he South Florida Gay News and City of Fort Lauderdale agreed to a court order at an emergency hearing Monday, June 20. The order states the City and Police Department will not prohibit the taking of photographs from public areas near the film set of the Rock of Ages starring Tom Cruise, Catherine Zeta-Jones, and Alec Baldwin. The lawsuit was filed last week after SFGN discovered signs posted near the filming of the movie stating, “Photography of this area is prohibited. Strictly enforced by FLPD. Violators subject to arrest.” Since then several photographers have come forth with complaints of harassment by city officials. In response to the harassment and signs the South Florida chapter of the Society of Professional Journalists joined the lawsuit with SFGN and staged a protest last Friday. The National Press Photographers Association has also since joined the lawsuit.

The signs were removed before Friday’s protest, but even so police officers were still enforcing the “No Trespassing” portion of the signs and a photographer was later ordered to leave a public parking garage. “By removing the signs the police department made a bad situation worse,” Kent said. “Now there’s nothing out

there informing the public where they are allowed to be or not be.” Instead at Friday’s protest a uniformed off duty police officer hired by the movie production company was simply shouting orders at every person that came close to an invisible line she arbitrarily decided upon that appeared to keep moving. At the emergency hearing the city argued the injunction was moot because the signs have been removed and the police department is denying harassing any photographers. However, Kent said he is moving forward with the lawsuit. “We’re seeking a declaration by the court that the city acted illegally. Taking down the signs does not eliminate that fact,” Kent said. “You don’t strip people of their right to peacefully assemble and then get a reward for saying you won’t do it again a second time. You get penalized for taking it away the first time.The cops and city knew better but they sold their souls to Hollywood.”

Former Pride South Florida Director to Plead Guilty Friday By Jason Parsley

FGN has learned that Mike Cruz, the former director of Pride South Florida will change his plea Friday to guilty, according to his lawyer Daniel Young. Judge Andrew Siegel will sentence him. Cruz was arrested last year for second-degree grand theft, accused of stealing more than $40,000 from the organization. However, current Vice President of Pride South Florida, Marc Hansen, was more forthcoming. “We’ve been working hard to get past the blemish that Michael Cruz put on this organization,” he said. “We’re working to return it to the respectable place it used to be. Michael Schiavi and the Celluloid Activist By Jesse Monteagudo

So a figure 3 like Vito, who was out there screaming bloody murder against a government that let thousands of gay men die, seems very alien to them.” Though Celluloid Activist gives Russo his due, it does not shy away from its hero’s less admirable qualities. Schiavi describes Russo as “Brash. Hilarious. Ballsy. The quintessential New Yorker. The biggest Judy Garland queen in history. Man-crazy. Obsessed with gaining visibility for the LGBT community. Obsessed with denouncing and obliterating governmental indifference to AIDS. Someone who loved living with all his heart and body.” On the other hand, “Vito never had any interest in assuming leadership roles, even in organizations that he co-founded. I think he liked to help get organizations off the ground, liked to give stirring speeches and benefit lectures/screenings, and then move on. Professionally, his first love was always writing, and that requires considerable solitude and space.” As great as Russo’s contributions to LGBT and AIDS activism are, his contributions to

gay film criticism are unique and invaluable. As Schiavi says, “The Celluloid Closet more or less invented the field of gay and lesbian media studies. Through his Celluloid Closet lectures and, eventually, book, Vito was determined to read film much more practically. He knew that the way LGBT people are portrayed on screen has a direct impact on how they are treated in society. So he set about finding every possible mainstream American film, from the silents through the ‘80s, that purported to represent our lives. The sheer grunt work of his task is overwhelming. Through international archives and the advice of countless friends, he tracked down and analyzed over 400 movies that had never before been considered together. Collectively, they presented the almost universally vicious portrayal -- clowns, victims, villains, murderers, perverts, destroyers of society -- that had been our popular representation for over 75 years.” Unfortunately, “Vito’s brand of activist criticism isn’t practiced today. The current era of activism lacks the edge and urgency that typified all of Vito’s writing.” Schiavi described Russo-- who was born, lived most of his life, and died in Manhattan -- as “the quintessential New Yorker.” Back in the seventies, arguably Gay New York’s greatest decade, Russo asserted that Manhattan was “the best place in the world to be alive, well, and gay.” This, Schiavi adds, “was a conviction he held his entire life. He often stated how lucky he was to grow up in NYC and realize, long before Stonewall, that he was surrounded by gay people. He knew that unlike the majority of LGBT folks his age, he did not have to grow up in isolation. He also loved living in a city where, as he put it, ‘Every time you head out the door, it feels like something’s gonna break out in headlines!’ Vito’s personality was like one enormous capitalized headline, so he needed an environment up to his energy level.” In Celluloid Activist, Vito Russo has the biography he deserves, one that matches his energy level.

