ell I am sure you have all been waiting with baited breadth to find out which venues the Advocate named as the gayest cities in America. Not surprisingly, greater Fort Lauderdale came in as number 4, with Orlando, apparently because of Gay Days, garnering a second place finish. But how Salt Lake City claimed the winner’s trophy as number one is beyond me. I mean, just how many people in the LGBT community come clamoring to you that they just “must move to Salt Lake.” Thinking that that the advocate.com staff is really taking a long reach with that pick. They must have spent too much time at the Sundance Festival.

Speaking of Sundance, I love going there, but not this year. If I could I would definitely catch the debut of the Ira Sachs film, ‘Keep the Lights On.’ It chronicles an emotionally and sexually charged journey of two men through love, friendship, and addiction. One is an older lawyer and the other younger men, who meet through a casual encounter, but soon find a deeper connection and become a couple. Individually and together, they are compulsive risk takers, their decade long relationship fueled by drugs, sex, and self indulgence. Gosh, nothing like that ever happens here in South Florida. The Mack Mixer at the Outback on 17th Street rocked again yesterday. What a team of professionals. Meanwhile, congratulations again this year to the Liberty Suites for its 5th year as a Pink Choice Awards

Gay Men Don’t Get Fat, They Do Sit-Ups on YouTube winner, the group which rates the top gay and lesbian hotels worldwide. Sorry, but it is quite impossible to do a serious review of a book written by a Barney’s New York window dresser, and titled “Gay Men Don’t Get Fat.” But don’t tell that to Simon Doonan, who returns to the presses pitching an effeminate tribute to all things floral. The quite amusing takeoff on a 2004 book, “French Women Don’t Get Fat,” Doonan does have a premise, that French women simply cannot compete with gay men when it comes to matters of taste. Says Doonan, “We gays are the true oracles. We are the chosen people.” Doonan ruminates on personal style — plus food, relationships and more — in his latest tome (his sixth), which covers the rules gay men often adhere to in a tongue-in-cheek manner. “It’s probably the most demented book I’ve ever written,” he joked. Featuring chapters like, “Moobs (man-boobs) and Fat Asses” and “Macaroons Are So Gay,” it’s satire at its best — and most stylish. On the totally opposite side of the fence, an openly gay woman is campaigning to become Miss California. Mollie Thomas is a spirited 19 year old who was raised both on a horse farm in Pennsylvania and in Manhattan by an American mother and a French father. Thomas says, “My family is so open and accepting that I knew very young who I was and who I loved. “Growing up with a father in the travel industry, Thomas saw the world with her family and lived in Switzerland for the majority of last year. She also spent time in Thailand working on an elephant reserve and says, “The

She is currently taking classes part-time at UCLA, with aspirations toward political science or gender studies. Randy Phillips, the gay U.S. airman who became an Internet sensation after filming himself coming out to his father, just hours after the repeal of the military’s controversial “Don’t Ask, Don’t Tell” policy in September, is finding new ways to utilize his newfound fame. Now, the 21-year-old Phillips hopes to help his viewers kick off their post-holiday workouts with a video of himself demonstrating “Oblique Side Crunches.” Though he insists on his YouTube page that he was “nowhere near [his] best physical shape” at the time the clip was shot, the toned, shirtless Phillips – who reportedly would like to open his own gym one day – certainly gets my stamp of approval. Wonder if Peter Jackson has any openings at Push Fitness? Well, it’s hard to believe we are about to celebrate our second anniversary, and in less than two weeks, on Monday, January 23, 2012, from 6 to 8 p.m., we will be gathering on the patio at J Marks in Fort Lauderdale for cocktails. Once again, the proprietors, Steve Wilson and Ariel Ayala, are extending us a marvelous courtesy in hosting this event. As we did last year, we are asking our guests to bring at least a ten dollar donation to benefit Tuesday’s Angels. I hope to see you there to benefit a good cause.

Attorney General Revises UCR’s Definition of Rape

ASHINGTON – Attorney General Eric Holder announced revisions to the Uniform Crime Report’s (UCR) definition of rape, which will lead to a more comprehensive statistical reporting of rape nationwide. The new definition is more inclusive, better reflects state criminal codes and focuses on the various forms of sexual penetration understood to be rape. The new definition of rape is: “The penetration, no matter how slight, of the vagina or anus with any body part or object, or oral penetration by a sex organ of another person, without the consent of the victim.” The definition is used by the FBI to collect information from local law enforcement agencies about reported rapes. The old definition of forcible rape, established in 1927, is “the carnal knowledge of a female, forcibly and against her will.” It only included forcible male penile penetration of a female vagina and excluded oral and anal penetration; rape of males; penetration of the vagina and anus with an object or body part
other than the penis; rape of females by females; and, non-forcible rape. “This long-awaited change to the definition of rape is a victory for women and men across the country whose suffering has gone unaccounted for over 80 years,” said Vice President Biden, a leader in the effort to end violence against women for over 20 years and author of the landmark Violence Against Women Act. The revised definition includes any gender of victim or perpetrator, and includes instances in which the victim is incapable of giving consent because of temporary or permanent mental or physical incapacity, including due to the influence of drugs or alcohol or because of age. The ability of the victim to give consent must be determined in accordance with state statute. Physical resistance from the victim is not required to demonstrate lack of consent. The new definition does not change federal or state criminal codes or impact charging and prosecution on the local level. Police departments submit data on reported crimes and arrests to the UCR. The UCR data are reported nationally and used to measure and understand crime trends. In addition, the UCR program will also collect data based on the historical definition of rape, enabling law enforcement to track consistent trend data until the statistical differences between the old and new definitions are more fully understood. The revised definition of rape is within
FBI’s UCR Summary Reporting System Program. The new definition is supported by leading law enforcement agencies and advocates and reflects the work of the FBI’s CJIS Advisory Policy Board.

