third grade reading scores, the study found.

As Resnick has shared the findings informally with elementary school teachers and principals, she said many of them have acknowledged that churn can be difficult. But they said they never thought of it as a problem that could be solved by policy. Instead, Resnick said, they thought of it as something that would always be there. She described it as “the air they breathe.”

The study makes several policy recommendations to address classroom churn, including providing more support in classrooms with high churn or having teachers “loop” with the same cohort of students year after year to provide some level of stability.

Housing instability is often a root cause of classroom churn, and while it may be difficult for schools to affect housing policy, the study suggests that states shore up their school records transfer systems so teachers know the academic histories of students who arrive midyear.

Now that the study has been released, Resnick hopes to find the funding to take it on the road to discuss the findings and potential policy solutions with educators across Colorado.

“We see this as the beginning to frame a conversation,” she said.

Police asking public to help find hit-andrun driver after Aurora fatal pedestrian crash

Police are asking for the public’s help in identifying a car and driver involved in a fatal hit-and-run pedestrian crash July 13 in the morning in south Aurora.

The crash occurred at about 9:30 a.m. at East Hampden Avenue and South Uravan Street.

An unidentified man struck by a blue sedan was taken to a nearby hospital, where he died from his injuries.

Police did not release details about how the man was struck by the car.

Police said the suspect’s car appears to be a mid-1990s Pontiac Grand Am sedan with no front license plate.

The car “should have passenger side damage including a missing passenger side view mirror,” said police spokesperson Joe Moylan. “The vehicle was last seen heading eastbound on Hampden from the scene.”

The intersection was closed for a few hours and then reopened after investigators cleared the scene.

No suspect information was available.

“We are asking the community to please call 911 if they see the suspect vehicle,” Moylan said.

HOW OLD IS TOO YOUNG TO RIDE A BIKE, AND HOW OLD IS TOO OLD?

When Michael Natividad learned to ride a bike at 7 or 8 years old, he knew his training wheels were ready to come off when he leaned on them while zipping around corners.

His daughter, on the other hand, was barely 3 when she sped away from him on her tiny bicycle, he said, admitting to feeling a bit robbed of a special moment.

“I kept thinking of that opportunity holding her up, but I did it for all of maybe one minute,” said Natividad, of Rohnert Park, California. “I was looking forward to that for three years.”

A big difference was that Loralani, now 4, never used training wheels. Instead, like an increasing number of children, she had learned to ride a balance bike first, at around 2.

Balance bikes look like miniature bicycles without pedals. An adjustable seat can be lowered for children to put their feet on the ground. Some models come with attachable pedals, so kids can use them as their first real bike when ready.

Now, as some companies market balance bikes for children as young as 8 months old, the question is, at what age

should kids learn to ride a bike?

Annie Pezalla, a professor of human development at Macalester College in St. Paul, Minnesota, said the 8-month marker “raised my eyebrows” but she saw the logic behind the claim. That’s because the part of the brain largely responsible for coordination, the cerebellum, goes through a huge growth spurt from about 6 to 8 months.

Still, Pezalla recommended caution. Rather than a particular age, she said, it is more important to consider milestones that occur at different times for different children, such as holding their head up on their own and taking a few steps while grasping onto something.

“Once those milestones have been reached, then I think it’s the perfect time to get on one of those balance bikes,” she said, noting they usually happen between 9 and 18 months.

She added the caveat that early attempts should be made in a very safe space, like a carpeted room.

Pezalla said training wheels are going out of style because they don’t teach proprioception, the body’s ability to understand where it is in space. It’s what allows

one, for example, to walk without thinking about each step. So when training wheels come off, kids have to relearn how to balance.

Research also shows that children who start with balance bikes get a leg up, said Cristiana Mercê, a sport sciences professor at Santarém Polytechnic University in Portugal. Over five studies published on balance bikes, Mercê and her team have demonstrated that balance-bike users learn to ride regular bikes in less time, and up to two years younger, than peers using training wheels.

Bikes with training wheels are too large for most young children. Balance bikes offer the chance to explore many behaviors that training wheels don’t, such as pushing with both feet, one foot, and gliding without pedaling, she said.

The variety of movements makes it easier to transition to a traditional bicycle, Mercê said. “You can balance without pedaling, but you can’t pedal without balancing.”

But the guidance hasn’t been updated since 2011, years before balance bikes became more popular.

