Welcome Welcome to The Riyadh Car Show 2019. Silverstone Auctions are proud to be here in Riyadh, the capital of Saudi Arabia, as part of the Riyadh Season inaugural event. By invitation of Seven Concours, Silverstone Auctions are delighted to be hosting the first ever Riyadh Car Show Auction, which forms part of the broader Riyadh Car Show event. The Riyadh Car Show auction is our first sale in the Middle East, and I would therefore like to take the opportunity to provide a brief history on Silverstone Auctions. We are a world-class specialist auction house in the sale of classic cars, supercars and competition cars, and furthermore, we hold the exclusive automotive auction rights to Silverstone Circuit. Since the company was formed in 2011, we have sold over 3,000 cars, with a sale value of £170,000,000, to customers in 31 countries around the world. We select the very best of breed vehicles for our sales which has resulted in us achieving numerous record-breaking auction prices. Coming back to today and our sale here in Riyadh, we are delighted to offer you 45 superb and simply unrepeatable hypercars, supercars and classic cars. Key Sale Information BIDDER REGISTRATION There is a refundable charge for registering to bid of $26,000. A certified cheque for that amount must be executed by the bidder in the name of Seven Modern Trading Company. This will be refunded if no vehicle is awarded. If your bid is successful, this payment will be deducted from your total invoice amount. Proof of identification will be required in the form of a passport or National ID, before the registration process can be completed.
VAT, IMPORT DUTIES AND TAXES Please note that all lots are subject to VAT on the full purchase price (both on the hammer price and buyers premium). It is the buyers responsibility to be aware of any relevant taxes and duties payable.
BUYER’S PREMIUM Buyers Premium on motor vehicles is 12% plus VAT Please note that online bidding incurs an additional surcharge of 1% plus VAT.

We are informed that 40,000km was showing on the odometer at the time of cataloguing and we believe the car was delivered new to the KSA. Representing the end of an era for the 911, the 993-generation is considered to be one of the most desirable variants of the model and has achieved exceptional collectable status not only for its place in Porsche history but for its overall reliability and usability. Whilst the high-horsepower models are often found preserved in collections, the slightly more pedestrian models were generally put into regular use by their first owners and consequently, two decades after production officially ended, finding a low-mileage and well-preserved Carrera S or 4S can be difficult. As such, this C4S warrants serious attention.

Other improvements included more responsive throttle software, enhanced steering feedback, and a reduction in weight by as much as 95kg. The Challenge Stradale also got Brembo carbon-ceramic brakes as standard, shaving 16kg off the curb weight, improving handling and eliminating brake fade. However, the Challenge Stradale is no mere racer-for-the-road and remains sufficiently civilised for comfortable road use.

The latter first appeared on the grid in Challenge form in 2000, featuring a multitude of alterations making it eminently suitable for track use. Three years later, at the Geneva International Motor Show, Ferrari introduced the 360 Challenge Stradale, which in essence was a lightened version of the 360 Modena incorporating some of the racer’s suspension and braking improvements. This was designed by Ferrari engineers with a 20% circuit use and 80% road use in mind. It was fitted with a 3.6-litre V8 engine generating 426bhp at 8500rpm which, when coupled

At the 2002 North American International Auto Show, Ford unveiled a new GT40 concept car. Camilo Pardo, the then head of Ford’s Living Legends studio, is credited as the chief designer of the GT and worked under the guidance of J Mays and Carroll Shelby, the original designer of the Shelby GT500, was brought in by Ford to help develop the GT including performance testing of the prototype.

The GT is similar in outward appearance to the original GT40 but is bigger, wider, and most importantly four in (100 mm) taller than the original’s 40 in (100 cm) overall height; as a result, a potential name for the car was the GT44. Although the cars are visually related, structurally, there is no similarity between the modern GT and the 1960’s GT40 that inspired it. Three pre-production cars were shown to the public in 2003 as part of Ford’s centenary celebrations, and delivery of the production version, simply called the Ford GT, began in the Autumn of 2004. The ultra-high performance Ford GT showcases the finest in advanced technologies, constructed on a lightweight aluminium chassis clothed in superplastic-formed lightweight composite and aluminium body panels. Powered by a mid-mounted, hand-built, supercharged quad-cam 550bhp V8 engine mated to a 6-speed manual transaxle and featuring racing-derived suspension and braking systems, the GT is hugely powerful and delivers astounding performance. It can accelerate from 0-60 in about 3.5 seconds, hurtling on to some 205mph before the speed limiter kicks in. When production ceased in 2006, with just over 4,000 Ford GTs produced, 101 were delivered new to Europe and only a handful to other markets, this epic Ford had made its mark on automotive history once again - and became an instant collector’s car.

Impeccably maintained and in pristine condition • An Aston Martin masterpiece that still looks fresh today When Daniel Craig sauntered into the Casino Royale, Montenegro for his high-stakes poker game in the eponymous film of 2006, parked outside was his service issue Aston Martin DBS. Menacingly sleek and packing a punch, much like 007 himself, the DBS was to star in a record-breaking action sequence towards the end of the film and an exhilarating opening scene for Craig’s second outing as Bond in Quantum of Solace. With a top speed of 191 mph and a 0-60 time of 4.3 seconds, the DBS was the raffish younger bother to its rather sedate older sibling, the DB9, within the Aston family at the time. Although it was a relatively large car, weighing in at 1,680kg, it was in fact 65kg lighter than the DB9 thanks to the extensive use of carbon fibre for its bonnet, bumpers and numerous structural components. using lighter weight semi-aniline interior leather and even the standard carpets were made of a lighter weight fibre.. The centre console was changed with a cast metal surround, new graphics and turned aluminium heater knobs. Scissorstyle doors formed from aluminium ensured that the DBS would make an impression wherever it arrived. Underneath, the DBS utilised a new adaptive suspension design that gave the car tenacious handling when pressing-on or, at the touch of a button, a cosseting ride for gentle cruising. Carbon-ceramic disc brakes ensured that it would come to a halt quickly and effortlessly. Complete street-credibility was ensured by the introduction of a polished sapphire ECU that was inserted into a slot in the starter button instead of a boring old key. Powered by a 510bhp, 5.9-Litre, V12 engine the DBS is a seriously fast Aston and very impressive on the road particularly when fitted with the manual six-speed gearbox as is the car here. In left-hand drive and finished in Stratus White with a Spicy Red interior, the Aston was delivered new to the UAE in 2012 and currently lives in Dubai. Impeccably maintained and having covered only 900km this is a superb example of a very special car.

S.p.A. is an Italian racing car and road car maker founded by Italo-Austrian Carlo Abarth and the company are now about to enter their eighth decade of doing all sorts of things to Fiats, particularly the little 500. Over the years Abarth has offered dozens of variations on the 500, always performance-focused, and more recently special edition models have included the Abarth 695 Biposto Record, the 595 Yamaha Factory Racing Edition and the 500 Track Experience, amongst others. None of them, however, can lay claim to the title of being the “most sophisticated Abarth ever.” That distinction, according to

Abarth itself, now rests on the shoulders of the 695 Rivale Special Edition. Developed specifically to celebrate the company’s close ties to yacht maker Riva, the 695 Rivale is the physical embodiment of the premium luxury that goes into the craft of building those sea vessels. Safe to say, that the “most sophisticated Abarth ever” title fits the 695 Rivale. It’s inundated with aesthetic features that shine a big spotlight on the nautical theme of the compact car. Inside and out, the 695 Rivale is decked to the brim with luxury, the kind you expect from any one of the yachts that Riva has built during its 175-year history. The Rivale 695 doesn’t pack any power or performance upgrades, but that’s an inconsequential omission when you compare it to the quantity and quality of cosmetic additions on offer. The Rivale is finished in two-tone Riva Sera Blue and Shark Grey with an Aquamarine double stripe running the length of the car at waistline height. The door handles are in a satin chrome finish, as are the tailgate mouldings. Specific 695 Rivale badging can also be found on the tailgate and rear bumper of the car with the Riva-inspired side grilles and the new set of 17-inch Supersport alloys finishing off the exterior look. ambience much in evidence. The dashboard appears to be Riva-style solid Mahogany, the interior leather is in a shade of Mediterranean Blue and the use of carbon fibre on the interior also extends to the kick plates.
Supplied new to the KSA, this 695C is one of only 175 convertibles (commemorating Riva’s 175th anniversary) and is unused and offered with delivery mileage only.
The car is powered by a 1.4-litre, turbocharged, fourcylinder engine that produces 180bhp and 184lb-ft of torque, not huge numbers but, in a car this size, it’s enough to accelerate the hatchback to 62 mph in 6.7 seconds before peaking at a top speed of 140 mph. An Akrapovic exhaust ensures it will no doubt be seriously aural, while Koni suspension and four-piston Brembo brakes will make for serious g-forces in all directions when driven hard. This particular car is optioned with the automatic gearbox.

One 115 kW (154 hp) electric motor drives the rear wheels in parallel with the engine and also serves as the main generator. This motor and the engine deliver power to the rear axle via a 7-speed gearbox coupled to Porsche’s own PDK double-clutch system. The front 95 kW (127 hp) electric motor directly drives the front axle and an electric clutch decouples the motor when not in use. The total system delivers 652 kW (874 hp). Porsche provided official performance figures of 0-100 kph (62 mph) in 2.6 seconds, 0-200 kph (120 mph) in 7.2 seconds, 0-300 kph (190 mph) in 19.9 seconds with a top speed of 345 kph (214 mph).
Porsche have a track record of launching groundbreaking sports cars including the 959 and more recently the Carrera GT and, following in the footsteps of these two, Porsche introduced the production version of the 918 Spyder at the 2013 Frankfurt Motor Show. Incorporating cuttingedge hybrid technologies with track-proven Motorsport engineering, the Porsche 918 Spyder would go on to rewrite the supercar rule book with blistering performance, handling and the ability to glide silently in EV mode.
Just 25% of 918 Spyders were optioned with the Weissach package offering upgrades including magnesium wheels, contributing towards a total weight saving of 41Kg, and aero updates resulting in three seconds a lap less than the standard car’s time around the Nordschleife. In September 2013, a 918 fitted with the Weissach package set a Nürburgring lap time of 6:57 reducing the previous record by 14 seconds and making it the first series-production, road-legal car to break the 7-minute barrier.

Power was provided by a 48-valve version of the existing Lamborghini V12, which produced 492bhp, propelling the Diablo to a 207mph top speed and from 0-60mph in under four seconds. It was no surprise then that the Diablo was the fastest production car in the world during 1991. The Diablo VT (Viscous Traction) was introduced in 1993 and set a precedent for Lamborghini’s four-wheel-drive supercar production. All of these improvements resulted in a far better driving experience with neutral handling and better reliability, whilst retaining truly awesome performance. Presented here is a left-hand drive 2001 Diablo VT 6.0, built during the last year of the model’s production. It left Sant’Agata finished in a distinctive Titanium Silver with a Torpedo Nero interior and was delivered to the UAE. We are informed that, at the time of cataloguing, just 13,000km was indicated on the instrument cluster and consequently this Diablo presents in superb condition. Furthermore, McLaren chose to leave the carbon fibre in the cockpit unlacquered, saving another 1.5kg and the windscreen glass was redesigned to be only 3.2mm thick and reinforced with a thick plastic interlayer that allowed McLaren to save 3.5kg over the same item fitted to the MP4-12C. In total, the P1 tips the scales at a dry weight of just 1,395kg. The P1 is powered by a 3.8-litre, twin-turbocharged V-8 mated to an electric motor intended to fill the gaps in performance from the conventional petrol engine. This gives the McLaren a total output of 903 bhp (727bhp from the V-8 and 176bhp from the electric engine). Thanks to the car’s monstrous power output and unique aerodynamics, including adjustable front and rear wings providing as much as 600kg of downforce at 160 mph, performance is nothing short of electrifying. 100 kph takes just 2.8 seconds, followed by 200 kph in 6.8 seconds, onwards to 300 kph in 16.5 seconds (five full seconds faster than the venerable F1) and a top speed of 217 mph (347kph). Introduced at the 2009 Frankfurt Motor Show, AMG described the M159 563bhp engine as “The world’s most powerful naturally aspirated production series engine ever”. From 2013 to 2015, customers could order the highperformance variant of the SLS named SLS AMG Black Series. Notable changes over the SLS AMG included increased engine power to 631 bhp along with a higher rev limit of 8,000rpm, fully revised high-speed valve train with modified camshafts, adapted cam geometry and optimised bucket tappets with a special coating normally used on racing engines. Taking it to the supercar establishment, Horacio Pagani set out to build his own supercar in Ferrari’s backyard in Modena. Thanks to a fruitful career at Lamborghini, Pagani had the experience and drive needed to succeed, and his first production model, the Zonda, quickly proved to be reasonably successful in Europe. However, the Zonda was not available in North America, and consequently, Pagani was missing out on a massive market share. This was especially true in the United States, where potential customers were clamouring for a supercar that stood out from the standard offerings from the likes of

Ferrari, Lamborghini, and McLaren. In order to bring their company to the next level and grow their business, the next Pagani needed to be road-legal in the US. The next project was actually first conceived in 2003, only halfway through the production run of the Zonda. With the Zonda having been first designed in the early 1990’s, it was assumed that the platform was reaching obsolescence and that an entirely new car would be needed to compete with the next generation of supercars. However, Pagani wanted to retain the overall spirit and essence of what had come to define his marque and, for the new Huayra, he continued to be inspired by Leonardo da Vinci, who believed that art and science needed to be in sync to create a masterpiece. Similarly to the Zonda, the Huayra’s engine was sourced from Mercedes-Benz but, unlike the Zonda, Pagani chose to utilise turbochargers. Capable of producing 720bhp and an incredible 1,000 Newton-meters of torque, the resulting performance is simply phenomenal. To help keep the Huayra firmly planted on the road, it utilises active aerodynamics in the form of four independently-operating flaps placed one at each corner of the car. Later that year, an upgraded engine (L410I) was fitted utilising Bosch KE/K-Jetronic fuel injection which increased output to 237bhp at 4,000rpm extending the top speed to 118mph. Built in 1978, this particular Corniche Coupe was optioned in left-hand drive, finished in Seychelles Blue with a black Everflex roof and a navy blue interior, it was delivered new to the KSA. The Zerouno’s bodywork was developed at Italdesign’s advanced Virtual Reality Centre, which enabled the firm to conduct virtual aero testing prior to building the various components in real life. They explain that the upper portion of the car is modelled after the “Italian Gran Turismo tradition,” whilst the lower half is shaped by the demands of aerodynamics. Regardless, it’s more than obvious that the pointed front end was inspired by single-seat race cars (Formula 1 in particular). Front end lift from that central intake was eliminated thanks to something Italdesign is calling the “Y Duct,” whereby air is routed through the intake and split through a Y-shaped divider under the skin, eventually making its way out through vents placed just ahead of the windshield,

generating significant downforce as a result. There are also heat extractors that cool the brakes via vents in the wings, plus further aerofoils at the front end that create even more downforce. At the rear, there are further downforce generators, with a new, large wing, plus a diffuser element. Cooling is enhanced thanks to new rear fins and wing vents. Powered by a 5.2-litre, naturally-aspirated V-10 engine mated to a seven-speed dual-clutch gearbox, the engine produces 610 bhp and 560 Nm of torque at 6,500rpm, with drive to all four wheels. The company quotes a 0–100 kph time of just 3.2 seconds and a top speed of 330 kph. Each of the five made-to-order examples was finished to suit the owner’s requirements: from the choice of materials to the development of a bespoke paint colour code, everything could be tailored to an individual’s wishes. The first owner of this particular car was certainly no stranger to bespoke supercars as he already owned a sizeable private collection regularly showcasing many of the finest supercars and race