he Broward Sheriff’s Office recently donated $10,000 to a local organization to create a teen suicide prevention hotline. That charity, Broward House, provides support to HIV patients and ensures they have all the things they need to survive without having to pay for assistance. The funds will come from the Sheriff Office’s Law Enforcement Trust Fund (LETF), which basically is money collected from drug busts and the seizure of any related assets. “I’ve always said what a great thing to take money from bad guys and give it to good guys. It was a natural fit for our LTFE funding…Bad money used for good projects,” Sheriff Al Lamberti said. Lamberti explained that when Captain Rick Wierzbicki, of the Sheriff’s Office Hate Crimes and Anti-Bias Task Force, approached him about the project he said it was a no brainer. “I saw the movie Bullied. I also know that there have been a couple of incidents right here in Broward County,” Lamberti said. “Then I saw the statistics and saw that for gay teens there is four times as high a suicide rate. Half of them have thought of committing suicide. That to me is crazy.” The BSO helped fund and distribute the Bullied movie which was produced by The

“This isn’t being built as an isolated project. We need to start out here and truly gauge what the need is in other places and we will expand to other places as necessary,” he said. “The main thing is that not one teen who is even contemplating suicide is left without help.” DeCarlo adds that advertising will be done through various social networking channels, in addition to word of mouth. “We’re going to look to have a strong Internet presence in addition to having two manned phones as much as we can,” he said. The Internet and phone counselors, according to DeCarlo, will be able to not only speak with the teenager – whom he said may range from 13 to 23 – but will also help them use the resources immediately available to them despite their location. “Listen, even if we get a call from Wisconsin, we will have the necessary numbers available to us to ensure that that child can not do harm to themselves and really to show them that there are people who care and want to help him out of this – even if they’re thousands of miles away.” DeCarlo goes on to stress that while the percentage of LGBT teens contemplating suicide is higher than those of a “straight” teenager, the program itself does not discriminate. “Much like the Broward House, there is no one we will turn away. It doesn’t matter if you’re LGBT or anything else,” he said. “If you need help, that’s what we’re here for. ‘Mother Annie’ of Boardwalk Passes On

She served as the front door greeter at the Boardwalk Bar in Fort Lauderdale for the past 10 years. Annie is survived by her brother, son, and a host of friends from her second family, the employees, patrons, and dancers of the Boardwalk Bar. Born and raised near Atlantic City, NJ, Annie came to South Florida and began working at Boardwalk since the bar opened its doors. She was by far the best, most dedicated, and honest employee that served at the door as a cashier. At her request, a memorial was held for Mother Annie on Monday, Jan. 9 at Boardwalk to celebrate the life and to reflect back on all the wonderful memories she has left behind as her legacy. Tiffany Aerieagus led the memorial to a packed house and Victoria Michaels

From Prop 8 and DOMA to Tammy Baldwin, These Are the Things to Look for in 2012 By Lisa Keen

S
ignificant events are crowding the calendar for 2012, and each promises considerable drama and suspense for the LGBT community. Here are the ten most important to keep an eye one: The next decisions on Proposition 8: A three-judge panel of the 9th Circuit U.S. Court of Appeals could release its opinions any day now. That’s “opinions,” plural. Before the panel can rule on the constitutionality of California’s law banning marriage for same-sex couples, it must decide whether the Yes on 8 coalition has legal standing to appeal the federal court ruling that Prop 8 is unconstitutional, and it must decide whether there is any justification for Yes on 8’s request that the lower court decision be vacated. The list of possible outcomes in Perry v. Brown –the case brought by the American Foundation for Equal Rights with famed attorneys Ted Olson and David Boies leading the charge—is mind-boggling. Whatever the results, any or all aspects could be appealed to the U.S. Supreme Court immediately or they could be appealed to a full 9th Circuit bench and then to the Supreme Court. But the panel’s decision will almost certainly have political impact, too. Not only will it affect the momentum of the marriage equality movement, it will almost certainly become fodder in the presidential campaigns. The decision, on appeal, in DOMA: A three-judge panel of the 1st Circuit U.S. Court of Appeals will hear oral arguments, perhaps as soon as early February, in a powerful challenge to the federal Defense of Marriage Act denial of federal benefits to same-sex married couples. The challenge, referred to most often as Gill v. OPM, is actually three consolidated cases, two brought by Gay & Lesbian Advocates & Defenders (GLAD) and one by the state of Massachusetts. While there are other challenges underway to DOMA, this is the “big guns” challenge and the one most likely to reach the U.S. Supreme Court first. And while there is no deadline by which the panel must render its decision, it is likely to turn out one by year’s end. Then, as with Proposition 8, the case could go to the full circuit court for appeal or straight to the Supreme Court. And, if the appeals court decision is rendered before the November elections, it will almost certainly provoke debate on the presidential campaign trail. Tammy Baldwin’s historic bid: U.S. Rep. Tammy Baldwin is not the first openly gay person to run for U.S. Senate, but she’s the

