he Obama Administration made a blockbuster announcement last Wednesday, saying it has concluded that one part of the Defense of Marriage Act will not be able to pass constitutional muster in the 2nd Circuit and that Department of Justice would not defend that part of the law in two pending cases in that circuit. It was a dramatic, unexpected, and significant move by the Obama administration and one that could trigger maneuvers by DOMA supporters to appoint an intervenor to defend the law. But beyond the eventual legal consequences of the announcement, the political impact was characterized by most LGBT leaders as historic and monumental. “This is a monumental turning point in the history of the quest for equality for lesbian, gay and bisexual people,” said Jon Davidson, legal director for Lambda Legal Defense and Education Fund. NCLR Executive Director Kate Kendell put it even more strongly. “The President’s leadership on this issue has forever changed the landscape for LGBT people in this country,” said Kendell. “For the first time, the President and the Department of Justice have recognized that laws that harm same-sex couples cannot be justified. This is the beginning of the end, not just for the mean-spirited and indefensible Defense of Marriage Act, but for the entire panoply of laws that discriminate against same-sex couples.” Attorney General Eric Holder announced Wednesday that the Department of Justice would not defend the constitutionality of Section 3 of the Defense of Marriage Act (DOMA) in two of the four cases where that section of the law is currently under challenge. Those

two cases are Pedersen v. OPM, filed by Gay & Lesbian Advocates & Defenders, and Windsor v. United States, filed by the ACLU. Two other cases – in the First Circuit – also challenge Section 3, which prohibits federal recognition of any same-sex marriage, as does a more narrow case, Golinski v. OPM, in the 9th Circuit, at the district court level. DOMA Section 2, which enables states to ignore valid marriage licenses issued to same-sex couples from other states, has not yet been challenged in court and Holder made no reference to it. Since entering the White House, President Obama has said that DOMA should be repealed, but his administration continued to defend the law, saying, through various spokespersons, that Obama was concerned about setting a precedent that would make it easier for some future administration to pick and choose which laws it would defend. Last summer, asked whether there isn’t a difference between enforcing existing laws and defending them in court, his Domestic
Policy chief, Melody Barnes, said the president believed DOMA and Don’t Ask, Don’t Tell to be “discriminatory” but that he had not yet “made an argument” concerning their constitutionality. “[W]e believe we have an obligation to defend the law if Congress had a rational basis for passing the law,” said Barnes. In his announcement Wednesday, Attorney General Holder noted that the administration would still defend DOMA Section 3 in the two First Circuit cases because the First Circuit has ruled that rational basis is sufficient justification for treating people differently based on their sexual orientation. (He was apparently referring to the unsuccessful class action case challenging Don’t Ask, Don’t Tell). But Holder also noted that DOJ attorneys would argue that the court should, instead, apply a stricter test for DOMA. Lambda Marriage Project Director Jenny Pizer said the First Circuit would make its own decision about whether to adopt Holder’s view. “Any court is going to make its own determination about what the law requires,” said Pizer. “The government is usually given particular credence, but it is always court’s job to decide what the law requires.” But Pizer noted that the increasing volume of voices declaring the injustice of DOMA can have an influence, particularly given that the arguments made in support of DOMA “are not even coherent.” It is possible –just as happened in California— that some other entity might attempt to mount its own defense of DOMA in the pending cases. Last October, U.S. Rep. Lamar Smith (R-Texas) filed a motion in the two First Circuit cases, seeking to be named intervenor-defendant. Smith, aided by the right-wing Alliance Defense Fund, said at the time that the Justice Department was
providing “no defense at all” for DOMA. He withdrew his motion a few weeks later, without comment. Lambda’s Pizer said she thinks it is “very likely” someone will ask the First Circuit for permission to serve as a defendant-intervenor in the DOMA cases. And she noted Congress has the authority to appoint its own counsel to defend the law. Such was the development in the California same-sex marriage case, Perry v. Schwarzenegger. The federal district court allowed the group that sought passage of Proposition 8, Yes on 8, to defend the law at trial. The 9th Circuit recently asked the California Supreme Court to determine whether any state law gives Yes on 8 the authority to appeal that district court decision in the federal appeals court. A three-judge panel of the First Circuit is currently receiving written briefs from both sides in the DOMA cases and, presumably, will now receive a written brief from DOJ arguing that DOMA Section 3 should meet a heightened standard of review. NCLR’s Minter said he believes the law “can’t survive” that standard. Mary Bonauto, lead attorney on the DOMA cases for GLAD, could not be reached for comment. But ACLU Executive Director Anthony Romero, executive director of the ACLU, which has filed one of the Second Circuit cases, praised President Obama for doing “the right thing.” Romero said President Obama’s action has “just propelled gay rights into the 21st century, where it belongs. Our government finally recognizes what we knew 14 years ago — that the socalled ‘Defense of Marriage Act’ is a gross violation of the Constitution’s guarantee of equal protection before the law. DOMA betrays core American values of fairness, justice and dignity for all, and has no place in America.”

