Boebert says divorce had a hand in her groping for answers at Denver theater

Sure, all the world, other than X, is all a twitter over news that Congressperson Lauren Boebert got caught on secret tape having some serious mutual grope at the Buell Theater during a performance of Beetlejuice.

But isn’t the most shocking news here that Boebert actually went to the theater?

If you’re just coming out of a coma or a deep cave in Turkey, Boebert has been grabbing headlines this week after some on-camera mutual mammary and genital handiwork while apparently on a date at a performance of Beetlejuice in Denver last Sunday.

After the Denver Post reported she’d been eighty-sixed from the DCPA theater because of vaping, loud singing, taking photographs, and generally being obnoxious, Boebert and her staff snarkily pushed back.

“It’s true, I did thoroughly enjoy the AMAZING Beetlejuice at the Buell Theatre and I plead guilty to laughing and singing too loud!” according to an Associated Press story that ran in the Sentinel later in the week. She denied that she was vaping in the theater, dismissing the event as the result of an uptight Denver thing.

She clearly didn’t anticipate 9News using the power of Colorado’s open government laws retrieving the entire videotape of her visit to the Buell.

The tape made it clear Boebert was a vaping, selfie-snapping, hooting and wooting tyrant to those near her, including the pregnant woman behind her who asked her not to vape inside the theater. The tape also revealed that Boebert’s date spent at least some minutes motor-boating Boebert, as she threw back her arm, except for the one that kept returning to between the legs of the gentleman accompanying her.

Confronted with the irrefutable truth, Boebert said she was sorry about the vaping thing, and that, “I simply fell short of my values.”

Given Boebert has a history much like Donald Trump, whom she has repeatedly called the “best” president ever and continues to support, despite his numerous impeachments, indictments and even a court admonition for his sexually assaulting a woman and then slandering her. So it’s hard to tell which “values” she believes were misaligned with lying and public obscenity.

She’s attended many a rodeo in making clear she doesn’t cotton to gay people in public, and especially drag queens reading to children in libraries. But that was months ago, and I think a lot of us gave Boebert the benefit of doubt, given her apparent intellectual capacity, that she was more concerned about the immorality of teaching people to read more than having a guy in drag being the teacher.

We do know that she may be fine with some serious hands-on sex education for children attending the Buell theater performances, but peeing in the street crosses the line, or at least it used to.

Boebert drew similar national embarrassment and scorn to herself earlier in the year when she tried to go all Perry Mason on a congressional committee witness about crime in Washington DC.

“Did you or did you not decriminalize public urination in Washington D.C.? Did you lead the charge to do so?” she asked.

The witness, clearly unexpectedly to Boebert, said, “no.”

Unfazed, Boebert continued hammering away at DC Councilman Charles Allen, and he continued to tell her how wrong she was.

Making clear how she did not value people whipping it out in the streets of DC, she immediately brought media scorn on herself, or actually her ex-husband-in-waiting, for a past criminal convictions of indecent exposure he was convicted of years ago, of which Boebert, a teenager at the time, was witness to, according to numerous media reports.

All that is now just a memory, which Boebert regularly has problems with.

She said she simply didn’t remember vaping in the theater, possibly because she was just so excited about the show and being in a new “environment.”

She apologized that the stress of her divorce pushed her away from her values.

Who among us who’ve undergone divorce can’t acknowledge the stress inflicted by divorce and are simply thankful we never found ourselves in Buell watching a musical with a vape pen and a date?

She did not, apparently, apologize for violating state public decency laws, which, under C.R.S. 18-7-301 includes public sexual intercourse, intentional exposure and lewd fondling.

well-documented case does not appear to be any kind of medical resuscitation, oddly timed physical therapy or simply theater patrons clumsily looking for list items in dark theater. It meets the definition of lewd, but so far, Denver Police and district attorney officials haven’t responded to queries by the Sentinel or other media as to whether a crime was committed, on tape, and whether Boebert or her date will be charged.

Under Donald Trump standards, adopted by numerous states and a vast number of Congressional Republicans, it’s not a crime to lie, like Boebert did when, being hustled out of the theater by Buell staffers, she first ask them if they “know who I am,” and then told them that she was “on the board,” and would be contacting the mayor.

Boebert is not a member of the board of directors of the Denver Center for the Performing Arts.

Which brings us back to my initial wonderment. Boebert rarely misses on opportunity to mug with a gun strapped to her leg, berated “Tic Tacs” after a congressional hearing about “Tik Tok” and once pushed back against paid parental leave and said she gave birth to one of her four children in the front seat of a pickup truck, “because as a mom of four, we got things to do.”

What was she doing at the Buell with a loaded vape pipe, and four hands a boyfriend set on automatic?

Perhaps, confused, she thought Beetlejuice was an adult show, and the Buell, being in a place we call “Downtown Denver” was the kind of theater that would offer shows that “fell short of my values.”

Or not.

2 former APD officers face trial for their choices as cops

The police bodycam video, the voluminous police reports and ultimately, the results of a grand jury investigation and indictment have long evaporated any doubts that Aurora police and firefighters caused the death of Elijah McClain just over four years ago.

Despite that, the police and firefighters charged with McClain’s death will certainly give a passionate argument in their defense as their trials, finally, get underway this week.

Jurors will decide whether former APD officers Randy Roedema and Jason Rosenblatt committed manslaughter, criminally negligent reckless homicide and other assault charges.

Not on trial this week is the Aurora Police Department. That trial opened and closed more than a year ago when the state attorney general determined “patterns and practices” exhibited for years by the APD. The department was convicted of police officers systematically abusing people, using excessive force, especially when dealing with people of color.

The Aurora Police department was found guilty and is still working out terms of its parole.

While the employer of Roedema and Rosenblatt were responsible for creating an environment for these two cops to carry out their crimes against McClain, these officers, and others charged, solely bear responsibility for McClain’s death.

As police critics and proponents have frequently pointed out, the Aurora Police Department is filled with diligent, dedicated police officers who deserve the community’s respect and gratitude — despite working for a department that did virtually nothing to prevent nor discipline officers for the depravity inflicted on McClain.

In fact, after an initial internal investigation, Aurora police determined that the officers accused were justified in how they eventually killed McClain.

It took two years after McClain was killed for a 32-count indictment handed down to Colorado Attorney General Phil Weiser to illustrate how Aurora police wrongly accosted McClain while he was walking home at night from a convenience store.

Years of investigation from inside and outside the Aurora police department have made it clear that McClain was targeted and tortured by police because he was a young Black man in a poor neighborhood.

Despite doing nothing wrong nor illegal, police pounced on McClain, attacked him as they tried to wrongly subdue him and choked him into unconsciousness as he struggled, petrified that he was about to be killed.

Incompetent and complicit fire department medics then injected McClain with ketamine, a powerful tranquilizer, even after he’d been subdued with a chokehold and fainted.

Misjudging his weight, they injected McClain with too much of the drug for his size. His heart stopped, and he died a few days later.

Despite investigations making clear how the events of that night led to and caused McClain’s death, neither the Aurora police department nor the 17th Judicial District Attorney found evidence that a crime had been committed and warranted prosecution, or even discipline.

The case this week is against two officers who acted inappropriately from the moment they rolled onto the scene and encountered McClain walking home on a summer night, carrying a plastic bag with cans of iced tea he’d walked to the end of the street to buy from a convenience store. Police were not looking for a crime suspect. No crime had been committed.

A passing motorist called police to say something seemed wrong about McClain because he was wearing a runner’s mask, something he regularly did.

Had Roedema and Rosenblatt have just harassed or only injured McClain while accosting him, it’s nearly certain no one but McClain and his family would ever have known about the patently abusive attack.

But not only was McClain’s treatment by police and firefighters so abusive, it was lethal.

And in this case, each officer and medic had the opportunity to draw back on the abuse as it unfolded, and each officer and medic chose to escalate the event. They chose to inflict the injuries on McClain that ultimately robbed him of his liberty, his dignity and then his life.

The trial starting this week isn’t about errant policing or making mistakes under pressure. It’s about deliberating choosing to be deadly abusive, and the public seeking justice for the crimes individual police and medics committed.