Bankruptcy Court Rules Against Doma By Paul Elias

S

AN FRANCISCO (AP) Gene Balas and Carlos Morales were facing health problems and crushing financial pressures plaguing many U.S. households when they decided to file bankruptcy as a married couple. The Obama administration said they couldn’t, citing the Defense of Marriage Act, which prohibits federal recognition of samesex marriages. On Monday, June 13, 20 of 24 judges sitting on the country’s largest consumer bankruptcy court sided with the gay couple. In doing so, the court took the extraordinary step of declaring the Defense of Marriage Act unconstitutional. The ruling is the first such attack of the Defense of Marriage Act in bankruptcy court, and it adds to the building pressure on the Obama administration to make good on a February pledge to stop defending the law in court. Balas and Morales were among the 18,000 Californian same-sex couples who wed Aug. 30, 2008, during the brief period when gay marriages were legal in the state. “It is hurtful to hear my own government

say that my marriage is not valid for purposes of federal law,” Balas said in a court filing. Balas said he was laid off from his $200,000-a-year job in the financial industry in March 2009. The couple said they share all income and expenses. “All the property that either of us owns is community property, and all of our debts are community debts,” said Morales, who has spent most of the relationship unemployed. “We have no prenuptial agreement, postnuptial agreement or transmutation agreement.” The ruling written by U.S. Bankruptcy Judge Thomas Donovan wasn’t the first blow to the Defense of Marriage Act in federal court. That came last year when a federal judge in Boston declared the law an unconstitutional violation of equal protection guarantees. Two other bankruptcy courts have also rejected administration attempts to dismiss joint filings made by same-sex couples, but neither of those rulings addressed the constitutionality of the act. Monday’s strongly worded ruling contributes to the legal assault on the Defense of Marriage Act and puts added pressure on the Obama administration to stop defending the law. Attorney General Eric Holder said in Feb-

ruary that the U.S. Department of Justice would “remain parties to the cases and continue to represent the interests of the United States throughout the litigation” despite the administration’s view that the law was unconstitutional. After the administration’s announcement, a House of Representatives committee hired former Solicitor General Paul Clement to

defend the Defense of Marriage Act against federal court challenges. In May, U.S. Trustee Peter Anderson, who represents the federal government’s bankruptcy interests in Southern California, told the judge the Obama administration opposed the gay couple’s petition to give the Congressional committee a chance to join the case in support of the Defense of Marriage Act. Justice Department spokeswoman Tracy Schmaler declined to comment. The judge noted Monday that the committee didn’t respond to requests to join the case. Brendan Buck, a spokesman for House Speaker John Boehner, said the committee

can’t afford to respond to every legal challenge to DOMA. “Bankruptcy cases are unlikely to provide the path to the Supreme Court, where we imagine the question of constitutionality will ultimately be decided,” Buck said. “Obviously we believe the statute is constitutional in all its applications, including bankruptcy, but effectively defending it does not require the House to intervene in every case, especially when doing so would be prohibitively expensive.” Clement and the committee have responded to at least seven separate legal challenges across the country, lawyers said. Without hearing a detailed defense of the 15-year-old law, Judge Donovan ruled Monday the Defense of Marriage Act violates the couple’s equal protection guarantees. He added there is “no valid governmental basis for DOMA.” Nineteen of Donovan’s 23 colleagues on the Los Angeles bankruptcy court signed the opinion. The couple’s lawyer, Robert Pfister, said that’s significant because it shows an overwhelming majority of that court is prepared to rule similarly. “Litigating constitutional issues takes a lot of time and money,” Pfister said. “To have 20 judges sign on sends a strong message that almost the entire bench has decided this important constitutional issue.”