ormer President Bill Clinton was given the nickname the first “black” president. President Obama, as the first black president, may one day be given a nickname of his own: the first “gay” president. In just two years he’s already proven to be the gay friendliest president. Obama’s decision last week to stop defending the constitutionality of a portion of the controversial Defense of Marriage Act came as a surprise and shock to the LGBT community. Courageous, historic, monumental, and extraordinary were just some of the words used to describe the announcement. Director of Get Equal, Robin McGhee agrees Obama thus far has been the gay friendliest president, but she added: “I don’t believe there was a high bar to judge off of though.” She said there’s still more work to be done for LGBT rights. “My role is to fight until we have everything,” she said. “Yes I do believe we are making progress but at same time there are young people killing themselves. So it’s never going to be fast enough.” The LGBT community generally loved President Clinton, but even as much as he may have supported the community he put in to place two laws that gays and lesbians have been fighting against the day they were implemented – Don’t Ask Don’t Tell and DOMA. In just two short years though Obama has already undone Clinton’s DADT and hammered the first nail in DOMA’s coffin. Besides those two feats he signed into law the Matthew Shepard and James Byrd, Jr. Hate Crimes Prevention Act; signed a memorandum expanding federal benefits for the same-sex partners of Foreign Service and executive branch government employees; and issued a Presidential Memorandum directing the HHS Secretary to ensure that hospitals allows partners of gays and lesbi-
ans to visit their loved ones in the hospital. In addition he’s appointed more than 150 openly gay people to office so far. And that’s only in two years. Clinton appointed 140 openly gay people over the course of eight years in office. To compare Obama to Clinton may not be fair though. They’re obviously serving in very different environments. Polls now show more than 70 percent of the population against DADT, and two polls last year, showed for the first time, a majority of American’s supporting gay marriage. In 1996 when Clinton signed DOMA in to law one poll from Gallup showed 68 percent of American’s against gay marriage and only 27 percent in favor. Last year Gallup showed 53 percent against and 44 percent in favor. While all of the polls may have different numbers the trend remains the same – more American’s supporting gay marriage. Obama’s biggest criticism in regards to gay rights so far seems to be that he’s moving too slow as McGhee pointed out. Obama took a calculated and methodical approach to repealing DADT that started with a yearlong study. With his recent DOMA announcement it appears he may be taking the same approach. His decision only affected two DOMA cases making their way through the courts. However, just two days after the announcement the White House announced that they would also stop defending DOMA in a third case. The ripple effects have already been felt. “This wasn’t politically necessary,” said openly gay Congressman Barney Frank of Massachusetts. “[Obama] didn’t do this for political reasons. This shows the president is committed to our rights. It’s the best you can get from the federal government and it was a smart strategy from the legal team.” It’s too early to tell what significance last week’s announcement will have in the long continued on page 34

Here in Florida, gays can now legally adopt. But you do not see our holy governor rushing to the table to offer up same sex marriage. The last thing on his list is an agenda for equal rights. In fact, in many states that have elected Tea Party and conservative Republicans, there are legislative moves to knock out progressive LGBT reforms. He has won that honor by announcing that his administration will no longer defend DOMA- the ‘Defense of Marriage Act.’ There is no defense for it, lawyers say. They opine that it is unconstitutional. It is a courageous legal position, because it is customarily the duty of the Attorney General of the United States to defend the laws passed by Congress. It is of historical import and monumental significance that this administration has chosen to stand by the courage of its conscience.