first who has a real chance of winning. The daily Capital Times is already referring to her as the “likely” Democratic nominee to fill the seat being vacated by Democrat Herb Kohl. She doesn’t have a challenger for the nomination. But she will have a very tough battle against whomever the Republicans put on the ballot. That’s because the battle will be for more than just one seat in the powerful U.S. Senate, which currently has a breakdown of 53 in the Democratic Caucus and 47 in the Republican. It will be part of a multi-state slugfest between the parties over control of the chamber, the Congress, and the nation’s laws. The fight for the Senate: Polls at the moment indicate voters are inclined to vote for Democrats over Republicans next November. But that sentiment is not providing a large margin (one or two points), and it’s too soon to guess who the voters will blame for what 11 months from now. But some Senate races –in addition to Baldwin’s—could have big consequences for LGBT voters. In Virginia, a progay former governor, Tim Kaine, will likely be pitted against an anti-gay former senator, George Allen. In Massachusetts, a pro-gay challenger, Elizabeth Warren, will almost certainly be the Democrat facing incumbent Scott Brown, whose attitude toward the community has been much less friendly. And at least seven other states are expected to have competitive races for the Senate. Counting the “Gay Caucus”: U.S. Rep. Barney Frank (D-Mass.) will be starting his 40th year in Congress when the House reconvenes January 17. And it will be his last. He announced last year that he would retire. When he does, the clique of four openly gay members of Congress – Frank, Baldwin, and Reps. Jared
Polis and David Cicilline—will shrink by one. If Baldwin fails to win a Senate seat, it could shrink by half. But there are prospects for adding members. Openly gay Wisconsin Democratic Assembly member Mark Pacon is running for Baldwin’s U.S. House seat. And there are two other openly gay candidates for the U.S. House this November: Marko Liias from Seattle, Washington, and Mark Takano from Riverside, California. So, the number of openly gay members of Congress could go from four to as low as two (though zero is, technically, possible) to as high as six. But no one will have the seniority and clout that Frank has had and used to advance pro-gay measures. On hold, and on defense, in Congress: Pro-LGBT bills –such as efforts to repeal DOMA and pass the Employment Non-Discrimination Act (ENDA)— are not likely to see much action in 2012. Anti-gay measures might. Why? Because it’s an election year and Republicans still control the House. Supportive Democrats will not be inclined to push controversial legislation during an election year, because it can detract from the focus on jobs and the economy, where most voters want focus right now. Republicans, on the other hand, have often used hostile measures aimed at gays during election year as a way of putting Democrats on the spot with voters generally and gays specifically. Ballot battles abound: There will be important LGBT-related ballot measures before voters in several states this year: North Carolina and Minnesota will vote on whether to ban same-sex marriage through an amendment to their state constitutions. Voters in Maine will decide whether to strike down their existing ban on same-sex marriage.
LGBT activists in Washington State are gathering signatures to put a measure on that state’s ballot to gain marriage equality. A small group in California has until May 15 to gather more than 800,000 signatures to put a measure on the ballot there to repeal Proposition 8. And the California Attorney General is expected to announce by January 9 whether opponents of a new bill to include information about LGBT figures in history as part of the public school curriculum can begin circulating petitions to get a repeal measure on the ballot there. All of these have the potential to be big, expensive, and consequential battles. Fight for freedom of religion: The rightwing Alliance Defense Fund and others have a concerted effort underway in the courts to undermine laws prohibiting discrimination based on sexual orientation and gender identity. Their strategy is to argue that people who discriminate against LGBT people do so because their religious beliefs require them to do so. Their question to the court is, “What rules? The First Amendment guarantee of free exercise of religion or the equal protection clause that says all citizens should be treated equally under the law?” One case has already reached the U.S. Supreme Court and failed, but other cases –many other cases-- are winding their ways through nearly every circuit in the country. And their outcomes have the potential to chip away at the strength of the nation’s legal mandate that all people be treated equally. A fight for the White House: The difference for LGBT people between having President Obama in the White House and President George W. Bush has been stark. So the consequences of November’s presidential election will also be profound. Either Obama stays, and things continue to improve – in law and in society’s attitudes – or a new president is elected from a field of Republicans who seem, at times, to be vying for the mantle of most gay hostile candidate. In the latter case, LGBT people can expect progress to halt or backslide. Ah, the unpredictable: One of the bigger LGBT stories of 2011 happened in February, and it was one nobody expected: The Obama administration announced it considered DOMA unconstitutional and would not argue for its defense in most cases. Another big story that no one expected: The Obama announced a major new diplomatic mission to push for protection of human rights for LGBT people around the world. And given that Rep. Frank said in January 2011 he’d run for reelection in 2012, it was a surprise, in November, when he announced that he would not. As Frank pointed out, circumstances change. Circumstances change, things change, people change. And often, they change each other. But history marches on through time, and only in retrospect can any trajectory be certain as to where it’s going.