In a nod to Stirling Moss’ 300 SLR, which wore #722 and won the 1955 Mille Miglia in record time, McLaren released the 722 Edition, which was introduced in 2008 as an upgraded version of the already excellent model. Its horsepower was raised to 650, and as a result, the car’s 0–60 mph time was improved to 3.6 seconds. Larger carbon-ceramic disc brakes were fitted with lighter 19 inch wheels and the nose received an all-new diffuser and air splitter to improve downforce, as well as a modified front spoiler. 599 GTB could launch from 0 to 60 MPH in 3.7 seconds and continue accelerating hard up to 205 MPH. Like the Maranello that preceded it, the 599 GTB’s electronically controlled adjustable suspension could be programmed for various driving conditions, but response time was increased almost fourfold with the switch from electric motors to magnetorheological shock absorbers. The 599’s interior was voluptuously sculpted and a wonderful blend of leather and carbon fibre with seats that were clearly inspired by those of the Daytona. However, there is always someone who wants something just that bit different and, in 2007, the legendary Italian coachbuilders Zagato were asked to create something special from a customer’s Ferrari 599GTB. The customer wanted something that was distinctive yet obviously Zagato and, some months later, the 599 GTZ Nibbio was unveiled. It was the latest in a long, fine, often wild line of creations from a company that had been modifying cars for nearly 100 years and managed to include all their regular styling cues, the bulbous nose, wide grille, powerful haunches and the signature “double-bubble” — a long-established Zagato calling card. It is difficult to see any elements of the 599’s design remaining in the Nibbio. The front of the car bears a resemblance to those iconic Ferrari racing cars of the early Fifties with its large egg-crate grille and air intakes where

Stuggart-based Gemballa GmbH has been tuning and creating dramatic Porsches for nearly 40 years now so it’s only natural that they would turn their attention to the Carrera GT and the Mirage GT was the result. The idea was to build 25 of these Carrera GT developments and 25 customers were duly persuaded to bring along their beloved Carrera GTs and a substantial quantity of Euros to become the owner of a new Mirage GT.

Naturally, with a project of this nature, a significant amount of the final specification is dependent on the customers’ preferences and in this case, number 25/25, no expense appears to have been spared. Gemballa has been somewhat discreet about the 1,000 hours of work that went into Number 25 other than saying it now offers a “dream combination of carbon fibre, leather, and Alcantara”. An important upgrade, however, is in the engine bay where the 5.7-litre engine has been massaged to deliver 661 horsepower or a healthy 58bhp over the standard model. Torque has also been bumped from the original 435 poundfeet (590 Newton-meters) to 465 lb-ft (630 Nm). The power gains might not be all that impressive, but let’s keep in mind that we’re dealing with an engine lacking forced induction. Gemballa generated the extra power after installing a

custom air intake, a new stainless steel exhaust system, and catalytic converters. They’ve also remapped the ECU of Porsche’s glorious high-revving V10 engine. With the updates in place, the Mirage GT arrives at 62 mph (100 kph) from a standstill in only 3.7 seconds or two-tenths of a second quicker than the standard car. Top speed exceeds 208 mph (335 kph) or a little bit higher than Porsche’s quoted 205 mph (330 kph) – not too shabby for a supercar launched in 2003. The interior has also been subjected to a few changes, with this particular car’s owner deciding to go with Alcantara for nearly all of the visible surfaces. There’s also generous use of carbon fibre, along with contrasting Lemon Yellow stitching and a modified rev counter with the same vibrant hue shared with the gear shift pattern on the centre console and the seat belts. The yellow accents are also much in evidence on the outside where the brake calipers are finished in the same shade, much like the Mirage GT
lettering, the headlights, and the engine cover. Needless to say, the most visible change is represented by the more aggressive body kit encompassing a massive fixed rear wing replacing the standard retractable spoiler. Other modifications worth mentioning include the front spoiler lip, roof scoop, beefy side skirts, and the quad exhausts further denoting that this isn’t your plain Carrera GT. Dating originally from 2005, number 25/25 is left-hand drive and is finished in what appears to be a lovely shade of Porsche Sportclassic Grey with those Lemon Yellow touches and presents superbly. We understand that it has only covered 710km and is fitted with air conditioning, Xenons, ABS, ESP, cruise control and parking sensors. Absolutely remarkable and you won’t see another one.

The engine revs so quickly that Lexus had to fit a digital tachometer instead of a traditional analogue gauge. This technological marvel of an engine is mated to an Aisin SA6 six-speed automated single-clutch, sequential transmission that can shift between gears in less than two-tenths of a second. This gleaming example (468 of 500) is finished in Whitest White (079) and has only covered a handful of delivery miles since being delivered new to the KSA. Predominantly red, the car’s interior is state of the art and incorporates carbon fibre, leather, Alcantara, and metallic surfaces. The LFA’s unique aural footprint is enhanced by the two octaves of engine sound that are channelled into the cabin through twin ducts which connect the firewall with the intake manifold, with the subsequent sound tuned in the manner of an acoustic guitar. The LFA’s huge development costs meant that Lexus lost money on every one of the 500 cars that they produced, a fate which is unlikely to befall the next owner of this rare, delivery miles LFA.

include a new vented carbon-fibre bonnet, carbon-fibre splitter, wide side sills, rear diffuser, and carbon-edged bootlid spoiler. The dynamic front design is also distinguished by the addition of a glossy black mesh grille insert and bold circular daytime running lights borrowed from the Vanquish Zagato. Thankfully, there is considerable substance to complement this racy style. Under that carbon bonnet, the Rapide’s 5.9-litre naturally aspirated V-12 gets upgraded to Vantage GT12 specification. That means an additional 35bhp, raising the output to 590bhp which, according to Aston, results in a 0-to-100kph in 4.2 seconds and a 329kph top speed.
Aston Martin has sprinkled a little of its AMR racing-division magic on its elegant Rapide four-door coupe, as evidenced by the recent unveiling of its new, special-edition 2019 Rapide AMR. Developed with the help of Aston Martin Racing, the car sticks closely to the Rapide AMR Concept showcased at last year’s Geneva Motor Show, which may be why Aston labels this new production version its “most extreme four-door” ever.
To ensure the Rapide AMR stops as effectively as it goes, it’s fitted with huge new carbon-ceramic rotors - a first for the Rapide - clamped by six-piston calipers up front and four at the rear. Another first for the Rapide is the addition of standard 53cm forged alloy wheels at each corner, wrapped in ultra-high-performance Michelin Pilot Super Sport rubber.
Whereas the standard Rapide S is a masterpiece of refined elegance, this AMR version throws subtlety out the window with its track-focused persona. Bold exterior changes

The Zonda C12 debuted in Coupe form at the 1999 Geneva Motor Show, its maker freely acknowledging

that its styling had been inspired by the Mercedes-Benz Group C Silver Arrow sports-racers. Mercedes-Benz’s influence was more than just skin deep, for the German firm’s AMG performance division was responsible for the Zonda’s 6.0-litre V12 engine, which was mounted longitudinally amidships in the predominantly carbon fibre body tub. With some 408 horsepower on tap, the C12 was always going to be quick, but performance figures of 0-60mph in 4.2 seconds and 0-100mph in 8.2 seconds were simply staggering plus, of course, that all-important 200mph (or thereabouts) top speed. Seemingly small from the outside, yet endowed with a comfortable cabin, the C12 provided the basis for a host of derivatives, which emerged from Pagani’s factory at San Cesario Sul Panaro near Modena, in strictly limited numbers over the next 11 years. After only a handful of 6.0-litre C12s had been built, the model was joined by the 7.0-litre C12 S in 2001. Maximum power increased to 542bhp with a commensurate increase in all-round performance, the 0-60mph time dipping below 4 seconds and, as if that wasn’t enough, a 7.3-litre, 555bhp version followed in 2002. Traction control became standard equipment on a Pagani for the first time with the 7.3’s introduction Subsequent variations on the C12 theme include the Zonda GR sports-racer, C12 S Monza track-day car, C12 F and C12 Roadster F, Zonda R track car, Zonda Cinque and Cinque

Roadster, Zonda Tricolore and various one-offs for wealthy clients. This, one-off Zonda Riviera is another addition to the 760 Series and is based on a Zonda F. As has become a regular practice, owners of earlier models return their cars to the factory to be upgraded and, in this case, Pagani offered him the opportunity to create a one-off, totally bespoke 760 Series. Upgrades include new carbon fibre body panels, a roof scoop, a carbon fibre rear wing, carbon-black wheels and carbon fibre front canards on the exterior. The interior is fitted with bespoke brilliant blue leather bucket seats with matching door panels, a flat-bottomed Alcantara-covered steering wheel and an interior design mix of navy blue aluminium, navy Alcantara, navy carbon fibre and dark blue

The Ferrari F12 Berlinetta was Ferrari’s replacement for the 599 GTB and the company was keen to ensure that not only was it considerably quicker than its seminal predecessor, but also more enjoyable at low speeds. Those aims were broadly achieved and the F12 is both a GT and a supercar, mixing front-engined packaging and civility with exotic, F1inspired dynamic ability.
The F12 also benefits from the latest evolution of Ferrari’s adaptive magnetorheological dampers (SCM-E), which react much more quickly, improved carbon-ceramic brakes and, as ever, the relentless evolution of the many traction and stability systems sees huge gains in control and speed. Then there’s the famous aero-bridge – ducts set into the front wings – which reduce drag and improve downforce, plus active brake cooling ducts that only open when the discs are getting really hot, to reduce drag. The list of technical highlights is almost endless! Ferrari retained an aluminium chassis for the F12 but new materials increase stiffness and reduce weight. It really is quite a package!
The engine is similar in size to the Ferrari FF’s but significantly re-engineered to produce more power, rev higher and offer a much quicker throttle response. It produces an almost unbelievable 730bhp at 8250rpm

Though customers were thrilled with the 550 Barchetta Pininfarina, many felt limited by the lack of a conventional convertible top and only used their cars for quick outand-back jaunts in the summertime. Looking to provide a solution to this sales-limiting problem when the 575M Maranello arrived, Ferrari introduced the Superamerica with its revolutionary rotating hardtop. Unveiled at the LA and Detroit Auto Shows in 2003, the Superamerica was a Targa version of the 575M and was the first Ferrari to feature a motorised and folding hardtop.

The title Superamerica extends back into Ferrari’s history as a name that was given to the most exclusive and powerful luxury models. Derived directly from the 575M Maranello, the Superamerica’s big 12-cylinder engine was boosted to deliver 540bhp through a six-speed electro-hydraulic F-1 transmission and independent front and rear suspension with coil springs, telescopic shock absorbers with adaptive damping and anti-roll bars, combined to keep the fastest convertible of the time on the road. Designed by Fioravanti, the innovative flip-top roof is made of translucent materials, which adjust to vary the amount of light coming into the cockpit. Called Revochromico by Ferrari, the system has five tint levels available and the glass can go from dark to light in under a minute. As the frame for the glass is made from very strong carbon fibre, the Superamerica can reach very high speeds with the top in the up or reclined position. The new car’s performance figures were seriously impressive with 0-100 kph coming up in 4.2 seconds and a top speed of 320 kph (199mph). A total of 559 Superamericas were built fitting in with Enzo Ferrari’s philosophy that there should always be one fewer car available than the market demanded. The Superamerica was a much more serious attempt at an open V12-engined Ferrari than the completely roofless and poorly executed 550 Barchetta and promised to bring a new dimension to the heavy-hitting thrills of the 575M Maranello

The Carbon Series cars only differ externally from the other 370 P1s and are mechanically identical, powered by a 3.8-litre, twin-turbocharged V-8 mated to an electric motor intended to fill the gaps in performance from the conventional petrol engine. This gives the P1 a total output of 903bhp (727bhp from the V-8 and 176bhp from the electric engine). Thanks to the car’s monstrous power output and unique aerodynamics, including adjustable front and rear wings providing as much as 600kg of downforce at 160mph, performance is nothing short of electrifying. 100kph takes just 2.8 seconds, followed by 200kph in 6.8 seconds, onwards to 300kph in 16.5 seconds (five full seconds faster than the venerable F1) and a top speed of 217mph (347kph). A high-density lithium-ion battery pack powers the electric motor, which can be left to deploy automatically or selected by the driver, who thus has the options of using the petrol engine on its own, the electric motor on its own, or the two in combination. Following the continued success on the track and in order to homologate Ferrari’s 1966 Formula 2 campaign, a new line of mid-engined production V6 Coupes with Fiat running gear went on sale in 1967 in 2-litre form, however, in 1969 a larger 2.4 litre Dino was introduced, named the 246 GT. The voluptuous bodywork, which many people still regard as the prettiest ever to grace a road-going Ferrari, was designed by Pininfarina and built by Scaglietti and covered a tubular chassis which carried wishbone independent suspension at each corner. The compact, four-cam engine which delivered 190bhp, was mounted transversely above the five-speed gearbox and just ahead of the rear axle, allowing for both a comfortable cockpit and some usable boot space. This stunning, left-hand drive 246 GT is showing only 4,300km on the odometer and is finished in the classic Ferrari colour combination of Rosso and Crema. A 246 GT Dino showing this mileage and level of quality is virtually impossible to repeat and, combined with this competitive estimate, this certainly looks like a very exciting proposition indeed.

the time necessary to design, build, and develop a new single-seater for the 1954 season. Instead, Chief Engineer, Fritz Nallinger, suggested that the company build a new twoseat sports car utilising the strong in-line SOHC six-cylinder engine from its luxurious 300 series. Because the engine and drivetrain were relatively heavy, the chassis would have to be extremely light. Test Department manager Rudolf Uhlenhaut, having some experience with tubular chassis design, sat down with construction engineer Joseph Müller and laid out an extremely light (154 pounds) and rigid lattice-work chassis capable of accommodating the big inline six. One major problem soon presented itself: there was no way to mount conventional doors without compromising the rigidity of the chassis. The solution was to raise the entry so that the doors cut into the roof, but that meant hinging them from the top, thus giving birth to this car’s timeless signature design feature. New York imported auto-entrepreneur, Max Hoffman, is credited with urging Mercedes Benz to build a production sports car based on their 300SLR racer. He was remarkably persuasive and the new 300SL Gullwing, in final form, was unveiled at the New York International Motor Sports Show in early February 1954, with production beginning that Autumn. The new Coupe was only slightly changed in appearance from the SLRs but featured Bosch direct fuel injection. This prompted the factory to claim it was,

Nowadays though, this extreme rarity has made the Camargue highly collectable and the majestic angularity of the coachwork is increasingly appreciated for its sculptural qualities, so evocative of the haute couture of its period. Dating from 1979, this left-hand-drive car was supplied new to the KSA where it still resides to this day. It remains completely in its original factory specification and although the combination of a Masons Black exterior and a black leather interior was unusual at the time, it now looks seriously cool. Having covered a mere 9,000km from new, this is surely one of the lowest mileage examples on the market and combined with it being one of the rarest, and most controversial Rolls-Royce models ever, the Camargue is undoubtedly a future collectable.

