SUPREME COURT OF THE UNITED STATES SUPREME COURT OF OBERGEFELL ET AL. v. HODGES, DIRECTOR, OHIO DEPARTMENT OF HEALTH, ET AL. No. 14–556. Argued April 28, 2015—Decided June 26, 2015

No union is more profound than marriage, for it embodies the highest ideals of love, fidelity, devotion, sacrifice, and family. In forming a marital union, two people become something greater than once they were. As some of the petitioners in these cases demonstrate, marriage embodies a love that may endure even past death. It would misunderstand these men and women to say they disrespect the idea of marriage. Their plea is that they do respect it, respect it so deeply that they seek to find its fulfillment for themselves. Their hope is not to be condemned to live in loneliness, excluded from one of civilization’s oldest institutions. They ask for equal dignity in the eyes of the law. The Constitution grants them that right. The judgement of the Court of Appeals for the Sixth Circuit is reversed.

Mozambique Decriminalizes Homosexuality

The Republic of Mozambique dropped a colonial era law from its penal code last week that banned gay and lesbian relationships. The African nation, home to an estimated 25 million people, removed a law that called for “security measures to be taken against anyone practicing vices against nature.” The move is viewed as a more liberal social stance taken by newly elected President Filipe Nyusi at a time when same-sex conduct

is criminalized in many other African nations. Mozambique gained its independence from Portugal in 1975. The country, situated in southeastern Africa on the Indian Ocean, is slightly less than twice the size of California. Lambda, a gay rights group in Maputo, Mozambique’s capital city, issued a statement hailing the decision as “an important step to guarantee that society is free and equal.”

from a position of inclusivity, not exclusivity,” said Carter. “Anything less is just plain wrong; it’s bad defense policy, and puts our future strength at risk.” The new policy mirrors the DoD’s protections for gay and lesbian civilian employees and allows soldiers to seek relief if they feel discriminated against by a superior on grounds of sexual orientation.

Latinos Salud Receives CDC Grant John McDonald

Three Florida community-based organizations have been awarded grants from the Centers for Disease Control and Prevention to deliver the most effective HIV prevention strategies. Latinos Salud of Miami Beach, Empower “U” Community Health Center of Miami and Metropolitan Charities, of St. Petersburg are recipients of $216 million in funding announced by the CDC on July 1. “It’s clear that we need to focus our limited resources on strategies that can have the greatest possible impact,” said Eugene McCray, M.D. director of CDC’s Division of HIV/AIDS Prevention in a news release. “This funding targets local communities to help maximize the impact of every prevention dollar. By delivering powerful prevention tools where they’re needed most, we can have a transformative impact on the epidemic.” A total of 90 community-based organizations (CBOs) nationwide were selected by the CDC to deliver effective HIV prevention strategies to those at greatest risk, including people of color, men who have sex

In a presentation June 26 at the Florida Department of Health in Broward County, Latinos Salud Executive Director Stephen Fallon said the organization must “reach beyond its walls” to be more effective in high impact prevention. “For Latinos Salud, a very small organization, that meant buying two vans -- one for each county (Miami-Dade and Broward) – for mobile testing,” Fallon said. “We busted the bank with that one.” For the first time in its nearly 30-year history, this CDC funding program includes a component that allows organizations to pool their expertise and resources into “prevention partnerships.”

linton Offers Reassurance to Gay Youth in Web Posting

(AP) Boosting her social media outreach to younger voters, Hillary Rodham Clinton is seeking to offer reassurance to gay youths in a posting that is drawing wide online attention. "Prediction from a grown-up: Your future is going to be amazing," Clinton wrote Friday on the Facebook page for Humans of New York, a popular blog. "You will surprise yourself with what you're capable of and the incredible things you go on to do. Find the people who love and believe in you there will be lots of them." The Democratic presidential candidate made the comment below a picture of an unnamed boy on that Facebook page with a tearful expression and a captioned quote that reads, "I'm homosexual and I'm afraid about what my future will be and that people won't like me." The Clinton campaign confirmed Sunday that the posting, which is signed with an "H," came personally from her. The posting has since drawn more than 68,000 "likes" as of Sunday evening and her reaction was noted in various news reports. Clinton has been seeking to embrace youth culture and gay rights activism, having put the issue of gay marriage near the forefront of her campaign. The former secretary of state backed gay marriage in 2013 after she left the State Department. That followed President Barack Obama's announcement during the 2012 presidential campaign that he supported gay marriage.

ay Rights Activists Mark Landmark 1965 Demonstration

(AP) Gay rights activists gathered in front of Independence Hall in Philadelphia on the Fourth of July to mark the progress of their movement and pay tribute to those who launched it a half-century ago - but also made it clear that the fight for equality was far from over. "In too many communities, you can still get married on Sunday and then fired on Monday. Marriage equality was a critical milestone but not the final destination," said activist Aisha Moodie-Mills, referring to the recent U.S. Supreme

Court decision legalizing same-sex marriages nationwide. "If history has taught us anything, it's that no community's rights are one and done with a simple piece of legislation. Equality is not set in stone," Moodie-Mills said. The event was part of a weekend-long celebration of some of the earliest gay rights marches, including a gathering of about 40 protesters calling for equality at the same location on July 5, 1965. "Fifty years ago, America perceived us as degenerates," said Malcolm Lazin, who organized the anniversary events. "One of the many goals of the gay pioneers was to demonstrate that we are first class American citizens." The event also took time to pay special tribute to the "mother and father of the gay rights movement," as Lazin described them: activists Barbara Gittings and Frank Kameny. Other notables included Edie Windsor, the plaintiff in the 2013 Supreme Court case that struck down parts of the Defense of Marriage Act; Judy and Dennis Shepard, whose son Matthew was killed in 1998 because of his sexual orientation; the Rev. Gene Robinson, the first openly gay priest in the Episcopal Church; and Walter Naegle, long-time partner of civil rights activist Bayard Rustin, a confidante of the Rev. Martin Luther King Jr.

"Holly gave [visibility] long before it was comfortable to do so and also gave thousands of people both hope and pleasure." ernie Sanders Lauds Ruling, Balks at Denying Exemptions

(AP) Vermont Senator and Democratic presidential candidate Bernie Sanders lauds the recent U.S. Supreme Court ruling on gay rights, but he has balked at taking tax exemptions away from organizations that do not recognize same-sex marriage. During an interview with Jake Tapper on CNN's "State of the Union" program Sunday, Sanders said he strongly supports the court's ruling that same-sex couples have a constitutional right to marry in all 50 states. But when asked about taking tax exemptions from groups - including religious organizations - that do not recognize same-sex marriage, Sanders said he wasn't ready to go that far. He cited religious freedom and said he respects "people who have different points of view." Sanders' vocal support of gay rights dates back more than two decades.

"I was the one person pushing Kayden away from the barmen and the barmen away from Kayden," Taylor continues. "You know what has happened tonight is not from his doing or mine. There's no reason for anybody to be racist." Both porn stars have been active on social media since the incident.

ow Turnout Marks Anti-Homosexuality Demonstration in Kenya

Nairobi, Kenya.

(AP) A demonstration against homosexuality in Kenya has fizzled after attracting only a handful of protesters. The demonstration by about 35 people Monday was called by the Evangelical Alliance of Kenya and timed to coincide with the visit later this month of U.S. President Barack Obama. The group is calling on Obama not to advocate for gay rights during his visit to Africa July 24-28. Obama is making his first trip as president to

Kenya, the country of his father's birth, to attend the Global Entrepreneurship Summit, a meeting of business leaders, international organizations and governments. Alliance leader Bishop Mark Kariuki said homosexuality goes against moral values and sends the wrong message to youth. The protest comes a day after Deputy President William Ruto said same-sex couples should leave the country.

Marriage Equality Benefits and Backlash

Gay Marriage Could Provide Business Boost in Nebraska (AP) The U.S. Supreme Court decision to allow same-sex marriage could be good news for businesses that serve couples, from wedding planners to divorce attorneys. Businesses that help plan and stage weddings say they expect a boost from gay and lesbian couples who can now marry legally in Nebraska, instead of traveling elsewhere. Susan Madsen, general manager of the Cornhusker Marriott Hotel in Lincoln, says

she has fielded a handful of calls from couples interested in using the venue for wedding receptions. Madsen says the hotel is marketing itself in hopes of attracting more soon-to-wed couples. A 2014 study by the UCLA School of Law's Williams Institute found that extending marriage rights to Nebraska same-sex couples could generate $8 million in economic activity over three years.

Mike Huckabee.