Things I’ve never done

Afew days ago, my wife and I were taking our evening almost-senior-citizen power stroll, and the subject of Hooters came up. Yes, Hooters. And I’ll tell you why (even if you wish I wouldn’t).

We were having a good laugh because someone on Facebook had suggested that our local and recently-shuttered Bed Bath & Beyond store might become a giant Hooters. (Pretend you didn’t read those last two words together.)

It was at that point I realized and proudly confessed to my wife that I’ve never visited a Hooters restaurant. My self-righteous gloating was soon silenced, though, when my wife announced, “Well, I have. It was a long time ago, and I was on a business trip. It obviously wasn’t my choice.”

I was stunned, not so much that my wife had been served owl tacos, or whatever it is they have at Hooters, but that she had done this stereotypical “man” thing that I’d never done – and really have no desire to do. (I mean, who eats owls?)

That got me thinking about other things I haven’t done in my 50-something-year-old life, so I made a list (even if you wish I wouldn’t).

1. I’ve never been duck hunting. My father-inlaw did take me deer hunting once–back when I was dating his daughter and he was still trying to decide whether or not to let me live. Duck hunting actually sounds kind of fun, except for the getting wet, getting cold and getting up before noon on a Saturday parts.

2. I’ve never been to an escape room. However, I experience something like it every night when I try to find my way to the bathroom half asleep in the dark.

3. I’ve never been to a NASCAR, Formula 1, or drag race. I have given all three of my daughters driving lessons, so I’m good.

4. I’ve never watched “Game of Thrones.” (See number 2.)

5. I’ve never been fly fishing–unless you count those times I’ve been sitting in a meeting at work and discovered, to my horror, that my pants were unzipped.

6. I’ve never been axe throwing. I did abuse some pine trees with those ninja throwing stars as a kid, though. (I grew up during the 1970s and 80s when parents still allowed kids to eat highly processed meats and play with sharp objects unattended.)

7. I’ve never played “Call of Duty.” (See number 2.)

8. I’ve never been to a Taylor Swift concert, and I’d really like to go. I’m actually on a waiting list for tickets to an upcoming concert in New Orleans, but I think it’s more of a “you sad, sad man who will never get tickets and shouldn’t want them” list.

9. I’ve never played pickleball. I’m not exactly sure what it is, but if it involves food eaten with pickles (or food of any kind), I’m in.

10. And speaking of eating, I’ve never had cauliflower-crust pizza. I’ve tried to eat raw cauliflower, which reminds me of eating a candle, and I eat my own weight in pizza about once a week. (See number 2.) But I really believe in keeping my food groups separate, so I think I’ll pass.

So, there you have it. Now that I’ve gotten all of this off my chest, I know I’ll sleep better – if I can find my way back from the bathroom.

4 YEARS AFTER ELIJAH MCCLAIN DEATH AND AURORA TURMOIL, TRIAL BEGINS AGAINST COPS

lijah McClain’s fatal encounter with police began on a summer night in 2019 when a 911 caller reported that the young Black man looked “sketchy” as he walked down the street wearing a ski mask and raising his hands in the air in Aurora.

In reality, McClain, who was often cold, was just walking home from a convenience store, listening to music.

But moments later, police stopped him and after struggling with him, put the 23-year-old in a neck hold. Then paramedics gave him a sedative that officials eventually determined played a key role in his death days later. McClain, a massage therapist known for his gentle nature, was unarmed and hadn’t committed any crime.

Four years after his death — which left a gaping hole in his mother’s heart and sparked outrage over racial injustice in American policing — a trial for two of the officers was set to begin Friday with jury selection. Trials for a third officer and two paramedics are scheduled to start later this year.

While officials from inside and outside Aurora point to a host of tragedies, missteps and outright crimes committed by police as reasons why police reform has been imposed by state officials, the McClain death stands out.

A jury will decide if officers Randy Roedema and Jason Rosenblatt are guilty of manslaughter, criminally-negligent homicide and assault

Echarges in a trial expected to last about a month. They have pleaded not guilty but have never spoken publicly about the allegations against them.

Roedema, a former Marine who is currently suspended without pay, had been with the department for five years before McClain’s death. Rosenblatt had worked for the agency for two years and is the only officer who confronted McClain who was fired — not for the fatal encounter itself, but for making light of other officers’ reenactment of the neck hold.

Their attorneys — Donald Sisson for Roedema and Harvey Steinberg for Rosenblatt — didn’t return requests for comment.

The officers were indicted in 2021 by a state grand jury after an outcry over McClain’s death following the police killing of George Floyd. McClain’s pleading words captured on body camera, including, “I’m an introvert and I’m different,” drew widespread attention after Floyd’s murder in Minneapolis.

The grand jury indictment came nearly two years after a local prosecutor decided against prosecuting the officers largely because the coroner’s office could not determine exactly how McClain died. He called McClain’s death “tragic,” but said that finding made it hard to prove that the officers’ actions caused his death.

A revised coroner’s report issued in 2021 said the cause of death was complications from the ketamine but also noted that that occurred after McClain was forcibly restrained. Pathologist

Stephen Cina wrote he couldn’t rule out whether the stress of being held down by the officers may have contributed to McClain’s death.

McClain, who weighed 140 pounds, was given a higher dose of ketamine than recommended for someone of his size and overdosed, Cina found. McClain was extremely sedated within minutes of being given the ketamine, wrote Cina, who said he believed McClain was gasping for air when he was put on a stretcher.

His death brought increased scrutiny to how police and paramedics use ketamine. It is often used at the behest of police who believe suspects are out of control.

Sheneen McClain, Elijah McClain’s mother, declined an interview request ahead of the trial but has long called for the officers who stopped her son to be sent to prison. She and McClain’s father, LaWayne Mosely, sued Aurora and reached a $15 million settlement with the city.

Experts say the case against the officers is far from a slam dunk.

With ketamine blamed for causing McClain’s death, it will be difficult for prosecutors to convince jurors that the police officers are responsible for his death, said Hermann Walz, a defense lawyer and former prosecutor and adjunct professor at John Jay College of Criminal Justice.

“They don’t have a direct link for the police. They might have a better case against the EMTs,”

he said.

But Jonathan Smith, who helped conduct the Aurora investigation and is a senior special counsel for the Washington Lawyers’ Committee for Civil Rights and Urban Affairs, said even if they can’t prove that the officers’ actions contributed to McClain’s

death, prosecutors could still try to win a conviction on the assault charges.

Except for when officers thought McClain had grabbed for one of their guns, Smith said there was no legal justification for using force against McClain.

Like so many police brutality cases today, body camera footage from the officers played a major role in bringing to light what

happened. The officers’ cameras eventually fell off but kept recording though sometimes only capturing audio.

The video shows it starting when one of the officers — Nathan Woodyard, on trial later this year — gets out of his car. He approaches McClain and says, “Stop right there. Stop. Stop. … I have a right to stop you because you’re being suspicious.”

McClain, using earbuds, kept walking down the street, as he carried a plastic bag and his phone. Within ten seconds, Woodyard put his hands on McClain, turning him around. As McClain tried to escape his grip, Woodyard said, “Relax, or I’m going to have to change this situation.”

Then Roedema took the bag McClain was holding, containing cans of iced tea, and threw it to the ground. McClain told them he would stop the music he had been listening to to hear them while demanding to be let go.

Then came a pivotal moment that escalated the situation.

As Rosenblatt and Woodyard held McClain’s arms and pulled him toward a grassy area, Roedema said, “He grabbed your gun, dude.” But that can’t be seen on body camera footage and was never corroborated.

All three officers later told investigators that they helped bring McClain to the ground because of Roedema’s statement.

As the officers restrained him, one of them put him in a neck hold that stops the flow of blood to the brain. Paramedics later arrived and gave him ketamine, which at the time was legal to give to people showing erratic behavior.

Pinned to the ground, McClain can be heard crying out in pain, apologizing, explaining himself and pleading with the officers. He vomited and tried to explain himself — but the officers didn’t engage.

“I was just going home … I’m an introvert and I’m different. Go-

ing home … I’m just different. I’m just different. That’s all,” he said.

Later, as the officers talked to a supervisor about what happened, McClain said: “You all are phenomenal; you are beautiful. … Forgive me.”