Styled by Pininfarina’s Leonardo Fioravanti, creator of the awe-inspiring Ferrari 365GTB/4 Daytona, the 288 GTO was based on the 308 GTB (another Fioravanti creation) and made its public debut at the Geneva Salon in February 1984. Fioravanti later recalled Enzo Ferrari’s original design brief, ‘There was no specific instruction, just to produce a car based on the 308 GTB that could be used for racing’. Although superficially similar to the contemporary 308 GTB Quattrovalvole, the 288 GTO was radically different beneath the skin, mounting its V8 engine longitudinally rather than transversely, a change that necessitated a new chassis with a wheelbase extended from 234cm to 245.1cm. This new frame was constructed of steel tubes in the traditional manner while incorporating the latest in Formula 1-derived composite technology in the form of a Kevlar and Nomex bulkhead between the driver and engine. The alteration in engine layout had been made to accommodate twin IHI turbochargers and their associated Behr inter-coolers and plumbing; the adoption of forced induction requiring that the quad-cam, 32-valve V8 be downsized from 2,927cc to 2,855cc to comply with the regulations. Ferrari’s considerable experience gained from turbo-charging its Formula 1 engine was deployed in adapting the 308 unit, the latter in highly modified 288 GTO form producing 400bhp at 7,000rpm and a mighty 366lb-ft of torque at

just 3,800 revs. Top speed was a staggering 189mph. Its three rear-wing cooling slots deliberately recalling the earlier GTO, the 288 bodywork likewise benefited from the adoption of F1 technology, being constructed of glass fibre and a mixture of the lightweight composite materials Kevlar and carbon fibre. Aerodynamically refined in the wind tunnel, the 288 GTO sported flared wheel arches, larger front and rear spoilers, taller door mirrors and four additional driving lights in the front grille, these subtly altered looks combining elegance with muscularity in equal measure. Given its race-bred, state-of-the-art technology and drop-dead gorgeous looks, it is not surprising that the 288 GTO appealed to Formula 1 drivers of the day, with Ferrari’s Michele Alboretto and René Arnoux, and even McLaren’s Nikki Lauda numbered among its owners. In the event, the 288 GTO never contested the races for which it had been conceived, as the FIA axed Group B, citing lack of manufacturer interest as the reason.
We understand that 55233 is the 135th GTO built (out of 272), was delivered new to Austria finished in white with a blue interior and was once part of Chris Evans’ famous ‘White Collection’ of seven important Ferraris all finished in Bianco. It was subject to a ground-up restoration costing in excess of £150,000 in 2009. The car is now finished in Rosso Corsa with a Nero interior and has only covered 31,000km from new. With total production amounting to only 272 cars, every one of which was sold prior to the start of production in July 1984, these cars have been covetable ever since the production ceased in 1986. The modest number built, particularly compared to all subsequent Ferrari flagship supercars, has ensured that today it is truly a worthy successor to the 250 GTO and remains one of the most desirable and sought-after Ferraris of recent times.

However, whilst enjoying the vast reserves of power available, W12 owners were not over-impressed with the fuel consumption and it wasn’t long before the range was joined by the GT V8. Producing 500bhp, this all-new power unit incorporated the latest in fuel-saving technology, including cylinder deactivation and over-run alternator charging offering significantly better fuel consumption. It was to be this new V8-powered car that would be chosen to spearhead Bentley’s return to active competition. First seen in concept form at the 2012 Paris International Auto Salon, the GT3 was intended to bring the famous British manufacturer back to the forefront of international endurance racing. The car was developed jointly by a special team of Bentley engineers working with Malcolm Wilson’s company, M-Sport Ltd and with its 4.0-litre V8 engine boosted to 600bhp, the rear-wheel-drive GT3 incorporated all the latest developments in competition-car technology. There was never any chance that Bentley’s marketing department would miss out on building a road version, and the resulting GT3-R was launched for the 2014 season at that year’s Pebble Beach Concours. Maximum engine power was reduced slightly (to a still staggering 572bhp) which, combined with a reduction in weight of 100kg compared to the standard V8, endowed the GT3-R with truly supercar performance. Equally impressive was the maximum torque of 516lb-ft, which was delivered at a lowly 1,700 revs and vectored for each of the rear wheels. In addition, the GT3-R featured shorter gearing, re-calibrated control software, an all-new titanium exhaust system, 21 inch forged alloy wheels, electronic stability control, and a Carbon Silicon
Carbide (CSiC) braking system with 8-piston front calipers. Externally, the GT3-R boasted a vented bonnet and fixed carbon fibre rear wing and boot lid, whilst the Glacier White livery featured contrasting two-tone green graphics, and external trim fittings were picked out in gloss black. The two-seat cabin was trimmed in a mix of carbon fibre, Alcantara, and leather, with a smattering of GT3-R badges. The UK launch price was a substantial £237,500 and this, and the fact that only 300 were built, also helped to ensure its exclusivity. Immediately recognisable as not only an Aston Martin but one with Zagato coachwork, the V12 Zagato is clothed in lightweight, hand-rolled aluminium and carbon-fibre body panels and over 2,000 hours of craftsmanship were expended in the construction of each. This represents the extreme application of Aston Martin’s know-how and the technologies, materials, and techniques that have been gained by creating the recent generation of Aston Martin cars, making the V12 Zagato a modern classic Aston Martin like no other. The use of the finest materials has always distinguished Aston Martin from its rivals. Although never considered a fast car, with the help of the General Motorssourced ‘Turbo-Hydramatic 400’ transmission, the Silver Shadow was smooth, quiet and capable of rapid and comfortable cruising. This particular Silver Shadow is a long-wheelbase car dating from 1975 and was finished in left-hand drive before being exported new to the KSA where it remains registered. Only 2,780 long wheelbase cars were built, fewer without the division between the front and rear seats. Cars without the dividing panel are more desirable offering more legroom in the rear and enabling the driver’s seat to go back further. Remarkably, it has only covered some 7,000km during that period, incredibly low mileage and likely impossible to find again. The car has been subject to a sympathetic restoration, retaining as much originality as possible, and carefully restoring or replacing everything else with the intention of returning it, both visually and mechanically, to as close to new as possible. It is currently presented in Porcelain White with a Bordeaux leather interior piped in white and is an excellent example of the era-defining Silver Shadow.

Using a twin-turbocharged version of Audi’s 4.2-litre 90-degree V8 – complete with lightweight internals – and mated to a sixspeed sequential transmission, the Apollo was available in three versions: the entry-level Apollo (641bhp), the Apollo Sport (690bhp) and Apollo R (for race) at an incredible 789bhp. Production of the Apollo started in October 2005 and, not long later, the first fully functioning road car made its way to Europe, became fully road-legal and was sold in various Gumpert dealerships. test driver Matt Prior stated that “the Apollo recalibrates the meaning of pure speed and driving feel”. On Series 11 of Top Gear, the Apollo lapped the Top Gear test track in a time of 1:17.1, setting a record that lasted for two years until surpassed by the Bugatti Veyron Super Sport. The Apollo S is equipped with an extended aerodynamic package and, in contrast to the three-part spoiler of the entry-level car, possesses a racing wing which produces even more downforce and pushes the Sport’s maximum speed up to 360kph. On offer here is an unused, delivery mileage Apollo S that was built in 2013 finished in matte black with red-stitched grey Alcantara and black carbon fibre. Believed to be one of only 13, this is a rare car and possibly one of the last from the production line before bankruptcy was filed in August 2013.

Aston’s biggest engine shoehorned into their smallest sports car • 0-100kph in a mere 4.2 seconds, this engine, gearbox and chassis work in complete harmony • In Cobalt Blue, with a manual gearbox and only 600km, this is a very desirable Aston In early 2008, Aston Martin CEO Dr. Ulrich Bez confirmed that production of the V12 Vantage would commence in mid-2009, though with the 510bhp engine shared with Aston Martin’s other 12-cylinder models rather than the Vantage RS prototype’s 580bhp dry-sump racing unit. Based on the V8 Vantage Coupe, the production V12 Vantage is powered by Aston Martin’s 6.0-litre V12 as found in the V12 Vanquish, DB9, and DBS models. Getting the V12 to fit the V8 Vantage chassis involved grafting on the engine cradle from the DB9, while the resulting weight increase and more forward weight distribution was accommodated by revised suspension settings. Boasting a kerb weight of 1,695kg (3,737lb), the V12 Vantage accelerates from 0-62mph (100kph) in 4.2 seconds and can achieve a top speed of 190mph (306kph).

The V12 Vantage’s interior features plush full-grain leather with an Alcantara headlining, power seats and automatic temperature control. Steering wheel-mounted audio controls are standard for the base 160-watt audio system. Alloy dash trim was standard and piano black trim was available. Heated, memory seats, a voice-activated Bluetooth, a 700watt audio system with Dolby Pro Logic II, and personalised sill plates were amongst the many factory options. Optional carbon fibre and Kevlar composite seats save 37 pounds per car, the instruments and gauges were redesigned to be more legible at speed and carbon fibre and Alcantara were used throughout the cabin to help lighten the car’s overall mass. This left-hand drive, manual gearbox, V-12 Vantage was supplied new to the UAE and now resides in Dubai. Finished in a stunning shade of Cobalt Blue with a Spectral Blue and Obsidian Black leather and Alcantara interior, the car has covered a mere 600km from new and remains in pristine condition.

It has extensive reinforcements to compensate for the lack of a standard roof and small changes to the windshield and running lights. Two removable tops are included, the second a temporary arrangement fashioned after an umbrella. The top speed with the hardtop in place is the same as the standard Coupe version, but with the roof removed is limited to 369kph (229mph) and to 130kph (81mph) with the temporary soft roof. On offer here is a 16.4 Grand Sport in Full White with a striking red leather interior that was built in 2011 and remains in standard factory specification. It had become traditional for Sant’Agata to celebrate important anniversaries and following on from the Countach 25th Anniversary edition launched in 1988 and the Diablo SE launched in 1993, Automobili Lamborghini introduced the Murcielago 40th Anniversary Edition which was limited to 50 cars. They were only available in an exclusive Verde Artemis (jade green) colour, with a three-layer pearl effect paint and featured some significant modifications – both internal and external – compared to the series production Murcielago.

The upper door moulds, as well as the voletto or pillar surrounding the rear window where the petrol door is located, featured an optic carbon fibre coating and the bespoke, model-only, alloy wheels were finished in Anthracite Grey and sported logos accurately reproducing Lamborghini’s trademark. These cars were also fitted with a newly designed exhaust system and silver-grey callipers. Last but not least, the cars had a lateral side plaque featuring the 40th Anniversary logo as well as an internal limited edition numbered plaque located inside the rear window. The interior is also new with an asymmetrical design. The driver’s side is trimmed with Grigio Syrius (dark grey) perforated leather and the passenger’s side with smooth black leather, a bit quirky we know but it works quite well in practice. The new accessories are completed with special floor mats featuring the 40th Anniversary logo and an Alpine radio with incorporated CD player. Mechanically these cars were no different from the standard 2004 Murceliago and utilised the 571bhp naturally aspirated, V12 producing 571bhp which was fed to all four wheels.

Friday 22nd November 2019 • Number six of just 20 exclusive examples sold between 2007 – 2009 • Sought after, rare and highly collectable, examples seldom come to market • Very low use, indicating just 3,000km at the time of cataloguing • Carbon fibre body finished in Grigio Reventon with a Nero and Verde Oliva interior Manfred Fitzgerald, Lamborghini’s Director of Brand and Design at the time, apparently made a number of visits to the NATO base at Ghedi and is believed to have used the Lockheed-Martin F-22 Raptor as the Reventon’s inspiration. It’s fairly clear to see, given everything from the gaping front air intakes, the vastly reclined cock-pit style bucket seats and the wing-like scissor doors, that this Lamborghini’s design couldn’t be moulded on anything else. The Reventon was the company’s first real limitedproduction halo car created to give the world a glimpse of the brand’s next production car which, in this case, was the dramatic Aventador in 2011. Lamborghini produced just 20 customer Reventons (and one for its museum), 10 of which were destined for the United States.

As well as representing the F-22 Raptor visually, the car’s pace isn’t far behind, with Lamborghini’s raucous V12, 6,496cc engine, pushing out 650bhp, combined with a sixspeed, single-clutch, paddle shift mechanical transmission. Lamborghini also decided to opt for front and rear independent suspension with hydraulic shock absorbers, co-axial coil springs as well as four-wheel ventilated disc brakes, utilising ABS. This astonishing package means that the Reventon propels its occupants from 0-62mph in a Raptor-rivalling 3.4 seconds. The bodywork is entirely carbon fibre and has some aerodynamic pieces, such as the subtle canards, leading to a 10% reduction in the drag coefficient as well as notable increases in both front and rear end downforce at high speeds. From the seat of this left-hand-drive model, the driver can observe the TFT liquid crystal screens, displaying the digital circular tachometer dials, representing those of a fighter jet. On the armrest between the seats, you’ll find a plaque with ‘6/20’ stamped on it, indicating that this car is number six of the Reventon’s 20-car production run. Just like its 19 siblings, this example is finished in a special Grigio Reventon (opaque grey) exterior with Nero (black) and Verde Oliva (olive green) interior.