Deferring to the AAP’s age range, Pezalla said the transition to a pedal bike will probably occur as a natural progression with little instruction. At first, children straddle and walk with the balance bike, then sit and walk and finally, run, sit and glide.

“It should go in stages with no expectation that, gosh, an 8 month old is going to be gliding on this thing,” she said.

After that, the gap between gliding and pedaling is negligible, Pezalla said, noting that she wishes she would have known to teach her 10-year-old twin boys to ride with balance bikes. Learning these motor skills early conveys several benefits that transcend a new way to get around.

“It represents a deal of independence and self-confidence in a way that’s not possible any other way,” she said. “And I think teaching kids how to ride a bike earlier has all sorts of benefits, not only to their coordination, their balance, but their sense of self-confidence and agency as well.”

The American Academy of Pediatrics’ bicycle guidance doesn’t specify an age, instead saying most kids learn to ride at their own pace between 4 and 7. It explicitly warns against “purchasing a larger bike for the child to ‘grow into.’”

WHEN RIDING A BIKE IS NOT ‘JUST LIKE RIDING A BIKE’

At least I didn’t break my face. That’s pretty much all I was looking for from my first bike-riding lesson at Treads Bicycle Outfitters in Aurora, far from where I live. (I wanted no one to know my secret shame.)

I’m in my 20s, and I don’t know how to ride a bike. I grew up in South Texas, where the climate is ideal for staying indoors. In November, the temperature still hovers in the low-90s with typically 50-60 percent humidity. So you can imagine what the weather is like in summer, when most kids here embrace their handlebars and hit the paths.

It also probably doesn’t help that my family was kind of poor. I never felt like I was missing out on anything. My parents provided plenty to eat, a safe place to live, toys and I always got killer hand-me-downs from my older sisters (who definitely have a better sense of style than I do).

But I also knew to never ask for anything that cost more than $100. Not that my parents wouldn’t have worked their butts off to get me something I really wanted, but I knew we couldn’t afford anything big so I never asked. And honestly, biking was never something I felt like I was missing out on. In my mind it was like walking really fast, but on two dubiously teetering wheels. And I was in no rush to get anywhere, so why bother?

Now I’m in a state with gorgeous views and killer weather and health nuts on every corner. Side note to all the restaurants selling gluten-free corn tortillas to impressionable Coloradans: That’s not a thing, most corn tortillas are already gluten-free.

Anyway, I called up Treads and asked the most embarrassing question of my journalism career: Can you teach an adult how to ride a bike?

There was a pause and then a chuckle. “We don’t typically offer bike lessons, to children or adults, but we can help you out.”

Gravy. I was on my way to being a near-native Coloradan.

So I stopped by on a blissful autumn day, sneakers on my feet and butterflies in my stomach. I don’t do well in scenarios where I don’t know what I’m doing with 100 percent certainty.

I was greeted by Treads’ veteran bike guru Gene Hodges, who has been in the bike business longer than I’ve been alive. He would be guiding me in my evolution to becoming a two-wheeler.

“You’re small.”

Yes, Gene, I am small, but my feet do touch the ground when I’m standing. My stature and my ability to keep my feet on the ground would later prove to be an issue.

We started off with the basics: putting on a helmet and getting it to fit right, and pedaling.

Bicycle seats suck. All this money and technology and I have to sit on an anvil? What the heck, Cannodale? It didn’t feel too uncomfortable at first but, admittedly, my butt was a not happy in the days that followed.

Gene set the bike onto a stand that kept the wheels stationary as I mounted and got a feel for the pedals. He put the seat as low as it would go, but my sneakers barely grazed the floor when they needed to. Alas, being 4-feet11-and-almost-one-half-inches tall would prove to be difficult in this saga.

Pedaling was quite fun. It was relaxing. Like a mechanical dance.

The relaxation abruptly ended, though. We took the teal Cannondale outside and found a nice covert spot in a parking lot behind some businesses.

The first thing Gene helped me figure out was how to turn in the direction I felt like I was leaning. A counterintuitive move, but not unlike turning a car when you’re hydroplaning. He held the bike from the back and leaned it to the left, to the right, to the left, over and over again as I turned in the correct direction with the handlebars.

And then things got awkward.