Warns a 'RedeďŹ nition of Love' will be Threat to Marriage Huckabee

(EDGE) The Beatles said "All You Need Is Love," but Mike Huckabee begs to differ. During an interview with CNN's Jake Tapper Sunday, 2016 GOP presidential hopeful Mike Huckabee, who has been on a tear since the United States Supreme Court decision in Obergefell v. Hodges, was spewing his well-worn idea that the institution of marriage is somehow under attack. "Which do you think threatens to undermine the institution of marriage in this country more," Tapper asked the candidate, "same-sex marriage or the rampant ranks of infidelity and the high divorce rates in this country among straight couples?" Huckabee's response was not to choose from the options presented in front of him, but rather put the blame on the emotion that leads to marriages in the first place - love. "One of the mistakes we have even heard over the course of the same-sex marriage debate is that marriage is all about just love and feeling and sentimentality," Huckabee said. "And, regardless, heterosexual marriage is largely in trouble today because people see it as a selfish means of pleasing self, rather than a committed relationship in which the focus is upon meeting the needs of the partner," he continued. "And that sense of selfishness and the redefinition of love as to something that is purely sentimental and emotional has been destructive." The former Arkansas governor also warned that this new definition of love would end up hurting people in oppositesex, same-sex and even polygamous relationships.

// 7.8.2015 // SFGN.com //

(AP) Same-sex marriage is now legal in all 50 states, but nestled in the Idaho Constitution remains the provision that defines marriage as only between a man and a woman. The Supreme Court struck down all gay marriage bans nationwide last week, making Idaho's constitutional marriage definition unenforceable. However, removing the language will likely be an uphill battle. Amending the Idaho Constitution first requires approval from the Republican-dominated Legislature. The proposal must then win a simple majority in a voter referendum -a tough task for even lesser politically-charged initiatives. Idaho is one of 30 states that amended their constitutions to ban gay marriage that have not yet take steps to repeal their amendments, even though they have been rendered unenforceable by the Supreme Court's gay-marriage decision. "It might be difficult to remove the language, but it's the right thing to do," said Leo Morales, acting executive director of the American Civil Liberties Union of Idaho. "Lawmakers have sworn an oath to uphold the law. It makes sense to clean up the books." Idaho's gay marriage ban has been enshrined in the state constitution since 2006 after winning 63 percent of the vote. Gay rights supporters argue removal is the natural next step to comply with the Supreme Court's ruling. But Republican lawmakers and gay marriage opponents counter that there is no legal need to change the constitution.

ay Marriage Opponents Propose Two Colorado Ballot Measures

(AP) Opponents of gay marriage have proposed two Colorado ballot measures in response to the Supreme Court ruling that same-sex couples have a right to marry nationwide. One measure would redefine same-sex marriages in Colorado as civil unions. A second initiative would allow wedding-related businesses opposed to gay marriage to hire a contractor to serve same-sex couples. The ballot measures were filed Thursday by Gene Straub

soflagaynews //

SouthFloridaGayNews

and D'Arcy Straub, both of Littleton, The Denver Post reported ( http://dpo.st/1GX8VEr ). They did not return calls from the Post for comment on the measures. It's not clear whether the measures would meet legal muster. The Straubs are scheduled to meet with state Legislative Council staff July 16 to review the proposed ballot language. Each measure would need about 98,000 signatures from registered voters to get the measure on the ballot in 2016. The proposed constitutional amendment regarding civil unions states, "A marriage is recognized as a form of religious expression of the people of Colorado that shall not be abridged through the state prescribing or recognizing any law that implicitly or explicitly defines a marriage in opposition or agreement with any particular religious belief." Any same-sex couple married before the proposed amendment takes effect or in another state would have their relationship redefined as a civil union, which carries some but not all of the legal rights of marriage. The second measure would require the state to maintain a list of businesses willing to provide services to same-sex and transgender couples, so that those opposed could contract with them. Dave Montez, the executive director of One Colorado, the state's largest advocacy group for gay rights, said the civil unions proposal "is an unnecessary attempt to radically redefine all marriages in Colorado in order to undermine the Supreme Court's recent decision."

ontana's Gay Marriage Ban to Remain in State's Constitution

CLU Sues Jindal over Marriage and Conscience Order

Photo: Facebook.

(AP) When the U.S. Supreme Court struck down same-sex marriage bans nationwide last week, it torpedoed a provision of the Montana Constitution that defined marriage as between a man and a woman. Even though last week's ruling nullified the state's ban, the language will remain in the Constitution unless a voter referendum is held to remove it. Gay rights advocates say that is one of the issues left to work on after Friday's court ruling, likely after pushing for a statewide non-discrimination law in the next legislative session. "Words do matter," said Niki Zupanic of the American Civil Liberties Union of Montana. "Even though the ban can't be enforced any longer, keeping them on the books is sending the message that gay and lesbian citizens are second class." But that will be no easy task. A fight over a

Bobby Jindal. Photo: Gage Skidmore.

similar issue just ended in 2013 over deleting a state law that criminalized gay sex. The Montana Supreme Court struck down that law as unconstitutional in 1997, and it took 16 years for lawmakers to remove it from the state's code. Montana's same-sex marriage ban was approved by voters in 2004. Removing it would require another constitutional initiative, which can be expensive and timeconsuming to organize because it takes twice the number of voter signatures to place on the ballot compared to a statutory initiative to change state law. Zupanic said that rather than attempting to change the Constitution immediately, they see the next priority for gay rights advocates as pushing for legislation in 2017 that would make it illegal to discriminate against LGBT people.

(ACLU) The ACLU Foundation of Louisiana, Forum for Equality Foundation, and 6 individual plaintiffs filed suit challenging Governor Bobby Jindal's "Marriage and Conscience Order," signed on May 19, because “it goes beyond his constitutional authority as governor.” The lawsuit asserts that the “Marriage and Conscience Order” creates a class of persons who are protected over others due to their belief that same-sex couples should be denied marriage equality. New Orleans law firm Herman Herman & Katz have joined in filing suit. The “Marriage and Conscience Order” sends the message that same-sex couples, their families and friends, and supportive employers should avoid living, working or visiting Louisiana, according to Herman Herman & Katz partner Steve Herman.

soflagaynews //

Under the Louisiana Constitution, the governor is not authorized to create a substantive right by executive order. The "Marriage and Conscience Order" creates substantive rights in favor of those who oppose marriage equality, and therefore is invalid. ACLU of Louisiana’s Executive Director Marjorie Esman said, “Governor Jindal has violated the Louisiana Constitution by setting up special protections for those who share his belief system. In our country no one is above the law, including the Governor. He swore to uphold the laws of Louisiana. This lawsuit seeks to hold him to that oath.” The plaintiffs in this lawsuit all believe differently from Governor Jindal on the issue of marriage equality, and need protection for their beliefs just as those whom he favors are now privileged by the order’s special protection.

The damages are for emotional suffering caused by Sweet Cakes by Melissa, which two years ago refused to bake a wedding cake for Laurel and Rachel Bowman-Cryer. A 2007 Oregon law protects the rights of LGBT people in employment, housing and public accommodations. It provides an exemption for religious organizations, but the agency ruled that exemption does not allow private businesses to discriminate against potential customers. Sued Official Reads at Gay Wedding

(AP) Ohio's health director, Rick Hodges, whose refusal to list a gay man as the surviving spouse on a death certificate led to last week's landmark U.S. Supreme Court ruling, has delivered a Bible reading at a gay wedding. The marriage lawsuit bore Hodges' name because he heads the Ohio Department of Health, which records vital statistics. Ohio Attorney General Mike DeWine defended Ohio's 2004 gay marriage ban on behalf of the state. Hodges told the Northeast Ohio Media Group (http://bit. ly/1RUunA7) he's been friends with one of the grooms, Steve George, for 25 years. George worked in Republican Gov. John Kasich's administration and represented the governor on the panel that oversees Ohio Statehouse operations. Hodges said he saw no irony in being the defendant in a case against gay marriage one week and a reader at a same-sex wedding the next. "I love my friend," he said.