Like its illustrious predecessor, the F12tdf was a lightweight, track-focused model aimed at wealthy connoisseurs and gentleman racers and only 799 were built during the 2016 and 2017 seasons. The F12tdf utilised the same 6.3-litre V12 engine as the standard car, albeit modified to produce 770bhp, and the deletion of much of the leather/aluminium interior trim in favour of Alcantara and carbon fibre, together with swapping many exterior aluminium panels for carbon fibre, resulted in a weight loss of a substantial 110kg. The result was a reduction of the 0-100 kph time to 2.9 seconds, top speed was now in excess of 340kph and around Fiorano, the F12tdf was 2.0 seconds quicker than its standard sibling. Ferrari Tailor Made is the exclusive Ferrari programme for those customers who want to customise each element of their car for a perfect fit, creating an unmistakable, one-ofa-kind vehicle which reflects their personality and tastes. Amongst the new features on the Turbo was an electronically controlled, viscous coupling, all-wheel-drive system, something Porsche had not offered on a turbocharged model since the 959 and a system that greatly improved the driveability of the car. Under the engine lid, now topped with a sculpted tail spoiler with downturned edges, lived the 3.6-litre, flat-six force-fed by twin K16 turbos. Combined with bigger brakes, fatter tires, a wide body and lower stance, the 993 Turbo was one of the fastest cars on the planet. Dating from November 1995, this lovely example is a lefthand drive, US-specification car finished in Guards Red with a Savannah Tan interior and cashmere coloured carpets. Aston Martin’s most recent collaboration with Zagato was first seen at the Concorso d’Eleganza Villa d’Este in 2016. Built on the Vanquish platform, this two-door Coupe boasted a variety of typically Zagato design cues, yet was instantly recognisable as an Aston Martin, albeit one with a bit more Italian flair! Shortly following the Coupe, several other body styles were introduced, including a Volante, Roadster and arguably the most compelling, a Shooting Brake. The stunning coachwork was made completely of carbon fibre using larger panels and fewer split lines than usual, helping to create a truly handcrafted appearance and a seamless design, almost as if it was sculpted from a single piece of metal. Underneath its coachwork, Aston Martin’s 6.0-litre V-12 produces 580bhp and 630 Nm of torque, which helps the car sprint to 100 kph from a standstill in just 3.5 seconds. Further mechanical changes include a slightly more open exhaust, creating for a more sonorous exhaust note, and a slightly stiffer suspension. As one would expect for a coachbuilt motor car, each Vanquish Zagato was fully customisable, leaving their lucky owners to tailor their new cars to their specific tastes. It would be difficult to find two examples with identical specifications, making each car just as special as the last
and that was certainly the case here. This striking car is finished in special-order Topaz Chrome 2 which really suits the car’s elegant lines and complements the stunning Sahara Tan interior. The long list of this car’s standard features runs to two pages, however, a close inspection of the invoice from Park Place Aston Martin reveals that the options list was ticked to the tune of a further $173,961. This includes the Villa d’Este package (the badges, wheel spokes, and side strakes are picked out in gold – which is then brought through to the dashboard on vents and elements of switchgear) - $30,630, carbon fibre roof panel - $10,700, Burl Ash dashboard veneers and fascia trim $29,061, and duo-tone machined aluminium-£45,495 and much more. In addition, the car has been equipped with a
set of Bridge of Weir leather fitted luggage in Sahara Tan. There are only 99 of these cars and this is the only one that looks like this.

Yet the term supercar does not do full justice to the SLR, which, its peerless performance notwithstanding, is a luxurious and finely engineered Gran Turismo in the best traditions of Mercedes-Benz. Rather than creating an all-out, nocompromise supercar, Mercedes-Benz and McLaren decided to take a slightly different route. Instead of placing the engine behind the cabin, the car had a front-mid-engine layout, with the engine sitting behind the front wheels

and just ahead of the cabin. This, near-perfect, weight distribution not only helped to improve the SLR’s handling but also provided the car with a rather spacious cabin and a decent boot, not common in cars boasting such performance credentials. As it was supremely engineered and built to incredible standards at McLaren’s facilities in Woking, it boasted a very high level of fit and finish, absolutely appropriate for any car wearing a Mercedes-Benz badge. The heart of any car is its engine, and that of the SLR McLaren is truly outstanding. Produced at MercedesBenz’s AMG Performance Division, it’s a 5.5-litre, 24-valve, supercharged V8 producing 617bhp, making it one of the most powerful engines ever found in a series-produced roadgoing sports car. Impressive though this peak horsepower figure is, it’s the torque produced by the Lysholm-type twinscrew supercharger that is its most remarkable feature. The torque curve is almost flat: there is already 440lb/ft by 1,500 rpm and well over 500lb/ft between 3,000 and 5,000 revs, and acceleration is equally phenomenal, with 0 to 60 mph taking just 3.8 seconds and the quarter-mile only 11 seconds. Of course, a car with such impressive speed credentials also requires an equally impressive braking system. The basic facts can look a bit dry; type 993, 450bhp, 3605cc air-cooled flat six-cylinder engine with twin turbochargers and electronic fuel injection, six-speed manual transaxle, front and rear independent suspension with coil springs, and four-wheel ventilated steel disc brakes, however, the Turbo S was a big step up over the standard 911 Turbo in terms of performance and price. Headlined by a 0–60mph time of 3.6 seconds, the S could hit 100mph from a standstill in 8.9 seconds, only half a second faster than the standard Turbo. But that didn’t

matter, the Turbo S was special and getting your name on the waiting list to buy one was nigh on impossible unless you were very closely related to a Dealer Principal. All 345 examples of the 993 Turbo S were built by Porsche’s Exclusive department and the specification included a number of unique features when compared to other 911’s of the period. The car sported yellow brake callipers, a unique rear spoiler, polished five-spoke Turbo S wheels, an Aerokit front spoiler, an air intake in the rear wings, and four exhaust pipes at the rear. Inside, the car luxuriated in carbon fibre trim contrasting with the softest of leathers and provided the type of luxury that customers had come to know and love from Porsche’s top-shelf models. The Turbo S delivered stunning performance in a package as luxurious and exclusive as discerning Porsche customers had come to expect and was one of the very few supercars that could comfortably be driven as a daily commuter. Collectors today value the ‘S’ for its rarity, performance, and the timeless styling of the final iteration of the legendary air-cooled 911 Turbo. Terms and Conditions GENERAL The following Terms (“Terms”) together with such other terms, conditions and notices as may be set out in any relevant catalogue apply to all sales by SEVEN MODERN COMPANY TRADING at auction or within 14 days after the auction. No alteration to the Terms will be binding unless accepted by SEVEN MODERN COMPANY TRADING in writing. The Terms may be amended by SEVEN MODERN COMPANY TRADING provided it is reasonable for it do so by the posting of notices or by oral announcement made by the Auctioneer prior to or during the sale. Nothing in the Terms shall affect the statutory rights of a consumer. Additional information applicable to the Auction may be set out in the Catalogue for the Sale, in an insert in the Catalogue and/or in a notice displayed on the Lot or visible elsewhere. Verbal announcements affecting the Auction may be made before and during the bidding. Buyers should be alert to this possibility of changes especially if bidding otherwise than in person at the Auction. SEVEN MODERN COMPANY TRADING acts solely for and in the interests of the Seller. SEVEN MODERN COMPANY TRADING’s duty is to sell the Lot at the highest price obtainable at the Auction to a Buyer. SEVEN MODERN COMPANY TRADING does not act for Buyers in this role and does not give advice to Buyers. When SEVEN MODERN COMPANY TRADING or its employees make statements about a Lot it is doing so as agent for the Seller of the Lot. Buyers who are themselves not expert in the Lots are strongly advised to seek and obtain independent advice on the Lots and their value before bidding for them. DEFINITIONS 1. In these Terms: 1.1 “Auction” means the auction sale in respect of which a Lot is consigned for sale. 1.2 “Auctioneer” means the representative of SEVEN MODERN COMPANY TRADING conducting the Auction. 1.3 “Automobilia” means any memorabilia including but not limited to trophies, badges, programmes, models, prints and other collectables. 1.4 “Buyer” means the only person whose bid is accepted by SEVEN MODERN COMPANY TRADING to conclude the contract for the purchase of a Lot. 1.5 “Buyer’s Premium” means the amount payable by the Buyer to SEVEN MODERN COMPANY TRADING. Buyers premium on Motor Vehicles is 12%. The buyer also bears the value of VAT and customs arrangements as applicable in the country where the vehicle will be registered. 1.6 “Catalogue” the catalogue relating to the relevant Auction includes any advertisement, brochure, estimate, price list or other publication or webpage relating to one or more Lots offered in the related auction. 1.7 “Contract” means the agreement between the Buyer and the Seller on the successful bid of the Buyer on which the Lot is awarded to them. 1.8 “Entry Fee” means the sum of $300 (inclusive of VAT). 1.9 “Expenses” in relation to the sale of any Lot means charges and expenses payable by the Seller in addition to the Seller’s Commission including insurance, storage, illustrations, auction Entry Fee, cleaning costs, photography costs, catalogue costs, special advertising, packing, freight, of that Lot and any VAT thereon. 1.10 “Hammer Price” means the price in US dollars at which a Lot is awarded by the Auctioneer to the Buyer. 1.11 “Lot” means any item(s) consigned to SEVEN MODERN COMPANY TRADING with the view to its or their sale at Auction (including all motorcars and Automobilia items). 1.12 “Motor Vehicle” means any car or motorbike included or proposed to be included in a sale of motor vehicles together with spares, tools, documentation etc. stated as being part of the Lot.

1.13 “Purchase Price” means the Hammer Price together with the Buyer’s Premium and any additional charges due plus VAT. 1.14 “Reserve” means the minimum Hammer Price agreed between SEVEN MODERN COMPANY TRADING and the Seller at which a Lot may be sold. 1.15 “Sale Proceeds” means the net amount due to the Seller being the Hammer Price less the Seller’s Commission and VAT, Expenses and any other amount due to SEVEN MODERN COMPANY TRADING from the Seller. 1.16 “Seller” means the person who offers the Lot for sale, whether as agent or principal. 1.17 “Seller’s Commission” shall have the meaning given in clause 10. 1.18 “VAT” means Value Added Tax applicable at the prevailing rate from time to time. 1.19 “Working Day” means any day at which clearing banks are open for the transaction of normal US dollars banking business. 1.20 “Provisionally sold” means the bid placed during the auction has not been accepted by the seller. A provisional bid stands until 12pm the day following the auction. 2. Agent SEVEN MODERN COMPANY TRADING sells as agent for the Seller (except where SEVEN MODERN COMPANY TRADING is selling as principal, which SEVEN MODERN COMPANY TRADING will disclose in the Catalogue or otherwise in the Auction). The Contract for the sale of a Lot is between the Seller and the Buyer. SEVEN MODERN COMPANY TRADING shall not be liable for any act or default by the Seller (except where selling as principal) or the Buyer. The Seller undertakes and commits to transfer the ownership of the Lot or the Car to the Buyer and terminate all legal procedures required, without any liability on SEVEN MODERN COMPANY TRADING to the Buyer. 3. Discretion 3.1 SEVEN MODERN COMPANY TRADING has the right as its sole discretion to refuse any bid, to divide any Lot, to combine two or more Lots, to withdraw any Lot and, in the case of dispute, to put any Lot up for Auction again. 3.2 If SEVEN MODERN COMPANY TRADING is notified about the Seller’s alleged breach of any of the Terms before it has remitted the Sale Proceeds to the Seller, it may at its sole discretion withhold payment until that dispute is resolved. SEVEN MODERN COMPANY TRADING may, however, deduct any sums that are due to it from the sum held. 3.3 Automobilia lots will be subject to an auctioneers 10% discretion on the reserve unless SEVEN MODERN COMPANY TRADING are notified in writing by the seller otherwise. 4. Loss or injury SEVEN MODERN COMPANY TRADING shall be under no liability for any injury, damage or loss sustained by any person while on SEVEN MODERN COMPANY TRADING premises (including any premises where a sale may be conducted or where a Lot, or part of a Lot, may be on view from time to time) except for death or personal injury, damage or loss caused by the negligence of or other breach of duty by SEVEN MODERN COMPANY TRADING, its employees or agents in the ordinary course of their duties to SEVEN MODERN COMPANY TRADING. 5. Lots 5.1 The Catalogue contains details about each Lot. The description printed in the Catalogue is given on behalf of the Seller, from information supplied by the Seller for which SEVEN MODERN COMPANY TRADING is not responsible. 5.2 Photographs, Illustrations and diagrams contained in the Catalogue are for identification purposes only. They may not show the true condition and colour, (which may be inaccurately reproduced) of the Lot. 5.3 Lots are available for inspection prior to the Sale and it
is for any potential bidder to satisfy themselves as to each and every aspect of a Lot, including its originality, authorship, condition, provenance, history, background, authenticity, style, period, age, suitability, quality, roadworthiness (if relevant), origin, value and estimated selling price (including the Hammer Price). No description of a lot carries with it an implication that it is fit for any particular purpose. 5.4 Each Lot is sold by its respective Seller to the Buyer. Lots are sold to the Buyer on an “as is” basis, with all faults and imperfections without any liability on SEVEN MODERN COMPANY TRADING to the buyer. 5.5 The actual condition of a Lot may not be as good as its outward appearance suggests. In particular parts may have been replaced or renewed and those parts may not be original or of ‘Satisfactory Quality’. The inside of a lot may not be visible where, for example, it is covered by upholstery or material, and may not be original or may be damaged, have been damaged or poorly repaired. Given the age of some Lots, no assumption should be made with regard to any aspect of their condition. 5.6 Any person who physically interferes with, scratches or damages the Lot in any way (at, before or after the Auction) will be held liable for the loss so caused. 5.7 The Seller is responsible for delivering the Lot in a presentable and saleable condition. If additional cleaning is required, it will be charged for by SEVEN MODERN COMPANY TRADING to the Seller as an Expense. 5.8 If a Lot is not sold at Auction SEVEN MODERN COMPANY TRADING will for the next 14 days be entitled exclusively to negotiate a sale of the Lot on terms agreed with the Seller and as Seller’s agent, and if successful will be entitled to charge on the Seller’s Commission and Expenses. 5.9 The Seller gives SEVEN MODERN COMPANY TRADING the full and absolute right to photograph and illustrate any Lot consigned for sale, and to use such photographs and illustrations as are provided by the Seller at any time at its absolute discretion (whether or not in connection with the Auction), with indemnity to SEVEN MODERN COMPANY TRADING against copyright infringement. 5.10 The copyright in all written matter and illustrations relating to Lots shall remain at all times the absolute property of SEVEN MODERN COMPANY TRADING, and any person wishing to use such materials, or any part of them, may only do so with the prior written consent of SEVEN MODERN COMPANY TRADING. 6. Alterations and Estimates 6.1 Estimates and descriptions may be amended at SEVEN MODERN COMPANY TRADING discretion from time to time by notice given orally or in writing before or during an Auction. 6.2 The Lot is available for inspection and any potential bidders must form their own opinion in relation to it. They are strongly advised to examine any Lot or have it examined by a specialist or engineer on their behalf before the Auction. 6.3 SEVEN MODERN COMPANY TRADING gives no warranty or representation as to the anticipated or likely selling price of any Lot. Any estimate given, whether written or oral and whether or not printed in any Catalogue, as to the estimated selling price of any Lot is a statement of opinion only and may be subject to revision from time to time at SEVEN MODERN COMPANY TRADING’s sole discretion and should not be relied upon as an indication of the actual selling price. 6.4 SEVEN MODERN COMPANY TRADING shall not be liable to the Seller for any error or misstatement in or omission from the description of any lot in any Catalogue where SEVEN MODERN COMPANY TRADING has: 6.4.1 been provided with such description by the Seller or any person on his behalf; or 6.4.2 provided the Seller with a copy of such description prior to publication of the Catalogue and neither the Seller nor any person on his behalf has notified SEVEN MODERN COMPANY TRADING in writing within a reasonable time before
the Auction of any error or misstatement in or omission from the description. 6.5 SEVEN MODERN COMPANY TRADING has no duty to the Seller or the Buyer to investigate the accuracy of the description of any Lot provided by or on behalf of the Seller. 7. Warranty by the Seller 7.1 The Seller warrants to the Buyer and to SEVEN MODERN COMPANY TRADING that: 7.1.1 The Seller is the owner of the Lot or is properly authorised to sell the Lot by the owner, and is able to sell the Lot with full title guarantee free from all encumbrances and third party claims and in particular that there is no outstanding finance affecting the Lot or any taxes due or any other legal barrier. If the car is subject to finance the amount outstanding must be confirmed prior to consignment and sale. 7.1.2 The description of the Lot in the Catalogue is to the best of the Seller’s knowledge accurate and not misleading. The Seller has notified (or will before the Auction notify) SEVEN MODERN COMPANY TRADING in writing of any material alterations to the Lot of which the Seller is aware and of any concerns expressed by third parties in relation to the authenticity, provenance, origin, age, condition or quality of the Lot and the seller has provided SEVEN MODERN COMPANY TRADING with all such information in the Seller’s possession or control. 7.1.3 The Seller shall compensate SEVEN MODERN COMPANY TRADING and the Buyer in full for all losses, expenses and other costs which are caused by the Seller’s breach of any obligation of the Seller under the Terms. 7.1.4 Where the vehicle is not registered in the KSA, the seller shall be responsible for completing the regulatory procedures in KSA within 14 days of the car arriving in the KSA and before the vehicle arrives at the auction for sale. 8. Vehicle Registration Numbers 8.1 If the Seller wishes to sell the Motor Vehicle but to retain the right to the registration number of the Motor Vehicle it is the Seller’s Responsibility to notify SEVEN MODERN COMPANY TRADING in writing before the auction in a reasonable period. 8.2 It shall be the Seller’s responsibility to complete the retention documentation prior to sale and offer the vehicle with a new car registration form from the General Department of Saudi Traffic. The completion of the legal procedures required to register the car within the Kingdom of Saudi Arabia prior to the Motor Vehicle being sold at Auction fall on the Seller and no liability shall attach to SEVEN MODERN COMPANY TRADING in respect to any act or omission as a result. 9. Bidding and Reserves 9.1 Admission to the Auction requires the purchase of a Catalogue which must be presented at the entrance to the Auction. 9.2 SEVEN MODERN COMPANY TRADING do not accept bids from any person who has not completed and submitted a registration form. A certified cheque of an amount of $26,000 shall be executed by the bidder in the name of SEVEN MODERN COMPANY TRADING. The amount of the cheque shall only be refunded if no vehicle is awarded to the bidder. However, if a vehicle is awarded to the bidder, then the amount of the cheque shall be deducted from the total amount of the vehicle invoice. In addition, the amount shall not be refunded if the bidder violates the terms and conditions after the vehicle is awarded to the bidder and the sale is not closed. Proof of identification will be required in the form of a passport or National ID, before the registration process can be completed. 9.3 The Auctioneer will commence and advance the bidding at levels and in increments he considers appropriate and is entitled to place a bid or series of bids on behalf of the Seller, up to the Reserve on the Lot.