2010 Census: Early Hint Shows

.S. Census 2010 data on samesex couples has begun trickling out and, if the first two states are any measure, there are dramatically more same-sex couples in the United States than previously counted. The U.S. Census Bureau is releasing 2010 data state-by-state on a rolling basis. It released numbers for the first two states— Alabama and Hawaii—June 16. The Williams Institute, a nationally respected public policy research organization focused on issues related to sexual orientation, released “snapshots” of the data related to same-sex couple households. The data show that, in 2010 in Alabama, the Census Bureau found 11,259 households headed by same-sex couples. That number is 3,150 (or 39 percent) more than

in 2000, when the Census Bureau found 8,109 same-sex unmarried partner households in Alabama. In 2010 in Hawaii, the Census Bureau found 4,248 households headed by a samesex couple –1,859 (or 78 percent) more than the 2,389 same-sex unmarried partner households reported in 2000. The data released thus far this year by the Census Bureau reports all same-sex couple households, regardless of whether they are legally married, in a legally recognized civil union or domestic partnership, or in a relationship that has not been formalized by law. Gary Gates, the lead author of the “snapshot” analysis, said the Census Bureau is expected to provide a breakdown of the data of just same-sex married couples later this year. But he said that breakdown will not be an accurate reflection of how many samesex couples have marriage licenses because

A diplomat from the northwest African state of Mauritania called the resolution “an attempt to replace the natural rights of a human being with an unnatural right.” Indicating that Washington plans to keep up the pressure on this issue, Clinton said the U.S. “will continue to stand up for human rights wherever there is inequality and we will seek more commitments from countries to join this important resolution.” One of her senior diplomats, U.S. Deputy Assistant Secretary Daniel Baer, told reporters the Obama administration had chosen what he described as a “course of progress” on gay rights, both domestically and internationally. In March, the U.S. issued a nonbinding declaration in favor of gay rights that gained the support of more than 80 countries at the U.N. This has coincided with domestic efforts to end the ban on gays openly serving in the U.S. military and discrimination against gays in federal housing. Asked what good the resolution would do for gays and lesbians in countries that opposed the resolution, Baer said it was a signal “that there are many people in the international community who stand with them, and who support them, and that change will come.” “It’s a historic method of tyranny to make you feel that you are alone,” he said. “One of the things that this resolution does for people everywhere, particularly LGBT people everywhere, is remind them that they are not alone.”

Flying the Colors By Leslie Robinson I mentioned it. “We strongly support a diverse and inclusive culture at the Richmond Fed and have learned that it is important to value and embrace differences, both seen and unseen,” said Sally Green, the bank’s chief operating officer. “We are flying the ‘Pride’ flag as an example of our commitment to the values of acceptance and inclusion.” Aren’t those great sentiments? I’d like to work for Ms. Green, if I didn’t have such a blanket distrust of any entity that might’ve contributed to the world’s economic collapse. Forget I mentioned that, too. So there was the rainbow flag, dressing up the downtown concrete monolith in Virginia’s capital city. And there were members of The Family Foundation, enjoying their new headquarters until they looked out their west-facing windows and spotted the flag.

It’s a real shame the rainbow flag won’t permanently mar the view of these guardians of family values. They blogged their displeasure, noting bank executive Sally Green’s statement about inclusivity and complaining, “Apparently that inclusivity doesn’t apply to those who do not condone homosexual behavior.” Honestly. How can you condone or not condone a naturally existing group of people? It’s like saying you don’t approve of redheads, or left-handers, or Pygmies. Don’t forget I mentioned that. The Cavalier State’s protectors pledged stiff upper lips: “At The Family Foundation, we will simply choose to use this flag . . . as motivation for the work that lies ahead.” Namely attacking gay, redheaded, left-handed Pygmies. Bob Marshall, a Republican member of the Virginia House of Delegates, pitched in with a hysterical response to the Pride flag. He dispatched a letter to Jeffrey M. Lacker, the president of the Federal Reserve Bank of Richmond. Marshall misspelled Lacker’s name, but hey, he was so upset he could hardly think straight. t the start of June, citizens of Richmond, Va., noticed an addition to the flagpole outside the Federal Reserve Bank of Richmond. Underneath the American flag waved a rainbow flag. The two banners, Old Glory and Newish Pride-y, flapped in the breeze. Then gums flapped, too, and within seconds Richmond had its very own flag flap. A flap over the fag flag. Gag. I’ll stop now. The rumpus began when PRISM, a yearold employee LGBT group at the Federal Reserve Bank of Richmond, asked for the flying of the rainbow flag to mark Pride month. The bank, a private financial institution located downtown, agreed to fly the flag for all of June, reported Richmond.com. Richmond’s Pride actually takes place in September, but that’s not the point, so forget