New Year, New Shoes

n my eyes there isn’t a better way to start off the New Year than with your best foot forward and why not do it with a positive attitude and a fabulous pair of new shoes? The turn of a New Year has always been a time for looking back to the past, and more importantly, looking forward to the coming year. It’s a time to reflect on the past year, figure out what we can change to fulfill our New Year’s needs and implement the changes. We make up New Year’s resolutions to achieve change by setting goals, but in the end how long do any of us stick to our New Year’s resolutions? This year I decided that I would set a goal that was actually realistic and simple enough to stick with it forever. My resolution was to be punctual everywhere, simple enough right? Well the first day back to work after the New Year holiday the struggle began. Running to the kitchen with one high heel on one foot (of course a black platform stiletto) and the other in my hand, trying to balance pouring a cup of coffee while making sure I did not spill any on my Max Mara jacket that was on my arm or my brand new Michael Kors purse barely in my hand. As I was half way out the door, with both shoes on, I couldn’t find my keys and spent 15 minutes frantically looking for them. I started out with a fabulous pair of new shoes and the attempt to put my best foot forward, but in the end I was just the same woman in a fabulous new pair of shoes. Don’t get me wrong, I love my stilettos but am I asking too much of myself? On a daily basis I get the question “How do I manage to juggle and successfully maintain a life that consists of having a career
as a Medical Case Manager, serving tables part-time, attending graduate school, being in a relationship of seven years, and still maintaining a circle of friends? First I can not take credit for all of it because without an amazing support system of co-workers, loving boyfriend, incredible family, and the best friends I could ask for I wouldn’t make it a single day. It never really dawned on me until just the other day; I have always used a strategy to maintain my life but never gave it that much thought. Whenever I have wanted to make a change and accomplish something, I have always started by prioritizing what it is I want to accomplish and making sure that I am doing it for myself and not someone else. See it’s all about the right shoes, and the right attitude. That one formula will make all the difference in your world. I positively focus on each day to make sure each and every day counts. If I can make it through the day then I can get to the week, the month, and then the year. When I set a long-term goal, the key is to always have a plan and take it one day at a time, because as we all know Manolo Blahnik did not build a reputation for fabulous shoes in one day. I set long terms goals with the idea that to get there I need to make equal amount of attempts each and every day. Committing myself to a specific amount of effort each day was the key for me, no more no less. However, one has to be flexible and remember that this is real life and problems can arise. No one is perfect but what happens if I falter? As the old saying goes, if you fall down one step, don’t throw yourself down the whole staircase. If one day you break your stiletto’s heel and everything completely blows up in your makeup bag, you simply start over. Only focus on getting through one day. I did have a hiccup on my first day back to work but I took it just as that and didn’t let it discourage me. New Year’s resolutions are hard to stick to but if we remember to take them one day at a time, the battle can be won more easily. If you fall get back up, wipe off the running mascara and keep in mind that tomorrow is another day that can be conquered in a fabulous new pair of shoes! While all this was going on, Leddick became a performer. As he recalls, “My trainer, David Sexton, was producing a Miami Gay Men’s Chorus show. And they needed an older performer. But when we went into rehearsal I noticed my character didn’t have any numbers! I got to have a song! So I got a finale song. And then he wrote a sequel to that show. I died in the first show so I came back as an angel. It was a Christmas show called “It’s a Fabulous Life.” Leddick followed that with a series of one man shows where he told stories and sang songs accompanied by pianist Andrew Sargent. Leddick even did drag in some of his shows – “Mexico City” and “Presenting Gilda Lilly” – though he assures us that he does drag “only on stage.” Leddick also wrote and starred in a tribute to the late Quentin Crisp; a musical based on his Escorts book; and a musical based on his new book, How to be Gay in the 21st Century. How to Be Gay in the 21st Century:There’s nothing wrong with being gay but a lot of people do it wrong (White Lake Press), is David Leddick’s latest and wittiest book. In this book, Leddick muses about the ups and downs of being gay, accompanied by
photos taken by the renowned South Beach photographer David Vance. “Being gay is just like being Swedish. It’s a little different, but in no important way,” he writes. “There are a lot of people in my age category who are still living in the 20th Century,” Leddick notes. “And other people live in a very different gay environment. My generation is primarily concerned about what other people thought of them whereas in this century people are much more concerned about being fulfilled; who I am and what kind of life I should have so that I really live my life. Whatever I want to do I actually do it. And I think that’s the big difference.” How to Be Gay in the 21st Century, like other Leddick books, is available through Amazon.com. Leddick also writes about being gay today in his column in huffingtonpost.com and in his blog, “David’s Gay Dish” (davidsgaydish.blogspot.com). Just JoeKing. Is It Gay-funny or Is It Gay-hateful? By Tony Adams

artoonist Joe King, who on Facebook lists “Christian satire” as his primary activity, has produced a 2012 wall calendar called “I’m Not Gay, I’m Just A Sissy” (subtitled “12 Months of Sexual Confusion – Not that there’s anything wrong with that!”). The strong LGBT online reaction to its content got the calendar kicked off Barnes & Noble in a firestorm that illustrates the sometimes blurry line between satire and hate-speech. Andy Towle got the ball rolling on his blog Towleroad (http://bit.ly/vruZx9) when, on December 27, he simply highlighted the fact that a reader was upset to find the calendar for sale on Amazon and at Barnes & Noble. On December 30, The Pink News, “Europe’s Largest Gay News Service” notes that the calendar remains available on Amazon-UK, and reports, “One of King’s cartoons depicts Paul Revere riding on horseback and shouting “The sodomites are coming! The sodomites are coming!” [The calendar] is dedicated to the memory