9.4 The Seller may place a Reserve on any Lot when he consigns it to the Auction, and once placed it may not be changed without the written consent of SEVEN MODERN COMPANY TRADING. All Lots will be sold without Reserve unless a Reserve has been agreed by SEVEN MODERN COMPANY TRADING in writing. 9.5 Where a Reserve has been agreed, only SEVEN MODERN COMPANY TRADING at its absolute discretion may bid on behalf of the Seller. 9.6 If no Reserve has been placed on a Lot, SEVEN MODERN COMPANY TRADING shall in no way be held liable should the Lot be purchased for a price below any lowest estimated selling price of the Lot given in any Catalogue. 9.7 SEVEN MODERN COMPANY TRADING may sell a Lot below the Reserve agreed with the Seller, provided that SEVEN MODERN COMPANY TRADING accounts to the Seller for the same Sale Proceeds as the Seller would have received had the Lot been sold at that Reserve. 9.8 The Auctioneer may declare a lot “provisionally sold”. The highest bid placed during the auction will remain open for acceptance by the seller until 12pm the next day following the auction. During this period SEVEN MODERN COMPANY TRADING will take steps to contact the seller and determine whether they are willing to accept the bid. Following confirmation from the seller, SEVEN MODERN COMPANY TRADING will notify the buyer whether their bid has been accepted or rejected. The buyers bid will be deemed to be rejected if they have not been notified of its acceptance by 12pm the following day. Where the buyer is notified that the bid has been accepted a contract for the sale of the lot will be formed between the buyer and the seller as if the hammer fell during the auction. 10. Commission and Expenses 10.1 SEVEN MODERN COMPANY TRADING shall be entitled to deduct from the Hammer Price and retain an amount equal to 5% of the Hammer Price for vehicles and 15% for automobilia and lifestyle goods or such other sum agreed by SEVEN MODERN COMPANY TRADING in writing (“Seller’s Commission”) plus VAT together with Expenses and any other sums due from the Seller to SEVEN MODERN COMPANY TRADING 10.2 The Seller acknowledges SEVEN MODERN COMPANY TRADING right to retain the Buyer’s Premium payable by the Buyer. 11. Insurance 11.1 Only on payment of the Purchase Price in cleared funds shall title in the Lot pass from the Seller to the Buyer. However, the risk in the Lot passes to the Buyer on the fall of the hammer. It is therefore, the responsibility of the Seller to insure the Lot before the hammer falls and the responsibility of the Buyer to insure the Lot after the hammer falls. 11.2 SEVEN MODERN COMPANY TRADING will not be responsible for any damage to or the loss or destruction of a Lot unless caused by the negligence of or other breach of duty by SEVEN MODERN COMPANY TRADING, its employees or agents in the ordinary course of their duties to SEVEN MODERN COMPANY TRADING and the Seller shall compensate SEVEN MODERN COMPANY TRADING in full in respect of all other claims and proceedings brought against SEVEN MODERN COMPANY TRADING in respect of any loss or damage to or destruction of the Lot. 11.3 SEVEN MODERN COMPANY TRADING will not be liable for any injury, loss or damage caused by any Lot or by the Seller’s negligence of SEVEN MODERN COMPANY TRADING, its employees or agents in the ordinary course of their duties to SEVEN MODERN COMPANY TRADING. The Seller shall compensate SEVEN MODERN COMPANY TRADING in full in respect of all claims and proceedings brought against SEVEN MODERN COMPANY TRADING in respect of injury, loss or damage caused by any Lot or by the Seller’s negligence or breach of any obligation under the Terms.

12. Payment of Sale Proceeds 12.1 Subject to SEVEN MODERN COMPANY TRADING right of retention under Clause 3.2 and other provisions of this Clause 12, SEVEN MODERN COMPANY TRADING shall pay the Sale Proceeds to the Seller not later than 14 Working Days after the Auction provided that the Purchase Price has been received in full by SEVEN MODERN COMPANY TRADING from the buyer. Unless an alternative method of payment has been agreed by SEVEN MODERN COMPANY TRADING in writing, payment shall be made by bank transfer. In the event of an unsettled hire purchase, finance agreement or any other charge or lien affecting the Lot SEVEN MODERN COMPANY TRADING reserves the right to settle the amount due of such charges not exceeding the Sale Proceeds and if the Sale Proceeds are less than the charges outstanding the Seller will be responsible for the settlement of the balance forthwith. 12.2 If the Purchase Price has not been received in full by SEVEN MODERN COMPANY TRADING within the time specified in clause 12.1 SEVEN MODERN COMPANY TRADING will pay the Sale Proceeds to the Seller within seven Working Days from when the Purchase Price is received in cleared funds from the Buyer. 12.3 In respect of road registered Motor Vehicles, SEVEN MODERN COMPANY TRADING reserves the right not to remit the Sale Proceeds to the Seller unless the Seller has deposited with SEVEN MODERN COMPANY TRADING the registration document of the Motor Vehicle, and any other documents relating to the Motor Vehicle in the Seller’s possession or control which he agreed with SEVEN MODERN COMPANY TRADING to supply. 12.4 If the Buyer fails to pay the Purchase Price within 28 days of the Auction, SEVEN MODERN COMPANY TRADING will notify the Seller who may instruct SEVEN MODERN COMPANY TRADING as to the appropriate course of action. SEVEN MODERN COMPANY TRADING may endeavour to assist the Seller but SEVEN MODERN COMPANY TRADING shall be under no obligation to do so and shall not be under any obligation to institute proceedings in its own name. 12.5 In the absence of any written instructions from the Seller to SEVEN MODERN COMPANY TRADING within 7 days of SEVEN MODERN COMPANY TRADING having notified the Seller under clause 12.4 SEVEN MODERN COMPANY TRADING shall be entitled to take one or more than one of the actions set out in clause 19.: 12.6 Any monies recovered by and paid to SEVEN MODERN COMPANY TRADING in consequences of SEVEN MODERN COMPANY TRADING taking one or more of the steps referred to in clause 19 shall be applied to the payment of: 12.6.1 legal or other costs incurred by SEVEN MODERN COMPANY TRADING in connection with such steps;. 12.7 Expenses; 12.7.1 the Buyer’s Premium and the Seller’s Commission on the sale of the Lot; 12.7.2 any balance remaining shall be paid by SEVEN MODERN COMPANY TRADING to the Seller (or, if appropriate, the Buyer). If there shall be a shortfall any such shortfall shall be made good by the Seller to SEVEN MODERN COMPANY TRADING on demand. 12.7.3 If within 7 days after receipt of the notice referred to in clause 12.5 the Seller informs SEVEN MODERN COMPANY TRADING that he wishes the Lot to be returned, he shall be entitled to do so but only upon prior payment of all Expenses and all legal and other costs reasonably incurred by SEVEN MODERN COMPANY TRADING so as to keep SEVEN MODERN COMPANY TRADING fully recompensed for any losses suffered as a result of this action by the seller. 13. Withdrawal Fees 13.1. The Seller may by notice in writing to SEVEN MODERN COMPANY TRADING withdraw the Lot from the Auction. In the event of such withdrawal, the Seller shall within 14 days of withdrawal pay SEVEN MODERN COMPANY TRADING
the sums set out in this Condition 13. All such sums shall be payable to SEVEN MODERN COMPANY TRADING as remuneration for the services performed by SEVEN MODERN COMPANY TRADING down to the date of withdrawal, and not by way of penalty or liquidated damages. 13.2 In all cases of withdrawal, the Seller shall be liable to pay SEVEN MODERN COMPANY TRADING 5% of the mid estimate value of the Lot, notwithstanding that commission of a lesser, or no, amount had previously been agreed, to reflect the time, effort, loss of publicity and buyer’s premium suffered by SEVEN MODERN COMPANY TRADING. In the event of a Lot having no reserve and therefore no estimate the Seller shall be liable to pay SEVEN MODERN COMPANY TRADING 5% of the auctioneer’s reasonable estimate. The fee shall be subject in each case to VAT and Expenses. 13.3.In the event that the Seller withdraws the Lot from the Auction, the Seller shall arrange for collection and removal of the Lot at his own expense within two working days after the date of withdrawal provided that the Seller may not collect the Lot unless and until any withdrawal fee payable under Conditions 13.2 and 13.3 shall have been paid in full. 14. Removal and Storage 14.1 The Seller shall arrange for the removal of any unsold Lot and the Buyer for the removal of purchased lots by the time specified in the vendor delivery instructions and key sale information in the auction catalogue or by other such time as agreed by SEVEN MODERN COMPANY TRADING 14.2 Failure to remove Lots pursuant to clause 14.1 above will entitle SEVEN MODERN COMPANY TRADING to charge the Seller or Buyer a removal charge, storage fees, insurance and other expenses and any costs incurred at the following rates: Motor Vehicle: Removal – 1,000 USD plus VAT Storage – 15 USD per day plus VAT Delivery can be arranged via CARS SHIPPING LLC - delivery by quotation. These fees apply unless stated otherwise in the Key Sale Information of the sale catalogue Automobilia: Removal – 25 USD plus VAT Storage –15 USD per day plus VAT 15. The Buyer 15.1 The Buyer shall be the highest bidder at the Hammer Price. Any dispute as to any bid shall be settled by the Auctioneer at his/her absolute discretion. 16. Buyer’s Premium The Buyer shall pay the Buyer’s Premium to SEVEN MODERN COMPANY TRADING and the Buyer acknowledges that SEVEN MODERN COMPANY TRADING may also receive the Seller’s Commission due to SEVEN MODERN COMPANY TRADING under Clause 10. 17. Payment 17.1 Once a lot is sold, the Purchase Price shall become immediately payable to SEVEN MODERN COMPANY TRADING. 17.2 Full payment for all Lots must be made to SEVEN MODERN COMPANY TRADING by 5:00pm the next Working Day. Payment can only be accepted in USD. For security reasons, payments by Debit or Credit card (VISA/Mastercard) will only be accepted where the cardholder is present. 17.3 No Lot may be collected until the Purchase Price has been received by SEVEN MODERN COMPANY TRADING and payments by a Buyer to SEVEN MODERN COMPANY TRADING may be applied by SEVEN MODERN COMPANY TRADING towards any such sums due from that Buyer to SEVEN MODERN COMPANY TRADING on any account whatsoever notwithstanding any directions to the contrary by the Buyer or his agent whether express or implied. 17.4 Title to the Lot will pass to the Buyer only when the Purchase Price in cleared funds has been received by SEVEN
MODERN COMPANY TRADING. 17.5 Immediately a Lot is sold the risk shall pass to the Buyer notwithstanding that possession will not be given and title will not pass to the Buyer before payment of the Purchase Price. 17.6 The Buyer shall, at his own expense, remove the Lot purchased but not before payment in full to SEVEN MODERN COMPANY TRADING of the Purchase Price whether in respect of this or any other Lot. 17.7 Cash payments are not accepted as a payment method for the purchase price of the buyer. 18. Responsibility for Purchased Lots 18.1 The Buyer will be responsible for loss or damage to a Lot they have purchased from the fall of the hammer. Neither SEVEN MODERN COMPANY TRADING nor its employees or agents shall be responsible for any loss or damage unless caused by the negligence of SEVEN MODERN COMPANY TRADING, its employees or agents in the ordinary course of their duties to SEVEN MODERN COMPANY TRADING while the Lot is in SEVEN MODERN COMPANY TRADING custody or under its control. 18.2 The Buyer shall be responsible for all removals, insurance, storage and other charges on any Lot from the fall of the hammer (in accordance with Clause 11). 18.3 General department of Saudi Traffic will be notified of the change of owner within 5 working days following receipt of payment, using the details from invoice, unless otherwise stated. 18.4 Automobilia, watches & lifestyle Lots that have not been paid and collected by midday on the first working day following the sale will be sent to the buyer at the buyer’s expense. 19. Non-payment or Failure to Collect 19.1 If the Purchase Price is not paid in full, SEVEN MODERN COMPANY TRADING as the agent of the Seller, shall in its absolute discretion and without prejudice to any other rights it may have, be entitled to exercise one or more of the following remedies:19.1.1 to remove, store (either at SEVEN MODERN COMPANY TRADING premises or elsewhere) and insure the Lot at the expense of the Buyer; 19.1.2 to charge interest at a daily rate equal to 4% pa over National Commercial Bank’s (SA) Base Rate on so much of the total amount due as remains unpaid after the date of and time referred to in clause 17.2; 19.1.3 to retain that or any Lot sold to the same Buyer at the same or any other auction of SEVEN MODERN COMPANY TRADING and to release it only after payment of the total amount due; 19.1.4 to apply any money due or to become due to the defaulting Buyer in or towards settlement of the total amount due and to exercise a charge or lien on any property of the Buyer which is in SEVEN MODERN COMPANY TRADING’s possession for any purpose. 19.1.5 take such steps as SEVEN MODERN COMPANY TRADING shall at its absolute discretion consider necessary to collect the monies due from the Buyer, and to agree terms for the payment of the Purchase Price; 19.1.6 to cancel the sale and refund any monies to the Buyer, or to cancel the sale to the Buyer and to purchase the Lot itself. If it does so, property in the Lot shall pass to SEVEN MODERN COMPANY TRADING on its election and SEVEN MODERN COMPANY TRADING shall remit the Purchase Price to the Seller within 14 Working Days of its election less the Seller’s Commission, Expenses and sums due to SEVEN MODERN COMPANY TRADING which would have been payable had the contract not been rescinded; 19.1.7 to appoint a solicitor and/or other agent to pursue any of the courses of action referred to in this clause 19, and the Seller hereby authorises SEVEN MODERN COMPANY TRADING to take any of the courses referred to in this clause, including the issue and prosecution of proceedings on the