You know those super cute photos of dads pushing their 5-year-olds on their first big-kid bike with some fall foliage in the background and a happy grin on the kid’s face? Yeah,

it’s a lot less endearing to do that as a 20-something with a strange man. OK, not strange, Gene was actually very nice and friendly, but it was still awkward on top of awkward. Gene held the bike from the back as I attempted to pedal and balance this metal beast. While for most people, it’s just like riding a bike, for me, it’s just like doing a million things at once and none of them right. Poor guy was huffing and puffing after a few runs because this was an adult-size bike and I’m an adult-size human he was helping hold up (OK, my weight and height make me more the size of a 12-year-old boy, but still much heavier than a tot).

I skidded a lot because any time I felt off-balance I turned the wheel and used the brake because I had no desire to munch pavement on a bike Gene had graciously loaned for the lesson. It was a work in progress to say the least. A brief shout-out, here, to the employees who were taking a break in the parking lot and witnessed my cycling struggle. One particular man kept giving me words of encouragement, like a dad cheering on his kid at his first Little League game. I’m not going to lie, I needed that. Eventually, we came to the conclusion that I needed to 1. Try balancing on grass first and 2. This bike was too tall for me to learn on. So we ended up trading the teal big-girl bike for one intended for adolescents. Cool.

I rode down a grassy incline with my feet off the pedals, focusing on balancing. I felt much more self-assured because my feet could completely touch the ground if I felt unsteady. Also, it wasn’t pavement, so I felt better about the prospect of falling.

At the end of the lesson, I still couldn’t ride a bike with the confidence and balance of an energetic, granola-munching Boulderite, but I think I managed to ride for a solid 10 seconds without Gene holding onto the bike, and that was good enough for me.

I think I’ll roll with it.

Arapahoe County Fair Returns for 118th Year

It’s time for mutton bustin’ and county fair glutton.

Arapahoe County announces the 118th annual Arapahoe County Fair, running Thursday July 25 through July 28.

This long-time tradition highlights the county’s rich agricultural and Western heritage through a variety of 4-H programs, educational activities, and entertainment for all ages.

And it offers fun for the entire family.

Admission to the fair is $25, and children under 36 inches tall get in for free. The ticket price includes parking, unlimited carnival rides, rodeo tickets, fireworks (weather and fire restrictions permitting), live entertainment, NSPA truck and tractor pulls, the Canine Stars Stunt Dog Show, mutton bustin’, public competitions, Top Hogs pig racing, line dancing lessons, a petting farm, 4-H livestock shows, and the Kids Corral, along with a long list of other events and activities.

Fazal Sheikh: Thirst | Exposure | In Place is an exhibition created from three projects photographer Fazal Sheikh made on the Colorado Plateau from 2017 to early 2023. Sheikh’s portraits and landscapes shed light on the far-reaching consequences of extractive industry and climate change.

LOW TECH Aurora city court system faulted for understaffing and flailing computer systems

Aurora’s municipal justice system lacks the prosecutors, public defenders and administrative staff needed to handle the volume of cases that end up in court, according to a study completed by the National Center for State Courts and published last week.

In March 2023, the Aurora Municipal Court contracted with the center, which evaluated the different types of cases handled in municipal court; the amount of time spent on cases, broken down by the type of case and employee; and the relationship between the workload and number of employees in each office controlled by the city.

Among other conclusions, the study’s authors found that “every position analyzed does not have enough (full-time employees) to process the current workload.”

They estimated the court would need to bring on about 10 prosecutors, three public defenders and three courthouse employees to promptly process cases.

“All departments did have a staffing deficit,” Court Administrator Candace Atkinson said during the July 11 meeting of the council’s public safety committee, where the center’s findings were presented and discussed. “As we improve our case management systems, that’s likely to shift a little bit, but that’s

where we were as of the time of this study.”

The findings of the study were included in the agenda packet for Thursday’s committee meeting. Besides highlighting the shortage of employees, the study’s authors also raised concerns about the court’s antiquated system for sharing and managing case information, writing that “the case management system, reliance on paper files, outdated technology and equipment significantly impact court operations.”

Court staffers described their efforts to move toward electronic recordkeeping during a council study session Monday — information technology manager Kyle Peterson told the council that the court is currently in the process of “going fully paperless.”

In response to a survey included in the study, attorneys and other employees of the municipal justice system expressed frustration with how entities handled case files, with all offices but the Public Defender’s Office using paper records.

