TENANT IMPROVEMENT WHAT IS IT AND WHO PAYS? In a Landlord/Entrepreneur and Tenant/ Entrepreneur relationship this can be a big part of the negotiation and the long-term future of the space. Tenant improvements generally refers to improvements or changes the new tenant plans to make to the space. Many types of changes can alter the space permanently. Take for example, a tenant who wants to convert retail space to a restaurant. Typically, this is a very extensive improvement due to revamping plumbing, electrical and HVAC. Discussion about who pays for what is incredibly important here prior to signing the lease. Most infrastructure improvements will be left behind when the tenant vacates. Landlord/Entrepreneurs should consider: · If the space is permanently changed, will it fit into my future plans for the space? · If it does, who is going to pay for it? · If the tenant leaves what can they take with them? · How does the space function after they remove what they are entitled to? Tenant/Entrepreneurs should consider: · If plans entail a major infrastructure project, will the Landlord/Entrepreneur participate in some form? (cash, free rent period, loan paid back over the course of the lease…) · Is the lease clear about what stays and goes when you leave? · Does your budget and proforma support the improvements you will have to make?
