Given that the mortgages can be made for 100 percent of the current value of a home and can be used for either a purchase or refinance, Birk says they make refinancing possible for homeowners who’ve seen the price of their home drop. Penalties on New Loans — Yes or No? Question: Please settle an argument: Can lenders charge prepayment penalties on new loans?
Answer: In limited cases they can. Let me explain: One of the major issues raised by the mortgage meltdown was the use of prepayment penalties. If a borrower had a loan and wanted to refinance or pay off the debt, they often found that to do so within the first few years of origination would require a massive prepayment penalty. Example: Smith took out an option ARM and must pay a 5 percent prepayment penalty if he refinances within the first three years of the loan term. If Smith refinances after 30 months and owes $175,000 he will have to bring an extra $8,750 in cash to closing. The cost of the prepayment penalty plus the expense to refinance were too great for many (if not most) borrowers, thus effectively locking them into mortgages with high rates and bad terms. The result was if monthly costs soared they were stuck. For instance, Fitch Ratings estimated in 2008 that the average option ARM payment increased 63 percent once start periods ended, enough to demolish many household budgets. Even worse, if someone had to sell the property during the penalty period – say for a new job in a distant town – the fee would still apply with some loans even though the mortgage was not being refinanced. Under the Dodd-Frank Wall Street Reform and Consumer Protection Act the rules are different.

First, the mortgage pie is divided into two parts – qualified mortgages and non-qualified mortgages. An example of a non-qualified loan might be an interest-only jumbo mortgage. Second, lenders may charge prepayment penalties only with qualified mortgages. Third, a “qualified mortgage” is an FHA, VA or conventional loan, or a “portfolio” loan that meets certain standards. A portfolio loan is a mortgage that a lender originates and keeps, it is not sold to another lender. Fourth, there are no prepayment penalties allowed with FHA, VA or conventional loans. Therefore, the only place where you can find a prepayment penalty today is with a portfolio mortgage that meets the standards to be a qualified mortgage. Fifth, the maximum penalty is restricted to the following schedule: 2 percent the first year, 2 percent the second year, 1 percent the third year and nothing thereafter. Sixth, be aware that a form of prepayment penalty – what are called “postpayment interest charges” – will continue for FHA loans until Jan. 21, 2015. Close after that date and you get a penalty-free FHA mortgage. FHA loans – which have relativelymodest prepayment penalties equal to no more than one month’s interest – can be used to give some sense of how big the problem really is. According to HUD, “nearly two-thirds of borrowers who prepaid their mortgage in full in 2012 paid post-settlement interest. The estimated amount of post-settlement interest these borrowers pay amounts to $449 million.” For more information speak with lenders. If you’re considering an FHA loan and are set to close around the end of January, it might be very much in your interest to assure that you settle after the 21st and that your loan does not allow a post-payment interest fee, a prepayment penalty by any definition.

An enticing price will only go so far. To truly make your case for your dream home, it can pay to get a little creative If you adore the home that you just toured, consider sending the sellers a love note. Though bidding wars for real estate are not as intense as in past years, they’re widespread and may require creativity to come out on top. To be sure, a high bid will catch the seller’s attention. But real estate experts say buyers also appreciate unusual offers. Austin Christopher Bradley, a marketing manager at a New York real estate brokerage, says that in a market like Manhattan, where money is often not an object, he has seen many unexpected approaches that gone beyond the obvious ones — dropping all contingencies, offering the shortest close possible and bidding as high as possible. “I had a buyer [who was a personal trainer] throw in 12 free personal training sessions, which sealed the deal,” he notes. occasion, he suggested to a buyer to offer time for the seller to find a new home. They closed within 30 days, and then allowed the seller to stay in the house for an additional 90 days. The seller had the funds from the sale and time to make a proper decision. “This made for a happy buyer and a happy seller,” he says. Marcia Cotlar, a realtor in Boulder, Colorado, points out that selling a home is an emotional decision for a homeowner. A seller may be more motivated by knowing that his or her home is going to a family that will love it and take care of it. Many realtors recommend that buyers write a personal letter when they know they will be competing against multiple offers. Cotlar suggest that buyers include a family photo. “If the buyer’s letter references that it is a great home with the right layout for their family, or that they want to stay within a certain school district, the family photo will resonate with the sellers,” she says. John Underwood, a real estate agent in Los Angeles with a national real estate brokerage, says a personal letter to October 24, 2014
the seller helps the two parties connect emotionally. “It sounds hokey, but you’d be amazed at how often they work,” he adds. Sure there are times a seller will trash the letter before selecting the offer with the highest price. Other times, sellers and buyers will bond over a shared sentimental value. Not only can it save a buyer literally tens of thousands of dollars, Underwood adds, it also gives all parties a good feeling as they approach closing.
UNDERWOOD OFFERS A FEW OTHER TIPS: Use a reputable local agent A real estate professional with a solid reputation and contacts in the community can do a lot for a buyer. The credibility he or she brings to the table is invaluable in a competitive situation. Underwood even had a seller select an FHA buyer with a lower down payment because his strong relationship with the buyer’s agent brought a level of trust and confidence the deal would close on time.
Ask for inside information A buyer’s agent should contact the listing agent to understand the client’s motivation. This offers flexibility on part of the buyer and accommodates the seller’s needs, such more time to remain in the property at the close of escrow.

Record-low interest rates and record-low housing prices are renewing interest in the floundering housing market for many people. “When sellers are interviewing real estate agents to market their homes, their primary focus is usually on the advertising that the agent will offer them,” says Jessica Goodbody of Weichert Realtors.