“Because there are so many steps and staff involved in creating a paper case file, locating the file can take hours, depending on where it is in the process,” the study states. “Scheduling a case is not linear and requires multiple back-and-forth conversations between offices. Handwritten notes on the paper files are also hard to decipher, adding to case processing time.”

An outdated operating system used throughout the court is, apparently, another source of problems.

“The court’s database is locally run via an antiquated DOS system. If multiple programs run simultaneously, computers crash, and work is lost,” the study’s authors wrote.

Staffing problems that survey respondents blamed in part on sub-par pay and benefits were also cited as contributing to “delayed dispositions.” Atkinson did not describe and council members did not ask about case delays caused by the problems described in the study.

The study’s release also comes as the council considers handing off to counties all domestic violence prosecutions in the Aurora Municipal Court, a category of cases that the study said represents about 5% of all cases filed as well as 29% of the time spent on all cases by prosecutors and 51% of time spent by public defenders.

Council members who attended the committee meeting questioned the extent to which the findings could be used to model what workloads might look like if the city halts the prosecution of domestic violence.

While the study’s authors indicate that such a study should be redone when “factors affecting the study change significantly,” Atkinson said the city could simply subtract the cases and associated investments of time from the data provided.

In response to a suggestion from chief public defender Elizabeth Cadiz that the city invite the National Center for State Courts to weigh in at a study session about how ending domestic violence prosecutions would impact the workload model, Atkinson said she did not think it was necessary and that “they made sure to give us the tools (so) that we could do it ourselves going forward.”

Councilmember Danielle Jurinsky, who chairs the public safety committee, said she agreed that what the court had gotten from the center was sufficient.

She also indicated that the city will be ending its prosecution of domestic violence, despite the fact that council conservatives voted Monday to direct city leadership to come up with a plan for doing so that was framed by supporters as an exploratory step.

“It’s literally ‘when’ we get rid of (domestic violence) cases. It’s no longer an ‘if,’” Jurinsky said.

The city has yet to reach an agreement with overlapping counties on how those cases would be handed off, with Arapahoe and Adams counties both warning that they lack the resources to handle Aurora’s domestic violence caseload.

Raptors three-peat at Hog Wars

EAGLECREST STRETCHES LENGTH OF RULE OVER RANGEVIEW’S ANNUAL TEAM STRENGTH AND TEAMWORK COMPETITION TO THREE YEARS WITH DECISIVE WIN

The Eaglecrest football team has long relied on its strength in the trenches during the season.

For quite some time, the Raptors have fielded one of the Aurora area’s most physical groups on the offensive and defensive sides of the ball, and the early returns make it appear likely that will again be the case for the upcoming 2024 season.

Eaglecrest flexed its considerable muscle again July 10 on its way to a third consecutive victory at the annual Hog Wars strength and teamwork competition hosted by Rangeview High School. The Raptors — who have a new head coach this season in Jesse German, who was at Green Mountain previously — racked up 48 points from seven events to finish easily atop a field of five teams.

The winning team was comprised of holdovers from last season’s victory in seniors T’Mario Walters and Branden Replogle and junior Parker Hocker along with senior Jack Waugh and juniors Noah Fulgham, Javon Jones and program newcomer AJ Sosef.

Pomona, the only non-Aurora area team that was invited, edged the Vista PEAK Prep team of Cody Morris, Ethan Hay, Jeremiah Bustamante, Jason Harvell, Matt Morales, Kahlel Willis and Dominic Linderman by two points for second place (33 to 31). Like Eaglec

tearest, the Bison are also under new leadership this season with Mike Campbell, who came over from Englewood in the offseason.

Coach Chris Dixon’s host Rangeview team accrued 21 points to finish fourth and Smoky Hill’s 19 points put it fifth. Different from years in the past, each program had just one team instead of multiple groups.

This season, the event consisted of competition in an obstacle course, log press, farmer’s

carry, sled push, monster truck tire flip relay, tug-of-war and firetruck push.

Eaglecrest is the only multiple-time champion in the history of the Hog Wars event — which began back in 2005 under longtime Rangeview coach Dave Gonzales — as the host Raiders own 11 titles. Gateway (2011), Overland (2012), Cherokee Trail (2013) and Vista PEAK (2019) also have won the event.

Cougars flex at Columbine

Cherokee Trail did not participate in Hog Wars this year, but coach Justin Jajczyk’s team did work elsewhere.

