Gift Money Question:
My parents are prepared to give us a large sum of money for a down payment. We are very grateful and realize that without their help we would not be able to afford a house. The lender wanted them to sign a form saying the money was a gift and not a secret loan. That was OK with my parents. Then the lender wanted my parents to prove that the money was theirs. My parents are furious. They feel their honesty has been questioned and now we’re unsure the money will be available. How do we explain the lender’s actions to my parents?
Answer:
Before the mortgage meltdown, lenders often failed to demand proper documentation
– think of such things as no doc, low doc, and NINJA (no income, no job, no asset) mortgage applications. Many borrowers did not have the income or reserves to pay their mortgages when the economy slowed and home values fell. The result was a massive number of foreclosures. Federal rules now require that lenders verify the ability of borrowers to repay most residential mortgages – there are limited exceptions for such things as reverse mortgages and bridge loans. It used to be that gift money only required a gift letter, a form which said that the money received by the purchaser is truly a gift and that no repayment or interest can ever be required. With a gift letter the lender – and the borrower – were certain that in the future the donor could not demand a return of the money. But in a period of greater scrutiny, some lenders are going further. They want to make sure that gift money is not actually a secret loan in the name of the parents or another donor. For this reason, they may ask for donor financial records. It’s likely the lender’s inquiry would have been better received had the parents been told about

such an inquiry up-front, that it’s now a normal question. The parents could have prepared documentation showing that the money was in savings, a brokerage account, a retirement fund, etc. Or, the parents could have provided the money to you several months ago. That way it would be “seasoned” and show up in past monthly statements, meaning that the lender would likely accept it as your funds without further question. Since lenders have changing standards, so should borrowers. If you are expecting to buy with a gift, ask the lender how the gift should be documented and whether the donors will have to provide any financial records. The odds are that if the money has been in your account at least 60 days it will be regarded as sufficiently seasoned to be a settled matter.

5 Must-Know Tips for FirstTime Investors If you have commitment issues and you’re considering real estate investment, you may want to skip to Plan B. Real estate investment is not for those who are unable or unwilling to make long-term commitments, says Samantha DeBianchi, founder of DeBianchi Real Estate, Miami and a star of the Bravo reality TV show “Million Dollar Listing Miami.” “There are ups and downs even in a healthy market,” she says. “Investors must be ready for everything and know that there are goods and bads in every property ownership.” As the real estate market continues to improve and stocks and bonds exhibit volatility and lackluster returns, more people are considering the idea of investing in real estate as a means of building long-term wealth. Enter the real estate with caution and preparation. Heed these earnest tips from professional in the trenches. 1. Be realistic about your goals. DeBianchi notes that everyone dreams of grabbing a luxurious property that produces a 10 percent cash-on-cash return. “Be realistic with your goals. Sometimes an ugly house is the best investment for long-term appreciation,” she says. When you invest in a property, you must develop a comprehensive budget. Depending on the type of investment, money will be needed for repairs, maintenance, association dues, vacancies, taxes and so on. When you’re setting goals and calculating a return, make sure to account for all costs. November 16, 2018

2. Educate yourself. Often first timers get caught in one of two modes, says Brian LeBow, a sales associate at Coldwell Banker in Temple City, Calif. They enter analysis paralysis, or they jump in too quickly. You may find yourself swamped in emails from wholesalers and flippers describing great deals you must grab quickly. Slow down, LeBow advises. Read everything carefully and question all offers. Don’t over analyze, but don’t jump in, either. As you educate yourself about the industry by attending industry conferences, information sessions and investment workshops, you will be in a better position to make smarter investments. Experts are eager to share the mistakes that they have made along the way. Learn from them. 3. Think long-term. Embrace the downturns as well as success. New York investor Josh Klimkiewicz likens real estate investing to a marathon versus a sprint. “In good times, when real estate is stable or even increasing in value, it’s easy to get complacent regarding the quality of a deal. The real test of a property’s quality will be realized in a downturn, and all markets – real estate included – have their ups and downs,” he says. “Anyone who doesn’t appreciate this concept should not invest.” Better quality locations represent more durable income streams, since it will always be easier to
replace tenants. Be mindful of the balance of risk and reward, however. Higher returns are generally less secure, although they’re great while they last. They need to be considered in the context of potential decline. 4. Take your time. Pace yourself, especially in moments of enthusiasm. Although you may think you can quadruple profits by buying multiple properties in a short time frame, resist the temptation, says Tiffany C. Wright, an Atlanta real estate investor and owner of a business consulting firm for entrepreneurs called The Resourceful CEO. With your first few properties, you will learn lessons. Yes, you can multiply profits with a bigger portfolio. But if you have serious issues, such as poorly structured contracts, mis-recorded deeds, or unrented stock, your problems can also multiple and cause grave financial losses. 5. Try, try again. When at first you don’t succeed – dust yourself off and try again. Do not call it a “failure” when things don’t work out. Instead, conduct a post-mortem, an analysis of everything that went according to plan, much better or much worse, and make adjustments accordingly. “When you find the product and strategy that works well for you, and you’ve ironed out the kinks, you can accelerate and grow as fast as you want,” says Wright.