Last night’s “Dan Rather Reports” looked at a disturbing trend on the rise in South Africa – lesbian woman are being attacked by men who believe that rape can “cure” or “correct” the victim’s sexual orientation. These attacks are being referred to as “corrective rape.” With homosexuality banned in 38 African countries – and punishable by death in three of them – gay rights are hot button issues on the continent. And, even though South Africa is the only country in Africa that specifically bans all discrimination based on sexual orientation, there is still an alarming frequency of these attacks on lesbian women. Barack Obama has not just named a gay man as his social secretary, he has appointed gay women to posts as U.S. Attorney in one state and U.S. Marshall in another. Gay men have been nominated to our federal courts as well, and the LGBT community has found a receptive and active voice in the White House. We can be proud of our progress and encouraged by our President. We can be emboldened by legislators and leaders who have undertaken the cause of equal rights for all. We have court battles to fight, but reasons to appreciate what we have won and are winning at home, even in Florida, where it took thirty years, but gay couples can now legally adopt children. Beyond our shores, outside of Western Europe, still light years ahead of us, the world is still cruel for the LGBT community. The Internet has made it clearer, and the hate in Uganda today can be tweeted around the world in seconds. As long as we have mayors in Moscow defiling us, Arab countries lashing us, and African communities killing us, there is no time for complacence and comfort. We still have wars to win.

he public school teachers in Wisconsin are not responsible for the credit collapse, the national unemployment rate, the fall of the industrial sector or the fiscal crisis. Allowing them to bargain collectively has not bankrupted Wisconsin. The declining tax revenues have nothing to do with the fact that highly educated and trained professionals are earning a decent wage, albeit less than they would in the private sector. So why are they being blamed and scapegoated? Why are they in the center of the storm over our fiscal future? Where are the Wall Street banks for whom there was no limit to greed? And most important: Why should our children pay for this? Make no mistake: They will pay. I saw Fox News Channel’s Megyn Kelly drag the president of the teachers union in Wisconsin over the coals and then some when he refused to condemn what is being reported as resorting to phony sick days to allow teachers to go to Madison to protest. Is it wrong to not show up for work so you can protest? Of course it is. The governor isn’t paying for that; you’re not getting even with him. It’s the kids who sit staring blankly at a substitute who pay. But I can certainly understand the frustration of dedicated teachers at being the butt of bad politics. Everyone likes to talk about bad teachers. However many there are, is too many, and they should be fired. But most teachers, the overwhelming majority of teachers, are dedicated men and women working against incredible odds to do right by their students. The teachers I know arrive early and leave late. They bring with them school supplies that they buy out of

their own pockets. They make themselves available to parents and students long after the school day ends. They are as frustrated by the bureaucracy in large school systems as anyone. Many of them, including many very good ones, give up within five years. How will taking away their collective bargaining rights change that? Did I miss the part in this debate where we thank teachers for taking on the social ills no one else wants to touch? The part where we express our gratitude to them for taking care of and trying to teach kids who come to school scared and hungry and unable to read or write? Was I not listening when someone made the point that teachers are the foundation of our nation’s future? There’s plenty of blame to go around for what’s gone wrong with the economy. You can blame Bush or Obama, Wall Street or the regulators. You can blame Fannie and Freddie and Congress and the Fed. But how do we get off blaming public school teachers? People keep asking me how this will play politically: Will it help or hurt the Democrats in the next election? Will it help or hurt the union movement nationally? The truth is that I (and, dare I say, most of the people opining) have no idea. Those are not even the questions that trouble me most. What worries me is the fact that when you turn teachers into scapegoats for problems they had no role in creating, they’re likely to do more than call in sick to go protest. At a certain point, like others who feel their work and commitment are neither recognized nor rewarded, they will simply quit. Frankly, I wouldn’t blame them. But it means that whether it’s the Republicans or the Democrats who gain, it will be the kids who pay.

