‘Know Before You Owe’ 4 Ways New Rules Make Home-Buying Better for Consumers

B

ig changes to lending rules in the wake of the foreclosure crisis appear to be doing their job: making the cost and terms of mortgage loans and the home purchasing process much more clear to home buyers. The legislation – TILA-RESPA Integrated Disclosure, or TRID – went into effect last October. Better known as “Know Before You Owe,” the new rules include a series of disclosure forms designed to make it more clear to consumers what they’re getting into with a loan. Two new “Know Before You Owe” forms replace three old ones: the Good Faith Estimate, a HUD-1 Settlement Statement and a Truth in Lending disclosure. Instead, the new Loan Estimate and a Closing Disclosure form sum up every aspect of the mortgage transaction. Buyers receive the Loan Estimate shortly after applying for a mortgage 4

and can use the document to shop and compare loans. The Closing Disclosure must be in the purchaser’s hands three business days before the loan and purchase close, allowing the customer time to ask questions. The good news: a significantly higher percentage of homebuyers now actually read their loan documents prior to closing. Some 92 percent of polled buyers now say they review their closing documents in advance of settlement. Just 74 percent did so before the simpler documents were available, according to a survey by the American Land Title Association. Fears that the new rules would significantly delay closings appear to have been exaggerated. A survey by San Diego technology and data company ClosingCorp also found homebuyers generally pleased

with the new process. Some 68 percent said that the new forms “did a better job preparing them for the closing costs they would have to pay;” 63 percent said the new forms were easier to understand; 65 percent said costs and fees are now “explained better.” Professionals who have worked closely with the documents and closings acknowledge “Know Before You Owe” has changed home buying for the better for buyers. Among the benefits:

1. MORE TRANSPARENCY Lenders are now solely liable for errors and incorrect fees, points out Daniel P. Hodin, attorney with Presidential Title, Bethesda, Maryland. “Lenders must provide final figures, rates and terms three days before closing, giving the consumer time to review, understand, compare and correct, if necessary.” June 17, 2016


2. EASIER COST COMPARISONS The Loan Estimate form breaks out specific costs and rates, making it far easier for consumers to compare costs for third-party service providers, including the title company, inspector and property attorney. “This can save them money, often hundreds, and in some cases, thousands of dollars,” says Dave Petro, senior vice president for ClosingCorp. Petro said more than half – 55 percent – of homebuyers polled by ClosingCorp. said they had saved money thanks to comparison shopping using the new form. 3. FEWER SURPRISES When customers understand the costs and fees they’ll face at closing they can budget for those costs in advance, Petro points out. And there’s less chance that revised prices make a sudden appearance. “The new rules severely limit the changed conditions that can increase fees from the time they are estimated until the closing,” he said. 4. SMOOTHER PROCESS The legislation nudged lenders and settlement services to automate estimating and closing processes in order to save time and money. “The industry has progressed technologically and professionally,” says Presidential Title’s Hodin. Wayne Stanley, ALTA director of public affairs, believes it’s too early to fully gauge the success of “Know Before You Owe.” Some kinks still need to be worked out, he says, including the calculation for title insurance fees. “Home buyers are taking more time to review their forms, which is important. However, we don’t know if consumer understanding of their transaction and the closing process is getting better,” says Stanley. “We will continue to test this.”

Investor Misses Foreclosures Question: We’re interested in buying foreclosures but there are now fewer of them. Just how bad is the foreclosure shortage?

Answer: A foreclosure shortage is something to welcome! There’s nothing bad about it. Reduced foreclosure numbers mean fewer people are losing their homes and lender losses are smaller. Fewer foreclosures mean less risk in the marketplace. Fewer foreclosures also mean that investors are more willing to fund real estate loans, one reason we’re seeing lower mortgage rates. According to the Mortgage Bankers Association, the foreclosure start rate for the first quarter of 2016 stood at 0.35 percent. That’s 10 basis points lower than last

year and the lowest point since mid 2000. The national delinquency rate (loans 30 or more days past due but not in foreclosure) fell 8 percent in March, to the lowest point since March 2007. And at just under 2 percent, the rate of 30-day delinquencies is at the lowest level in more than 15 years, according to Black Knight Financial Services. Since there are fewer delinquencies, fewer homes are moving toward foreclosure. Even when loans become delinquent the odds of foreclosure are small. The borrower typically brings the loan current or the lender and borrower work out some arrangement to avoid the courthouse steps and losses for everyone. The result: real estate owned by lenders (REOs) fell from 861,664 units in 2008 to 449,900 units in 2015 according to RealtyTrac.com. However, the foreclosure and delinquency figures do not tell the whole story. The most important part – the hidden part – is that most of the foreclosures we see today are related to mortgages originated before 2008. Last August, the MBA reported that 73 percent of the mortgages that were seriously delinquent had been originated prior to 2008. By November older, “legacy” loans represented 80 percent of all problem mortgages, according to the MBA. Fewer and fewer foreclosures are

related to new loans, a trend that suggests the REO total will continue to fall. The National Association of Realtors said that in March the total unsold housing inventory amounted to 1.98 million homes, down a touch from the 2.01 million units available a year earlier. For investors, however, the most attractive slice of unsold inventory is shrinking. “Home values are rising the fastest among entry-level homes in more than half of the largest U.S. housing markets,” said Zillow. “Rising home values in this segment of the market can be attributed to a lack of supply, with 10 percent fewer homes for sale this year compared to last.” The declining REO supply means investors will need to widen their search for potential acquisitions by looking for short sales and attending auctions. It’s not that distressed properties aren’t out there, it’s just that more digging is required to find them.

Home Buying Student Debt Just One Piece of the Puzzle for First-Time Home Buyers

o doubt you’ve heard: student debt is clouding the future of college graduates, derailing hopes they will one day own a home. That forecast doesn’t hold up, according to a report from the Brookings Institution. Drawing on Federal Reserve data from 2003 to 2012, the report finds that graduates who had borrowed for college do have a slower start to home buying than those who went to college debt-free. However, by the time both groups of graduates enter their mid-thirties, they have similar rates of home ownership. “The typical undergraduate borrower with a Bachelor of Arts degree has a debt of $30,000 and owes $350 a month,” reports Dynarski. The significantly higher earnings college grads can expect offset the burden of student debt, she notes. It’s the total amount of student debt measured against earnings that determines whether grads will later be in a position to buy, agrees Mark Kantrowitz, publisher at the college scholarship site Cappex.com.

If total student debt exceeds annual income, he says, incomedriven repayment plans that stretch payback beyond the usual ten years are often necessary. If the borrower’s income rises, payments revert back to the ten-year term. Since new rules make it more difficult for students to get credit cards, many recent grads don’t have any other debt than a student loan. If they make timely payments, they build a good credit score, putting them in a position to buy later, says Adam Levin, co-founder of Credit.com. A mortgage applicant who is still paying off student loans can still be approved, notes Neil Caron of Freedom Mortgage. As long as the monthly payment on the new mortgage and monthly student loan bill and any other regular monthly debt don’t exceed a certain threshold of total income, often about 36 percent, the loan can be approved.