Three days later, McClain was pronounced dead in a hospital.

Since 2020, neck holds have been banned for police in Colorado by the state’s Democratic-led Legislature. The state health department has also told paramedics not to give ketamine to people suspected of having a condition involving erratic behavior known as excited delirium.

The diagnosis of excited delirium is itself controversial, with the American Psychiatric Association and other entities questioning its validity and stating that it is disproportionately applied to Black males who have had an encounter with police.

McClain’s death became a rallying cry for police reform advocates. They hope his death can be a watershed moment that brings meaningful reform to police and serves as a warning that police brutality won’t be tolerated.

“If we just continue to sit by and allow anyone to be murdered under the guise of ‘protect and serve’, we have failed exponentially,” said Candice Bailey, a police reform advocate in Aurora. “Elijah McClain was a wake-up call for the planet.”

Cherry Creek opens school focusing on students struggling with mental health issues

Superintendent Chris Smith said it’s not unusual that families come to school needing help, whether it’s financial or for some other challenge in supporting their child’s education.

At the end of October, the district will begin “meeting the needs of kids in a way we’ve never done before.”

Traverse Academy, a unique mental health treatment facility, will open Oct. 23. District students from 10-18 years-old will be able to access intensive mental health support at the unique school.

The district will be partnering with CU Medicine’s Department of Psychiatry to serve students.

Students attending Traverse Academy will receive individualized therapy while general education teachers help them continue with their education. Students will receive nine hours each week engaging in therapeutic programming at the school, which could include individual or group therapy.

Students in need of help must be referred by their school’s mental health provider such as a social worker or psychiatrist before undergoing an intake process with a mental health team.

They will stay at the school for an average of 8-12 weeks. Students will start their day at 8:15 a.m. and end at 2:20 p.m.

While parents can drop their child off at the school, the district will also provide transportation services. District spokesperson, Lauren Snell, said that the district will likely contract out a “car service” to provide transportation.

After completing the weeks-long program, students will move into a transitional phase that will help them return to their home school. During this time, students will use the tools they’ve learned to manage their mental health in a school-like structure.

Even the design of the building, from the lobby to bathrooms, takes student wellbeing into consideration.

During a media tour Tuesday morning, Kasia Bulkowski, a spokesperson for the architecture firm that helped design the building, said that the lobby was designed to look less institutional. Bathrooms and focus rooms, where students can decompress in silence, were designed with doors that can open both ways in the event of an emergency.

All the doors also have slanted handles to prevent students from injuring themselves.

Rooms also have large windows to bring in sunlight, and a variety of seating options are available for students in the multipurpose rooms and in the cafeteria. Students also have the option of eating indoors or outdoors, giving them agency over their day.

Traverse Academy Principal Kimberly Avalos said she’s seen many mental health facilities close during

her decades-long career, making the opening of this one more critical than ever.

“While the nation was recognizing we had a problem, there weren’t a lot of solutions. Our taxpayers and our board of education sent a very different message to kids, and we said ‘you’re important. We want you here and the world is better with you in it,” Avalose said.

Traverse Academy was initially funded through a bond approved by voters in the 2020 election. After the project went over budget, the district was able to continue construction with the help of $1.5 million in federal money.

Last December, the board of education chose to name the facility Traverse Academy.

“This name is a nod to the four great Traverses in Colorado mountain climbing, representing the obstacles to be overcome to move from one great peak to the next,” board documents said.

Aurora gets $5 million from U.S. government for tree planting

A $5 million program to plant and maintain trees in Aurora neighborhoods with large immigrant populations kicked off Thursday with a Chinkapin oak sapling planted outside of Moorhead Recreation Center.

U.S. Deputy Secretary of Agriculture Xochitl Torres Small and a handful of state and local officials heaped dirt on the sapling to commemorate the more than $22 million in grants awarded to Colorado municipalities by the federal government to provide shade and improve quality of life in disadvantaged areas.

Torres Small spoke about her childhood in New Mexico, where, like in Colorado, summer temperatures can climb into the triple digits. She described providing and preserving lush tree cover for neighborhoods like the diverse community north of Montview Boulevard as a way of promoting equity across the city.

“When you have a canopy of trees, it can reduce the temperature (by) between 11 and 19 degrees,” said Torres Small. “Trees do a lot more than that, as well. … The community investment in trees is really a community investment in each other.”

City spokesman Michael Brannen later said the city originally applied for a grant of about $7.5 million to plant an estimated 6,000 trees and that city staffers were calculating how many trees could be planted with the final award of $5 million.

Mayor Mike Coffman — who attended the event at Moorhead along with council members Alison Coombs, Juan Marcano and Ruben Medina — said Aurora’s forestry team is responsible for close to 54,000 trees, nearly half of which are in poorer areas of the city.

“These areas with high immigrant and refugee populations are also the same areas with the oldest most valuable trees,” Coffman said. “This is a tremendous opportunity for Aurora to promote equity, en-

hance the urban forests, improve public health and foster environmental resilience.”

Representatives from the Colorado State Forest Service were also present for Thursday’s ceremony. Director and state forester Matt McCombs said the state has been working with the U.S. Forest Service for decades, planting millions of trees, but that the allocation of money provided under the Inflation Reduction Act was “significant.”

Police accuse man, 18, of ‘menacing’ children while driving erratically near park

An 18-year-old Arapahoe County man faces a bevy of charges stemming from erratically driving around a southeast Aurora park parking lot, endangering several children, according to Aurora police.

“The charges stem from Tuesday morning when Aurora police received multiple reports of a gold Honda Pilot driving recklessly and nearly striking numerous children near Aqua Vista Park in the Prides Crossing neighborhood,” Aurora police spokesperson Joe Moylan said in a statement.

Owen Riley Severson faces misdemeanor charges of child abuse, menacing, reckless endangerment and reckless driving, police said.

On Tuesday, police provided media with video tape screen shots of the incident in hopes the public could identify the driver.

“…he was driving recklessly and nearly hit 20 children after speeding away from Aqua Vista Park,” police said in a tweet ” He is believed to be between the ages of 20-25 with long light colored hair and a pock-marked face. “Evidence shows he may have purposely aimed his vehicle at certain people, including children, nearly hitting them.”

Moylan said a police investigation

led to Severson’s arrest.

“Officers also impounded the Honda Pilot for processing after Severson made statements to police about the accelerator sticking,” Moylan said.

Woman run over and killed after lying in Aurora hospital parking lot

Police said an unidentified woman was killed after lying down in an Aurora hospital parking lot Sunday morning, Sept. 17, when she was struck by a car.

Police were called to investigate the death at about 9:30 a.m. Sunday in the parking lot of The Medical Center of Aurora, 1501 S. Potomac St.

“The investigation revealed a woman was lying down in a lane of travel when she was run over by a Ford sedan going eastbound through the parking lot,” Police Agent Matthew Longshore said in a statement.

“The pedestrian, a 55-year-old woman, was pronounced deceased on scene,” Longshore said. “The driver, a 35-year-old man, remained on scene, and speed nor alcohol are believed to be contributing factors.”

The woman’s identity will be revealed later by coroner officials.

The death marks the 48th traffic-related fatality this year in Aurora.

One killed, another injured after shooting in car near Heather Gardens

A man was shot to death while driving Sept. 14 when a gun held by a passenger in his car went off, according to Aurora police.

The 21-year-old died at the scene, and police said he would be identified once the Arapahoe County Coroner’s Office notifies his family and performs an autopsy. The 47-year-old passenger, who was also injured, was taken to the hospital with a gunshot wound and was in police custody at the hospital as of Friday morning.

It was unclear whether the shooting was accidental or intentional. Police said charges in the case have not been filed pending further investigation.

Officers responded at 10:49 p.m. to a report of a crash involving a gray Toyota Camry around the Heather Gardens neighborhood, in the 13600 block of East Bates Avenue. When they arrived, they found the two men suffering from gunshot wounds.