Seller’s behalf, and to settle claims and/or proceedings made by or against the Buyer on such terms as the Seller shall instruct, or in the absence of instructions on such terms and procedures as SEVEN MODERN COMPANY TRADING shall at its absolute discretion think fit. The Buyer shall be liable for all the costs incurred in any proceedings, negotiations or ADR (Alternative Dispute Resolution) including any shortfall in cost between those expended by SEVEN MODERN COMPANY TRADING or the Seller and those awarded by any Court or Tribunal. 19.2 If the Buyer fails to make payment within 14 days after the date and time referred to in clause 17.2, SEVEN MODERN COMPANY TRADING shall at its absolute discretion and without prejudice to any other rights it may have, be entitled to re-sell the Lot or cause it to be resold by public auction or private sale, and, if this results in a lower price being obtained, the defaulting Buyer shall then pay to SEVEN MODERN COMPANY TRADING any deficiency, together with re-sale costs and any costs incurred in connection with the Buyer’s failure to make payment and any surplus shall belong to the Seller. 19.3 If the Lot is not taken away on the date and time referred to in clause 17.2, whether or not the Purchase Price has been paid, SEVEN MODERN COMPANY TRADING shall remove, store (either at SEVEN MODERN COMPANY TRADINGS premises or elsewhere) and insure the Lot at the expense of the Buyer and only release the Lot after payment of the total amount due. 20. Liability of SEVEN MODERN COMPANY TRADING and the Seller 20.1 Buyers are solely responsible for ensuring that Motor Vehicles are safe for use, roadworthy (if a road going car) and comply with all relevant laws and regulations in force in all relevant jurisdictions and for ensuring that any necessary test certificates are in force It is the responsibility of the Buyer to carry out such inspection as he thinks necessary. 20.2 In bidding for any Lot, the Buyer acknowledges that he does not rely on any representation made to them by SEVEN MODERN COMPANY TRADING, its employees or agents. 21. Governing Law Any transactions to which the Terms apply shall be governed by KSA Law and the Courts of KSA shall have exclusive jurisdiction to settle all disputes arising in connection with all aspects of all matters or transactions to which these Terms apply. 22. Notices 22.1 Any shall be deemed to have been received:22.1.1 if hand-delivered, at the time of delivery; 22.1.2 if sent by mail, two days after the date of posting. 22.2 In proving service by delivery:22.2.1 by hand, it shall be necessary only to produce a receipt for the notice signed by or on behalf of the addressee; 22.2.2 by post, it shall be necessary only to prove that the notice was contained in a pre-paid envelope which was duly addressed and posted first class. 23. Data Protection 23.1 All information provided to SEVEN MODERN COMPANY TRADING will be treated confidentially and shall not be passed to third parties, except where necessary to complete a sale transaction. 23.2 SEVEN MODERN COMPANY TRADING reserves the right to pass on information when required by legislation, government authorities or the courts.

"االحتياطي" يعني الحد األدنى لسعر إغالق المزاد المتفق عليه بين شركة سبعة الحديثة التجارية والبائع الذي يمكن بيع اللوت به. ً "عائدات البيع" تعني صافي المبلغ المستحق للبائع وهو سعر المطرقة مطروحا منه عمولة البائع وضريبة القيمة المضافة ،والنفقات وأي مبلغ آخر مستحق لشركة سبعة الحديثة التجارية من البائع. "البائع" يعني الشخص الذي يعرض اللوت للبيع ،سواء كان وكيالً أو رئيسا ً. "عمولة البائع" لها المعنى الوارد في البند .10 "ضريبة القيمة المضافة" تعني ضريبة القيمة المضافة المطبقة بالسعر السائد من حين آلخر. "يوم العمل " يعني أي يوم تكون فيه البنوك المقاصة مفتوحة لمعامالت األعمال البنكية العادية بالدوًلر األمريكي. "العناصر ال ُمباعة مؤقتا " يعني أن العطاء الذي تم طرحة خالل المزاد لم يقبله البائع ،ويستمر العطاء بشكل مؤقت حتى الساعة 12مسا ًء في اليوم التالي للمزاد.
-2الوكيل تبيع شركة سبعة الحديثة التجارية بصفتها وكيالً للبائع (باستثناء الحاًلت التي يتم فيها البيع من شركة سبعة الحديثة التجارية مباشرة ،والتي سيتم كشفها من قبل شركة سبعة الحديثة التجارية في الكتالوج أو خالف ذلك في المزاد)؛ ويكون عقد بيع اللوت بين البائع والمشتري ،وًل تكون شركة سبعة الحديثة التجارية مسؤولة عن أي إجراء أو تقصير من جانب البائع (إًل في حالة البيع بشكل مباشر من شركة سبعة الحديثة التجارية) أو المشتري. ويتعهد البائع ويلتزم بنقل ملكية لوت السيارة أو المقتنيات إلى المشتري وإنهاء كافة اإلجراءات القانونية المطلوبة لذلك، دون أدنى مسئولية على شركة سبعة الحديثة التجارية تجاه المشتري حيال ذلك. -3السلطة التقديرية 1-3 2-3 3-3
يحق لشركة سبعة الحديثة التجارية وفقا لتقديرها المطلق رفض أي عطاء ،وتقسيم أي لوت ،وجمع لوتين أو أكثر وسحب أي لوت ،وفي حالة النزاع ،طرح أي لوت مرة أخرى للبيع في المزاد. إذا تم إخطار شركة سبعة الحديثة التجارية عن أي انتهاك من قبل البائع ألي من الشروط قبل أن تحيل عائدات البيع إلى البائع؛ فإنه يحق لها حسب تقديرها المطلق ،حجب الدفع حتى تتم تسوية هذا النزاع؛ كما أنه يحق لشركة سبعة الحديثة التجارية استقطاع أي مبالغ مستحقة لها من المبلغ المحتفظ به. سوف تخضع عقود لوت المقتنيات للتقدير المطلق لبائع المزاد بنسبة ٪10على اًلحتياطي ما لم يتم إخطار شركة سبعة الحديثة التجارية من قبل البائع كتابةً بخالف ذلك.
-4الخسائر أو األضرار ًل تتحمل شركة سبعة الحديثة التجارية أي مسؤولية عن أي إصابة أو ضرر أو خسارة يتكبدها أي شخص أثناء وجوده في مقر شركة سبعة الحديثة التجارية (بما في ذلك أي مبنى يمكن فيه إجراء عملية بيع أو أينما يوجد مجموعة ،أو جزء من مجموعة ،قيد العرض من وقت آلخر) باستثناء حالة الوفاة أو اإلصابة الشخصية أو التلف أو الخسارة الناجمة عن إهمال أو خرق آخر للواجبات من قبل شركة سبعة الحديثة التجارية أو موظفيها أو وكالئها في سياق واجباتهم المعتادة إلى شركة سبعة الحديثة التجارية. -5اللوت 1-5 2-5
يحتوي الكتالوج على التفاصيل حول كل لوت؛ حيث يتم تقديم الوصف المطبوع في الكتالوج بالنيابة عن البائع من المعلومات المقدمة من البائع والتي ًل تتحمل شركة سبعة الحديثة التجارية مسؤوليتها. إن الصور الفوتوغرافية والرسوم التوضيحية والرسوم البيانية الواردة في الكتالوج هي ألغراض تحديد الهوية فقط، وقد ًل تظهر الحالة واللون الحقيقي (الذي قد ًل يتم إعادة إنتاجه بدقة) للوت.

تتم إتاحة اللوت للفحص قبل البيع ،وعلى أي مقدم عطاء محتمل أن يتحقق بنفسه من اًلستيفاء من جميع العناصر لكل جانب من جوانب اللوت ،بما في ذلك أصالته ،وتأليفه ،وحالته ،ومصدره ،وتاريخه ،والمعلومات العامة عنه، وموثوقيته ،وطرازه ،وفترته ،وعمره ،ومالءمته ،وجودته ،وصالحية الطريق (إذا كان ذلك مناسبًا) ،ومنشأه ،وقيمته وسعر البيع المقدر (بما في ذلك سعر إغالق المزاد)؛ ًل يوجد وصف للوت يحمل معه دًللة أنه مناسب ألي غرض معين. يتم بيع كل لوت من قبل البائع المعنّي إلى المشتري ،ويتم بيع اللوت إلى المشتري "بحالته الحالية" ،مع جميع العيوب والخلل ،دون أدنى مسئولية على شركة سبعة الحديثة التجارية تجاه المشتري. قد ًل تكون الحالة الفعلية للوت جيدة كما يوحي مظهره الخارجي؛ فربما تم استبدال أجزاء معينة أو تجديدها وقد ًل تكون تلك األجزاء أصلية أو "ذات جودة مرضية" ،وقد ًل يكون الجزء الداخلي للوت مرئيًا ،على سبيل المثال ،عندما يكون مغطى بالتنجيد أو المواد ،وقد ًل يكون أصليًا أو قد يكون تالفا ،أو قد تعرض للتلف أو تم إصالحه بشكل سيئ، نظرا لعمر بعض اللوت ،لذلك يجب عدم اتخاذ أي افتراض فيما يتعلق بأي جانب من جوانب حالته. ً ً أي شخص يتصادم جسديًا مع اللوت أو يخدشه أو يتلفه بأي طريقة (قبل المزاد أو خاللها أو بعده) سيكون مسؤوًل عن الخسارة الناتجة. يكون البائع هو المسؤول عن تسليم اللوت بحالة جيدة المظهر وقابلة للبيع ،وفي حال تطلب األمر إجراء عملية تنظيف إضافية ،فسيتم فرض رسوم عليها من خالل شركة سبعة الحديثة التجارية على البائع كنفقات. إذا لم يتم بيع اللوت في المزاد ،فإنه يحق لشركة سبعة الحديثة التجارية لمدة أربعة عشر ( 14يو ًما) التفاوض بشكل حصري على بيع اللوت بنا ًء على الشروط المتفق عليها مع البائع وكوكيل للبائع ،وفي حالة إتمام البيع سيكون من حقها أن تفرض رسوما على عمولة البائع ومصروفاته. يمنح البائع شركة سبعة الحديثة التجارية الحق الكامل والمطلق في تصوير وتوضيح أي كمية مرسلة للبيع ،واستخدام الصور الفوتوغرافية والرسوم التوضيحية التي يوفرها البائع في أي وقت وفقًا لتقديره المطلق (سواء كان ذلك يتعلق بالمزاد أم ًل) ،مع احتفاظ شركة سبعة الحديثة التجارية بحقها في التعويض ضد انتهاك حقوق النشر. دائ ًما ،يجب أن تظل حقوق النشر في جميع المواد المكتوبة والرسومات التوضيحية المتعلقة باللوت ملكية مطلقة لشركة سبعة الحديثة التجارية ،وًل يحق ألي شخص استخدام هذه المواد ،أو بعضها ،إًل بعد الحصول على موافقة كتابية مسبقة من شركة سبعة الحديثة التجارية.

يمكن تعديل التقديرات واألوصاف وف ًقا لتقدير شركة سبعة الحديثة التجارية المطلق من حين آلخر عن طريق إرسال إشعار مسبق شفهيًا أو كتابيًا قبل المزاد أو خالله. يكون اللوت متاحا ً للفحص ويجب على أي من مقدمي العروض المحتملين أن يكونوا رأيهم فيما يتعلق به؛ وينصحون بشدة بفحص أي لوت أو يجب فحصها من قبل متخصص أو مهندس نيابة عنهم قبل المزاد. ًل تقدم شركة سبعة الحديثة التجارية أي ضمان أو تمثيل فيما يتعلق بسعر البيع المتوقع أو المحتمل ألي لوت؛ حيث يكون أي تقدير يُقدم ،سواء كان كتابيا أو شفهيا ،وما إذا كان مطبوعا في أي كتالوج أم ًل ،فيما يتعلق بسعر البيع المقدر ألي لوت ،هو عبارة عن رأي فقط وقد يخضع للمراجعة من حين آلخر وفق تقدير شركة سبعة الحديثة التجارية المطلق وًل يجب اًلعتماد عليه كمؤشر على سعر البيع الفعلي. ًل تكون شركة سبعة الحديثة التجارية مسؤولة أمام البائع عن أي خطأ أو بيان غير صحيح أو عن عدم إيراد نظرا لقيام شركة سبعة الحديثة التجارية بما يلي: توضيحات اللوت في أي كتالوج ً تقديم هذا التوضيح بناء على الوصف المقدم من قبل البائع أو أي شخص نيابة عنه. تزويد البائع لشركة سبعة الحديثة التجارية بنسخة من هذا الوصف قبل نشر الكتالوج ،ولم يقم البائع أو أي شخص نيابة عنه بإخطار شركة سبعة الحديثة التجارية كتابة في غضون فترة زمنية معقولة قبل المزاد بأي خطأ أو بيان غير صحيح فيه أو عدم إيراد التوضيحات. ًل تتحمل شركة سبعة الحديثة التجارية أي مسؤولية ُملزمة تجاه البائع أو المشتري للتحقيق في دقة وصف أي لوت ُمقدم من البائع أو نيابة عنه.