of the US revolutionary hero and to gay rights opponent Anita Bryant.” (http://bit.ly/ sjdXDA) At The Daily Kos, Chrislove writes, “I called Amazon and Barnes & Noble today. I spoke with a supervisor at Amazon who agreed that the calendar is highly offensive. She said Amazon does pull certain offensive items, but it takes a lot of customer feedback to make a decision like that. The customer service representative I spoke with at Barnes & Noble was noticeably appalled that the company was selling the item, and she said, ‘Surely somebody wouldn’t make something like this in this day and age.’ Oh, but they would.” (http:// bit.ly/w4ycgl) Additional mention on Huffington Post (http://huff.to/uhhIHr) and elsewhere resulted in a barrage of demands to Barnes & Noble causing the calendar’s boot and also resulted in an extremely negative ranking on Amazon that may eventually cause its removal from that retailer as well. The Gay and Lesbian Alliance Against Defamation takes a clear stand in its description of the calendar as offensive.
GLAAD’s Danny Heffernan writes, “The cartoons employ outdated, highly-offensive stereotypes about LGBT people, and more specifically, gay men…The ‘humor’ it purports to offer relies on a belief that there is something inherently funny about being gay or gender non-conforming. Furthermore, it espouses inaccuracies about LGBT people that only contribute to the stereotypes used to stifle progress toward equality.” (http://bit.ly/vnhiMX) Mr. King’s Facebook response to all this is startlingly cavalier and grade schoolish with its come-on-guys-can’t-you-take-ajoke attitude which is not what one would expect from an experienced satirist whose living depends on the size of his audience. Saying that he feels like David against a gay Goliath, he writes, “Hoo-we! Hell hath no fury like a he/she scorned... The telephone tree of tantrums is lit up like a Las Vegas marquee for “Boy-Lesque” today with hate mail, threats of boycott and even the risk of Jesus spitting on me for my “Sissy” calendar. I SAID I WAS A SISSY UP FRONT. Ironic who the real bullies are isn’t it?” To justify his harrumph over being attacked for the calendar, Mr. King serves up the assertions that he once worked for a lesbian, that the material in the calendar is not new, and that a queer publication once purchased rights to one of his cartoons. Mr. King’s cluelessness aside, the contentious calendar reminds us that there is a difference between free speech and hate speech. There is a difference between humor and defamation. Sometimes the litmus test of that difference is as simple as “I know it when I hear it” but more often, the LGBT community is faced with a con-
stant barrage of depictions, references, jokes, ads, TV shows, pop songs, movies and bumper stickers that make some of us laugh and others cringe. Does Mr. King really envision his vocation as being that of the boorish guy at a dinner party who, at table, tells an off-color or racist or homophobic joke and then wonders about the dead silent response? As a gay writer for a number of LGBT media outlets, I sometimes learned this lesson the hard way. The trans community was not shy about letting me know when my attempts at humor or the words I chose were offensive to them. When I would explain that I intended no offense, their reply amounted to “Well now you know.” I took this to heart and have tried to craft my words carefully so as not to offend. I will not always succeed, but I see great merit in trying to elevate the quality of my self-expression. I suspect that Mr. King, who has not responded to my request for a dialogue about this matter, feels that the rights of a satirist in the area of sexual identity are boundless now that LGBT characters of all types appear frequently in mainstream media. This is naïve. Does he really think we are a humorless and testy lot? Does he really think that making cracks about HIV and AIDS in a world in which so many of us live with the enduring and terrible sadness and grief over the loss of friends and relatives should go unchallenged? I do not think Mr. King needs a lesson in freedom of speech and why it is different from defamation and slander, but I do think Mr. King would benefit from a lesson in good manners, which, when acquired, always increase rather than decrease a satirist’s ability to delight and amuse. Finally there is that almost unteachable quality called skill. A skilled satirist succeeds where a clumsy one fails. Alas, some people who feel the music never become great dancers. ‘A Lust to Bust’ is a Disgrace to Erase

oday’s editorial will be short. The front-page story speaks for itself. There is no defense for what law enforcement officers do to gay men in public parks. It does not happen in Palm Beach alone, though Palm Beach is where our story is featured this week. From shore to shore, from Seattle to South Florida, ‘bag-a-fag’ tactics are illegally employed by cops to ensnare and entrap otherwise innocent gay men. Mind you, this paper is not endorsing pubic sex in public parks. Parks are for kids, not tricks. But trickery is not a tactic that police should use to arrest gay men either. The willingness of the Palm Beach sheriff’s office to devote and dedicate two officers over five years to arrest hundreds of men is indefensible. But the sheriff was given an opportunity to defend it. An elected official, he declined an interview with our Editor in Chief, an accredited writer who has won local awards and is on the board of the local chapter of the Society of Professional Journalists. It seems the Sheriff may be gayer then he realizes. ‘Stonewalling’ is a policy and practice he employed with Broward New Times as well, when one of their writers, Jose Lambiet, was investigating sexism in the sheriff’s office. That’s unacceptable. Whether it is Congressman Allen West or Sheriff Rick Bradshaw, you have a duty to answer questions from the press other than the sycophants on the Fox News Channel. And if you are an elected official, you ought to study the extraordinarily high voting demographics of the LGBT community. The truth is the LGBT press is now more than entertainment magazines showcasing our nightlife. It consists of representatives

