Reverse Info Question:

Some years ago, my now wife was widowed and took out a reverse mortgage to help her economic situation. We married two years ago. I am not on the reverse mortgage. I am 90. She is 86. In the event she predeceases me, what are my rights, if any, to remain in the house?

Answer:

A reverse mortgage is a negatively-amortizing debt secured with the borrower’s home. The attraction of such loans is that they allow borrowers to age in place while accessing a portion of their real estate equity. In some cases, seniors use them to

pay off existing mortgage debt. HECMs do not require monthly payments for principal or interest, thus reducing cash needs. However, because no payments are being made, the loan balance grows each month. We asked Mike Roberts with MyHECM.com, an independent reverse mortgage resource, for a response. “The gentleman in question,” said Roberts, “unfortunately, has no protections in the event his wife passes away before he does. The reverse mortgage predates their marriage and he is not grandfathered into the protections that would be applicable to a spouse who was on the original reverse mortgage contract. “If his wife passes, he’ll have about 90 days to refinance the balance if he wishes to keep the home. Otherwise, he can just sell the home and pay back the balance or let the lender sell the home. If he chooses to sell the home himself, he has six months with a possible extension to one year to complete the sale. “Regardless of what he chooses to do,” Roberts explained, “he will have no liability for any shortage if the home doesn’t sell for enough to settle the entire loan balance. The HECM reverse mortgage is a non-recourse loan, which means FHA will settle any shortage out of

the mutual mortgage insurance fund.” In the current situation, there are several steps you can take. First, contact the lender and see what options may be available to you should your wife pass away. Second, what plans would you and your wife like to see in place if one of you should pass? This is a matter for the two of you to discuss. Third, contact an attorney who specializes in elder law for information regarding documents that may be necessary in your jurisdiction for each of you. Fourth, speak with local real estate brokers for estimates. If the loan balance is greater than the property’s value, you likely want to stay in place for as long as possible. If you have equity, there may be value that can be passed along through your wills.

Finding apartments with friends and services attached These days, selecting an apartment can feel like choosing a hotel for a vacation stay. Enticements like a fitness center offering free yoga classes, summer wine tastings at a rooftop lounge, regularly scheduled social events, like outings to a local brewery are becoming a staple, at least with pricier apartment communities competing for the new breed of “lifestyle renter.” Millennials who move to a new city like an apartment community that comes with the chance to meet people, and 6

so do others, like Empty Nesters who leave suburbia for urban living, says Rick Haughey of the National Multifamily Housing Council (NMHC). Apartment companies have gravitated to building “Class A urban properties” that cater to the lifestyle renter, Haughey adds. Besides on-site amenities, rental communities also act as a concierge, hiring third-party providers of house cleaning, dog-walking, meal delivery and other services for residents. Not only convenient for residents this approach

helps them “get bulk discounts,” says Haughey. “Class A urban” is the industry term for the priciest city rental buildings, followed by Class B or C urban, and then Class B and C suburban, Haughey explains. Newer urban communities with a strong array of amenities will “for the most part, be more expensive per square foot,” explains Adrian McHale, data scientist with rental listing site RentHop. com. Indeed, it’s only renters who aren’t put off by the highest rates –which vary

NMHC research still shows that the budget-constrained renter looks for the “basic” amenities: good cell phone reception, parking, swimming pool and fitness center, says Haughey. Meet in the Middle As the recent government shutdown demonstrated, when two parties aren’t willing to compromise, nobody gets what they want and bitter feelings arise. The same can be true of home purchase negotiations. Once a buyer makes an offer on a home for sale, there’s no guarantee the seller will accept the price and terms. Counteroffers and concessions can be made; contingencies can be suddenly added to or removed from the offer; and one party may choose to abruptly back out. But all of these possibilities should be considered, because the back-and-forth of contract negotiations is fairly standard operating procedure. Preparing for and knowing how to resolve an impasse and preventing the deal from completely falling through is the real trick. “Disputes often arise because the buyer and seller are at opposite ends of the transaction and have opposing goals – the buyer wants to pay the lowest price, and the seller wants the highest price possible. So naturally, they’ll argue over the trade price,” says Fiona Dogan, a Realtor with Rye, New Yorkheadquartered Julia B. Fee Sotheby’s. “Depending on February 8, 2019

the motivation of each party, negotiation disputes can escalate and quickly kill a deal.” Jennifer Okhovat, agent with Compass Real Estate in Los Angeles, says common disagreements usually come down to two things: money and ego. “Serious disputes sometimes occur when the buyer and seller can’t see eye-to-eye on a repair the buyer requests. Many times, sellers think their property is perfect and declare that it’s being sold ‘as is.’ But the buyer may still request repairs or credits during escrow,” explains Okhovat. Other times, Okhovat adds, “the buyer believes the seller is being greedy and trying to drive up the price in negotiations, especially when there is more than one offer on the table.” Perhaps the most common cause for a stalemate or deal collapse? “The seller thinks their property is worth significantly more than it actually is, and the seller gets offended when a buyer suggests their property is significantly lower than the listed price,” notes Brett Ari Fischer, associate broker at New York Citybased Lee & Associates

Justin Potier, branch manager/broker for Carrington Real Estate Services in Long Beach, Calif., says other common disagreements can arise related to: the requested closing date; home inspection contingencies; who pays for what portion of the closing costs; the buyer requesting a home warranty; how long the escrow period will be; the date the seller will relinquish possession after closing; and the kind of financing the buyer chooses. “Negotiating items like these prior to executing a contract can be crucial for the transaction to move forward to escrow,” says Potier. His best advice for avoiding or resolving offer/ counteroffer conflicts? “Stay rational and calm. Don’t take the other party’s request personally. And don’t act abruptly or in haste – allow yourself an evening or day to process the request before responding,” Potier suggests. “Also, keep an open and honest dialogue with the other party. And try not to let your ego or emotions get in the way, either. “Don’t be too rigid about everything. Be prepared for some given and take to get the deal done. Each side may have to share some of the pain points,” adds Dogan. “Look at the big picture, and rely on the experience of your agent who is acting in your best interest.” 7