large and growing number of local gay men and women boldly park their cars in front of the South Florida Center For Cosmetic Surgery, next to Fort Lauderdale’s Galleria mall. They come for the regular acquisition of the services and products of Stephane Merot who directs the “Medical Spa” at the center. They approach his door without hiding behind dark glasses or under big hats, and they leave injected, peeled, lasered, exfoliated, contoured, refreshed and damn proud of it. In the comfort of the spacious waiting rooms of the spa, the happy-faced clients are representative of a broad demographic that excludes only that shrinking sector of those who claim they would never have any “work” done. The facilities are polished, clean, modern, welcoming and assuring. Merot’s appearance matches these surroundings, and would easily relax a nervous firsttimer. He is fresh-faced and luminous, and he laughed while gladly admitting that he does make use of his own procedures. He is 36-yearsold and of the “Don’t wait till it’s too late” school of treatment. Merot has been the director of the spa for one year. He was born in Paris, and grew up in the Ivory Coast where his family was in the pharmacy business. “The Ivory Coast, which is in turmoil right now, was a beautiful country to grow up in. I lived there till I was 16, and then went to boarding school in Paris and then came to the USA for training in International Studies and Spanish. When I came to Florida, I got into this business. I have always been
attracted to making people look better. Before this, I ran three medical spas.” Merot has always been in the management part of the cosmetic procedure business, and does not actually perform the procedures the clients receive, but he is meticulous in his oversight of all work performed, and in his concern for safety and for client satisfaction. “Our employees are skilled in all the newest techniques involving injectables and lasers.” Sun damaged skin is obviously an important issue in South Florida. The center offers a number of different treatments and Merot who is pale rather than tan echoes the common warnings about the effects of too much sun. “It’s all about not waiting to take good care of your skin. There is a limited amount of reversal that is possible when sun damage is extreme.” Merot described his typical client. “Anybody from age 20 to 80. We are getting more and more men, and we have obviously a large gay clientele. The center has been open for about 15 years, and has two operation rooms. All the surgeries are performed here, on these premises”. Merot says that because theirs is a high volume business, the center is able to maintain attractive prices. “This is not the kind of place where insurance covers the process, so we have to be affordable.” Merot sees an increase in the number of requests for procedures that are either minimally invasive or entirely non-invasive, and which require little to no recovery time. He opened the door to the room containing the spa’s new and gleaming Zerona machine that slims the body with no invasive surgery, allowing patients to continue their daily routines uninterrupted by pain, wounds or special garments. Zerona uses a scanner that emulsifies adipose tissue. It emits five
cold diode laser beams targeted at the area of concern. The excess fat is flushed from the body through its normal detoxification. “Our most popular procedures are our facial injectables which are lasting longer and longer. We have some that are semi-permanent and will last for three to five years. Our faces continually change, so a permanent treatment is not always a good idea. With new clients, I try to understand why they are concerned with certain features. I start gradually with temporary stuff to see how it works on them. People sometimes want things that are not right for them. You have to educate them.” Merot started receiving botox shots when he was 24, and explains that botox will not just calm a furrowed brow, but will prevent the formation of wrinkles. magine being old, sick, confused and alone without a roof over your head when winter weather arrives. That’s exactly what happened late last year to a well-known gay political activist who had lived in Dallas for many years. It’s unclear how much he actually understood about his circumstances because he was suffering from either the early onset of Alzheimer’s Disease or some other form of dementia — a condition that had left him unable to survive alone or to seek help.