Iconic Front Range mountain tied to Sand Creek massacre is renamed Mount Blue Sky

Federal officials on Sept. 15 renamed a towering mountain southwest of Denver as part of a national effort to address the history of oppression and violence against Native

Americans. The U.S. Board on Geographic Names voted overwhelmingly to change Mount Evans to Mount Blue Sky at the request of the Cheyenne and Arapaho tribes and with the approval of Colorado Gov. Jared Polis. The Arapaho were known as the Blue Sky People, while the Cheyenne hold an annual renewal-of-life ceremony called Blue Sky.

The 14,264-foot (4,348-meter) peak was named after John Evans, Colorado’s second territorial governor and ex officio superintendent of Indian affairs. Evans resigned after Col. John Chivington led an 1864 U.S. cavalry massacre of more than 200 Arapaho and Cheyenne people — most of them women, children and the elderly — at Sand Creek in what is now southeastern Colorado.

“It is a huge step, not only for the Cheyenne and Arapaho people, but also for the Ute Mountain Ute Tribe, Southern Ute Tribe, Northern Arapaho Tribe, Northern Cheyenne Tribe, and other allies who worked diligently to begin the healing process, bringing honor to a monumental and majestic mountain,” Cheyenne and Arapaho Tribes Gov. Reggie Wassana said after Friday’s vote.

Tribal leaders are now focusing their efforts on changing the name of the adjacent Mount Evans Wilderness Area to Mount Blue Sky Wilderness area, which would require congressional action.

Polis, a Democrat, revived the state’s 15-member geographic naming panel in July 2020 to make recommendations for his review before being forwarded for final federal approval. On Friday, the federal board considered changing several other geographical names submitted from across the country, none as prominent or well-known as Mount Evans.

The name Mount Evans was first applied to the peak in the 1870s and first published on U.S. Geological Survey topographic maps in 1903, according to research compiled for the national naming board. In recommending the change to Mount Blue Sky, Polis said John Evans’ culpability for the Sand Creek Massacre, tacit or explicit, “is without question.”

“Colonel Chivington celebrated in Denver, parading the deceased bodies through the streets while Governor Evans praised and decorated Chivington and his men for their ‘valor in subduing the savages,’” Polis wrote in a Feb. 28 letter to Trent Palmer, the federal renaming board’s executive secretary.

Polis added that the state is not erasing the “complicated” history of Evans, who helped found the University of Denver and Northwestern University in Evanston, Illinois. Evans also played a role in bringing the railroad to Denver, opposed slavery and had a close relationship with Abraham Lincoln, Polis noted.

Studies by Northwestern and the University of Denver published in 2014 also recognized Evans’ positive contributions but determined that even though he was not directly involved in the Sand Creek Massacre, he bore some responsibility.

“Evans abrogated his duties as superintendent, fanned the flames of war when he could have dampened them, cultivated an unusually

interdependent relationship with the military, and rejected clear opportunities to engage in peaceful negotiations with the Native peoples under his jurisdiction,” according to the DU study.

In 2021, the federal panel approved renaming another Colorado peak after a Cheyenne woman who facilitated relations between white settlers and Native American tribes in the early 19th century.

Mestaa’ hehe Mountain, pronounced “mess-taw-HAY,” honors and bears the name of an influential translator, also known as Owl Woman, who mediated between Native Americans and white traders and soldiers in what is now southern Colorado. The mountain 30 miles (48 kilometers) west of Denver previously included a misogynist and racist term for Native American women.

In the 1960s and 1970s, the federal board took action to eliminate the use of derogatory terms related to Black and Japanese people. The latest moves come amid a reckoning on race relations across the U.S. and under the leadership of Interior Secretary Deb Haaland, the nation’s first Native American Cabinet member.

Former Ft. Lupton officer gets probation for putting woman in police vehicle that was hit by a train

A former Colorado police officer who put a handcuffed woman in a parked police vehicle that was hit by a freight train, causing the woman to suffer serious injuries, has avoided a jail sentence and must instead serve 30 months on supervised probation.

Jordan Steinke, 29, was sentenced Sept. 15 by Weld County District Court Judge Timothy Kerns, who found her guilty of reckless endangerment and assault for the Sept. 16, 2022, crash near Platteville. Kerns acquitted the former Fort Lupton police officer of criminal attempt to commit manslaughter after her bench trial in July.

Kerns said he had planned to sentence Steinke to jail, but he changed his mind after both prosecutors and defense attorneys sought a probationary sentence, The Denver Post reported.

“Someone is going to hear this and say: ‘Another officer gets off,’ “ Kerns said. “That’s not the facts of this case.”

He ordered Steinke to perform 100 hours of community service. And if she violates the terms of her probation, “I will harken back to my original gut response as to how to address sentencing,” Kerns warned.

Steinke, who wept during the sentencing hearing, apologized to Yareni Rios-Gonzalez, who attended the hearing virtually.

“What happened that night has haunted me for 364 days,” Steinke said. “I remember your cries and your screams.”

Thoa’s slice of heaven at Bánh and Butter

DAUGHTER OF ICONIC VIETNAMESE RESTAURATEURS STAKES OUT HER OWN PATH TO CULINARY SUCCESS

The French influence on Vietnamese cuisine hails back to the colonization of Vietnam by the French in 1877 — even in the words were influential.

The word for Vietnamese “phô” is attributed to the French “feu,” which means fire. Chefs often link how the French helped the Vietnamese create “phô” based on the iconic “pot-au-feu,” a French dish of slowly boiled meat and vegetables in broth.

Vietnamese cuisine is hardly the only menu heavily influenced by fusion, which is a mixed bag for Thoa Nguyen.

Asian fusion was never something that made sense to Thoa, save for French-Asian fusion.

“I was against Asian fusion for so long, but with the French and Vietnamese relationship already existing after the colonization of Vietnam, it just made sense,” Thoa said.

The journey to opening Bánh and Butter began nearly 20 years ago. The name is, literally, “bread and butter.” “Bánh” is the Vietnamese turn on “pain,” French for bread.

Her parents carry a storied career in Vietnamese cooking, having been the owners of New Saigon, in Denver, for more than 35 years, an iconic Vietnamese restaurant.

At 14, Thoa would help her mother in the kitchen at home with tasks like marinating and skewering shrimp.

“So, that started at a very young age, going into the kitchen,” she said. “Just interacting with my mom” was what drew her there.

Thoa’s family never ate much beyond the traditional Vietnamese fare, if they were eating at home. If they wanted Italian, they would go out for pasta. If they wanted pizza, “we’d just go to Pizza Hut,” she said.

It wasn’t until a night watching chef Giada de Laurentiis make a shrimp scampi on a Food Network show that other global cuisines suddenly became intriguing.

“When I saw that shrimp scampi, I thought, ‘I’ve got to learn how to make this,’” Thoa said.

She learned the recipe, made it for her parents, and they loved it.

Teaching herself that dish sparked curiosity and ambition to learn more, much more.

Given that Thoa’s mom was the dinner cook at home, Thoa would make lunch for her three older sisters and one younger sister, in the vein of gourmet paninis and other sandwiches.

There was just one problem for Thoa. Over time, it was morphing into more of a deli than a bakery.

Given its location along Federal, the need from the clientele was more of a quick grab-and-go for lunch or dinner, rather than a bakery and cafe where people could linger.

What she saw was a traditional Vietnamese Bánh mi shop, and not her vision.

“I wanted a cafe where people can sit and have a coffee and enjoy pastry,” she said.

That made for a difficult decision. Thoa wanted to focus on French pastry, and she decided she needed to leave New Saigon Bakery and Deli.

There’s the underlying pressure of always wanting to make parents proud, and that pressure is often especially keen among Asian immigrant families. Recognizing that they built the establishment for her after finishing school in France, she feared disappointing her parents.

There was guilt, not only as a result of their investment into her, but she was worried of seeming unappreciative.

The sacrifices her parents made in ensuring a good life for their family weren’t lost on her.

They sold the restaurant five years ago, however, but they still own the adjacent New Saigon Bakery and Deli on South Federal Boulevard.

Fast forward a few years, and Thoa is on her way to France to learn the art and chemistry of pastry. Bringing home her training and credentials, her parents opened the New Saigon Bakery and Deli, just for Thoa.

“You feel like you owe them everything,” she said.

The Nguyen family fled Vietnam during the war, while Thoa’s oldest sister was just 2 years old. They found passage on a small vessel suited for 50 people. There were nearly 200 people on the boat, as Thoa remembers being told.

