Good Times, Bad Time

It’s great time to sell, but sellers need to consider their next move, too – literally.

igher home sale prices have many homeowners asking the age-old question: How much could my home fetch if I sold it today? While it’s exciting to speculate on answers to that query given the current seller’s market, it may not be the most important question to ponder. Instead, ask yourself: If you were to unload your property right now, where would you live next, what could you afford and how hard would it be to find your next home given the current housing shortage? Indeed, the results of a new Redfin poll indicate the biggest hurdle for home sellers in 2017 is a dearth of domiciles to choose from when they themselves move; nearly 66 percent of real estate agents polled ranked low inventory/worries about finding another home to purchase as the greatest challenge right now for home sellers. That’s a legit concern, say the pros, because any higher-than-expected profits you make on your timely sale could get nullified by the exorbitant price you may have to pay on your next residence – especially if you get in a bidding war with other buyers. Plus, you may not be able to time your listing and sale to coincide with a closing and move-in window on your next home. For better peace of mind on these issues, prepare to do your homework well before that “for sale” sign goes up. “Sellers should definitely have an idea how much they will make from the sale of their home and then 4

how much they can afford on their next home,” says Brittney Atwood, real estate contract expert from Huntington Beach, Calif. “That requires speaking to an agent and a mortgage lender to get those details squared away before listing.” Additionally, sellers-turned-buyers need to begin shopping for their next home early “to get a good idea of what they want and how quickly and competitively the homes they desire are selling for, so they can be prepared for when they are ready to make an offer,” says Rachel Musiker, spokesperson with Seattleheadquartered Redfin. John Powell, broker with Help-U-Sell Real Estate in Tucson, Ariz., echoes that sentiment. “Check out the available inventory before you list to get a feel for what’s available and at what price,” says Powell, who recommends getting pre-qualified for your next mortgage early in the process. “If inventory is tight, consider the possibility of purchasing a new construction home, which can make the whole timing and transition thing easier.” Buying a move-in ready new home or soon-to-be-built abode can take some uncertainty out of the equation, as you don’t have to worry about when previous occupants will move out. But new construction homes can go fast, too, and you may have a budget that limits you to older existing homes only. One of the least-recommended strategies is to place a “subject to seller finding suitable housing”

contingency or clause in your next home’s purchase contract. “In a hot seller’s market, this is more difficult to have success with because the seller of the next home you want to buy is more likely to accept a noncontingent offer over a contingent one,” Atwood says. A better option, she notes, is to pursue a “seller rent back” agreement, wherein you stipulate in an additional contract that you have the option of renting back your sold home from the new buyer after close of escrow. “This gives you time to find and close on your new home, and it’s usually agreeable to the buyer because they can negotiate the rent and coordinate the timing of their move,” Atwood says. Or, you can try to find alternative living arrange-ments, “either short-term rentals, extended stay hotels, or living with friends or family while keeping your belongings in a storage facility,” suggests C.J. Johnson, broker/CEO of 3CR Global Properties in Baton Rouge, La. An advantage to selling first and moving into temporary housing for a while is that your cash is freed up, “enabling you to offer a larger, more competitive down payment on the next home you’ll eventually find, which can make your offer more desirable,” Musiker says. No matter which option you pursue, “take time to research, understand market dynamics and arm yourself with a team you can trust – including an agent and lender,” Musiker adds. June 16, 2017

Fast Money? Not So Fast Question:

We received a letter from a major lender that says we’ve been prequalified to refinance. Since we already qualify for financing, if we say yes will the lender simply schedule closing and give us a check?

Answer:

Unfortunately that’s not how the system works. To understand why, go back to the lender’s letter. It surely says on the front that you are prequalified to refinance your home. However, if you look very carefully, you will see that the important point about the letter is not the term “prequalify” – it’s the asterisks and fine print. In that fine print it will say you’ve been “prequalified” for financing but not actually able to get a loan.

What happened here is the lender got your name from a credit bureau, data broker or other source. On the basis of your credit score and other factors the lender then sent you an offer to sell you a loan. Keep looking with that magnifying glass and you will see that the offer is not without conditions. Before giving you a penny, the lender must determine you have the ability-to-repay the loan. That means while you qualify to get the lender’s offer, you may not qualify for the actual financing being offered. What more is required? Nothing less than a fullblown mortgage application. But wait – there’s more. Even if you meet all the financial standards required by the lender, you still may not qualify for financing. That’s because the lender will want to get the property appraised to assure that it has enough value to justify the mortgage. There must be a certain loan-to-value ratio (LTV), say 80 percent. For example, imagine that the property can be appraised at $200,000. If the lender will provide financing equal to 80 percent of the property’s value, a qualified borrower can get a $160,000 mortgage.

You might see that the lender’s letter says that not only do you prequalify for a given rate you also prequalify for a given amount. But – again – take a close look at the letter. No doubt it says somewhere that the rate is subject to change. Also, that loan amount mentioned in the letter may require a certain LTV. If the lender says it will only accept a 70 percent loan-to-value ratio – an extremely conservative LTV that assures the loan is virtually risk-free – then you will get a much smaller loan than would be the case with 80 percent or 90 percent financing. If the letter is interesting, if you think now is a good time to refinance given today’s rates, that’s fine. Use the prequalification letter as a benchmark, speak with a number of local lenders, and see what options are available to you.

A Sort-Of Secret Home for Sale ‘Pocket Listings’ can be attractive to both sellers and buyers

S

ince the economic crisis last decade, observers say there’s been a discreet build-up in “pocket listings,” whereby sales occur without the property ever being listed on the multiple listing service, the data networks brokerages share to spread information about available properties amongst realty firms. “We have no way of tracking pocket listings since they are not on the MLS,” says Adam DeSanctis, economic issues media manager for the National Association of Realtors, Washington, D.C. Pocket or “whisper” listings have long existed, though, because for some owners “the idea of having their home listed ‘for sale’ is distasteful,” says Rochelle LeCavalier, managing broker at Pink Palm Properties in Boca Raton, Florida. Famous owners, for example, or those selling due to a divorce or other misfortune, fear a formal listing as an invasion of privacy, say agents. However, critics say the pocket approach limits the pool of potential buyers, and therefore may result in a less-than-optimum price. Indeed, LeCavalier believes that the strategy works best in the high end of the market, since the pool of agents representing lower priced homes is “larger, covering a wide geographical area, and is less connected/ networked.” In another approach, a seller wants to place his listing with a specific agent but isn’t ready for buyers to start viewing, explains Terry Denoux, principal broker at

Cascade Sothebys International Realty, Bend, Ore. “You let the public know and fellow agents know you have a coming listing,” says Denoux, adding that his local MLS doesn’t have an option to post a “coming soon” listing, which several other networks have started to incorporate. And, if sellers allow it, a “coming soon” sign on the property can also spread the word. In another pocket practice, an ad for a property is placed on a real estate brokerage’s own website, which then may be picked up by real estate sites. That strategy though, doesn’t serve the seller well since it may be motivated by a brokerage trying to keep all sales commissions on the transaction in-house. It’s human nature that when buyers feel as if they “have an edge over what everyone else is seeing” they are motivated to bid. And, the buyers benefit because they get a discount for buying early, he adds. Likewise, calling other agents about a property that will soon be ready or by personally inviting select agents to a brokers’ open house can add some panache, Denoux says. LeCavalier says buyers often tell her they want a certain type of home, but low MLS inventory forces her to call owners of desired properties “In some cases, there is no dollar amount that would have them sell. In others, there is an opening for dialogue and potentially a sale. The idea is to create a win/win for buyer and seller,” she says.