in nationally affiliated organizations, from the Florida Press Association to the National Gay and Lesbian Journalists Association. The story we report on today was investigated over two years, and required this newspaper spending close to two thousand dollars in public records requests to review over 300 police reports and other materials. The results speak for themselves, as does the silence of the Palm Beach sheriff’s office. Rick Bradshaw, you should be embarrassed. Nevertheless, without the sheriff’s input, this newspaper reaches the conclusion that for a period in excess of five years a task force of officers was deployed in public parks to interdict sexual activity but wound up instead creating and then perpetuating the very criminal activity they were assigned to stop. We conclude that the Sheriff’s office unjustly targeted, improperly arrested, and then selectively prosecuted gay men in Palm Beach County public parks. We further conclude that no oversight units within the sheriff’s office were utilized to screen, evaluate, or monitor the tactical operation employed by the designated officers, which were impaled by due process violations. We find also, that the sheriff, given an opportunity to discuss these tactics with credible reporters from an established LGBT newspaper, has cowered from his civic responsibility to do so. We encourage the LGBT community of the Palm Beaches to demand answers and hold the sheriff accountable. Being gay is more than holding pride parades. It is being proud to stand up against injustice, fight discrimination, and respond to challenges. This story is not over. Rather, it is just begginning. he new year is upon us, and with it, a chance for new plans and resolutions. Here are 10 things I resolve to do with my family this year. I hope some of them may inspire you and your families, too. Not only are they fun in themselves, but they’re great for teaching kids things like counting, arithmetic, the balance between risk and reward, and being a good sport, win or lose. (That’s why my spouse and I avoid playing Scrabble when we’re both PMS’ing.) There’s nothing like a rainy Saturday afternoon with a bag of popcorn and a stack of games to play through. Read more books: I admit I’m a book junkie, and can take this one to extremes—but I also find myself doing much of my reading before bedtime, when my son is asleep. I have to remind myself that if I want him to read, I have to model it myself. I hope this year not only to spend more time reading with him, but encouraging him to read on his own as well—at eight years old, he’s at the age when he still enjoys both. Maybe we’ll take one evening a week, set out some cookies, and have a family reading hour. Cook things together: If the references to popcorn and cookies above weren’t obvious enough, our family often combines food and celebration. I involve my son as often as I reasonably can in cooking (while also allowing him time for homework and Legos). He’s learning basic fractions and simple chemistry (caramelizing sugar is a chemical reaction!), but also getting involved with our meals in a way that makes him an enthusiastic eater of a wide range of cuisines. Additionally, he loves to pretend we’re on a cooking show, talking to an audience, as we chop and stir. So far, the cat (our usual spectator) is not impressed—but I think we’ll keep it up through the new year. Get outdoors: Notwithstanding the above, our family loves to get outside and camp or hike, even if “hike” sometimes means just a walk in a local park. Bringing along binoculars or a magnifying glass can turn even the shortest hike into a scientific adventure. One other hint for families whose children are reluctant hikers: Contrary to expectations,
our son much prefers harder hikes—ones involving rock scrambles and climbing over logs—to flat ones, which bore him. Nature is sometimes best viewed as a playground. Plant something: Whether it’s our full outdoor garden or a few seeds in an indoor pot, our son likes seeing how things grow. Watering plants can also be a useful early responsibility for kids—if they forget, it’s a good lesson, but not as traumatic as losing a goldfish. See more local attractions: Even in these tough economic times, there are plenty of ways to have fun for almost no money. Some museums offer special free days—or can be visited free or at reduced cost with a pass from the local library. Libraries themselves often host events such as book readings or crafts. Performances by local high school music and drama groups can also be entertaining. They’re not Broadway-caliber, but chances are, kids won’t notice. Talk about the elections: This will be the first presidential election year our son is old

enough to understand to any reasonable degree. I expect we’ll be talking a lot about civics in the coming months. Given his age, if I can convey why our democratic system is basically a good one, despite some flaws, I’ll consider it a success. Relate a bit of family history: I’ve always loved hearing stories from my parents and grandparents about their childhoods, and
I sense that my son does, too. Sometimes the stories are simply funny (my father played his share of pranks as a kid); some are of historical interest (remember life before the Internet?); and some help our children understand that many of the challenges they face growing up are ones we had, too. Record a bit of family history: Family history is, however, a fragile thing. My father died in 2011, taking with him a lifetime of stories. We have captured some through photographs and videos—and even though they are but a pale reflection, they supplement our own memories. I hope to continue recording our family tales and adventures, while not getting so caught up in documenting that I forget to simply experience and enjoy them. Tell my family I love them: That may go without saying—but it should never go without saying. May the year be full of love, happiness, peace, and equality for all. SFGN Investigation Reveals PBSO Targeting Gay Men In Parks