VETO! At a town hall in Miami Beach on Wednesday evening, Florida Senator Gwen Margolis and Representative David Richardson lamented lost projects to Governor Rick Scott’s pen. The two elected officials, both Democrats, named several approved budget items that were vetoed by Scott during the 2015 session in Tallahassee. Margolis went as far to call the session, “fairly dysfunctional.” “It was a session where fewer pieces of legislation passed than any other session I can ever remember,” said Margolis, who began her legislative career in 1974. “Not much passed so there’s not going to be much change.” One change, however, that was pushed through by Richardson involved the gay adoption ban being removed from the books. “I offered an amendment to have it removed from Florida Statue and after a lot of pushing and pulling we got it removed,” said Richardson, Florida’s lone openly gay representative. The removal though was mostly symbolic in nature since an appeals court had ruled Florida’s gay adoption ban violated the state constitution in 2010. Around 50 people attended the town hall held at the Miami Beach Golf Club where Margolis and Richardson blasted Scott, a Republican, for vetoing funding to several

local projects, including the Holocaust Memorial and Miami Boat Show. “I’ve done a lot of analysis on the vetoes,” Richardson said. “The big cities were hurt more than the rural areas.” Richardson, a certified public accountant, said the Governor feels many local projects should not be funded at the state level. “We play host to people from around the world,” Richardson said. “We are very much a donor community because of tourism. We never get our fair share back, but I want something. This year we got ripped off.” Instead of funding for programs to help gay homeless teens and Medicaid expansion for low income families, Floridians were given tax exemptions for gun club memberships and yacht repair services. “Almost everything we had in the budget was cut by the Governor,” Richardson said. “What bothers me are the inconsistencies.” Richardson said the vetoes occurred at eleventh hour under the cover of darkness. “They moved money around at night when nobody was watching,” he said. “I’m furious.” Other issues discussed included a proposal to restrict the use of plastic bags, a 24-hour waiting period for abortions, a law to prevent photographic cyber sexual harassment and a $20 tax reduction on communication services. soflagaynews //

On July 26, supporters of same-sex marriage rejoiced as the Supreme Court ruled in favor of marriage equality, making it the law of the land. However, the battle is far from over for LGBT equality in America. While couples are able to marry in all states (at least those that are abiding the decision), LGBT people still do not have many rights that others take for granted. According to the Center for American Progress, these same people who are getting marriage licenses across the country can still be “fired from their jobs, evicted from their apartments, denied credit, or refused services or goods simply because of their sexual orientation.” “This discrimination leads to disproportionate rates of unemployment, poverty, homelessness, and negative health outcomes for LGBT people and their families,” the center writes. In 28 states, there are no nondiscrimination laws protecting gays and lesbians, and the same goes for 31 states when it comes to transgender people. The center produced a telling infographic that plainly outlines the many privileges and benefits that are not afforded to LGBT people -- a couple can get married on a Sunday and be discriminated against every day for the rest of the week. This includes being denied a loan and having your child thrown out of college, in some states. “While you have a marriage license, too many people still have a license to discriminate,” it says.

Take Online Survey For SFGN

SFGN Staff

SFGN freelance writer, Sean McShee, is conducting an online survey to learn about beliefs about how often gay and bi HIV negative men should take the HIV test. The survey results will appear in SFGN by late September. At present, not much is known about our beliefs about the optimal frequency of testing for HIV infection. Your participation in this survey can help to start this conversation. This survey takes around ten minutes to complete. You can stop at any time and skip any question that you do not want to answer. The survey does not ask for details about behavior or anti-body status. It only asks about beliefs regarding HIV testing frequency and some demographic questions. The survey does not ask any identifying questions. Both English and Spanish versions (Thanks

to Latino Salud’s translations services) are available. To participate in this survey please visit the SFGN website and follow the prompts. It is be available online at sfgn.com/ HIVsurvey from July 8 to July 22.

To visit the survey, please visit sfgn.com/HIVsurvey.

SunServe Hosts First Annual

Transgender Pool Party Brendon Lies

Submitted Photo.

It was an opportunity for those who had waited a lifetime. SunServe’s first ever transgender pool party on July 5 in Wilton Manors was hosted in order to encourage its participants to receive HIV testing as well as provide a safe space for gender nonconforming individuals to relax outside. Trans men and women alike were welcomed to a pool area free of judgment, with helpful staff members from SunServe willing to provide anyone at the party with access to condoms as well as information about their free transgender services. Those present were encouraged to mingle, expanding their support system within South Florida. Providing games, raffles, free drinks and even an on-staff DJ, the event was a huge success, drawing a crowd of at least forty people from every background. A number of community activists such as Rajee Rajindra Narinesingh were also present, eager to show their support for the new event. While trans individuals were allowed to enter for free, allies were still welcome but encouraged to either receive a free HIV test provided by Holy Cross Hospital’s Community Outreach bus, or to donate $40 to SunServe. Many of the guests who were allowed to enter for free still had themselves tested at the mobile screening bus, partially a result of the positive encouragement of SunServe staff members. According to the CDC, transgender people have an extraordinary high rate of HIV infections, with 27.7 percent of trans women testing positive. Another study revealed that 73 percent of the transgender women who tested positive

were previously unaware of their status. CDC claims these rates are rising in the trans population. This event is by far not SunServe’s first step towards helping the many transgender and gender non-conforming citizens of Broward County. The organization has allocated an entire branch of its services specifically towards transgender patients, which the organization claims to be its fastest growing department. According to Atticus Ranck, an intern for the Director of Transgender Services at Sunserve, they typically assist Broward residents with counseling, name changing services, support, education, and access to hormone therapy, among other services. “Hopefully today’s event will build year after year after this,” Atticus said, who was present at the pool party as one of many volunteers. “Our hope is it will raise money for the Transgender Services, which are directed by Arianna Lint.” While the pool party was not free of kinks, with isolated arguments arising, the composed volunteers of SunServe including Arianna Lint herself seized the opportunity to unite their attendees and remind them of the importance of embracing each other as a community. Once the night had concluded, the party’s attendees were each given bags with donated items from the event’s sponsors, such as AIDS Healthcare Foundation. As the Transgender Services Department at SunServe continues to grow, it’s likely that the community can come to expect more transgender-focused events that allow both the trans community of Broward County as well as other members of the LGBT community a chance to safely collaborate and embrace each other.

Marketplace Discrimination Complaints

Sean McShee The Center for Health Law and Policy Innovation (CHLPI) has developed templates for people infected with HIV to file complaints about Health Insurance Discrimination. They are developing additional templates for people with Hepatitis C or with a generic medical condition. Health Insurance Discrimination refers to those policies designed to drive away people with expensive conditions. For example, plans may place needed medications on the most expensive tier, require onerous pre-authorizations, or fail to provide an appeals process. Besides discriminating against the affected individuals, it drives high cost patients to competitors. It not only discriminates, but it also subverts fair competition. HIVHealthReform.org and the CHLPI presented a webinar “A New Tool to Fight Health Insurance Discrimination. Carmel Shachar, from CHLPI, led this webinar. This webinar introduced two templates for filing complaints with insurance regulators: a longer one for providers and advocates, and a shorter one for consumers. Consumers can use either. Complaints to insurance companies frequently fail to resolve issues. Some just give a perfunctory review re-affirming the denial, and others just fail to respond. When one level does not work, Shachar recommends that people move up to the next higher level. The next level consists of filing a complaint with insurance regulators at the state level. These CHLPI templates should facilitate that process. Under the Affordable Care Act (ACA), state insurance regulators must enforce its anti-discrimination provisions. Most states have failed to align their regulations with the new insurance landscape. If a state has sympathetic or neutral regulators, complaints on file can provide them with political cover and counterbalance lobbyists. If a state has hostile regulators, complaints on file can become evidence in subsequent litigation and facilitate moving up to the federal level. This process draws attention to the issue, and avoids the adversarial relationship of litigation, with its slow pace and high costs. Shachar identified three types of complaints:

16

soflagaynews //

SouthFloridaGayNews

1.

Changing the terms of coverage after its purchase 2. Refusing to cover standard care for HIV 3. Unreasonably high costs for standard medications or treatment The template consists of the following parts: 1. The complaint 2. Relevant sections of the ACA 3. The standard of care for HIV infection 4. Federal anti-discrimination law and the responsibility of state insurance regulators to enforce it. Some insurance regulators may lack familiarity with the standards for HIV care. One complaint can include multiple problems. Shachar stressed that people should feel free to contact her if they had any questions. CHLPI based these templates on Marketplace plans and HIV infection. Some people will have complaints about other types of plans or other conditions. People with such complaints should contact Shachar, rather than modifying the template themselves. The CHLPI will update the template when regulations or standards of care change. People should always download the templates to ensure they are current, rather than storing them on their computer. Shachar recommends sending copies of the complaint to the insurance company, to the CHPLI, and to sympathetic state politicians. They also suggest sending both hard and electronic copies to the state regulator, as well as a follow-up meeting. One of the unintended consequences of the ACA involves increased public education about resolving complaints about plans and getting results. This may be one of its many significant reforms. To download the templates or to view this webinar, visit: http://bit.ly/1gdoSkd For questions about the template and its use, contact Carmel Shachar 617-390-2588 or cshachar@law.harvard.edu. Santorum, Huckabee Slam Gay Marriage; Walker’s Sons Slam Their Father

John McDonald

Having profiled 22 different candidates for the U.S. Presidency, our White House Watch piece now evolves into juicy nuggets from the campaign trail. This week we start with former U.S. Senator Rick Santorum. Appearing on the CBS Sunday morning program, "Face The Nation," Santorum called the recent Supreme Court decision in Obergefell v. Hodges, "an assault on religious liberty." In a 5-4 decision, the high court ruled gays have a right to marriage in all 50 states. "It is a further erosion of this basic building block of society which is the nuclear family," said Santorum. Not to be outdone, fellow Republican hopeful Mike Huckabee took to CNN's State of the Union to declare selfish 'redefinition of love' is destroying marriage. “The whole point of marriage is to create a relationship where two people are committed as life partners,” Huckabee told CNN anchor Jake Tapper. “One of the mistakes we’ve even heard over the course of the same-sex marriage debate is that marriage is all about just love and feeling and sentimentality. And regardless, heterosexual marriage is largely in trouble today because people see it as a selfish means of pleasing self, rather than a committed relationship in which the focus is on meeting the needs of the partner. That sense of selfishness and the redefinition of love as to something that is purely sentimental and emotional has been destructive.”

