Notice is hereby given thatpursuant toa resolution adopted on the 23rd day of January,2023 (the “Resolution”), Community Unit School District Number 6, Whiteside County, Illinois (the “District”), intendsto issue general obligation alternate revenue bonds (the “Bonds”) inan aggregateprincipalamountof$3,500,000for the purpose of altering,repairingandequipping school buildings and facilities and improvingthe sites thereof The revenuesourcethat will be pledged to the payment of the principal of and interest on the Bonds will be collections distributed to the Districtfrom taxes imposed in The County of Whiteside,Illinois, pursuant to the County SchoolFacility Occupation Tax Law ofthe State of Illinois, as amended. TheDistrict will also levy ad valorem property taxes upon all taxable propertyin the District without limitation as to rate oramount topay theprincipal of and interest onthe Bonds.A complete copy of the Resolution follows this notice.

RESOLUTION authorizing the issuance ofgeneral obligation alternate revenue bonds of CommunityUnit School District Number 6, Whiteside County, Illinois, in anaggregate principal amount of $3,500,000 pursuant tothe Local Government Debt Reform Act of the State of Illinois, as amended, for the purpose of altering, repairing and equipping school buildings and facilities of said School District and improving school sites.
WHEREAS, CommunityUnit School District Number 6, WhitesideCounty,Illinois (the “District”), is a duly organizedand existingschool district created under the provisions of the laws of theState of Illinois, and isnow operating under the provisions of the School Code of the State of Illinois,as amended; and
WHEREAS,the Board of Education of the District (the “Board”) has determined that itisnecessary and in the best interests of the District to alter, repair and equip the schoolbuildings and facilitiesand improvethe sitesthereof (the “Project”); and
WHEREAS, theBoard has further determined that the Project is a “school facility purpose” within the meaning of the County School Facility OccupationTax Law of the State of Illinois, as amended(the “Sales TaxLaw”); and
WHEREAS, the estimatedcost of the Project, includinglegal, financial, printing andpublication costs and other expenses,is not less than $3,500,000, and there areinsufficient funds on handandlawfullyavailable to paysuch costs;and
WHEREAS,such costs are expected to be paid for from the proceeds of alternate revenue bonds authorized to be issued at this timepursuanttothe LocalGovernment Debt Reform Act of the State of Illinois,as amended (the “Act”); and
WHEREAS,the Board has further determined that itisnecessary and in the best interests of the District thatthe Project be undertaken and,in order to raise fundsrequired forsuchpurpose, that it will be necessary forthe Districttoborrow the sum of $3,500,000 and, in evidence thereof, issue alternate revenue bonds in anaggregate principal amount of $3,500,000 (the “Bonds”), allin accordancewith the Act;and
WHEREAS, the principal of and interest onthe Bonds will bepayable from collections distributedtothe District from those taxes imposed in The County of Whiteside, Illinois, pursuant to the SalesTaxLaw (the “Pledged Revenues”); and
WHEREAS, if the Pledged Revenues are insufficient topay the Bonds, ad valorem propertytaxes upon all taxable propertyin the District without limitation asto rate or amount are authorized tobeextended to pay the principal of and interest on the Bonds:
NOW, THEREFORE, BeIt and It Is Hereby Resolved by the Board of Education of Community Unit School District Number 6, Whiteside and Madison Counties, Illinois,asfollows:
Section 1. Incorporation of Preambles. The Board hereby finds thatall of therecitals containedin the preambles to thisresolution are full,true and correct and does incorporate them into thisresolution by thisreference.
Section 2. Determination to Issue Bonds. It is necessary and in the bestinterests of the District to undertake the Project, and that for the purpose of payingthe cost of the Project, theBonds are hereby authorized to beissued and sold.
Section 3. Publication. This Resolution,together with a notice in the statutory form, shall be publishedinthe WhitesideNewsSentinel, thesame being a newspaper ofgeneral circulationin the District, andifno petition,signed by 342electors,said number of electors being equal to the greater of (i) 7.5% of the number of registered voters in the District or(ii)200 of those registered votersor 15%of those registered voters,whicheveris less, askingthatthe issuance of the Bonds be submitted to referendum, is filed with the Secretary of the Board within thirty (30) days after the date of the publication of this Resolution and said notice,thenthe Bonds shall be authorized tobe issued.
Section 4.AdditionalResolutions. If no petitionmeeting the requirements of applicablelaw is filed during the petition period hereinabove referred to, then the Board may adoptadditional resolutionsorproceedings supplementing or amending thisResolution providing for the issuance and sale of the Bonds and prescribing all the details of the Bonds,solong asthe maximum amount of the Bonds as set forth in this resolution is not exceeded and there isno material change in theProject or the purposes described herein. Such additionalresolutions or proceedings shall inall instances become effective immediately without publication or posting or any further act or requirement This Resolution, togetherwith such additional resolutions or proceedings, shall constitute complete authority fortheissuance of the Bonds under applicablelaw.
Section 5. Severability. If any section, paragraph, clause or provision of thisresolutionshall be heldinvalid or unenforceable, the invalidity or unenforceability of such section, paragraph, clause or provision shall notaffect any of the other provisions of this Resolution.
Section 6. Repealer. All resolutions ororders, or parts thereof, in conflict withthe provisions of this Resolution are to the extent of such conflicthereby repealed and this Resolutionshall bein full force and effect forthwith uponits adoption. Adopted January23,2023.