Her family was picked up along the coast of Australia, and since Thoa’s father had a cousin in Colorado, they made their way east and ended up in the Centennial State.

Ultimately, to her relief, the family supported her decision to move on with her career.

Following a brief stint at Whole Foods, Thoa opened Bánh and Butter on East Colfax Avenue in Aurora.

The time spent at Whole Foods, while repetitive, did serve as a learning opportunity for the corporate and business side of things, like margins, food waste and other necessities of a successful working kitchen.

When she was working with her parents, they handled all of the business side of things.

“When you’re working for a family business, I just go through the day, we make what we need to make and we get a paycheck at the end of the day,” Thoa said.

Through these rites of passage was born Bánh and Butter Bakery Cafe.

The name says it all.

Thoa’s vision of a place where

people can sit, have coffee and enjoy pastry is coming to life.

Thoa has taken over the old Third Culture location on Colfax, which was an unsuccessful Mochi Donut spot. That made it the perfect turnkey establishment, outfitted with all of the accouterments needed for a working bakery.

Her neighbors have been helpful as well.

Heimi Haynes owns the building that houses Bánh and Butter and the neighboring Baba and Pops pierogi shop.

A couple doors farther down is the People’s Building. That’s an events venue run by Aaron Vega, a well known East Colfax face who tirelessly works to keep the Aurora

Cultural Arts District alive. Both have offered what Thoa says has been priceless feedback, opinions and connections for setting up on Colfax, a worthwhile risk, she said.

“Give East Colfax a chance. I think it has a bad rep and note everyone sees the potential in it,” she said. “There are a lot of artists and small businesses that could use the support and I would like the community to give us a chance.”

Location aside, the draw anywhere she chose to set up had to be what comes out of the oven every day.

Her flaky layered pastries, “laminates” is the industry term, are very loyal to the traditional methods of making those French pastries. In addition to traditional flaky fare, she prefers to stick to traditional formulas for just about everything, not straying too far because there is history within them.

“I love traditional French pastry. I like to make sure that a cream puff looks like a cream puff,” she said.

“I try to be a little modern, but I can never stick with it,” Thoa said.

The display cases of Bánh and Butter are packed every morning with freshly made pastry, savory and sweet.

The best seller and customer favorite is the strawberry-and-cream croissant, boasting freshly sliced strawberries and whipped cream stuffed to overflowing from the laminate.

There is also a variety of breakfast and lunch sandwiches to choose from, including a Bánh mi, which is a traditional Vietnamese sandwich on a baguette, filled with layers of meat, mayonnaise, pickled

vegetables, chilies, fresh cucumbers and herbs.

Thoa likes to sometimes substitute a croissant for the baguette, when she’s treating herself. She also loves to fill croissants with apples, bleu cheese and chili oil, or separately with Laughing Cow cheese and raspberry jam.

But the bakery business isn’t all sweetness. It’s a business.

She’s learned that the numbers side of owning a business is critical and consuming.

As Bánh and Butter gets off the ground, she’s considering expanding to more than just a brick and mortar establishment. She has plans for e-commerce, too.

Thoa wants to create and market what she calls “Cookies for a Cause” with proceeds from the sales going toward foundations that support women and minority small business owners.

She’s learned that her expansion depends on a successful relationship with dedicated employees, who deserve her dedication to them.

Thoa said opening any business can be tough, but it’s often even tougher for women and minorities for a host of reasons.

She knows that not everyone who wants to start a small business has the opportunity to get a loan from their family in order to fulfill their dreams and passions, like she did.

“There’s a lot of weight on your shoulders when you’re responsible for the livelihood of nine other people,” she said. “The last thing I want is to see this business fail and have people lose their jobs as a result of it.”

Mid-Autumn Fest, also known as the Moon Festival, is an important holiday in Chinese culture, and it is just around the bend.

SUPPLY PROBLEMS AND INSURANCE ISSUES MAKE POPULAR WEIGHT-LOSS DRUGS HARD TO GET

When she prescribes the popular weight-loss drug Wegovy, Dr. Angela Fitch sends patients on a quest she likens to “The Hunger Games.”

They will have to call drugstores over several days to find one with the properly sized first dose. Then they’ll do that again for their second dose, and probably the third. And that’s only if the patient has insurance or the means to afford a drug that can cost more than $1,300 a month.

“This is not for the weak-willed,” said Fitch, who is president of the Obesity Medicine Association and also consults for drugmakers.

Supply problems and insurance complications have made it difficult for people to start — and stay on — Wegovy and similar medications that are transforming obesity treatment, according to doctors and patients around the country. They say getting the high-demand, injectable drugs requires persistence and a fair amount of luck.

People starting on Wegovy have to take injections of gradually increasing strength before they reach the so-called maintenance dose that they stay on.

The drug’s maker, Novo Nordisk, says that demand has forced it to restrict the supply of those smaller, initial doses in the U.S. The company also is warning those taking another weight-loss drug, Saxenda, to expect difficulty filling prescriptions “for the remainder of 2023 and beyond.”

Another drugmaker, Eli Lilly, has said it expects tight supplies until year’s end for its diabetes treatment Mounjaro, which also is prescribed for weight loss.

Finding Wegovy can become a part-time job for patients, said Dr. Diana Thiara, medical director of the weight management clinic

at the University of California, San Francisco.

Thiara said some wind up driving 45 minutes or more to get prescriptions filled, a barrier for hourly workers who can’t leave their job and for people without cars.

“It’s usually patients who are a little bit more privileged, able to take off from work to go make those drives,” Thiara said.

One of Fitch’s patients, Mike Bouboulis, has taken Saxenda, Mounjaro or Ozempic, a Novo diabetes drug with the same active ingredient as Wegovy, since around 2019. It became much harder for him to find the drugs in the past year, after their popularity exploded. Refilling a prescription involved calling five to seven pharmacies.

“They all know what you’re calling for, and they all have the same answer: ‘I don’t know. We’ll see tomorrow,’” said the 35-yearold small business owner who lives outside Boston.

Pharmacy technician Lizzy Nielsen used insider knowledge to start Wegovy earlier this year.

She regularly checked drug wholesalers’ supply lists, refreshing her screen each morning, and then ordering Wegovy for her pharmacy as soon as she saw it in stock.

“I was really lucky ... because that’s when it was like starting to be constantly back-ordered,” the 42-year-old West Springfield, Massachusetts, resident said.

While patients have had to deal with shortages of many medications in the past year, those taking weight-loss drugs can face coverage complications too.

The federal Medicare program for people age 65 and older doesn’t cover obesity medicines, but some privately run Medicare Advantage or Medigap plans do, according to Novo. Coverage from Medicaid programs for people with low incomes varies.

Doctors and patients say many insurers have stopped covering Ozempic and Mounjaro outside their approved use for diabetes. Some insurers and employers don’t pay for Wegovy.

Novo Nordisk even offers a form letter on its Wegovy website to help doctors request coverage.

Bouboulis, the Boston-area resident, said his insurer stopped covering Mounjaro earlier this year. He then tried switching back to Ozempic but found that also was no longer covered.

He’s taking low doses of leftover Ozempic until he can find coverage.

“I know the insurance companies don’t want to pay, but between (them) and the pharmaceutical industry, they need to find some kind of nice middle ground because these medications, they can save people’s lives,” said Bouboulis, who has lost around 80 pounds since he started taking them.

Employers and insurers that do pay for the weight-loss treatments often require patients to get pre-approval or to first try other strategies like diet and exercise.

Some require patients to show they’ve lost 5% of their body weight after six months on the drugs in order to continue coverage. Supply problems make that hard, Thiara noted.

“A lot of patients are not staying on it consistently because they can’t get it,” she said.

Dr. Laura Davisson estimates that less than 30% of her patients with insurance through an employer or an individual plan have obesity medicine coverage.

Davisson directs a weight-loss program in West Virginia, a state that consistently ranks as having one of the highest obesity rates in the country. The state’s Medicaid program doesn’t cover Wegovy, but neighboring Pennsylvania’s does.

“For me, it’s either they have coverage through insurance, or they’re not taking it,” she said. “No one can afford it.”