After he came to the attention of a police department social worker who tried to locate help for him, the activist eventually was admitted to a residential facility where he is now receiving the care he needs. A plea published last year by a gay newspaper at the request of the social worker for information about the identity of his family members went unanswered. The activist
had mentioned in the past he was the father of a grown son, but he has never been located, according to the social worker. The only response to the newspaper’s blog post was from an individual who had found photographs and other belongings of the activist on a curb and wanted to return them to him. Someone apparently dumped the items there after he was evicted from his apartment sometime last year. The activist had been on the streets for months when law enforcement officers picked him up because he allegedly tried to break into a car. The activist may have been confused and only seeking shelter in the car, the social worker said. He was arrested and taken to jail, where a nurse, who realized he was suffering from dementia sought help from the police department’s crisis intervention department. It’s shocking that someone who had run for political office on the Democratic Party ticket, worked with police and other local officials to benefit the community and participated in other LGBT endeavors could wind up helpless and on the streets. Neighbors of the activist contacted the social worker when the newspaper blog post was published and informed her about his eviction. She suspects that he may have gotten evicted because his dementia left him too disorganized to pay rent and take care of his personal business. The activist’s story reveals that there
doesn’t appear to be many resources dedicated specifically to LGBT seniors. That’s a cause for great concern because they are more likely to become estranged from their families than their straight counterparts. There have been efforts in recent years by concerned people to raise interest in LGBT retirement communities of townhouses, apartments with full-care facilities that would serve people of all financial situations. There have been retirement communities built, but so far there has been little success in terms of benefiting financially needy LGBT seniors across the country. Many larger communities’ resource centers reach out to LGBT seniors, but the focus is more on learning, entertainment and social activities, according to the organizations’ websites. In comparison, the Los Angeles Gay and Lesbian Center’s Senior Services program employs four workers to assist gay people 50 and older with social, educational and support issues. About 70 events are held
monthly at the center, which is a much larger and older operation than most other gay centers in the country. The case management services and referrals sponsored by the Los Angeles group’s program addresses affordable housing, benefits, home health assistance, bereavement, isolation, mental health and legal issues, according to the organization’s Web site. The Los Angeles center’s operation is a good model for other LGBT communities to consider implementing – especially in the area of senior services – as leaders look to the future. The number of aging LGBT people is only going to grow in the coming years as the baby boomers continue to mature. It only makes sense to support the idea of providing services to our community’s older population because everyone who lives long enough is going to grow old eventually. And anyone who hasn’t started planning for their future ought to take a lesson from what happened to the Dallas activist and start thinking along those lines.

he Washington Post has finally responded to SFGN’s repeated attempts to contact them for a comment on a news story they posted two weeks ago that an SFGN investigation revealed to be fake. “I wrongly assumed the Toronto Sun – which we cite as our source – had done its due diligence here,” Post reporter Liz Kelly wrote. “It’s a good lesson in not relying on anyone else’s fact-checking.” SFGN is still waiting for a response from the Toronto Sun. The article in question was written by Fernando Palazzo of Examiner.com. The story involved a poll conducted by the Orange County Equality Project, which claimed Britney Spears was the gay community’s greatest icon. The Toronto Sun picked up the news story as well as several other international news organizations.
An investigation by SFGN revealed that the Orange County Equality Project is most likely either fake or a one-man show. Palazzo initially did not respond to SFGN’s repeated attempts to contact him for more information about his story and the group in question. However, after the story broke online he contacted Publisher Norm Kent and at first threatened to file a lawsuit. After several more e-mails back and forth he provided a link to the Orange County Equality Project’s website, which turned out to be nothing more than a WordPress blog titled “Orange County Equality Project,” authored by a Joel Waddell. In Palazzo’s last e-mail to SFGN he claims he was the one duped by his friend Waddell and the Orange County Equality Project. In that e-mail to Kent, Palazzo admits, “I am going to write a blog entry about the scam and how I fell for it. I know who Joel Waddell is, but was never ‘great friends’ with him…I
made an honest mistake….What about the people from the mainstream media who picked this up without even questioning the sources? Although the movie failed to take home any gold statues, the occasion gives us a chance once again to make lesbian moms and other LGBT parents a part of a national conversation. Here are some of the lessons Kids can teach us—and that we can teach others using the film as a starting point. Our kids are indeed all right. The film is notable for being one of the few representations of lesbian mothers in film or television where the women weren’t pregnant, trying to get pregnant, or had very young children. Kids instead show lesbians who have successfully raised children to near adulthood. But they’re not perfect. Real-life gay dads are at least experiencing a celebrity surge, with Elton John, Neil Patrick Harris, Ricky Martin, Rufus Wainwright, and their respective children much in the news. Transgender parents, however, get much shorter shrift. Even when movies try to portray them in a positive light, as in 2005’s Transamerica, the focus is almost always on the shock when a parent comes out as transgender, and not on the ordinary, everyday parenting they do in the face of misunderstanding and discrimination. We’re not all middle class and white. Even leaving aside the wealth of the aforementioned celebrity dads, Nic and Jules’ spacious, well appointed home is not typical of LGBT parents. New research from the Williams Institute at UCLA has shown that one in five children being raised by a same-sex couple
lives in poverty. Almost four times as many lesbian couples raising children (and twoand-a-half times as many gay male couples with children) receive public assistance versus opposite-sex married couples with kids. And while the number of non-white LGBT parents in film and television is pitifully small, the Williams research has also shown that black or Latino same-sex couples are more than twice as likely as white ones to be raising children—and more likely to be struggling economically. Not only that, but same-sex couples in Southern states such as Arkansas, Louisiana, Mississippi, and Texas are more likely to be raising children than those in “gay meccas” such as the West Coast, New York, and New England. While The Kids Are All Right may have been a step forward in visibility for LGBT families, then, I’ll also be hoping for a future film about a black, working class, lesbian couple in Mississippi, one of whom is transgender, trying to make ends meet and raise their children with integrity while fending off slurs, bullying, and ostracism from their neighbors. If the name wasn’t already taken by another Best Picture contender this year, it could be called True Grit.