U.S. Senator Rick Santorum.

MEANWHILE,

The Huffington Post is reporting the college-aged sons of Wisconsin Governor Scott Walker were disappointed with their father's statement that the Supreme Court's ruling was 'a grave mistake.' “That was a hard one,” Walker's wife Tonette told HuffPo. "Our sons were disappointed ... I was torn. I have children who are very passionate [in favor of same-sex marriage], and Scott was on his side very passionate." In a poll released July 1 by Quinnipiac University, Walker leads the long list of GOP hopefuls in Iowa with 18 percent. Huckabee and Santorum, both past winners of the nation's first caucus, received five and four percent of the vote, respectively. On the Democratic side, all of the major candidates expressed support for same-sex marriage. Democratic frontrunner Hillary Clinton offered words of encouragement to a young boy who is struggling with his same-sex attractions. “Prediction from a grown-up: Your future is going to be amazing," Clinton wrote Friday on the Facebook page for Humans of New York, a popular blog. "You will surprise yourself with what you're capable of and the incredible things you go on to do. Find the people who love and believe in you — there will be lots of them."

news local Equality Florida’s Endorsements

Under Scrutiny…Again

Jason Parsley

In March SFGN exposed serious flaws in Equality Florida’s political endorsement process. One of those flaws included their reliance on using surveys and questionnaires to make their decisions. Now the organization is under fire again. Equality Florida endorsed Sarasota Commissioner Shelli Eddie, but now the commissioner has come forward admitting she lied on the questionnaire to get the LGBT rights group’s endorsement. "Because of my faith, I should not have completed the survey responses the way I did, and I should not have accepted your endorsement,” an email from Eddie to Equality Florida read. Eddie was elected in May, defeating incumbent Stan Zimmerman. Zimmerman told SRQ Magazine he did not fill out the questionnaire. Last week the registered Republican came out in favor of same-sex marriage. While Eddie, a registered Democrat came out against same-sex marriage in her email to Equality Florida. "I want to make my personal beliefs clear so as to not mislead your organization on my positions and more importantly to publicly repent for giving survey responses which are in direct conflict with my religious beliefs,” the email continued. Ken Shelin, Equality Florida co-chair and a former Sarasota City Commissioner was shocked by the commissioner’s admissions telling SRQ: “Shelli not only deceived the Equality Florida PAC with her answers on its candidate questionnaire. She deceived her campaign donors and she deceived the voters.”

But others see this as a failure on the way Equality Florida handles its endorsements. “This is exactly why the Palm Beach County Human Rights Council Voters Alliance conducts personal interviews with candidates before we endorse them,” said Rand Hoch, president of PBCHRC. While the executive director of SAVE, Tony Lima, also chimed in on Facebook saying “SAVE also conducts personal interviews with a panel of community members. Very important!” Hoch said none of his group’s endorsements have ever recanted. “It’s an entirely different system when you sit down face to face,” he told SFGN. “You can explain your positions more so than just checking something off. And you can ask follow up questions.”

Pride Still Matters So Keep Celebrating

Jesse Monteagudo The Day After Pride

Many of you will be reading this article after one of this month’s many LGBT Pride events. First established to commemorate the Stonewall Riots of June 27-28, 1969, LGBT Pride is now observed worldwide as a community-wide celebration that unites all genders, races, classes and lifestyles. By taking part in Pride events, we assert who we, as individuals and as a people. We contribute all that is good in us to Pride events and in return Pride makes us feel good about ourselves and others like us. In short, Pride is a tremendous morale booster and an antidote to self-hatred and internalized heterosexism, homophobia and transphobia. Unfortunately, Pride events are usually followed by all-too real and not very proud reality. After Pride ends, we return to a world that seems to hate us as much as it did before Pride began. Back in the 1980s, bad news always seemed to follow a Pride celebration. As if the mounting AIDS casualties were not bad enough, Pride Month 1986 ended with the now-infamous Supreme Court decision in Bowers v. Hardwick (since overruled by Lawrence v. Texas). The 1987 March on Washington for Lesbian and Gay Rights (which was a Pride event writ large) was soon followed by U.S. Senate approval of one of the late Senator Jesse Helms’s notorious amendments that would have banned federal assistance for LGBT or AIDS groups. Pride Month will not keep AIDS from killing us, bashers from hurting us, or bigots from trying to send us back into our closets. But Pride parades and festivals do not last forever and, once Pride Month ends, the emotional and spiritual energy we acquired during those events seem to disappear. This does not have to be this way. Pride, as a state of mind as opposed to a particular event, should be with us year-round. I admit that it is natural and essential for humans to rest after an overly-active week or month of celebration; in order to recharge our batteries, relax and enjoy ourselves. But LGBT and questioning kids continue to take their own lives; same-sex loving men continue to test HIV positive; queers everywhere continue to suffer from hate crimes and antigay violence; and bigots of all kinds continue to make life hard for us.

20

// 7.8.2015 // SFGN.com //

Therefore, it is important that we keep the spirit of Pride alive long after Pride is over. Let Pride be not an end but a beginning. For some of us, the annual Pride events are our only contact with the rest of our community. But do not wait until next year for your next contact. Let the goals of Pride Month be your goals for life:

1. TAKE PRIDE IN YOURSELF

Internalized homophobia is still a part of our lives. “Ex-gay” groups prey on those of us who still believe what straight society taught us. Do not let yourselves fall into that trap. Nor should you let confusion and selfhatred lead you into addictive behaviors, unsafe sex, loneliness or suicide. There are many individuals and groups that can help.

2. COME OUT

If all the lesbians, gay men, bisexuals, transgender and intersex people who “come out” for Pride Month remain out, society would surely have to notice. Studies show that heterosexuals who personally know LGBT people tend to be less prejudiced than those who do not. Though announcing our sexual orientation might not be right for all of us, being honest with our loved ones seldom hurts and usually improves our relationships. And if the person in question turns you off because you are LesBiGay or soflagaynews //

Trans, more often than not that person is not worth our effort.

3. HELP A FRIEND IN NEED

As the Jewish sage Hillel observed, “If I am not for myself, who will be for me? If I am for myself alone, what am I? If not now, when?” Closely linked to taking Pride in ourselves is taking pride in our sisters and brothers. If you know someone who is in a life-threatening situation - whether it be AIDS, cancer, substance abuse, impending suicide, domestic violence, homelessness or hopelessness - give them a helping hand, always remembering that they, too, have their Pride. If you do not know anyone who needs our help (though I find it hard to believe), volunteer to help at your local AIDS organization, battered women’s home, homeless shelter or community center. There is enough Pride to go around.

4. BE A PART OF YOUR “FAMILY OF PRIDE”

It is impossible to take part in Pride events without encountering a variety of community organizations. They serve a variety of purposes, not the least of which is the reassurance that we are not alone. There are literally thousands of LGBT and AIDS-service organizations in the U.S. and Canada, all of which translate into

SouthFloridaGayNews

thousands of reasons that we can proud of. Surely there are at least one that you can call your own. By joining such a group, you will get involved in activities that you enjoy, meet like-minded people and help make our world a better place to live in.

5. BE A PART OF THE SOLUTION

I do not have to remind you that we live in a tough world. Things are often not easy for us, and things might get worse if we do not watch out. As the saying goes, if we are not part of the solution we are part of the problem. Let us make Pride work for us, by fighting for our lives, our communities and for our rights. There is a variety of activist groups that can use your political energies, from those that work within the system to more aggressive, “in your face” entities. If you feel you do not have the time for active involvement, then vote, write, phone or email your representatives and make a financial contribution to your local LGBT advocacy group. All of this should keep the adrenalin flowing and the Pride growing throughout the coming year. Let LGBT Pride be more than just a slogan. In the immortal words of gay folk singer Charlie Murphy, we must “love life enough to struggle.” Working together, we can make a difference.

letter to the editor

Warning From A Reader We have a long way to go

Photo: Tony Webster.