andy McGilton, Shawn Browser, and Gerry Sanders have never met but they have something in common; they were all arrested by the Palm Beach Sheriff’s Office in a five year undercover operation targeting gay men having sex in parks. And they weren’t the only one’s. Those three men represent just a few of the more than 600 arrests made by Detectives Peter Lazar and his partner Vaniclov “Van” Garner, from 2005 to 2010. SFGN reviewed more than 300 of those police reports starting with the year 2007, but PBSO acknowledged their operation began two years before that. Only a handful of the arrests – four to be exact -- were between two men; the rest of them involved an undercover detective soliciting another man for sex using tactics that one lawyer called “disgusting” while another lawyer questioned the legality of the detectives’ behavior. “They approach, lure and entice guys who are sitting alone in their car, start a sexually charged conversation and then look for a way to arrest them,” said Fort Lauderdale attorney Russell Cormican, who estimates he’s probably represented upwards of a 100 men over the past 15 years for getting busted for public sex. Two of the men mentioned above, McGilton and Browser, were charged with exposure of sexual organs while the third, Sanders, was charged with loitering in a public restroom. McGilton and Browser admitted they were guilty of the crime, but neither explored the possibility that they each might have been a victim of entrapment. Most arrestees do not; they can’t afford to do so. While the third, Sanders, denies any wrongdoing, and believes he was a victim of an overzealous cop looking to make an arrest. In fact, Sanders is still worried about retaliation from the cops and did not want his real name used for this article. At first glance his story might seem hard to believe but police reports confirmed most of the major details as he described them to SFGN (see sidebar on page 23). Simply put, Sanders was taking a jog through the park, took a short break, and washed his face in the restroom. Sanders, who noticed two men acting strangely in the restroom, mistook the undercover detectives for potential muggers. After leaving the bathroom he got in his car and left with the detective following him through the park. The incident ended with Sanders being charged with loitering in a public restroom. Sanders said he’s straight and has a girlfriend. He insists he was not at the park looking for sex. As for Browser, he posted an ad on Craigslist looking

for a quick hook up. The detectives responded to it and they agreed to meet at Okeeheelee Park where they promptly arrested him as soon as he exposed himself. Browser also did not want his real name used. “They got me all excited by responding to an ad on craigslist...so I pursued it...I met them in the park...they led me down a road...insisted that I’d whip it out before I could suck him,” he wrote in an email to SFGN. As for McGilton’s story: “They approached me. I was standing there for a minute. I wasn’t giving off any signals,” he said. “They asked me what I like to do. [The undercover detective said] my friend likes to fuck. Do you want to get fucked? I told him not really.” He did, however, end up exposing himself to the detectives who promptly arrested him. Like many of the other men arrested, McGilton and Browser had to pay fines, attend prostitution classes, and take an AIDS test. Many who wind up in this situation plead no contest and not hire an attorney because they don’t have the funds or are too embarrassed to fight. Some like Sanders though come to regret that decision. “Because of my financial situation I didn’t get an attorney to fight it. It was just easier to plead the way I did. My girlfriend told me to fight this. Basically the judge said this is just loitering in a bathroom,” he said. “I was warned about the detective. I was told, you go up against him and you have problems. I didn’t want to push the issue.” Cormican pointed out that: “What these defendants do not realize is that once they plead no contest they compromise their ability to sue afterwards for false arrest. In fact those who accept the state’s offers are usually required to waive their right to sue.” Even though loitering in a public bathroom is a misdemeanor and may not be a big deal it still showed up on Sanders record and he had to explain the situation at work. As far as SFGN can tell the operation started sometime between 2005 and 2007 and lasted until 2010. During that time the two police officers made more than 600 arrests of purportedly gay men in public parks throughout Palm Beach County, from Jupiter to Boca. More than half of the arrests were men aged 45 to 70. That was the detectives’ only job – going undercover and soliciting men for sex and then arresting them. SFGN did not come across any arrests of men having sex with women and only a handful of arrests that involved two men. Even though SFGN requested all of the arrest records that both detectives made since 2007, only about 320 were handed over. The others may have occurred before SFGN’s request.

A few arrests, though, were of female prostitutes, but none were of female detectives soliciting straight males in parks. If that were the case Russell Cormican is sure plenty of straight men would be arrested. E
ntrapment is a legal defense used by criminal defense attorneys to prove that an otherwise innocent defendant was wrongfully induced into committing an illegal act by the improper solicitations of a law enforcment officer. To prove it up in a court of law, there are two prongs which must be met, states Fort Lauderdale attorney Russell Cormican. He estimates that his office has represented upwards of a 100 men over the past 15 years for getting busted for public sex. The first part of entrapment, he said, has to do with whether the police induce the crime charged, which means, did the police, through their behavior, encourage the defendant to engage in a criminal act? Inducement alone, however, is not enough. Simply offering someone the opportunity to do something illegal does not constitute entrapment. Anyone can still say no. “The issue is were there overreaching factors. It’s the second part of the entrapment defense that gets tricky,” Cormican explained. The second part is the issue of predisposition. The question becomes “was the defendant predisposed to act in an illegal manner?” Are there factors that show the defendant was likely to engage in the improper behavior anyway, or did the police behavior entice the defendant to do something he otherwise wouldn’t have done. Cormican added that when a defendant uses entrapment as their defense they are admitting to the acts they are accused of, but arguing they only engaged in that behavior because the police encouraged them. “By going out and creating the crime, they’re not fighting the problem,” he said. “They’re creating the entire incident from the beginning to end themselves. It’s an artificially created act. If that police officer was not there that day the illegal acts wouldn’t have occurred.”