Coverage may improve over time, as it has with other obesity treatments like bariatric surgery.

About 46% of large U.S. employers cover obesity medicines like Wegovy, according to the benefits consultant Mercer. Another 18% are considering it. Mercer’s experts say employers are still trying to learn about how the added cost will affect them and what other support patients may need.

Dr. Deborah Horn says she thinks supply problems and coverage will eventually smooth out, but it may take a couple years. She noted that the FDA may soon approve Mounjaro to treat obesity, which could improve coverage.

Drugmakers also are developing other weight-loss medications, including easier-to-take pills.

In the meantime, more patients are realizing that they can get medical help for their disease and don’t have to manage it on their own, said Horn, an obesity medicine expert at UTHealth Houston.

“I feel like this is the beginning of the change in obesity care, where we will see every year better and better medications coming to market and people getting their disease under control,” she said. “We’re just in the hard part ... right now.”

Americans can now get an updated COVID-19 vaccine

Most Americans should get an updated COVID-19 vaccine, health officials said last week.

Advisers to the Centers for Disease Control and Prevention endorsed the new shots for everyone 6 months and older and the agency’s director quickly signed off Tuesday on the panel’s recommendation. That means doses should be available this week, some as early as Wednesday.

The severity of the COVID-19 pandemic has faded, but there are still thousands of hospitalizations and hundreds of deaths in the U.S. each week. Hospitalizations have been increasing since late summer, though the latest data indicate infections may be starting to level off, particularly in the South.

Still, experts worry that immunity from previous vaccinations and infections is fading in

many people, and a new shot would save many lives.

According to a survey last month that CDC cited, about 42% said they would definitely or probably get the new vaccine. Yet only about 20% of adults got an updated booster when it was offered a year ago.

Doctors hope enough people get vaccinated to help avert another “tripledemic” like last year when hospitals were overwhelmed with an early flu season, an onslaught of RSV, or respiratory syncytial virus, and yet another winter coronavirus surge.

Here is what you need to know about the new COVID-19 shots:

WHO SHOULD GET THE UPDATE TED VACCINE?

The Food and Drug Administration approved the updated shot s from Pfizer and Moderna for adults and children as young as age 6 months. FDA said starting at age 5, most people can get a single dose even if they’ve never had a prior COVID-19 shot. Younger children might need additional doses depending on their history of COVID-19 infections and vaccinations.

The CDC decides how best to use vaccines and makes recommendations for U.S. doctors and the general public. The agency’s panel of outside experts recommended the updated COVID-19 shots by a vote of 13-1. The no vote came from a panel member who had argued that the new shots should initially be recommended only for older people and others at greatest risk of severe illness. But other panel members said all ages could — and should — benefit.

“We need to make vaccination recommendations as clear as possible,” said one panel member, Dr. Camille Kotton, an infectious diseases doctor at Massachusetts General Hospital.

WHERE CAN I GET A SHOT?

The new vaccine will be available at pharmacies, health centers and some doctor offices. Locations will be listed on the government’s vaccines.gov website. The list price of a dose of each shot is $120 to $130, according to the manufacturers. On Tuesday, a Pfizer official said his company expected to have doses available at some U.S. locations as early as Wednesday.

WHY MORE COVID-19 SHOTS?

Similar to how flu shots are updated each year, the FDA gave COVID-19 vaccine makers a new recipe for this fall. The updated shots have a single target, an omicron descendant named XBB.1.5. It’s a big change. The COVID-19 vaccines offered since last year are combination shots targeting the original coronavirus strain and a much earlier omicron version, making them very outdated.

Pfizer, Moderna and Novavax all have brewed new supplies, and the FDA on Monday approved shots from Pfizer and Moderna. Novavax’s updated vaccine is still under review.

WILL THEY BE EFFECTIVE ENOUGH?

Health officials are optimis-

tic, barring a new mutant. As expected, XBB.1.5 has faded away in the months it took to tweak the vaccine. Today, there is a soup of different coronavirus variants causing illness and the most common ones are fairly close relatives. Recent lab testing from vaccine makers and other research groups suggest the updated shots will offer crossover protection.

Earlier vaccinations or infections have continued to help prevent severe disease and death but protection wanes over time, especially against milder infections as the virus continually evolves. The FDA did allow seniors and others at high risk to get an extra booster dose last spring. But most Americans haven’t had a vaccination in about a year.

CAN I GET A FLU SHOT AND COVID-19 SHOT AT THE SAME TIME?

Yes. The CDC says there is no difference in effectiveness or side effects if people get those vaccines simultaneously, although one in each arm might be more comfortable. The CDC urges a yearly flu shot for pretty much everyone ages 6 months and up. The best time is by the end of October.

Boston firefighter Daniel Ranahan had heard about colleagues getting cancer but he was stunned when doctors discovered a tumor in his chest.

He was only 30 and had been on the rolls for less than a decade. But as he investigated his diagnosis of Hodgkin’s lymphoma in October 2020 and sought successful treatment, he learned he and others wore gear that contained the toxic industrial compound PFAS.

“You always hear about the dangers. You just never think it’s going (to) be you,” said Ranahan, who stopped working due to the cancer and is among thousands of firefighters nationwide who sued PFAS manufacturers and companies that make firefighting gear and foam, seeking damages for their exposure.

“These guys put this on day in and day out to protect neighborhoods and wherever they are working,” he said. The Associated Press was not given access to his doctors due to the ongoing litigation, making it difficult to independently verify his claims.

The multi-layered coats and pants worn by firefighters have become the latest battleground over PFAS, or per-and polyfluoroalkyl substances. It’s found in everything from food packaging to clothing and is associated with health problems including several types of cancer. In March, the Environmental Protection Agency for the first time proposed limits on the chemicals in drinking water.

The news that PFAS compounds are in their gear — primarily meant to repel water and contaminants like oil and prevent moisture-related burns — is worrisome to firefighters.

The International Association of Fire Fighters or IAFF says that cancer has replaced heart disease as the biggest cause of line-of duty deaths. Firefighters have been shown to be at higher risk than the general population of getting several types of cancer.

Years after fire departments began identifying illness caused by firefighting gear, the battle continues

Firefighters are exposed to a laundry list of carcinogens coming from fires burning hotter and faster than ever before — often due to increased petroleum products in homes. But as they learn more about PFAS, firefighters have grown suspicious that their personal protective equipment or PPE is sickening them.

Aurora Fire Rescue chief Alec Oughton said first responders have only recently become aware of the potential hazards posed by their own PFAS-laced gear.

“We signed up for going into fires. We signed up for caring for our community in pandemics and in environments that produce carcinogens,” Oughton said. “What we didn’t understand and what we are learning now is that some of the equipment that’s designed to protect us from cancer is reaching into our bodies and has the potential to cause cancer.”

He said the agency follows national best practices for decontamination when its members return from calls, including expecting firefighters to shower within an hour of going into a fire. There have also been discussions about removing and cleaning all of the firefighting equipment in the cab of a truck that has returned from a fire, but it’s not clear whether that can be done without impacting response times.

About five years ago, the Aurora City Council set aside $800,000 for gear cleaning and additional sets of structural fire gear to prevent firefighters from having to don contaminated equipment.

But Oughton and Travis Pulliam, president of Aurora Fire FIghters Local 1290, said PFAS compounds — which have been dubbed “forever chemicals” for their ability to linger in the environment and in the human body for years without breaking down — are in all of the multi-layered suits worn by Aurora firefighters responding to structure fires.

“There is not a manufacturer that makes structural firefighting gear that doesn’t have the forever chemicals in it,” Pulliam said. “One has committed to trying to make that gear in the future. The others are spending their time trying to argue that PFAS doesn’t cause cancer.”

He and Oughton said there is a campaign underway to pressure gear manufacturers into phasing out PFAS. A Congressional bill introduced in July would accelerate the search for safer alternatives and support firefighter training to reduce exposure from existing gear.

Other groups are taking legal action on behalf of firefighters who were exposed to PFAS present in their gear. Sam Dillon, president of Boston Firefighters, Local 718, said that, once his union became aware of the problem, it had to act.