nforgettable. That’s only word that can pretty much sum up the swimming with the dolphins program at the Miami Seaquarium. Sales Manager John Fugate and I had the opportunity last week to visit the Seaquarium and literally swim with the dolphins. “I’ll never forget it,” Fugate said. One of the members of our group Alena Cvetkovski of Pompano Beach echoed those sentiments, “It was unforgettable. I’ve been waiting for four years to do this.” The experience includes 30 minutes in the water with the dolphins where they will kiss you, allow you to hug them, and shake your hand. You’ll get to feed them and watch them perform a variety of other tricks. There’s also a 15-minute educational program before the swim. “The dolphin ride was my favorite part,”

Alena said. “But I loved the kiss too.” Alena was all smiles after the program. And so was Fugate who acted like a child exploring a candy store for the first time. “It was awesome. I had a great time,” Fugate said. “Besides the dolphins, the trainers were helpful and interactive. They really taught us a lot.” It was an experience Fugate said he’ll never forget. “I think it’s definitely something every gay man in their 20s should try, because I had a blast, that’s for sure,” he said. “I can’t wait to go back with my boyfriend.”

Like the others, one of my favorite parts was hanging on to the dolphin’s dorsal fin for the ride of my life. But just having the opportunity to watch these magnificent creatures communicate with their human trainers was also amazing. There’s no doubt these animals are far more intelligent than
we can fully understand. For the most part the trainers use hand signals, and a whistle to communicate with the dolphins. They use positive reinforcement to get the dolphins to do tricks. Each successful trick is rewarded with a fish. If the dolphin isn’t successful the trainer simply looks away for a few seconds and doesn’t hand out a treat. In one instance our dolphin wasn’t too keen on receiving hugs. She had to be coaxed several times before allowing one of the couples in our group to give her a hug. The trainer could sense the dolphin’s discomfort and didn’t push her. Instead she was patient and allowed the dolphin to go at her own pace. Eventually the dolphin stayed still long enough to complete the hug. Normally the cost is $199 per person for the Dolphin Odyssey program. Towels and a wetsuit are included. teve Stagon is a beautiful man, an eyecatcher in a crowd, whose handsome smile is a distraction from whatever he may be saying. Steve is neither vain nor overly self-conscious. In the mirror, he sees his flaws rather than his assets, and as someone who has lived with HIV for many years, he is not happy with the distention of his torso at the core of an otherwise lean and perfectly proportioned body, maintained by careful diet and exercise. Steve is one of hundreds of thousands of men who wear the scarlet letter of their HIV infection. HIV-associated lipodystrophy, the visible result of the virus and the drugs that treat it, is the redistribution of body fat, with fat disappearing from some areas (facial wasting) and increasing in other areas (bellies enlarged with visceral fat, and pads of fat on the back of the neck referred to as a “buffalo hump”). The social consequences of this disfigurement, and the painful marginalization of the stigmatized men whose HIV status is proclaimed by it, are distressing for its victims, but the condition can also be disabling, with life-challenging cardio-vascular results. As Steve says, “After all I have been through and all I have survived, I do not want to let something like this kill me. This is not just about looks or vanity. This is about real health.” Steve is the moderator and facilitator of POZitive Attitudes, a topic-driven and peer-led support group for gay and bi men who are infected with or affected by HIV/ AIDS. The group, which has been meeting every Wednesday for 10 years, provides a confidential safe-space for sharing knowledge, friendship, support and social activities including dinners and movie nights. The group convened this week at the Pride Center in Wilton Manors for a presentation about EGRIFTA by Vernon F. Appleby, R.N., Director of Clinical Research with the practice of Dr. Gary J. Richmond. EGRIFTA is the first FDA-approved treatment for lipohypertrophy, the belly fat-specific manifestation of the lipodystrophy syndrome. For many of the men in attendance who have been fighting HIV for much of their adult lives, and for whom lipodystrophy is a constant advertisement of their status, EGRIFTA may be a godsend.