In 130 out of 317 police reports the encounter took place within a restroom, while the rest took place in the woods or in a parked car. In 107 of the reports the officer squatted down in order to get the defendant to expose himself. In 58 of the reports the officer either told the defendant “I like to
suck” or asked the defendant if he likes to be “sucked.” And in 74 of the encounters it appeared from the police report that the officer approached the defendant or started a conversation. In many of the reports, however, it was difficult to conclude who approached who first.

ut down the knitting, the book and the broom…” it’s time for Cabaret at the Maltz Jupiter Theater. And, according to artistic director Andrew Kato, you can put down your recollections of the Liza Minnelli Joel Gray “sweet and clean-cut musical and get ready for some down and dark performances of a down and dark play with music.”
“This is the 1998 revival that is more powerful and grittier than the movie we all remember so well,” Kato said. “We are really lucky to be able to bring this to South Florida with B.T. Nicholl, the premier director authorized to produce this version. “In the original musical, the character of Cliff is hinted to be gay or bisexual and in the movie they made him bisexual but the theme wasn’t developed,” said Bruce Linser, a local actor who plays the role of Cliff. “In this version Cliff’s homosexuality and his wish to hide it becomes a major theme that adds to the drama of the play. It’s an exciting enhancement.” “B.T. is really a great director to work with,” Linser said. “He knows what he

wants but he’s not afraid to let the actors have a little fun with the production – within reason, of course.” Christopher Sloan, a New York actor down for the role of the Emcee agreed. “There has to be some flexibility or the play would be stilted and impossible to watch but everything in this production hangs together so well you don’t want to go too far. It’s an incredibly tight production.” Sloan, who has performed in the play five different times, also raved about working at the Maltz. “It’s an incredible theater,” he said. “It’s beautifully designed and appointed and everyone is absolutely professional. I’m thrilled to be working here.” “We do our best,” said Kato who
grew up in Jupiter and remembers waiting table at the old Burt Reynolds Dinner Theater, which was morphed into the Maltz. “When I was offered the position here in 2005 I was a little hesitant about the location but the theater’s motto has always been ‘If you give them quality, they will come,’ and so far that’s been true.” A unique aspect of the Maltz production is the integration of the musicians directly into the action of the play “It’s been an incredible experience working with the musicians during rehearsal,” Linser said. “They’re an integral part of the play, not an add on just before production. It makes a huge difference.” Cabaret is a Tony-award winning musical based on the book by Joe Masteroff,
the play by John Van and stories by Christopher Isherwood with a score by John Kander and Fred Ebb. The original Broadway show ran in 1967 with revivals in 1987 and 1998. The last production, which won the Tony Award for Best Revival of a Musical - was based on the 1993 Sam Mendes-directed Donmar Warehouse production from London. Co-directed by Mendes and Rob Marshall and choreographed by Marshall, it held a 2377-performance run at Studio 54, becoming the third longest-running revival in Broadway musical history. The Maltz Jupiter Theatre is producing this version, with direction from B.T. Nicholl, one of the few directors given permission to direct this particular revival of the show. continued on page 34

Broadway Across America brings the best of the Great White Way to South Florida. Super Healthy Food #1: Kale to the Rescue!
Kale is “all the rave” these days. Full of vitamin C, loaded with beta carotene, tons of calcium, fiber and a truly great fat burner in its own right. With all these health benefits, what could be the bad news? Unfortunately many people just don’t love the taste of kale. Now I’m not the right person to ask when it comes to the taste of veggies, because I am a diehard lover of all veggies, but someone like my dear hubby who just does not appreciate many green things describes kale as “eating the grass in our backyard might be tastier”….you gotta love his honesty, right? Here I share my favorite ways to get that wonder veggie in a variety of forms.

1. Kale Chips Making Kale Chips is easy. Tear the leaves into pieces and toss with olive oil, sea salt, and pepper. Spread on a baking sheet and bake at 300 degrees F until crisp, 20 to 30 minutes. Make sure to monitor your chips while they are cooking so as not to burn them. Store them in airtight containers or bags with paper towels to absorb moisture. You can try other seasoning blends like Old Bay, Sonoma Seasoning or Mediterranean Seasoning Blends
2. Chicken Vegetable Soup with Kale Ingredients: • 2 teaspoons coconut oil (great fat burner) • 1/2 cup chopped onion • 1/2 cup chopped carrot • 1 teaspoon thyme • 2 cloves garlic, minced • 2 cups chicken broth or Veggie Broth • 3/4 cup diced tomatoes • 3/4 cup cannellini beans • 1 cup cooked chicken, skinned and cubed or nitrate free chicken sausage • 1/2 cup cooked brown rice (optional) • 1 cup chopped kale, stem removed (about one large leaf)
Directions: 1. Heat oil in a medium sauce pan. Add onion and carrot. Sauté until vegetables are tender, 5-8 minutes. 2. Add thyme and garlic. Sauté for one minute. 3. Add chicken broth or water, tomatoes, cooked rice, chicken, beans and kale. 4. Simmer for 5-10 minutes. 5. Feel free to add the Hot Sauce – great to maximize the metabolic fat burning rate.
3. Morning Green Drink Ingredients • 1/2 pear • 4-5 green grapes • 1/4 banana • 1/2 cup kale • 1/2 - 1 cup water • 1 cup ice cubes • Stevia or Agave Syrup Directions: Place all ingredients in a blender on High. Enjoy immediately. You can vary the ingredients (adding more or less of each fruit or kale) to suit your taste. This is a great way to start your morning along with a good serving of protein to go along with it (raw nuts, cottage cheese or some hard boiled eggs). Bon Apetit!