Marshall continued, “The Richmond Fed’s endorsement of costly, anti-social, immoral behavior is rejected by 6,000 years of Western Religious and moral teaching. You want the American people to trust your judgement in economic matters when your spokesperson celebrates an attack on public morals?” That Virginians trust Marshall’s judgement enough to elect him is what is truly scary. The legislator ended his fanciful rant with, “Mr. Lacke (sic), take down that flag!” As of this writing, the bank hasn’t. I’m fascinated to see if it withstands the attacks, and if it hoists the flag next year. I know one thing: These colors don’t run. Unless you wash them in the wrong temperature.

ew York City is one of those places that makes you feel at home every time you visit. Okay, I may be a little prejudice, having been born and raised there, but there is still something about the Big Apple that cannot be replicated in any other city. Having relocated after college, one of my favorite things to do when visiting the city is to take a day or two to tour one of the numerous fine art museums. My first stop was the distinguished Metropolitan Museum of Art.The MET is one of the world’s largest and finest art museums, comprising of more than two million works spanning 5,000 years of world history. The two-million-square-foot building spans four blocks and represents a series of collections, each of which ranks in its category among the finest in the world. The museum holds nearly 2,500 European paintings to form one of the greatest such

collections in the world—Rembrandts and Vermeers are among the wonders, not to mention the collection of Impressionist and Post-Impressionist canvases, Egyptian, Islamic, Asian, Medieval and Renaissance art. Just a few blocks away is the Guggenheim, completed in 1959 by Frank Lloyd Wright. The museum is called one of the 20th century’s most important architectural landmarks. The museum houses a renowned collection of art, which ranges from Impressionism through contemporary art. And what journey to New York would be complete without a little shopping spree? Of course, the choices are abundant depending on taste and price point, so be sure to research the city in detail to discover what neighborhoods fit your profile. One of the most iconic landmarks in the city is Macy’s Herald Square. The 10-story structure, comprising of an entire city block, is a must-see attraction. With numerous

A

s a guest of the Key West Business Guild during their annual Pride Fest last week, I did not object to being introduced to some of the local restaurants that were gay-owned or gay-friendly. I don’t resent the few extra pounds I acquired as a result of this indulgence -- despite having had a bicycle and an Island House gym pass -- because what I sampled was extraordinarily good. In fact, the other travel writers at the table with me agreed that Key West cuisine seems to have improved [g]astronomically in the last year. I don’t know why this has happened— and there have always been some great Key West dining options— but I am not complaining. Here are four recommendations for eating the best of Key West. The Flaming Buoy (TheFlamingBuoy.com) is a comfortable spacious place dedicated to the premise that you should never have to shove your butt into the breadbasket of the adjacent table when you leave your

seat. The owner could easily wedge more tables into this homey space but he is more concerned with quality than he is with volume and turnover. Go here for that special celebration or romantic dinner. Get the Lobster Mac N Cheese and the caramelized bacon-wrapped scallops. Antonia’s (AntoniasKeyWest.com) is located on Duval Street and is therefore livelier and able to handle the larger numbers that crowd Key West’s biggest tourist street. Surprising is the fact that Antonia’s handles this without sacrificing quality. I honestly would have passed it by with the assumption that any Italian restaurant this big and centrally located would probably be inferior. I was happily proven wrong, and when I informed the owner of my affection for bold flavors before letting him select our dishes, he did not disappoint me. Get the calamari and the shrimp and their signature salad.