Appleby discussed the differences between EGRIFTA and Serostim, a synthetic version of Human Growth Hormone that is FDA approved for the treatment of HIVrelated wasting and weight loss. In its trials, Serostim also reversed the effects of lipodystrophy, but the FDA was not convinced that the risks associated with Serastim outweighed its benefits with lipodystrophy, and did not approve it for that purpose. The differences between Serostim and EGRIFTA are significant. Serostim (generic name: somatropin) is a daily injection of a synthetic hormone that often comes with severe side effects including joint and muscle pain, swelling, and an increase in glucose levels in the bloodstream that can increase the risk of diabetes. The desired effects of Serostim begin to be visible after a few weeks on the drug, and the monthly cost is a staggering $10,000. EGRIFTA (generic name: tesamorelin) is a daily injection of a drug that causes the body to produce its own growth hormone. The possible side effects, including fluid retention, pain, rash and glucose intolerance, are mild in comparison to Serostim. The good results begin to be visible in three months, and the monthly cost of treatment is a less staggering $2,900. EGRIFTA will not reverse facial wasting and will not increase arm or leg width. It does not address the kind of fat that is acquired through overeating and not exercising. It specifically targets fat surrounding the internal organs in the abdomen. Appleby described the trials that led to the FDA approval of EGRIFTA. No one with an active malignancy was allowed to participate, and all participants had to be off Se-
rostim for at least 6 months. Those in the study were also asked to follow a healthy diet and exercise routine. The critical results were calculated not in weight but in fat distribution measurements. Steve was one of the participants in those trials who experienced a satisfying reduction of his lipohypertrophy, and then its unfortunate return after the treatments ended. Despite the fact that the FDA has approved EGRIFTA as a treatment for a syndrome that can be damaging to the cardio-vascular system, the biggest marketing hurdle is the refusal of many insurance companies to consider it anything more than a cosmetic treatment. Those insurers are also shortsighted in their refusal to see that erasing the scarlet letter of HIV infection will have a restorative impact on the daily lives of HIV-positive men, with an overall betterment of their health and a consequential lowering of other costly HIV-
related treatments and medications covered by most health insurance providers. During the question and answer portion of the EGRIFTA seminar, some spoke about the unclear possibility of a patient assistance program and about current monthly co-pays that vary drastically from a few dollars to a reported high of $600. In the USA, EGRIFTA is distributed by Serono Laboratories and is not currently available at some of the national drug store chains. Many HIV doctors are still unfamiliar with EGRIFTA, and their patients are driving their continued education with requests for the treatment. After the seminar, Steve reported that the attendees were satisfied that EGRIFTA’s benefits are clear, as was the fact that there is little that can be done but wait for the drug’s developer and marketer to battle successfully with health insurance companies that consider it an unnecessary cosmetic intervention, similar to liposuction. NNAPOLIS, Md. (AP) – Same-sex couples in Maryland would have the same full marriage rights as heterosexuals under a bill that cleared the Senate Thursday. If the House of Delegates approves it and the governor signs it, Maryland would be the sixth U.S. state to approve gay marriage. Opponents, including Senate President Thomas V. Mike Miller, D-Calvert, promised that if it does become law that a referendum question would be on the 2012 ballot so voters have the final decision. One Republican, Sen. Allan Kittleman of Howard, joined 24 Democrats to pass the bill with 21 opposing. A majority of 24 of 47 senators was needed. Senators amended the bill to include protections for religious groups and institutions to keep them from being forced to participate in gay weddings.