“When we break it down, the problem, to us, becomes very simple,” he said. “There is proven science that PFAS is a known carcinogen. There is also proven science that PFAS is in protective gear that firefighters wear. So when it’s brought to our attention that there is a known carcinogen in the protective ensemble that our members wear, it is (of) grave concern to the union and it’s our job to address that issue.”

One defendant in the related lawsuits, 3M Co., said in a statement that it “manufactures a variety of personal protective equipment products that meet nationally recognized standards to help protect first responders facing high-hazard environments.” Last year, the company announced it would stop manufacturing PFAS by the end of 2025 and would work to discontinue using the chemicals in its products.

Another defendant, W. L. Gore & Associates, says the PFAS compound PTFE used in its clothing is nontoxic and safe.

“Based on the body of available and reliable science, Gore concludes its firefighting products are not the cause of cancers impacting firefighters, who by the nature of their important work are sometimes exposed to cancer-causing chemicals from fires,” said company spokesperson Amy Calhoun.

The American Chemistry Council said in a statement that “PFAS-based materials are the only viable options for some key equipment that meet the vital performance properties required for firefighting gear.”

Heightened concerns about gear

The PFAS has been in the gear for decades. But the wife of retired Worcester, Massachusetts fire lieutenant Paul Cotter who had cancer raised concerns about PFAS in gear in 2016. Until then, many firefighters had not heard of PFAS or did not know it was in their gear.

Gear makers told Diane Cotter that there were only trace amounts of PFAS and that it

was safe. “I was attacked by firefighters when discussing the idea that chemicals in the gear could be causing cancer,” she said.

Cotter sent patches of gear to Graham Peaslee, a University of Notre Dame professor who studies PFAS, for testing.

“It was loaded with PFAS. That was the first eye-opening moment that there may be more than just trace amounts,” said Peaslee, who also found the chemicals on gloves and in firehouse dust.

“They come off and they pose risks,” he said.

Courtney Carignan, an exposure scientist and epidemiologist at Michigan State University, said she found PFAS at twice the levels of the general population in the blood of more than half of the 18 firefighters she tested in Nantucket and Fall River, Massachusetts. She also found that PFAS in gear was transferred to the skin of firefighters.

But Carignan is still investigating how much the gear contributed to increased levels of PFAS in the blood and whether PFAS exposure may be causing or contributing to cancer.

“Even though we know PFAS is in the gear, we still don’t know how much exposure that is,” she said.

Firefighters take action

The revelation of PFAS in the gear sparked a campaign by firefighters to find safer alternatives and to hold companies responsible.

Lawsuits on behalf of firefighters argue they were exposed to significant PFAS levels and companies knew the gear contained PFAS and that it can cause serious health problems. The suits also allege companies misrepresented their products as safe.

The IAFF, which represents more than 340,000 U.S. and Canadian firefighters, decided in 2021 to no longer accept sponsorships or advertising from the chemical industry and to oppose PFAS in turnout gear.

Seven states including Washington, New Hampshire and New York passed bills requiring companies to disclose PFAS in their gear, according to Safer States, a coalition of environmental health groups.

Colorado passed a restrictive bill in 2019.

Several more states introduced or enacted bills this year that provide funds to purchase PFAS-free gear or prohibit manufacture or sale of gear containing the chemicals, according to Emily Sampson, an environment policy analyst at the National Conference of State Legislatures.

No easy fix

For most fire departments, there is no easy fix. Replacing gear is expensive — one set can cost upward of $4,000 — and finding alternatives has proven challenging. Some companies are promoting a PFAS-free outer layer but that doesn’t solve the problem because the other two layers still contain PFAS, the IAFF said.

Oughton said that Aurora Fire Rescue is searching for gear free of PFAS that firefighters can wear to calls that don’t require multi-layered suits.

“The short answer is that, right now, 100% of structural turnout gear contains forever chemicals of some kind,” Oughton said.

“There’s a real sense of urgency for us first to ask the manufacturers to produce gear without these forever chemicals and second to find gear alternatives for our firefighters in the interim for everything other than structure fires.”

Among the hurdles, according to a IAFF lawsuit filed in March, is that the National Fire Protection Association or NFPA standard for gear can only be met with PFAS-infused ma-

terial. The suit accuses the NFPA of working with several gear makers to maintain that requirement. It seeks damages and an end to the standard.

Chris Dubay, NFPA vice president and chief engineer, said in a statement that the standard “does not specify or require the use of any particular materials, chemicals or treatments for that gear.” He said the group has no “special agreements or relationships with any company or organization” in development of standards.

“The manufacturers who are producing this gear owe it to the fire service to come up with an alternative,” Brockton Fire Chief Brian Nardelli, who has heard of companies promoting gear with less PFAS but is reluctant to buy it for his 231-member department without more proof.

Instead, his department tries to limit firefighter exposure to gear that’s been integral to firefighter identity. They would take it everywhere, including charity events. Now, Brockton discourages firefighters from wearing turnout gear in living quarters and encourages them to wash it after fires. It’s stored on trucks and is only to be worn for serious calls like fires and car accidents.

“Guys have seen everyone who has gotten cancer, guys dying from cancer,” said William Hill, the president of the Brockton Fire Fighters Local 144 who was successfully treated for testicular cancer. “Being told that PFAS is in the gear, guys don’t want to take the chance of being overexposed.”

Oughton said Aurora Fire Rescue is preparing to ask for $800,000 to $1 million in funding through the federal Assistance to Firefighters Grants Program that would be

used for ultrasound cancer screenings as well as acquiring single-layer firefighting gear to be used on calls other than structure fires.

While Pulliam said his union helps members report information about exposures and cancer diagnoses to the IAFF, Oughton said Aurora and other cities are still figuring out how to fully quantify the problem of cancer among first responders while respecting their privacy.

“I don’t think we have a robust system for tracking cancer in our agency. I don’t think the nation’s fire service has figured that out,” Oughton said. “But unfortunately, cancer is real for firefighters, and there are members walking around right now who have cancer right now who don’t know it.”

Cherokee Trail blanked Chatfield 5-0 Sept. 18 at Legacy Stadium to move its record to a sparkling 6-2 on the season as the program continues its recent resurgence under coach Mark Hill.

The Cougars have dropped contests to Valor Christian and undefeated Broomfield, but otherwise have been outstanding and posted five shutouts. Senior Bentley Sutherland-Arreola had a hat trick against Chatfield and leads the team with six goals, while six others have multiple goals.

BOYS SOCCER

Still unbeaten, but with only six games under its belt so far is Regis Jesuit, which stands at 3-03 after playing Mountain Vista to a 1-1 tie Sept. 19 in a game played at Regis University. Coach Rick Wolf’s Raiders have yet to play a home game as work is in the final stages on renovations to the playing surface and track at Lou Kellogg Stadium.

Pitch performance

Currently ranked sixth in the CHSAA Class 5A seeding index, Cherokee Trail has a chance to improve given the strength of teams it will face soon when Centennial League play begins. The Cougars open with a Sept. 28 showdown with rival Grandview, which is off to a 4-23 start of its own.

Regis Jesuit has a road trip ahead that will be telling, as ahead is its annual time in the Jesuit Classic, which is set to be played this season in Washington, D.C. The Raiders will play host Gonzaga Sept. 22 and Marquette University out of Milwaukee, Wisconsn, Sept. 23. Both sides, in addition to the fourth program involved — Rockhurst out of Kansas City — generally give Regis Jesuit a good test in addition to the camaraderie of the tournament.

The Raiders are led offensively by junior Jack De Simone, who has notched six goals already.

Also undefeated is the area’s most successful program over the past two seasons in the Lotus School For Excellence, the Class 2A runner-up in 2021 and 2022.

The Meteors have jumped to a 5-0-1 start — which includes a 2-1 win over a Vail Mountain team they lost to in last season’s final — with help from a pair of double-digit goal scorers in senior Fredy Peraza (13) and sophomore Mikiyas Regassa. Lotus has a matchup with Smoky Hill (2-4-1) on Sept. 21.

Aurora Central — which is in its first season under coach Rudy Villalobos — has surged to No. 7 in the 5A seeding index with a 4-1-1 start, with the only loss a one-goal road defeat at No. 2 Legacy Sept. 14. The Trojans have owned Aurora thus far with wins over Smoky Hill, Vista PEAK Prep and Overland with two matches against Gateway to come in Colorado League play.