Dear Editor,

I write this letter to you with a distinct sense of pride but also as a warning to not let your guard down in the fight for equality. The win that the U.S. Supreme Court gave to marriage equality only places us in the middle of the story. After all, our right to choose who we want to love and share our lives with was only affirmed, not granted. What we are ultimately fighting for is the respect to exercise our rights freely. Respect, as they say, is earned. The LGBT community has achieved a lot since the sixties when my uncle, Freddy Nodal, and his partner, Raydel, were pioneers of Boys Town in Chicago. They refurbished the brick building across the street from Las Mananitas on North Halsted and rented out apartments to the budding “gayborhood”. Throughout the U.S., people like my uncle have established the LGBT community as the driving force behind many vibrant urban beacons like New York's Chelsea, San Francisco's Castro and Miami’s South Beach as well as its Upper Eastside and many others. The LGBT community has

become known for accomplishments in culture and business rather than just an association to sexual orientation. Before the U.S. Supreme Court decision, the LGBT community already achieved marriage equality in 37 states and is currently on the forefront of such issues as adoption, economic justice and oppression (or bullying). Politically, the LGBT community can no longer be ignored. Even places in the Midwest such as Indiana are celebrating their first openly gay executive, Pete Buttigieg, Mayor of South Bend who came out in June in a written statement saying, “Our shared knowledge that the greatest thing any of us has to offer is love.” The work of the LGBT community will and must continue beyond the U.S. Supreme Court’s decision affirming marriage equality. The Supreme Court’s decision did not change hearts and minds, only the legal landscape. This is a task set before you. Respect is earned, but if the past is any indicator, the persistence, unity, and freedom of the LGBT community will achieve this goal. It is time to press on.

analysis

In Defense of Justice Kennedy’s Soaring Language

Michael Dorf

In the nature of split decisions, the majority opinion makes an affirmative argument and the dissent criticizes that argument, with the majority responding, if at all, in footnotes and other asides. That pattern holds in Obergefell v. Hodges. In sometimes-soaring language, Justice Anthony Kennedy’s opinion barely addresses the pointed and occasionally nasty critique leveled in four separate dissents, perhaps leaving the impression that nothing can be said in response. That impression is false. None of the points made by the dissenters withstands critical scrutiny – not least the claim that because marriage originated as an institution to address accidental procreation by heterosexuals, a state has a rational (much less compelling) interest in forbidding gay and lesbian couples from participating in the modern institution of marriage. Still less persuasive is the dissenters’ repeated insistence that this case differs from prior marriage cases because those cases did not involve the definition of marriage. To quote Justice Antonin Scalia’s acerbic dissent, “Huh?”. Chief Justice John Roberts, in the principal dissent, sets forth the most elaborate argument, but fundamentally he makes three points: (1) there is a difference between support for samesex marriage as a policy matter and as a constitutional matter; (2) premature constitutionalization of a right that cannot yet be said to be deeply rooted in the nation’s history and traditions risks undermining long-term support for the right because defeat of the anti-samesex-marriage position in the democratic process would be more acceptable; and (3) the majority’s logic opens the door to claims such as a right to polygamy. Beyond that, his dissent repeatedly compares the ruling to Lochner v. New York, citing the case a whopping sixteen times. Nearly all of what the Chief Justice says would work equally well as an argument against all unenumerated rights, indeed, against all judicial decisions that draw inferences from vague language contained in enumerated rights as well. The other dissents do not fare better. Justice Clarence Thomas (joined by Justice Scalia) is more succinct but also more radical than the Chief. He rejects substantive due process in its entirety, but then, citing Founding Era and earlier

24

// 7.8.2015 // SFGN.com //

texts, provides two fallbacks. To the extent that Justice Thomas would allow any substantive due process it would be for the liberty of movement only, and failing that, for no more than negative liberties. Marriage, as state recognition, would not be a fundamental right for anyone. Recognizing that, taken at face value, his view would require overruling Loving (in its fundamental rights aspect), Zablocki v. Redhail, and Turner v. Safley, he elevates the happenstance that those cases involved criminal prohibitions into central features, concluding that “in none of those cases were individuals denied solely governmental recognition and benefits associated with marriage.” Thus, two Justices of the Supreme Court apparently believe that, consistent with the Constitution, a state could forbid, say, people (even of the opposite sex) over the age of fifty from marrying. Justice Samuel Alito (joined by Justices Scalia and Thomas) is chiefly concerned about people who oppose same-sex marriage on religious grounds. Will they now be required to participate in samesex marriages? The short answer is no. As mocks the opening line of the majority Justice Elena Kagan noted during the oral opinion: “The Constitution promises argument, even to Justice Scalia’s evident liberty to all within its reach, a liberty that satisfaction at the time, clergy who includes certain specific rights that allow solemnize marriages have long been given persons, within a lawful realm, to define the freedom to decide which ceremonies and express their identity.” Justice Scalia at which to officiate replies: “If, even based on criteria as the price to be “Would the eight that would be paid for a fifth co n st i t ut i o n a l l y Justices who signed vote, I ever joined problematic in an opinion for the onto the fundamental other contexts. In perhaps the most intemperate and lesbian minority), in another dissent line in the U.S. Reports, Justice Scalia compared same-sex intimacy to bestiality, soflagaynews //

SouthFloridaGayNews

Associate Justice Anthony Kennedy/Wikipedia and in a futile effort to read Loving as having nothing to do with evolving values, invented his very own inaccurate text of the Fourteenth Amendment. Forget about the bag. Justice Scalia should not appear in public except in a full burka. What bothers Justice Scalia and, to a somewhat lesser extent, his fellow dissenters, about Justice Kennedy’s soaring rhetoric? In prior gay rights cases, they have, with some justification, complained that the majority was unclear about how its holding fit with conventional constitutional doctrine, but there is little cause for complaint on that score in Obergefell. Justice Kennedy says with admirable clarity that marriage is a fundamental right and that the state has not offered a sufficient justification for denying it to same-sex couples. Both Chief Justice Roberts and Justice Scalia are puzzled by Justice Kennedy’s invocation of “synergy” between the Equal Protection and Due Process Clauses, but they ought not be. Especially not Justice Scalia, whose opinion in Employment Division v. Smith explained away prior cases that obviously contradicted the rule he announced there by describing them as resting on a “hybrid” of free exercise

and other rights (including substantive due process!). Viewed from the window of Justice Scalia’s glass house, “synergy” is argle bargle but “hybrids” rest on a firm constitutional foundation. Were the dissenters more interested in understanding than ridiculing the majority opinion, they would see that equal protection considerations help explain why a right to same-sex marriage does not necessarily open the door to polygamy, adult incest, and the other supposed horribles in their gay shame parade. With a few notable exceptions, for thousands of years people have been stigmatized, beaten, and killed for the sin of loving someone of the same sex. The dissenters regard this shameful history only as the basis for continued denial of constitutional rights. The majority, by contrast, sees in this history of subordination a special reason to be skeptical of the reasons advanced for excluding same-sex couples from the institution of marriage. Justice Kennedy writes: “Especially against a long history of disapproval of their relationships, th[e] denial to same-sex couples of the right to marry works a grave and continuing harm. The imposition of this disability on gays and lesbians serves to disrespect and subordinate them.” It really is that simple. Is it possible that some day we as a society will come to regard plural marriage in the same way? Sure. Just as a social and political movement led a Court whose Chief Justice once dismissed the idea of an individual right to bear arms as a

“fraud” to change its mind about that constitutional right (as Reva Siegel has argued persuasively), so too a social and political movement for plural marriage could likewise succeed and if it does, the Court will follow suit. Indeed, notwithstanding their citations of Magna Carta and The Federalist, even the dissenters appear to be evolving when it comes to gay rights. For all of his fulminating, at least Justice Scalia is no longer comparing gay sex to bestiality. Meanwhile, the Chief Justice was gracious in inviting the victors to celebrate their victory. That is also precisely what Justice Kennedy was doing in a prose style that sometimes bordered on poetry. And as numerous pictures of celebrations around the country illustrate, it worked. My gay and lesbian friends have no illusions that Obergefell marks the end of what one with whom I partied at a gay pride event in Brooklyn last night called their “liberation struggle.” We still need a federal antidiscrimination law. And as importantly, hearts and minds must continue to be won over. But the Chief Justice is wrong in suggesting that only elections will do the trick. For better or worse, in the U.S., courts play a vital role in a complicated dance involving grass-roots activists, political organizers, elected officials, and ordinary citizens. Much work remains to be done with each of these constituencies but for now we can pause to celebrate a hard-won victory. Justice Kennedy’s opinion fittingly solemnized the occasion.

column speakout

Photo: @Racia, Instagram.

SFGN Staff

What are your thoughts “ on the SCOTUS decision? SFGN’s “Speak OUT” is a weekly feature giving a regular voice to South Florida LGBT leaders. Below are some of their answers:

First: The legalization of same sex marriage throughout the nation has given us equality that has been long fought for. It is not however, the end of our battle. There are still many pockets of resistance supported by laws on state books that continue to allow for discrimination against LGBTQ people. In many places you can now marry today and be fired tomorrow because you are not heterosexual. Second: The chatter coming from church officials belaboring the threat of religious oppression is a fallacy. The LGBTQ community has long been oppressed by the religious community, denied access to worship and to God as defined by religious sects and dogma, because of who we love. Now we have equal rights under the law to marry and those same religious zealots who oppressed us say our right to marry will oppress them. The truth is there is no law that requires anyone to marry anyone else. The law allows ministers to legally marry others. It does not require them to."

