Nationwide, evictions have been on the rise. Further, the typical renter now allocates 30 percent of their income on rent, according to Zillow. Consider these among the factors that led to approximately 125,000 household evictions nationwide in 2013, according to the U.S. Census Bureau’s American Housing Survey, up from 120,000 in 2011 and 84,000 in 2007. Lonni Summers, managing attorney with Maryland Volunteer Lawyers Service in Baltimore, says the three primary reasons why landlords seek eviction are failure to pay rent on time, breach of lease terms, and tenant holdover, where the lease expires but the occupant refuses to move. Some tenants also could be evicted if the landlord’s property is in foreclosure.

While laws can vary from state to state, renters do have rights, including the right to fight an eviction proceeding in court. “First, if landlords and tenants disagree about an issue, they should try mediation,” Summers says. “If they cannot agree, they may mutually end the lease agreement. Be sure to put the termination agreement in writing. Some states are judicial eviction states, meaning that landlords must go through the court to evict tenants. If they are served with eviction papers, tenants should always go to court and, if they disagree with what the landlord is claiming, tell the judge why they shouldn’t be evicted.” If tenants are unlawfully evicted – as can happen if the landlord doesn’t give proper advance notice of eviction (some states mandate a notice window of three days) and changes the locks – they can attempt to sue the landlord. Saving for a down payment can is no easy task. A cash gift from a loved one can help ease the burden. Here’s how it works For many prospective home purchasers, coming up with the necessary down payment funds can be tricky – especially young buyers who haven’t had many years to salt away savings. But fear not: you can always turn to family for help in the form of a monetary gift. This practice, in fact, is fairly common today: Based on a recent survey by the National Association of Realtors, 26 percent of first-time buyers helped raise down payment funds by accepting a financial gift from parents, relatives or friends. Receiving such a gift can help you qualify for the loan you need, keep intact private emergency funds like retirement savings, and perhaps push you over the 20-percent down payment threshold so that you don’t have to pay for pricey private

mortgage insurance. Lenders may be strict on the fine-print rules with receiving a down payment gift. Most lenders require the gift to be from a family member; however, some lenders are willing to make exceptions, especially if they intend to keep your loan instead of selling it to an investor after closing. The donor will need to compose a gift letter to the lender verifying that the funds are a gift, not a loan. Detailed documentation and bank receipts may be required. A private loan from a relative or friend can be rejected as a down payment funding source because the loan adds to debt, altering a borrower’s debt-to-income ratio. “While all parties may think of the funds as a loan December 12, 2014
and treat it as such, the lender requires the donor to state in writing that the funds do not need to be repaid,” says Tal Frank. With conventional loans, if a down payment is less than 20 percent, a gift can cover part of the money, but some of it will have to come from your own funds. Note that all of the money can be from a gift if the gift money covers the entire down payment plus closing costs, or if your down payment is at least 20 percent – unless the total loan amount exceeds $417,000. For FHA and VA loans, all of the money you put down can be from a gift; but if your credit score falls between 580 and 619, a minimum 3.5 percent of your down payment has to come from your own December 12, 2014

Be well prepared if you plan to approach a loved one about a gift toward a down payment, says Lauren Bowling, an Atlanta-based personal finance blogger. “I’m not sure there’s a tactful way to ask, but be straightforward and honest and prepare to prove your credit worthiness by showing you can live within your financial means,” Bowling says. One item you’ll want to mention to your potential donor is that he or she may have to pay a gift tax, although the current annual gift tax exclusion law allows any individual to gift another person up to $14,000 annually tax free; married parents can each gift $14,000 to married home seekers, yielding a

total $56,000 tax-free gift. “The good news is that the recipient doesn’t pay a gift tax – only the donor,” says Tom Wheelwright. If you can’t finagle a gift from your kin, and you have nowhere else to turn for the down payment deficiency, you can explore other options. “I suggest looking for grants, lowinterest loans or deferred payment loans,” says Cara Pierce, a housing counselor in Fresno, California. “Many cities and counties also offer down payment assistance program for firsttime buyers. And veterans can get a VA loan that allows borrowers to make no down payments and minimal closing costs.” 9
