GOING GREEN How to Reign in Your Water Usage

ith cold weather coming, now is the time to think about water-saving measures Want a sure-fire way to save water and money? Reduce the water use outdoors. The average U.S. household uses more water outdoors than most American homes use for showering and washing clothes combined, according to the U.S. Environmental Protection Agency. Some experts estimate that up to 50 percent of landscape water use goes to waste. As the cold weather approaches, and gardeners start planning for next year’s activities, the time is ripe to think about how to incorporate water-saving measures. Experts offer a variety of solutions from harvesting rainwater to designing water-smart landscape

and replacing irrigation components for more efficient ones. Mike Ruck, cofounder of a rain water solutions company in Raleigh, North Carolina, is passionate about rainwater harvesting. The practice of collecting and using rainwater, most commonly from roofs and used for watering lawns and washing cars, is one that has been around for generations. Barrels that collect as little as 50 gallons to tanks that store 650 gallons are available for purchase. But Ruck says interest of late has increased as consumers look for ways to save water. “The whole process of collecting water is a real educational experience for people,” he says. In addition to using a rain barrel to collect water for use in the landscape, the Alliance for Water Efficiency also provides other outdoor water conservation tips:

• Use native plants or other plants that require little water to thrive in your region. • Organize your landscape into areas with similar water requirements. • Add mulch to prevent water loss through evaporation. • Add a graywater system to collect water from your washing machine or shower and bath and use it in the landscape. • Install a weatherbased irrigation controller. It is essential that controllers are properly programmed and maintained. • Install and maintain a rain sensor, either wireless or wired, on the irrigation controller if it does not have one built in. What’s New in Water Conservation TAKE A LOOK AT THE LATEST WATER-EFFICIENCY HOME FEATURES THAT ARE REDUCING USAGE AND RECYCLING WATER, SAVING HOMEOWNERS MONEY IN THE PROCESS

I

n some parts of the nation, energy efficiency is taking the back seat to a new concern: water conservation. Also prompted by rising costs similar to those that spurred growth of the green building movement in the last decade, shortages in water is raising bills and inspiring homeowners to find opportunities to consume less H2O. “Droughts are unfortunate, but they do raise awareness,” says Bill Christiansen, a program planner for a Chicago-based water efficiency alliance. “And the use of water-efficient fixtures and accessories will only grow at this point.” The alliance built a website (www. home-water-works.org) for consumer information that includes a water calculator to quickly estimate how much water your household uses and compare it to a similar average and a highly efficient home. The calculator also shows how to begin home water conservation efforts. The U.S. Environmental Protection Agency encourages water efficiency in the United States through the use of a special label on consumer products and fixtures known as WaterSense — similar to the EnergyStar rating for electric appliances. Builders also have started to tout more water-saving features to help reduce usage and help save money. Warm gray water, which studies have indicated may account for two out of every three gallons of indoor water, is normally treated as waste. Some water systems supply recycled drain water to all of a home’s toilets, meaning they will use zero freshwater in a household of four or more, and recycled energy to heat the home’s fresh water. Combined with the home’s other water-conserving features — including a water-recycling dishwasher, WaterSense-labeled fixtures, and a touchless kitchen faucet — these home can conserve as much as 70 percent of the freshwater that would traditionally be used in a typical resale home.

“We’ve found a way to use technology of the future to address the problems of today,” says LeMessurier. To be sure, reducing water usage for the toilet, alone, is a huge conservation effort. Toilets are by far the main source of water use in the home, accounting for nearly 30 percent of an average home’s indoor water consumption, according to EPA estimates of residential water usage. Christiansen suggest replacing toilets installed before 1994 with highefficiency toilets. Older toilets use about 3.5 gallons per flush. A highefficiency toilet uses 1.28 gallons per flush. For a toilet flushed an average of six times each day, the savings amount to 13 gallons per day. For newer toilets, check to verify they are working properly. Make sure the water level is not too high, the fill valve is working properly, and the flapper is not leaking. A running toilet can waste hundreds of gallons per day. OTHER AREAS WHERE WATER MAY GO TO WASTE: CLOTHES WASHER: Consider replacing your old clothes washer, which uses approximately 40 to 45 gallons of water per load, for a high-efficiency washer that uses 14 to 25 gallons per load. Clothes washers use more than 20 percent of the water in a home. SHOWERHEADS: Showering account for nearly 17 percent of residential indoor water use. Low-flow and restricted-flow showerheads help reduce excess water use. Standard showerheads use 2.5 gallons of water per minute, while as water–saving showerheads with a WaterSense label must demonstrate that they use no more than 2 gallons per minute. BATHROOM FAUCETS: Faucets account for more than 15 percent of indoor household water use. WaterSense labeled bathroom sink faucets and accessories can reduce a sink’s water flow by 30 percent. Faucet accessories, which can attach to existing faucets, also help save water and money.

Our house was supposed to close in several weeks but now our buyer has backed out of the deal because of personal issues. We have a $1,500 deposit and have offered to return $500, but they want to split the deposit. We feel $1,000 is fair compensation because we had the house off the market and lost a potential full-price offer. How should we proceed?

Answer: If the matter goes to court you will need to hire an attorney. You have offered $500 and they want $750 (half of $1,500). The difference is $250. You will want to retain an attorney not just because $250 is at stake but because there might be larger numbers involved. It may be that the potential for a bigger liability is why the buyers want a settlement and not just the superficial $250 difference between the two positions. The purpose of a real estate deposit is to assure performance by the purchasers. As a seller you take a considerable risk when you accept a buyer’s offer, including such perils as the loss of other offers, the cost of complying with the agreement and the possibility of a price drop if the deal does not go through. It’s entirely possible for an offer to fail without the loss of a deposit because most purchase agreements today are contingent arrangements.

They say that the buyer wants to make an offer but only if certain requirements are met such as financing at or below a certain rate, a satisfactory home inspection, approval by a relative, etc. If the contingency is not met, the buyer typically is entitled to the return of their full deposit. Because real estate deals are risky sellers should seek the largest possible deposit. With a big deposit owners have more leverage if a dispute arises. For example, imagine if you had a $10,000 deposit in this situation. Notice that the broker or other party holding the deposit has not written a check to either buyer or seller, instead they have deposited the money with a court. This is a common practice because without approval of both parties the deposit money cannot be released. In your situation you say the agreement fell through because of personal issues with the purchaser. Does the agreement say the deposit will be returned because of such matters? You want an attorney to read the agreement and determine the facts and circumstances involved. Once that’s done the attorney can explain the options available to you. For instance, what does the agreement actually say? Does it give you the right to the deposit if the deal falls through, or does it also say you have a right to the deposit plus the right to sue for additional damages? Does it say that if you accept the deposit you lose the right to sue for more money? As you’re about to see, the devil really is in the details.