— Mildred Smith, executive producer for Empty Closet Women's Theater

Don’t become complacent in the face of our great win! Only 22 states and the District of Columbia have laws against discrimination in employment, places of public accommodation and housing. Our recent wins in the area of gay marriage may well be our last wins for some time to come. The Republican controlled Congress and legislatures throughout the country won’t be enacting any anti-discrimination laws in the foreseeable future. And if a Republican takes the White House in 2016, say good-bye to the Supreme Court bailing us out in the future. We are one Ruth BaderGinsberg away from losing a majority vote on the Court. As a community, we must continue doing what has led us to the amazing reality we are now living in: Same Sex Legal Nationwide. Your every personal moment of confrontation with homophobia is a political force - your acts of courage are, as President Obama said on Friday, “like pebbles being thrown into a still lake, ripples of hope cascade outward and change the world”. We must come out, brazen the moment when you can be invisible - be visible - be your own gay self! Vote, contribute, volunteer: show up. This is your life and you deserve to live it fully and equally. "

— Robin L. Bodiford, noted attorney and LGBT rights activist

The Supreme Court decision of Obergefell v. Hodges will go down as one of the landmark civil rights decisions in history, alongside Brown v. Board of Education. Equal Justice Under the Law, carved into the Supreme Court building itself, is now understood to include same sex couples wanting to marry. There is a lot of work left to do to insure that discrimination is eliminated in all its forms from all of our laws across the country, and in the State of Florida. The Family Law Section of the Florida Bar has committees currently working on redrafting dozens of laws that impact Florida’s families to be inclusive of same sex families. "

I'm beyond ecstatic that the Supreme Court ruled in favor of same sex marriage. I take comfort in knowing that should my partner and I decide to want to get married that we can now do this anywhere within the U.S. I take comfort in the thought that maybe one day same sex marriage will simply be called "marriage." Over the past few days I've also been elated for friends who live in states with their wives or husbands respectively and can now be recognized as married. While I take comfort in knowing this, my elation is mixed with a tinge of sadness as I am still having to contend with bigotry on another level as an African American with current events as well."

— Nancy K. Brodzki, Board Certified in Marital & Family Law

On one hand, I am elated our nation's highest legal authority has ruled that all lesbians and gay men in America now have the fundamental freedom to marry the people they love. On the other hand, I am somewhat disappointed that the Supreme Court did not provide a stronger legal basis for lower courts to strike down discriminatory practices against LGBT Floridians, which, unfortunately, remain legal in all but a handful of Florida counties."

— Danielle Allen, founder of the Black Women's Education Empowerment Initiative

The effort to secure marriage equality has been slugged out in the courts and at the ballot box costing millions of dollars and countless hours of time and energy by people like you and me. Such is the price of liberty. But no blood was shed, maybe a few tears here and there, but liberty for all is the ultimate victor. When the euphoria subsides we must now close ranks to defend our newfound freedom for we have already felt the sting of the impending backlash. We should not fear the reprisals, but instead use our success to build upon and seek out equality at the workplace, in housing, and in public accommodations. I can’t wait to hear what Jesus has to say about that."

— Rand Hoch, President and Founder, Palm Beach County Human Rights Council

Equal rights achieved! This is a milestone for our LGBT community. Now, to gear up for the nasayers who will still discriminate at the subtle level; Black Americans have dealt with this for years. It will be interesting to see how LGBT community handles the discrimination that exist within environments they approach especially employment. For instance, will the community roll into the Affirmative Action Plan, as a way to protect from discrimination? Just a thought. "

column guest Right-Wing Media Invents 'Gag Order' For Anti-Gay Oregon Bakers Media Matters for America

Photo: Facebook.

Conservative media are falsely claiming that an Oregon bakery that discriminated against a same-sex couple was given a "gag order" prohibiting them from expressing their religious beliefs. In reality, the bakery was ordered to "cease and desist" publicizing that it would violate state law by discriminating against gay customers. On July 2, Oregon's Bureau of Labor and Industries ruled that Aaron and Melissa Klein, owners of Sweet Cakes by Melissa bakery in Gresham, Oregon, must pay $135,000 in damages to Rachel and Laurel BowmanCryer. In 2013, Sweet Cakes refused to bake a cake for Rachel and Laurel's commitment ceremony, after which the couple filed an antidiscrimination complaint using the Oregon Equality Act of 2007, which prohibits private businesses from discriminating on the basis of sexual orientation. In the July 2 ruling, Bureau of Labor and Industries commissioner Brad Avakian found that the Kleins had discriminated against the couple on the basis of their sexual orientation. Additionally, Avakian ordered the Kleins to "cease and desist" from publishing or advertising that they would refuse services "of a place of public accommodation... against any person on account of sexual orientation." As reported in USA Today, "The Kleins will not be penalized for speaking about the issue on Christian television and radio programs." Conservative media, led by an article in the far-right Daily Signal, falsely portrayed the "cease and desist" as a "gag order," implying that the Kleins are barred from discussing the case or their personal religious beliefs. This misinterpretation of the order was echoed by the National Review, Breitbart, Weekly Standard, The Daily Caller, FoxNews.com, and during a segment on the Fox News Channel.

During the July 5 edition of Fox News Sunday, host Shannon Bream discussed the case, asking her guest whether he was concerned "as an American" about the "gag order." Charlie Burr, Communication Director for the Oregon Bureau of Labor and Industries, debunked the "gag order" talking point in an email to Media Matters: Our Final Order against Sweet Cakes by Melissa did not contain a gag order (as reported by Fox's Todd Starnes, National Review, Daily Caller and others). It does contain damages for the samesex couple denied service based on sexual orientation and also includes a cease and desist order directing the business to refrain from discriminating against future customers. That does not mean that the owners are prohibited from talking about the case or their opposition to Oregon antidiscrimination laws. This cease and desist order is based on enforcement of Oregon's non-discrimination law, which prohibits advertising that services of a public accommodation will be denied on the basis of sexual orientation. It's the same language that makes it illegal for a business to place a "whites only" sign in their window. As Slate's Mark Joseph Stern explained, this is not the same as a gag order: There is nothing in Avakian's order that bars the Kleins from talking about the ruling. They can rail against it, march against its injustice, and pen Facebook screeds complaining about antidiscrimination law. What they cannot do is proclaim (publicly!) that their business will not serve gay couples.

Vendor Booths Now Available for October Pridefest Pride Fort Lauderdale

Online registration for the annual Holiday Park Pridefest has begun, with important deadlines looming for those seeking vendor booths. According to Logistics Director Barrie Wood, Pride Fort Lauderdale has contracted with Thundertix, and all registrations are now being done online and on a first-come, first served basis, starting Monday, July 13. “Prior to that date, we will honor requests for returning vendors to select the spot they had last February,” Wood said. Vendors should go online to www. pridefortlauderdale.org, which enables them to register with a major credit card in hand. “This year’s Pridefest will have more open space indoors, so there will be less booths available inside the auditorium,” Wood advised. The festival this year will include an indoor exhibition from the Stonewall Museum and presentations from professionals in the fields of family and estate planning, parenting, law, finance and bankrupty. Stated Rocky Bowell, the group’s secretary, “we want an event that unifies the community and reaches all ages. We can’t be about beer alone.” The outdoor theme, along with entertainers who have not been contracted for as of yet, will include films run in conjunction with the Fort Lauderdale Gay and Lesbian Film Fest. During the daytime, a host of traditional vendors will be supplemented with an animal petting zoo and pony walk.

Photos: Facebook.

The newest venture by Pride Fort Lauderdale will promote weekend AIDS testing. Norm Kent, the Pride Chair, says he would like to see the AIDS Health Care Foundation, a presenting sponsor, along with Care Resource, Broward House, and the Pride Center run at least 1,000 instant HIV tests over the two day weekend, October 10 and 11. The big hit of the weekend may be the Himmarrshee Street closing party in downtown Fort Lauderdale on Sunday evening. Coordinated by Brian Wilson, it will help promote Sunserve’s youth services programs. Many dignitaries have confirmed their presence, including elected local officeholders. Final details for a parade, if there is one, will be announced before the end of the month, the Board reports. Volunteers can contact the office at 954 561 2020 if they seek to participate. The festival will be held in Holiday Park, with an admission entry fee of $10 per day, and $5 for those under 21. For those seeking entry into the VIP tent, with air conditioning, drinks, and upscale food entrees’, there will be a $50 entry fee. “We are still planning and finalizing,” Rocky Bowell said, but “we have done it before and the community knows it is a good time for two days, with businesses and individuals able to interact socially and professionally in a healthy, secure environment, in a beautiful Fort Lauderdale park.”