On July 12, the Cougars headed to Columbine High School — home of the defending Class 6A state champions — with two groups and did well with both despite sweltering conditions in triple-digit temperatures.

Cherokee Trail’s younger mix of mostly juniors and sophomores earned the championship of the 10-team competition, while the older team — which was junior-heavy — won the relay race and placed in the top five of most events on their way to fifth place. The Cougars were in position to place as high as third but had to push a pickup truck full of large-sized Arvada West lineup that ended up posing some difficulty.

“It was a really good day overall for our guys,” Jajcyzk said. “The big guys are where games are won and lost, so that’s big.”

The city of Aurora will open applications for the 2024 summer round of the Community Investment Financing Program at 8 a.m. MST, Monday, July 29, 2024. The purpose of the Community Investment Financing Program is to provide financial resources for developers interested in creating and/or preserving affordable housing opportunities in Aurora. Applications will be evaluated based on alignment with the policies and goals of the Aurora Housing Strategy found at AuroraGov.org/HousingStrategy. It is expected that applications for the Community Investment Financing Program summer 2024 round will be extremely competitive. Not all applications will receive awards.

The following funds are made available for developers to support the city’s housing goals included in the Housing Strategy for the summer 2024 round. If applying for multiple funds, developers must submit a

separate application for each fund.

Obituary

Isabelle Rose Schuckman

Isabelle was born into a family of 13 children: 11 girls and 2 boys, on a farm in Pfeifer, Kansas to her parents, Anthony and Regina Jacobs. From an early age she learned the value of hard work and developed a lifelong faith in the Catholic Church. She graduated from Schoenchen High School in 1956. She married Robert Martin Schuckman in June of that year, and they moved to Denver with a few hundred dollars in their pockets. Their marriage, which produced 6 children, lasted nearly 65 years until Robert died February 11, 2021.

Growing up on the farm, her family learned to work together, play together, and sing together. This closeness lasted their entire lives. Isabelle said her biggest blessing was her 6 children. She was also blessed to have 18 grandchildren, 25 great-grandchildren and 1 great-great-grandchild.

She was multi-talented in many areas. She took pride in everything she created as a seamstress and avid quilter. She made many outfits and quilts for family and friends. To give thanks on her 80th birthday she made 80 small “comfort quilts” for babies in Children’s Hospital. She was a self-taught musician. She enjoyed playing the guitar, banjo and piano. Music could always be heard in her home. She always took fastidious care to make sure it was comfortable for her family and visitors.

She was also an avid sports fan, especially of baseball. Her favorite player was Joe DiMaggio. She enjoyed visiting numerous Major League stadiums. She was always the official scorekeeper for all of her sons’ baseball games.

She had a keen interest and appreciation for numbers. She used this same attention to detail when it came to business. She and Bob established and successfully operated Schuckman’s Plumbing and Heating for 35 years from 1974-2009.

Her community service was extensive. She was the Treasurer of Aurora Boys Baseball for 5 years, Treasurer of the Aurora Girls Track Club for 5 years and President of the Knights of Columbus Auxiliary for 5 years. In 2001-2002 she was named Lady of The Year by the Knights of Columbus Colorado State Ladies Auxiliary in recognition of her dedication and commitment to the charitable, social and spiritual contributions of the organization.

Surviving children include: son, Russ (Norma) Schuckman; daughters, Rebecca Dudley; Mona (Jose) Laborda; Rhonda (Jeanna Pool) Hillis; Roberta (Stan) Barnett; and son, Randall (Leiloni) Schuckman. Preceding her in death were son-in-law, Frank Dudley, grandson, Bryce Barnett, grandson-in-law, Larry Rauh, grandson-in-law, Preston Becker and granddaughter-in-law, Naomi Barnett.

Siblings: Lucille Dreher, Marvin Jacobs, Elsie Stegman, Eva Jacobs, Darlene Sander, Dolores Unrein, Rosaline Unrein (identical twin), Wayne Jacobs, Wilma Kuhn, Theresa Bieker, Carol Moeder (Arvada), Cecelia Jacobs and cousin Glen Jacobs (Chicago).

She died peacefully at St. Andrews Village Assisted Living in Aurora.

Funeral mass: Queen of Peace Catholic Church in Aurora Date and Time: Thursday, July 18th, 10:00 am Burial: St. Simeon Catholic Cemetery. Lunch to follow.