-7الضمان ال ُمقدم من البائع 1-7
يضمن البائع للمشتري ولشركة سبعة الحديثة التجارية بأن:
1-1-7
البائع هو مالك اللوت أو الشخص ال ُمعتمد فعليًا لبيع اللوت من قبل المالك ،وبإمكانه بيع اللوت بضمان حق الملكية الكامل دون أي قيود ومطالبات الطرف اآلخر ،وبصفة خاصة ،عدم وجود تمويل غير ُمسدد يؤثر على اللوت أو أي ضرائب مستحقة أو أي مانع قانوني أخر؛ وإذا كانت السيارة خاضعة للتمويل ،فإنه يجب تأكيد المبلغ ال ُمستحق قبل الشحن والبيع.
2-1-7
يعد وصف اللوت في الكتالوج هو أفضل ما لدى البائع من معلومات ومعرفة دقيقة وغير مضللة ،وقد أخطر البائع كتابة (أو سيفعل ذلك قبل المزاد) شركة سبعة الحديثة التجارية بأي تعديالت جوهرية على اللوت يعرفها البائع وأي مخاوف أعربت عنها أطراف أخرى فيما يتعلق باألصالة أو المصدر أو المنشأ أو العمر أو الحالة أو جودة اللوت ،وقد قام البائع وعلى مسئوليته الخاصة بتزويد شركة سبعة الحديثة التجارية بكل هذه المعلومات التي في حيازته أو الخاضعة لسيطرته.
3-1-7
يجب على البائع تعويض شركة سبعة الحديثة التجارية والمشتري بالكامل عن جميع الخسائر والنفقات والتكاليف األخرى الناجمة عن خرق البائع ألي من التزاماته بموجب الشروط.
4-1-7
في حالة عدم تسجيل السيارة في المملكة العربية السعودية ،يكون البائع مسؤوًل عن إكمال اإلجراءات النظامية المتبعة لذلك داخل المملكة العربية السعودية خالل ( )14أربعة عشر يوما ً من وصول السيارة إلى المملكة العربية السعودية وقبل وصول السيارة إلى المزاد للبيع.
-8أرقام تسجيل المركبات 1-8
إذا كان البائع يريد بيع محرك السيارة ولكن مع اًلحتفاظ بحقه في رقم تسجيل السيارة ،فإنه يتعين على البائع إخطار شركة سبعة الحديثة التجارية كتابةً قبل المزاد بفترة معقولة.
2-8
يتحمل البائع مسؤولية استكمال مستندات الملكية واًلحتفاظ قبل البيع للسيارة ،وتقديم السيارة مع استمارة تسجيل سارية لها من اإلدارة العامة للمرور السعودي ،أو الحصول التصاريح الالزمة من الجهات المختصة ،وإنهاء كافة اإلجراءات القانونية المطلوبة لتسجيل السيارة داخل المملكة العربية السعودية بشكل قانوني قبل أن يتم بيع السيارة في المزاد العلني ،ولن تتحمل شركة سبعة الحديثة التجارية أي مسؤولية فيما يتعلق بأي فعل أو إهمال نتيجة لذلك.
-9تقديم العطاءات واالحتياطات 1-9 2-9
يتطلب اًلشتراك في المزاد العلني شراء كتالوج المزاد ،والذي يباع عند مدخل المزاد. ًل تقبل شركة سبعة الحديثة التجارية عروض العطاءات من أي شخص لم يقدم أو يستكمل استمارة التسجيل بالمزاد، وسيلزم على المزايد بالمزاد أن يقوم بتحرير شيك مصدق بمبلغ ( )$26,000ستة وعشرون ألف دوًلر أمريكي باسم شركة سبعة الحديثة التجارية كتأمين دخول المزاد ،يسترد في حالة عدم رسو أي سيارة من السيارات على المزايد في المزاد؛ ويخصم هذا المبلغ في حالة رسو السيارة على المزايد بالمزاد من إجمالي مبلغ فاتورة السيارة؛ كما انه ًل يسترد هذا المبلغ إذا أخل المزايد بالشروط واألحكام بعد رسو السيارة عليه ولم يتمم عملية البيع ،ويجب عليه أيضًا أن يقدم إثبات الهوية سواء كان صورة جواز السفر أو بطاقة الهوية الوطنية ،وذلك قبل إتمام عملية التسجيل.
3-9
سيبدأ منادي المزاد العلني ب تقديم العطاءات على مستويات وبزيادات يراها مناسبة ويحق له تقديم عرض أو سلسلة من العروض نيابة عن البائع ،حتى اًلحتياطي على اللوت.

يحق للبائع أن يضع احتياطي على أي قطعة عندما يعرضها في المزاد ،وبمجرد وضعه ًل يحق له التغيير دون موافقة كتابية من شركة سبعة الحديثة التجارية؛ وسيتم بيع جميع اللوت دون احتياطي من قبل شركة سبعة الحديثة التجارية إذا لم يتم اًلتفاق كتابةً على احتياطي بين البائع وشركة سبعة الحديثة التجارية.
5-9
إذا تم اًلتفاق على "اًلحتياطي" ،فإنه يحق لشركة سبعة الحديثة التجارية فقط ،وفقًا لتقديرها المطلق ،تقديم عطاءات نيابة عن البائع.
6-9
إذا لم يتم وضع أي احتياطي على اللوت ،فلن تتحمل شركة سبعة الحديثة التجارية بأي حال من األحوال المسؤولية في حال شراء اللوت بسعر أقل من أي سعر بيع ُمقدر للوت الوارد في أي كتالوج.
7-9
يحق لشركة سبعة الحديثة التجارية بيع لوت أقل من اًلحتياطي المتفق عليه مع البائع ،شريطة أن تكون حسابات شركة سبعة الحديثة التجارية للبائع عن نفس عائدات البيع التي كان البائع سيحصل عليها لو تم بيع اللوت في ذلك اًلحتياطي.
8-9
يحق لمنادي المزاد العلني اإلعالن بأنه "تم بيع اللوت مؤقتًا" .وسيظل العطاء األعلى الذي ُ طرح خالل المزاد مفتو ًحا ظهرا من اليوم التالي للمزاد ،وخالل هذه الفترة ستتخذ شركة سبعة الحديثة للقبول من قِبل البائع حتى الساعة 12 ً التجارية إجراءات لالتصال بالبائع وتحديد ما إذا كان يرغب في قبول العرض من عدمه؛ وبعد التأكيد من البائع، ستقوم شركة سبعة الحديثة التجارية بإخطار المشتري بقبول عرضه أو رفضه؛ وسيتم اعتبار عرض المشتري مرفوضًا إذا لم يتم إخطاره بقبوله بحلول الساعة 12مسا ًء في اليوم التالي؛ وفي حالة إخطار المشتري بأن العطاء قد تم قبوله ،سيتم إبرام عقد لبيع اللوت بين المشتري والبائع كما لو أنه تم إقفال المزاد بطرق المطرقة على الطاولة.
-10العمولة والمصاريف 1-10
يحق لشركة سبعة الحديثة التجارية الخصم من سعر المطرقة واًلحتفاظ بمبلغ يساوي ٪5من سعر المطرقة للسيارات والمركبات ،و %15بالنسبة للمقتنيات والبضائع النمطية أو أي مبلغ آخر يُتفق عليه من قبل شركة سبعة الحديثة التجارية كتابةً ("عمولة البائع ") باإلضافة إلى ضريبة القيمة المضافة مع النفقات وأي مبالغ أخرى مستحقة من البائع إلى شركة سبعة الحديثة التجارية.
2-10
يُقر البائع بأنه يحق لشركة سبعة الحديثة التجارية اًلحتفاظ بعالوة المشتري المستحقة الدفع من قبل المشتري.

ًل يحق منح حق الملكية ونقل العنوان على اللوت من البائع إلى المشتري إًل عند دفع سعر الشراء بأموال التسوية؛ ومع ذلك فإن المخاطرة في انتقال اللوت تقع على المشتري عند سقوط المطرقة ،ولذلك تقع على عاتق البائع مسؤولية تأمين اللوت قبل سقوط المطرقة ،وتقع على عاتق المشتري مسؤولية تأمين اللوت بعد سقوط المطرقة. لن تتحمل شركة سبعة الحديثة التجارية المسؤولية عن أي ضرر أو خسارة أو إتالف يلحق باللوت ما لم يكن ذلك ناجما ً عن إهمال أو خرق آخر للواجبات من قبل شركة سبعة الحديثة التجارية وموظفيها أو وكالئها في سياق واجباتهم المعتادة تجاه شركة سبعة الحديثة التجارية ،وسوف يقوم البائع بتعويض شركة سبعة الحديثة التجارية بالكامل فيما يتعلق بجميع المطالبات واإلجراءات األخرى المرفوعة ضد شركة سبعة الحديثة التجارية فيما يتعلق بأي خسارة أو ضرر أو إتالف للوت. لن تتحمل شركة سبعة الحديثة التجارية المسؤولية عن أي إصابة أو خسارة أو ضرر ناتج عن أي لوت أو عن إهمال البائع نحو شركة سبعة الحديثة التجارية أو موظفيها أو وكالئها في سياق واجباتهم المعتادة تجاه شركة سبعة الحديثة التجارية ،ويجب على البائع تعويض شركة سبعة الحديثة التجارية بالكامل فيما يتعلق بجميع المطالبات واإلجراءات المرفوعة ضد شركة سبعة الحديثة التجارية فيما يتعلق باإلصابة أو الخسارة أو الضرر الناجم عن أي لوت أو إهمال البائع أو خرقه ألي التزام بموجب الشروط.

-12سداد إيرادات البيع 1-12
وفقا ً لحقوق اًلحتفاظ الخاصة بشركة سبعة الحديثة التجارية بموجب البند ( )2-3واألحكام األخرى من البند (،)12 يجب على شركة سبعة الحديثة التجارية سداد إيرادات البيع للبائع في موعد أقصاه ( )14أربعة عشر يوم عمل بعد المزاد ،شريطة أن تكون شركة سبعة الحديثة التجارية قد استلمت سعر الشراء بالكامل من المشتري؛ ما لم يتم اًلتفاق على طريقة بديلة للدفع من قبل شركة سبعة الحديثة التجارية ،ويجب أن يتم السداد عن طريق التحويل البنكي؛ في حالة عدم اًلستقرار في عملية الشراء أو اتفاقية تمويل أو أي رسوم أو امتيازات أخرى تؤثر على اللوت؛ فإن شركة سبعة الحديثة التجارية تحتفظ بحقها في تسوية المبلغ المستحق لهذه الرسوم التي ًل تتجاوز إيرادات البيع ،وإذا كانت إيرادات البيع أقل من الرسوم المستحقة ،فسوف يكون البائع مسؤوًلً عن تسوية الرصيد المتبقي مباشرة.
2-12
إذا لم يتم استالم سعر الشراء بالكامل من قبل شركة سبعة الحديثة التجارية خالل الوقت المحدد والمنصوص عليه في البند ( ،)1-12فإن شركة سبعة الحديثة التجارية ستقوم بسداد إيرادات البيع إلى البائع خالل سبعة أيام عمل اعتبارا ً من تاريخ استالم سعر الشراء بأموال مستحقة الدفع من المشتري.
3-12
فيما يتعلق بالسيارات ال ُمسجلة على الطرق ،تحتفظ شركة سبعة التجارية الحديثة بحقها في عدم تحويل إيرادات البيع إلى البائع ما لم يقم البائع بإيداع وثيقة تسجيل المركبة وأي وثائق أخرى ،لدى شركة سبعة الحديثة التجارية ،تفيد بأن المركبة في حيازة البائع أو تخضع لسيطرته ويتم اًلتفاق مع شركة سبعة الحديثة التجارية على توريدها.
4-12
إذا لم يدفع المشتري سعر الشراء خالل ثمانية وعشرين ( )28يوما ً من المزاد ،فستقوم شركة سبعة الحديثة التجارية بإخطار البائع الذي يُم ّكنه توجيه شركة سبعة الحديثة التجارية إلى مسار العمل المناسب؛ وفي هذه الحالة قد تسعى شركة سبعة الحديثة التجارية إلى مساعدة البائع ،إًل أنها ليست ُملزمة بالقيام بذلك ولن تكون ُملزمة برفع الدعاوى باسمها.
5-12
في حال عدم وجود أي تعليمات مكتوبة من البائع إلى شركة سبعة الحديثة التجارية خالل ( )7سبعة أيام بعد إخطار شركة سبعة الحديثة التجارية للبائع بموجب البند ( ،)4-12يحق لشركة سبعة الحديثة التجارية اتخاذ أي من اإلجراءات المنصوص عليها في البند (.)19
6-12
تُطبق أي أموال تُسترد من قبل شركة سبعة الحديثة التجارية وتدفع لها تبعا للنتائج المترتبة على اتخاذ شركة سبعة الحديثة التجارية لواحد أو أكثر من اإلجراءات المنصوص عليها في البند ( )19لسداد اآلتي:
1-6-12التكاليف النظامية أو غيرها من التكاليف التي تكبدتها شركة سبعة الحديثة التجارية فيما يتعلق بهذه اإلجراءات. 7-12
النفقات
1-7-12عالوة المشتري وعمولة البائع من بيع اللوت. 2-7-12يتم دفع أي رصيد متبق لشركة سبعة الحديثة التجارية من قبل البائع (أو المشتري ،إذا كان ذلك مناسبا ً) ،وإذا كان هناك نقص ،فإن البائع يقوم بتوفيره لشركة سبعة التجارية الحديثة عند الطلب في حال وجود أي نقص من هذا القبيل. 3-7-12إذا كان البائع خالل ( )7سبعة أيام بعد استالم اإلخطار المنصوص عليه في البند ( )5-12قد بلغ شركة سبعة الحديثة التجارية بأنه يرغب في إعادة تسليم اللوت له ،فإنه يحق له القيام بذلك ولكن فقط عند الدفع المسبق لجميع النفقات وجميع التكاليف النظامية وغيرها من التكاليف بشكل معقول التي تكبدتها شركة سبعة الحديثة التجارية ،وذلك مع الحفاظ على تعويض شركة سبعة الحديثة التجارية بالكامل عن أي خسائر لحقت بها نتيجة هذا اإلجراء من قبل البائع.