Trying both places with a prospective husband will tell you what your domestic kitchen will be like after the honeymoon. If he loves Antonia’s, learn to use garlic. If he prefers Azur, learn to work with rosemary. If he is like my husband, have both on hand and let him do the cooking. Try Azur’s salads and tapas. You can’t beat La Crêperie Key West (lacreperiekeywest.com) for a breakfast or brunch or just for excellent coffee and

something sweet. It’s located on Petronia Street in my favorite Key West neighborhood, soulful Bahama Village. Everything they put on our table was wonderful.The pâté, the crêpes, and the eggs were dreamy.This is the kind of charming French bistro that makes you linger. I hope it never changes. Those are my top four recommendations but I’d like to add a mention of that always delightful, casual and authentic Cuban experience called El Siboney (elsiboneyrestaurant.com.) If the Guild had not chosen to include it in their tour, we’d have demanded it. Get the Siboney steak, the yellow rice and the plantains, and don’t pretend you don’t want it when they offer you more of their bread.

Girl Play, which takes place June 24-26 at the Pride Center at Equality Park in Wilton Manors, is an illustration of why The Women’s Theatre Project was once named the Best Place to Meet an Intelligent Lesbian by New Times. Last week, I went to Bill’s for the first time as a hungry customer, as opposed to a thirsty one and decided to order their quadruple burger. There are two things about me you might not know. One: my metabolism is so high I can eat anything and still look like a rail. Two: I’m a sucker for a delicious hamburger. When they brought the bad boy out, I immediately cut it in two, knowing there was no way something that big… well enough of the innuendo, you get the picture. Needless to say, this skinny mini finished the entire thing in five minutes. I found out afterwards that all of their burgers are called “crack burgers” and for good reason. I’ve been back four times since. I’m pretty sure I’m headed over there as soon as I get off of work. Atomic Boom on a Monday and Tuesday is the place to be. They’ve got the best song selection in town and the audience is so animated and usually hammered that there’s no reason for butterflies to creep up in your stomach before you take the mic. I’ll recommend getting there early if you’d actually like to sing and not wait for 40 minutes before your name is called, but if your sole purpose is to make fun of listen to the other performers, then anytime after 9 is perfect. urricane Andrew in 1992 showed everyone how destructive a hurricane can be, as did Hurricane Katrina in 2005. The next big one could arrive this year and everyone needs to be prepared. All South Florida residents should be ready for hurricane season 2011. To stay safe this hurricane season, you must develop a hurricane plan. The first step of being prepared for hurricane season is to develop a Hurricane Plan for you and your housemates or family. Here are 10 easy steps you should follow to develop your plan. STEP 1 - Hold a Family or Household Meeting. Discuss

the hazards of hurricanes. If you have children, be sure to get them involved. Start a written list of things you’ll need to do and encourage everyone to contribute ideas. STEP 2 - Stay or Go. Determine if you live in an evacuation zone. Plan where you will go in an evacuation. Best choice - family or friend’s house or hotel outside the evacuation area. Let others know your hurricane plan. Establish an out-of-town contact. STEP 3 - Protect Your Assets. Inventory your home posses-

sions and videotape or photograph items of value. Review your insurance policies. STEP 4 - Assess Your Home.

Look for vulnerabilities. Evaluate the condition of your roof, windows, garage door, landscaping, etc. and determine what actions you will take. STEP 5 - Protect Your Vehicles. Decide where you will

store or park your vehicle, boat or RV. Review vehicle insurance policies. STEP 6 - Secure Your Home.

Decide what actions you will need to take to protect your home including shutters, generator and tree-trimming. STEP 7 - Special Needs. Does anyone in your home have special medical needs? If so, make arrangements in advance to accommodate

those needs. Certain shelters are equipped to take care of individuals with special needs. STEP 8 - Plan for Your Pets. Determine how

you will address your pet’s needs and make a plan in case you have to evacuate. STEP 9 - Gather Supplies.

Important Registrations If you have special medical needs, it is important that you register for the County’s Vulnerable Population Registry at Broward.org/registry or call 954-831-4000 the Broward County Call Center. Being on this registry list will help emergency responders to make the best decisions for your individual needs. Residents with medical conditions that require a greater level of care than that provided at a Mass Care shelter, but do not require hospitalization, can register for a Special Medical Needs Shelter. These shelters offer basic medical assistance and monitoring. Seeking Shelter from the Storm Broward County has several options when it comes to shelter. If you feel safe in your home and it is located outside an evacuation area, you can shelter there. Residents with medical issues that require a higher level of care should contact the Broward County Human Services Department at 954-3576385 or TTY 954-357-5608 for information on staying in a Special Medical Needs Shelter. Staying in a Red Cross Mass Care Shelter should be your final options.