Senior Cesar Romero had seven goals through five games to lead Aurora players in large schools.

Grandview is No. 15 in the 5A seeding index with the help of some quality early results, which included draws with Regis Jesuit and Fossil Ridge, both of which appear in the top 12. The Wolves have scored as many goals as they’ve allowed (12) so far this season with Centennial League play ahead.

Rangeview dropped to 4-3 with a 1-0 loss to Eaglecrest (3-4-1) Sept. 19 and all three defeats came to Aurora programs as the Raiders also fell to Cherokee Trail and Overland. Senior Alexis Salas is off to a six-goal start.

Vista PEAK Prep and Gateway had three wins apiece in the early going, while Overland (2-4-2) and Eaglecrest have shown signs of improvement. Note: The elimination of overtime this season has led to more ties, 15 so far for city teams.

FOOTBALL Eaglecrest now 4-0, city squads finish 5-6 in Week 4 of season

Things improved greatly for Aurora programs in Week 4 of the prep football season, as they put a 2-9 Week 3 behind them for a 5-6 mark in the penultimate week of non-league play.

The beat went on for Eaglecrest, the area’s only undefeated team, which moved to 4-0 with a 34-9 victory over Rocky Mountain Sept. 14 at Legacy Stadium.

The Raptors played their first home and navigated the challenges of weather in a performance that saw quarterback Joe Steiner throw two touchdown passes to Logan Ryan and another to Xavier Waldron, while also rushing for a score. Cam Chapa continued his impactful start for Eaglecrest with a rushing touchdown on offense and an interception on defense.

Grandview bounced back from a Week 3 defeat for a strong 42-21 victory over Fruita Monument in a physical contest Sept. 16 at Legacy Stadium. The Wolves scored on nearly every one of their offensive possession of the game and got a five-touchdown performance from quarterback Liam Szarka. Szarka turned in a highlight reel scramble for a touchdown as part of a 28-point unanswered burst for Grandview and he threw two touchdown passes to Nate Denton and others to Xay Neto and Kyler Vaughn.

Regis Jesuit’s difficult schedule to open the season marched on with a matchup against Ralston Valley Sept. 15 at the North Area Athletic Complex and the Raiders dropped a hard-fought 28-21 contest that sent them to 2-2 on the season. Quarterback Peyton Lindell rushed for a touchdown and threw a scoring pass to Anthony Medina and Lawson Douglas took back an interception to the end zone for Regis Jesuit.

Vista PEAK Prep improved to 2-2 on the season with a 41-20 road win over Skyline Sept. 15 at Everly Montgomery Field. Marcel Evans Jr. rolled up a whopping 268 yards rushing and scored three touchdowns, while Owen Packer threw a touchdown pass to Kyron Chiku-Martinez among the highlights for the Bison.

Cherokee Trail is also 2-2 in the wake of a 35-31 road win over Fort Collins Sept. 14 at French Field. The Cougars got a combined three touchdown passes from Eliot Ming and Tyson Smith and Ming also rushed for a touchdown. Jacob Mathenge, Carson Pierce and Isaiah Jones caught touchdown passes for the Cougars.

Rangeview got into the win column for the first time with a gritty 21-6 victory over district rival Aurora Central Sept. 15 at APS Stadium. Playing quarterback, versatile Jah Alexander scored rushing touchdowns in each of the final three quarters and amassed 119 yards total. William Gregory accounted for more than 200 yards of total offense as well. Christopher Perkins had the lone touchdown for the Trojans, who dropped to 1-3.

Smoky Hill’s game with Palmer Ridge — the No. 1 ranked team in 4A — got pushed two days because of bad weather its regularly scheduled day. The Buffaloes played host to the Grizzlies on Sept. 16 at Stutler Bowl and fell to 1-3 with a 49-0 defeat. Overland is also 1-3 after a 57-15 loss to Heritage Sept. 14 at Stutler Bowl in a game that took five hours to complete due to mutiple lightning delays. Talil Seals-Fisher threw a touchdown pass to Avante Hendrix and Jarrius Ward rushed for 103 yards and a touchdown for the Trailblazers.

Knyle Serrell rushed for 121 yards and a touchdown and also recovered a fumble to help Gateway in its quest for its first win, but the Olys fell just short

in a 17-6 road loss at Liberty Sept. 14. Hinkley also remains in the hunt for its first victory and scored first on the road at Centaurus Sept. 14 before it dropped a 42-13 decision. Gabriel Ocampo and Larek Dominguez reached the end zone for the Thunder.

BOYS GOLF Regionals tournament schedules set in 4A, 5A

The postseason has arrived for boys golf and city teams dispersed to various Class 5A and 4A regional tournaments in the quest to qualify for state tournaments Oct. 2-3.

The first local programs compete on Sept. 20, with Vista PEAK

Prep among the group of teams set to play in the 4A Region 4 tournament that is slated to begin at 9 a.m. at Bookcliff Country Club in Grand Junction. Also in 4A play on the same day is Aurora Central and Gateway, who are part of the Region 2 tournament that has an 8:30 a.m. start time at the Country Club of Colorado in Colorado Springs.

In 5A regional play on Sept. 20, Cherokee Trail — the Centennial League runner-up — Rangeview and Smoky Hill play in the 5A Central Region tournament scheduled to tee off at 8:30 a.m. at the University of Denver Golf Club in Highlands Ranch. On Sept. 21, Continental League runner-up Regis Jesuit and Grandview have 8 a.m.

The top two teams and 13 individuals not on one of the top two teams from each of the four regionals in each classification earn admission into the 84-golf state fields. The 4A state tournament is scheduled for The Bridges in Montrose, while 5A is slated for Collingdale in Fort Collins.

BOYS GOLF Regis Jesuit ends as Continental League’s second-place team

The Regis Jesuit boys golf team picked up second win of the season in the seventh and final Continental League tournament of the season played, which took place on Sept. 13 at Saddle Rock G.C.

The Raiders finished one stroke better than Rock Canyon atop the team standings in the last tournament with the help of a trio of topnine individual finishes. Junior Anthony Lore grabbed one of three shares of medalist honors with a 2-under-par 70, while fellows juniors Ryland Doolittle and Ben Sander shot 73 and 74, respectively, to finish tied for sixth and ninth.

The final result cemented Regis Jesuit’s runner-up finish behind Rock Canyon in cumulative team strokes (2,073 for the Jaguars and 2,114 for the Raiders) following tournaments at King’s Deer, Broken Tee, Meadow Hills, CommonGround, Murphy Creek, South Suburban and Saddle Rock.

Individually, junior Roland Thornton shot in the 70s in six of the seven league tournaments and earned All-Continental League first team honors, while junior Sam Walker, Lore and Sander all made the all-league second team and Doolittle earned honorable mention status.

Then-Plateville Police Sgt. Pablo Vazquez had stopped Rios-Gonzalez after a reported road-rage incident involving a gun. Steinke took her into custody and locked her in Vazquez’s police vehicle, which was parked on the railroad tracks. A train crashed into the SUV.

Rios-Gonzalez, who suffered a lasting brain injury and is in pain, was conflicted about how she wanted Steinke to be punished, attorney Chris Ponce said.

“The conflict that she feels is one where every day she has to feel this pain,” Ponce said. “And she’s had to deal with (doctor) appointments and having her life so radically changed. And feeling upset, very upset about that — angry about that — but on the

other hand, feeling for Ms. Steinke, and, I think, truly empathetically feeling sorry for how she lost her career.”

Steinke was fired from the Fort Lupton police department after her conviction. She is expected to lose her Peace Officer Standards and Training certification, her attorney Mallory Revel said, meaning she can never be a police officer again.

During Steinke’s trial, her defense attorneys said she did not know that Vazquez had parked his police vehicle on the tracks. Vazquez still faces trial for his role in the crash. He has been charged with five counts of reckless endangerment for allegedly putting Rios-Gonzalez, Steinke and three other people at risk, as well as for traffic-related violations, including parking where prohibited.

Rios-Gonzalez has also filed a lawsuit against the police agencies involved.