يحق للبائع سحب اللوت من المزاد عن طريق تقديم إشعار خطي إلى شركة سبعة التجارية الحديثة؛ وفي حالة حدوث هذا يدفع البائع خالل ( )14أربعة عشر يو ًما من السحب إلى شركة سبعة التجارية الحديثة المبالغ المنصوص عليها في هذا الشرط ( ،)13ويجب دفع جميع هذه المبالغ إلى شركة سبعة الحديثة التجارية بمثابة تعويض عن الخدمات التي تؤديها شركة سبعة الحديثة التجارية حتى تاريخ السحب ،وليس عن الغرامات أو التعويض عن األضرار التي لحقت بها.
2-13
في جميع حاًلت السحب ،يتحمل البائع المسؤولية عن سداد مبلغ لشركة سبعة الحديثة التجارية بنسبة ٪5من القيمة المتوسطة ال ُمقدرة للوت ،بصرف النظر عن أنه تم اًلتفاق على مبلغ عمولة أقل أو ًل من قبل ،وذلك لتعويض الوقت والجهد وخسائر الدعاية وعالوة المشتري الذي تكبدته شركة سبعة الحديثة التجارية؛ في حالة عدم وجود احتياطي للوت ،وعدم توفير مبلغ تقديري ،يتحمل البائع مسؤولية دفع مبلغ لشركة سبعة الحديثة التجارية بنسبة ٪5من المبلغ التقديري المعقول المقدر من قبل بائع المزاد؛ يخضع الرسم في كل حالة لضريبة القيمة المضافة والنفقات.
3-13
في حالة سحب البائع للوت من المزاد ،يجب على البائع اتخاذ الترتيبات الالزمة إلستالم وإزالة اللوت على نفقته الخاصة خالل يومين عمل بعد تاريخ السحب ،شريطة أًل يحق للبائع إستالم اللوت ما لم يتم دفع رسوم السحب المستحقة بالكامل بموجب الشرطين ( 2-13و.)3-13
-14اإلزالة والتخزين 1-14
يتعين على البائع اتخاذ الترتيبات الالزمة إلزالة أي لوت غير ُمباع ،وكذلك المشتري إلزالة اللوت ال ُمشترى في الوقت المحدد والمنصوص عليه في تعليمات تسليم البائع ومعلومات البيع الرئيسية في كتالوج المزاد أو في أي وقت آخر على النحو المتفق عليه من قبل شركة سبعة الحديثة التجارية.

سوف يمنح اإلخفاق في إزالة اللوت وف ًقا للبند ( )1-14أعاله شركة سبعة الحديثة التجارية الحق في فرض رسوم اإلزالة والتخزين والتأمين وغيرها من النفقات وأي تكاليف يتم تكبدها ،على البائع أو المشتري ،بالمعدًلت التالية: السيارات: اإلزالة 1000-دوًلر أمريكي باإلضافة إلى ضريبة القيمة المضافة. التخزين 15 -دوًلر أمريكي عن كل يوم باإلضافة إلى ضريبة القيمة المضافة. يتم التسليم عن طريق شركة كارز شيبنج .ذ.م.م ،بعملة الدوًلر األمريكي ،والتسليم في الخارج عن طريق التسعير؛ ويتم تطبيق هذه الرسوم ما لم ينص على خالف ذلك في "معلومات البيع األساسية" في كتالوج المبيعات. المقتنيات: اإلزالة 25 -دوًلر أمريكي باإلضافة إلى ضريبة القيمة المضافة التخزين 15 -دوًلر أمريكي عن كل يوم باإلضافة إلى ضريبة القيمة المضافة

يجب أن يكون المشتري هو أعلى مزايد قدم سعر إغالق للوت؛ ويقوم بائع المزاد بتسوية أي نزاع يتعلق بأي عرض وفق تقديره المطلق.

-16عالوة المشترى يجب على المشتري أن يدفع عالوة المشتري إلى شركة سبعة الحديثة التجارية ويقر المشتري بأن شركة سبعة الحديثة التجارية قد تتلقى أيضًا عمولة البائع بتداول شركة سبعة الحديثة التجارية بموجب البند (.)10 -17السداد 1-17
بمجرد بيع اللوت يصبح سعر الشراء واجب الدفع لصالح شركة سبعة الحديثة التجارية مباشرة.
2-17
يجب أن يتم سداد سعر شراء اللوت بالكامل لشركة سبعة الحديثة التجارية بالكامل بحلول الساعة 5:00مسا ًء في يوم العمل التالي ،ويمكن قبول الدفع فقط بالدوًلر األمريكي؛ وًل يتم قبول الدفع عن طريق بطاقة الخصم أو بطاقة اًلئتمان (فيزا/ماستركارد) إًل بحضور حامل البطاقة.
3-17
ًل يحق استالم المشتري للوت حتى يتم سداد سعر الشراء بالكامل لشركة سبعة الحديثة التجارية ،ويحق لشركة سبعة الحديثة التجارية تحصيل أي مبالغ أخري تكون مستحقة لها من هذا المشتري على أي حساب بصرف النظر عن أي توجيهات بخالف ذلك من قبل المشتري أو وكيله سواء كانت صريحة أو ضمنية.
4-17
سينتقل حق ملكية اللوت إلى المشتري فقط عندما يتم استالم سعر الشراء باألموال المستحقة من قبل شركة سبعة الحديثة التجارية.
5-17
يتم بيع اللوت مباشرة ويجب أن تنتقل المسئولية إلى المشتري على الرغم من أن الحيازة لن يتم منحها للمشتري وأن الملكية لن تنتقل إلى المشتري قبل دفع سعر الشراء.
6-17
يجب على المشتري إزالة اللوت المشتراة ،على نفقته الخاصة ولكن ليس قبل سداد سعر الشراء بالكامل لشركة سبعة التجارية الحديثة ،فيما يتعلق بهذا اللوت أو أي لوت أخرى.
7-17
ًل يتم قبول المدفوعات النقدية كوسيلة سداد لسعر الشراء من المشتري.
-18المسؤولية عن اللوت المشتراة 1-18
يتحمل المشتري مسؤولية الخسارة أو الضرر الذي لحق باللوت المشتراة عند سعر إغالق المزاد؛ ولن تتحمل شركة سبعة الحديثة التجارية أو موظفيها أو وكالئها المسؤولية عن أي خسارة أو ضرر ما لم يكن سبب ذلك هو إهمال شركة سبعة الحديثة التجارية أو موظفيها أو وكالئها في السياق العادي لمهامهم تجاه شركة سبعة الحديثة التجارية أثناء وجودها في فترة الوصاية أو السيطرة.
2-18
يتحمل المشتري مسؤولية جميع عمليات النقل والتأمين والتخزين والرسوم األخرى على أي لوت بد ًءا من سعر إغالق المزاد (وفقًا للبند .)11
3-18
سيتم إخطار اإلدارة العامة للمرور السعودي ،أو الجهات المختصة بتغيير المالك خالل خمسة ( )5أيام عمل بعد استالم المبلغ باستخدام التفاصيل الواردة في الفاتورة ما لم يُذكر خالف ذلك.
4-18
سيتم إرسال لوت المقتنيات والساعات التي تم دفع أسعارها والتي تم تحصيلها بحلول منتصف اليوم في أول يوم عمل بعد البيع إلى المشتري على نفقة المشتري.

-19عدم الدفع أو عدم اإلستالم 1-19
إذا لم يتم دفع سعر الشراء بالكامل ،فيجب أن تكون شركة سبعة الحديثة التجارية وكيالً للبائع ،وفقًا لتقديرها المطلق سبل التعويض التالية: ودون المساس بأي حقوق أخرى قد يتمتع بها ،يحق لها ممارسة واحد أو أكثر من ُ
1-1-19إزالة وتخزين (إما في مواقع شركة سبعة الحديثة التجارية أو في أي مكان آخر) وتأمين اللوت على نفقة المشتري. 2-1-19فرض فائدة بمعدل يومي تساوي ٪4سنويا ً على السعر األساسي للبنك األهلي التجاري ( )SAعلى أساس القدر الكبير من إجمالي المبلغ المستحق الذي ًل يزال غير ُمسدد بعد التاريخ والوقت المنصوص عليهما في البند (.)2-17 3-1-19اًلحتفاظ بهذا اللوت أو أي لوت تم بيعه لنفس المشتري في نفس المزاد أو في أي مزاد آخر لشركة سبعة الحديثة التجارية ولفك قيده فقط يكون بعد دفع المبلغ اإلجمالي ال ُمستحق. 4-1-19التطبيق على أي أموال مستحقة أو تصبح مستحقة للمشتري المتعثر في أو نحو تسوية المبلغ اإلجمالي المستحق وممارسة رسم أو امتياز على أي ممتلكات للمشتري والتي هي في حيازة شركة سبعة الحديثة التجارية ألي غرض. 5-1-19اتخاذ الخطوات التي تعتبرها شركة سبعة الحديثة التجارية ضرورية وفقا ً لتقديرها المطلق ،لجمع األموال المستحقة من المشتري ،والموافقة على شروط دفع سعر الشراء. 6-1-19إلغاء البيع واسترداد أي أموال إلى المشتري ،أو إلغاء البيع للمشتري وشراء اللوت نفسه؛ إذا تم ذلك ،فإن ملكية اللوت تنتقل إلى شركة سبعة الحديثة التجارية عند اختيارها وتحول شركة سبعة الحديثة التجارية سعر الشراء إلى البائع خالل ( )14أربعة عشر يوم عمل من تاريخ اختياره مطرو ًحا منه عمولة البائع والمصروفات والمبالغ مستحقة الدفع إلى شركة سبعة الحديثة التجارية التي كانت سوف يتم دفعها لوًل تم إلغاء العقد. 7-1-19تعيين محام أو وكيل آخر لمتابعة أي من مسارات اإلجراءات المنصوص عليها في البند ( ،)19ويفوض البائع شركة سبعة الحديثة التجارية بموجب هذا لتنفيذ أي من اإلجراءات المنصوص عليها في هذا البند ،بما في ذلك القضايا ومالحقة اإلجراءات نيابة عن البائع ،ولتسوية المطالبات أو اإلجراءات التي يتخذها المشتري أو ضد المشتري وفقًا للشروط التي يجب على البائع توجيهها ،أو في حالة عدم وجود تعليمات فوفقًا للشروط واإلجراءات التي تراها شركة سبعة الحديثة التجارية مناسبة ووفقًا لتقديرها المطلق؛ يتحمل المشتري المسؤولية عن جميع التكاليف المتكبدة في أي إجراءات أو مفاوضات أو الحلول البديلة لتسوية النزاعات ( )ADRبما في ذلك أي نقص في التكلفة بين تلك النفقات بواسطة شركة سبعة الحديثة التجارية أو البائع وتلك التي تمنحها أي محكمة أو هيئة قضائية.

إذا أخفق المشتري في السداد خالل ( )14األربعة عشر يو ًما من التاريخ والوقت المنصوص عليهم في البند ( ،)2-17يجب على شركة سبعة الحديثة التجارية وفقًا لتقديرها المطلق ودون المساس بأي حقوق أخرى لديها ،إعادة بيع اللوت أو التسبب في إعادة بيعه بالمزاد العلني أو البيع الخاص ،وإذا أدى هذا إلى الحصول على سعر أقل ،فإنه يجب على المشتري المتعثر سداد أي نقص إلى شركة سبعة الحديثة التجارية ،باإلضافة إلى تكاليف إعادة البيع وأي تكاليف يتم تكبدها فيما يتعلق بإخفاق المشتري في القيام بالسداد وأي فائض يجب أن يخص البائع.
3-19
إذا لم يتم سحب اللوت في التاريخ والوقت المنصوص عليهما في البند ( ،)2-17سواء تم دفع سعر الشراء أم ًل، يجب على شركة سبعة الحديثة التجارية إزالته وتخزينه (إما في مواقع شركة سبعة الحديثة التجارية أو في أي مكان آخر) وتأمين اللوت على نفقة المشتري ويكون فك قيد اللوت فقط بعد دفع المبلغ اإلجمالي المستحق.

-20مسؤولية شركة سبعة الحديثة التجارية والبائع 1-20
يتحمل المشترون وحدهم المسؤولية عن ضمان أن تكون "السيارات" آمنة لالستخدام ،وصالحة للقيادة (إذا كانت السيارة تسير على الطريق) ،واًلمتثال لجميع األنظمة واللوائح ذات الصلة المعمول بها في جميع الوًليات القضائية ذات الصلة ولضمان سريان وصالحية شهادات الفحص ،ويتحمل المشتري مسؤولية إجراء هذا الفحص الذي يراه ضروريًا.
2-20
في المزايدة على أي لوت ،يقر المشتري بأنه ًل يعتمد على أي تمثيل يتم تقديمه له من قبل شركة سبعة الحديثة التجارية أو موظفيه أو وكالئه.
-21النظام الحاكم تخضع أي معامالت تنطبق عليها الشروط للنظام السعودي ،وللمحاكم في المملكة العربية السعودية صالحية قضائية حصرية لتسوية جميع النزاعات الناشئة فيما يتعلق بجميع الجوانب وجميع األمور أو المعامالت التي تنطبق عليها هذه الشروط. -22مالحظات 1-22يعتبر أي منها قد تم استالمه. 1-1-22إذا تم تسليمها باليد ،في وقت التسليم. 2-1-22إذا أُرسلت عن طريق البريد ،بعد يومين من تاريخ اإلرسال. 2-22إثبات الخدمة عن طريق التسليم. 1-2-22باليد ،سيكون من الضروري فقط إصدار إيصال لإلشعار ُموقّع يدويا ً من قبل المرسل إليه أو أي شخص ينوب عنه. 2-2-22عن طريق البريد ،يجب فقط أن يكون ضروريًا في ذلك إثبات أن اإلشعار كان واردًا في مظروف مدفوع مقد ًما تم توجيهه ونشره على النحو الواجب من الدرجة األولى. -23حماية البيانات 1-23
سيتم التعامل مع جميع المعلومات المقدمة إلى شركة سبعة الحديثة التجارية بشكل سري ولن يتم التصريح عنها إلى جهات خارجية ،إًل عند الضرورة إلتمام معاملة البيع.

تحتفظ شركة سبعة الحديثة التجارية بالحق في نقل المعلومات حسب الحاجة بموجب التشريعات أو السلطات الحكومية أو المحاكم.