To register as a vendor, please visit pridefortlauderdale.org.

Charles Laughton (1899-1962) studied at the Royal Academy of Dramatic Art in London and had lead roles on the British stage. In the 1930s he appeared in numerous films and won an Academy Award for The Private Life of Henry VIII (1933). Three of his most famous roles are Captain Bligh in Mutiny on the Bounty (1935) with Clark Gable, Quasimodo in The Hunchback of Notre Dame (1939) and barrister Sir Wilfrid Robarts in Witness for the Prosecution (1957), for which he was nominated for an Oscar. During his long career, Laughton also portrayed Inspector Javert in Les Misérables (1935) and starred in The Barretts of Wimpole Street (1934), The Big Clock (1948), Hobson’s Choice (1954) and Advise & Consent (1962). Actor Daniel Day-Lewis said, “He had something quite remarkable.… you cannot take your eyes off him.” Laughton married actress Elsa Lanchester (Bride of Frankenstein) in 1929. They were both nominated for Academy Awards for Witness for the Prosecution—he for Best Actor, she for Best Supporting Actress. Laughton’s bisexuality has been corroborated by several contemporaries and is accepted by most Hollywood historians.

2015 Rolls-Royce Phantom Drophead Coupe Nighthawk Edition Steve Siler

A Rolling Tuxedo for the Point One Percent

Every so often, as a professional car reviewer, I get to test a six-figure car—hey, someone’s gotta do it—and there are lots out there, from well-optioned Mercedes-Benz S-Classes, Porsche 911 Cabriolets, and the relatively common Bentley Continental. Alas, I can’t afford any of them myself, but many people, even beyond the proverbial One Percent, can. But when prices climb up over half a million, we’re talking about different animals altogether. These are cars made for the Point One Percent. The leisure set. Guys whose garages are more like closets, chock full of choices; folks who don’t drive their cars as much as they wear their cars. Seen in that light, the $569,600 RollsRoyce Phantom Drophead Coupe Nighthawk Edition—one of nine ever to be made—is the world’s fastest tuxedo. I say fastest because the V-12-powered Phantom is indeed rather swift, especially considering it weighs as much as a Cadillac Escalade. But like breakdancing in a tux, this massive ragtop is rather unwieldy when making quick moves. Wafting along at low speeds is when the big Roller is at its silent best, gliding along as if on a hydroplane across a smooth sea, thanks to the softest ride of any of the thousands of cars I have tested in 20 years. Like a ground-bound pleasure boat, the Rolls allows air to blow ever so gently through your hair whilst giving its lucky occupants a commanding view of the world from any one of its high-mounted, impossibly cushy thrones. Yet protected by walls as thick as a medieval castle, they may drink in their surroundings without ever feeling susceptible to them. Conceived to show off what Rolls-Royce’s Bespoke division can do with materials and special paints, the Nighthawk brandishes hectares of carbon fiber, black leather hides

with occasional swathes of “Hotspur Red,” and inch-deep sheepskin carpets (take your shoes off before you get in, please). The exterior wears a unique diamond metallic black paint job that’s mostly gloss, but is matte-finished on the hood as well as the grille and windshield frames. The word “dressy” doesn’t even begin to describe this thing. Hence, arriving in the Nighthawk is like pulling up to the Oscars every place you go, a feeling amplified each time one opens the rearhinged “coach” doors. This is not a car you take to the mall—that’s what Range Rovers are for— but it is perfectly at home at the theatre, a golf resort, or, say, in front of an historic sound stage like those of the Hollywood Center Studios in Los Angeles, where I took these photos of the car. The Phantom is a car for movie stars, royalty, and high-level VIPs that need to show the world who’s boss when they arrive. And for tasks like that, there may be no car better than this one.

HOMO HISTORY 101

History was never as straight as we are told. Recording our history means reporting the truth. Pier Angelo

W

Tennis is one of the world’s most gay-friendly sports. But the sport is still in search of that elusive top gay male player to come out. There is no shortage however of out gay women. Here are some of the most famous lesbian tennis players: Helen Jacobs, Rennae Stubbs, Amelie Mauresmo, Hana Mandlikova, Casey Dellacqua, Lisa Raymond, Gigi Fernandez, Venus Williams. Billie Jean King ( 1943) is an American former World No. 1 professional tennis player. King won 39 Grand Slam titles, including 12 singles ( 6 Wimbledon’s titles) , 16 women's doubles, and 11 mixed doubles titles. She married Larry King in Long Beach, California, on September 17, 1965. By 1968, King realized that she was interested in women, and in 1971, began an intimate relationship with her secretary, Marilyn Barnett . King acknowledged the relationship when it became public in a May 1981 'palimony' lawsuit filed by Barnett, making King the first prominent professional female athlete to come out as a lesbian. Martina Navratilova (1956) is a retired Czech and American tennis player . In 2005, Tennis magazine selected her as the greatest female tennis player for the years 1965 through 2005. She won 18 Grand Slam singles titles, 31 major women's doubles titles (an all-time record), and 10 major mixed doubles titles. She reached the Wimbledon singles final 12 times and won it a record nine times During the early 1980s, she was involved with basketball player Nancy Lieberman and author Rita Mae Brown. From 1984 to 1991, Navratilova had a long-term relationship with Judy Nelson, whom she met at a tournament in Fort Worth in 1982. Their split in 1991 included a muchpublicized legal wrangle. On September 6, 2014, Martina proposed to her longtime girlfriend Julia Lemigova at the US Open. They married on December 15, 2014. William Tilden II (1893 –1953), was an American male tennis player. Tilden was the World No. 1 player for six years from 1920 through 1925. He won 14 Major singles titles including 10 Grand Slams(3 Wimbledon’s titles). He also won a record seven US Championships titles. During his lifetime he was a flamboyant character who was never out of the public eye, acting in both movies and plays, as well as playing tennis. He also had two arrests for sexual misbehavior with teenage boys in the late 1940s; these led to incarcerations in the Los Angeles area. He was shunned in public and his photos removed from the walls of his home club, the Germantown Cricket Club. California did not repeal its sodomy law until 1976. Because he lived in an era when homosexual sex was illegal and was not tolerated socially, some suspect that Tilden was a victim of the homophobic society of the era. More shocking than Tilden's being caught was the revelation that "sports and homosexuality were not mutually exclusive".

Bobby Blair (1964) publisher of the Florida Agenda and Guy Magazine, was a member of the 1983 US Junior Davis Cup Team. He reached the finals of The USTA Boys 18 and under National Clay Courts Championships in the summer of 1983 where he lost a three-set marathon match to future world top-ten player Aaron Krickstein. Blair became All American in 1986 and was ranked among the top-five Division One singles players in the United States. He counts career wins over several former top-10 players in the world including Wimbledon Champion Pat Cash, French Open Finalist Mikael Pernfors, Karl Novacek, Emillio Sanchez and grand slam doubles champion Rick Leach. He recently published a comingout memoir, Hiding Inside the Baseline. Billie Jean King had this to say: “Bobby Blair is committed to providing a safe and confidential support team for LGBT athletes around the globe and by sharing his own experiences and showing how important it is to live your truth, he strive to make a major impact in the lives of those he reaches through his foundation and his new book.”

'Speak Now:

Marriage Equality on Trial'

Terri Schlichenmeyer

By Kenji Yoshino

$26.00 / $31.00 Canada 384 pages c.2015, Crown

THIRD FINGER, LEFT HAND. If you’re wearing a ring there, chances are that it means more than a bit of metal around your digit. It’s undoubtedly more precious than the sum of its parts. It means a commitment of marriage – that is, if you can get married, because some still cannot. And in the new book “Speak Now” by Kenji Yoshino, you’ll read about a trial that impacted many an engagement. Just before Kenji Yoshino married his husband Ron in 2009, the officiant pulled the couple aside and reminded them that, though they were really no different than any other two people in love, he could not marry them under federal law because of DOMA. As they said their vows in Connecticut, another legal drama on the other side of the country was just beginning… Only four states recognized same-sex marriage then; California wasn’t one of them. In 2008, that state’s voters passed Proposition 8, effectively amending its constitution to allow legal marriage between opposite-sex couples only. A legal challenge to Prop 8 was filed in California in May of 2009, which ultimately opened the doors for an unlikely pair of lawyers to take the issue to the U.S. Supreme Court. Attorney Ted Olson was famous for helping to put George Bush in office in 2000, and had worked in Ronald Reagan’s Justice Department. Though Olson was known for his conservative stance, he was friends with David Boies, a renowned, more liberal litigator. They seized the opportunity to argue this important case together, and began laying the foundation for it. But their unusual pairing wasn’t the only uniqueness in Hollingsworth v. Perry: The judge assigned to the case was known to be gay. Lead counsel for defense of Prop 8 had once flirted with a pro baseball career. Both sides tried to keep direct mentions of sex

out of the courtroom. In the end, children played a large part. And, though neither side wanted it, the case went to trial. That last point, says author Kenji Yoshino, came as the biggest surprise. Issues such as same-sex marriage very seldom go to trial; both parties usually try to avoid it long before things ever get that far. But Yoshino’s fascination – and the in-depth examination he offers on Hollingsworth v. Perry - becomes a mixed bag in “Speak Now.” On one hand, there are heartfelt examples of people who would most benefit from the defeat of Prop 8, as told from the exciting perspective of a major courtroom drama; on the other hand, there’s a lot of legalese here that is only partially explained in layman’s terms. We’re treated to detailed, sometimes happy human-interest stories (including the authors’ own), followed by information that will send many readers scrambling for a legal dictionary. Oy. Still, despite that near-obstacle, I think this book is worthwhile - if nothing but for the significance of the case it highlights. Read carefully, don’t rush yourself, have a legal reference source handy, and “Speak Now” is a book you won’t want left on the shelf.

irst it was cookies, then it was muffins. The sweet treat that is trending right now is the doughnut. We’re not talking your run of the mill pastry from Dunkin’, we’re talking gourmet creations. Before we look at some of the places in the area offering these trendy treats; a little Doughnut 101. A doughnut is technically a type of fritter, or fried dough. The dough can be yeast-based or a cake batter. The most popular shape is the familiar ring, but it can also be disc shaped (usually filled with jelly or custard), sticks or spheres (doughnut holes). Fried dough had been around for centuries, but supposedly it was Hanson Gregory, an American, who claimed to have invented the ring-shaped doughnut. Dissatisfied with raw

Every culture has its own version of a fried dough-based pastry; the French beignet, Italian zeppole, Polish paczki, Greek loukoumades and Mexican churro are just a few examples. Whatever the culture or cuisine, doughnuts are always a favorite. After all what’s not to like about sweet fried dough? There have been hybrid doughnuts (croughnut: a doughnut crossed with a croissant) and now, shops specializing in doughnuts with wacky and often delicious toppings. ith nearly three decades in the game Dandee Donuts isn’t exactly jumping on the bandwagon. It’s more like they built the bandwagon. Founded in 1995 by friends who happened to be co-workers at a famous doughnut franchise, they thought they could do better and converted the once franchised location to their new concept. From such humble beginnings Dandee now offers more than 50 types of doughnuts ranging from traditional flavors such as chocolate glazed, Bavarian Cream and jelly filled, to more unusual offerings such as the “Maple Bacon Bomb,” “Walnut Crunch” and a cookies and cream filled pastry topped with crumbled Oreo cookies. If you feel guilty eating a meal comprised only of doughnuts, Dandee’s isn’t just a doughnut shop, but rather a diner that just happens to serve up delicious versions of its namesake. There’s just about every type of breakfast meal that you can imagine. Donuts are $1.50 each, $8.38 a half-dozen and $13.49 a dozen. A breakfast special features a coffee and two donuts for $3.59. Order any large iced or hot cappuccino and they’ll give you a free doughnut.

While the place serves a full menu of breakfast, lunch and entrees, you don’t go there for the sit down dining (or the service for that matter-it’s truly awful), you go there for the doughnuts, which, while not as exotic as the places mentioned above are still damn good, and reasonably priced at 95¢, each or $9.95 a dozen.

Martin Gore is one of the cofounders and the indisputable mastermind behind Depeche Mode. His solo work is where he likes to experiment and play. The man has a natural talent for making the dark seem appealing. Darkness doesn't have to conjure images of hanging with Damien (from “the Omen”) in his sandbox. Gore has always made the darkness strangely comforting, possibly because it is something that we have all felt at one time or another. On "MG" his second full length solo studio album, the darkness leads to light and back again. It also is hopefully how he is preparing the next DM LP to sound even though several of the tracks Gore started while working on DM's last LP, "Delta Machine," were somewhat disappointing. With 16 tracks, all instrumental, "words are very unnecessary" as he once wrote. There is a lot of bleeping and blooping, but M.G. appears to be genuinely interested in this project. A few tracks feel unfinished - "Elk", or need to be longer -- "Exalt". The latter starts out like lost recordings from the cold war, and is lifted at just the right moments, when a synth line breaks through and demands to ease the tensions until you are taken back to being unsettled again. It left me wanting more, instead of less. "MG" could have been titled "A.D.D.", and it would have been appropriate as it varies in style and scope. The first track,"Pinking" feels like light echoes of the early classic DM track, "Pimpf". On

"MG" the synths at times recall, 2005's DM LP "Playing The Angel," one of their last great albums. Also present here is intensity in percussion on tracks like, "Spiral" which is what has been missing from DM for some time. There are a couple gems. "Creeper" and "Southerly" recall Vangelis, circa 1982's Bladerunner, indicating that he would be perfect to score the sequel which is in the works. It is all pretty interesting if you love landscape and texture in sound. There are many impressive masterful moments -- the Clock DVAish "Stealth". "Islet" is fantastic. You just have to calm yourself, be patient and give it a chance to all soak in.

Charlie David and Jacob York star as a gay couple expecting a baby in “Paternity Leave,” a special summer screening from the Fort Lauderdale Gay and Lesbian Film Festival on Thursday, July 23.

The hot, humid South Florida summer has finally set in, but movie fans can beat the heat in a cool, dark theater or even the comfort of their living rooms. Fort Lauderdale and Broward County are the stars of “Filmed in Broward: A Reel Celebration,” a mini-festival featuring movies shot in South Florida, July 9 – 16 at Cinema Paradiso, 503 SE 6th St. in Fort Lauderdale. Take a cinematic look back at the changes in Broward County, courtesy of the Fort Lauderdale International Film Festival and Broward 100, the county’s centennial celebration. Among the films being screened are “Cape Fear,” “Rock of Ages,” “There’s Something About Mary,” “The Birdcage,” “The Naked Zoo,” “Ace Ventura: Pet Detective,” “Caddy Shack” and, of course, the iconic “Where the Boys Are.” Special events include a hot dog cookout at 5:30 p.m. on Saturday, July 11, and a closing party at 9 p.m. on Thursday, July 16. All screenings are free. For more information and complete schedule, go to FLIFF.com. Beginning July 9, more than a dozen films from Outfest Los Angeles LGBT Film Festival will be available to view online through July 16, in conjunction with the festival. Outfest, founded in 1982 by a group of

UCLA students, is one of the oldest and largest LGBT film festivals, presenting the latest features, documentaries and shorts to thousands of viewers each year. Since the festival began, more than 35,000 works have been screened. Among the films available for free online viewing are “The Heroes of Evil,” “Tomgirl,” “Gideon’s Cross,” “Maybe Next Season,” “The First Date,” Caged,” “Gay Over” and “The BrocKINGton.” The films can be streamed at OutfestOnline.com. The Fort Lauderdale Gay and Lesbian Film Festival, planned for Oct. 9 – 18, offers a special summer screening of “Paternity Leave,” on Thursday, July 23 at 7 p.m. at the Classic Gateway Theater, 1820 E. Sunrise Blvd. in Fort Lauderdale. The romantic comedy from director Matt Riddlehoover focuses on the hilarious twists and turns in the relationship of Greg (Jacob York) and his partner Ken (Charlie David) when they find out Greg is pregnant with Ken’s baby. Scientifically implausible— actually biologically impossible—but a dilemma that will ultimately reveal the many similarities between straight and gay couples. Judge Orders Sean Cody Model To Testify

Hunter Houston

New juicy details emerged this week in the Jarec Wentworth trial. Wentworth, as you might recall, is charged with extorting billions from Palm Beach tycoon Donald Burns. In its investigations, the FBI discovered Burns employed the services of 11 different young men -- all connected to Wentworth, who currently sits in a California prison. The website Str8upgayporn.com has been tracking this case as well as uncovering photos of Burns with well known Republican Party figures Kip Forbes and former New York City Mayor Rudy Giuliani. According to court documents, the lawsuit was filed in the central district of California on March 6, 2015 under United States of America v. TeoďŹ l Brank (aka "Jarec Wentworth") A federal judge is now ordering a Sean Cody model named "Ashton" to appear and testify on behalf of the defendant. Like Burns, "Ashton" has also appeared alongside Republican politicians such as failed U.S. Congressional candidate Carl DeMaio. In his film work for the Sean Cody studio, "Ashton" can be seen barebacking his scene partner

"Calvin." Porn Pulse is monitoring this case and will report the trial's verdict. Meanwhile, Levi Michaels is still living it up in Spain. The exclusive Cocky Boys model and self proclaimed "professional traveler" tweeted a $25 Airbnb credit to his Twitter followers this week. Michaels (aka Rustin Low) uploaded a video to YouTube on July 1 showcasing his new 11 bedroom flat in Madrid. "This is the life of a backpacker," Michaels says as he bemoans the living conditions of his new Spanish setting.
